» Amen.
[clears throat]
[1:59]
» I pledge algiance to the flag of the
United States of America and to the
[2:05]
republic for which it stands, one nation
under God, indivisible, with liberty and
[2:12]
justice for all. Thank you, brother
Scott. Uh, Brother Scott Parker is from
[2:16]
the Hartford Christian Church. And
again, thank you very much. Behind me,
[2:20]
we have some distinguished guests. Miss
CC Robinson from the Ohio County
[2:25]
Healthcare along with Dr. Skibba, who is
a heart doctor there, and we're fixing
[2:30]
to recognize HeartM. So, it's quite
adequate. I It's important to be here.
[2:38]
and and and then and then then we have
uh Miss Shelley Sha who is the boss of
[2:43]
the hospital
>> in Ohio County Healthcare.
[2:46]
» Right now we're going to do a
proclamation for health month and
[2:50]
because of me stuttering and not reading
as fast as Sonia, Sonia's going to read
[2:55]
it.
Whereas [snorts and clears throat] heart
[2:58]
disease is a staggering health problem
and a leading cause of death for
[3:01]
American women and men. And whereas
there are steps each of us can take to
[3:06]
prevent this chronic disease, in a time
when one in three adults in the United
[3:11]
States is living with some form of
cardiovascular disease, American Heart
[3:15]
Month provides an important reminder
that it is never too early to take
[3:18]
action to improve your heart health. And
whereas all Americans should be aware of
[3:23]
risk factors that can lead to heart
disease, including high blood pressure,
[3:27]
high cholesterol, diabetes, obesity,
physical inactivity, tobacco use, and
[3:32]
family history. practicing everyday
habits such as eating a balanced diet,
[3:36]
maintaining a healthy weight, limiting
sodium consumption, exercising
[3:40]
regularly, avoiding tobacco, and
moderating alcohol intake can reduce
[3:45]
these risks. And whereas during American
Heart Month, we honor the health
[3:49]
professionals, researchers, and heart
health ambassadors whose dedication
[3:54]
enables countless Americans to live full
and active lives. Be it resolved,
[3:58]
therefore, that I, David Johnston, judge
executive of the county of Ohio, do
[4:03]
hereby proclaim February 2026 as
American Heart Month in Ohio County. And
[4:09]
I invite all of our citizens to take an
active part in their health and
[4:12]
wellness. Let us rededicate ourselves to
reducing the burden of heart disease by
[4:16]
raising awareness, taking steps to
improve our own heart health, and
[4:20]
encouraging our colleagues, friends, and
family to do the same.
[4:24]
» Thank you.
Oh, Justin, Larry, and uh you guys on
[4:29]
that end, off three, get up here and
scrunch in with us for the picture.
[4:32]
Okay,
>> y'all. Come in right here close to me.
[4:36]
» Scrunch right in.
[4:50]
» There we go.
[4:53]
picture better than the first.
>> We did too, Rich. So, you take one.
[4:59]
» Love it.
>> From a bunch of people with big hearts.
[5:03]
» Thank you.
>> Thanks so much for coming. I really
[5:05]
appreciate
>> it.
[5:26]
Uh gentlemen, you have before you the uh
minutes of the January 27th, 2026 amen
[5:33]
meeting. We need a motion, a second to
approve those minutes.
[5:43]
» I make a motion to approve the minutes.
Um motion by Michael, second by Bo.
[5:56]
Is there any discussion, corrections, or
additions to the minutes?
[6:00]
Any discussion, corrections, or
additions to the minutes?
[6:07]
Being [snorts] none, all in favor say I.
>> Post like sign.
[6:13]
» The minutes are approved.
Uh next to you, you have the deals,
[6:19]
claims, payments, and transfers.
Uh need a motion, a second for that.
[6:32]
» I'll make a motion.
>> Motion by Jason.
[6:35]
» Second.
>> Second by Dale.
[6:41]
Is there any discussion on the bill's
claims, payments, and transfers?
[6:48]
Is there any discussion? Being none,
all fair I post like sign. The bills are
[6:57]
paid.
[7:00]
Uh I got a question.
Um who authorizes
[7:08]
these vouchers? The recover who
authorizes them? What vouchers
[7:15]
» for uh
[7:18]
the uh opium recovery?
>> Okay. I didn't even know we had one on
[7:24]
this bill.
>> There's not any on this bill.
[7:27]
» What?
>> Not any on today's bills.
[7:29]
» I know, but I the one just been on there
or who who has authorized them?
[7:36]
» I can maybe answer that. There has been
times when ASAP has had like a revolving
[7:46]
just a pot of money sitting there and it
was with River Valley and if anybody
[7:50]
came through that needed one
River Valley would send it over and it
[7:55]
would get authorized it would come out
ASAP money. Now I don't know if that's
[7:58]
the case.
>> Well,
[7:59]
» but that's the way it is.
>> It's it's been come in and and uh
[8:03]
actually uh everybody approves them once
they make the bills and claims list. But
[8:07]
I'm asking that ain't I'm asking you to
authorize them to put them on there.
[8:12]
» Okay. I'm I'm assuming it's just when
they turn one in from the father's
[8:15]
house.
>> It's budgeted for assistance. As the
[8:19]
opioid money,
>> yeah,
[8:22]
» those papers that I gave you, I mean,
>> it's for it's for it's just for that
[8:26]
sort of thing. Yeah. It's just for help
with the opioid problem,
[8:30]
» but somebody has to authorize to put it
on there.
[8:39]
Uh
[8:42]
» Cassidy, can you explain this next deal?
We had to make amendment because of the
[8:46]
jailer's salary this year, not the one
we're fixing to talk about.
[8:49]
» The jailer salary is budgeted for I
don't have it with me. I'm sorry. Um for
[8:54]
the correct amount and it was in the
wage scale was voted on last year for
[8:59]
the correct amount. Now, however, the
annual compensation that we put on bill
[9:04]
on the amendments, I think that's in the
end of June, that amount did not get
[9:10]
changed. So, it is reflecting the
previous year's salary. So, we just need
[9:14]
to do an amendment to show the correct
compensation for the jailer.
[9:22]
» And the correct amount is now 16.
[9:28]
There it is.
Tell Say that again. Michael
[9:31]
» 16326.
[9:34]
» Would you would you be comfortable
making that motion?
[9:37]
» I'll make the motion for the amendment
to the minutes that were incorrect.
[9:42]
» Do I have a second?
>> I'll second.
[9:44]
» Second by Larry. Any discussion?
Being none. All on favor say I. I.
[9:51]
» Post like sign.
Motion carried. I'm going to recognize
[9:57]
our county court clerk.
One more time, Bess.
[10:03]
» One more time.
Got a few more times.
[10:07]
» I mean, the introduction.
>> Oh,
[10:13]
» yes. You go right here. Okay. If that
makes your
[10:15]
» I want to introduce to you the prettiest
county court clerk in the state of
[10:19]
Kentucky and maybe the whole world.
>> Best rapper. You do know he's doesn't
[10:24]
see well, right? But anyway, [laughter]
that's okay.
[10:28]
» It's just a joke. We We have fun with
that, right, Judge?
[10:31]
» Yeah.
>> What are you grinning at, B? See, now
[10:35]
you got me off track here. Is this too
loud?
[10:38]
» No, you're fine.
>> Now, Justin, you're grinning.
[10:40]
» Is this your first time? [laughter]
[10:45]
» It's not my first time, but it's getting
close to my last time. I know. So now
[10:50]
what I you guys have a pamphlet in front
of you. Okay. So every five years uh
[10:57]
since I've been in office, we've been
upgrading our computer system just for
[11:02]
recording.
So I'm try to make it simple and if you
[11:08]
are aware of when we're talking about
storage fee account, do you know what
[11:12]
I'm talking about? Not I'll be happy to
explain so everybody knows where I'm at,
[11:18]
right?
So the price of to upgrade this year is
[11:23]
uh for the next five years $63,582.
[11:29]
So when I talk about the storage fee
account that is what uh Frankfurt when
[11:35]
we record we get a percentage now that
goes into this storage fee account
[11:40]
that's just for things in recording.
Okay. So, at this present time, I have
[11:45]
about 43,000 and something in that
account. So, I I would like to be able
[11:52]
to I'm willing, I should say, to pay
33,582
[11:57]
out of that account for the upgrade.
And
[12:02]
Deborah Batty is in charge of overseer
of this
[12:09]
of all the recording. I'm sure you're
probably aware of uh laws. We have to
[12:13]
have everything
on uh
[12:19]
internet by I can't remember the date
exactly, but this year we're right on
[12:24]
schedule. Everything's good. Got a lot
of u
[12:29]
of lost my train of thought here. We've
got a lot of grants money. Uh you might
[12:35]
be familiar with House Bill 1 and two
that's helped do this. So in the last 19
[12:40]
years, we have absolutely gone from
zero to everything right on schedule. So
[12:48]
I would just like the court to help with
this uh upgrade. It' be good for 5 years
[12:55]
and that would leave a balance of 30,000
if I pay 33,582
[13:00]
out of the uh storage fee. And then our
monthly service right now, as you can
[13:05]
see, is 24,421.
So it would increase our monthly to 227
[13:12]
which would be need to be added to our
budget in July.
[13:17]
Uh whenever this all comes effect I will
pay the difference of the monthly until
[13:23]
uh the budget starts in July. So I'm
just asking for your help and they are
[13:29]
willing. they pay uh I think last time
we did this they you paid 15,000 one
[13:34]
year 15,000 the next year and they're
willing to do that also. So I'm just
[13:39]
real proud of what the recording
department has done in these 19 years
[13:44]
and uh I appreciate uh y'all's help all
this time to get it where it's at. And
[13:51]
once again be the last time I'll be
asking now. Keep promise you got the new
[13:56]
clerk. But anyway,
>> so that's
[14:00]
» any questions feel free to ask.
[14:08]
» Uh Candace, will you make a note of that
and we'll we'll work on that while we're
[14:12]
working on the budget.
>> Okay. All right. Appreciate it.
[14:16]
» Thank you. Now I'm going to assume. Is
that a yes? Cuz I have to order this
[14:20]
stuff. We'll wait till next time.
>> Like to I'd like to table it for us to
[14:25]
find out where the funds are going to
come from if that's all.
[14:28]
» That's fine.
>> I'd like to make a motion to table this
[14:30]
for the next meeting.
>> We'll put on the next agenda. Sign.
[14:33]
» Can we get a second?
>> Second.
[14:36]
» Thank you. Is that
>> Yeah. On say I.
[14:40]
» I.
>> Now we're going to do your approve your
[14:44]
reports. Bass.
>> Okay. Uh we have a one item lined up if
[14:48]
you're following the agenda is the
clerk's January 2026 financial report.
[14:53]
We've got to say that show that we got
that from her.
[14:58]
» Yeah, that's that's 10. Yeah.
12. I'm sorry.
[15:04]
» Clerk's financial report.
>> I'll make a motion to acknowledge we
[15:09]
receive it.
>> Move by Jason.
[15:11]
» Second. Second by Michael. Any
discussion or question? Being none, all
[15:16]
in favor say I.
>> Oppos like sign. Motion carries.
[15:22]
Um
then the clerk's 2026 budget which she
[15:28]
has a calendar year budget. So that's
why we got to do it at this time. So we
[15:33]
need to uh also approve that
>> which is already in our budget.
[15:39]
» Okay. This is the
>> motion.
[15:43]
» Motion. Motion by Bo.
>> Second.
[15:47]
» Second by Dale.
Any discussion?
[15:51]
Any discussion? Being none. All first
say I.
[15:54]
» I.
>> Post like sign. Motion carries.
[16:00]
Um and then also back again to the
clerk's annual order setting salaries
[16:08]
comes again. It's already in the budget.
It's just because she's on a calendar
[16:13]
year. We have to prove that again for
her calendar year.
[16:18]
» Make a motion to approve annual order
saving salaries.
[16:22]
» Motion by Michael.
>> Second.
[16:25]
» Second by Dale.
Any qu any questions?
[16:30]
Being none. All favor say I.
>> I. Post like sign. Motion carries. Same
[16:37]
thing on the sheriff. We've got to do
the same thing for him. He's also on the
[16:41]
calendar year. We got to approve his
budget, which is already in our budget.
[16:46]
» And uh then we got to also approve the
uh his salary uh order.
[16:51]
» I'll make a motion we approve the
sheriff's budget.
[16:54]
» Motion by Dale.
>> Second. Second by Michael.
[17:01]
Any discussion or questions?
Being none, all in favor say I. I
[17:07]
» oppose like sign.
Motion carries.
[17:13]
Uh same way as with the clerk, we also
got to approve his salaries.
[17:20]
» Make a motion to approve the sheriff's
2026 annual order setting salaries.
[17:24]
» Motion by Michael.
>> Second.
[17:26]
» Second by Dale.
Any discussion?
[17:32]
We see them.
[17:37]
» I'm sorry.
>> Will we see those?
[17:41]
» Yes.
>> Yeah. From the sheriff's office.
[17:44]
» It's on the back of your pocket.
>> It's back here, Larry.
[17:47]
» The very last sheet.
[17:55]
» So,
we both
[17:59]
motion. Okay. And no discussion.
All in favor say I.
[18:05]
» I.
>> Oppos like sign. That motion carries.
[18:10]
Um I've been asked by one of the members
of this body to have a short close
[18:16]
session to discuss the uh personnel item
that's on the uh on it. So I'll take
[18:22]
that in close session with me.
>> So do I have a motion for that? I'd
[18:26]
» like to make a motion. We go into close
session.
[18:28]
» Motion by Michael. Second.
>> Was that Bo? Second by Bo.
[18:35]
» All on favor say I.
>> I.
[18:38]
» Uh we're going in close session. We will
be right back though because we're only
[18:43]
discussing one personnel issue.
[18:47]
» Yeah. So I
>> is a motion to go back in the open
[18:52]
session.
>> Make a motion go back by Michael.
[18:56]
» Second.
>> Second by Bo. All say I
[19:01]
» post like sign. We're back in open
session. Uh, next order of business is
[19:06]
personnel. I have one item. I put up the
name Adam Dy,
[19:12]
seasonal manager for the golf course
at level one. Rate of pay 2027 per hour.
[19:21]
Effective date is 28 2026.
Uh, roll call
[19:27]
[clears throat]
>> Johnston. Yes,
[19:30]
» Bivven.
>> Yes,
[19:32]
» Morphw.
>> Yes,
[19:34]
» McKenna.
>> Yes,
[19:36]
» Bulock.
>> Yes,
[19:38]
» Bennett.
>> Yes.
[19:41]
Give it to me.
[19:46]
We're ready for committee reports. And I
want to say a little something along
[19:51]
that way. Uh, our road employees done a
wonderful job this during this storm.
[19:58]
They worked hard. U they uh got it. This
there was nothing wrong with any of our
[20:04]
procedures. There's nothing wrong with
really our equipment. The only problem
[20:07]
was it's the wrong kind of storm. It's
something that you'll never see again. I
[20:12]
hope we had never seen it before. Hope
never see it again. Exactly. The kind
[20:17]
kind of ice the way it was stuck to the
uh to the floor. I mean to the roads.
[20:22]
Uh but I want to thank shout out to them
has of course the uh next committee that
[20:28]
met today and I will read that out. It
was u we have to our committee met today
[20:36]
to set the salaries for the next term of
certain offices.
[20:41]
U the first one is the uh county
attorney.
[20:47]
Uh
we're we're lowering him from a dollar
[20:51]
to 50 cents a month. No, not really. Uh
[laughter]
[20:55]
no, now we're we're setting the salary
for the county attorney for next next
[21:01]
term at 18,400 or that's my proposal.
Uh the corner at 20,000. I will I forgot
[21:10]
to tell where they come from, but he
came from 16848
[21:14]
is what they make now to 20,000 and
that's good for the next four years and
[21:18]
that's not effective now. That's
effective the first of 2027 when when we
[21:23]
take take office. We're raising the
jailer from 83,000
[21:29]
uh 928 about 84,000 to 90,000.
Uh only thing we doing on the magistered
[21:37]
salaries is the CPI. They'll just take
the CPI for each year.
[21:45]
Uh this is effective January 1st, 2027.
[snorts]
[21:49]
Uh my recommendation is the motion. I
need a second.
[21:54]
» Make a second.
>> Second by Michael. Roll call.
[22:00]
[clears throat]
>> Johnston.
[22:02]
» Yes.
>> Vivven.
[22:03]
» Yes. Morphew.
>> Yes.
[22:06]
» McKenna.
>> Yes. [clears throat]
[22:08]
» Bulock.
>> Yes.
[22:10]
» Bennett.
>> Yes.
[22:10]
» Okay. There'll be some form of paperwork
which you can find out what it is that
[22:15]
we've got to do on this.
>> Some official form have to be filled
[22:20]
out. Find out what it I forgot. We going
to do it every four years. Was there any
[22:25]
other committees made?
I would say judge on the landfield
[22:29]
committee that um one of the uh
landfield operators uh has asked for a
[22:36]
meeting. They did not give us some
dates. I would let you know that the
[22:40]
preference would be prior to a regular
schedule meeting but they may need a
[22:44]
special call. Um so uh we have met and
we have discussed some of the
[22:51]
contractual terms similar to the
president franchise agreement not with
[22:56]
that company. we and discuss it with
them but within the committee.
[22:59]
» Okay. Well, uh just let us know and
we'll call we'll have a special call for
[23:03]
them whenever [snorts] come time.
>> Any other committees?
[23:09]
Me. Being none, let's do a roll call on
the uh magistrates comments and
[23:15]
requests. We'll start with the fifth
district. I don't have anything. Fourth
[23:20]
district.
I think North Park was needing $1,000
[23:25]
for their
fireworks show. City of Forsville, I
[23:29]
think there's four or 5,000. So, just
wonder if anybody wanted to pitch in and
[23:37]
help.
>> I will
[23:39]
proportionately.
Who else wants to help North Park?
[23:45]
» That that brings up qu I would I don't
mind at all to pitch in as well. Uh but
[23:49]
that brings up a question and I spoke
with uh our treasurer earlier last week.
[23:54]
Uh we had the community contributions
account and we've been have we been
[23:59]
paying for our dumpsters out of that? Is
that is that what has run through that
[24:06]
account because we're we're now to zero?
>> Yeah.
[24:10]
» Okay. Um, I know when we set our budget,
I thought that things like this were
[24:14]
going to be taken care of out of that
and the the community dumpsters is a
[24:18]
great great program, but we need to
visit this next budget and take care of
[24:23]
that in a different way because this is
something that's unforeseen and the
[24:26]
dumpsters was not in every district. So,
and this is something that is a
[24:31]
community- based.
>> Okay. Well, that's what we'll we'll
[24:35]
we'll look at that in in in
[clears throat] the budget. Uh, I didn't
[24:38]
intend for it to be for the dumpsters.
That's just the way it ended up.
[24:43]
U, so there's Dale and I are going to
contribute in and was that
[24:49]
» Jason Michael?
[clears throat]
[24:51]
» So that's five of us. Larry, you want to
help?
[24:54]
» No, I've got three parks in my district.
>> Yeah, that's So that's still five of us.
[24:59]
So that'll be two 200 a can you write
that down? [clears throat]
[25:04]
» How much?
>> 200 each. It'll be on builds and cranes.
[25:08]
» Okay, got it.
>> Do we need any kind of like an invoice
[25:13]
thing?
[25:17]
» No, I think since it's coming out of
your discretionary
[25:19]
» Okay, you just put it on bills claims to
North Park Association. Is that what
[25:23]
it's called?
>> North Park Association.
[25:26]
» Okay, I believe we got that. Thank the
road department for the job that they've
[25:30]
done and I think the airport let's
borrow blade and one other person to
[25:36]
help peel the ice off. So
hopefully we'll be more ready next time.
[25:41]
» Okay.
All right.
[25:46]
» Uh nothing nothing from the third is
district.
[25:49]
» Thank you Jason.
>> No thank you
[25:52]
» Michael.
>> I just like to give a shout out to the
[25:56]
road department. I know they took a lot
of calls. I took a lot of calls. I think
[25:59]
the other magistrates probably did as
well. This was unforeseen ice that we
[26:04]
didn't have, not saying we didn't have
the proper equipment. We didn't have the
[26:08]
right equipment for uh removing the ice
timely and the weather staying cold for
[26:16]
the time period that it did and stay
below freezing. It was it was really a
[26:21]
task. And if anyone goes to Facebook and
looks at Jason Burton's video, it's a
[26:26]
good example. He just went down the road
and went back down the road and it was
[26:31]
there was no change and with the
equipment that we were using and we
[26:35]
we're not from up north so we don't have
equipment like they do. Um, fortunately
[26:40]
we had some local farmers that showed us
what would work and uh we were able to
[26:45]
get a couple of those blades and get
finished up but not as quickly as
[26:48]
everybody would have liked. But I want
to give a shout out to the road
[26:51]
department working so hard.
>> Yes. And all of our neighboring counties
[26:54]
had the same problems. The back streets
in Orangeboro uh did not clear until
[26:59]
they melted off.
>> So we're not the only ones that had that
[27:03]
issue around. Thank you, Michael. Um
Justin, do you have anything?
[27:08]
» No, just thank you.
>> Uh Sheriff, you have anything else? Uh
[27:13]
who else? Donnie,
>> any other county official have anything?
[27:20]
If not, does anybody from the U general
uh citizenry have anything for the good
[27:27]
of this body?
>> You want to speak?
[27:30]
» Is that personal?
>> Yeah. You want to speak?
[27:32]
» Huh?
>> You want to speak?
[27:34]
» Yeah.
>> Yeah. Go ahead.
[27:37]
» Well, my interest is personal. Uh but
the issue is because of uh these charges
[27:45]
that the county brought against me over
the county issue over the cemetery road.
[27:53]
Do you recall this? Okay. I wanted to
know that you did and you recall it too,
[28:00]
Justin?
>> Yes, sir.
[28:01]
» Yes, sir.
>> Uh anyway, their binds was that I didn't
[28:06]
do anything wrong. What I done was not
against the law. Right.
[28:10]
» And uh under duress
uh Justin asked me for $600 restitution
[28:17]
for the gates [clears throat] and I
resent that and I think that I really
[28:21]
ought to have my money back.
>> What's uh what's the issue? We I don't
[28:26]
know.
>> Uh I actually didn't Well, I can't I
[28:29]
don't recall it either. I'm sure I knew
at the time, but I don't recall now. I
[28:32]
remember having to get cemetery gate
down to get people.
[28:36]
But the fact is is it's a public roadway
that it can't be closed because it's a
[28:41]
cemetery attached.
>> Mhm. [clears throat]
[28:44]
» And if it's a public bearing ground, it
cannot be changed.
[28:49]
And so therefore, the coal mines uh
their their vines was was wrong and the
[28:56]
engineering was wrong.
>> Okay?
[28:57]
» Because it should have never been
included.
[29:00]
» Okay?
>> I tell you what, Mr. Let me look into
[29:03]
that because
>> well what happened what you're saying
[29:08]
» what happened what what was the money
for
[29:12]
» uh for restitution for their gates
because I cut them down. I I talked to
[29:17]
everybody. I talked to uh the attorney
general, state of Kentucky attorney
[29:22]
general. They didn't know. They said to
take it up with my locals. I'd done
[29:26]
talked to Justin and uh that didn't
work. So, and I uh talked to the judge
[29:34]
and uh there was there I was at a better
end. So, I felt like that it was only
[29:40]
right to have the cemetery open. If it
had been a rock and had rolled out of
[29:44]
the bank and rolled down there and
blocked the road, if I'd moved it,
[29:46]
nobody had ever said a word. But this
show favoritism to the coal mines in my
[29:51]
opinion.
[29:54]
» Judge, do you care if I address it, Mr.
>> Yes, sir. Appreciate it. So with respect
[29:59]
to the charges that were brought that
they asked to prosecute or whatever um
[30:04]
at the time the coal mines has to take
certain precautions with regard to the
[30:08]
area and question that they may be
mining in a sense or in with respect to
[30:13]
there's certain federal laws on people's
access to that. And so it's my
[30:19]
understanding in doing so that that was
where they could block off. There was
[30:22]
question as to whether there was a
public road or not, but they put a fence
[30:26]
up so that that there could not be
public access in violation of federal
[30:30]
law. They had indicated that to you and
you demanded to be able to go to the
[30:35]
cemetery for uh to to visit, which is
certainly reasonable. Um, but they have
[30:41]
to monitor that and make sure. It was
also my understanding from the deputy
[30:44]
that they were offered a key so that you
could or anybody else that wanted to.
[30:49]
Now, I think you dispute that, right? I
think
[30:51]
» I refuse that because I didn't want the
key. I wanted the gate open.
[30:54]
» I understand. And so you disputed the
fact of whether you should get a key or
[30:58]
whether it should be open. And and and
you're okay with me disclosing any of
[31:02]
this?
>> No, I'm fine. That's I'm fine with that.
[31:05]
» So the problem became whether um the
federal law would would would control
[31:10]
with respect to whether even that
portion of the road was public or not.
[31:15]
So ultimately
um with that gate the officer said you
[31:19]
could have the key talk to them they'll
give you the key access anytime you want
[31:23]
but they just have to manage that so
that there's not unlimited access and
[31:28]
you chose then to say I'm not doing that
and I think you either cut down or ran
[31:33]
over or did whatever to their fence. I
don't recall exactly the damage but then
[31:37]
they showed proof of the purchase of the
gate um that what it cost them and so
[31:43]
with regard to the disposition of the
case we were asked to pay for that fence
[31:48]
no other and I think we deferred the
charges because of the question as
[31:52]
[clears throat] to access or not in in
convening the federal law with regard to
[31:58]
right to cemetery use and access. So I
mean it's a difficult case and I
[32:01]
understand the frustration and we're
very frustrated with it but it was
[32:06]
different things to do with it.
>> But my opinion I disagree with the
[32:09]
decision on it because because it's been
this way for probably a hundred years
[32:15]
and then all of a sudden the coal
company they can say that we're under
[32:19]
federal law and everything. The
engineering is supposed to go around
[32:23]
that. That was their problem. That's the
coal mine's problem. And let me tell you
[32:28]
more about the coal mine. The same
particular bunch years ago and they
[32:33]
change the names all the time. But there
was a time that I was going across
[32:37]
Midway Road and to come out over on
Highway 69 for between Centertown
[32:42]
Hartford.
>> Mhm.
[32:43]
» And uh there was a truck that was pulled
to the side of the road and the tail end
[32:47]
of it was sticking out in the road and I
sat there and waited for a few minutes.
[32:51]
So I chose to go on around him. They
chased me down and chewed me out
[32:57]
because they was fixing to set a a
charge up and I jumped out of the truck
[33:01]
and I chewed them out. I said, "Do you
realize that it's your job to get me
[33:06]
shut down?" I said, "You want an A
order?"
[33:10]
I know enough about that that I could
get them an A order of it. And that's
[33:13]
that's explosive under explosive laws.
You're probably familiar.
[33:18]
But the coal mines is not perfect. And
uh the other thing is is there's a few
[33:25]
of us here that's probably got family
buried and I know I do
[33:30]
» through the James.
>> Uh Mr. Hamilton.
[33:33]
» Yeah. Uh I had forgotten about this. Uh
I tell you what we'll do. Let me take it
[33:39]
up, get off the coal company, see if we
can resolve it some way. And I'll get
[33:44]
back with Justin, then I'll get back
with you. Okay.
[33:46]
» Okay.
>> Son, be sure I call Coke company.
[33:50]
» Appreciate you. Appreciate it. time you
give me here.
[33:52]
» Thank you, Mr. Hamilton.
>> Thank you. [clears throat] Does anyone
[33:55]
else got anything for the good of the
body?
[34:03]
» I just got a real simple request. Um,
I'm here on behalf of the mission
[34:08]
center. Um, I introduced myself a couple
weeks ago. My name is Jackie Brown. I'm
[34:12]
the manager of the mission center and
currently we are functioning as the Ohio
[34:18]
County clothing bank and we uh fulfill
the DCBS clothing vouchers as well as
[34:24]
our instore vouchers now and we provide
clo low barrier clothing access for
[34:29]
residents who do not qualify for formal
aid. We supply furniture to uh families
[34:34]
who have lost everything due to fires or
floods or domestic violence situations,
[34:38]
things like that. Um, all I'm really
asking for is that the county will
[34:44]
actually recognize us as
basically officially that we are a
[34:51]
clothing bank. No m,
no nothing else. I'm just trying to get
[34:56]
the county's recognition of us as that
facility.
[35:01]
» Um,
>> and we we have copy for 501c3
[35:05]
in on file,
>> right? Um, I do have a little packet
[35:08]
with me. I also have the paperwork that
needs to be filled out and signed if you
[35:12]
choose to decide that we are actually
the clothing bank. Um DCBES has already
[35:17]
signed and and has recognized us as
their go-to for their clothing vouchers
[35:24]
and things like that. So that's all I
was wanting to do was just to get formal
[35:29]
recognition of of the mission center as
being a clothing bank.
[35:32]
» Okay. Can you give the paperwork for
that to to Justin and let him review it
[35:38]
and will you put it on the agenda the
next time, son?
[35:41]
» So on the our next court meeting, we'll
officially act on that. Okay.
[35:45]
» Okay.
>> Give us time to review it because these
[35:47]
guys will ask questions.
>> Yeah.
[35:50]
» I know enough about it that I won't, but
thank [laughter]
[35:55]
» Okay. And I really so much appreciate
folks like you that have a passion to
[36:00]
help their fellow man in time and need
that it's just uh I just my hats off to
[36:06]
you.
>> Well, we've been there. So,
[36:11]
» thank you very much. Anyone else have
anything for the good of the body?
[36:15]
» Okay. Anybody else have anything for the
good of the body? If not, we're going to
[36:20]
dismiss. Oh, did you see somebody else?
I thought you I thought you raised your
[36:24]
» Well, the only thing I was going to do
is I want to acknowledge Miss Best Route
[36:28]
who is apparently coming towards the
end. Uh I done quite a bit of stuff over
[36:33]
the years. Uh I was in oil and gas. I
spent quite a bit of time in her office
[36:39]
uh researching title, etc. And I just
wanted to say to you that you're going
[36:44]
to be sorely missed in there. And I hope
wherever takes your place does just as
[36:48]
good a job as you've done because I've
been Illinois, Indiana, Kentucky, uh
[36:56]
Tennessee, Ohio. I've done title
research in courouses across the central
[37:01]
part of the United States. And Ohio
County has one of the best clerk's
[37:07]
office and is set up in a way that makes
it functional. And I just want to let
[37:12]
you all know how special she was and
that I appreciate her and she's going to
[37:16]
be missed.
[applause]
[37:21]
» Appreciate that. Thank you very much. Uh
Jody, did you have something?
[37:30]
» No. Um I'm really glad I could come in
the road department. Uh things were very
[37:35]
slow for tourism over the past two
weeks, but we're opening back up and
[37:39]
things are happening. We're looking at a
fundraiser coming up to um support the
[37:44]
museum and that's about it. We're doing
good.
[37:47]
» All right. Well, thank you and uh no one
else has anything. We're going to call
[37:51]
this meeting a journey. See y'all back
in two weeks. I'll see you Friday
[37:55]
morning.
