>> Oh, okay.
[0:07]
[laughter]
>> Work our way through this.
[0:10]
» Yeah,
>> I've got 5:00. I'll call the meeting to
[0:14]
order. Roll call.
>> Yeah, go ahead.
[0:18]
» Okay. Mr. Bay
>> here.
[0:21]
» Mr. Row
>> here.
[0:23]
» Mr. Shields
>> here.
[0:25]
» Mr. Diesson
>> here. Mr. Cessville here. Mr. Evans
[0:29]
» here.
>> Miss Sanders
[0:31]
» here.
>> Miss Green
[0:32]
» here.
>> All members present.
[0:35]
Anyone have a any comments about the
minutes of the last meeting?
[0:40]
If not, I'd entertain a motion to
approve those.
[0:44]
» Second.
>> I got a motion and a second.
[0:46]
» Okay.
With a motion and
[0:51]
» evidence. Okay. Sorry.
>> Okay. And I have a motion in second. Uh
[0:57]
I guess We'll go roll call again. Mr.
Bay,
[1:01]
» yes.
>> Mr. Row,
[1:03]
» yes.
>> Miss Shield,
[1:05]
» Mr. Shields,
>> yes.
[1:07]
» Mason,
>> yes.
[1:09]
» Miss Suspel,
>> yes.
[1:11]
» Mr. Evans,
>> yes.
[1:13]
» Miss Sanders,
>> yes.
[1:14]
» Miss Green,
>> here.
[1:15]
» Okay. Motion carries. All right. Um,
I would also like to have a a motion to
[1:24]
change the agenda. I think all our
visitors out there uh are here for one
[1:30]
item that's a non-aggenda item. Is there
anyone there with an agenda item?
[1:35]
» Okay. Uh if we could go ahead and have
that part of the meeting, we save them a
[1:40]
lot of time having to sit through the
rest of it
[1:43]
» or we just ask them to move it public
comments.
[1:47]
» To administer non agenda items nine to
uh take that up at this point.
[1:53]
» Mr. Chairman, I move we amend the agenda
to go ahead and take up item number nine
[1:57]
at the first of our agenda for tonight.
Second.
[2:01]
» I have a motion and a second.
>> Roll call. Mr. Bay,
[2:07]
» yes.
>> Mr. Row,
[2:09]
» yes.
>> Mr. Shields,
[2:10]
» yes.
>> Mr. Diesel,
[2:12]
» yes.
>> Mr. Cesold,
[2:14]
» yes.
>> Mr. Evans,
[2:15]
» yes.
>> Miss Sanders,
[2:17]
» yes.
>> Miss Green,
[2:18]
» yes.
>> Okay, so done.
[2:21]
John, would you like to go now?
[2:31]
» This is John Bur who live out on Guian
Drive and we got a situation out there
[2:35]
that I really don't know what to do with
according to the charter. I have to
[2:40]
enforce all ordinances.
So, I don't know if it's ordinance here,
[2:45]
but somebody had moved in. They bought
bought a house and they started a
[2:49]
business
of some kind. What what do they call it?
[2:54]
» Treatment facility.
>> It's uh Soaring Eagle Sober Living One
[2:59]
LLC.
>> And they have got an LLC through the
[3:04]
Secretary of State. I don't think they
have an ID number with our local tax
[3:09]
commission that you know about.
>> I I've called the tax commission. and
[3:12]
they haven't screwed with them. So, and
they haven't uh filed for any permits
[3:18]
nor an application to do any resoning.
>> And of course, what is the name of
[3:22]
subdivision?
>> Shadow Brook subdivision.
[3:25]
» So, so they have the covenant, you know,
no business, no vehicle for sale, so on
[3:30]
like all covenants. So,
so we just need to get some guidance on
[3:36]
what I need to do as past president to
stop this. And the only thing we have in
[3:42]
place to uh
the teeth end of these ordinances is
[3:47]
electrical ordinance. So
y'all talk about it and see what we need
[3:51]
to do with it.
Um if they haven't filed an application
[3:55]
for a permit and don't have a legal
permit and they've got an electrical
[4:00]
service, I believe uh the service can be
disconnected and they have to go would
[4:05]
have to go through the process.
>> Well, are they already in there?
[4:11]
Yes, someone stays there with no
patience as you would call them, but
[4:16]
there's someone that's there every day.
>> They they have put a piece in the paper
[4:20]
trying to find a manager to run the
thing. So, they are trying to get
[4:24]
established
>> and they're also going to open. This is
[4:27]
a men's facility that they're trying to
open in our neighborhood.
[4:30]
» I mean, I understand you talking about
cut the power off. You can't cut the
[4:33]
power off if the bill is paid.
>> If the what? If the light bill is paid,
[4:39]
you can't everything is in current
standard. You you don't have no right to
[4:41]
cut the power.
>> Well, I don't know about that. That's
[4:44]
what I'm trying to find out. But that's
what the ordinance is raised in
[4:48]
electrical service.
>> Well, if it would, it' be a first
[4:54]
because I was
>> I wasn't going to go out there first. I
[4:56]
going to send somebody out.
>> No, no. What I'm saying is normally they
[4:59]
don't do it like that.
>> How they do it? Well,
[5:02]
» I mean, the slip code not
>> require a permit to put it into the
[5:07]
business name, I would think.
>> Well, they they should have come before
[5:11]
this body before they ever did anything
even get an they got the electricity
[5:16]
switched over without even coming to get
a permit.
[5:19]
» Well, what they did they probably put
they didn't put it in the name of the
[5:22]
business probably
>> put it in their name.
[5:25]
» Yeah.
There there are some code limits to the
[5:29]
number of people that can be in that can
stay in a dwelling that are not family.
[5:33]
» Be nine people together.
>> Nine people eight.
[5:37]
» Okay. I thought it was low as six.
>> I'm not saying that's how many will be
[5:41]
staying there.
>> Okay. So if if they're nine and I don't
[5:46]
I'd have to go back and look at the
legal limit.
[5:51]
» How many?
>> I think it's four. I was told that by a
[5:53]
realtor.
Yeah.
[5:55]
» For non non-family numbers. Correct.
>> Right. If if they exceed a certain
[6:01]
number, they've got to have a sprinkler
system and an alarm system. It's an
[6:05]
entirely different thing, but they have
to be living as a as a family. There's
[6:12]
state laws and things that govern that.
So,
[6:16]
» and it's not family.
>> Who's doing who's the person over?
[6:20]
» Uh, Gina HS H E L Ms. is who has um
wrote her. Here's a copy for y'all.
[6:29]
What's her first name?
>> Gina G I N A
[6:37]
» and you keep that.
>> Okay. I glad we get there. We got
[6:42]
» Well, I think
just speaking personally though, in my
[6:46]
tenure on this board, I haven't seen
something like this, but I 100% agree.
[6:50]
They should have come before this body
>> before they were able to operate. So,
[6:54]
something they obviously didn't do that
because we didn't see it and you guys
[6:58]
would have been here upon those notices,
I'm sure. Um, so I don't know that we'll
[7:02]
have you an answer tonight, especially
with our attorney not present here, but
[7:07]
I'm certain there is a legal pathway to
hold this until it goes through the
[7:13]
proper channels to which each of you
should have ample time to voice your
[7:18]
opinion in those in those procedures and
hearing. get their uh neighborhood
[7:23]
covenants that on the development,
>> then uh
[7:28]
» we can enforce those, but you can get an
attorney and you
[7:33]
» we have spoken to an attorney that's
supposed to be getting back to us. Um
[7:40]
but just haven't heard a response yet.
>> Well, so would that be a fire marshall
[7:45]
review that would
>> I would think
[7:47]
» cap the number of people and all that? I
believe so. You
[7:50]
» hear back from them?
>> Yeah. There's certain regulations on uh
[7:55]
sober living homes and things. Basically
is what it sounds like. This is
[7:58]
» Yeah.
>> Neighborhood with children in there.
[8:02]
» Yeah.
>> Well, this is this is common, but I I've
[8:05]
never seen it come to fruition without
some sort of because they are business.
[8:11]
So you see them inside inner cities and
things like that in neighborhoods, but
[8:16]
there's still a process they got to
follow to get to this point. And
[8:19]
obviously that hadn't been done. And so
so neighborhoods like yourself have a
[8:24]
voice and whether or not it's welcomed
in your neighborhood, right?
[8:27]
» And u you know coming up from the front
of it, but that process wasn't wasn't
[8:32]
followed. So they're behind they're they
didn't do what their due diligence.
[8:35]
» Yes.
>> What happens if they go ahead and do it
[8:37]
without coming by here? just put the
people. We show up one day and there's
[8:40]
nine, eight, eight guys there.
>> Well, it sounds like obviously they're
[8:43]
already on their way to do it.
>> I mean, they've had they have the house
[8:47]
remodeled. They're ready to show it
>> and ready. I mean, they've already said
[8:51]
that they were going to start taking
residence on the third.
[8:54]
» Yes. So, I think
>> so far, as we know, nobody's there.
[8:57]
» Mr. Chairman could correct me if he's
seen something different. He's been at
[9:00]
this a long time. But just thinking at
it from a common sense approach in this
[9:04]
body, what we're capable of doing is
that they should have come for to change
[9:08]
the purpose of that property. They would
have submitted an application that would
[9:12]
have been a reasonzoning for a business
at which point you folks would have been
[9:16]
notified. We would had a public hearing
and then we would have had to vote based
[9:21]
on that hearing and the evidence brought
before us whether or not we supported it
[9:24]
or declined it. And that obviously
didn't happen. And as far as the
[9:29]
legalities of this body as far as far as
as I believe we go, but as far as
[9:34]
potentially someone moving in some sort
of immediate cease and desist, I don't
[9:38]
really know who would be the enforcing
partner on that except maybe the fire
[9:42]
marshall's office if they haven't
[snorts] um gone through all of their uh
[9:47]
due diligence with their office.
She told me she could do it because she
[9:52]
was under the Disability Act, the
Americans with Disability Act.
[9:57]
» But I wouldn't think that that would
bypass.
[9:59]
» No, that that won't fire codes.
[10:05]
» Yeah, fire code would be the first thing
they have to go and get. I think what
[10:10]
I'll do in the morning is send a email
to the attorney general and and not the
[10:16]
attorney general but the secretary of
state
[10:19]
» and ask them how how was they able to
get this LLC without going through all
[10:23]
this and
>> we'll work at it from there.
[10:27]
» Well, I appreciate y'all listening to
these folks because they didn't know and
[10:30]
I I don't really know what to do with it
except turn the power off.
[10:34]
» It says it's under fire protection
[cough and laughter] six.
[10:37]
» Yeah, it is.
>> Yeah. So, not only does she have this
[10:40]
business, she's going to be opening one
in where was the
[10:45]
[clears throat]
>> or where?
[10:46]
» She got one on Coil Lake, she's got one
in Clarence, and she's got one on Black
[10:51]
Lake.
>> The
[10:52]
» They all the same thing.
>> One one's a bed and breakfast, and then
[10:56]
the one in Coil is going to be a women's
home, and the one in our neighborhood is
[11:00]
going to be a men's home. I seen that
>> on Facebook.
[11:04]
» Oh, you did? You did? And who is that
attorney that would normally be here?
[11:10]
» Mansour.
>> Mr. Mansour. He works for the the
[11:16]
assistant district attorneys.
[clears throat]
[11:21]
» I told you
this for our next meeting. And in the
[11:27]
meantime, we'll have time to consult our
attorney and and check in Bel.
[11:34]
I don't know what action we'd take
before there's an application made or or
[11:39]
something. What
>> I don't know
[11:43]
» discuss it as business as you know this
business.
[11:47]
» I guess my thoughts on it if if she has
a bed breakfast and clearance then she
[11:53]
should be registered with the tax
commission now
[11:57]
» and but should have had a a permit
>> to do a bed and breakfast also. Isn't
[12:03]
that correct?
>> Yeah. I don't know where it's located
[12:08]
is. I don't know the name of it.
>> If she's registered with the tax
[12:12]
commission now, we can ask the tax
commission to contact her
[12:18]
» about this business that she's supposed
to open that she doesn't have an
[12:21]
occupancy license and all this. So,
they can work it from that end. I do
[12:29]
think the fire marshall um I don't know
what the official
[12:34]
revenue or avenues are
>> but I think we need to look at a
[12:41]
complaint [clears throat]
or something to the fire marshal.
[12:44]
» I contacted Mr. Corey Leo and they did
do a formal complaint based on what I
[12:49]
spoke with him about and I sent him all
the secretary of state information as
[12:53]
well but I have not heard back. They
said they were going to send a deputy
[12:56]
out to the resident. He didn't know
exactly when, but a formal complaint has
[13:00]
been filed.
>> Doesn't Corey work for the city though?
[13:04]
» Not anymore.
>> Not anymore.
[13:05]
» He just went back to the state.
>> That's what um
[13:10]
» he's
>> he's over community risk reduction for
[13:14]
» he's he's very knowledgeable.
>> I'll see what I can find out. Secretary
[13:17]
of State and I'm sure Julie will try to
check with the tax commission and see
[13:21]
what's going on there. And
>> I didn't realize she didn't know this.
[13:24]
» We'll gather up some information on it.
there's anything he wants to put on the
[13:29]
agenda for the next meeting.
>> Well, until we compile, what is the
[13:33]
deadline to get on the agenda?
>> 20th of the month. January,
[13:39]
» we should have some stuff by then or
they whoever these people are,
[13:43]
» they need to come see y'all, you know.
>> Yeah. Get
[13:47]
» straightened out.
>> I'm trying. And the realtor, whoever
[13:51]
sold that should have known
>> Virginia Rashio,
[13:55]
» whoever it was, you know,
>> my she was she with Century 21.
[14:01]
» I spoke with Century 21, the um lady
over and she said Virginia Moros, I mean
[14:07]
Virginia Rashel sold it.
>> Well, she got out in the moral. So,
[14:12]
cuz I seen it on you, [clears throat]
>> but you had something like that,
[14:16]
wouldn't you? Whoever they they should
have told those people all
[14:20]
» surely they're not that
>> would they also have to be
[14:26]
inspected by the health department.
>> Yeah.
[14:32]
» That's partly
>> they haven't done that yet either as far
[14:36]
as we know.
>> That's the first I've heard of it
[14:38]
tonight and like that is in my fire
district as well that I'm the chief of
[14:41]
and I I wasn't aware of it. Okay. And so
I I will commit to personally circling
[14:45]
back from the fire protection side, but
also we as the board, we can look at the
[14:50]
plan and zoning
>> guidelines and ordinances and make sure
[14:53]
there's nothing we're missing that
>> can be done after the fact. But I think
[14:57]
at the
>> we'll try to talk to the
[15:00]
give John some feedback.
Okay.
[15:08]
[laughter]
[15:14]
» Can I make just a quick comment?
There's four widowerower or widows on
[15:20]
the street. I'm one of them. I lost my
husband in May. I moved here in June
[15:26]
from Memphis to be closer to my dad. and
my mom lives with me who is a widow
[15:32]
also. And then so there's two other
widows. So there's four widows that are
[15:36]
on a street. And so had I known that
this was a possibility, I would have
[15:42]
never bought a house on the street to be
quite honest. And I'm from Memphis.
[15:47]
» I mean, not originally, but in the past
20 years, I've lived in the Memphis
[15:51]
[snorts] metro area. And I wouldn't have
bought a house on a street if I knew
[15:56]
there would be, you know, eight men who
are recovering alcoholic and or drug
[16:02]
addicts, possibly
>> been convicted and been court ordered to
[16:08]
attend some type of drug or alcohol
treatment and then now they're going to
[16:12]
come into a halfway house on the street
that I'm going to be three houses down
[16:16]
from. So,
I'm very freaked out about it and I'm
[16:21]
the newest person in the neighborhood.
>> Yeah.
[16:26]
» Do we need to put it on the
[16:31]
» based on our
>> We can I mean that's
[16:35]
» Julie.
We could just add it to the old
[16:39]
business.
[16:42]
» We may have we may have more
information.
[16:45]
» Yeah. not willing to come back to the
next one.
[16:49]
» Yeah, that's fine.
>> Oh, yeah.
[16:50]
» I mean, because we have small grandkids,
too, that are up and down that road
[16:53]
» and that's a big concern for me.
>> My only concern is I think they're going
[16:58]
to do it regardless of what y'all say.
>> Yeah.
[17:00]
» So, what what we do then that the
problem?
[17:07]
» I don't think so.
I I think there's too there's too many
[17:11]
legalities against
>> too many
[17:15]
» but but they obviously got the cart
ahead of the horse and so as we get as
[17:19]
we get the cart straighten back out I
would encourage all of you obviously the
[17:23]
temperature in this room is you don't
support that on your street when that
[17:27]
day comes and you are noticed that you
need to come for the hearing
[17:31]
» you need to be here to take turns and
voice your thoughts and opinions
[17:34]
» we will
>> okay
[17:36]
» and when is the next meeting that week
>> be the first
[17:41]
Monday [clears throat] in January, which
I mean is the 5th.
[17:48]
» That is correct.
>> January 5th, January.
[17:51]
» She going to do it anyway cuz she told
me she could do it. Everybody can do
[17:55]
anything. But
[18:01]
» you think they have to have a license to
do
[18:16]
because you don't rush
that.
[18:29]
» We thank y'all for listening to us. She
may not be aware
[18:38]
from
[18:45]
we got small grand
[18:53]
[laughter]
or swing on the swing
[18:57]
out the house.
[19:12]
Well, just because she said that doesn't
mean it's going to happen.
[19:17]
» Just because she said that don't mean
it's going to happen. We going we going
[19:19]
to do what we can.
>> She's next door.
[19:23]
» Yeah, I can imagine.
and she come visit me and told me
[19:27]
everything she was doing. I didn't know.
>> Wow.
[19:32]
» Okay. Thank you so much for
>> Thank y'all.
[19:35]
» All right. See y'all next month.
>> I'm sure.
[19:40]
[clears throat]
>> No, it's okay.
[19:45]
» Okay, babe.
>> Sorry that happened. We going to do all
[19:48]
we can to help
you back.
[19:53]
» Okay. [laughter] We going to do all we
can. I
[20:00]
» you everyone ready to get started? We'll
see if we can't get this. [laughter]
[20:05]
Okay.
>> All right. Survey plat item four survey

[21:12]
» I have a motion to second.
>> Second by
