[1:39:50] But that case involved a swimming pool, well for a simple application, that was found to be

[1:40:02] The pool was moved into the setback to avoid sensitive lands, which is similar to what we
[1:40:07] have here.
[1:40:07] Harchup was found to be based on the land and not the building or the development or the structure
[1:40:12] per se.

[1:41:41] the parking lot in the front.
[1:41:43] We are looking at relief here as the front setback,
[1:41:46] The proposed building is essentially going to be nestled into a green area where the four buildings are
[1:41:53] Slightly closer to the road than where those existing building line is established, but as you can see
[1:41:59] Not nearly as close to the street line as the building that would be immediately to the north, and that's the office building
[1:42:06] And then if we pan to the second view, which would be a three dash two
[1:42:11] So, depending more to the southeast, you can see that we've got the if the restaurant, which
[1:42:17] is also closer to the road than the subject development is going to be.
[1:42:23] So, while we're looking for relief related to, again, the positioning of the building, not the
[1:42:28] size of the building per se, there is a basis for that relief by virtue of the fact that this
[1:42:33] is not going to look at a place as an infill development, considering what's around it in
[1:42:38] building's closer. Again, the overall building coverage is going to comply, the
[1:42:43] lot coverage is going to comply, the building height, the flow area, and no relief
[1:42:47] has to the size of the building. It's just the positioning of the building at the
[1:42:51] applicant is looking for the relief. Again, as an infill development, we think
[1:42:55] there's good compatibility there. The third view frame A3-3 is if you're looking
[1:43:03] west to the developing property across the street. And again, you get a sense of
[1:43:07] massive scale of that compared to the subject, and again, the beautiful landscape that
[1:43:12] defines your town, the rugged terrain, and the wrap around the effect of that buffering.
[1:43:18] And then finally, the last view is a top-down view sort of a plan view of existing conditions,
[1:43:23] which you've seen from Mr. Manilio's plan A3-4, about the four buildings, the new building
[1:43:30] will situate behind that parking area. Essentially, working the building into what's already
[1:43:37] there. We know we're renovating or modifying that parking area, but essentially working with
[1:43:44] the front parking area where it is, working with the back parking area where it is, and
[1:43:49] nestling that building in the front. So that all goes towards that C1 hardship criteria as
[1:43:55] relief related to the land, related to the structures that are lawfully existing there on. And
[1:44:01] you think that the board can find legitimate practical difficulties with respect to a retrofit
[1:44:06] reconstruction of a developed site and not wholesale new construction all together.
[1:44:11] The parking areas are there, they're being modified, but the building position is based
[1:44:15] on same.
[1:44:16] There are the woodlands to the rear, I'll call those sensitive lands, which is similar
[1:44:21] or what we saw in the land case.
[1:44:22] That dealt with slopes, staying away from slopes.
[1:44:25] Here keeping the building forward deals with preserving woodlands or wooded areas in
[1:44:31] the back.
[1:44:32] And with that I would say we're by relief relates to the land.
[1:44:35] and the structures, roughly there on, there's a basis for a hardship.
[1:44:39] That would go towards the positive criteria.
[1:44:42] With respect to the negative criteria, I believe based on the evidence we've given you here.
[1:44:47] Setback relief can be granted without substantial detriment to the public or impairment to the zone.
[1:44:52] The building is no closer than those buildings that flank it.
[1:44:55] The relief relates to this 14 foot overhang that you heard about.
[1:45:00] The building core is actually set back at 85.4 feet, which gets us closer to that 90 foot mark that's required by the ordinance.
[1:45:09] And then the project is also going to move closer to the zone scheme to the extent that a non-conforming sidewalk setback is going to be eliminated.
[1:45:18] With that, I would offer that the C2 test. C1 test is met here. The board may find there's an element of C2 as a better alternative with a permitted use.
[1:45:28] a clean reuse of the site in a highland preservation area and the benefit of saving trees and
[1:45:35] positioning the building in the form of a retrofit as opposed to wholesale new construction,
[1:45:40] the board may find that it's a better zoning alternative as well, but I think the strong
[1:45:44] basis for relief is under C1 here. There are some design exceptions which I won't go through
[1:45:51] in detail unless the board wants me to. I know the rationale for all of them were hit by
[1:45:56] Mr. Manilio before me, with respect to their reasonableness and appropriateness under the law.
[1:46:03] And strict or literal enforcement of the standards here, I think, would be impracticable,
[1:46:10] or sort of no practical planning purpose.
[1:46:12] We're looking for parking dimensions, lighting, parking location, and some buffering, again,
[1:46:19] working with the land that is presently there.
[1:46:23] I just heard about the relief related to the science set back as well and we think that's a better zoning alternative for clear and safe identification of the site as well and we think the board can fold that into the overall approval.
[1:46:36] With that, I would offer based on all the testimony, the criteria are met.

[2:08:27] with the approved plan.
[2:08:30] And Mr. Garretty is from the 40, his first two comments were about how we came
[2:08:33] about with the number of parking spaces, and as well as number of cars for us.
[2:08:39] So what I had to work with was the original plan.
[2:08:42] Back from 2000.
[2:08:44] There was a minute plan of 2007, and there was another minute plan in 2018.
[2:08:48] And it traveled as plans put it together and tried to make sense.
[2:08:52] So I went out on site, and I first went out there and expected it, and this plan we have
[2:08:57] right now accurately reflects all of the existing conditions we're going to parking a
[2:09:03] lot, a number of spaces and so forth and what happened.
[2:09:05] And there was a discrepancy in the number of spaces now as there was from the original approval
[2:09:10] thereafter.
[2:09:12] And I can explain some of the discrepancy in all of them, but I can explain some of them.
[2:09:17] During the course of the last few years or so,
[2:09:21] Lowes will restrain the parking lot.
[2:09:23] That's part of maintenance and so forth, whatever.
[2:09:26] Sometimes they'll be paid and then they'll restrain.
[2:09:28] And then when they restrain, they don't need to restrain accurately.
[2:09:32] The last time they restrain, they added some additional parking spaces,
[2:09:38] specific type of parking spaces that cater more towards the customer.
[2:09:42] The biggest one was they could handle parking for contractors.
[2:09:46] So instead of having your normal 9x18 or 10x20 parking space, you now have a 11 foot wide by 40 foot wide angle parking space.
[2:09:55] So it takes 16 parking spaces to convert it to 3.
[2:09:59] So right there you lose 13 parking spaces.
[2:10:02] They also created some customer pickup spaces, and you have striping in there.
[2:10:07] And it takes eight spaces to create six spaces.
[2:10:10] So as you can see, as part of some of the restriping itself for,
[2:10:13] There's a discrepancy in the parking, and it was a number of parking spaces.
[2:10:17] So that does explain some of the discrepancy system is very good, but not all of it.
[2:10:22] But this plan acted or reflects that.
[2:10:24] With respect to the carcarous, those are multiple structures, and they get moved around all the time.
[2:10:30] In order to clean the parking lot, we would have to move to carcarous.
[2:10:33] The parking lot's frequent comes in and speeds up the parking lot, and the winter time,
[2:10:36] you have snowplows, so the carcarous would move around all the time.
[2:10:40] So what I do is I count the number of parked for else,
[2:10:43] and I put the number on the plan, and I try to locate them
[2:10:46] on the places where they're supposed to be.
[2:10:49] But when you go out sometimes, they're not in the exact location,
[2:10:52] but they are accounted for.
[2:10:53] So when doing that, I create it a plan,
[2:10:56] in which we have the exact number of strike parking spaces.
[2:11:00] We reduce out the number of parked for else, which is 13.
[2:11:04] We then deduced out the number of parking spaces
[2:11:06] that she used for outdoor storage, and we come up
[2:11:09] the final number, so we had 675 spaces counted, 13 spaces, carcaraels, 33 spaces for
