So, with 14, we are good. The eyes will pursue the asphalt. But it's 557. So I suppose should we wait another couple of months? Yes, exactly. Let's open it to the head. So, folks, a few more minutes. All I know is, Dennis is not wearing one of the jackets. I know it. I know it. I'm so kind of public buildings. What is shame on him? I'll define that.
[0:29]
Yeah,
[0:32]
I
[0:42]
think they're on mute again. Yes, I think so too. There we are. We are. We're just
[0:48]
wait the other two minutes until six o'clock. Sure. Then we can get started. We do have a coin.
[0:55]
Okay, good. I'll come Dennis doesn't have the jacket. No, they can't.
[1:01]
I just want mine for music for ourselves. How's the press going to get them? And then they weren't
[1:06]
got the wrong okay so they were jealous I see how it is 2799 plus three dollars for the
[1:17]
logo you can get it from the universe oh we were just saying that the school building
[1:24]
committee should have one too and we all walk in uniform you know okay so for 2799 plus three dollars
[1:31]
from a long ago. Not bad. Yeah. You might as well get one of the town hall building committee.
[1:38]
That's a percentage building committee. The permanent building committee. Oh, that way I can
[1:42]
take my jacket off. This committee, you know, the jacket they want up though.
[1:52]
We need 90 minutes to discuss the logo.
[1:56]
You're so right.
[2:01]
I got it.
[2:03]
So right.
[2:05]
I'm looking like a person that contains a thumb in.
[2:08]
I'm saying.
[2:09]
Ty, but it's just happening.
[2:10]
The smile figure every time he comes to me.
[2:14]
Do you have any more select for me?
[2:16]
Left or the other?
[2:17]
I think there's one.
[2:18]
One for me.
[2:19]
You may have any other make.
[2:21]
My screen is going strong.
[2:23]
I'm taking this one.
[2:24]
My wife wanted to leave it there.
[2:26]
I'm doing one of the things.
[2:26]
Can you remember?
[2:28]
And then it's first anniversary.
[2:29]
I changed the meeting.
[2:49]
All right, folks, seeing that it is 6 o'clock and that we have a quorum, buying both of those
[2:55]
that are joining virtually this evening as well as in person, I'd like to call to order
[2:58]
the well-eschooled building committee on this evening of April 3, 2025. As always, if we can
[3:04]
begin with a roll call please, Vivian. Absolutely. Thank you. Diane Allen. Here. Greg Bindell. Here.
[3:14]
Kate Bissell. Kate is a doctor. Yeah, Dr. Brand. Here. Kevin Kyra. Yeah. Michael Camosio. Here.
[3:27]
Justin Kushe, Mary Ann Glezzo, Nicholas Golden, Christine Hawler,
[3:42]
John Holloway, Dennis
[3:46]
Kelly, Paul Melorani, Craig Meiner, Christine Murray,
[3:57]
Judy O'Connell, Christine
[4:00]
Jim Pentergast, David Ragsdale, Paul Ruggiero, Stacey Scott, Eric Schlagel, Steven Turner,
[4:16]
and myself.
[4:17]
Yes.
[4:18]
Thank you, everyone.
[4:20]
Thanks, Vivian.
[4:21]
Item number two.
[4:22]
No minutes to approve tonight, but item number two will go away to the purpose of this meeting
[4:27]
is discussion of consultant contracts for the project and with that I'll turn over to Eric.
[4:33]
Thank you. I appreciate everyone for meeting on what is relatively short notice.
[4:39]
Given the stage we are on the project, I did want to sit down and meet with the committee
[4:46]
regarding our consultant contracts.
[4:50]
So the first one that we have up is the OPM contract.
[4:54]
As folks are aware, just to folks who are watching this at home, the way that MSBA structures their designer and opium contracts for MSBA projects is.
[5:08]
You sign up with an opium and designer and their contract runs through the end of schematic design.
[5:14]
That is on purpose.
[5:15]
So both SNMAs contract and door witness contract will expire at the end of the schematics
[5:23]
design phase.
[5:28]
For purposes of the OPM contract, I did want to let the committee know that after multiple
[5:35]
meetings and leadership team, an in-person meeting with SMMA, SMMA's leadership and
[5:48]
numbers of our leadership, conversations with various members of the committee, and conversations
[5:58]
with legal counsel, conversations with MSBA, and that's been determined that we're not
[6:03]
going to be moving forward with SMAVA into the construction phase.
[6:12]
That's something I wanted folks to be aware of.
[6:18]
Importantly, in my conversation with the MSBA, they are not concerned about this.
[6:23]
There's a reason why they structure their contracts, such that they don't just start
[6:28]
go from start to finish. And so that the the the Miss colleagues could make a
[6:34]
determination as to whether or not there's an appropriate fit between the consultants and the town.
[6:41]
We had I had very long conversations with our
[6:52]
We had meetings expressing some of our concerns about moving forward, and at the end of the day, rather than exercise our option, which we had an option to make a change in key personnel at the town's discretion, rather than do that.
[7:13]
SMA indicated that they would just agree to and would leave our ways and we would move on with the process of getting another OPM.
[7:28]
My conversations with MSBA, they provided an outline as to how that process would work.
[7:37]
We're basically going to be re-duing the OPM selection process from module two.
[7:45]
So what that means is we have to submit them a request for services.
[7:51]
Robin McLeaney, who we've worked with at MSBA, provided us a calendar to see the quickest way to get an OPM back on board with the town.
[8:04]
And so that means we have to get their request for services to the MSBA for their review by April 17th.
[8:11]
We would put an advertisement in the central register by May 1st.
[8:15]
The advertisement would appear in such a register by May 7th.
[8:19]
And then we'd have two weeks of steps for a minimum two weeks to have applications due, which should have them back on May 21st.
[8:27]
And then we would have a selection package to the MSBA by June 11th.
[8:35]
We couldn't hire an OPM until they approve it at their July 7th OPM meeting.
[8:41]
So they have a meeting where they have to, they have to review our process and our choice
[8:46]
and they have to give their stamp to it.
[8:49]
But if we went through that process, it means in early July, we would be able to execute
[8:54]
a contract with an OPM.
[8:55]
Yeah. In my conversations with SMA and with MSBI, they indicated that they feel like the
[9:03]
phase, the schematic design phase ends, not at the submission on May 1st, but at the June
[9:13]
25th MSBI hearing. So, Julie will be on board until that hearing.
[9:24]
and then within a couple of weeks after that we should have another OPM that would be stepping
[9:30]
on board to make us through the remainder of the contract and construction.
[9:36]
What was the July date? The OPM panel is July 7.
[9:44]
July 7. What was the contract signed with
[9:49]
at the end of the semester, and we had, there was an April date in there, but that was based
[9:59]
on before we had extended, when we, when we extended the dates back in late, when we extended
[10:07]
talks over, we moved from the April meeting to the June meeting. And so it wasn't clear to me whether
[10:14]
the contract meant that they were going through April or going through June, but MSPA indicated
[10:19]
that the contracts that their contracts are through phase and it's not through specific dates.
[10:27]
So that was a question and I put it to them and that was their answer.
[10:33]
I have just been in full transparency.
[10:37]
I spoke into a durian word about this multiple times.
[10:40]
Lee and I had probably three or four conversations about this.
[10:43]
So he's aware that this is happening and is, you know,
[10:47]
understands the town's position and it's fully prepared to kind of move forward.
[10:52]
I spoke to Fontaine about it, David Fontaine, Jr. about it, made them aware of the town's position
[10:59]
and he's fully prepared to move forward. In full transparency, one of the reasons why I was in favor of
[11:07]
the construction manager at risk method of procurement was in the event that we made the town made this
[11:15]
choice we still have to really great consultants on board to help us through to the vote phase.
[11:27]
When SMA offered to take $35,000 out of their contract that was earmarked for their third party
[11:39]
basically costs an estimator and put it towards a sea of unrest. In my
[11:45]
mind the length, that means we have the people who prepared our budget and did
[11:49]
the estimating are fontane endured with here. And so those are the folks that
[11:53]
we're doing in Kenya with after this process. So this was this was not a this was not a
[12:06]
goes to know that it's a choice that has been made so we're going to be moving forward.
[12:14]
Interestingly enough, that OPM will be down by the budget that we've already put forward in the 30-11 form.
[12:23]
So we've already set up a budget for that OPM. They won't be negotiating.
[12:26]
I mean, they may be offering less, but they won't be, you know, they'll be bound to
[12:31]
that budget.
[12:32]
We're not going to hire an LPM for more than we've, we've put it with 30, 11, 20.
[12:36]
And my understanding is that OPMs all understand this.
[12:40]
It happens, not frequently, but on an occasion, and, and there's, you know, I know that there's
[12:48]
multiple OPM firms that are looking forward to bidding on this, when, when it actually
[12:53]
I put it up.
[12:56]
So that means that I wanted to open it up to see if anybody in the committee had any
[13:00]
questions about that process or how we're going to be moving forward with respect to
[13:06]
the OPM.
[13:10]
Just clarify the date that you're going to go out for RFQ for their services.
[13:16]
We're putting, so the ad is going to appear in the central register on May 7.
[13:20]
May 7.
[13:21]
Okay.
[13:22]
Thank you.
[13:22]
And for those of you who have worked with Tommy down here in our office,
[13:27]
I mean, I talked about this. He's on board. We have the procurement package that we've put out before. So we're not going to be repreating the wheel. It should be relatively shameful or to have these packages done.
[13:38]
And I started working on the repressor services tomorrow for the 17 deadline.
[13:48]
Is there any other questions from folks that are virtually joining us this evening?
[13:57]
Does not appear to.
[14:04]
Okay.
[14:05]
The second contract is with regards to Jordan Whittier.
[14:13]
Their contract also only goes through schematics design.
[14:19]
I'm fully prepared to execute an amendment with them that continues them through the construction phase, assuming funding happens.
[14:30]
From my perspective, I'd be interested to hear what other people think.
[14:34]
I've been impressed at their flexibility to kind of hear what the town is saying and kind of move their design thoughts
[14:45]
that's closer to our vision instead of being kind of stuck with their own vision, and
[14:52]
And I think there's, you know, they've did a good job with high school and, and, um,
[15:00]
Sorry, I wouldn't have any concerns about going forward with that.
[15:08]
Any else have any thoughts or
[15:10]
feelings about that? I agree, again, thank you all for what you've done. May I ask you out for the time?
[15:18]
Nick, I see your hand raised. Thank you, thank you, Dr. Brandt. Yeah, I just say anecdotally,
[15:25]
I was very impressed with how they handled the butter's meeting. I thought that Lee,
[15:30]
When he jumped up on stage, kind of walk people right through everything, I really
[15:34]
appreciated his like directness in that. I think sticking with them is a good
[15:39]
course of action.
[15:42]
Thanks, Lee.
[15:44]
Anyone else comments? Questions? I would just add that
[15:48]
I've been really impressed. I think others were running. I think she does a great
[15:51]
job. She presents. She's always very thorough. She does a great job of
[15:55]
interviewing questions in the past. I just think her and Lee, but I just want to
[15:59]
about the appropriate else and what I've really been
[16:00]
impressed with, I'm going to agree.
[16:03]
One of the things that happens, that the community doesn't
[16:06]
get a chance to see, but that happens
[16:09]
behind the scenes is the specifically
[16:12]
around the educational program planning,
[16:14]
a huge part of that, and not so much necessarily,
[16:17]
certainly has been presented and discussed
[16:19]
through the building committee, but there
[16:22]
have been a awful lot of exchanges of information
[16:26]
and co-planning with them, and they've
[16:27]
then terrific through that process, very responsive.
[16:32]
That's sort of died down a little bit now
[16:34]
because the program plan has buttoned up,
[16:36]
but there's still an awful lot of communication
[16:38]
that happens outside of the meetings with Dorn Whittier,
[16:41]
trying to put together the pieces that we need to
[16:44]
from the educational standpoint,
[16:45]
and they've been, you know, they're just,
[16:47]
they're solid partners, what you see in the public here,
[16:50]
what happens behind the scenes,
[16:52]
and they've been great to work with in those capacity.
[17:01]
I think that same thing adapted to everything we've asked and I think that's a great idea.
[17:06]
It's a great impact.
[17:07]
So I'm pretty happy with it.
[17:08]
Working with them on the high school,
[17:10]
built all that process,
[17:11]
some plays in the background,
[17:13]
so I thought they were great to deal with the school construction.
[17:19]
So can I just ask to clarify,
[17:21]
for this particular part of the agenda tonight,
[17:23]
is there any action that the committee needs to take,
[17:26]
relative to either the first or the second meeting?
[17:29]
No.
[17:29]
I mean, I think we'll be voting on on an extension to the contract for
[17:36]
Dornwood year, probably later on in the summer, once we actually, there's going to have
[17:40]
spoken in negotiation, but nothing, nothing, nothing tonight, not from purposes of
[17:45]
those two, those are more updates and making sure that we're on the same page.
[17:52]
I just wanted to say that I think it should be restated, you know, it'd be us repeating that
[17:58]
You took a very methodical approach coming in as a new manager and working alongside the organization to see how things were going.
[18:06]
Didn't rush any decisions. We got through to this point collectively as a committee.
[18:12]
We've reached the major milestone through this process to get to this point.
[18:16]
I do agree with the door and with your peace while they work together. And I think we are in a very good place.
[18:22]
the meetings that I've been a part of, they've been very thoughtful, they've been very
[18:27]
detailed.
[18:28]
I think everybody collectively on all fronts work together to arrive at the conclusions
[18:33]
that you're articulating tonight, ultimately it's a committee input, but you know you are
[18:38]
the time manager and are executing decisions and showing leadership in a big way and I think
[18:43]
that should be noted.
[18:45]
You know, Doran Whittier has worked very well with Fontaine and I believe that relationship
[18:49]
is off to a great start.
[18:51]
So I think it should also be conveyed that MSBA did not see any issues with this change
[18:57]
and felt that this would not be disruptive or problematic or impede the success of this project.
[19:04]
So I think that's a real important point to what I dare to the people on this committee
[19:10]
and to the public that this is not going to have a detrimental effect on this project
[19:15]
and meeting the future milestone dates that we have before us.
[19:18]
In fact, if you know MSBA said this is the time to do it set up this way so you know if
[19:25]
we need to change consultants, the funding module 5 which is what we are going to go
[19:33]
with 2 after June doesn't have any deliverables from the OPM to MSBA so it's all going to
[19:39]
be and if we're only going to be because weeks in the module 5 by the time we'll be able
[19:46]
get in front of a panel and I'll play a lot of the group wherever we decide to go forward.
[19:52]
Day and I see your hands raised?
[19:55]
Yes, I just wanted to occur what most of the people is saying tonight.
[20:01]
I also felt that Durham would do a very very good job and I'm pleased with their performance so far
[20:09]
and I think Granny, what Greg said, she does a terrific job at the meeting, very, very knowledgeable.
[20:18]
And I'm sure there's a lot that goes on with you and them in questioning and everything
[20:26]
that there's a lot of phone calls going back and forth.
[20:29]
So I totally support staying on with Durham Whittier for the next phase.
[20:34]
Thank you.
[20:36]
Thanks, Diane.
[20:39]
Should just one more historical foot, no correct me from wrong, but I think we've done this in the past. I think it was actually a Gentile project.
[20:45]
We've changed contracts in the middle and actually obviously checked out to be a wonderful project.
[20:51]
So this does happen.
[20:53]
That is true.
[20:54]
That is true.
[20:57]
Thank you.
[20:58]
Okay.
[20:59]
So you have a meeting?
[21:01]
Yeah.
[21:01]
First.
[21:03]
Uh, in 3D chip, is the question.
[21:06]
If we're voting to establish a new OPM review committee, shouldn't we vote not to extend the contract.
[21:14]
Of the old OPM.
[21:16]
That there's no need to.
[21:17]
Yeah.
[21:18]
The contract we have to vote to extend it.
[21:21]
So the contract expires on its own without an extension.
[21:24]
So.
[21:26]
Thanks.
[21:26]
Thanks.
[21:29]
So then if there is anything further that brings us to item number three on the agenda tonight vote to establish an owner's project manager review committee.
[21:40]
Yes.
[21:41]
So, you know, similar to the.
[21:45]
The same.
[21:47]
Address committee that we did a couple of months ago into the.
[21:51]
both the designer architect committee and the opium committee.
[21:56]
But this committee has already done.
[21:58]
We have to establish an opium review committee.
[22:03]
I've asked some folks if they'd be willing to do it
[22:06]
because I know it's a little bit of time commitment.
[22:09]
And so I know that there's going to be a window from May 21st
[22:18]
When we get the applications in and then we have to have a selection package has to be received by the MSBA by June 11. So we're talking about.
[22:31]
You know, three weeks and during that three weeks, we have to shortlist interview and have a meeting.
[22:39]
selecting a person. So it's not going to be a long committee, but it's going to be a probably
[22:45]
a pretty intense committee because you're going to have to, you know, there's got a lot's
[22:48]
going to have to do three weeks.
[22:55]
So I would,
[22:59]
so just in, in, in, in, in full disclosure, there's some people I think would make sense to be on this committee.
[23:09]
One of them is Dennis because Dennis is going to have to be in this person's back pocket for three years and so I've asked Dennis and he is this committee as well and he's willing to be on the government committee.
[23:25]
I talked to Paul.
[23:27]
Paul indicated that he would be willing to do it. Paul's on this the permanent building committee and it's worked through multiple buildings with the town.
[23:37]
and I think that's a great, you know,
[23:39]
a person to be on it.
[23:40]
I ask, I ask Glenn to ask,
[23:44]
that's Paul Rosario, whether or not he'd be,
[23:46]
be willing to be a school representative.
[23:48]
I know that Paul's, I tried to,
[23:55]
sorry, sorry.
[23:56]
But I think everybody knows Paul's experience
[23:59]
and I think he's done this a bunch of times.
[24:01]
So I think that's truly great.
[24:04]
Great. And I would ask Judy to be on the committee since she's going to be the chair. I'm going to have to work with this OPM.
[24:12]
You know, pretty close for the next few years as well. So I was looking for one other person.
[24:21]
I had no chance to ask anyone else if they wanted to do it.
[24:24]
And so, I mean, there's, there's, there's, there are folks here if there's another person who wanted to, who felt like they had the time during that three weeks together.
[24:36]
Lean into it. Diane's got her hand up.
[24:40]
I haven't gone through it with the town hall and the senior center.
[24:50]
I would be happy. I'll be home on the, you know, May and I'll be back May and you're not going to go out to May 7th and they're doing on the 21st.
[25:02]
If there's no one else unless someone else, you know, would like to go in place, but I'd be willing to be a part of it.
[25:16]
So I would make a motion that the committee appoint a OPM review committee of Paul Raleigh,
[25:23]
Paul Algerio, a Judy O'Connell, Dennis Kelly, and Diane Allen.
[25:28]
Second.
[25:29]
Second.
[25:31]
Motion second.
[25:32]
Any further discussion?
[25:33]
One thing.
[25:34]
So I have this one day that I can't do it.
[25:36]
So we'll be able to work around one day.
[25:39]
I would.
[25:40]
I would.
[25:41]
So just being twice as early as the next day, I mean, I think we would compare calendars
[25:48]
on your own same commonality. Yeah. Yeah. Yeah. So motion and a second further discussion,
[25:55]
peer so. So then with that, we will need a roll call Vivian. Are you still with us?
[26:02]
Of course. Thank you. Diane Allen. Yes. Greg Bendel.
[26:11]
Yes. Dr. Brand. Yes. Kevin Kyra. Yes. Michael Camosio. Yes. Mary Ann Glezzo. Yes. Nick Golden. Yes.
[26:30]
Dennis Kelly. Yes. You're voting for yourself. Yes. Paul Mellorani. Yes.
[26:37]
Craig Meiner, you made the motion, so thank you, Judy O'Connell. Yes.
[26:47]
Paul Ruggiero. Yes.
[26:50]
Eric Schlagel. Yes. And myself, yes. Great. Well, it definitely passes. I don't remember
[26:59]
four unless there's anything further that you need on that. Any other news? I apologize. I
[27:04]
Apologize. I was able to write down that Craig minor made the motion. I didn't catch who made the second.
[27:11]
So I actually made the motion to be in here.
[27:14]
Okay. So perfect. And he seconded.
[27:17]
Thank you. Great. Great. Great. Great.
[27:20]
Secondary. Yes. Yes.
[27:22]
Great. Great. Great. Great. Great. That was the second.
[27:24]
Thank you so much. I just want to make sure I got it correctly.
[27:27]
Thanks, Vivian. Any other new items or discussion tonight, Judy?
[27:31]
This one to share that the water bill in service completed at Shawshane, so it's ready for pick up the turned it around literally in less than 48 hours. So we will absolutely need that deadline. And they came on great. So they go again when I have to deliver them to the tax office by April 17.
[27:51]
So it'll be probably the following week that they'll actually go.
[27:55]
Fantastic. Great. Thank you.
[27:56]
Thank you so much for that, Judy. Thank you.

Thank you to Michael Promosio for really forging that relationship with Shashi.

And it's really a credit to him and everyone else that put that together.
[28:13]
I know that just on a somewhat similar note, I know Michael's reached out to already thinking about the July 4th time period when the promotional or informational items can be for that.
[28:24]
So to be continued on that, but thank you for raising that might go that we have to start thinking about that soon. So anything other than that, thank you Judy, anything else further this evening.
[28:38]
Okay, well, thank you again for everyone for squeezing yet I know another meeting into a very busy time to appreciate it.
