different departments that we support

set out by Treasury, and Robin and her

team have done a great job, but now it's

time for us to get those projects closed

out and to get our final reports to
[27:24]
Treasury, and that's going to require a
[27:27]
little bit more guidance um for those
[27:30]
that either
[27:33]
received incorrect information in the
[27:35]
beginning or need help getting across
[27:37]
the line. So, this is what we're trying
[27:39]
to do, and Robin has put together a
[27:41]
brief presentation that will probably
[27:43]
give you a little bit more information
[27:45]
as to where we are right now. So, I'll

level as far as compliance with this

one-time generational funding through

the ARPA program. Um we brought to your
[28:41]
attention early on that we had serious
[28:43]
concerns about some initial
[28:44]
determinations made relative to whether
[28:46]
the agreements with your partners,
[28:48]
because that's what we call them, your
[28:49]
partners and your grantees, uh
[28:52]
were
[28:53]
I will just say with the designation of
[28:55]
the agreement type, subrecipient versus
[28:57]
beneficiary, were consistent and
[29:00]
compliant with both the Treasury
[29:02]
guidance as well as the uniform
[29:03]
guidance. And we raised those issues. Uh
[29:06]
what we what we recommended and and
[29:15]

So, what we
[30:01]
what we identified early on was that
[30:04]
those issues could potentially put this
[30:06]
really the county in a precarious
[30:08]
situation under audit. And one of the
[30:10]
big things we are audit defensible and
[30:13]
and we brought that to the table as far
[30:14]
as our approach. You can go to the next
[30:16]
slide. So, when we looked at the
[30:17]
projects and made that it down There we
[30:19]
go. So, what we identified was that for
[30:22]
those projects, that determination of
[30:25]
subrecipients versus beneficiary had
[30:27]
tremendous impact on how you had to
[30:29]
monitor projects. We elected and
[30:32]
discussed with going with the
[30:33]
conservative approach, so that even if
[30:35]
the initial determination is questioned
[30:37]
under audit,
[30:40]
The approach for the county is that
[30:42]
we're going to be the most conservative
[30:43]
and we're going to treat them all at the
[30:45]
highest standard, which would have been
[30:46]
as a subrecipient. So, we did not go
[30:49]
back and try to argue the point about
[30:50]
the initial determination. What we
[30:52]
proposed and the county understood and
[30:54]
accepted was that we're going to go with
[30:56]
the most conservative and the most
[30:58]
protected um protective and audit
[30:59]
defensible for the county and to treat
[31:02]
these projects as subrecipients and make
[31:04]
sure we're validating 100%
[31:07]
of the dollars that were used for ARPA
[31:09]
programs. So, there's 65 projects. The
[31:11]
good thing is you all have obligated all
[31:13]
of the money's obligated. This meant
[31:15]
that as of December 31st, 2024, all your
[31:17]
pro all your money's were in a pro a
[31:19]
project. To date, total we've totally
[31:22]
validated When I say validated, that
[31:24]
mean my teams have gone through the
[31:25]
actual expenditure exports supporting
[31:27]
documentation, um the project scope,
[31:30]
every dollar and we verified that these
[31:32]
dollars were spent
[31:34]
based on eligible um costs, allowable,
[31:37]
reasonable, and necessary costs
[31:38]
consistent with the uniform guidance.
[31:40]
However, we have about 11,800
[31:43]
11,800
[31:45]
that we have to validate and get spent
[31:48]
by December 31st, 2026. And that's the
[31:51]
population we're focused in on because
[31:53]
as you all know, failure to for those
[31:55]
funds to be expended by December 31st
[31:57]
will result in me and the county having
[31:59]
to recapture and return those funds to
[32:02]
um the county and that's what Regina was
[32:04]
alluding to. Of that 72 of that 11,800,
[32:08]
a lot of those are your uh grantees who
[32:12]
do not neces did not necessarily have a
[32:15]
full understanding standing of federal
[32:17]
grants. And we've had to work very
[32:19]
closely with them and and getting them
[32:21]
to, you know, have it, you know,
[32:23]
identify expenditures, maybe modify the
[32:25]
expenditures to make sure they're
[32:26]
eligible. Their budgets are off. Um lack
[32:29]
of documentation. They simply didn't
[32:31]
realize the level of documentation, even
[32:33]
though it is in their agreement. I do
[32:35]
want to note that your agreements made
[32:36]
it clear that all of that they had to
[32:38]
provide audit supporting documentation
[32:42]
as requested for any expenditure. So
[32:44]
whether they were a subrecipient or
[32:45]
beneficiary, your agreements made that
[32:47]
clear. So at this point, we have about
[32:50]
32 projects that pretty much were ready
[32:52]
that they complete documentation. We're
[32:55]
ready to close out. 33 we have where
[32:57]
we're in this
[32:59]
period of of attempting to work with
[33:01]
them to make sure these funds are spent
[33:02]
and spent allowable.
[33:05]
We have about 39 where we had a
[33:07]
discrepancy with the classification. And
[33:09]
so as I said, we've dealt with them. We
[33:11]
feel like the county is in the best
[33:13]
protected position based on our approach
[33:15]
to treat them
[33:16]
hold them to the higher standards. So we
[33:19]
have 35 projects that are in process. We
[33:21]
have about
[33:22]
um
[33:23]
28 that are ready for closeout, which is
[33:25]
going to we're closing starting to close
[33:26]
them out and then two that we're trying
[33:28]
to kind of determine where they are. We
[33:31]
have One of the issues too is we started
[33:33]
to have some poorly reporting that
[33:35]
wasn't being done. So we've been working
[33:37]
with them as well. You can go to the
[33:38]
next slide. So where we are
[33:43]

then this deals with with advances,
[33:48]
spend rate, and deobligation. So one
[33:51]
other thing to keep in mind is that some
[33:52]
people got money up front. So we have to
[33:54]
validate their expenses. And of that
[33:57]
419,000,
[33:58]
basically we have validated. We have 600
[34:01]
Remember now, this money is already
[34:03]
gone. We're we're trying to get their
[34:05]
their actual expenditures to validate
[34:07]
that they used those funds for the
[34:08]
intended purposes. So potentially, those
[34:11]
are the ones too and that's within that
[34:13]
whole 11 million that we're attempting
[34:15]
to validate. We see a potential
[34:17]
obligation of 500,000 just because some
[34:20]
under and over budgets, but that number
[34:22]
is not firm at this point. And at this
[34:24]
point, we have about 60.2% of the funds
[34:27]
advanced funds that are
[34:29]
validated. So we have about 38% roughly
[34:32]
that are not validated. We can go to the
[34:34]
next slide.

taken what we've done, a lot of direct
[34:43]
communication, Regina, our team,
[34:46]
calling, emails, not
[34:49]
follow-up, conference calls. We've
[34:51]
looked we've reviewed their quarterly
[34:53]
reports, their financial reports, their
[34:54]
project reports, their request for
[34:56]
reimbursement money reports, um weekly
[34:58]
conference calls on spending
[35:00]
projections. We still meet weekly with
[35:02]
um the county to go over these spending
[35:04]
projections and even more so as we're
[35:05]
getting closer and closer to that
[35:07]
deadline. We have um discussed a more
[35:10]
aggressive approach for these
[35:11]
non-responsive. Like I said, the last
[35:13]
quarter we noticed we didn't get 46 46
[35:15]
reports and we're at um that quarter was
[35:18]
June 30th and we're August 11th. So, we
[35:21]
just talked about the fact of making it
[35:22]
clear to failure to validate or provide
[35:25]
us with the documentation to validate
[35:26]
may result in the recapture of um of
[35:30]
those funds or the re-obligation or
[35:31]
re-allocation of those funds. So, that's
[35:34]
the more aggressive approach we're going
[35:36]
to have to that we're taking now to get
[35:38]
us across the finish line. And so, of
[35:40]
course, the conflict consequences of
[35:42]
non-responsive, of them not responding,
[35:44]
this $11 million of those in that pool
[35:46]
are not is potential de-obligation and
[35:49]
the county does still have some
[35:50]
re-allocation they can do um within now
[35:53]
and December 31st, 2026. The issue is
[35:56]
understanding what needs to be
[35:58]
de-obligated and rather re-allocated,
[36:00]
which is what we're trying to get our
[36:01]
pulse more around. Next slide.
[36:06]
So, what that looks like that yeah. What
[36:09]
that looks like when you see that number
[36:11]
350 increase, I just want to say our
[36:13]
original contract only went through
[36:15]
January 1st, 2027.
[36:18]
Um Treasury has put out guidance and
[36:20]
indicated that close out those to April
[36:22]
30th, 2027. So, what does that mean?
[36:25]
Even if funds are expended by December
[36:27]
31st, every grant, every project has to
[36:29]
be closed out. And even And Treasury
[36:31]
recognized that that will not will not
[36:33]
happen by December 31st, even if all the
[36:35]
money's are. So, Treasury has extended
[36:38]
through April 30th, 2027 for the
[36:40]
closeout of the project. And we're
[36:42]
recommending um our contract be extended
[36:45]
to cover that period as well. So, in
[36:47]
that period, um
[36:50]
and you can go to the next slide.
[36:52]

here. Um what this budget supports, we
[36:56]
got to complete all of the ARPA
[36:57]
reconciliation and closeout. One of the
[36:59]
big reconciliations is to what you've
[37:02]
been reporting in Treasury. Treasury
[37:04]
just issued an alert about 6 weeks ago
[37:07]
about the aggressive actions that how
[37:08]
they're going to determine who's being
[37:10]
monitored. And they're going to really
[37:12]
look at those Treasury reports and the
[37:13]
categories and the expense categories,
[37:16]
um how you've been reporting. So, we
[37:18]
need to make sure that all of the
[37:20]
changes that have impacted are being
[37:22]
reported in those reports. We're going
[37:24]
to finalize, continue monitoring, and
[37:26]
technical assistance, processing
[37:27]
reimbursements, getting these files as
[37:30]
complete as possible. We've done so many
[37:31]
amendments and we'll continue to do so
[37:33]
to get the documentation right. And as
[37:35]
you know, we're working on three audits,
[37:37]
which were 40% complete. And we hope to
[37:40]
have the audit results on the conflict
[37:42]
of interest within the next 30 days,
[37:45]
putting it mildly. Within the next 30
[37:46]
days, we should have
[37:48]
um some
[37:49]
some reporting to you at least on the
[37:51]
conflict of interest audit. And we're
[37:53]
very close to finishing that. All the
[37:55]
other audits we're doing field work, and
[37:57]
we expect to be finished by September
[37:58]
30th, 2026. You can go to the next
[38:01]

So, as I said, when we got involved and
[38:06]
we made you aware that the compliance
[38:08]
were issues, financial was issue. I will
[38:10]
say some of your um beneficiary your
[38:13]
your grantees didn't understand they had
[38:15]
to keep any documentation for whatever
[38:17]
reason. So, it's it's been a hill to
[38:19]
climb for some. And some were just
[38:20]
getting advances up front and with no
[38:23]
actual expenditure testing or no actual
[38:25]
documentation being having to be
[38:27]
submitted. So, if I can go to the next
[38:29]
slide.
[38:31]
And I'll try to try to wrap up. Um as I
[38:33]
said, these are all the things we've
[38:35]
done to address those issues. You can go
[38:37]

Um I talked about the risk to you, what
[38:43]
could happen to the county. We're always
[38:44]
on a audit defensible mode and how our
[38:46]
act our approaches protected you, giving
[38:49]
you the best position in training of
[38:50]
those to mitigate those risks. You can

lot of I I want to say maybe we're
[41:32]
building some sustainability, too,
[41:34]
because we're building a capacity,
[41:37]
because we're building we're
[41:39]
taking them through the process of
[41:40]
understanding federal grant requirements
[41:42]
so they so they can
[41:44]
you know, comply with this grant. That
[41:45]
hopefully builds capacity.

the level of um reporting that's been
[41:50]
required as far as just from them and
[41:52]
understanding and making sure that
[41:54]
they're in compliance, we could not have
[41:56]
anticipated that um initially. I will

another unanticipated. We could not have
[42:06]
have anticipated that those particular
[42:09]
situations and that level of monitoring.

to make sure that these uh, recipients,

subrecipients or beneficiary uh, you

they they should have been been aware of

that. So, and I I want to know, I'd like

having a baseline of 2.8 million to
[57:37]
distribute to businesses. Every dollar
[57:40]
counts and this allowed us to do
[57:41]
additional 6 to 10
[57:43]
businesses here. We remain
[57:47]
We want to continue to remain
[57:48]
transparent on that but we're thankful
[57:49]
[clears throat]

that we were able to serve more
[57:51]

Most of the as you see the most of the

award programs were the capital
[1:00:11]
improvements. So, business small
[1:00:12]
businesses that were looking to
[1:00:15]
improve their

their business somehow, but we had
[1:00:20]
others and other allocations as well
[1:00:22]
that took advantage of that. But, really
[1:00:25]
happy about how that went and how how it
[1:00:27]
helped small businesses. Next slide,

Here you look at the the county
[1:00:33]
districts. This is a breakdown of where
[1:00:36]
things went. Uh
[1:00:39]
District 4 having the most, but
[1:00:44]
kind of everybody got touched across the
[1:00:46]

categories that we that you see for
[1:00:52]
those areas.

So, wanted to talk this a little bit
[1:00:59]
briefly about the
[1:01:00]
grant execution agreement. This was
[1:01:02]
definitely a
[1:01:06]
Go back to the other slide. There, thank

This is definitely a kind of partnership
[1:01:11]
between the county city
[1:01:14]
as well as what being the management of
[1:01:16]
Booth Management.
[1:01:18]
This process kind of was fully there.
[1:01:21]
We participated in weekly sessions uh
[1:01:23]
with the county and the city and Booth
[1:01:26]
Management. We met every week. We
[1:01:27]
discussed uh kind of the grant uh
[1:01:30]
execution. Uh they were they were
[1:01:32]
electronic signatures. Uh fully executed
[1:01:36]
uh copies were returned. Um and then
[1:01:38]
we're transitioning to the reimbursement
[1:01:39]
phase now. And so, really uh
[1:01:42]
collaborative um
[1:01:44]
uh
[1:01:45]
way that we we approached this.
[1:01:49]
As you see uh here on this slide, I
[1:01:52]
wanted us to mention that we are we have
[1:01:54]
the disbursements. We're starting to
[1:01:56]
that 312,000
[1:01:58]
uh is actually higher now, but that's
[1:02:00]
the total amount uh finally approved.
[1:02:03]
So, once they get a uh conditionally
[1:02:05]
approved, uh we they go through the our
[1:02:09]
businesses have to return their process.
[1:02:11]
They have a process that they have to
[1:02:12]
do, watch videos, and other things. And
[1:02:16]
so, that that amount that's been
[1:02:17]
released because they've finished those
[1:02:19]
things. Those This uh we expect this one
[1:02:22]
to go up because we're at now at this
[1:02:25]
portion of the phase. So, we expect by
[1:02:27]
the end of the month that this would be
[1:02:29]
80 80%.
[1:02:33]
Uh this this request was funding type.
[1:02:36]
Uh this what you want to know is that we
[1:02:38]
had a assessment that uh Booth
[1:02:40]
Management has set up for us. Uh and
[1:02:43]
there were two things. There was
[1:02:45]
advanced uh if there was a low risk,
[1:02:46]
there was a risk uh profile that
[1:02:49]
everyone got. And if there was depending
[1:02:51]
on what type you were in, uh there was a
[1:02:54]
advanced uh that's given um at a
[1:02:56]
percentage. But also, uh there were
[1:02:59]
retroactive uh
[1:03:00]
grants as well. So, if they were higher
[1:03:02]
risk, uh they were included in the
[1:03:04]
budget. They had to show certain things.
[1:03:06]
Um and then the those payments were done
[1:03:07]
on a reimbursement basis based upon risk
[1:03:10]
and other factors. Next slide.

Uh just want to just these are some I
[1:03:15]
won't go into this. Uh these are some of
[1:03:17]
the requirements uh that went into the
[1:03:20]
risk factors here.

The award amount, the years of business,
[1:03:24]
and other criterias that I can

get into at a later time.

as as it was said, but this was a really
[1:04:11]
good partnership and a turnaround
[1:04:14]
kind of where we were a couple of months
[1:04:16]
ago,

and I just want to thank you for for the
