[5:04] So, as part of the organizational meeting in January, leadership roles are reaffirmed
[5:10] or changed and that sets the tone for the council year.
[5:15] Therefore, the president shall be elected as the first order of business.
[5:20] The clerk shall serve as the president pro tem and shall conduct the election of the
[5:24] council president.
[5:26] The president pro tem shall ask for nominations for council president.
[5:29] The nomination shall be made, and after the nominations have been closed, voting shall be conducted by voice vote.
[5:37] Four votes shall be required for the election of the President.
[5:42] If the first vote results in no nominee receiving at least four votes, the nominee with the least vote shall be stricken from the ballot,
[5:50] and a new vote shall be taken.
[5:52] If nominees tie for the least votes, a coin toss
[5:59] shall determine which nominee shall be stricken from the subsequent ballot.
[6:04] The side of the coin that emerges face up from the toss shall determine the nominee who is to be stricken.
[6:11] Heads shall be ascribed to the nominee who is the subject of the first vote that results in a tie.
[6:16] At the conclusion of the election, the newly elected president shall, from that point on,
[6:22] preside over the meeting. The newly elected president shall then conduct the election of the vice president,
[6:29] employing the same procedures as in the election of the chair.
[6:34] Article 7 of the Open City Council Rules lists the responsibilities of the president of council as follows.
[6:41] Normally, I would probably not read through all of these, but we did an amendment this
[6:46] year, so out of respect for those who worked on the council rules amendments, I'm going
[6:50] to read all of them, okay?
[6:53] The primary responsibility of the president is to facilitate the decision-making process
[6:58] relying on an adopted set of rules.
[7:01] Those rules recognize in the right of the majority,
[7:05] I should have this memorized,
[7:06] us. Ultimately to rule the right of the minority to be heard and the right of the individual
[7:13] to participate in the decision making process. To that end, the President shall, one, convene
[7:20] all meetings, call the members to order, and ascertain whether a quorum exists. Two,
[7:27] cancel meetings of counsel, where it is apparent that there will be a lack of a quorum,
[7:31] 1. Inclement weather, emergency or other good calls, 3. Announce the business before the
[7:38] council pursuant to the order of business, 4. Assign the floor and recognize members
[7:44] to speak, 5. Enforce all rules including time limitations, rule of debate and maintain
[7:51] order and decorum, 6. Maintain their impartiality, 6. I attempt to alternate between pro and
[8:00] when conducting the debate, and 6-2, closed discussion when all sides have been represented.
[8:09] 7, keep at hand the bylaws, rules of order, standing rules,
[8:15] and other documents to facilitate the transaction of business,
[8:18] such as a roster of all committees and their members.
[8:22] 8, authenticate by signature any documents relevant to the council.
[8:27] nine, represent the council at various meetings and report to the council the contents of those meetings.
[8:34] Ten, state and put to vote all motions in order.
[8:38] Eleven, initiate general consent when appropriate.
[8:41] Twelve, vote on all matters before council.
[8:45] Thirteen, refrain from allowing themselves or others to dominate the discussion
[8:49] or to directly outcome of issues before the council.
[8:54] 14, establish a schedule for individual members of council to attend agenda-setting meetings.
[9:02] 15, set the agenda for the council meeting with the participation of the city manager
[9:07] and the vice president of council, the designated member of council,
[9:11] and in consultation with other council appointees.
[9:14] The president of council may appoint another member of council to attend the agenda-setting meeting
[9:18] in their absence or absence of the Vice President.
[9:23] 16, ensure that discussions during agenda-setting meetings
[9:26] relate solely to actual or proposed agenda items.
[9:31] 17, adjourn the meeting.
[9:34] And 18, which is where I probably would have started,
[9:38] perform all other duties that the President of Council
[9:40] is required to do pursuant to the charter,
[9:43] ordinances, and resolutions of the City of Oberlin.
[9:47] Now, before we move on, there are four points I would like to address.
[9:51] Number one, members of council who are nominated for president of council will be able to vote
[9:56] for themselves.
[9:57] Number two, no second is required on nominations.
[10:02] Three, the first nominee to receive four votes, four or three, will be the council
[10:08] president and the elections will close at that point.
[10:11] Four, public comments pertaining, and please listen, public comments pertaining to the
[10:17] elections are to be directed to the newly elected president of council, and we are requesting
[10:23] that they be made at the next regularly scheduled meeting, which is tentatively scheduled for
[10:28] Tuesday, January 20th.
[10:30] Having said that, nominations are now in order for the office of president.
[10:36] Are there any nominations at this time?
[10:41] Ms. Peterson.
[10:42] Thank you, Madam President Pro Tem.
[10:44] I nominate Ebony Johnson to be president.
[10:47] Okay.

[10:57] I just read all that.
[11:01] No beautifully, too.
[11:02] Well, anyways.
[11:05] Okay.
[11:10] So we're going to go ahead and take the roll call.
[11:13] Okay.
[11:14] As many as are in favor of Ebony Johnson for president,
[11:18] say aye for approval and nay if you oppose. I'm going to go ahead and take the

[11:37] Aye. Walzer? Aye. Congratulations.
[11:51] All right here we go.
[12:02] Thanks again everybody
[12:04] really looking forward to an awesome term.
[12:08] But before we do that, we must elect a vice president.
[12:11] So at this time, are there any nominations
[12:14] for vice president?
[12:17] I saw Ms. New first.
[12:20] I would like to nominate Michael McFarlane
[12:22] for vice president.
[12:24] Mr. Walter?
[12:25] That was my nomination.
[12:28] Okay, are there any other nominations
[12:30] for vice president?
[12:35] Okay, hearing none.
[12:36] Madam clerk will you please call the roll we
[12:43] should officially close
[12:44] now I forgot to do that too but we should do it that's okay I see that in my
[12:48] script right here let's get that over I'm hearing none may I have a motion to
[12:52] close nominations a second isn't required but thank you okay nominations are

[13:42] And so there's not another nomination, there's no tie vote, there's none of that that we
[13:48] have to deal with, Madam Clerk.
[13:51] And so with that, we will carry on with the rest of our agenda.
[13:55] Starting with item 1D, approval of minutes for the whole pile of meetings that we had
[14:02] in December.
[14:04] I will not list them all out individually, but is there a motion to approve the meetings,

[15:34] Sure, go for it.
[15:35] Okay. This is for the 2026, 2027 city council board appointments. For comp plan committee,
[15:44] there are two vacancies currently. We are going to consider for those positions
[15:50] for the nominated committee, there are three positions.
[15:56] We are considering Ebony Johnson, Jessenew, and Sandra Miller.
[16:00] And for the social equity committee, we are considering
[16:02] Libny Lopez and Sandra Miller.
[16:08] I move that we accept the nominations.
[16:13] I think that's just a sign.
[16:17] We don't have John here, so in this case we would just approve the slate.
[16:22] as presented. There needs to be a motion. Oh, I made it. I said so. Yeah, sorry. I move

[18:34] Okay.
[18:34] So the first appointment is to the library board.

[19:21] New.
[19:22] Aye.
[19:22] Johnson.
[19:23] Aye.
[19:25] And finally, under council business,
[19:27] a proclamation for Martin Luther King, Jr. Day,
[19:30] which will be read by Ms. New.
[19:34] Thank you, Madam President.
[19:43] Whereas Dr. Martin Luther King, Jr.
[19:45] was born on January 15, 1929.
[19:48] And whereas Dr. King had special personal and professional ties to Oberlin and visited here on several occasions and became an honorary alumnus of Oberlin College in 1965 when he was awarded the Doctor of Humane Letters and Degrees.
[20:02] And whereas he was assassinated and died on April 4, 1968, in the end he gave his life for the cause of true justice in our land.
[20:10] and for his dream that all people of all colors and conditions could live in peace and in harmony
[20:15] and could treat each other and all others with respect.
[20:19] And whereas the City Council under the leadership of Bob Thomas
[20:22] observed a holiday in the City of Oberlin in association with Dr. King's birthday for the first time in 1971,
[20:29] and the United States Congress ultimately passed legislation to establish the third Monday in January
[20:34] as the Martin Luther King, Jr. Day, federal holiday.
[20:38] And it was first observed in 1986.
[20:40] And whereas we therefore pause every January
[20:43] to reflect on the life and work of our nation's greatest
[20:46] champion of civil rights and human dignity,
[20:48] whose powerful words, whether written on smudged fragments
[20:51] of newsprint smuggled out of a narrow jail cell
[20:54] in Birmingham, Alabama, or echoing eloquently
[20:57] from the steps of a great memorial in Washington, D.C.,
[21:00] calmed fears and solidified resolve
[21:02] among people of goodwill of every race, class, gender, and circumstance.
[21:07] And whereas the memory of Dr. Martin Luther King Jr. is a continuing inspiration and ideal
[21:12] for many young people in Oberlin and all over the world.
[21:16] And whereas each year community members gather together before a monument to him in a public
[21:21] park and civic space named for him and rededicate themselves to his dream of a
[21:26] society transformed.
[21:28] His dream that one day this nation will rise up and live out the true meaning of its creed, that all men are created equal.
[21:36] And whereas it is now our generation's responsibility to honor the life and memory of Dr. King by answering his powerful calls to action and by continuing to fight for his legacy of equality for all.
[21:48] Now, therefore, I, Ebony Johnson, Mayor of the City of Oberlin, Ohio, on behalf of Oberlin
[21:53] City Council, do hereby proclaim Monday, January 19, 2026, as Martin Luther King, Jr. Day,
[22:00] and commend all persons who have joined in the community celebration and communal witness
[22:04] of this historic occasion in the City of Oberlin.
[22:07] And in witness aware of, I have on to set my hand and cause the great seal of the
[22:12] of Oberlin, Ohio to be affixed here to this fifth day of January 2026.
[22:19] Thank you so much. I don't think we have anyone to present it to this time. But thank you
[22:25] so much and I really hope that everyone will join in the King Day celebrations that will
[22:30] be happening later this month.
[22:34] With that, we're on to item two. Any concerns that
[22:37] are not on the agenda may be brought to the attention of council at this time. Members
[22:42] Members of the public and council members may address the city council for a maximum of three minutes each. If you would like to make remarks, please step up to the mic, state your name and address for the record.
[22:53] And you have three minutes. I'm keeping a timer. So the timer will start when you do.
[22:58] If there's anyone who wants to say anything at this time, don't worry. You'll have another chance later in the meeting.
[23:06] Item three opportunity for a report from a city board or commission. I don't think we have one of those quite yet sit tight, but we will item for opportunity for a report from an administrative department representative. Again, I don't think anyone has been identified for that yet either.
[23:28] moving on yes ma'am there isn't a report but I do want to make an
[23:32] announcement that there is a boards and commissions orientation that has been
[23:35] scheduled for January 14th 2026 and that's going to start at 5 o'clock and
[23:41] we'll end at 8 p.m. and we are expecting all boards and commission members to
[23:45] attend thank you and that will be at the Oberlin Enrichment and Activity
[23:50] Center is that correct yes ma'am on January 14th from 5 to 8 we'll see
[23:54] there. Thank you. Thank you for that.
[23:59] All right. Now moving on to old business,
[24:02] Madam Clerk, would you read item A by number and title only please? Ordinance
[24:08] number 25-61, ACCMS, and ordinance implementing 3735.65 through 3735.70
[24:18] of the Ohio revised code establishing and describing the boundaries of the
[24:22] community reinvestment area in the city of Oberlin designating a house
[24:26] officer to administer the program and creating a community reinvestment housing council in
[24:31] a tax incentive review council.
[24:34] Thank you so much.
[24:35] Council, is there a motion to approve on first or third reading?
[24:39] Sorry.
[24:40] Second.
[24:41] All right.
[24:41] Moved by move seconded by Peterson.
[24:43] Thank you so much.
[24:45] Ms. Porter.
[24:51] Good evening, council.
[24:53] So this legislation will create a community reinvestment area on the property where
[24:58] the proposed Oberlin Place affordable senior housing project is going to be
[25:04] located at 450 West College Street. Creating this area will allow us to offer
[25:10] tax abatement incentives which will help with the financing of the project. This
[25:16] legislation though just creates the area and the different bodies that we
[25:20] need to to do the program. We will be coming back to council with an actual
[25:25] agreement with the developer at a later date and probably also a school compensation agreement
[25:32] that will dictate how much the schools will be compensated for their
[25:38] in lieu of taxes being abated for this development. So I'd be happy to answer any questions anybody
[25:46] has. I would like to know the Tax Incentive Review Council pretty much already exists. We convene
[25:53] at every year to review the existing tax abatement agreements that are offered
[25:57] under our enterprise zone program so that body does already exist but we did
[26:02] have to put it in the legislation for the state so be happy to answer any
[26:07] questions thank you so much counsel any questions okay if not madam clerk
[26:14] will you call the roll on third reading please
[26:18] Lopez Peterson hi Waltz new
[26:23] New.
[26:23] Aye.
[26:24] McFarland.
[26:24] Aye.
[26:25] Miller.
[26:25] Aye.
[26:26] Johnson.
[26:26] Aye.
[26:29] Thank you so much, Ms. Porter.
[26:33] Item B, Madam Clerk, would you read that by number and title only, please?
[26:38] Ordinance number 25-67, ACCMS, an ordinance enacting new chapter 707 of the Oberlin
[26:46] codified ordinances to prohibit the provision of conversion therapy to minors within
[26:51] the City of Oberlin.
[26:55] Thank you so much.
[26:56] Council, is there a motion to approve on second reading?
[26:59] So moved.
[27:00] Second.
[27:01] All right, moved by Lopez, seconded by Walzer.
[27:07] Mr. Clark.
[27:09] Yes, can you hear me?
[27:10] Yep.
[27:10] Yes.
[27:12] So, as I've indicated to you before, it's still
[27:18] unclear as to how these types of ordinances are to be analyzed, whether
[27:23] they're a restriction on conduct,
[27:27] in which case it's the lowest level of judicial review
[27:30] or whether the restrictions on speech,
[27:33] which would invoke the highest level of judicial review.
[27:38] The Supreme Court, as I understand it,
[27:40] is due to issue a determinant of opinion
[27:43] on that probably in June,
[27:46] but until then we have different decisions
[27:50] from different jurisdictions.
[27:53] Two days after our first reading on this ordinance, there was an opinion or a decision rendered
[28:00] by the Sixth Circuit Court of Appeals, which has jurisdiction over the state of Ohio.
[28:05] That court focused in on a Michigan statue, which essentially tracks the same definition
[28:14] as we have for conversion therapy.
[28:17] And there are two provisions of that.
[28:19] The first is that it means any practice or treatment by a provider that seeks to change
[28:24] a person's sexual orientation or gender identity, including efforts to change behaviors or gender
[28:32] expressions or to eliminate or reduce sexual or romantic attractions or feelings toward
[28:38] individuals of the same gender.
[28:41] The Michigan statute, like our ordinance, would prohibit that.
[28:45] However, the Michigan statute also, like our ordinance says, it currently stands.
[28:52] It does not include counseling that provides assurance or assistance to an individual undergoing
[28:58] gender transition.
[29:00] And the court recognized that both of these types of therapy are speech-based and that
[29:07] therefore the statute at Issue in Michigan differentiated between one message which was
[29:14] permitted or prohibited under the legislation and the other one which was permitted.
[29:20] And the court noted that in its opinion that was a violation of the First Amendment as
[29:28] it was viewpoint discriminatory.
[29:30] So I had emailed council a proposed revision to our ordinance if you care to do it and
[29:36] And that would simply be to delete the second sentence in paragraph B under section 707.02,
[29:45] which would eliminate the part that is expressly permitted.
[29:52] And I don't see that doing any damage to the legislation because we still have the
[29:58] the core deaf and hard of hearing people.
[30:00] Commission of conversion therapy. And I don't know that it really matters what we say that
[30:04] it doesn't mean as long as we say what it does mean. So, I would, my suggestion is at the
[30:11] very least that that amendment be made before final passage of this ordinance.
[30:18] Excellent. Thank you so much, Ms. New. John, could you repeat the amendment proposal, please?
[30:25] To delete the second sentence, which is about one half of section 707.02B, which is the definition of conversion therapy.
[30:43] Thank you.
[30:45] Any other questions for Mr. Clark?
[30:51] Mr. Lopez.
[30:52] Thank you, Madam President. Thank you, John, for giving us the updates on the court case that's pending and for looking at the ordinance and seeing how it could best align.
[31:01] So that way we can hopefully pass this ordinance without issue or contradiction with whatever
[31:09] the court decision is.
[31:11] So I think the amendment is fine with council would meet that standard.
[31:19] And so I think, and I don't know, John, if we need to, if because we're on second
[31:25] reading, because we still need to make the amendment, it doesn't, it wouldn't change
[31:29] if we wait till the next reading for that to be changed.
[31:31] we're not approving it tonight or you could do it you could do it tonight or
[31:35] you could do it on third reading okay it doesn't set us back though right right
[31:41] now it doesn't so we could approve it on second reading tonight make the
[31:45] amendment and still come back and approve it on third reading yes okay but we need
[31:52] a motion to do that.
[31:57] I move that we approve ordinance number 25-67 ACCMS with Mr. Clark's
[32:12] amendment to strike. Just point of order. So there needs to be two votes. One is someone
[32:19] When these introduce the amendment it should be seconded and voted on and then you can after
[32:24] that it's done then you would approve it on second reading.
[32:28] It's like the first day of school again.
[32:31] Hold on one minute.
[32:32] Mr. Lopez.
[32:33] You make the motion?
[32:33] Yeah.
[32:34] Okay.
[32:34] All right.
[32:35] Mr. Lopez.
[32:35] Thank you, Madam President.
[32:37] I move to amend chapter 707.02 section B to delete the second sentence.
[32:44] Should I beat the whole sentence?
[32:45] Can you just say the second sentence of Section B?
[32:51] Second.
[32:52] All right, so we have a motion by Lopez, seconded by Peterson.
[32:57] Madam Clerk?
[33:00] Walter?
[33:01] Aye.
[33:02] New?
[33:02] Aye.
[33:03] McFarland?
[33:03] Aye.
[33:04] Miller?
[33:04] Aye.
[33:04] Lopez?
[33:05] Aye.
[33:06] Aye.
[33:07] Johnson?
[33:07] Aye.
[33:09] And now Ms. New?
[33:12] So just to make sure, do we need to now make another motion,
[33:16] or is that enough?
[33:17] It's just second reading.
[33:18] It's just second reading.
[33:19] We don't need a motion.
[33:20] Yeah, so I think that's enough.
[33:21] Correct.
[33:21] Correct.
[33:22] In that case, Madam Clerk, would you read the roll on second reading, please?
[33:29] John, that's correct, right?
[33:31] Yes, you don't need a motion on second reading, but it does need a separate roll call.
[33:35] Okay.
[33:36] New?
[33:37] Aye.
[33:37] McFarland?
[33:38] Aye.
[33:38] Miller?
[33:39] Aye.
[33:39] Lopez?
[33:40] Aye.
[33:40] Peterson?
[33:41] Aye.
[33:41] Walter Johnson. All right, we got that all tidied up. Thank you, Council. Thank you, Mr. Clark.
[33:51] Okay. Thank you. And now moving on to new business. Madam clerk, would you read item a by number
[33:58] title and substantive portions, please? Certain. Resolution number are 26-01 CMS a resolution
[34:09] Appointing just a new as a designee for the members of council for the purposes of the
[34:14] public works law to go into immediate effect.
[34:17] Section 1 of the designee is hereby appointed the designee within the meaning set forth
[34:21] in Ohio revised code section 109.43.
[34:26] Section 3 to ensure the timely appointment of a designee for members of council to
[34:31] meet the deadline for Ohio Sunshine Law certification training as soon as possible
[34:36] and provide that at least five members of council determined by motion that this resolution
[34:40] shall go into full force and effect immediately after this passage, otherwise shall take effect
[34:45] on the earliest date allowed by law.
[34:48] Thank you so much.
[34:49] Council, is there a motion to approve on first reading?
[34:52] So moved.
[34:53] Second.
[34:53] Moved by Walzer, seconded by McFarland.
[34:58] Ms. Anderson?
[35:00] Mr. Clark, are you taking this one?
[35:02] Mr. Clark?
[35:04] You want to flip forward?
[35:05] I have a coin right here Mr. Clark you're muted we can't hear you
[35:18] so by
[35:20] resolution passed in 2005 a 2025 that long ago some time ago
[35:28] Kristen Peterson was designated as the as the primary representative for the
[35:34] city on the board. We are authorized to appoint up to two additional alternate members. In
[35:44] this case, the resolution is written to appoint one alternate.
[35:50] Mr. Clark? Yeah.
[35:51] I'm sorry to interrupt you. We're on R26-01. This is for the public records law training.
[35:57] thank you so the each public each public body in Ohio that's bound by the
[36:08] public records law is required to appoint one person to attend the public
[36:14] records training on behalf of the the body that that person sits on it's not
[36:21] an excuse for other people not to do it because it's very interesting stuff but
[36:25] And in this case, we would, the proposal was that just a new would be appointed as that
[36:30] representative.
[36:31] She would take, she would attend the training session and receive a certificate which would
[36:38] qualify all members of council in the requirement for attendance at the, at the public records
[36:46] training.
[36:49] Okay.
[36:51] Any questions, concerns?
[36:54] Let me be the first to thank Ms. New for taking one for the team.
[37:03] You should all think about going.
[37:05] It's worth going to.
[37:07] It's fun.
[37:08] I did it once on Zoom.
[37:10] It was really cool.
[37:11] It was a half day and you learned a lot.
[37:13] I really actually kind of nerded out about it.
[37:16] I liked it.
[37:17] This is being requested for immediate effect with someone
[37:21] like to waive the rule requiring three readings.
[37:23] Mr. Walzer.
[37:24] Thank you, Madam President.
[37:25] I move, we waive the rule requiring three readings for ordinance R26-01CMS.
[37:32] Second.
[37:34] All right.
[37:34] Moved by Walzer, seconded by Neu.
[37:37] Madam Clerk, will you call the roll?
[37:39] Miller?
[37:40] Aye.
[37:41] Lopez?
[37:41] Aye.
[37:42] Aye.
[37:43] Walzer?
[37:43] Aye.

[37:44] Aye.
[37:45] McFarland?
[37:45] Aye.

[40:18] Mr. Clark, now.
[40:25] Well, actually, I was confusing that
[40:27] with actually the third one.
[40:29] The next one, yes.
[40:32] But again, you're appointing,
[40:34] you can appoint up to two representatives
[40:36] and one alternate or up to two alternates.
[40:39] So in this case, you'd be appointing Kristen Peterson
[40:42] as the primary representative for Designee
[40:47] and Mr. McFarland as the alternate.
[40:50] Awesome. Thank you. Council, any questions about that one? Hearing none. Ms. Peterson, I move we

[45:20] Moved by Peterson, seconded by Lopez. Mr. Clark, are you taking this one as well?
[45:26] for real this time.
[45:30] Ms. Peterson was appointed by a prior resolution as the primary designee for the city.
[45:38] That piece of legislation left it open for a future appointment of an alternate, which
[45:43] is what you're doing today.
[45:45] So like the previous resolution, we can appoint up to two alternates and this piece of legislation
[45:52] appoint Sandra as the alternate to the primary Miss Beegerson. Thank you so much. Council,
[46:01] this is being requested. Oh, no, it's not. Okay.
[46:10] No. Well, on my agenda, it doesn't say immediate
[46:14] effect. Is it immediate effect? It is. Okay. According to the ordinance, so we'll go by the,

[47:21] Madam clerk.
[47:23] Peterson.
[47:24] Aye.
[47:24] Walter.
[47:25] Aye.
[47:25] New.
[47:26] Aye.
[47:26] McFarland.
[47:27] Aye.
[47:27] Miller.
[47:27] Aye.
[47:28] Aye.
[47:29] Johnson.
[47:29] Aye.
[47:32] All right, council.
[47:33] We made it through.
[47:34] We made it through.
[47:35] It does feel like the first day of school all over again.
[47:40] But we will get back into the swing of things pretty
[47:44] quickly.
[47:44] We are on to council communications.
[47:47] I will start with Ms. Peterson.
[47:51] I just want to say PUC will meet on January 13th.
[47:56] Thank you so much, Mr. Lopez.
[47:58] Thank you, Madam President.
[48:00] Just to remind folks that there will be no meeting for tomorrow
[48:06] for the Human Relations Commission.
[48:09] And you all know that I won't be able to be here for the training
[48:13] for all the boards and commissions on the 14th.
[48:17] I believe it's the dates.
[48:18] It's the 14th.
[48:20] 14th.
[48:20] I will be away, so I will not be here.
[48:24] Thank you so much.
[48:25] Ms. Miller, welcome.
[48:27] Thank you.
[48:29] I have nothing to add, but I'm happy to be here.
[48:32] Thank you so much.
[48:32] We're glad you're here.
[48:35] Mr. Walzer.
[48:36] Nothing at this time.
[48:37] Thank you.
[48:38] Ms. New.
[48:40] Thank you, Madam President.
[48:43] Okay, so I did want council to be aware of so that we could have maybe a brief discussion.
[48:52] There's some inconsistencies in terms of security protocol when we are entering for council chambers.
[48:59] And I've had a conversation with one of our more senior officers who would love to know
[49:05] what we would like on a consistent basis to make sure that we are being protected
[49:11] in the way that we all want to be protected and you know obviously they're
[49:16] willing to do whatever whatever we need but we need to send a consistent
[49:19] message so whether it's you know everybody goes through the metal
[49:23] detector just you know whether you're a council member or not you still
[49:27] take everything out you still go through you know currently that's not
[49:31] necessarily the way it is, but this is a scary world and I would hate for, God forbid, something
[49:37] to happen in us to look back and say that we were not taking all the necessary precautions.
[49:43] So it may involve some inconveniences, but that's kind of what safety is, right?
[49:49] It's a small price to pay.
[49:51] So with that said, I don't know if you want to have a discussion now or we just
[49:55] want to think on it, but they would like our sort of cohesive feedback on it.
[50:00] does anyone have thoughts right now that they want to talk about or should we
[50:05] table this until another time? Well I guess with that question I would say if we
[50:10] want to schedule our first retreat back on the horse here we go you know we
[50:17] can we could wait till then but I do think it's a really important matter
[50:21] but my personal inclination is that and you know barring some some sort of
[50:29] emergency, that we all go through the metal detector and the check, the way that everyone
[50:35] in the public goes through it as well. I know it's a little inconvenient, especially if we're
[50:39] showing up a little towards the starting gate time, but I really think it needs to be consistent
[50:46] and we need to keep everybody safe. So that's my thought.
[50:52] Thank you. Anybody else?
[51:00] I'm sorry. I mean, I have no objection to going through the security.
[51:05] I have also no objection to go to security if it makes it more consistent and it helps
[51:11] with the way the process goes with the officer, no objection.
[51:16] So I guess if no one has an objection, I'm happy to relay that to the officer, if that
[51:22] would be, unless someone does want to talk about it further, I know.
[51:26] I think that would be Mr. McFarland.
[51:30] Hey Greg, guess what?
[51:31] But I was just going to say, maybe a city manager can communicate to the police chief.
[51:36] Thank you.
[51:37] Sorry about that.
[51:39] Obviously.
[51:41] But yeah, that would be greatly appreciated to get everybody on board so that it's a
[51:45] nice, consistent, safe protocol every single time.
[51:50] Okay, so that was the first thing.
[51:51] Yeah, sorry.
[51:53] Second thing, I guess we should talk about a work retreat, but maybe we could save
[51:56] that for the second meeting in January.
[51:58] Mary, let's ease in a little bit.
[52:01] Ms. Anderson already spoke of our very exciting Board and Commission Orientation.
[52:06] So again, can't strongly encourage enough that folks come to that, even if you've been
[52:11] on a Board and Commission before.
[52:12] This is going to be an excellent opportunity to ask questions.
[52:16] We have someone coming from the Ohio Ethics who is going to do an amazing detailed
[52:22] overview of everything you want to know and what you didn't know you wanted to
[52:25] know.
[52:25] So please come if you can come I believe we're going to record it or attempt to record it if possible, but that's not a guarantee
[52:32] Not with our not with our internet. So
[52:37] No offense to cable call up it has nothing to do with cable call just want to make that clear
[52:42] Fund them. Okay. So yeah, so please come to that orientation if you can come
[52:48] Let's see anything else
[52:52] We have sort of completed our appointee evaluation overhaul.
[52:58] Our new and past Vice President Michael McFarlane, according to our updated council rules, will
[53:05] be in charge of that.
[53:07] And now I believe has all the materials that he needs to go ahead and implement that.
[53:12] But I do believe that Mr. Clark correct me, Ms. Anderson correct me if I'm wrong.
[53:17] I think we do need to adopt the process.
[53:20] Is that correct?
[53:24] I don't think it needs to be overly formal because that makes it difficult to tweak.
[53:29] I think you could do it by motion.
[53:31] I don't think you need anything beyond that.
[53:33] Right.
[53:33] Okay.
[53:34] So to do that, though, does everyone need to have the materials in hand and it needs
[53:39] to be part of the packet or can we just do it now as is so that we can move forward?
[53:45] I guess it depends how familiar people feel that they are with what the proposals are.
[53:51] Okay.
[53:52] Yeah, I would ask that we hold off on that because I do have a couple questions for you John about each of your appointee
[53:59] Ordinances themselves, which does talk about how evaluations are are done. I just want to make sure that we are clear about
[54:08] Clarifying that in the new ordinances when we're ready, so I'll be in touch tomorrow
[54:13] And then and then we can and then I'll make sure everybody is aware with those materials
[54:17] And so you can all see it and before we actually say yes
[54:20] So, appointees, thank you for being very patient with us.
[54:23] This is a really important process and I feel like we did a pretty good job vetting it and
[54:27] doing what we thought would be a really good comprehensive overview going forward.
[54:33] And then, can you remind me please, because I think our next task was going through the
[54:38] City Council Handbook, who volunteered to help with that?
[54:43] Was he?
[54:44] I think it was you.
[54:45] No, it was you.
[54:46] And was you?
[54:47] No, no.
[54:51] I know I did. I'm not for sure who else did. I think it might have been the three of us
[54:58] here. Michael, does that ring a bell? Do we have to go back and review some minutes?
[55:03] We can do that in a minute. But I'll go ahead and send the materials out to whoever volunteered
[55:07] to help with that. That's all I have. Thank you.
[55:10] All right. Thank you so much. Mr. McFarland? The only thing I have is just that if
[55:17] if anyone was planning to go to the Planning Commission meeting
[55:19] on January 7th, and that it is canceled.
[55:22] So, you know me.
[55:26] Nothing for me tonight, except to say,
[55:32] welcome back to City Council.
[55:34] Glad you all are here.
[55:37] Thank you for entrusting us with leadership this term.
[55:42] Really looking forward to doing some amazing things
[55:44] with all of you and all of you.
[55:47] that's it for me so I'll turn it to mr. Holcomb testing
[55:59] okay just wanted to
[56:01] provide a couple updates the boards and commissions training that we're having
[56:07] coming up the Ohio ethics portion of it we're inviting all the department heads
[56:12] and superintendents as well to the training as long as their schedules are
[56:17] available I just wanted to update you all this was there was in a
[56:20] requirement for a council approval but the staff are replying to the head of
[56:26] Department of Development for a grant for the design and construction of the
[56:30] sewer to the Innovation Park. So I just wanted to give you a notice of
[56:35] that. Otherwise normally these some of these grants require your approval
[56:39] prior to that. This one did not. The legislative calendar and work schedule
[56:44] I'm still working on that with the department heads. We have our meeting
[56:48] meeting tomorrow. I hope to finish that up by the end of the week, at least this first
[56:52] iteration. And then maybe when we have our first retreat, we can go through and start
[56:57] clarifying some of that work in that schedule.
[57:02] And then finally, the Vine Street Bridge, just wanted to provide the public an update
[57:06] that there has been backfilling of the abutments. And they're currently working
[57:10] on the sanitary line. If you remember, there was a very strange situation with
[57:15] sanitary line that's being adjusted right now and that the estimated completion time is
[57:20] in mid-April.
[57:22] The hope is though once the sanitary sewer line is completed, things like the pump that
[57:27] is there will no longer be needed because water can actually now flow through the
[57:31] creek naturally.
[57:33] So that will be coming before mid-April, way before.
[57:37] But the finalization of it is simply we have to wait for the asphalt plants
[57:42] is to open in April to finish the bridge.
[57:45] So that's why it's in mid-April.
[57:48] Thank you so much, Ms. Fowler.
[57:51] Thank you, Madam President.
[57:53] I am unable to attend the Boards and Commissions
[57:58] orientation, so sorry I will not be there.
[58:02] Right now it's a really busy time in the finance office.
[58:05] We are closing 2025 and preparing
[58:08] for our financial statements and our audit of 2025.
[58:11] We also have a vacancy, a full-time finance assistant.
[58:16] The first review is today of the applications.
[58:20] So hopefully we get that filled pretty soon.
[58:22] Thank you.
[58:23] Good luck.
[58:24] Thank you.
[58:25] Mr. Clark?
[58:28] Well, I just want to say that Ms. Anderson did a great job as President Pro Tem.
[58:35] So thank you for that.
[58:37] Also, just to let you know I have hired a prosecutor and assistant law director's name
[58:44] is Carl Felice.
[58:45] He works in a firm in Lorraine County, but he has a significant trial experience in the
[58:53] Cuyahoga County Court of Common Pleas as a prosecutor.
[58:57] He served briefly as an assistant law director in some other communities up and around Cleveland.
[59:04] So, I'm excited to have that task completed and very, very excited about my former prosecutor
[59:14] or our former prosecutor now becoming the judge.
[59:19] Thank you so much.
[59:21] Ms. Anderson.
[59:23] Yes, I just want to say thank you, John, for that compliment.
[59:26] I appreciate it.
[59:28] You know, I always have a good time playing that role.
[59:32] I also want to say I'm I'm looking forward to the the boards and commissions
[59:38] orientation we're getting it together we've been meeting so we do have an
[59:43] agenda we do have a game plan we are working out some of the kinks and some
[59:48] of the details right now so we've taken everything that we've been given
[59:53] every suggestion we've taken into consideration and for the most part
[59:57] are probably touching on every last one of them as some former.
[1:00:00] So, if you have any questions in the meantime, please feel free to contact us, any one of us and we'll be willing to provide you with any information we have.
[1:00:10] How have the invitations gone out to all the current members of the boards and commissions?
[1:00:18] There was a mass e-mail that went out. You should have been on that e-mail. Were you not?
[1:00:23] I might have been.
[1:00:23] Okay. Okay. You probably were. I do know that Mr. McFarland's came back, so I'm not sure.
[1:00:29] I'm checking on some of those emails. Mr. McFarland's has been bouncing back, and so has Mrs. Johnson's.
[1:00:34] There's something going on, so don't worry about it. We'll get it fixed.
[1:00:39] But so it has gone out to every board and commission member. It will go out again this week,
[1:00:45] and I think we are getting something put together by Diane. We're hoping she's been out of the office on vacation.
[1:00:50] So this is a you know, this is that time of the year where everyone takes their vacation time
[1:00:54] So she's trying to work with us. So we should have something else going out this week
[1:00:59] Well, I won't say we should we will definitely have something going out this week
[1:01:04] How nice it will look that's the that's the thing
[1:01:06] It may just be coming from me just saying as a reminder, you know, we're gonna this next Wednesday because it's coming fast
[1:01:13] All right. I'm really looking forward to attending and I hope that the rest of council will be there if you can
[1:01:20] I'm sorry, is that it for me?
[1:01:22] Yeah, that's it.
[1:01:23] Thank you.
[1:01:24] Perfect.
[1:01:24] Well, as I promised earlier, there's one more chance for public participation.
[1:01:29] So members of the public may address City Council for a maximum of three minutes.
[1:01:34] If you would like, you can come up to the mic and state your name and address for the record and you have three minutes.
[1:01:43] All right.
[1:01:44] It's early in the year.
[1:01:46] Maybe we'll hear from y'all soon.
[1:01:48] But with that, it is 8.05 and we are adjourned.
[1:01:52] Thank you so much for coming out in person to be here.
[1:01:56] Those of you who are watching on Zoom, we appreciate you there too.
[1:01:59] We will see you in a couple of weeks.
[1:02:01] I think the next meeting is January 20th.
[1:02:04] So we'll see you then.
[1:02:07] With that, we're adjourned.
[1:02:09] Good night, everybody.
