[1:05]
a minor amendment to the agenda before

you get started. We'd like to introduce
[1:08]
McGomery County Juvenile Court Judge
[1:10]
Nick Sane to the podium.

» Good evening. Uh thank you for the
[1:23]
opportunity to introduce myself to you.
[1:26]
My name is uh I'm Judge Nicholas Sane,
[1:28]
Montgomery County Juvenile Court Judge.
[1:30]
And I've uh this is one of my stops uh
[1:33]
that I've been making across McGomery
[1:35]
County, introducing myself to councils
[1:38]
and boards uh boards of education uh
[1:41]
since I am recently uh to juvenile
[1:43]
court. Uh little bit of background about
[1:46]
myself. I graduated from the University
[1:48]
of Dayton with my engineering degree
[1:50]
before I went off to law school. After I
[1:52]
came back from law school, I was a
[1:54]
McGomery County prosecutor here doing
[1:56]
criminal trial work. And then for the
[1:58]
last 23 years, uh I've been a domestic
[2:01]
relations court magistrate uh making
[2:03]
important decisions for the families and
[2:05]
children of McGomery County. Now that
[2:08]
I'm in juvenile court, um I'm here
[2:10]
because there are many partners and
[2:12]
stakeholders in juvenile justice issues.
[2:14]
uh your police department, your schools,
[2:17]
um and obviously this board and the
[2:19]
citizens that you represent. I I'm here
[2:22]
because I want to listen. I want to hear
[2:24]
people's concerns about juvenile justice
[2:26]
issues. Uh I'm bringing fresh eyes to
[2:29]
juvenile court. I want to hear about
[2:32]
what the court is doing well and if the
[2:34]
court uh needs improvement, I want to
[2:36]
hear about that, too. Um hopefully
[2:39]
having introduced myself uh we can have
[2:42]
communications about shared uh juvenile
[2:44]
justice concerns and then we can enhance
[2:47]
our cooperation and make progress on
[2:50]
those issues that are important to you.
[2:52]
U this is obviously my first uh
[2:54]
appearance before you but I certainly
[2:56]
hope that it won't be my last and I look
[2:59]
forward to future communications and
[3:01]
collaborations with you and other
[3:03]
members of the community. So thank you
[3:05]
for the opportunity tonight. Thank you,

judge. Thank you. The juvenile court
[3:08]
does important work and I can
[3:10]
conclusively say you're the first judge
[3:11]
we've seen here in our in my tenure at
[3:13]
least and we look forward to future
[3:15]
conversations.

Board and guests, it's an honor and a
[3:32]
privilege to uh bring up Julie Feebig.
[3:34]
So, I'm going to have you make your way
[3:35]
up. It's a short way. I know cuz you're
[3:36]
right here. But um so [clears throat]
[3:38]
we're we're here to honor um and to
[3:41]
swear in Julie Feebig. Julie's been with
[3:43]
the township and serving the PD since
[3:46]
two since 2007. Um she's she's been a
[3:49]
very big part of the police department
[3:51]
family. She's been a coach. She's been a
[3:53]
mentor. She's been leading teams. She's
[3:56]
she was just uh she just finished up a
[3:58]
10-year mark as a sergeant. So um we're
[4:01]
happy to move to uh move her up through
[4:03]
the ranks again. And um I think by by uh
[4:07]
the by by the looks of the room and how
[4:10]
how full the room is, the standing room
[4:13]
uh only in the back, I think it's a
[4:14]
testament to who she is as a person
[4:16]
because we could talk about um what
[4:18]
she's done with the shop uh with the
[4:20]
shop with the hero program with the
[4:23]
field training program. We could talk
[4:24]
about lines on her resume and things
[4:26]
like that which um are very are very
[4:28]
important because we want to we want to
[4:31]
talk about competency and we want our
[4:32]
leaders which she is to have a lot of
[4:35]
competency but what sets her apart and
[4:38]
why we're here is because of her
[4:39]
character. Um she's a great person.
[4:42]
She's a great leader recently. She's
[4:44]
she's a
[4:46]
grandma and so we're just very happy to
[4:48]
have her here and to have all of her
[4:49]
family here to have her friends here. um
[4:52]
some of the folks that she's uh worked
[4:53]
with in the past are here as well. I
[4:56]
think I think that's a testament to her
[4:58]
again because if you worked with her and
[5:00]
you were a training officer of hers
[5:02]
almost 20 years ago, um it speaks volume
[5:05]
to who she is. So, um I'm going to have
[5:08]
Julie have your family come up and help
[5:09]
us with the swearing in. Mr. Clingerman
[5:12]
as well, too. There he is. Everybody's
[5:14]
sneaking around on me tonight. So,
[5:28]

long uh standing practice and it's

actually in uh both of the union

contracts that when one of our sworn
[9:12]
folks uh finally retires that they can
[9:14]
purchase their uh uh used uh duty
[9:17]
weapon. And that's what I have before
[9:19]
you tonight. Scott Scott Miller worked
[9:22]
with the department for uh just under 20
[9:24]
years and he has uh finally retired. So,
[9:27]
we're going to sell him his gun. So, um,
[9:30]
fairly straightforward there, but I'd be
[9:31]
happy to I'd be happy to answer any
[9:33]
questions you may have about that one.

» Yes. Good evening, board. Uh, first
[9:42]
resolution for you as a uh, new
[9:45]
housekeeping item uh, we are required to
[9:47]
do per the McGomery County Auditor's
[9:48]
Office. Uh, each year we need to
[9:51]
reassess
[9:52]
uh, all of our uh, nuisance abatement
[9:55]
costs back onto individual properties
[9:57]
tax roles. uh provided a chart each
[10:00]
individual parcel, the tax year, and
[10:02]
then the amount being assessed. So
[10:03]
again, we'll be doing this each year u
[10:06]
to send this to county auditor's office
[10:07]
and place it on a tax lean for our
[10:09]
nuisance properties. Do you have any
[10:11]

» Great. Uh the next two resolutions are
[10:17]
related to nuisance properties and uh
[10:20]
the Miami Township Ciakqua neighborhood
[10:22]
uh 6055 South Fifth Avenue and 6046th
[10:27]
Avenue. Uh these are two homes that we
[10:29]
have had on our radar for a little
[10:31]
while. Uh one of them was a housefire
[10:33]
property and the other is one that has
[10:35]
just been abandoned uh and left to uh
[10:38]
deteriorate over the years. Working with
[10:41]
Montgomery County Land Bank, we are
[10:44]
trying to find supportive funds to help
[10:46]
potentially demolish these homes. But
[10:48]
the first step in that is to declare
[10:49]
them a nuisance. Uh once a nuisance is
[10:52]
declared, the property owner will be
[10:53]
given uh notice that they have 30 days
[10:56]
to request a public hearing uh which
[10:58]
they can try to defend that it is not a
[11:00]
nuisance. In this case, they've both
[11:02]
been declared nuisances by the Miami
[11:04]
Valley Fire District. Uh neither have
[11:07]
had utilities running for multiple years
[11:09]
at this point, sort of open to the
[11:11]
elements. Uh so certainly we uh give
[11:14]
them the opportunity for a public
[11:15]
hearing but uh if they do not request a
[11:18]
public hearing then we can take the next
[11:20]
abatement action steps. One of those
[11:22]
would be potentially contracting with
[11:23]
the land bank for demolition of these
[11:25]
homes. Uh we've had really good success
[11:27]
with the land bank uh in the past. Uh
[11:30]
the one item that we would uh very
[11:32]
carefully consider is as part of the
[11:34]
land bank uh program after three years
[11:37]
uh post demolition if the land does not
[11:40]
sell it would revert back to Miami
[11:41]
Township we then could take next steps
[11:44]
to either auction it or do other things
[11:45]
but it is something we potentially have
[11:47]
to deal with. So uh again this is the
[11:50]
first step to take the nuisance uh
[11:52]
action declare them a nuisance and then
[11:54]
we can work to determine next steps from
[11:56]
there. Uh do you have any questions on

108 is an appropriation amendment uh
[12:08]
primarily for higher than expected
[12:10]
medical and and property insurance uh
[12:13]
premiums for the 2627 policy year. Um
[12:17]
fuel costs are up for the police
[12:19]
department and so we've projected for
[12:21]
the to get them through the end of the
[12:22]
year as well as some access security at
[12:25]
both the police department, the
[12:26]
administration building and in public
[12:28]
works out on Wood Road
[12:41]

evening. My name is Tim Gaffne. I live
[13:08]
at 1187 Mary Lane West in Miamiisburg.
[13:12]
My wife Gan and I have lived in
[13:14]
Miamiisburg for nearly 50 years. We have
[13:16]
four children and a grandson who went
[13:19]
through the Miamiisburg school system.
[13:21]
Now Jean, my wife, chairs a citizens
[13:24]
group that is supporting the upcoming
[13:26]
Miamiisburg tax levy.
[13:30]
[clears throat]
[13:31]
She is speaking tonight at Miamiisburg
[13:33]
City Council. So I'm here to speak on
[13:35]
her behalf. I'm here because
[13:38]
[clears throat] the school district
[13:39]
includes the township as well as the
[13:41]
city and the new tax levy will affect
[13:43]
citizens across the district. This will
[13:46]
be an income tax levy, but unlike city
[13:49]
income tax, this one will apply to every
[13:52]
taxpayer in the school district,
[13:54]
including the township. The legal name
[13:56]
of our group is citizens for quality
[13:59]
education. We are essentially a
[14:01]
continuation of the same committee that
[14:04]
supported previous levies. Our slogan is
[14:08]
save schools and our website is
[14:13]
savebergschools.org.
[14:15]
We are independent of the school
[14:17]
district.
[14:19]
I know many citizens have questions
[14:21]
about why another tax levy is necessary.
[14:24]
We've been asking questions ourselves at
[14:27]
the district's state of the schools
[14:28]
informational meetings. These meetings
[14:31]
are open to the public and attended by
[14:33]
the superintendent, treasurer, and other
[14:36]
school officials. I encourage all
[14:39]
citizens to attend at least one meeting
[14:42]
and ask questions.
[14:44]
Five more information meetings are
[14:46]
scheduled.
[14:47]
Three are in the morning. Thursday,
[14:50]
September 3rd, Jane Chance Intermediate
[14:53]
School at 9:30 a.m. Wednesday, September
[14:57]
9th, at the Memorial Building at 10:00
[15:00]
a.m. Wednesday, September 30th, Mound
[15:04]
Intermediate at 9:30 a.m. Two meetings
[15:08]
will be in the evening. Thursday,
[15:10]
October 8th at the Memorial Building at
[15:13]
6 PM and Wednesday, October 28th at the
[15:17]
Memorial Building at 6 PM. And I have a
[15:20]
few cards I'll leave with you that have
[15:22]
these dates and times on them.

These meetings are a chance to bring
[15:27]
your questions to the people who can
[15:28]
answer them. More information is

There are a lot of financial details
[15:43]
behind the need for a levy. But here are
[15:46]
five talking points that I use to
[15:48]
explain to people why it's important.
[15:52]
One, the levy is an income tax levy, not
[15:54]
a property tax levy. It does not tax
[15:57]
social security income. Two, the school
[16:01]
district has tightened its belt. It's
[16:04]
cut 3.6 6 million during this school
[16:07]
year already.
[16:09]
Three, the levy is for a half percent,
[16:12]
which is lower than other current school
[16:15]
income tax levies in our area. Four,
[16:19]
state funding for schools is at the same
[16:21]
level as in 2019, while inflation has
[16:25]
climbed 31% in the same time period.
[16:29]
And yet five, the school district has
[16:32]
not asked for new money since 2010.
[16:35]
That's 16 years ago. Most school
[16:38]
districts ask every three to five years.
[16:42]
Of the 600 school districts in Ohio, 210
[16:46]
have passed income tax levies. Now about
[16:49]
our campaign committee. We have people
[16:52]
working on marketing, communications,
[16:54]
and fundraising, but we need help from
[16:56]
as many community groups and individuals
[16:58]
as possible. We will have a lovey
[17:01]
campaign committee meeting open to
[17:03]
anyone interested in volunteering or
[17:05]
just learning more on Thursday,
[17:08]
September 10th at 6:30 p.m. at the Miami
[17:12]
Branch Library.

Legal requirements for this case have
[20:15]
been met. I do have a report as well as
[20:17]
a recommendation from the township
[20:19]
zoning commission. Uh tonight's final
[20:21]
development plan case is for a new seven
[20:24]
brew coffee restaurant within the Austin
[20:27]
Crossing development ZC52-22.
[20:32]
Uh the seven Brew is specifically
[20:34]
located in the sort of southwest portion
[20:36]
of the Austin Crossing development. Uh
[20:39]
you can see sort of where the uh new
[20:42]
road merges into where the existing
[20:44]
Spring Pike frontage road is uh directly
[20:46]
between uh the Austin Crossing apartment
[20:48]
building and state route 741.
[20:52]
Uh
[20:54]
uh in general the applicant worked very
[20:56]
well with our staff to ensure that all
[20:58]
the standards of both township zoning
[21:00]
resolution and specific Austin crossing
[21:01]
plan development standards were met. uh
[21:03]
we went through a couple iterations of
[21:04]
the plan uh and came up with a a very
[21:07]
creative solution to what is a very sort
[21:10]
of practically difficult site. I'll flip
[21:12]
through here a second so you can take a
[21:13]
look at uh
[21:15]
uh it's one of the site as the road sort
[21:17]
of narrows down. Um so it is sort of a
[21:19]
spatially limited site. Um so something
[21:21]
small like a sevenrew uh certainly was a
[21:24]
a creative solution to uh take most
[21:27]
advantage of the land as we could and
[21:28]
create a development that brings a lot
[21:30]
of new amenities to the area. um where
[21:33]
some of them do not exist. So,
[21:38]
my clicker is slow today.
[21:41]
I'll stay on this for now. So, the site
[21:43]
plan, as you can see here, uh these
[21:45]
seven brews have a very small footprint.
[21:47]
I'm sure you've uh seen them around the
[21:49]
community as they're uh certainly
[21:51]
expanding as a business, but uh we're
[21:53]
under 800 square feet uh total. 510 for
[21:57]
the primary building, about another 280
[21:59]
for the cooler itself. Uh as you can see
[22:02]
uh the drive-thru parking lot uh takes
[22:04]
up sort of the majority of this site. Uh
[22:07]
the primary flow of traffic will be one
[22:10]
direction. It'll enter on the north
[22:12]
drive, flow to the south where it is a
[22:15]
single direction exit point. There is a
[22:18]
uh exit as well to the north but that is
[22:21]
predominantly going to be for employees
[22:22]
who are uh coming and going. There's not
[22:24]
a walk up window or uh you know other uh
[22:27]
sitdown area. So that is primarily for
[22:30]
employees and the majority of traffic
[22:32]
will be exiting from the south not uh
[22:34]
two-way in the north although there will
[22:35]
be some
[22:39]
uh as I'm sure you recall from uh some
[22:41]
of the previous final development plans
[22:42]
within Austin Crossing but also just
[22:44]
looking at the site uh there is
[22:45]
significant grading on the site so there
[22:47]
are retaining walls uh throughout the
[22:49]
site as it sort of platforms up um I
[22:52]
think we're in general working with the
[22:53]
developer actually pretty excited about
[22:54]
this would be a unique look from 741
[22:57]
again sort of tiered development velment
[22:58]
with nice retaining walls. They've
[23:00]
picked a really nice material. Uh you
[23:02]
can see here, but uh the entire frontage
[23:04]
will be retaining wall. Chick-fil-A will
[23:06]
be sort of another tier up. The
[23:07]
development in the back will be another
[23:08]
tier up. I think it'll be a really
[23:10]
unique look from 741. But just wanted to
[23:13]
remind the board that um this is sort of
[23:15]
near 741 again on the 741 side, but
[23:18]
it'll be teared up and pushed back a
[23:20]
little bit. I think it'll look very
[23:22]
nice.
[23:24]
Uh here's the first iteration of the
[23:26]
elevations. Um, I'm not going to hang on
[23:29]
these for too long, but working with the
[23:31]
applicant, working with the developer,
[23:32]
we came up with a second set. Um, this
[23:36]
uncolored to color, but uh, there are
[23:38]
some additional details here, additional
[23:40]
glass was added. Um, parapets on the top
[23:43]
of the building to help screen some of
[23:44]
the the roof mechanicals. Uh, introduced
[23:49]
uh, some additional base treatments to
[23:51]
help create new architectural interest.
[23:54]
uh they eliminated a lot of the uh the
[23:56]
neon blue striping that is sort of
[23:58]
typical to their branding. They did
[23:59]
allow it in one spot sort of on the 741
[24:02]
side in one area to be recessed, but
[24:04]
central to the site particularly near uh
[24:07]
residences. They were able to remove
[24:09]
that. So, uh we think it'll look good.
[24:11]
Um they they brought some of their

colors down a little bit, that blue to

meet some of our earth tone materials,
[24:17]
the gray and and earth tone. So, we
[24:19]
think it turned into a very nice looking
[24:22]
facade.

Uh similarly the first iteration of
[24:26]
landscaping um we felt that they could
[24:28]
do a little bit more to bring in uh
[24:30]
landscaping particularly central to the
[24:32]
site but also frontage landscaping on
[24:34]
sout 741 particularly with that
[24:36]
retaining wall to help buffer that and
[24:38]
soften that a little bit. So here's the
[24:40]
second iteration. Uh they added a lot of
[24:43]
landscaping. Uh we are very happy with
[24:45]
the work they did to uh bring in
[24:47]
screening trees to help with any
[24:49]
potential headlights particularly
[24:50]
adjacent to Austin Commons and Austin
[24:53]
Springs Apartments. We think that'll
[24:54]
help a lot with uh breaking up any kind
[24:57]
of headlight
[24:58]
impact on those residences, but again uh
[25:01]
they worked really hard to bring in
[25:03]
creative tree choices on 741. They're
[25:05]
overhead power lines there. So these are
[25:07]
smaller growing trees so they won't have
[25:09]
to get topped uh but they'll continue to
[25:11]
grow and create a really nice wall in
[25:12]
that frontage. So, um, on top of the
[25:16]
trees, lots of shrubs, lots of, uh,
[25:17]
flowers, other things. I think it'll
[25:19]
look like a really, uh, well-designed
[25:21]
site.

Uh, lighting, the original lighting
[25:26]
plan. Um, we've tended to see, uh,
[25:30]
lighting under certain canopies that
[25:31]
have exceeded the, uh, maximum lighting
[25:34]
required under our township zoning
[25:35]
resolution, but working with SevenBrew,
[25:37]
they were able to bring that back down.
[25:38]
Uh we were really very concerned about
[25:40]
this site again directly adjacent to
[25:42]
both residences and 741. We wanted to
[25:44]
ensure that this wasn't uh just a beacon
[25:46]
of light. So they were able to pull the
[25:48]
brightness down. They've met our zoning
[25:49]
resolution. Um they've meet all of our
[25:52]
temperature standards as well. So again,
[25:54]
very happy with the work they did on the
[25:56]
lighting plan.
[25:58]
Uh so zoning commission did recommend
[26:00]
approval in a five to zero vote. Uh
[26:02]
there were two stipulations. These are
[26:04]
sort of general housekeeping items
[26:05]
across the Austin Crossing development.
[26:07]
There are a lot of uh steps in the
[26:09]
development process uh applications that
[26:11]
are hinging on other applications. So
[26:13]
these are again more housekeeping rather
[26:15]
than uh any particular fault or or
[26:18]
requirement for this development to
[26:20]
change. But uh all final approvals of
[26:22]
the seven brewer dependent upon the
[26:24]
approval of the roadway. So any trickle
[26:26]
down effects that would change would
[26:27]
have to affect this site as well. And
[26:29]
then second approved storm water letters
[26:31]
from the county engineer uh must be
[26:33]
submitted before a zoning certificate is
[26:36]
issued.
