>> town of mooresville
[9:07]
board of commissioners meeting,
[9:09]
october 10, 2024. I
[9:13]
am the vice mayor for the town of
[9:14]
mooresville and as you can see the
[9:18]
mayor is not with us tonight.
[9:25]
first of all I would like to say mayor chris
[9:28]
carney is not here this evening
[9:32]
. He has faced a number of challenges including
[9:34]
a sudden death of a very close family friend,
[9:37]
and his father's illness. At this
[9:41]
time his dad is actually under hospice care
[9:46]
. As we all can imagine, his physical and
[9:47]
mental health has suffered a little
[9:48]
bit from this. The mayor has decided to take
[9:50]
a medical
[9:51]
leave of absence to address his current health issues.
[9:56]
he is committed to his public service role,
[10:00]
but
[10:01]
realized his health and well-being
[10:02]
of his family must come first right now.
[10:08]
chris is getting help from the support
[10:09]
of the healthcare team so
[10:10]
he may return as soon as he is able to.
[10:16]
we, as the board, wish him a speedy
[10:17]
recovery and ask that you respect
[10:18]
his privacy during these challenging times. Thank you.
[10:21]
at this time we will call
[10:24]
the meeting to order .
[10:28]
commissioner karriker, would you lead
[10:30]
us in the pledge of allegiance
[10:33]
and prayer please
[10:42]
?
[10:43]
>> heavenly father thank you for
[10:44]
the day you've given us. We thank
[10:45]
you for this town. We thank you for this
[10:46]
leadership and ask that
[10:47]
your hand be upon mayor kearney and
[10:48]
his family. During this time you know
[10:49]
what he needs more than anyone else
[10:50]
does and we draw on you
[10:51]
and ask you to be that for him and for his family
[10:52]
. Lord, I
[10:53]
thank you for as being obedient, as well,
[11:08]
and respecting to give him some time,
[11:09]
give them some privacy to work through
[11:10]
these things. We ask that our citizens
[11:11]
do that, as well, lord, for the opportunity
[11:12]
we have to come together to make decisions
[11:13]
on behalf of
[11:14]
our town we ask for your wisdom, discernment,
[11:15]
your guidance and what we say what we
[11:16]
do we ask and bring honor to you
[11:17]
and we thank you for our servicemen and women,
[11:20]
those we get to honor tonight. We
[11:21]
thank you for them coming to be a
[11:23]
part of this awesome staff . We continue
[11:24]
to pray for those
[11:27]
in the western part of our state
[11:29]
who are still struggling, still have
[11:30]
a lot of great needs ahead of them.
[11:32]
we thank you for the outpouring of love and support
[11:38]
that is going that way and that we
[11:39]
ask that continues. This will be
[11:42]
a very long process
[11:45]
for that part
[11:46]
of our state. We thank you for your presence
[11:47]
with the center decision-making tonight in
[11:48]
christ precious name amen.
[11:54]
>> I pledge allegiance to the flag
[11:57]
of the united states of america
[11:58]
and to the republic for which it stands
[12:00]
one nation under god
[12:01]
indivisible with liberty and justice for
[12:03]
all.
[12:18]
we are pretty fortunate
[12:19]
tonight. We have had some swearing
[12:20]
in of some new police officers and
[12:21]
at this time I would like to
[12:23]
recognize chief joe cook and commissioner west, please.

abilities and judgment, so help me god.
[22:36]
in front of my presence this 21st day of october, 2024.
[22:39]
welcome.
[22:54]
and with that, we will step aside .
[23:18]
>> [ inaudible ]
[23:57]
>> return of mooresville
[23:59]
and this board support public safety.
[24:01]
part of the team is supporting
[24:04]
everyone in town .
[24:07]
thank you, mayor pro tem and commissioners, for
[24:10]
allowing us to have them. Do your
[24:12]
job and make them proud.
[24:19]
with that I would like to invite the members
[24:20]
of the board down to take a picture.
[24:40]
you guys want to come up and be in the picture?
[25:07]
all right. One more big hand.
[25:45]
at this time our next item is an employee spotlight
[25:46]
and I
[25:48]
would like to recognize the town manager.
[25:51]
>> thank you very much.
[25:53]
we have any members of our crews that
[25:55]
were invited into night in the audience? I'm going to
[26:01]
ask them to come up and join me up front.
[26:35]
>> it is my pleasure to be recognizing
[26:36]
the
[26:39]
group of individuals who
[26:41]
serve tirelessly every day. I don't know
[26:43]
if you always realize, oftentimes what happens in
[26:47]
the town, the great services that
[26:48]
are provided happen and nobody pays
[26:50]
attention until they are not happening
[26:51]
or until a problem comes up and then you
[26:57]
notice that something is not going right.
[26:59]
this is a representative
[27:00]
group of a larger group of individuals
[27:01]
and I'm going to ask that the names
[27:02]
be shown as I'm talking through this.
[27:08]
an employee spotlight every month would
[27:10]
like to focus on either an individual or
[27:11]
team of people that are just doing
[27:13]
incredible work for the community.
[27:16]
during the recent hurricane and again, it is
[27:18]
through the grace of god that we did
[27:19]
not suffer more damage than we did,
[27:21]
you know, we are
[27:23]
still praying every day and sending
[27:24]
all the help we can to the western part of the
[27:26]
state, but there were challenges that
[27:30]
were being faced right here in mooresville and
[27:33]
it was through the incredible efforts
[27:34]
of these individuals, these gentlemen
[27:35]
and others on their team
[27:36]
that really made sure we all stayed
[27:37]
safe and that the town kept moving forward
[27:47]
and that you
[27:48]
did not have any more interruptions
[27:49]
to your daily lives then you had to when
[27:50]
the storm came in so there were multiple
[27:51]
departments we want to
[27:53]
recognize tonight and again you will see the names
[28:06]
and the names of the departments flushing
[28:07]
up on screens but I would like to
[28:08]
point out
[28:09]
a few of these groups and individuals in
[28:10]
the teams. Throughout public works
[28:11]
we got a lot of people doing a lot
[28:12]
of different things but
[28:13]
people don't always realize for example,
[28:14]
parks and recreation does amazing
[28:15]
work, and some of the work they did
[28:16]
during this
[28:17]
time is remove the fallen trees, the
[28:18]
debris and limbs from across the town
[28:22]
in our parks, our cemeteries that we
[28:23]
had issue with another town facilities
[28:24]
and then we had
[28:25]
our sanitation crews that were out
[28:35]
along
[28:36]
with our streets and the stormwater
[28:37]
crews and these teams are responsible
[28:38]
for addressing all the flood -related street
[28:39]
closures in the cleanup of multiple
[28:40]
trees that
[28:41]
had gone down on the roads and across citizens'
[28:44]
properties. I hope if you were on
[28:45]
social media that you had a look at
[28:46]
some of the images we shared because
[28:47]
we really wanted
[28:50]
to share with you
[28:52]
, almost in real time you could see the
[28:53]
work being done and for those of you
[28:54]
who have these issues in the community
[29:06]
you know they came very quickly. Almost all
[29:07]
the work across the town was completed
[29:08]
within three business days which I
[29:09]
think is a pretty remarkable turnaround time
[29:10]
given all the challenges we were facing
[29:12]
taking care of our community and helping other
[29:12]
parts of the state. Art
[29:18]
traffic and transportation team worked
[29:19]
to take care of all of our intersections.
[29:20]
we lost signals and
[29:21]
had one major traffic accident that had
[29:22]
to be cleared and serviced and again
[29:23]
they made sure they got out there
[29:28]
and made sure all of our traffic is
[29:29]
flowing safely because there is
[29:30]
nothing worse than coming to an intersection
[29:31]
and you have flights that are not
[29:32]
working in lines that are down so
[29:33]
again they worked both during and
[29:35]
after the storm to really ensure that we all stayed
[29:38]
as safe as possible
[29:40]
and that our lives were impacted as
[29:41]
little as possible during the storm.
[29:45]
they are really a shining example, I
[29:47]
believe, of the excellence
[30:01]
that all of our town departments deliver
[30:02]
every day but again, these people are
[30:03]
oftentimes unsung heroes because as
[30:04]
I said, they take care of things we
[30:05]
don't really pay attention to unless
[30:06]
they're not working so I would ask
[30:07]
you now to join me in
[30:08]
a round of applause to thank them
[30:09]
and just so you know,
[30:21]
we have a token of gratitude for all of
[30:22]
you that we are going to be distributing
[30:23]
because our group is large. We have
[30:24]
about 46
[30:25]
individuals total so I will be going
[30:26]
to departments individually but I
[30:27]
really appreciate you being here tonight.
[30:28]
I appreciate all that you do. We thank
[30:29]
you very much. We could not do it
[30:30]
without you and I would ask you not
[30:31]
to join me in a round of
[30:32]
applause to thank them.
[30:53]
thank you all.
[31:10]
>> tracy, thank you so much for that. Our next
[31:13]
presentation is from the mooresville youth council.
[31:19]
I would like to recognize carly nigel and nick lynch.
[31:35]
>> hello.
[31:38]
we would like to thank you for hosting us
[31:41]
tonight and having these
[31:53]
younger students to present to. They
[31:54]
are very excited and we are tremendously
[31:55]
proud of them for all the work they
[31:56]
have done and all the work they aspire to
[31:57]
do. Tonight we are excited to share
[31:58]
with
[31:59]
your up-and-coming volunteer opportunities
[32:00]
and the project we hope to construct,
[32:01]
build and promote the school year.
[32:04]
I will have the students join me. They
[32:05]
are very excited and is or
[32:08]
--eager to present to you their hard work.
[32:29]
>> hello. My name is will
[32:32]
roos. I'm the president of
[32:36]
mooresville youth council. I want
[32:37]
to begin by saying thank you to you
[32:38]
all for letting us speak.
[32:41]
I also want
[32:42]
to thank everybody else in the room
[32:44]
for supporting us and everything that we do.
[32:45]
so,
[32:49]
what is the mooresville youth council? We are
[32:52]
a youth volunteer program that aims to
[32:59]
help the mooresville community in every
[33:00]
endeavor. We
[33:02]
aim to assist youth that want to make
[33:03]
a
[33:05]
difference in the community and want
[33:06]
to
[33:09]
improve our community and
[33:14]
we aim to let youth participate in local
[33:15]
initiatives, to provide an
[33:16]
understanding of the town's functions.
[33:20]
I also would like to introduce the executive
[33:21]
team of the mooresville youth
[33:24]
council, our vice president
[33:26]
hannah, our social media and marketing
[33:31]
coordinator, our secretary, our assistant vice president
[33:37]
--she could not make it today --our
[33:39]
assistant social media marketing coordinator and our
[33:41]
assistant secretary who could also not make it.
[33:53]
I would like to say thank you to carly, nick,
[33:54]
and jane, advisers, for giving us
[33:55]
so much
[33:56]
of their time to make sure we are successful
[33:57]
and a big thank you to commissioner
[33:58]
deweese
[33:59]
for supporting us significantly, as well.
[34:07]
>> hi. I am the secretary of the mooresville
[34:08]
youth council and a little bit about
[34:09]
my job is that
[34:10]
I make the calendars for the meeting so that
[34:12]
we stay on track and
[34:13]
know what we want to discuss. I also
[34:15]
take minutes during the meeting
[34:19]
so we know what we have planned and how we
[34:20]
are going to execute in the future, and
[34:24]
I also put outposts
[34:26]
for meetings so we know when we are
[34:27]
meeting, what we are doing for the
[34:28]
meetings and we
[34:29]
know who is coming to the meetings
[34:30]
and regarding meetings, we have two per month.
[34:33]
one
[34:34]
is that the one mooresville center where
[34:35]
we plan our volunteer opportunities
[34:37]
and also discuss our projects and then another meeting
[34:41]
is at one of the town departments where
[34:42]
we are
[34:45]
able to take tours and allow all
[34:46]
of our members to explore these facilities.
[35:04]
>> hello, everyone. On the screen
[35:05]
here you can see our t-shirt design
[35:06]
for this year. This is actually
[35:07]
the first project we do as a group
[35:08]
every year and so it starts at our
[35:09]
very first meeting where we do
[35:10]
a team building activity and prepare
[35:11]
a list of words to present to the mooresville
[35:17]
youth council. You can see or local
[35:18]
just redesigned last year and our motto
[35:21]
.
[35:30]
>> one of our big things is our legacy project
[35:31]
every
[35:32]
year. This year we plan to create
[35:34]
free little libraries. We've been applying for
[35:39]
the state award mini
[35:40]
grant for the past month in order
[35:42]
to get a $500 grant
[35:43]
in order to do this project. Our goal
[35:45]
is to construct four free
[35:48]
little libraries
[35:50]
around mooresville to boost literacy rates
[35:51]
and bring awareness to
[35:53]
s.t.e.m. Education and its importance.
[35:59]
we had to give every child in person
[36:00]
and mooresville on equal opportunity
[36:03]
and a good education.
[36:04]
I a very big math guy. I love math ever
[36:06]
since I was little and would
[36:08]
love nothing more than to provide
[36:11]
children with knowledge on stem in mathematics.
[36:15]
we also plan to
[36:16]
have a collection event in november and december 2
[36:28]
collect books to be placed into the little
[36:29]
libraries. Once the little libraries are
[36:30]
constructed we will distribute them
[36:31]
widely to many different
[36:33]
parts of mooresville. Some potential locations that we
[36:40]
brainstormed our mega park, liberty park,
[36:41]
bellingham, hope park. We are always
[36:43]
open to more ideas. Working with commissioner
[36:43]
deweese on this
[36:44]
project was definitely a big help.
[36:45]
he helped us
[36:46]
tremendously with the main idea and
[36:48]
we managed to build several new ideas with his help.
[36:57]
we also have many ideas for opening
[36:58]
events of
[37:00]
the little libraries. We plan to have several stem demonstrations
[37:03]
at the openings. We will have a lot
[37:04]
of
[37:06]
social media awareness to
[37:10]
ring this to the community and we also
[37:11]
plan to create educational signs and
[37:12]
things that just explained
[37:14]
the purpose of the little libraries and
[37:15]
what they stand for.
[37:22]
youth council has also attended several
[37:23]
state youth council conferences in the past.
[37:27]
the state council leadership conference
[37:34]
was on september 10th and we learned how
[37:35]
other councils functioned in how our
[37:36]
leadership skills could be
[37:38]
improved. We plan to go to the state youth council
[37:48]
conferences in november, february
[37:49]
and april. The upcoming conference
[37:50]
in
[37:51]
april will be about the mini grant
[37:52]
for a legacy project and we are very
[37:53]
excited about going there.
[38:03]
>> every holiday season we show
[38:04]
our support for the town by being involved
[38:05]
in classic christmas and by posting your own
[38:18]
project. This year we plan
[38:19]
to center our holiday project around
[38:20]
our legacy project and we intend to
[38:21]
host a book collection aspect project
[38:22]
to support our legacy project but
[38:23]
for
[38:24]
classic christmas last year we helped
[38:25]
children build holiday
[38:27]
crafts and
[38:30]
take pictures with the zippy and hosted
[38:33]
the donation drive. For
[38:44]
creek week, we had a booth set up
[38:45]
with snail races and tattoos for young
[38:46]
kids alongside an educational booth
[38:47]
about
[38:48]
the storm water department. At this
[38:49]
event we were able to raise interest
[38:51]
from parents and teens about the youth council.
[38:54]
earth day was another opportunity
[38:55]
for us to connect with the youth of
[38:56]
mooresville and share information
[38:57]
with them about recycling and maintaining
[39:01]
a healthy environment.
[39:04]
we had an awesome time.
[39:21]
>> all right, this is my favorite part,
[39:22]
the dog mayor. Every year we host
[39:23]
our annual dog mayor elections and
[39:24]
they are held via our youth council
[39:25]
instagram. Last year, we hope the
[39:26]
election
[39:28]
nominations which is basically
[39:34]
a form for anyone
[39:35]
wanting to run for dog mayor will
[39:36]
fill out a form with their information.
[39:37]
that was from may 1st to may 15th
[39:38]
and we had elections
[39:40]
from may 19 to 25th which is
[39:43]
basically count of her likes on
[39:44]
each candidate's post. Last year we
[39:46]
had six total participants in the winter was real
[39:49]
--reya,
[39:52]
a
[39:55]
12-year-old pimple and she
[40:01]
won with 219 votes.
[40:02]
>>
[40:03]
we have a meeting tomorrow at public ups
[40:04]
were we will be taking a tour and
[40:05]
allowing our members to
[40:09]
experience these different areas that they
[40:10]
otherwise probably would never be
[40:11]
able to
[40:12]
experience, which is such a great
[40:13]
part about the council and
[40:23]
our second meeting, or our next meeting will
[40:24]
be at the one mooresville center for we
[40:25]
will continue to discuss our future
[40:26]
projects and volunteer
[40:27]
opportunities such as well was talking
[40:28]
about, the legacy project and
[40:32]
more about our volunteer opportunities.
[40:33]
we actually have one coming up this
[40:34]
saturday we will be
[40:36]
helping clean up the eastern heights community. Thank you.
[40:50]
>> I just want to talk about how the mooresville
[40:51]
youth council has influenced me as
[40:52]
a member. It's help me get out there
[40:53]
in the community
[40:54]
and take initiative. I have my own
[40:56]
programs with the library and it's helped me learn
[40:57]
what I want to do in my future and
[40:58]
helping me build
[40:59]
these public speaking skills and helping me
[41:01]
shape my skills as a leader.
[41:06]
>> the youth council helped me make
[41:07]
more friends and be more friendly
[41:10]
and
[41:12]
accepting to other people and going and
[41:13]
talking to other people.
[41:24]
>> youth council really just inspires
[41:25]
me to be my best self in any
[41:28]
way that I can,
[41:29]
and it inspires me to just be a leader
[41:31]
whenever I possibly can.
[41:34]
and I've just been
[41:36]
a big fan of the youth council for as
[41:37]
long as I've been here.
[41:43]
>> the mooresville youth council inspires
[41:46]
me by really showing how
[41:57]
the collaboration of teens from freshman
[41:58]
through senior can come together to
[41:59]
make
[42:00]
a huge impact on our town, especially
[42:01]
in the position that I am. I am able
[42:02]
to see how, with the
[42:03]
improvement of our communication ,
[42:04]
team building skills, how that has
[42:05]
an impact on the success of our projects
[42:06]
and
[42:07]
events and I hope
[42:09]
that I can see this passion in teenagers continue
[42:10]
for years to come.
[42:21]
>> so, the mooresville youth counselor
[42:22]
has inspired me to have
[42:23]
a greater impact on the community
[42:24]
as a whole so being able to see all
[42:25]
of our ideas and new members
[42:27]
come together to create different
[42:28]
opportunities and different offenses just
[42:29]
amazing and seeing them
[42:31]
come to reality. Thank you.
[43:02]
>> hello. The mooresville youth council inspires
[43:03]
me because it allows me to understand
[43:04]
and really immerse myself in the experiences
[43:05]
of our community, which
[43:06]
I think really brings us together
[43:07]
in a way beyond words and I would've
[43:08]
never gotten this close to the mooresville
[43:09]
community if it were not
[43:10]
for the mooresville youth council
[43:11]
and as a senior, I have done youth council
[43:12]
for all four years and I can say that
[43:13]
it has just shaped
[43:14]
me as a person, as everyone has mentioned.
[43:15]
volunteering, giving back to the community
[43:16]
and general leadership skills so as
[43:17]
a cornerstone of my high school experience
[43:18]
I hope to continue to inspire youth
[43:19]
to make mooresville a better place.
[43:20]
we want to thank the town of mooresville
[43:21]
for supporting us on our
[43:31]
journey to make mooresville a better
[43:32]
place for everyone
[43:33]
and to stay updated on our journey
[43:34]
and our projects, you can follow us.
[43:35]
this is our instagram. Scan the qr code
[43:36]
on the screen and you can
[43:37]
follow us as we post about meetings
[43:38]
, fun
[43:39]
outings that we do, projects for the
[43:40]
community and other fundings that
[43:41]
we do. Thank you so much.
[43:49]
>> thanks. Excellent.
[43:58]
>> I just want to say how
[44:01]
fulfilling it is to watch a
[44:03]
group of young people come together and grow
[44:07]
and have impact and
[44:10]
I thank you for the kind words, but I would say
[44:16]
that you guys are what makes the difference
[44:17]
and thank you very much for all that
[44:18]
you do and all that you help us with
[44:19]
and
[44:21]
how much your learning to be a good citizen. Thank you.
[44:36]
>> I'm looking at you I see the next
[44:37]
leaders. You will be sitting up here
[44:38]
one day so good luck and outstanding
[44:39]
presentation. I
[44:41]
love the stem math --s.t.e.m., I love the math stuff.
[44:43]
you guys did good. Thanks.
[44:54]
>> I would just like to reiterate I
[44:55]
am very proud of you all. I think
[44:56]
when we think about the future of our
[44:58]
town we are in good hands.
[45:11]
>> first
[45:12]
off, thank you very much. Just last week
[45:13]
I had someone ask me says what is
[45:14]
this dog mayor stuff about and how
[45:15]
does my dog become mayor.
[45:16]
I said you answered my question so
[45:17]
you guys are future leaders and always
[45:18]
amaze. Thank you very much and
[45:20]
continue to do what you do. You will go far. Thanks.
[46:59]
>> our next presentation
[47:00]
is a breast cancer awareness month
[47:02]
proclamation and I would like to recognize commissioner karriker.
[47:21]
>> whereas breast cancer awareness month
[47:22]
is an international health campaign
[47:23]
in october, whereas there are more
[47:24]
than 4 million breast
[47:26]
cancer survivors in america
[47:30]
, that is a big number, and this year
[47:31]
alone, hundreds of thousands more
[47:32]
will be diagnosed and whereas all
[47:33]
scientists
[47:34]
have made significant breakthroughs
[47:41]
to prevent, detect and treat breast
[47:42]
cancer, the diagnosis is frightening
[47:43]
and overwhelming. Patients and families
[47:45]
are often flooded with complex medical information
[47:50]
.
[47:52]
they're forced to advocate for themselves, often
[47:53]
to receive the basic care, whereas
[47:54]
although breast cancer is more common in women
[48:04]
, it does affect men, as well, now
[48:05]
therefore be it resolved that the mayor,
[48:06]
board of commissioners do hereby proclaim october
[48:07]
2024 as breast cancer awareness month
[48:09]
and encourage participation
[48:10]
and activities to support education,
[48:11]
support programs and the funding of research programs to
[48:14]
find a cure for breast
[48:15]
cancer this 21st day of october, 2024.
[48:29]
>> thank you, commissioner karriker. We
[48:32]
have another proclamation
[48:35]
. It
[48:36]
is world polio day. I'd like to recognize
[48:38]
commissioner qualls please.
[48:49]
>> good evening. I would love to have
[48:50]
any rotarians
[48:53]
in the audience please
[48:56]
come join me.
[49:02]
[ inaudible ] here
[49:03]
in the mooresville we meet on thursday
[49:04]
mornings at 8:15 and williamson chapel.
[49:08]
insurance club, mooresville club
[49:11]
.
[49:14]
everybody has a time
[49:27]
where they meet is what we classify everybody
[49:28]
else so we have the tuesday noon club
[49:29]
and the tuesday lunch club so if you
[49:30]
are not a
[49:31]
rotarian and you have some interest,
[49:32]
please come see any of us or if you
[49:33]
just google mooresville rotary we
[49:34]
will come up with
[49:35]
some places for you.
[49:36]
the cameramen taking the picture is
[49:37]
also one of our rotarians, as well.
[49:38]
I would like to read this proclamation
[49:39]
on behalf
[49:41]
of my friends here
[49:55]
, fellow rotarians. Whereas rotary is
[49:56]
a global network of neighbors, friends,
[49:57]
leaders and problem solvers that unite
[49:58]
and take action
[49:59]
to create lasting change in communities
[50:00]
across the globe, whereas the rotary motto,
[50:01]
service above self, inspires members
[50:02]
to provide humanitarian service
[50:05]
, follow high ethical standards and
[50:06]
promote goodwill and
[50:07]
peace in the world, whereas rotary in
[50:08]
1985 launched polio plus
[50:17]
,
[50:18]
and in 1980 it helped establish the
[50:19]
global polio eradication initiative
[50:20]
which today includes the world health
[50:21]
organization, u.s. Centers for disease
[50:22]
control and prevention, unicef and
[50:23]
the bill and linda gates foundation
[50:34]
along with gabby and the maxine alliance
[50:35]
to immunize the children of the world against
[50:36]
polio, whereas polio
[50:37]
cases have dropped by 99.9% since 1988,
[50:41]
we
[50:42]
are this close, folks, we are this close
[50:43]
--the world stands on the threshold
[50:44]
of eradicating the disease
[50:47]
. Whereas to date, rotary has contributed
[50:50]
more than 2.2 billion
[51:02]
and countless volunteer hours protecting
[51:03]
nearly 3 billion children in
[51:04]
hundred and 22 countries, whereas rotary
[51:05]
is working to raise an additional 50
[51:06]
million per year, which then will be
[51:07]
leveraged for maximum impact by
[51:08]
an initial 100 million
[51:21]
eventually from the bill and melinda
[51:22]
gates foundation, whereas these efforts are
[51:23]
providing much-needed operational
[51:24]
support, medical staff, laboratory
[51:25]
equipment and educational materials
[51:26]
for health workers and parents,
[51:27]
whereas in addition rotary has played
[51:29]
a major role in decisions
[51:30]
by donor governments to contribute
[51:30]
more than 10 billion
[51:32]
in the effort whereas there are over
[51:36]
1.2 million rotary members
[51:38]
and 36,000 clubs throughout the world but sponsor
[51:43]
service projects in addition to critical
[51:44]
issues such as poverty, disease, hunger
[51:48]
, literacy and
[52:01]
the environment in the local communities
[52:02]
and abroad now therefore be it resolved
[52:03]
the mayor and the board
[52:04]
of commissioners do hereby proclaim
[52:05]
october 24, 2024 world polio day in the
[52:06]
town of mooresville, and encourage all citizens to
[52:07]
join us in rotary international in
[52:09]
a fight for a polio-free world
[52:12]
this
[52:13]
21st day of october, 2024. Thank you.
[52:19]
joe, kim, would you like to say anything
[52:20]
on behalf of rotary international?
[52:27]
we had a guest speaker
[52:30]
last week at a
[52:33]
--our meeting, the district
[52:34]
governor and he was recently added
[52:41]
training event and ask one of the
[52:42]
members of the bill
[52:43]
and melinda gates foundation why you
[52:44]
continue to be supportive of rotary
[52:45]
, and your financial
[52:48]
support across the world
[52:51]
, and they said because
[52:52]
we know 1.2 million rotarians are
[52:54]
going to get it done so
[52:56]
that is what rotary does is we get
[53:00]
it done. Thank you.
[54:10]
>> thanks, commissioner qualls, for that.
[54:11]
our next item is the managers report.
[54:19]
>> we always like to recognize our new
[54:21]
hires again across the road
[54:24]
--organization. I am pleased
[54:32]
to have new team members joining us
[54:33]
and we always like to acknowledge
[54:34]
promotions and transfers as
[54:36]
we continue to grow our talent.
[54:37]
we would like to say thank you to
[54:38]
our veterans. We obviously appreciate
[54:39]
our veterans every day but
[54:41]
we are very much looking forward to our
[54:49]
up top upcoming veterans week. We
[54:50]
have a number of events scheduled
[54:51]
next month to honor and appreciate the
[54:52]
men and women who
[54:53]
protected our freedom and also those
[54:54]
who are of course on active duty.
[55:01]
this slide gives you some highlights
[55:02]
of some of the events that are going
[55:03]
to be happening throughout that week.
[55:06]
you can also visit our website on the town website
[55:08]
for more information. You click on
[55:12]
the info
[55:17]

[55:18]
click and that will be continuously
[55:19]
updated with
[55:20]
additional activities as they come.
[55:24]
again, you have the website
[55:27]
there and you can also visit the facebook
[55:28]

[55:30]

[55:36]
last week we had the induction
[55:47]
on the 30th anniversary of the north carolina
[55:48]
music hall of fame and we would like
[55:49]
to congratulate
[55:50]
the newest members of the hall of
[55:51]
fame. That was a night to remember.
[55:54]
we would also like to thank everyone
[55:55]
who joined us for
[55:57]
the mooresville motorsports celebration earlier this week.
[56:02]
we have the racing hall of fame, the
[56:03]

[56:24]
you all really enjoyed
[56:27]
the new crosswalks downtown, celebrating our
[56:30]
identity
[56:33]
as race city
[56:38]

[57:38]
go on during library hours and actually
[57:39]
chat via phone, via text with our library staff
[57:55]
and a new
[57:56]
offering that is coming in the middle
[57:57]
of next month is the library of things.
[57:58]
this is a collection of items that can
[57:59]

[58:04]

[58:05]
check out the new library of things.
[58:07]
I'm going to
[58:10]
hand it over to
[58:13]
teresa hills.
[58:31]
I get real excited
[58:32]
about all the activities.
[58:33]
>> thank you
[58:34]
for that. Upcoming parks and recreation
[58:35]
events, you can see here we have a slew
[58:36]

[59:10]
slides, if you go
[59:11]
on our website you can click on parks
[59:12]
and rec or catch up and get more detail on
[59:13]
each of these as well as on our
[59:15]
facebook or instagram page.
[59:16]
>> thank
[59:17]
you. I think it goes without
[59:26]
saying that this is going to be something that
[59:27]
continues to be part of our managers report
[59:28]
as we move forward. Just want to make
[59:29]
sure
[59:30]
we did not forget the folks in western
[59:31]
north carolina. A big push has been
[59:32]
made by our public safety department
[59:35]
, both mooresville fire rescue and
[59:36]
mooresville police department have spent
[59:40]
multiple days.
[59:41]
we have sent 21 different firemen
[59:56]
up to 14 days over there. We have
[59:57]
also sent three different teams of
[59:58]
mooresville pd to provide some security
[59:59]
for the supplies that have been
[1:00:00]
given and donated over there in western
[1:00:01]
north carolina and I know the photos there
[1:00:03]
give another small glimpse of the
[1:00:04]
catastrophic damage that occurred
[1:00:05]
over in western north carolina
[1:00:06]
and as details continue to float forward
[1:00:13]
about how these heroic individuals from
[1:00:14]
mooresville supported those over in
[1:00:16]
western north carolina we will be sure to share.
[1:00:19]
public education events .
[1:00:22]
literally last week
[1:00:25]
we had an event
[1:00:29]
literally every day. The one that
[1:00:30]
you see there, you will see three
[1:00:31]
different photos of the first baptist church.
[1:00:35]
both mooresville fire rescue and the
[1:00:36]
police department were there to speak with
[1:00:42]
preschool students, form relationships,
[1:00:43]
and let them know about what each
[1:00:44]
agency does and how they work together
[1:00:46]
to keep them safe.
[1:00:54]
I am always surprised at the number as
[1:00:55]
it continues to grow for our drug
[1:00:56]
takeback
[1:00:58]
event. Our next event
[1:01:09]
as you can see there on the left side
[1:01:10]
is this saturday from 10:00 to 2:00
[1:01:11]
p.m. At cannon pharmacy. If you don't know
[1:01:12]
what that is that, it's in front of
[1:01:13]
the food lion on 150. The other thing
[1:01:14]
I wanted to make sure
[1:01:16]
I plugged on this
[1:01:19]
slide is that if you are not able
[1:01:20]
to make the cannon pharmacy,
[1:01:21]
the new police department does have
[1:01:22]
a dropbox and its lobby that can be
[1:01:23]
used by our community, and since 2012,
[1:01:30]
this is a number that continues to for
[1:01:31]
me, over 6 tons of prescription drugs
[1:01:32]
have been taken
[1:01:34]
back at these events, so what is service to our community
[1:01:39]
. Just ask an employee to take back those
[1:01:40]
unneeded prescription drugs if you
[1:01:41]
have
[1:01:42]
the chance this weekend. Next two slides
[1:01:49]
are going to talk about
[1:01:50]
some of the details of our trick-or-treat
[1:01:51]
downtown. As you can see, it's going to be
[1:01:52]
on
[1:01:55]
this thursday, october 31st
[1:02:04]
. Not this
[1:02:05]
thursday. Next thursday from 3:00
[1:02:06]
to 5:00. If you go to the next slide it
[1:02:07]
will show you the exact boundaries on
[1:02:08]
main street between iredale and center
[1:02:10]
will be closed in moore avenue
[1:02:16]
will be closed starting at broad street and
[1:02:17]
heading down the
[1:02:18]
hill to church street so just want
[1:02:19]
to make sure everyone was aware of
[1:02:20]
that event and where it was going
[1:02:21]
to be held
[1:02:22]
at. The final slide , my portion of
[1:02:23]
the managers report is
[1:02:25]
to let you know
[1:02:27]
the one silver lining with all the
[1:02:28]
dry weather we have had after the
[1:02:31]
storms is that our
[1:02:37]
mullen overlay project has been able
[1:02:38]
to
[1:02:39]
make significant progress. What you will see
[1:02:40]
this week and make sure
[1:02:49]
to ask ms. Walker,
[1:02:50]
this week we are going to see milling
[1:02:51]
on institute, clover, underhill, cassie
[1:02:52]
elaine and jake's ridgeline's and
[1:02:53]
you'll see those workers from life
[1:02:54]
construction around town
[1:02:56]
and we are just thankful the board has supported us
[1:03:01]
in having such a robust overlay
[1:03:02]
project for this year. With that,
[1:03:04]
that it concludes the report.
[1:03:11]
>> thank you very
[1:03:12]
much.
[1:03:13]
>> any comments or questions
[1:03:14]
for the managers? Okay.
[1:03:17]
>> thank you. I just wanted
[1:03:20]
to take this time
[1:03:23]
as an opportunity to talk
[1:03:24]
about the scope of municipal authority.
[1:03:25]
this came up at the last board meeting
[1:03:33]
and the town gets a lot of questions
[1:03:34]
about the scope of municipal authority
[1:03:35]
and north carolina. I just want
[1:03:36]
to talk about that for a few minutes. Basically
[1:03:43]
north carolina is different from other
[1:03:44]
states
[1:03:45]
and it is important to understand
[1:03:46]
that north carolina cities and towns
[1:03:47]
are limited in what they can or can't
[1:03:48]
do based on regulations that are
[1:03:50]
adopted at the state level.
[1:03:57]
you hear terms put out, such as home
[1:03:58]
rule states in dylan's role states
[1:03:59]
and north carolina is somewhat of
[1:04:01]
a hybrid from that. Meaning that north carolina
[1:04:03]
municipalities are only granted authority
[1:04:05]
from the state legislature either through statute or
[1:04:08]
delectable rules. What
[1:04:11]
that means is that
[1:04:18]
what the town can or cannot do, that
[1:04:19]
is outlined by the state, so for instance,
[1:04:20]
impact fees. We
[1:04:23]
have no authority to
[1:04:25]
require developers to pay impact fees
[1:04:26]
and that comes from the state legislature
[1:04:27]
so I
[1:04:29]
just wanted to mention that
[1:04:33]
for the public. I think that is an
[1:04:34]
important piece for folks to understand, and
[1:04:35]
the services that we
[1:04:36]
provide is a town are granted by the state
[1:04:40]
, so counties have certain services that they provide
[1:04:46]
. Cities and towns have certain services
[1:04:47]
they provided there is overlap between
[1:04:48]
cities and counties, but I just wanted to
[1:04:58]
point that out for the public.
[1:04:59]
>>
[1:05:00]
any comments or questions?
[1:05:01]
>>
[1:05:02]
thank you very much. With that,
[1:05:07]
board members, we will move on to
[1:05:08]
adjustments of the agenda. I'm not
[1:05:09]
going to read through all this. You
[1:05:10]
should have a copy and it should be
[1:05:11]
on your screen in front of you. Are
[1:05:12]
there
[1:05:14]
any comments or questions?
[1:05:30]
at this time I'm going to ask for
[1:05:31]
a motion to approve the adjustments
[1:05:32]
to the agenda, the consent agenda
[1:05:33]
and the regular agenda as
[1:05:34]
presented.
[1:05:35]
>> so moved. >> commissioner
[1:05:36]
west made a motion. Is there a second?
[1:05:39]
second by commissioner aven. All in
[1:05:40]
favor?
[1:05:41]
>> aye. >> thank you very much.
[1:05:42]
that passes unanimously.
[1:05:44]
we
[1:05:46]
have item number 7a is a public hearing
[1:05:52]
, and I guess if you guys remember,
[1:05:53]
this is a request
[1:05:56]
for
[1:05:59]
the
[1:06:01]
approval of an ordinance for a conditional rezoning
[1:06:02]
request on the property located off
[1:06:05]
165
[1:06:08]
clodfelter road, 154
[1:06:11]
clodfelter road, and
[1:06:14]
816 shearers road.
[1:06:22]
there is actually no public comment. This
[1:06:23]
was the item that was continued, but
[1:06:24]
we do have something
[1:06:25]
from the applicant so at this time
[1:06:26]
of going to open the public hearing and
[1:06:28]
mr. Cole, could you start us off with
[1:06:29]
that,
[1:06:32]
please?
[1:06:33]
>> thank you,
[1:06:34]
mr. Mayor pro tem. The applicant is here
[1:06:35]
to speak a little bit more to the
[1:06:36]
topic
[1:06:38]
that was continued last meeting.
[1:06:50]
>> if you will all
[1:06:51]
bear with me I'm sorry, it's been
[1:06:52]
in and out for a few days. I will
[1:06:53]
try to speak as clearly and loudly
[1:06:54]
as possible
[1:06:56]
for as long as
[1:06:58]
possible. My name is sarah beeson,
[1:07:00]
119 barber loop, mooresville north carolina. I hear
[1:07:02]
representing
[1:07:08]
magnetic homes
[1:07:24]
. To give a quick overview of what we
[1:07:25]
spoke about at the last meeting, the
[1:07:26]
project that is being proposed as
[1:07:27]
a conditional rezoning and
[1:07:28]
annexation is 180 family single-family
[1:07:29]
residences, that gives a density of
[1:07:31]
2.87 dwelling units per acre. Which is far below
[1:07:34]
what could be in a traditional neighborhood of eight
[1:07:35]
units per acre and we have over
[1:07:36]
16 acres of open space entry space
[1:07:50]
. One of the other commitments that
[1:07:51]
has
[1:07:52]
been made as part of this project
[1:07:53]
that would not be included with the
[1:07:55]
bayreuth project is the 20-foot greenway easement
[1:07:56]
in the 10-foot paved path being constructed
[1:07:56]
from
[1:07:57]
ridge avenue all the way along the
[1:07:58]
western property line. The request
[1:07:59]
at the end of the last hearing was
[1:08:00]
to go back and look at enhanced
[1:08:01]
buffering for the site with the
[1:08:02]
existing
[1:08:05]
residences off of shearers
[1:08:08]
road, in particular.
[1:08:11]
[ inaudible ] home reached out to
[1:08:12]
many of
[1:08:14]
those residents either bite
[1:08:20]
email,
[1:08:21]
phone call or in person. This is the
[1:08:22]
original site from the eight-foot
[1:08:23]
perimeter buffer shown. There is also
[1:08:24]
fencing
[1:08:26]
at the northern inference
[1:08:29]
--entrance off of shearers road. What
[1:08:30]
is being
[1:08:32]
proposed tonight is that
[1:08:38]
the fencing is
[1:08:39]
not only at the northern entrance but follows
[1:08:40]
the entirety of the eastern property
[1:08:42]
line across 22 parcels, and that would be within
[1:08:42]
the eight-foot buffer
[1:08:44]
and six-foot vinyl fence
[1:08:47]
, and that is a condition in
[1:08:49]
the revised plan, just to give a little bit more
[1:08:55]
quantitative ability to look at that
[1:08:57]
math and that separation. This provides anywhere from
[1:09:05]
24 to 70 feet. This is between the building
[1:09:06]
lots where the homes
[1:09:07]
are actually going to be constructed
[1:09:08]
on, versus the existing residence
[1:09:18]
. That orange area,
[1:09:19]
and this is just a kind of make it
[1:09:20]
pop on the plan, that is all common
[1:09:21]
open space or treed area. None of that
[1:09:22]
is
[1:09:24]
proposed to be dwelling unit.
[1:09:31]
and so the requesting to be not only
[1:09:32]
visual separation but also physical
[1:09:33]
separation to address some of those
[1:09:34]
concerns as
[1:09:35]
far as ability for the residents of
[1:09:36]
the proposed community to come across
[1:09:37]
into the back of those residences
[1:09:38]
off of shearers and
[1:09:39]
clodfelter road. The 6 foot
[1:09:42]
fence seemed to best address
[1:09:45]
both of those concerns.
[1:09:49]
as part of that six-foot fencing condition,
[1:09:52]
we are noting that it would run temporarily
[1:10:02]
through the stub. There is a stub
[1:10:03]
proposed to the rear, one of the eastern
[1:10:04]
property lines
[1:10:05]
at 707 shearers, I believe, and so for
[1:10:13]
the duration until that connection if
[1:10:14]
ever needs to be made to any adjacent
[1:10:15]
development on that site, the
[1:10:16]
fencing would go through that stub just
[1:10:17]
to preserve the continuity of that buffer.
[1:10:20]
the other condition that was requested is regarding
[1:10:29]
clodfelter road itself. We initially noted
[1:10:30]
emergency access only after the udo.
[1:10:31]
the request was
[1:10:33]
to make that
[1:10:38]
no vehicular, no pedestrian connection
[1:10:39]
at all, and so the concept plan
[1:10:40]
has been revised to remove that connection to
[1:10:42]
clodfelter road and
[1:10:45]
expand the open active space area so no additional
[1:10:54]
lots were converted using that space.
[1:10:55]
the number of homes and lots remain
[1:10:56]
the same and there is an expressed condition
[1:10:57]
in the proposed packet that there
[1:10:58]
is
[1:10:59]
no vehicular pedestrian connection
[1:11:00]
allowed to
[1:11:10]
clodfelter. To summarize again, 187
[1:11:12]
single-family detached homes. 2.87 density
[1:11:16]
, a 20-foot greenway easement that
[1:11:18]
would not otherwise be provided
[1:11:26]
, the significant savings of open space
[1:11:27]
entry space
[1:11:28]
around the entire perimeter of the property
[1:11:30]
provides a buffer to existing homes and residences.
[1:11:30]
staff
[1:11:33]
is recommended to approve
[1:11:36]
and
[1:11:37]
we have made those updates with the six-foot
[1:11:38]
vinyl fence along the eastern property
[1:11:39]
line
[1:11:42]
on the closing off of clodfelter
[1:11:47]
as requested so respectfully request
[1:11:48]
that with these additional
[1:11:49]
conditions the board approved this
[1:11:51]
project as presented. Thank you.
[1:11:54]
>> board members,
[1:11:57]
any comments or questions for
[1:12:00]
the applicant?
[1:12:03]
>>
[1:12:11]
I know it has only been a couple of
[1:12:12]
weeks but a lot happens
[1:12:13]
in two weeks so I tend to forget so I
[1:12:15]
just want to make sure
[1:12:18]
I still have all of the information
[1:12:19]
correct. Right now
[1:12:21]
is the property stands , and what
[1:12:23]
the current zoning is, if it was not rezoned,
[1:12:30]
referencing my notes here,
[1:12:42]
the allowance would be like 131 houses.
[1:12:43]
>>
[1:12:44]
yes, ma'am.
[1:12:45]
>>
[1:12:46]
okay, so if we didn't do anything
[1:12:47]
they could build 131 houses,
[1:12:48]
they could have water and inactive plan
[1:12:49]
or whatever, there could be 131
[1:12:50]
houses there. The builder would deal
[1:12:51]
with the
[1:12:55]
[ inaudible ] as they normally were
[1:12:57]
whether we were doing anything
[1:12:59]
or not. And they would not be required
[1:13:00]
to do any of this
[1:13:03]
additional screening, buffering
[1:13:06]
, nothing.
[1:13:15]
>> that is correct. >> thank you.
[1:13:16]
I just
[1:13:17]
wanted to make sure I have that correct
[1:13:18]
in my mind. Thanks.
[1:13:19]
>> any comments
[1:13:20]
or questions from anyone else?
[1:13:21]
>> I know that you guys met with
[1:13:24]
some of the neighbors out there
[1:13:33]
. I would like to hear a little bit more
[1:13:34]
about that because I have a lot
[1:13:35]
of incoming mail from people who said
[1:13:36]
they were not contacted and did not feel
[1:13:38]
that they were listened to, so if
[1:13:39]
you could go through that process,
[1:13:42]
that would be helpful.
[1:13:43]
>> I can
[1:13:45]
give you the procedural
[1:13:53]
overview. This is jared whelan's who
[1:13:54]
did the one-on-one contact with the
[1:13:55]
phone
[1:13:57]
calls and in-person meetings and door knocks. So between
[1:13:57]
ji
[1:14:00]
s with public information ,
[1:14:03]
we also because the town sends out the colors for
[1:14:21]
anyone within half a mile for
[1:14:22]
hearing notices, we listed townhomes.
[1:14:23]
they give us phone numbers for anyone
[1:14:24]
we didn't have that information from
[1:14:25]
the community meeting report. We had
[1:14:26]
a number
[1:14:27]
of phone numbers and email addresses
[1:14:28]
but by far we did not have everybody,
[1:14:29]
so between using the public records,
[1:14:30]
calling erika
[1:14:31]
and stefan her helping
[1:14:39]
us get more phone calls, mainly jerry put
[1:14:40]
in some phone calls to all those residents
[1:14:41]
in trying to set up either speaking
[1:14:42]
with them over the phone or meeting
[1:14:43]
physically on the property with the house,
[1:14:53]
howard can go into additional details.
[1:14:54]
>> good evening. I think there were
[1:14:55]
about 19
[1:14:56]
or 20 different residents we reached
[1:14:57]
out to in totality and I think we
[1:14:58]
got to about 14 or so of those. There
[1:14:59]
were several that
[1:15:00]
did not return any of the phone calls
[1:15:04]
. I think there were three
[1:15:05]
or four of those so I think we got
[1:15:07]
to the majority of the ones that corresponded with us.
[1:15:08]
some ask for phone conversations and sharing
[1:15:21]
of our plan for the buffer on the
[1:15:22]
fencing
[1:15:23]
and what type was it, so it was a
[1:15:24]
pretty thorough conversation over the phone,
[1:15:25]
so then I finished it up with what time
[1:15:26]
would you like to
[1:15:27]
meet out there and I can walk your property
[1:15:28]
because one of the things I wanted
[1:15:29]
to make sure that they knew
[1:15:30]
is that orange perimeter that was
[1:15:31]
shown on the map
[1:15:35]
that they knew there was distance
[1:15:36]
between their property and that there was
[1:15:37]
hoa-maintained common open
[1:15:40]
space that would remain
[1:15:41]
and that where the fence wood et cetera,
[1:15:43]
just walk it with them.
[1:15:50]
probably half of those accepted an
[1:15:51]
invitation to meet at their house,
[1:15:52]
so I guess that somewhere
[1:15:53]
around six or seven of those I met with and
[1:15:57]
we did the walk it in the tape measure
[1:15:58]
type program
[1:16:01]
and walked through
[1:16:08]
and spoke of what her plans were,
[1:16:09]
when that would happen, the sequencing. It's
[1:16:10]
a couple years now
[1:16:11]
before the fence would even show up
[1:16:13]
but overwhelmingly, the concern was the visual block
[1:16:16]
, the not having
[1:16:19]
kids walk through blocking off
[1:16:22]
clodfelter and just having
[1:16:23]
that separation and privacy really
[1:16:24]
was a concern and felt like the fence was
[1:16:28]
our best offer.
[1:16:31]
>> thank you.
[1:16:37]
commissioner west, please.
[1:16:40]
>> thank you
[1:16:43]
. Likewise looking back from the original to this one,
[1:16:46]
there was
[1:16:49]
a six-foot privacy fence
[1:16:52]
and the initial one
[1:16:54]
to begin with so I'm not sure I understand
[1:17:05]
when we said go use the additional
[1:17:06]
money to enhance the buffering I was
[1:17:07]
thinking maybe shrubs or something
[1:17:08]
or
[1:17:09]
trees on the other side of that fence.
[1:17:14]
or a berm, or something, so not really
[1:17:15]
--I'm a little confused since the
[1:17:16]
fence was already in existence, you
[1:17:19]
added how many feet
[1:17:27]
is what I'm hearing. How many feet
[1:17:28]
did you add to that?
[1:17:29]
>> I think we have
[1:17:30]
an image
[1:17:31]
we can show you before and after.
[1:17:32]
that when that is up there right now
[1:17:33]
would be the before. That is just the entrance
[1:17:35]
there at the northern part. That was
[1:17:35]
the only place there was a fence at
[1:17:36]
our last
[1:17:37]
meeting, so we decided
[1:17:43]
since then, the fence --
[1:17:44]
if you look at that map there on the left
[1:17:45]
side of the map, that entry there
[1:17:46]
have fencing on it
[1:17:48]
and on both sides of the street we
[1:17:49]
met with the property owners there
[1:17:51]
and did the same thing, just walked it
[1:18:02]
. One of the solutions we had was
[1:18:03]
to put a fence there, which we decided
[1:18:04]
to do and that is what we showed at
[1:18:05]
the last
[1:18:06]
meeting. Since the last meeting we've
[1:18:08]
gone back and met with the other property owners
[1:18:10]
along sure and not a defense the
[1:18:11]
entire length of the property all
[1:18:12]
the way down past the southern entrance and
[1:18:13]
the
[1:18:16]
furthest property down sure, -- shearer
[1:18:22]
, you can see
[1:18:23]
the fence has the arrows pointing.
[1:18:24]
it is the entire redline that you
[1:18:25]
see is a fence line.
[1:18:32]
>> so, what was the previous? >> previous
[1:18:34]
was just at the entry right where that is highlighted.
[1:18:40]
>>
[1:18:43]
[ inaudible ]
[1:18:46]
we really just focus on every
[1:18:49]
parcel we would touch
[1:18:52]
[ inaudible ]
[1:19:00]
>> okay, thank you. >> and, my understanding
[1:19:01]
is that it still has
[1:19:04]
the buffer trees up on the top left portion.
[1:19:12]
so you get both, actually.
[1:19:13]
>> the
[1:19:14]
trees, as well? Okay, thank you.
[1:19:15]
>>
[1:19:16]
they will be on the hoa side.
[1:19:25]
we reviewed what happens if we get another
[1:19:26]
storm in the storm hits
[1:19:27]
the fence. That is the hoas responsibility
[1:19:28]
to fix the storm.
[1:19:31]
managing the hoa until the
[1:19:33]
last home is built, so we would be
[1:19:34]
managing that.
[1:19:35]
>> thank you.
[1:19:40]
>> [ inaudible ]
[1:20:07]
>> I want to
[1:20:10]
reiterate what miss calls --
[1:20:14]
commissioner qualls is saying. Something's
[1:20:16]
going to be built there.
[1:20:19]
either hundred and 30 your hundred
[1:20:20]
and 87.
[1:20:22]
something is going to go there . With
[1:20:23]
improvements are without improvements.
[1:20:25]
traffic
[1:20:28]
is going to be there,
[1:20:31]
be
[1:20:33]
it two cars or four cars. It's hard, guys.
[1:20:37]
I've got the emails. I've
[1:20:40]
made the phone calls.
[1:20:43]
it's hard for me to tell you what's the right one.
[1:20:46]
something is going to go there. Buffers
[1:20:49]
that can help you or nothing.
[1:20:54]
I mean, it's not an easy thing to sit here.
[1:21:11]
I've read your email. I hear
[1:21:12]
your concern. I hear mr. Beck's concern.
[1:21:13]
I hear your concerns over there. I've
[1:21:14]
got your email. I've heard your concern.
[1:21:15]
I hear it. Something is going
[1:21:16]
to go in there. Do we want the best something
[1:21:17]
or do we want it to just be something.
[1:21:18]
I will be honest, I'm struggling.
[1:21:19]
I don't know what the right answer is.
[1:21:23]
anyone else?
[1:21:35]
so, bored, if you don't mind
[1:21:36]
for a second, I've been born and raised
[1:21:38]
here in this is my word and it's interesting that
[1:21:45]
sharon brings up the home real estate
[1:21:46]
and billing real estate and is a look
[1:21:47]
at the project in
[1:21:48]
warsaw when we are actually saying
[1:21:49]
you could have up to eight units under
[1:21:50]
current zoning for this piece of property
[1:21:51]
would fall under 2.87,
[1:21:53]
we have all set here
[1:21:54]
for a long time and that is pretty
[1:21:56]
low, but also way out the fact
[1:21:59]
that with the trails,
[1:22:02]
the greenway going through,
[1:22:11]
what
[1:22:12]
they have done, how we've stopped
[1:22:13]
the connection from clodfelter, there is
[1:22:14]
a little bit of a win here. Should
[1:22:15]
there be more road improvements? Absolutely,
[1:22:16]
across
[1:22:17]
the state, but I do sit here and look
[1:22:18]
under the court of law and what and
[1:22:20]
how we are guided
[1:22:33]
. This one here is almost like a no-brainer
[1:22:34]
for the fact that the density is so
[1:22:35]
low compared to moores mill
[1:22:36]
and I'm tired of growth, myself but
[1:22:37]
as you sit there and talk, something
[1:22:38]
is going to go there and at the end
[1:22:39]
of the day,
[1:22:40]
to me, you are kind of shooting at the
[1:22:43]
middle. I'm not too sure under raleigh's
[1:22:44]
condition, the denial is that you
[1:22:47]
can defend that because
[1:22:58]
at the end of the day were talking
[1:22:59]
56 units compared to a right of 131
[1:23:00]
and you
[1:23:01]
could say you could have as many as
[1:23:03]
eight and I look at it from that legal perspective
[1:23:04]
because we all sit in these closed session
[1:23:04]
meetings and
[1:23:05]
try to figure out how we win again
[1:23:06]
but just my comment from where
[1:23:14]
I live when I look at a project is
[1:23:15]
if you
[1:23:16]
cannot defend it legally and where
[1:23:17]
I can't, this one here, in my book,
[1:23:18]
would be pretty tough, so thank you
[1:23:19]
all.
[1:23:20]
anymore comments or questions for
[1:23:21]
the applicant or anyone else?
[1:23:25]
>> thank you. Just for the record,
[1:23:26]
I want to confirm
[1:23:29]
the revised conditions
[1:23:32]
of the ordinance here.
[1:23:33]
there are nine conditions with the change
[1:23:39]
to condition seven, which was to not include
[1:23:40]
a road or pedestrian connection to
[1:23:48]
clodfelter than condition nine, which
[1:23:49]
was to provide a six-foot vinyl fence
[1:23:50]
within the eight-foot buffer. Thank you.
[1:24:03]
>> okay, board members. At this time I'm
[1:24:04]
going to entertain a motion so please.
[1:24:19]
>> I would like to make a motion to approve
[1:24:20]
the request with conditions the planning
[1:24:21]
board and staff recommendation again
[1:24:22]
a motion to approve cz-2024-10 rezoning
[1:24:24]
of the site to a traditional neighborhood with
[1:24:29]
added conditions to eliminate the
[1:24:30]
connection to
[1:24:32]
clodfelter and enhanced
[1:24:39]
landscaping the project is consistent
[1:24:40]
with the one moores mill comprehensive
[1:24:41]
plan. The proposal is consistent with
[1:24:42]
desired density, primary
[1:24:43]
uses and the opportunity described
[1:24:44]
in the neighborhood character area.
[1:24:45]
the request is reasonable
[1:24:49]
and public interest in the project
[1:24:50]
includes conditions to minimize
[1:24:52]
the impact on the adjacent properties.
[1:25:00]
>> commissioner qualls has made a motion.
[1:25:01]
I have a second from commissioner
[1:25:02]
west. All in favor.
[1:25:03]
>> aye.
[1:25:05]
>>
[1:25:08]
can we see hands?
[1:25:11]
>> any opposed?
[1:25:20]
>> okay, so that has failed. >> so
[1:25:21]
I guess without the mayor being here
[1:25:28]
, that fails. The mayor is not here
[1:25:29]
to make that decision for us, so thank you all.
[1:25:32]
>> I would suggest
[1:25:33]
that we do adopt a statement of reasonableness
[1:25:38]
to deny the request and see where that wetlands.
[1:25:43]
if one of the members who opposed
[1:25:44]
could make that motion.
[1:25:50]
>> one of you guys want to entertain that motion?
[1:26:04]
commissioner deweese please.
[1:26:05]
>> motion to
[1:26:06]
deny cz-2024-10 because it is consistent
[1:26:07]
with the mooresville
[1:26:08]
one plan. It does not match
[1:26:11]
because it is too intense
[1:26:14]
for the existing area.
[1:26:17]
>> is there a second? >> second.
[1:26:20]
just under discussion to help me
[1:26:26]
can we go back to a 3-3?
[1:26:27]
>> the request is failed
[1:26:29]
because the motion to approve did not pass
[1:26:34]
. This is really logistically to have
[1:26:36]
a statement of reasonableness to support that decision.
[1:26:38]
>> okay, so all in favor
[1:26:41]
with
[1:26:44]
commissioner deweese's motion?
[1:26:47]
>> aye. >> okay.
[1:26:50]
thank you all very much.
[1:26:53]
so mr. Cole,
[1:26:56]
item number 7b, this
[1:26:59]
is the annexation piece
[1:27:02]
continued. What are we doing
[1:27:10]
>> the applicant
[1:27:11]
will withdraw that request at this
[1:27:12]
time.
[1:27:13]
>> at this time it has been withdrawn.
[1:27:30]
so,
[1:27:33]
we will help clarify.
[1:27:39]
>> just for the audience,
[1:27:44]
the item lanterna request has been denied.
[1:28:01]
mr. Cole, could you provide the options for
[1:28:02]
the developer to bring the project
[1:28:03]
that?
[1:28:04]
>> under the unified development ordinance for
[1:28:05]
the project is denied the
[1:28:06]
developer can wait a year and bring back
[1:28:07]
a new request or
[1:28:09]
they can petition this group
[1:28:27]
at
[1:28:28]
a future meeting for a waiver of that
[1:28:29]
waiting period and can come back sooner.
[1:28:31]
additionally, they can make substantial modifications
[1:28:31]
and essentially make any request,
[1:28:32]
which might include substantial modifications to
[1:28:33]
the plan itself to come back within
[1:28:34]
a year.
[1:28:35]
>> thank you, sir. Appreciate
[1:28:36]
that. Our
[1:28:37]
next item is 7c
[1:28:42]
to consider a request from planning
[1:28:43]
and community development to approve
[1:28:45]
an ordinance for conditional rezoning cz-2024-11 for
[1:28:48]
0.8 a four-acre site located
[1:28:50]
off 106 bridgewater line. At this time we will
[1:28:58]
open the public hearing and recognize mr.
[1:29:00]
cole.
[1:29:01]
>> this is for a small site located
[1:29:02]
on williamson road
[1:29:03]
which is adjacent to exit 33 area.
[1:29:12]
this is also in
[1:29:13]
ward 1. The applicant is magnolia
[1:29:14]
property group llc. The property is
[1:29:15]
already in town limit so this was
[1:29:16]
a standalone
[1:29:17]
conditional rezoning request. Currently,
[1:29:18]
the property is
[1:29:19]
zoned corridor mixed-use switches
[1:29:25]
a mixed-use and commercial district.
[1:29:26]
it is also located in a critical watershed
[1:29:30]
which caps the site
[1:29:35]
and impervious areas so tonight the
[1:29:36]
applicant is requesting conditional mixed-use
[1:29:37]
zoning
[1:29:38]
so just for context conditional zoning
[1:29:39]
is required because they are proposing
[1:29:42]
drive-through on the site.
[1:29:47]
this is in front of the food lion
[1:29:48]
which is part of the watermark shopping
[1:29:49]
center so
[1:29:50]
it is adjacent to a bank, a gas station
[1:29:51]
and an arby's restaurant.
[1:29:56]
here's the proposal. It is for a 2500
[1:29:57]
ft.? Drive-through restaurant and
[1:30:14]
it would, because it constitutes development
[1:30:15]
of an existing out parcel, it was
[1:30:16]
sure the existing shopping center
[1:30:17]
access, which is located here along
[1:30:18]
bridgewater lane, just for reference
[1:30:19]
also, this is williamson road, which
[1:30:20]
runs north to south.
[1:30:21]
the development would orient the building
[1:30:22]
to bridgewater lane with a drive-through
[1:30:23]
stacking area plan. The development
[1:30:24]
would also
[1:30:27]
provide the frontage upgrades
[1:30:29]
as required by the udo including a shared use
[1:30:33]
paths along williamson road.
[1:30:40]
so here just to orient you all it
[1:30:41]
is a starbucks that is proposed here
[1:30:42]
currently adjacent to the abc store
[1:30:44]
over across bridgewater lane and some retail uses.
[1:31:02]
so, the conditions associated with
[1:31:03]
the site currently there are four. That
[1:31:04]
would be adherence to the
[1:31:05]
concept plan you see here, a series
[1:31:06]
of use restrictions which would narrow
[1:31:07]
uses to the drive-through restaurant
[1:31:08]
and potentially compatible uses should
[1:31:09]
the user change
[1:31:10]
in the future, medications if required
[1:31:12]
for the change of use and also a density averaging
[1:31:12]
certificate which is a little unique and
[1:31:13]
I'm happy to explain it further.
[1:31:18]
these are the uses that are currently allowed
[1:31:19]
on the site
[1:31:20]
in the bayreuth cm district so this
[1:31:21]
is a pretty broad retail commercial district.
[1:31:24]
these
[1:31:27]
would all be use restrictions so
[1:31:32]
should this request past tonight there
[1:31:33]
would only be a few that would be allowed,
[1:31:34]
drive-through restaurant of course
[1:31:36]
being one of them.
[1:31:38]
with density averaging, the site is here
[1:31:42]
, this gold star
[1:31:45]
. Currently the
[1:31:47]
site is proposing 70% impervious area which is above
[1:32:00]
the cap of 50% in the critical watershed so
[1:32:01]
the applicant, one of
[1:32:02]
the four conditions is that before they
[1:32:04]
can develop the site, they are required
[1:32:04]
to seek a density-averaging certificate
[1:32:05]
from the board of
[1:32:06]
adjustment that would allow
[1:32:09]
transfer of
[1:32:10]
that additional 20% impervious area
[1:32:11]
from one of the sites across williamson
[1:32:12]
road to the subject property. That is
[1:32:13]
something that is a process
[1:32:14]
allowed by the state and should the
[1:32:16]
request be approved tonight,
[1:32:17]
they would be required to have that issue.
[1:32:23]
because this is a conditional request
[1:32:25]
there was a
[1:32:26]
neighborhood meeting required held
[1:32:30]
that was a virtual meeting and advertise to
[1:32:34]
adjacent
[1:32:37]
property owners.
[1:32:43]
we would consider this
[1:32:51]
consistent with our standards. There
[1:32:52]
is only one small inconsistency with
[1:32:53]
one
[1:32:54]
mooresville. One mooresville considers
[1:32:56]
this area mixed-use corridor and commercial character.
[1:33:07]
this
[1:33:08]
is just looking to add another commercial use
[1:33:09]
to the next so it is compatible with adjacent
[1:33:10]
usages and future character map. The
[1:33:11]
only inconsistency is
[1:33:12]
one mooresville considers mixed-use corridor
[1:33:13]
is more of a pedestrian walking style.
[1:33:21]
however, it is worth noting there
[1:33:22]
are other drive-through uses adjacent
[1:33:23]
to the site
[1:33:24]
already. We do recommend approval of the request.
[1:33:29]
that concludes my presentation. The applicant is
[1:33:30]
also here to present some information
[1:33:31]
and happy to take questions.
[1:33:40]
>> does anyone have any comments or
[1:33:41]
questions? Is the applicant prepared?
[1:33:44]
would you like to come forward, please.
[1:33:54]
>> my name is martin friday with magnolia property group
[1:33:59]
. This is jesse hamlin with blue ridge
[1:34:00]
engineering. Can you hear me okay?
[1:34:07]
I guess I will go through these
[1:34:09]
even though that was an excellent
[1:34:10]
presentation of the facts.
[1:34:16]
think everybody is aware of the
[1:34:19]
ncdot
[1:34:22]
project in process as far
[1:34:25]
as the planning design .
[1:34:28]
completed the traffic study and
[1:34:31]
I don't think we have any mitigation requirements.
[1:34:36]
the property is right in front of the
[1:34:40]
arby's with the drive-through
[1:34:43]
. Certainly understand
[1:34:44]
the one mooresville plan and will
[1:34:45]
point out this is adjacent to the interstate
[1:34:49]
, so it certainly seems like an appropriate
[1:34:51]
place for drive-through uses . I think
[1:34:52]
there is also a drive-through
[1:34:58]
[ inaudible ] across the street.
[1:35:01]
that is the information
[1:35:04]
on the project and site plan.
[1:35:07]
we worked
[1:35:08]
probably for two years on the site plan to
[1:35:11]
come to an agreement that makes everyone happy
[1:35:13]
with the
[1:35:15]
design and the layout between the two ordinances
[1:35:19]
. The good design, the
[1:35:22]
building is oriented towards
[1:35:24]
wilson road. It's got a patio feature
[1:35:28]
on the front of the building
[1:35:31]
, covered patio ,
[1:35:34]
a lot of glass on
[1:35:37]
the ridgewater lane side. And
[1:35:40]
I will go back
[1:35:43]
. A lot of landscaping along
[1:35:44]
the front, too as well as pedestrian way.
[1:35:46]
and I guess I
[1:35:49]
should also point out
[1:35:52]
the stacking is through the internal portion
[1:35:55]
of the overall development
[1:35:58]
which is by
[1:36:07]
bb belt, as
[1:36:08]
well. Either jesse or myself will
[1:36:09]
be happy to answer any questions if you
[1:36:10]
have any.
[1:36:11]
>> comments or questions for the applicant?
[1:36:14]
>> thank you. Just for the record
[1:36:16]
on page 112 and 113
[1:36:24]
, there is a draft ordinance with
[1:36:25]
four proposed conditions. I just wanted
[1:36:26]
to confirm you are agreeable to those
[1:36:27]
conditions.
[1:36:28]
>> yes. >> thank you.
[1:36:31]
>> any comments or questions?
[1:36:34]
next
[1:36:36]
is we don't have anyone from the public
[1:36:40]
signed up to speak on this matter so
[1:36:43]
at this time we will
[1:36:46]
close the public hearing
[1:36:49]
and entertain a motion.
[1:37:04]
commissioner qualls, please.
[1:37:05]
>> make a
[1:37:06]
motion to approve cz 2024-11 because
[1:37:07]
the proposal is consistent with the
[1:37:08]
towns one mooresville plan specifically
[1:37:09]
the proposal to develop an info site
[1:37:10]
with commercial use that largely conforms
[1:37:11]
with the projected character
[1:37:13]
of
[1:37:14]
the mixed-use corridor future land use
[1:37:16]
and the character area on the condition
[1:37:18]
that requires adherence
[1:37:19]
to ws
[1:37:22]
four watershed standards, the density
[1:37:25]
proposal is
[1:37:26]
reasonable and it will provide retail
[1:37:31]
and a logical location amongst
[1:37:34]
similar uses among a
[1:37:35]
similar thoroughfare providing active
[1:37:40]
transportation improvements in alignment
[1:37:44]
with the towns pedal plan
[1:37:47]
and one mooresville plan.
[1:37:48]
>> I will second that.
[1:37:53]
all in favor.
[1:37:58]
>> aye. >> oppose? Motion carries.
[1:38:02]
thank you all. Congratulations.
[1:38:05]
you got something to stick.
[1:38:12]
our next item
[1:38:15]
is agenda item 7d and
[1:38:18]
it is a request
[1:38:21]
from the planning and
[1:38:22]
community development to improve -- a proven ordinance
[1:38:41]
for 137 lorenzo line. With that I
[1:38:42]
open it up to public hearing and recognize
[1:38:43]
mr. Cole. Thank you.
[1:38:44]
>> thank you,
[1:38:45]
mr. Mayor pro tem. This is a standalone
[1:38:46]
annexation request, 137 lorenzo lane
[1:38:47]
, so the owner and the applicant tonight
[1:38:51]
are
[1:38:54]
tim and dana
[1:38:59]
derylak. This is a voluntary continuous
[1:39:00]
annexation adjacent
[1:39:02]
to the towns boundaries. It is currently located
[1:39:09]
in our etj so it
[1:39:12]
already carries town zoning.
[1:39:19]
properties adjacent to it on three sides.
[1:39:20]
there is no zoning change or development
[1:39:21]
proposed with this request so the
[1:39:22]
purpose of
[1:39:23]
the request is to annex them recombine
[1:39:24]
with the property adjacent to it along sure
[1:39:30]
road to brent fee-simple access
[1:39:31]
to the subject property so currently
[1:39:32]
it is just there to accommodate a single-family home
[1:39:33]
that
[1:39:34]
is the proposed continued use of the site.
[1:39:41]
there are both water and sewer available on scherz road.
[1:39:49]
property was within the preferred
[1:39:50]
four-minute response time. That is
[1:39:51]
just down the road from station three.
[1:39:54]
both
[1:39:55]
police and public works sanitation
[1:39:57]
can service the site.
[1:40:00]
therefore staff recommends approval
[1:40:03]
of the annexation request.
[1:40:07]
and, the applicant is also present
[1:40:09]
if you have any questions.
[1:40:12]
>>
[1:40:13]
board members, comments, questions?
[1:40:20]
commissioner qualls please.
[1:40:21]
>> are the
[1:40:22]
applicants the current owners of this property?
[1:40:29]
>> yes, ma'am. >> reflected on the
[1:40:30]
tax bill?
[1:40:31]
>> that is
[1:40:32]
my understanding. They may be able
[1:40:33]
to speak to that further.
[1:40:36]
>> would we like
[1:40:39]
to invite them forward?
[1:40:48]
>>
[1:40:51]
good evening.
[1:40:52]
I tend derylak. I reside at 124 lorenzo line.
[1:41:11]
I didn't quite hear the question, commissioner
[1:41:12]
qualls.
[1:41:13]
>> are you the current
[1:41:14]
owner of this property?
[1:41:15]
>> we own
[1:41:16]
three parcels. We have the house at 970
[1:41:17]
scherz road in front of this parcel.
[1:41:18]
it is already in the
[1:41:19]
city limits. We have the nearly 3
[1:41:20]
acres in the back of that that is
[1:41:21]
outside the city limits at 137 lorenzo
[1:41:22]
lane, then we have
[1:41:23]
a house and reside at 124 lorenzo lane so
[1:41:24]
ultimately we are renovating the house
[1:41:25]
up on scherz road. We are looking
[1:41:26]
to do a recombination to give ourselves
[1:41:29]
our own driveway that we own from
[1:41:30]
scherz road back to
[1:41:34]
our house at 124 lorenzo lane and
[1:41:35]
in the process we will maintain that lot
[1:41:39]
we are asking to be annexed in the house will
[1:41:44]
either eventually be rented or sold off
[1:41:45]
but while we own the house up on
[1:41:48]
shira's reverie took this
[1:41:54]
opportunity to get the combination
[1:41:55]
to do
[1:41:56]
our own driveway. Right now it is
[1:41:57]
just an easement in the previous owners
[1:41:58]
did not take care of the property at all.
[1:42:02]
>> it was this year back in april or may.
[1:42:07]
>> any comments or questions for anyone?
[1:42:09]
okay. Thank you all.
[1:42:12]
>> thank you.
[1:42:15]
we have
[1:42:16]
no one signed up for public comment so
[1:42:17]
at this point we will close the public
[1:42:18]
hearing
[1:42:21]
and entertain a motion.
[1:42:24]
commissioner
[1:42:26]
deweese is made a motion. Do I have a second?
[1:42:39]
I didn't
[1:42:40]
quite hear the question, commissioner qualls.
[1:42:41]
>> are you the current owner of this
[1:42:42]
property?
[1:42:43]
>> we own three parcels.
[1:42:44]
we have the house at 970 shearers
[1:42:45]
road in front of this parcel. It is
[1:42:46]
already in the city limits. We have
[1:42:47]
the nearly 3 acres in the back of
[1:42:48]
that that is
[1:42:49]
outside the city limits at 137 lorenzo
[1:42:50]
lane,
[1:42:51]
>> all right, we will give it
[1:42:52]
to you tonight. We
[1:42:53]
have a motion by commissioner deweese,
[1:42:54]
second by commissioner aven. All in favor
[1:42:56]
>> aye. >> any opposed? Motion carries.
[1:43:09]
our next item
[1:43:14]
is seven lottery to consider a request from
[1:43:15]
planning and community development department to
[1:43:20]
schedule a public hearing for land-use item.
[1:43:26]
mr. Cole, please.
[1:43:27]
>> thank you, sir. Previously
[1:43:30]
this board scheduled the mackenzie bluffs neighborhood
[1:43:42]
which is cz-2024-09 and
[1:43:43]
ax-23 4-04 out to december 9th for
[1:43:44]
discussion. The only other item we
[1:43:45]
have scheduled for this evening is
[1:43:55]
1740-1814 mecklenburg highway which
[1:43:56]
we are also proposing beta scheduled
[1:43:57]
on november 4th.
[1:43:58]
>> any questions?
[1:44:04]
with
[1:44:05]
all that being said, would anyone like
[1:44:06]
to make a motion please?
[1:44:07]
>> so moved.
[1:44:12]
>> commissioner west made a motion.
[1:44:13]
second by commissioner deweese.
[1:44:15]
all in favor?
[1:44:16]
>> aye. >> motion carries.
[1:44:19]
our next item is
[1:44:22]
7f .
[1:44:34]
>> thank you, mayor pro tem. This is
[1:44:35]
a request from an outside party, langtry development company.
[1:44:38]
the request tonight is to have an
[1:44:39]
agenda item placed on your upcoming agenda
[1:44:43]
. Town staff received this
[1:44:46]
request from langtry development
[1:44:47]
and they are requesting this be scheduled
[1:44:49]
at a future date
[1:44:50]
. The ultimate request that would
[1:44:52]
be heard if you do
[1:45:00]
choose to schedule this tonight would be
[1:45:01]
a request for the
[1:45:02]
board to waive our voluntary annexation
[1:45:03]
utility extension policy as applies to 179
[1:45:13]
transco
[1:45:14]
road and to authorize connection of
[1:45:15]
that property to town water and sewer
[1:45:16]
so the only action you're being asked
[1:45:17]
for tonight is whether to schedule
[1:45:19]
this item for a future date.
[1:45:20]
>> I will start it. What you are saying
[1:45:25]
is [ inaudible ]
[1:45:31]
gotcha. Comments or questions?
[1:45:39]
commissioner west.
[1:45:40]
>> mayor pro tem, I
[1:45:41]
have thought long and hard about this
[1:45:42]
one. I took some time and thought
[1:45:43]
about it on the weekend and I noticed
[1:45:44]
just a request to rehear this
[1:45:46]
, but I go back to
[1:45:50]
over a year ago when this came before
[1:45:52]
us and I did not like it then.
[1:45:55]
you know, we did not have the land that
[1:45:58]
we wanted to use for
[1:46:02]
the department set up to support that
[1:46:03]
area. We did not even have the agreement
[1:46:06]
back from the east-west. We did not
[1:46:07]
even know how much it was
[1:46:10]
going to cost us.
[1:46:13]
at that time I did
[1:46:14]
ask them, would they be willing to
[1:46:15]
at least wait until we had the infrastructure in place first
[1:46:22]
and that is the unicorn, right?
[1:46:23]
we got this federal grant, not the
[1:46:24]
state. We got a federal grant to create
[1:46:25]
great infrastructure down there.
[1:46:28]
they
[1:46:29]
said no. They were going to move forward with it.
[1:46:33]
in the last but not least is that board split
[1:46:39]
, there are three of us appear that
[1:46:40]
voted no for it, not and
[1:46:43]
--
[1:46:52]
when that second board came up three of
[1:46:53]
us voted
[1:46:54]
no on it. It was high-density. I didn't
[1:46:55]
like that. When they singled us out with
[1:46:56]
an intent to hold
[1:46:57]
that ms. Crawford received, singling
[1:46:58]
out the three of us,
[1:47:01]
commissioner qualls and you,
[1:47:09]
mayor pro tem dangler and myself I
[1:47:10]
said that I'm not going to be bullied
[1:47:11]
and intimidated by this and I will
[1:47:12]
say it again. After thinking more
[1:47:13]
about it on this weekend, if the board
[1:47:14]
wants to rehear
[1:47:16]
it, they can. I
[1:47:22]
in no all day long again.
[1:47:23]
I don't trust them. It's not in the best
[1:47:24]
interest of the town of mooresville.
[1:47:25]
>> thank you. Any other comments?
[1:47:36]
>> it gets a little bit wonky like is
[1:47:37]
this a request for annexation
[1:47:40]
? This is a request to waive our rules
[1:47:44]
>> this is
[1:47:45]
merely a request to be scheduled at a later date.
[1:47:48]
it is a request that came in normally
[1:47:49]
, town staff
[1:48:02]
is the only person who can add things to
[1:48:03]
the agenda. Roles and procedure allow
[1:48:04]
for an outside party to add an item to
[1:48:05]
the agenda
[1:48:06]
so this is only a request to be scheduled
[1:48:07]
at a future date.
[1:48:12]
the request, if you choose to schedule
[1:48:13]
it tonight, would be
[1:48:16]
heard at that time.
[1:48:19]
>>
[1:48:21]
at this time, I will call for a motion.
[1:48:25]
>>
[1:48:31]
mayor pro tem, I
[1:48:33]
will make a motion to deny the request to
[1:48:34]
place this
[1:48:37]
item on the agenda.
[1:48:38]
>> commissioner west is made a motion. We have a second?
[1:48:48]
I believe from this position I can
[1:48:49]
make a second so I will make that
[1:48:50]
second. Any
[1:48:52]
discussion on the motion?
[1:48:58]
all those in
[1:49:01]
favor please say aye.
[1:49:03]
>> I go. >> any opposed? Motion carries.
[1:49:12]
our next item , number eight, is
[1:49:14]
new business. Would any
[1:49:15]
board member have any new business
[1:49:16]
you would like to discuss at this time?
[1:49:25]
I will be honest, I really appreciate that tonight.
[1:49:36]
our next item
[1:49:37]
is closed session and under closed
[1:49:38]
session we are going to consult with
[1:49:39]
the attorney under gs143-318.11 a13
[1:49:43]
, langtry development company
[1:49:45]
versus the town of mooresville, the
[1:49:46]
economic development gs143-318.1 1a4
[1:49:53]
. Item c is acquisition of property gs143-318.1
[1:50:00]
1a5 then personnel, gs 143-318.11a6.
[1:50:07]
>> motion going to close session.
[1:50:12]
>> commissioner west made a motion.
[1:50:16]
commissioner karriker a second that motion.
[1:50:18]
all in favor please say aye.
[1:50:20]
>> we are in closed session.
