[6:22] comments against me and my family. This was done in an attempt to damage my

[6:37] You were Well, you said you were doing this as a private citizen and not a

[6:41] member of the council. You must remember, you're always a

[6:44] member of the council.

[6:52] The problem is that you repeatedly and loudly wanted them to

[6:58] give it to anyone but me. This being the concession stand at Foot

[7:04] Park.

[7:08] All of this is recorded just as it is here because of the public meeting, and

[7:11] I urge the council, if they wish to, to look into it.

[7:17] Councilwoman Graner, you not only opened yourself up to liability,

[7:22] and the city of Middleton's liability, but you were at the time an employee of

[7:28] the Greater Middleton Parks and Recreation District,

[7:32] and left your job solely from your job at the city solely to make these

[7:44] Now, I love this city. I have donated over 40 years of my life

[7:49] doing different things for the city and volunteered

[9:54] of times before, but uh with some new members on the council,

[10:03] give a brief overview and I'll be glad to answer your questions. We have a

[10:06] contract with Knife River for mining of gravel out of some city property south

[10:12] of Mill Slough. Uh that contract has been going on for 2

[10:16] or 3 years. Uh with the royalties from that, we have

[10:20] had them construct a uh the roundabout at Sawtooth uh Road

[10:26] and Middleton Road. Uh

[10:28] with that was sort of an advance on some royalties for from that gravel mining

[10:32] contract. Uh they have mined out some gravel areas

[10:37] that that were available to them. Uh there's been a hold up on what

[10:41] additional

[10:47] » A a uh there's been some discussion about how

[10:50] much more area could be cuz there is some wetlands on that property.

[10:54] Uh they have reached out to us about about 6 months or a year ago and said

[10:58] there was only kind of a little bit of gravel left to mine out from the areas

[11:03] that are currently available to them. And uh uh wanted to do that. We also

[11:09] recognized at that time that backfill was not coming back into the site as we

[11:14] had we had both hoped a number of years ago

[11:17] when we were entering into this contract. So, uh the city

[11:21] took a look at that and said uh it would kind of might be in our best interest to

[11:25] stop mining because if they keep mining there wouldn't be anything left but a

[11:30] couple big lakes. We'd like some areas for some parking or some other more park

[11:35] amenities as that's our long-term plan for that area.

[11:39] So, we we kind of discussed both of those things.

[11:43] Uh I have worked with our legal counsel and their legal counsel.

[11:47] Uh what we would like to suggest to you is a non-binding letter of intent.

[11:54] The goal of this letter is to lay out sort of a path forward with them in that

[11:59] they're going to agree to stop mining uh the gravel that's there. We will agree

[12:05] to uh

[12:08] We will eventually This is a pathway towards finally getting a final

[12:12] amendment to our gravel land lease right now. This is non-binding, but we we

[12:17] would like to be on a pathway that will get us to where they will leave the

[12:20] gravel in place that still remains there currently.

[12:23] They will work with us and our park designer to

[12:28] uh figure out what what best how best that area is going to be as a park with

[12:32] what's there and what they can be doing to kind of shape the area to get us in a

[12:37] good position to that and so that's not being left as

[12:40] kind of a gravel mine. Will help us uh shape how we're going to

[12:46] uh do a final gravel reclamation plan that

[12:50] needs to get approved by ID uh

[12:52] Department of Lands. And then also let us work with our

[12:57] engineers to our and our park designers to to discuss the permitting and get the

[13:03] permitting kind of lined out for how we will get that through the core and

[13:07] through the uh uh

[13:11] through the the flood plain permitting and through the the uh reclamation

[13:17] closure of that pit. So, there's a number of things that we need to kind of

[13:20] work with them on on that. Uh we've have already

[13:24] uh had [snorts] two or three master plans

[13:27] for that park done before we do another one. We'd like to make sure that we're

[13:30] all on the same path and that the the the park that's going to be there is the

[13:34] park that we're master planning around. So, that was the intent of the letter

[13:39] that you have before you. This has been approved reviewed by our council and by

[13:42] their council and is kind of before you. Again, it's

[13:46] intended to be non-binding, but we would like to give the mayor authority to say

[13:50] this is the direction that we would like to be going with with Knife River.

[13:55] Uh if you have any questions, I'll be glad to stand for them.

[14:07] some monetary amount that's going to be paid to them. Is that

[14:21] roundabout that they constructed. We they have already reduced that amount

[14:27] by the gravel royalties that they have removed from the from the pit already.

[14:32] Uh so, the balance of that and I don't I don't have an exact number because I

[14:37] don't remember exact number and because they're still hauling out a little bit

[14:41] of the gravel that they've already processed. So, once once we get all that

[14:45] done, that will lead us to the exact number of what will make them whole and

[14:50] will allow us to go. That money we have budgeted in next year's uh a budget

[14:56] that's been approved and is actually eligible to be reimbursed through impact

[15:01] fees because it's for a project on the impact fee schedule.

[15:04] » Okay, that's exactly where I was going. Then um

[15:08] there there I tried to read through this uh

[15:11] um receiving the gravel mining and they're doing site grading.

[15:16] The site grading is not going to be anything additional cost-wise. It's

[15:19] going to be just part of what we're reimbursing through

[15:23] uh the the not item two roundabout payment

[15:27] that there's going to be no additional >> We have always known that uh they they

[15:31] stockpiled some of the topsoils along the back edge bank knowing that that

[15:38] would be ideal for kind of

[15:40] » [clears throat] >> smoothing out some of the edges. There's

[15:42] kind of a a little artificial berm along the near

[15:46] triangle uh pond that kind of needs to get graded out. And then along where we

[15:51] think there might be some beaches, there'll probably be a little bit of

[15:54] grading to make sure that the the pit doesn't have a big drop-off at the edge

[15:58] of the water. So, no, we're not anticipating paying them anything.

[16:02] » just wanted to make sure. It didn't say anything about additional. It sounded

[16:05] like that was all part of the original agreement.

[16:07] And so, just a curiosity question, could I hear you say that is there is going to

[16:12] be a lake there at some point or is it the areas where we're back to

[16:16] » Two large water bodies that will probably always be large water bodies.

[16:19] » And the areas that we're backfilling or absent as much backfill as we hoped for,

[16:24] they'll be flat >> We had We had uh

[16:28] some hope that there would be enough backfill just coming in to fill up at

[16:33] least one of those lake areas and provide a lot of areas for some some

[16:38] feelings and some picnic areas and and that's that's just

[29:54] one that was brought up at the Treasure Valley Partnership of Idaho the other

[29:58] day, which is an issue with uh Bitcoin and the ATMs that are being used for

[30:06] fraud across the valley. Um we have seen hundreds of thousands of dollars going

[30:13] into these machines that are totally wasted, um not recoverable. So, um

[30:20] if you guys find yourself in a situation where

[30:24] um you're not sure that you're talking to a

[30:30] complete resident or complete representative of a a company that you

[30:34] actually know, either hang up or get some more answers. Don't go put any

[30:40] money in an ATM Bitcoin, that's going to go away and you're going to suffer from

[30:46] it. So, we will be looking towards some

[30:52] issues with our council to remove such devices from our community.

[31:00] We also had a discussion with uh

[31:07] the Treasure Valley Partners on the pathway etiquette and

[31:12] signage situation. They provided a wonderful trifold

[31:18] advertisement for etiquette on the green belts,

[31:22] specifically to address the issue of the electric motorcycles on the green belts

[31:29] and on city streets from unlicensed drivers,

[31:34] under the age, without insurance. So, those issues are are definitely

[31:39] coming forward and we expect the legislature to enact another law this

[31:50] underage drivers. So, if you guys have brothers and sisters that are riding an

[31:55] electric motorcycle on the city street, remind your parents that they are not

[32:00] allowed. Okay?

[32:05] We had an invitation from Mayor Chadwick to attend the City of Stars

[32:14] What do they call that? Uh State of the city. Thank you.

[32:19] That will be 5:00 p.m. at the Eagle Nazarene Church in Star on the 21st.

[32:26] So, if you have time and would like to attend,

[32:30] I'm sure they'd love to have you there. A very wonderful event happened today

[32:35] that uh

[32:37] has a long time in coming. Fortunately, our our legislature has stepped up a

[32:42] little bit and uh funded a school. This is the second

[32:48] school funded in Idaho that is without taxpayer revenue.

[32:54] Um it is funded through the legislature on

[32:57] um different programs and ours. Uh

[33:02] superintendent of schools, Mark Gee, has been

[33:06] instrumental in making this uh come forward. It's been over a decade since

[33:12] our community actually approved the purchase of a new school, but we do have

[33:19] a new elementary school coming on Kingsbury, and we were lucky enough to

[33:24] attend the groundbreaking today. So, uh moving forward with that, uh I think

[33:29] that's going to be a wonderful asset the next couple of years. Unfortunately, it

[33:34] will not cure our school capacity problem.

[33:38] » Which one of them? >> It does address the elementary schools,

[33:42] [clears throat] but let's face it, junior high and high school are equally

[33:47] affected by the growth that our elementary schools are now seeing.

[33:53] Um the last thing I have is uh uh I was able to attend a water college

[34:00] in Boise um just this last week, which was very informative as to how our water

[34:07] is supplied from Lucky Peak through the system

[34:10] um down here to the valley. So, uh it was great to walk through that and

[34:16] actually get a chance to speak with some of our legislators about the

[34:21] housing problems that are created because of covering up farmland and

[34:27] and uh not

[34:30] using that water for crops but for watering somebody's

[34:36] lawn which still has the same impact so it was a [snorts] great thing to attend

[34:43] to and

[34:46] would be more than happy to share the information with you if you want to talk

[34:50] about it. So

[34:53] this time let's move on to Council comments

[34:57] anything that you ladies and gentlemen would like to bring forward.

[35:03] » I'm good. >> Just to add to the groundbreaking for

[35:07] the school you know I was there with a few of you guys and it was it

[35:11] [clears throat] was really neat seeing the community get together that the

[35:14] teachers and the different leaders of of Star and Middleton and having that

[35:18] connection and I [snorts] thought that was like really really really neat.

[35:22] I'm proud of our town. >> We also have more city council members

[35:25] from Middleton and Star. >> [laughter]

[35:29] » Not that it's a competition.

[35:32] It is the Middleton School District just happens to be

[35:35] all the way over in Star. Unfortunately the the growth from Star

[35:40] is getting to that site faster than the growth from Middleton

[35:44] and that's just how it is unfortunately.

[35:50] Absolutely. Simple. Well maybe not simple but
