[1:40:27] So, if the initial regulations adopted in 1990 say that this is a prohibited use, you know, if you weren't there before 1990 and staff showed me a photograph from data, an aerial photograph from 1994, showing that this lot was totally empty at that time.

[1:40:59] to be able to show, again, if this is prohibited used in the zoning district and it was adopted

[1:41:29] obstructing the road for pedestrians and vehicle traffic.

[2:30:17] a new thanks. Then he discovered later on that we needed a permit to do some driveway repair by the garage.
[2:30:27] we applied for a permit. We paid for the permit. When I met all of you guys, I was told
[2:30:35] that I had to pay an administration fee and I have to keep going with what's going
[2:30:40] on. And we are working, we are doing what the city wants us to do. Two issues, you are
[2:30:49] on. One, we were told that we had to move the AC unit from the front of the house.
[2:30:57] through the back of the house, met God when he bought this house, he bought this house as
[2:31:02] it, the way how it is. He had it, he paid for it. Now he's in a process of doing a refinance
[2:31:10] on the house. We discovered you are on it, that the city of Auckland Park already approved
[2:31:17] to have that easy unit and that location what it is today. I came personally, I met a
[2:31:24] lady, she was very nice, and then she said, okay, so you don't need to move it, you just need this.
[2:31:31] I picked up the phone. I called the G.C. and I told him, okay, we don't need to move the
[2:31:36] A.C. unit, we just need to get this calculation of the A.C. unit.
[2:31:43] He said, yeah, I know someone.
[2:31:47] I haven't heard back from him. I was like, dude, listen, I gotta take care of this right away.
[2:31:51] I personally, your honor, all two people.
[2:31:56] They own AC companies.
[2:31:58] I don't know, I need to do some calculations,
[2:32:00] but the AC unit in the front, nobody.

[2:35:12] But really, at the end of the day, that is the issue. So you've started the process, let me, you've started the process. Compliance under the law, I said this before, some of the other people, is not when you submit the application.
[2:35:28] But when you actually get the permit, because while it may be in review, the building
[2:35:35] department, the building official, made the term in that there's missing information.
[2:35:40] And as a result, they can't determine whether or not the plans comply with the Florida building
[2:35:44] code or not.
[2:35:46] So even though you submitted the application last month, or back in June,
[2:35:57] The length of time leads me to believe that there's been an issue that has been identified
[2:36:04] by the building department that needs correction.
[2:36:09] So the only person who can, the only person who can correct that information is either a
[2:36:17] licensed architecture engineer for a licensed general contractor and to the extent that you have
[2:36:24] any of those individuals or companies working for you, they need to make sure that what
[2:36:32] they've submitted to the city company, I'm going to be on the top of it.
[2:36:36] And for the record of honor, you can ask the inspector, I've been working with him, he knows
[2:36:41] that I'm doing my best, and when he goes to a GC and that he goes to an architect,
[2:36:51] it's
[2:36:51] I'm not, you know, making any, I'm just making a statement that, you know, whoever did this,
[2:37:00] an ultimately Mr. Dodd, should have known that he needed a permit to do this.

[2:51:47] The city's requesting 15 days to comply, or $150 per day, per violation.

[2:51:58] office condition and legal postings, BCPA printout,
[2:52:02] notice to appear, FAA service, and supporting evidence.

[2:52:11] we're not looking at just a couple of vehicles.
[2:52:13] Normally, on a daily basis, I see anywhere between
[2:52:17] nine vehicles parked on the grass.

[3:11:45] Which was the hearing that took place a notice of violation?
[3:11:47] No, no, this is a third one the one that you're that so there's been two notices
[3:11:54] sent to
[3:11:55] Heritage partners LLC at the address like provided to you there's a
[3:12:02] certified return receipt, and in a bunch of caution, this particular city, also post the property,
[3:12:12] and there's photographs in the file from the original hearing on this case that show, and
[3:12:20] there's affidavits in the record where the notice of violation and the notice of hearing
[3:12:25] were both posted one here on the side, not sure which one this one that looks like that's
[3:12:30] notice of violation. And the notice of hearing was actually posted on the front door
[3:12:39] and 5, 7, 20, 26. The notice of violation was posted on 2, 6, 20, 26 according to the
[3:12:49] date stamp. So, and it was mailed. So, the city doubled down, as I said.
[3:12:57] Right, sent the notice by mail, which is a requirement, and they also have the authority or the ability to also post, which by the way, they don't have to because
[3:13:09] mailing under the statute is actually sufficient.
[3:13:12] But they went a step further and also posted the property.
[3:13:18] So, you know, and so when I get these cases, if you've heard, you have sat through them, you'll hear me say,
[3:13:25] You know, this case is properly before the special magistrate, which is a legalese for saying I've looked through the file and all the notices that are required have been sent and therefore the case is properly before me because if they don't comply with these requirements, I will continue the matter and say you have to prove a service before you know, I can hear the case do process.
[3:13:49] But in this case, as I said, there are photographs in the file that indicate not only
[3:14:01] was opposing, but there's also the affidavits of service where under oath, the officer
[3:14:07] has tested an issue in a statement saying that they posted the property on 5, 20, 26, the
[3:14:18] that was the code
[3:14:30] enforcement case and then the notice of hearing and then the notice of
[3:14:35] violation was posted on February 6th, 2026, according to the affidavit in the photographs.
[3:14:42] So, and last but not least,
[3:14:55] like I said it was, hold on, the U.S. Postal Service.
[3:15:04] Attempted to deliver, but no one signed for the notice at the address, apparently, hold on, see. This is 1984.
[3:15:16] So, one of the notices, someone signed for, someone decided not to sign an accept service.
[3:15:26] So, that was signed for for the hearing date.

[3:15:39] your item was delivered to an individual at the address at 210 PM on February 23rd,
[3:15:45] 2026. So, someone signed for the notice of violation.

[3:16:03] hearing and whoever was at the address refused to sign to accept it, but it was then posted

[3:16:19] mastery, I made a formal determination that the city complied with the notice requirements.

[3:39:39] admin fee was imposed. This find and fee have not been paid. I have not had
[3:39:44] contact with the owner, certified mail goes to the location and it's returned to
[3:39:47] the city is unable to forward. The property continues to violate the city ordinance
[3:39:52] as evidence by the June 26th, 2026 and the August 18th, 2026 photographs.
