[0:47] blessings that you have poured out upon us. Lord, we thank you for getting us

[0:50] through this season of the cold and the ice and the weather. And we thank you

[0:54] for all those who have worked so diligently to prepare our roads and our

[0:58] schools and to repair our water lines. God, we thank you for all those that

[1:02] have been working so hard over this last month. God, we pray for this meeting. We

[1:06] pray for your blessing to be upon it. We pray for those in the positions to make

[1:10] the decisions that would affect our county that you would give them wisdom,

[1:14] that you would give them guidance and strength, Lord. that you would provide

[1:17] for the needs of all those in our community. We think of those that are in

[1:21] in need, Lord, and we pray for your blessings to be upon them. We thank you

[1:25] for all the services that you have provided for us. And God, we pray that

[1:28] we would be one. We know there are many ideas, many different opinions, but God,

[1:33] we we come together in our shared love for this community, for Ohio County, for

[1:38] our cities and our towns, for our state, and for our country. Lord, we pray that

[1:43] you may unite us together. May you bless this meeting and all those that are here

[2:43] the hospital >> in Ohio County Healthcare.

[2:46] » Right now we're going to do a proclamation for health month and

[2:50] because of me stuttering and not reading as fast as Sonia, Sonia's going to read

[2:58] disease is a staggering health problem and a leading cause of death for

[3:01] American women and men. And whereas there are steps each of us can take to

[3:06] prevent this chronic disease, in a time when one in three adults in the United

[3:11] States is living with some form of cardiovascular disease, American Heart

[3:15] Month provides an important reminder that it is never too early to take

[3:18] action to improve your heart health. And whereas all Americans should be aware of

[3:23] risk factors that can lead to heart disease, including high blood pressure,

[3:27] high cholesterol, diabetes, obesity, physical inactivity, tobacco use, and

[3:32] family history. practicing everyday habits such as eating a balanced diet,

[3:36] maintaining a healthy weight, limiting sodium consumption, exercising

[3:40] regularly, avoiding tobacco, and moderating alcohol intake can reduce

[3:45] these risks. And whereas during American Heart Month, we honor the health

[3:49] professionals, researchers, and heart health ambassadors whose dedication

[3:54] enables countless Americans to live full and active lives. Be it resolved,

[3:58] therefore, that I, David Johnston, judge executive of the county of Ohio, do

[4:03] hereby proclaim February 2026 as American Heart Month in Ohio County. And

[4:09] I invite all of our citizens to take an active part in their health and

[4:12] wellness. Let us rededicate ourselves to reducing the burden of heart disease by

[11:45] about 43,000 and something in that account. So, I I would like to be able

[11:52] to I'm willing, I should say, to pay 33,582

[12:02] Deborah Batty is in charge of overseer of this

[12:09] of all the recording. I'm sure you're probably aware of uh laws. We have to

[12:19] internet by I can't remember the date exactly, but this year we're right on

[12:35] be familiar with House Bill 1 and two that's helped do this. So in the last 19

[12:40] years, we have absolutely gone from zero to everything right on schedule. So

[12:48] I would just like the court to help with this uh upgrade. It' be good for 5 years

[12:55] and that would leave a balance of 30,000 if I pay 33,582

[13:00] out of the uh storage fee. And then our monthly service right now, as you can

[13:05] see, is 24,421. So it would increase our monthly to 227

[13:12] which would be need to be added to our budget in July.

[13:17] Uh whenever this all comes effect I will pay the difference of the monthly until

[13:23] uh the budget starts in July. So I'm just asking for your help and they are

[13:29] willing. they pay uh I think last time we did this they you paid 15,000 one

[13:34] year 15,000 the next year and they're willing to do that also. So I'm just

[13:39] real proud of what the recording department has done in these 19 years

[21:18] that's not effective now. That's effective the first of 2027 when when we

[21:23] take take office. We're raising the jailer from 83,000

[21:29] uh 928 about 84,000 to 90,000. Uh only thing we doing on the magistered

[21:37] salaries is the CPI. They'll just take the CPI for each year.

[26:08] right equipment for uh removing the ice timely and the weather staying cold for

[26:16] the time period that it did and stay below freezing. It was it was really a

[26:21] task. And if anyone goes to Facebook and looks at Jason Burton's video, it's a

[26:26] good example. He just went down the road and went back down the road and it was

[26:31] there was no change and with the equipment that we were using and we

[26:35] we're not from up north so we don't have equipment like they do. Um, fortunately

[26:40] we had some local farmers that showed us what would work and uh we were able to

[26:45] get a couple of those blades and get finished up but not as quickly as

[26:48] everybody would have liked. But I want to give a shout out to the road

[26:51] department working so hard. >> Yes. And all of our neighboring counties

[26:54] had the same problems. The back streets in Orangeboro uh did not clear until

[26:59] they melted off. >> So we're not the only ones that had that

[28:32] remember having to get cemetery gate down to get people.

[28:36] But the fact is is it's a public roadway that it can't be closed because it's a

[28:49] And so therefore, the coal mines uh their their vines was was wrong and the

[28:56] engineering was wrong. >> Okay?

[29:22] general. They didn't know. They said to take it up with my locals. I'd done

[29:26] talked to Justin and uh that didn't work. So, and I uh talked to the judge

[29:34] and uh there was there I was at a better end. So, I felt like that it was only

[29:40] right to have the cemetery open. If it had been a rock and had rolled out of

[29:44] the bank and rolled down there and blocked the road, if I'd moved it,

[29:46] nobody had ever said a word. But this show favoritism to the coal mines in my

[29:51] opinion.

[29:54] » Judge, do you care if I address it, Mr. >> Yes, sir. Appreciate it. So with respect

[29:59] to the charges that were brought that they asked to prosecute or whatever um

[30:04] at the time the coal mines has to take certain precautions with regard to the

[30:08] area and question that they may be mining in a sense or in with respect to

[30:13] there's certain federal laws on people's access to that. And so it's my

[30:19] understanding in doing so that that was where they could block off. There was

[30:22] question as to whether there was a public road or not, but they put a fence

[30:26] up so that that there could not be public access in violation of federal

[30:30] law. They had indicated that to you and you demanded to be able to go to the

[30:35] cemetery for uh to to visit, which is certainly reasonable. Um, but they have

[30:41] to monitor that and make sure. It was also my understanding from the deputy

[30:44] that they were offered a key so that you could or anybody else that wanted to.

[30:49] Now, I think you dispute that, right? I think

[30:51] » I refuse that because I didn't want the key. I wanted the gate open.

[30:54] » I understand. And so you disputed the fact of whether you should get a key or

[30:58] whether it should be open. And and and you're okay with me disclosing any of

[31:02] this? >> No, I'm fine. That's I'm fine with that.

[31:05] » So the problem became whether um the federal law would would would control

[31:10] with respect to whether even that portion of the road was public or not.

[31:15] So ultimately um with that gate the officer said you

[31:19] could have the key talk to them they'll give you the key access anytime you want

[31:23] but they just have to manage that so that there's not unlimited access and

[31:28] you chose then to say I'm not doing that and I think you either cut down or ran

[31:33] over or did whatever to their fence. I don't recall exactly the damage but then

[31:37] they showed proof of the purchase of the gate um that what it cost them and so

[31:43] with regard to the disposition of the case we were asked to pay for that fence

[31:48] no other and I think we deferred the charges because of the question as

[31:52] [clears throat] to access or not in in convening the federal law with regard to

[31:58] right to cemetery use and access. So I mean it's a difficult case and I

[32:01] understand the frustration and we're very frustrated with it but it was

[32:06] different things to do with it. >> But my opinion I disagree with the

[32:09] decision on it because because it's been this way for probably a hundred years

[32:15] and then all of a sudden the coal company they can say that we're under

[32:19] federal law and everything. The engineering is supposed to go around

[32:23] that. That was their problem. That's the coal mine's problem. And let me tell you

[32:28] more about the coal mine. The same particular bunch years ago and they

[32:33] change the names all the time. But there was a time that I was going across

[32:37] Midway Road and to come out over on Highway 69 for between Centertown

[32:42] Hartford. >> Mhm.

[32:43] » And uh there was a truck that was pulled to the side of the road and the tail end

[32:47] of it was sticking out in the road and I sat there and waited for a few minutes.

[32:51] So I chose to go on around him. They chased me down and chewed me out

[32:57] because they was fixing to set a a charge up and I jumped out of the truck

[33:01] and I chewed them out. I said, "Do you realize that it's your job to get me

[33:06] shut down?" I said, "You want an A order?"

[33:10] I know enough about that that I could get them an A order of it. And that's

[33:13] that's explosive under explosive laws. You're probably familiar.

[33:18] But the coal mines is not perfect. And uh the other thing is is there's a few

[33:25] of us here that's probably got family buried and I know I do

[33:39] up, get off the coal company, see if we can resolve it some way. And I'll get

[34:08] center. Um, I introduced myself a couple weeks ago. My name is Jackie Brown. I'm

[34:12] the manager of the mission center and currently we are functioning as the Ohio

[34:18] County clothing bank and we uh fulfill the DCBS clothing vouchers as well as

[34:24] our instore vouchers now and we provide clo low barrier clothing access for

[34:29] residents who do not qualify for formal aid. We supply furniture to uh families

[34:34] who have lost everything due to fires or floods or domestic violence situations,

[34:38] things like that. Um, all I'm really asking for is that the county will

[34:44] actually recognize us as basically officially that we are a

[34:51] clothing bank. No m, no nothing else. I'm just trying to get

[34:56] the county's recognition of us as that facility.

[35:01] » Um, >> and we we have copy for 501c3

[35:05] in on file, >> right? Um, I do have a little packet

[35:08] with me. I also have the paperwork that needs to be filled out and signed if you

[35:12] choose to decide that we are actually the clothing bank. Um DCBES has already

[35:17] signed and and has recognized us as their go-to for their clothing vouchers

[35:24] and things like that. So that's all I was wanting to do was just to get formal

[35:29] recognition of of the mission center as being a clothing bank.

[35:32] » Okay. Can you give the paperwork for that to to Justin and let him review it

[35:38] and will you put it on the agenda the next time, son?

[36:39] uh researching title, etc. And I just wanted to say to you that you're going

[36:44] to be sorely missed in there. And I hope wherever takes your place does just as

[36:48] good a job as you've done because I've been Illinois, Indiana, Kentucky, uh

[36:56] Tennessee, Ohio. I've done title research in courouses across the central

[37:01] part of the United States. And Ohio County has one of the best clerk's

[37:07] office and is set up in a way that makes it functional. And I just want to let

[37:12] you all know how special she was and that I appreciate her and she's going to

[37:16] be missed. [applause]
