[5:32] It is 6:30 and I'll call this meeting to
[5:35] order. Can we start with the pledge
[5:41] to the flag
[5:43] of America?
[6:05] here.
[6:07] >> Trusty Chad
[6:08] >> here.
[6:09] >> Trustee
[6:10] >> here.
[6:10] >> Trustee Hunter here. Trusty Turno
[6:13] >> here. Trusty
[6:15] Major
[6:16] >> here.
[6:18] >> You have to practice that too. Thank
[6:20] you.
[6:22] >> Um could does anybody have any changes
[6:24] they'd like to make to the agenda? If
[6:27] not, can I have a motion to approve the
[6:28] agenda?
[6:30] >> I'll make a motion to approve the
[6:32] agenda.
[6:33] >> Second.
[6:34] >> Okay. All in favor?
[6:35] >> I.
[6:36] >> Okay. Thank you. And uh does anyone have
[6:38] any announcements?
[6:42] » I have none. All right. We'll move on.
[6:45] Uh this is the public comment portion of
[6:47] the meeting where um people in the room
[6:49] or online can speak for three minutes on
[6:53] any topic that is not on the agenda. Do
[6:56] we have anybody that wanted to speak on
[6:57] something not on the agenda? you know,
[7:00] not the room and right.
[7:05] Well, we only have two people.
[7:08] >> What if you're speaking about Twin
[7:10] Lakes, it's on the agenda.
[7:12] >> What was that?
[7:13] >> If that I know you're here about the
[7:15] Twin Lakes executive session.
[7:16] >> Okay, that's what I was curious. Max
[7:18] says the agenda,
[7:19] >> right? It has anything that's not on the
[7:22] agenda. People can [snorts] speak on any
[7:24] topic they want for three minutes on a
[7:26] topic not on the agenda.
[7:28] >> Okay. So, I just want to clarify that
[7:30] because of course I know we're here. Um,
[7:32] and there are no hands up online.
[7:34] >> Correct. Okay. We will move on to the
[7:36] consent agenda which includes two sets
[7:38] of minutes December 9th, December 30th
[7:41] and dispersements.
[7:43] Any comments, changes, questions?
[7:47] >> I just have a couple quick comments on
[7:49] the minutes. So for the 129 minutes,
[7:53] section G1 doesn't include a second for
[7:56] Trusty Major's appointments.
[8:00] And then for the 12:30 minutes, section
[8:02] D1 has an ingress spelling administrator
[8:05] witness name.
[8:07] >> Okay, good. Just anyone else.
[8:11] >> Okay,
[8:13] with that would um Trusty Hunter, would
[8:16] you like to make the motion so you can
[8:18] include those changes for
[8:20] Are we splitting up or do you want to go
[8:22] into dispersements as well?
[8:24] >> Oh, well, it's all on the consent
[8:26] agenda. So, if you want to wait to see,
[8:30] did anybody have any comments or
[8:32] questions on the dispersements?
[8:34] >> Okay. Okay. In which case, I think you
[8:36] should do the whole consent agenda.
[8:37] Thank you.
[8:38] >> I move to approve the consent agenda
[8:40] with the two for mentioning changes.
[8:44] >> I'll second that.
[8:45] >> All in favor? I
[8:48] >> motion passes unanimously. So, we'll
[8:50] move right into staff reports. We don't
[8:53] have a town administrator treasurer
[8:55] report,
[8:56] >> but um
[8:58] uh please Chief Laminger, would you
[9:00] please go with yours?
[9:01] >> Yeah, this is kind of just a a quick
[9:04] overview of 2025, some of the statistics
[9:06] that I thought were relevant. You get
[9:08] the water each meeting, each month. So,
[9:11] I didn't really want to rehash the calls
[9:14] we had specifically. This is more kind
[9:16] of just an overview.
[9:18] The department inits is respond to
[9:20] approximately 1,800 calls in 2025. That
[9:24] includes traffic stops, citizen assists,
[9:27] code enforcement, and 911 emergency
[9:29] calls. No, that doesn't mean we wrote
[9:31] 1,800 reports. That's just calls for
[9:33] service or something that we have radio
[9:34] traffic law.
[9:36] 2025 was also the first year since 2019
[9:40] that the department brought on new
[9:41] officers. This represents progress of
[9:44] staff retention and department
[9:46] cohesiveness. It's a department our
[9:48] size.
[9:51] It's very resource intensive to bring on
[9:53] new people, run them through an FTO, to
[9:56] buy them new equipment. So, um to the
[9:59] best of our ability, if we can maintain
[10:01] staff and keep those teams together,
[10:04] that tends to pay dividends, not just
[10:05] financially, but each year that that
[10:07] group is together, they get more
[10:09] familiar with each other. They work
[10:11] better together. And that's kind of just
[10:12] a team set
[10:15] officers completed approximately 472
[10:18] hours of training in 2025. That training
[10:21] includes statemandated training um
[10:24] through post as well as policymandated
[10:26] training.
[10:29] We utilize a blend of inservice online
[10:31] and classroom training. So you know that training line item that you guys
[10:35] see in budget workshops each year. If we
[10:38] send somebody to another agency's
[10:40] training, that's what we use that for.
[10:42] We also have some grant money. We use
[10:44] grant money as well. We don't apply for
[10:47] grants to get their birth training sense
[10:49] who. But
[10:51] the officers here attend a fair amount
[10:53] of training. We also have a lot of
[10:54] instructors on staff. So it makes us a
[10:58] lot easier for us to get those
[10:59] postmandate trainings particularly when
[11:01] it comes to driving, rest control, and
[11:04] firearms. We do a lot of that in house
[11:05] which is also very helpful for us
[11:09] and for the first time in three years
[11:10] the town had a municipal court docket
[11:12] every month using municipal court as a
[11:14] venue has been valuable to both
[11:15] defendants [snorts] victims and
[11:17] officers. Um when I first started
[11:21] we were going skipping a month or going
[11:24] two months with municipal court because
[11:26] we weren't writing as much in municipal
[11:28] court. Now that we have our municipal
[11:31] court up and running, that process has
[11:32] become much more streamlined.
[11:35] Some of the changes we've made to our
[11:37] own has kind of allowed us to write more
[11:40] things into municipal court as well. But
[11:42] it's been really well received, not just
[11:44] by victims, but also by defendants and
[11:47] the officers. We're not having to drive
[11:48] to Delta. We're not having to utilize
[11:51] district attorney's office, use their
[11:52] time. They're very busy. So when we can
[11:55] utilize municipal support, it it really
[11:57] is better for everybody involved. And so
[12:02] it was a goal of ours. I'm very happy to
[12:03] see the municipal courts being utilized.
[12:08] >> Any questions for the chief?
[12:10] >> Sure.
[12:11] >> One question kind of out of left field,
[12:13] but I'm just wondering if you'd have any
[12:15] progress on where to take animals as far
[12:18] as Royce and if that's
[12:21] there.
[12:23] To the best of my knowledge, u
[12:27] we don't currently have access to the
[12:28] voice source channels and I'm not sure
[12:30] those are going to be
[12:34] utilized all this year and I believe
[12:36] there are some talks to perhaps utilize
[12:40] some morning or some kennel services
[12:41] that are in Ridgeway
[12:44] possibly non trails but given the
[12:46] distance I'm not sure that would be
[12:48] feasible for us except in emergency
[12:49] situations
[12:51] we were making progress with the Royce
[12:53] Tur, but again, I'm not sure that's
[12:55] going to be viable
[12:57] 2026.
[12:59] Thank you. Anyone else?
[13:03] >> Okay, seeing no questions, we'll move on
[13:05] to Nikki for the public works report.
[13:08] Thank you.
[13:10] >> Style, I should have done the year's
[13:12] overview, but this is just December. to
[13:14] start off with water. Um the 2 million
[13:18] gallon rellining project is still on
[13:20] hold a little bit until the crew can get
[13:22] back here. Um here's a picture kind of
[13:24] to show you what it looks like up there.
[13:26] They did some road work. U the outside
[13:28] is all painted green. So just a quick
[13:31] little update there. Uh wastewater, no
[13:34] updates. All right. Um streets, this is
[13:38] kind of our slower season in streets.
[13:41] So, there's a lot of potholes and
[13:42] trimming while the trees are dormant,
[13:44] uh, brush, things of that sort.
[13:51] We did, however, have a small little
[13:53] snowstorm there just about two inches in
[13:57] December. We saw this in the
[13:58] dispersements as well. We had some
[14:00] emergency living removal that were
[14:02] becoming dangerous. Here's a before and
[14:04] after. Sorry, they're from the opposite
[14:07] sides of the street. Um, but those
[14:09] branches that are hanging down, that are
[14:11] starting to curl down, um, when those
[14:13] get weight on them, they snap. So, they
[14:15] took those off because it was hanging
[14:17] over Third Street. Um, there's also a
[14:19] good picture on the next one. This one
[14:21] did snap and it was too high for us to
[14:24] reach. See, it's completely vertical
[14:27] there. That was another one we had to
[14:29] call someone in to get it.
[14:33] Um, that was a pretty big one for trees.
[14:36] uh parks. We are working with a
[14:38] landscape company
[14:40] to get us an estimate to redo the park
[14:43] sprinklers and pump house that's on the
[14:45] capital improvement project uh or plan
[14:48] which we ended up getting that back. So
[14:50] that'll be in January's report but we
[14:52] got a little bit more work to do on it.
[14:54] Um trash
[14:56] they have finished the initial
[14:59] construction for the del compost project
[15:02] out at Twin Lakes. Uh, I didn't have a
[15:05] picture of it completely finished, but
[15:06] we put some dirt in there that we can
[15:09] drive up on it. Um, so the lip isn't
[15:11] there anymore. There is a
[15:15] plan to hide it kind of like we were
[15:17] talking about before with a larger
[15:19] banner stand that we could put something
[15:21] with, you know, possibly welcome to
[15:24] payon with our logo, things of that
[15:26] sort.
[15:27] um they're going to start building the
[15:29] structure and then we will probably
[15:31] bring this back to what do we want on
[15:33] those banners? What do we want it to
[15:34] say? It's for us us.
[15:38] Um
[15:40] and just other in general uh public
[15:42] works, we completed our anti-ar
[15:44] training. I think that was probably the
[15:47] second time public works was actually
[15:49] able to all get together and training.
[15:51] So it was pretty big feet
[15:58] questions. Yes, sir. Just eternal.
[16:00] >> Right now the there is a like a banner
[16:03] stand near there. So you're talking
[16:05] about another doing something separate.
[16:07] >> Correct. Yeah. And it'll actually be
[16:09] twice as long
[16:11] >> um to make sure that we cover everything
[16:13] behind it as well. Um, so there's a few
[16:16] different ideas that we will bring um of
[16:18] which banner we would put on it, but
[16:20] they wanted to build the structure and
[16:21] it's also temporary, just concrete
[16:24] pillars, some steel just like the one
[16:26] that's out there already.
[16:29] There should be room for four bankers on
[16:33] questions from vote. Okay, seeing none,
[16:37] we'll move to the next part of the
[16:38] agenda, which is uh the executive
[16:41] session. And rather than my read this,
[16:45] I'd like to entertain a motion for
[16:48] someone to uh read this as part of the
[16:51] motion to go into executive session.
[16:53] Somebody would be willing to do that. I
[16:56] move that the board may enter into
[16:58] executive session as authorized by
[17:00] section 24-6402
[17:04] B4B CRS for the purpose of conference
[17:07] with the district's legal council
[17:10] regarding the specific legal questions
[17:12] pertaining to the Carl Eberg Education
[17:15] Foundation's interest in purchasing the
[17:18] town's property generally located at
[17:21] 33rd Street for the purposes of
[17:24] remediation and redevelopment into an
[17:26] educational museum and related uses and
[17:30] is authorized by section 24-6-42
[17:36] forec
[17:38] to determine positions relative to
[17:40] matters that may be subject to
[17:42] negotiation
[17:44] develop strategy for ne negotiations and
[17:47] instruct negotiators with respect to
[17:50] actions to be taken on behalf of the
[17:52] town. Thank you for all that. Now
[17:55] >> a second.
[17:56] >> All right, we have a motion and a
[17:59] second. All in favor?
[18:01] >> I
[18:02] >> Okay, with [clears throat] that we will
[18:03] leave go into executive session and see
[18:09] take a few things.
[18:14] And Trusty Hunter, thank you for ringing
[18:15] your phone. Yes, your wife. Thank you.
[53:06] on the rally.
[53:09] [snorts]
[53:10] All right,
[53:13] the time is now
[53:15] 7:18 and the executive session has been
[53:18] concluded. The participants in the
[53:20] executive session were Trusty Hunter at
[53:24] Czech Ari and Major Robin Mayor Prom
[53:27] Stelter, myself, Clerk Better, Sheila
[53:32] Stat, Clay Bner, and Nikki Polus.
[53:36] For the record, if any person who
[53:37] participated in the executive session
[53:39] believes that any substantial discussion
[53:41] of any matters not included in the
[53:43] motion to go into the executive session
[53:45] or that any improper action occurred
[53:47] during the executive session in
[53:48] violation of open meetings law, I would
[53:51] ask that you state your concerns for the
[53:53] record.
[53:56] Um before we move on to the next agenda
[53:59] item, I'd like to ask for a motion
[54:03] to be able to uh take our this issue to
[54:06] a public meeting.
[54:07] >> Madame Mayor, I'd like to move that an
[54:10] agenda item be added to the first board
[54:12] of trustees meeting in February to
[54:14] discuss
[54:16] um the Twin Lakes property.
[54:20] >> I'll second that.
[54:21] >> All right. All in favor?
[54:23] >> I thank [clears throat] you. That's
[54:24] unanimous. We're just going to move on
[54:26] to our next
[54:28] agenda item, which is
[54:33] catch up to myself. Um, consideration of
[54:36] extending the grant agreement with Dola
[54:38] for the code rewrite.
[54:40] So, in the absence of Stephan being
[54:43] here, um, I could probably do a little
[54:47] bit of a summary. So, we uh went into a
[54:50] contract with
[54:52] oh my gosh Leslie Clusmeer with her
[54:56] company to do a code rewrite and it was
[54:58] as pretty pretty entire code rewrite
[55:01] we've gotten some of the
[55:03] um code rewrite in a larger sense but
[55:07] because of the desire to have our
[55:12] chapter 16 land use comport with our
[55:16] recently adopted comprehensive plan. The
[55:20] request is to extend this contract until
[55:24] June, which the Department of Local
[55:26] Affairs is is okay with us doing. Uh
[55:30] originally the contract was going to end
[55:32] January 31st, but Stephan had some
[55:34] discussions with Department of Local
[55:36] Affairs and they said, you know, if you
[55:37] need more time, please write us a letter
[55:39] and let us know. So, he would like to
[55:41] ask for more time to June 30th. No, no
[55:44] additional money is being asked for. Um
[55:47] he wrote in his report that there is
[55:49] $9,78.15
[55:51] remaining in the grant and the town also
[55:54] has to provide a 50% match. So there's
[55:56] still close to $20,000 in the grant. And
[56:00] um Stephan feels that that is enough to
[56:03] get a pretty
[56:06] uh discussion ready changes to chapter
[56:09] 16. And then I'll add that I've looked
[56:12] at some of the other chapters that she
[56:13] had proposed changes to and they can
[56:16] come forward in the future as well in in
[56:18] a lot of cases as she had proposed
[56:20] because some of it is just a cleanup
[56:22] that's not a huge amount of difference
[56:24] in approach so we could have more code
[56:27] rewrite in the future. But Stephan felt
[56:30] like this was worthy of um staff
[56:34] uh
[56:36] hard looks is the word I'm looking for the staff to really focus in on
[56:40] chapter 16 as a comprehensive plan. So
[56:43] I'm sure there's stuff that Stephanie
[56:45] would add, but I think if that you know
[56:47] please ask any questions and I'm gonna
[56:49] also give the the public online and in
[56:52] the room the opportunity to ask any
[56:54] question or to speak for three minutes
[56:56] on this topic as well. So maybe I'll do
[56:59] that right now if anyone in the room
[57:01] would like to speak about extending the
[57:03] DOA grant for code rewrite or anyone
[57:05] online. I see no hands. Correct. Okay.
[57:10] So with that, if the trustees would like
[57:11] to ask questions, discuss
[57:19] questions.
[57:20] Okay. Well, I'd like to make a motion
[57:27] » move to approve the grant extension
[57:30] request with DOA
[57:32] uh for EIA AFA 00278 and allow the mayor
[57:36] to submit the necessary letter to DOA
[57:38] requesting the extension.
[57:40] >> I'll second.
[57:43] >> I second it. [laughter]
[57:45] >> All in favor?
[57:47] >> I.
[57:47] >> All right. Thank you. That passes
[57:49] unanimously. Now, the next one is
[57:51] consideration of approval of the
[57:53] intergovernmental agreement with Delta
[57:55] County elections for the April 7th, 2026
[57:58] municipal elections. And I will turn
[58:00] that over to clerk better.
[58:04] >> Um, so this is just basic housekeeping
[58:07] for once. We won't be turning it in at
[58:10] the last hour, which is nice for me. Um,
[58:14] I also want to make it clear. I mean,
[58:15] right now we have eight packets out.
[58:18] We've had three come back to go back out
[58:20] to be cured one um sufficient candidate
[58:25] so far. So there's always a possibility
[58:28] still to you know if we only get five
[58:30] people we could do a resolution and
[58:32] cancel the election but there's stuff
[58:34] built into place. So signing this today
[58:37] shouldn't affect that in the future um
[58:40] as long as our timing is right. So,
[58:44] >> um, and other than that, we just need to
[58:46] get it over there so they know that
[58:47] we're going to take part because, um,
[58:49] communities split the costs of
[58:51] elections. So
[58:54] >> that was a question of what you just
[58:55] said. So you got and this is these are
[58:58] for the vacancies of the board and so
[59:02] you said you got three two had to go
[59:04] back for curing
[59:05] >> kind of what are
[59:07] >> okay so you um the election packet they
[59:11] come and they pick up a packet and they
[59:13] have to return a candidate affidavit
[59:15] declaring their candidacy and you have
[59:17] to take a petition out and get at least
[59:21] 10 signature 10 valid signatures on it
[59:24] and so I've had eight people pick up
[59:26] packets. I've had three come back. Um,
[59:31] one I imagine she'll probably be here
[59:34] tomorrow to take care of the one thing
[59:35] that she needs to do for her petition.
[59:37] Um, another one I had to um take
[59:40] invalidate a couple of signatures
[59:42] because they didn't match voter
[59:43] registrations. So, they just have to
[59:45] bring me in a new thing with a few more
[59:47] signatures that are valid. Um, so that's
[59:49] what I mean by curing. um just because
[59:52] they have those are prerequisites for um
[59:54] actually declaring themselves as a
[59:57] candidate.
[59:59] Um I'll also say that as as I was
[1:00:02] reading through uh the exhibits
[1:00:05] um yeah the question was going through
[1:00:08] my mind if people mail things in there's
[1:00:10] postmark issue which is just being
[1:00:12] discussed now um as to whether um things
[1:00:17] that come in on the postmark are really
[1:00:20] going to count unless the postal office
[1:00:23] validates that. But I don't think the
[1:00:26] kinds of things that they're talking
[1:00:27] about right now would apply just yet.
[1:00:31] Okay. Yeah, that's um and I guess I was
[1:00:34] just like it it'd be good to be prepared
[1:00:37] to make sure we know the right answer to
[1:00:38] that question if it comes up.
[1:00:42] >> Well, who that is going to affect is
[1:00:44] going to be um Delta County elections.
[1:00:47] They're the ones that mail out the
[1:00:48] ballots, receive them back and do the
[1:00:50] counting. It's one of the reasons
[1:00:52] there's built-in time for that. It's one
[1:00:54] of the reasons why we wouldn't swear in
[1:00:56] new people until the second meeting of
[1:00:59] April, whether we have an election or
[1:01:01] not, because you have to certify an
[1:01:03] election within 10 days. And during that
[1:01:05] time is um you know, making sure that
[1:01:08] any ballots that came in late but are
[1:01:10] still valid or counted. Um and then I do
[1:01:14] believe it's built into statute to where
[1:01:15] there's just a certain point if you mail
[1:01:16] your ballot too late, you're just kind
[1:01:18] of in a trouble. that most overseas
[1:01:21] stuff goes out actually before other
[1:01:23] ballots do. So, they do have built-in
[1:01:25] things to help combat that.
[1:01:29] Other questions?
[1:01:31] Any comments from the audience or anyone
[1:01:34] on Zoom?
[1:01:36] Okay, seeing none. Um,
[1:01:41] are you ready for a motion? Any other
[1:01:44] Did anybody want to ask anything? I know
[1:01:46] I have my head turned so I don't always
[1:01:47] see Okay.
[1:01:51] I move to approve the IGA with Delta
[1:01:54] County elections for the April 7th to
[1:01:56] 2026 municipal election.
[1:02:00] >> Second.
[1:02:01] >> Okay. Motion and second. All in favor?
[1:02:04] >> I.
[1:02:05] >> Okay. Unanimous. Thank you.
[1:02:08] >> And our last topic is consideration of
[1:02:10] approval of resolution 01-2026
[1:02:14] public posting.
[1:02:18] and I'll turn that back to you. So, this
[1:02:22] is a statutory statutoily
[1:02:26] required resolution. We have to pass at
[1:02:28] the first regular meeting of the year.
[1:02:30] Um stating making sure that pe the
[1:02:34] public is aware that we post any meeting
[1:02:36] notifications and you know big legal
[1:02:39] stuff at the front of town hall on our
[1:02:41] town website and that are official and
[1:02:44] then in the DCI. Um so this is
[1:02:49] helps keep
[1:02:57] um questions.
[1:03:08] Any uh comments from the audience in in
[1:03:13] the in person or online?
[1:03:16] Okay,
[1:03:21] with that, would someone like to make a
[1:03:22] motion?
[1:03:25] >> I move to approve the resolution 01-2026
[1:03:30] for public posting.
[1:03:34] » We have a second. All in favor? I
[1:03:36] >> I
[1:03:36] >> thank that motion passes. And I don't
[1:03:40] think we have a ad hoc short-term rental
[1:03:44] report. Do we
[1:03:45] >> I just have a quick question before we
[1:03:47] adjourn. Is there a meeting scheduled?
[1:03:48] Just curious. Um,
[1:03:51] no, not that I'm aware of, but I'm happy
[1:03:54] to get a doodle pull sent out. I think
[1:03:56] everybody was waiting for the holidays
[1:03:58] to be over. Um, I'm happy to get a
[1:04:00] doodle poll sent out so you guys can get
[1:04:02] that committee going again.
[1:04:09] I'll adjourn the meeting in just a
[1:04:10] minute after we get this signed.
[1:04:14] Yes. [laughter]
[1:04:15] Okay. Mike has his own. Okay.
[1:04:36] Just for the record, every the trustees
[1:04:39] are signing the dispersements to uh
[1:04:42] acknowledge that they were approved
[1:04:44] tonight, but it doesn't become official
[1:04:46] until the meeting minutes are published.
[1:04:48] So, this is our interim public approval
[1:04:52] so that we can send checks and pay the
[1:04:55] vendors that we've just approved pay for
[1:04:58] anyone wondering. Okay, we're down to
[1:05:00] the last signature, so I will adjourn
[1:05:03] this meeting. Thank you all.
