[35:00] was on the 3rd. Discussed the the police
[35:04] contract. A couple members of council
[35:06] were not here. The mayor was not here.
[35:07] We didn't really have the legislation
[35:09] number in front of us. I thought we
[35:11] should get together and at least clarify
[35:13] before we go to the floor tonight
[35:14] because that night we voted to put it on
[35:16] the agenda. uh but at least to answer
[35:19] any questions that people weren't here
[35:21] might have about the contract and and
[35:24] what we're doing so that when we go to
[35:26] to move for a vote tonight, I'd like to
[35:28] be able to suspend the rules and and
[35:29] move on this thing if we could. But I
[35:31] thought this would be a good opportunity
[35:32] to get any other questions answered.
[35:35] Being that it is a contract issue, we
[35:38] need to go into executive session. So I

[1:05:29] liquor license request. Um there's not
[1:05:33] been any issues down there. You know,
[1:05:35] not that there was no alcohol to begin
[1:05:37] with, but there's not been any uh any
[1:05:39] concerns down there. Um, so we really,
[1:05:42] this actually needs to go fast because
[1:05:45] we, um, this went to the wrong

[1:23:11] Travel Tusk titled incident 9968460
[1:23:16] regarding a liquor license request that
[1:23:18] was filed by Town Place Suites in New
[1:23:20] Philadelphia. The email states that the
[1:23:23] original request was sent by the
[1:23:24] Division of Liquor Control to a township
[1:23:27] and not the city of New Philadelphia,
[1:23:29] which was the cause for the delay. The
[1:23:31] liquor license request has been sent to
[1:23:33] full counsel for a vote this evening. to
[1:23:36] council and administration from Danielle
[1:23:38] Deonteo with the auditor's office. This
[1:23:40] is the detailed trial balance expense
[1:23:43] report with incumbrance detail and the
[1:23:45] statement of cash position with
[1:23:46] month-to-ate totals for June of 2025 to
[1:23:50] council and administration from Mayor
[1:23:52] Day dated July 9th, 2025. This is an
[1:23:55] email titled call to action. Ohio House
[1:23:58] announces special session for budget
[1:24:01] veto overrides and to council and
[1:24:03] administration from Mayor Day dated July
[1:24:06] 14th, 2025, the mayor's report. And that
[1:24:09] concludes correspondence for this
[1:24:10] evening, Mr. President.

[1:24:19] go to the podium. I have a special
[1:24:21] presentation and my report.
[1:24:29] First of all,
[1:24:31] um I get asked about this every week, so
[1:24:34] I'm going to give you a Chick-fil-A
[1:24:35] update.
[1:24:38] The Travel Lodge on Bluebell Drive
[1:24:39] Northwest is now closed. It's been
[1:24:42] purchased by Chick-fil-A and the
[1:24:44] demolition permit has been approved by
[1:24:45] the city. Last week on a Microsoft Teams
[1:24:48] meeting, service director McAir and
[1:24:51] myself watched the ceremony from
[1:24:53] Chick-fil-A headquarters that introduced
[1:24:56] Brady Rust as the operator of the New
[1:24:59] Philadelphia restaurant. He and his wife
[1:25:02] and child recently visited New
[1:25:03] Philadelphia and they stopped by the
[1:25:05] mayor's office and met with us and we
[1:25:08] were very impressed with Mr. Rest. He's
[1:25:11] a Midwesterner from Iowa, has been
[1:25:13] managing a Chick-fil-A restaurant in
[1:25:15] Billings, Montana,
[1:25:18] and he told us that he loves our area
[1:25:20] and is excited to move his family here.
[1:25:22] The new Philadelphia restaurant is
[1:25:24] expected to open sometime in the first
[1:25:26] quarter of next year. So, that's the
[1:25:28] Chick-fil-A update as of today.
[1:25:32] More to come, though.
[1:25:35] Uh this past Saturday, we cut the ribbon
[1:25:37] to officially open the model home of the
[1:25:39] new Philadelphia housing plan, which was
[1:25:42] created by Matt Nadra Karum in
[1:25:44] partnership with the city. The model
[1:25:46] starter home, labeled the Jumpstart, is
[1:25:50] located at 347 Ray Avenue Northeast.
[1:25:52] That's at the corner of Third Drive
[1:25:54] Northeast. It's a 1300 square ft
[1:25:58] three-bedroom house priced at around
[1:26:00] $200,000.
[1:26:02] The idea behind the new Philadelphia
[1:26:03] housing plan is to build housing for the
[1:26:06] local workforce and young families to
[1:26:09] make it easier for them to attain home
[1:26:11] ownership. The city is participating in
[1:26:13] the program by using code enforcement to
[1:26:16] create buildable lots. The CAMS are also
[1:26:19] acquiring vacant lots in the city.
[1:26:22] Everyone who participated in the
[1:26:23] construction of the model home has
[1:26:26] deferred payment until it's sold. That
[1:26:28] is amazing. But but this is just the um
[1:26:33] you know the movement and the program
[1:26:35] that the CAMS have uh been able to
[1:26:38] create. The plan is truly a community
[1:26:40] effort to address the affordable housing
[1:26:43] shortage here in New Philadelphia and
[1:26:44] actually throughout Tuscross County. So
[1:26:47] if you'd like to tour the model home,
[1:26:49] just contact a local realtor. The new
[1:26:52] New Philadelphia housing plan also has a
[1:26:54] website uh at uh www.new new
[1:26:58] Philadelphiaousing plan.com.
[1:27:01] So you can visit that for more
[1:27:03] information. Now for my special
[1:27:05] presentation, I'd like to spend the
[1:27:07] remainder of my time reading and
[1:27:09] presenting this proclamation to Amy
[1:27:12] Smith and Jared Sllayoff.
[1:27:16] Who is Amy? Are you still the general
[1:27:18] manager of WJER? And Jared, the general
[1:27:21] manager of WTZ?
[1:27:23] » I'm the general manager of both.
[1:27:24] » Both.
[1:27:25] » Okay.
[1:27:27] Well, this is uh to uh honor the fact
[1:27:31] that that WJ radio has now moved to New
[1:27:34] Philadelphia. So, I'm going to read this
[1:27:36] proclamation then pre then presented to
[1:27:39] him. WJ Radio entered a new era in its
[1:27:43] 75 year history by moving its office and
[1:27:46] studios to New Philadelphia. And whereas
[1:27:49] the station first hit the airwaves as
[1:27:52] AM1450
[1:27:53] on February 22nd, 1950 under the
[1:27:57] ownership of Agnes Reeves Greer. She
[1:28:00] chose the call letters Jer in honor of
[1:28:04] her father Jeremiah E. Reeves and the
[1:28:07] station operated on a parcel of land in
[1:28:09] Dover that was part of the family's
[1:28:11] estate. And whereas WJER radio grew to
[1:28:15] add an FM station that began
[1:28:18] broadcasting at 101.7
[1:28:20] in 1969 from its studio on the boulevard
[1:28:23] in Dover. Whereas former WJ owner, the
[1:28:27] late Gary Petracola worked tirelessly to
[1:28:30] strengthen the radio station's community
[1:28:33] identity as the voice of the valley. And
[1:28:36] whereas the late Ed Shoemaker, a former
[1:28:39] WJER employee, fulfilled his dream of
[1:28:42] owning his own radio station by
[1:28:44] launching WTUZ
[1:28:47] 99.9 FM on May 1st, 1990.
[1:28:51] And whereas WJER was purchased by Lauren
[1:28:54] International in 2022 and then sold to
[1:28:57] WTU Radio Incorporated in 2024.
[1:29:02] The studios and business operation of
[1:29:04] both radio stations are now housed under
[1:29:06] one roof at 2424
[1:29:09] East High Avenue. And whereas WJR will
[1:29:13] continue to provide local news, sports,
[1:29:15] entertainment, and community service to
[1:29:18] generations of listeners. And whereas
[1:29:21] the city of New Philadelphia is honored
[1:29:23] to welcome WJER radio to New
[1:29:25] Philadelphia where both the voice of the
[1:29:28] valley and Z country will broadcast from
[1:29:31] the county seat of Tuscross County. Now
[1:29:34] therefore, I, Joel Beam Day, mayor of
[1:29:36] the city of New Philadelphia, do hereby
[1:29:38] proclaim today, Monday, July 14th, 2025,
[1:29:44] as WJ Radio appreciation day, and call
[1:29:47] upon all New Philadelphia residents to
[1:29:50] join us in welcoming WJ Radio and its
[1:29:53] staff to our city. So, welcome and
[1:29:56] congratulations.

[1:30:44] » Um, thank you, Mr. President. First, I'd
[1:30:46] like to start with um actually the the
[1:30:49] ongoing projects. Um, Glenn drives
[1:30:52] moving along uh reasonably well. um had
[1:30:56] that little bit of rain last week to
[1:30:58] kind of uh did a couple things to the
[1:31:00] road, but it it held in there. The
[1:31:02] concrete um road helped out there. It
[1:31:05] would have been black top might have
[1:31:06] been a little bit sketchier, but it did
[1:31:08] hold in there. So, uh again, it's moving
[1:31:10] along. Still on schedule for the end of
[1:31:13] September to be done after speaking with
[1:31:15] uh them last week. Uh, Franklin Square.
[1:31:19] Uh, still just waiting on the black top
[1:31:21] crew to come in and make those final
[1:31:23] changes and the repairs that they need
[1:31:25] to make there. The that little rib that
[1:31:27] they have right there around Allen Lane
[1:31:30] right there. So, they got to get that
[1:31:31] fixed. Um, Second Street water line over
[1:31:33] here on the northeast, the 100 200 block
[1:31:36] that should be done by the end of the
[1:31:37] week. So, you'll be able to use that
[1:31:38] road. I know half of it's been closed
[1:31:40] off biggest part of the last couple
[1:31:42] months, but that should be wrapping up.
[1:31:44] Um like you say by the end of this week
[1:31:46] we'll start to pave that ditch. We'll be
[1:31:48] waiting on um Newton asphalt to come in.
[1:31:50] So but other than that the road will be
[1:31:53] done as or the the road will be open by
[1:31:55] the end of this week. Um also on the KSU
[1:31:59] connector trail we did meet with um ODOT
[1:32:02] officials walked it again. All the curb
[1:32:05] strip reclamation work has been uh done
[1:32:08] to our satisfaction. So that's all done.
[1:32:11] We're still working through a few low
[1:32:13] spots in there, have them come back in
[1:32:15] and grind in. Um,
[1:32:18] they did shoot all the catch basins.
[1:32:20] They're all within that ratio, the
[1:32:23] tolerance there. So, it's in the way
[1:32:25] it's supposed to be, but we're still
[1:32:26] trying to work through that. Um, I
[1:32:28] believe we'll be able to work on a
[1:32:30] couple of them. I don't know if we'll be
[1:32:31] able to do anything that I'm 100% going
[1:32:34] to be happy with, but again, there's
[1:32:36] some things on there that are low on one
[1:32:38] side. And I went back through Google
[1:32:40] Earth. there was water laying in some of
[1:32:41] those areas prior to it. So, there was
[1:32:44] some of these areas already had water
[1:32:46] there. That's just doing the same thing
[1:32:48] there. Um, also the park pool, if
[1:32:51] anybody's
[1:32:53] » Uh known about that, the uh chlorinator
[1:32:56] pump had went out on Friday. Thought we
[1:32:58] was going to be able to get up and
[1:32:59] going. It's been closed. Uh pool's been
[1:33:01] closed until then and since then, I'm
[1:33:03] sorry. and uh looking for repairs to be
[1:33:07] done tomorrow and then by the time we
[1:33:10] get the chlorine back in there, get it
[1:33:12] acclimated. We're hoping by Friday uh
[1:33:16] that we can open that back up. So, it's
[1:33:18] been a trying year for the part pool,
[1:33:20] you know, a couple times there had to
[1:33:22] close down, but um that pump there,
[1:33:25] Victorian pump, uh is uh 27 years old.
[1:33:30] Life expectancy for those are about 20
[1:33:33] years. So, we got our money was worth
[1:33:35] out of that, but now it's leaving us to
[1:33:36] where to get it. Um,
[1:33:39] the price we received last week was
[1:33:42] right around $12,000 for a new pump. So,
[1:33:45] we're working on that, too. And did
[1:33:47] everybody get that the uh text that I
[1:33:49] sent? That is our raw sewage pump at
[1:33:52] their wastewater treatment plant. That
[1:33:54] is pump four that went down. Um, so, as
[1:33:58] you can imagine, that's all the raw
[1:34:00] sewage coming into the plant. Uh we've
[1:34:03] had another one go down uh before. We we
[1:34:06] did get that new one in. Uh we just got
[1:34:09] it in Friday. So um right now Dover has
[1:34:14] come over, let us borrow a pump and then
[1:34:16] we had ABC pumping out of Zanesville
[1:34:19] come in and had it had a submersible um
[1:34:23] craned in there today so we could bypass
[1:34:26] get it back to the head of the splitter
[1:34:28] box. So we did have that done. um talked
[1:34:31] with Brian right before the meeting uh
[1:34:33] the superintendent and uh we believe or
[1:34:36] he believes that uh
[1:34:39] um tomorrow they put one of the pumps in
[1:34:41] and then the other pump that he had
[1:34:42] sitting on the shelf for the other one
[1:34:43] that had went down believes they better
[1:34:45] put that in Wednesday. So we should be
[1:34:47] out in the clear after that. Um even if
[1:34:51] uh pump five that we're running on right
[1:34:52] now, if it was to go down, um my belief
[1:34:55] is with the pump that Dober has given us
[1:34:57] and the pump that we got from ABC that's
[1:34:59] submersible, we'd still be okay. So just
[1:35:02] let everybody rest assured that we'll be
[1:35:04] okay with the two pumps we have in
[1:35:06] there, but we do have pump five is
[1:35:08] available when it is pumping. Um I just
[1:35:10] want to make everybody aware of that. Um
[1:35:14] also just quick update on the gas lines.
[1:35:17] Um, I've heard nothing at city hall
[1:35:19] wise, so everything's going good. Uh, I
[1:35:21] didn't meet with them
[1:35:23] early last week, so it's been over a
[1:35:25] week, but everything's going good. You
[1:35:26] know, they're down on the south side and
[1:35:28] they're out on the east end on Bitler
[1:35:30] and Ridge and all that, but seems to be
[1:35:32] fine out there, too. So, uh, just quick
[1:35:34] update on the two gas projects, too. We
[1:35:37] know right both them are right right in
[1:35:40] that early November range too to try to
[1:35:42] get uh grass and everything back in. But
[1:35:45] those are moving along fine also. So yes
[1:35:48] sir.

[1:37:16] currently is our city income tax
[1:37:20] ordinance. Um, to my knowledge, we're
[1:37:22] the only one in Tuscar County that has a
[1:37:25] mandatory filing for city income tax.
[1:37:27] Whether you owe or not, for instance, I
[1:37:29] file city income tax every year, I don't
[1:37:31] know because it's taken out of my
[1:37:32] salary. Um, but um, we do have a we are
[1:37:36] mandatory filing city. It's critical
[1:37:39] because we can't collect from somebody
[1:37:42] if we don't know what they owe. Thanks.
[1:37:44] » So, for my money, I think it's a very
[1:37:46] important ordinance.
[1:37:47] » We do our best to enforce that.
[1:37:50] » One of the problems we run into is our
[1:37:52] current ordinance allows for um us to
[1:37:56] also go after businesses that are not
[1:37:58] withholding taxes the way they're
[1:38:00] supposed to. I believe when that
[1:38:02] ordinance was enacted, it contemplated
[1:38:05] local businesses where we could go after
[1:38:07] the owner because they live locally. It
[1:38:09] did not, I don't believe, con it did not
[1:38:12] contemplate going after
[1:38:15] uh corporate entities like
[1:38:18] uh a Walmart or man Walmart's not in any
[1:38:20] trouble
[1:38:22] like a like a Walmart or a Chick-fil-A
[1:38:25] or a McDonald's or something like that.
[1:38:27] none of which are in trouble with us,
[1:38:29] but we do have a a a local
[1:38:34] corporation that uh we're having some
[1:38:36] problems with. And um I can't
[1:38:41] unfortunately it's it's the the offense
[1:38:43] is an M4 misdemeanor, which is just one
[1:38:46] step above a minor misdemeanor. It's
[1:38:47] punishable by up to 30 days and a $500
[1:38:50] fine um at a as a maximum. And um that's
[1:38:57] usually very effective at getting people
[1:38:58] to file their income taxes. Um I know we
[1:39:02] had problems with the former owners of
[1:39:04] the pros table when it was here and we
[1:39:06] were able to proceed on that track with
[1:39:08] that. But to
[1:39:12] charge the CEO of say a McDonald's with
[1:39:19] uh to charge the CEO of a McDonald's, we
[1:39:21] there's no long arm statute that allows
[1:39:24] you to go after that person because
[1:39:25] that's who we would have to charge
[1:39:27] essentially the um chairman of the board
[1:39:30] and or all the board members. So um that
[1:39:34] becomes problem that becomes
[1:39:36] problematic. So what I am and the long
[1:39:39] arm statute to explain what that means
[1:39:41] is um if some we have a long arm statute
[1:39:44] for murder, rape, high level offenses
[1:39:47] like that and those are felonies. That
[1:39:49] means that if somebody murders somebody,
[1:39:51] flees to California, we can still get
[1:39:53] them and have them extradited here. Um
[1:39:56] or rape somebody's same same situation.
[1:39:58] We can't do that with misdemeanors. Um,
[1:40:00] basically our jurisdiction extends to
[1:40:03] the county and any of the surrounding
[1:40:05] counties that are touching us. So, what
[1:40:07] I'm looking at is so that I can bring it
[1:40:10] I would like to modify that statute to
[1:40:12] allow us to bring a civil action in
[1:40:14] common please court and get a a default
[1:40:17] judgment entry against them that we can
[1:40:19] then enforce against the entire
[1:40:21] corporation. So, that's something I'm
[1:40:23] researching right now. Uh, one of the
[1:40:25] things that troubled me was
[1:40:29] um the section that limits to a maximum
[1:40:34] $25 fee for um
[1:40:39] failing to file your income tax. Um,
[1:40:42] that section doesn't specify
[1:40:46] $25 for a late fee. It says the city
[1:40:50] cannot charge more than $25.
[1:40:54] Now, there has that that can't be 100%
[1:40:57] true because if you're charged with an
[1:40:59] M4 misdemeanor, obviously you're looking
[1:41:02] at a much larger fine than $25 and
[1:41:05] you're looking at jail time and
[1:41:06] probation. So, I'm hopeful that I can
[1:41:10] modify it to include a civil penalty,
[1:41:13] but that's what I'm researching right
[1:41:14] now to determine what other cities have
[1:41:16] done, what the courts have allowed, and
[1:41:20] it would give uh and this is this is the
[1:41:22] first time that I've seen where a
[1:41:24] corporate entity has been a problem for
[1:41:26] us, but it would give us another tool to
[1:41:30] go after people. We could even go after
[1:41:31] people individually uh civily on on
[1:41:33] those things.
[1:41:34] And I know from my own personal
[1:41:36] experience when we've had to file a
[1:41:37] civil suit against somebody um the uh
[1:41:41] the judges have held them very
[1:41:43] accountable and uh generally enforced
[1:41:46] the uh fines that we levied and um uh
[1:41:51] would hold them in contempt if they
[1:41:52] didn't
[1:41:54] uh pay the fines. and we would also be
[1:41:57] able then to put a lean on the property
[1:41:59] and foreclose in order to collect uh any
[1:42:02] taxes that were unpaid. So that's what
[1:42:04] I'm looking at right now. I'm just
[1:42:06] trying to figure out how to do it and
[1:42:08] make sure that it's done in accordance
[1:42:09] with the law. That's big thing that I'm
[1:42:11] working on right now. And I've got a
[1:42:13] meeting with the judge to on Thursday u
[1:42:17] along with my prosecutor to um go over
[1:42:20] how we can more effectively manage uh
[1:42:23] the misdemeanor cases that we have in
[1:42:25] there to uh make sure we're getting them
[1:42:27] to file. I I did we have not been uh as
[1:42:32] a compromise with the judge because it
[1:42:34] does give a tremendous backlog to the
[1:42:36] court on these cases. Um I had offered
[1:42:41] um a few years ago that we would not
[1:42:43] prosecute people for failing to pay
[1:42:46] their income taxes. And the reason for
[1:42:49] that is it's really a practical matter.
[1:42:52] Uh we can turn those into the state
[1:42:55] attorney general's office to collect.
[1:42:57] They can intercept you. They can
[1:42:58] intercept your income tax, something
[1:43:00] that we can't do. and they're a much
[1:43:02] more effective collection agency than
[1:43:05] having the court beat the collection
[1:43:06] agency and holding them accountable by
[1:43:09] threatening to put them in jail. No, we
[1:43:10] don't want people in jail that haven't
[1:43:12] paid their taxes. We want people that
[1:43:15] have committed domestic violence,
[1:43:16] assault, vehicular homicide, things of
[1:43:19] that nature, the biggest crimes that we
[1:43:21] prosecute in the city um on a
[1:43:23] misdemeanor level. So, um, so and I know
[1:43:28] that the court turns all their
[1:43:30] delinquent fees into the attorney
[1:43:31] general's office and that's how they get
[1:43:33] paid. So, uh, I haven't been prosecuting
[1:43:36] on those. But if if we can hold them, we
[1:43:40] have to be able to hold them accountable
[1:43:42] for uh, not filing because that's really
[1:43:44] the only mechanism we have to get them
[1:43:46] to file and to get
[1:43:49] find out if they owe anything. And if
[1:43:50] they owe anything, we can we can and and
[1:43:53] they're delinquent, we can we can turn
[1:43:54] them into the attorney general's office
[1:43:56] and get money that way. So that's that's
[1:43:58] the big thing that I'm working on. And
[1:43:59] we're meeting with the judge on Thursday
[1:44:01] with the mayor and me and u my
[1:44:04] prosecutor to review things and see how
[1:44:07] we can fasttrack those things and get
[1:44:09] them better worked out. I know in the
[1:44:10] past the court did have a a diversion
[1:44:13] set up where they heard all the cases at
[1:44:15] one time and uh they had the opportunity
[1:44:18] to get rid of the cases if they filed
[1:44:20] them which I thought was very effective.
[1:44:22] I don't know if that's something that's
[1:44:23] worth looking at to again but we'll find
[1:44:25] out on Thursday.

[1:46:14] to put some teeth into that. There one
[1:46:16] restaurant particular down at the mall
[1:46:18] that's apparently has trouble coming to
[1:46:21] grips with with their violations. So
[1:46:24] they're working on that. Uh, another
[1:46:26] thing they're going to do is is uh
[1:46:28] they're going to increase the cost of
[1:46:29] vaccinations for people that don't have
[1:46:31] insurance by 10 bucks. Uh, because we're
[1:46:34] already a bargain and uh we should um
[1:46:39] they are they rescheduled their employee
[1:46:42] u shifts in order to provide more time
[1:46:45] that they're open and available for
[1:46:48] service to people instead of they don't
[1:46:50] close for noon anymore. They don't do
[1:46:52] all that kind of stuff. This is our new
[1:46:53] health commissioner. I think I think
[1:46:55] she's doing a nice job. U and uh and
[1:46:59] she's she's got an increased focus on
[1:47:01] publicity. She's doing radio interviews.
[1:47:03] She's doing sending out news releases,
[1:47:06] raising the profile of the health
[1:47:07] department,
[1:47:09] which
[1:47:10] has to be good.
