[0:00] Our
[0:23] cameras aren't working through you, Mr. Chair. I can confirm it
[0:28] is 4:07 p.m. and we are now recording and you can begin
[0:33] your meeting. >> Okay. Thank you and thanks for
[0:35] everyone's patience. Sorry for the delay there. Um it's uh this is a meeting of
[0:39] the committee of adjustment and I'm going to call the meeting to order.
[0:41] There is a quorum of the committee present. Um
[0:47] uh Miss Assistant Secretary Treasurer would you please begin this meeting with
[0:51] the land recognition statement? >> Yes. The town of Pelum is situated on
[0:55] treaty land steeped in the ris rich rich history of the first nations such as the
[1:00] Haduender Hodenosi and the initab including the missagas of the credit
[1:06] first nation. This territory is covered by the upper Canada treaties and is
[1:11] protected by the dish with one spoon wampom agreement. Today many first
[1:16] nations mate and Inuit people from across turtle island live and work in
[1:21] Niagara. The town of Pelum stands in solidarity with all indigenous peoples
[1:26] past and present acknowledging that our high standard of living is a result of
[1:31] the resources and lasting friendship of indigenous peoples. Through you, Mr.
[1:35] Chair, you may proceed with your introduction.
[1:41] » Yeah, thank you. Uh so in terms of staff that are here today, there's three
[1:45] members of the committee that will be hearing uh the matters in front of us
[1:49] today. There's John Kappa, Sue Sarco, and myself, Isaiah Banick. Um, we have
[1:53] the assistant secretary treasurer Jodi Conte, um the legislative coordinator,
[1:58] Alex Lewis, planning manager, Shannon Lorac, and engineering technician, Jim
[2:03] Leisma. This is a hybrid hearing of the
[2:06] committee of adjustment for the town of Pelum. Everyone present will be given an
[2:10] opportunity to comment on the applications being heard. Agencies
[2:14] commenting on applications may request that certain conditions be imposed
[2:19] should an application be approved. Voicing objections to these conditions
[2:23] will not adversely affect the committee's decision.
[2:27] The purpose of the application and relative correspondence will be heard
[2:30] following which the applicant will be given the opportunity to address the
[2:34] application. During the public portion of each application, we will hear from
[2:38] anyone wishing to submit verbal comments. Comments received following
[2:42] the public portion will not be considered. At the conclusion of the
[2:46] discussion, the committee will render a decision and advise of any applicable
[2:50] conditions. Specific wording for conditions may be
[2:54] determined by the committee following the hearing.
[2:58] Copies of decisions will be mailed to the applicant and agent and members of
[3:02] the public that have submitted comments. Notices of decision can also be obtained
[3:07] by request to the assistant secretary treasurer. Committee members are asked
[3:11] to raise your hand if you would like to speak and vote. Applicants, agents, and
[3:15] attendees are advised they're free to leave the webinar or the room once a
[3:19] decision has been made on their application.
[3:23] Okay, let's move to uh item four, approval of agenda. Is there a motion to
[3:27] approve today's agenda? >> Go ahead.
[3:31] » I move. >> And I second it.
[3:34] » Okay, thank you. Um pecuniary interest. Does any member of this panel have a
[3:38] pecuniary interest in accordance with the Municipal Conflict of Interest Act
[3:42] in any of the applications to be considered at this hearing?
[3:46] » Uh, no, I do not. >> I have none.
[3:49] » And none for me either. Okay. Uh, Miss Ki, any requests for withdrawal or
[3:54] adjournment? >> There have not been any requests for
[3:57] withdrawal or adjournment. >> All right. Very good. Uh, so we are
[4:00] ready to proceed to our uh, first application today. This um is file
[4:06] A52026P relating to a request for minor variance
[4:10] at 1169A Maple Street. And we'll note that the
[4:16] committee is considering application A5. Uh the assistant secretary treasurer
[4:21] will present this matter relating to 1169A Maple Street as well as file A6
[4:30] relating to 1169B Maple Street together as they relate to adjacent semi-
[4:37] detached dwellings and seek identical reductions to the required front yard
[4:41] setbacks and have received the same agency comments. While the applications
[4:46] are under separate ownership, they will be addressed concurrently for the
[4:49] purposes of staff presentation. And notwithstanding that we're going to
[4:54] do this combined presentation, each application will be considered
[4:57] separately and will require its own comments, discussion, and decision by
[5:01] the committee. Okay. So with that, uh, Miss Conti,
[5:05] should we, uh, read this summary presentation?
[5:16] Okay. For committee of adjustment hearing,
[5:19] the town of Pel.
[5:23] Okay. >> The town of Pelum is holding hybrid
[5:26] committee of adjustment hearings. A hybrid hearing involves a mix mixture of
[5:31] inperson and remote attendance and participation. The following
[5:35] presentations are based upon the town of Pelum's planning department report
[5:39] analysis. Please note that no decisions have been made prior to this public
[5:43] hearing. All comments received from commenting agencies and the public have
[5:48] been forwarded in full to the committee of adjustment members for their
[5:51] consideration and will appear summarized.
[5:55] Decorum. The committee of adjustment is a formal public hearing requiring
[5:59] decorum. All comments are to be made through the chair. If you have
[6:03] pre-registered to speak virtually or are participating in person, you will be
[6:07] given an opportunity to address the committee at the public portion of the
[6:11] meeting. If someone ahead of you has made the same comments you wish to make,
[6:15] there is no need to repeat. Please keep all comments concise. Comments received
[6:20] during the public portion of the meeting. Otherwise, they will not be
[6:24] considered. Inappropriate comments are not tolerated. If the quorum is lost,
[6:29] the meeting may be recessed and persons will be asked to leave.
[6:33] So applications for minor variance for files A52026P
[6:39] and A62026P. A5 relates to 1169A Maple Street. The
[6:46] subject land is located on the east side of Maple Street lying north of Camber
[6:50] Road. Legally described as part 7 East Side Maple Avenue, plan 703, being parts
[6:57] three and four on reference plan 59R1 18183.
[7:02] municipally known as 1169A Maple Street. For file A62026P,
[7:09] this relates to 1169B Maple Street. The subject land is located on the east side
[7:15] of Maple Street, lying north of Camber Road, legally described as part 7 East
[7:21] Side Maple Avenue, plan 703, and being parts one and two on reference plan 59R
[7:28] 1801 183. The applications seek relief from section 6.1.3
[7:36] zone requirements for a semi- detached dwelling for the maximum front yard to
[7:41] permit a maximum front yard setback of 8 m whereas the bylaw requires 6 meters.
[7:48] To date, the following comments have been received from public works.
[7:52] Per the town CLI ECA process, it is required that all alter alterations to
[7:59] the town sanitary collection system be approved prior to installation by the
[8:03] town of Pelum. The application was incomplete and a force main was
[8:08] installed in April 2025 without the town's approval. As of the time of this
[8:14] application, the town has not received a complete application for the alteration
[8:18] of a 50 millimeter force mane installed at 1171 Maple Street. The town requires
[8:25] resubmission of all documents and application forms for the alteration of
[8:30] the 50 millimeter force main and the applicant is required to pay a fee of
[8:36] $1,820 for review and approval of the
[8:39] alteration and no public comments were received at the time of writing the
[8:44] report. Minor variance test one. The variance is
[8:48] minor in nature. Yes, the variance proposes an additional 2 meters to the
[8:53] maximum front yard. The impact on the surrounding neighborhood and adjacent
[8:58] properties is negligible given the prevailing pattern of development along
[9:03] Maple Street where larger and varying front yard setbacks are common. The
[9:08] proposed setback does not create adverse impacts on adjacent properties in terms
[9:12] of privacy. Test two, is the variance desirable for the development or use of
[9:18] land? Yes, a front yard setback of 8 meters allows the new dwellings to
[9:22] integrate well into the streetscape, which is characterized by varying front
[9:26] yards. Locating the dwellings further back on the lot may offer functional
[9:32] benefits such as enhanced landscaping opportunities and an improved interface
[9:37] with adjacent properties and additional parking opportunities. From an urban
[9:42] design perspective, the proposal respects and reinforces the character of
[9:46] the area, which is a key objective of appropriate development.
[9:52] Test three. Does the variance maintain the general intent and purpose of the
[9:56] zoning bylaw? Yes. The general intent of the maximum front yard setback provision
[10:01] is to regulate the placement of buildings to ensure compatibility with
[10:05] surrounding development and maintain high quality and consistent streetscape.
[10:10] Although the variant seeks relief from the prescribed maximum setback, it
[10:15] upholds the broader intent by aligning the new dwellings with the existing
[10:19] pattern of development on adjacent and nearby lots. By permitting a greater
[10:24] setback, the proposal avoids the future dwelling
[10:28] projecting greater into the front yard relative to neighboring homes. Test
[10:33] four. Does the variance maintain the general intent and purpose of the
[10:37] official plan? Yes, the subject property is designated
[10:42] urban living area in the official plan which permits lowdensity residential
[10:46] uses including semi- detached dwellings. Permitting the increased front yard
[10:51] setback facilitates a design that is contextually appropriate and contributes
[10:56] to a cohesive streetscape. Based on the analysis, staff is of the
[11:01] opinion the variances are minor in nature, conform to the general policies
[11:06] and intent of both the official plan and zoning bylaw, and are appropriate for
[11:12] the development and use of the land. Planning staff recommend that
[11:16] application number A52026P be approved subject to the following
[11:21] conditions and that application number A62026P
[11:26] be approved subject to the following conditions.
[11:30] Obtain all necessary building permits prior to construction commencing to the
[11:35] satisfaction of the chief building official
[11:38] and resubmit all required documents and application forms for the alteration of
[11:43] the 50 millimeter force man located at 1171 Maple Street and pay a fee of
[11:49] $1,820 for review and approval to the
[11:53] satisfaction of the director of public works.
[11:58] Through you, Mr. chair. The applicant and his agent are both here. Um,
[12:04] Lawrence Fairman and his agent, Jesse Fairman.
[12:10] Thank you. Yes, you're welcome to come forward. Um, just to speak again about
[12:14] process before we uh proceed. So, what we'll do today is we're going to hear
[12:18] both items separately. So, we're going to hear hear one and then move to the
[12:22] next one. and then of course invite you to speak and anyone else in the room
[12:24] that would like to uh speak to this item will be invited to do so afterwards as
[12:28] well.
[12:31] » So go ahead, start with your name kindly. Thank you.
[12:35] » So I'm Jesse and this is my dad Lawrence. And uh just a little
[12:39] background on the project is um my dad had the adjacent property and we severed
[12:46] it about a year ago and we're going to be building a semi- detached residence
[12:51] together to on the parcel that we seed and about a
[12:56] year ago we installed the force man and uh I talked to Jim earlier this morning
[13:02] because uh like I just don't agree with the comment that we did it without
[13:06] permission um just because we did go through all the process we had the
[13:11] pre-construction meeting with the city and uh we hired a reputable contractor
[13:16] with Silver Line and I think just the that transpired was that uh we were just
[13:24] missing a bit of information and I talked to Jim this morning and he talked
[13:28] with Jason Mah and we're going to get them that information because I haven't
[13:32] talked to our engineers since May of last year. So I I didn't really know
[13:36] that this information was out.
[13:42] » I appreciate appreciate that comment. Um uh perhaps we'll get some uh
[13:47] clarification from staff as well, but I wanted to invite the committee if
[13:50] there's any comments or questions before that or if you have the same same
[13:55] question as me perhaps. Okay. Uh perhaps I'll ask uh uh Mr.
[14:01] Ledma uh for your comment on the comment about the uh confusion around the uh uh
[14:10] the force main and the condition relating to that. if you'd like to
[14:14] comment on staff's position. Thank you. >> Uh three, Mr. Chair. Um yes, the we we
[14:22] spoke uh earlier regarding the um um with this matter um last year. This uh
[14:29] this project um uh it came through a committee as well uh for the severance
[14:33] of the the project and it went through a uh development um agreement with uh with
[14:39] the town and the the owners. Um there were some communication or
[14:44] miscommunication between the um the engineer and um I should say
[14:50] with the engineer because we the town had communicated a couple of times and
[14:55] tried to confirm and try to get that information from from the engineer.
[14:58] However, we're not successful of obtaining that um um uh that that
[15:04] document that we require. So um from our communication earlier with uh with Jesse
[15:09] I think uh once we get that uh information then we can get that cleared
[15:14] that condition cleared. I see. So just as a matter of kind of
[15:19] confirmation here what the condition um relates to is
[15:25] a resubmission of documents and application forms. That's kind of part
[15:32] one. And then part two to it is paying a fee relating to that. So is it your am I
[15:39] understanding correctly that it's your view that the first part of the
[15:43] condition should remain and the second part of the condition relating to the
[15:46] fee is not necessary anymore or did I misunderstand what you're saying?
[15:50] » Yes, that is correct. Uh I got confirmation from uh from our director
[15:54] that that can be waved um with uh with the uh uh applicant
[16:00] submitting those additional informations regarding the uh the force main.
[16:04] » Right. >> And uh we could uh clear it off.
[16:08] » Right. Okay. >> Okay. Mr. Beerman, does that make sense
[16:12] to you what what uh what my conversation was there. So in other words, um there
[16:15] is a condition there relating to submitting the documents. I think that's
[16:18] still required. Um but what what's being proposed or what the committee would
[16:22] consider at least um is whether the fee part would be removed. Does that does
[16:26] that make sense to you? >> Yeah, that makes sense to us. I just
[16:28] wasn't aware there was anything outstanding until uh this morning when I
[16:32] got the comments. So now I'll get on the engineer to provide the information.
[16:40] » Okay, thank you. Now we can now we can hear outside the room for the recording.
[16:44] Um okay, maybe I'll pause and invite uh the committee again. any any questions
[16:48] on what I've or comments on what I've asked?
[16:51] » No, I had the same kind of questions in my head when I first came in today to
[16:56] read this, but now that we've kind of um gone through it, I'm I'm comfortable
[17:00] with it being resolved.
[17:05] » Okay. Um any other questions for the applicants? I don't think so. Okay.
[17:12] Um you're welcome to take a seat for for now. Thank you. Um, anyone in the
[17:17] audience uh that would like to speak to this matter?
[17:22] Doesn't look like it. Um, and I I don't think there's anybody online either. Is
[17:26] there anyone online?
[17:30] No. Okay. Okay. Um, then should we close the public portion of the meeting?
[17:42] » Yes. I move that we uh close the public portion of the meeting.
[17:45] Okay, good. >> I second.
[17:47] » Thank you. Yes. Need that. Um, any other discussion or do we should we move to uh
[17:54] the agenda item? Any comments or questions? I'm happy to read out um if
[17:59] it's convenient uh the amended motion if that's uh that works.
[18:02] » That would be great. >> Okay. Uh so what I will what I will do
[18:06] is um
[18:10] um I'm going to propose just to preempt this that we will keep the condition um
[18:15] but I will read it in a way that will remove the fee component but otherwise
[18:20] keep the balance of the condition. So, um I will move that application A5206P
[18:27] be approved subject to the conditions in the staff report as amended and
[18:32] specifically that condition two be revised to read that the applicant
[18:38] resubmit all required documents and application forms for the alteration of
[18:44] the 50 millimeter force man located at 1171 Maple street
[18:53] to the satisfaction of the director of public works.
[18:58] Uh so with that I'll read the balance of the motion as well. Um the reason uh so
[19:03] the application is made for minor variance uh to permit a maximum front
[19:08] yard setback of 8 mters whereas the bylaw requires 6 mters. Um we uh move to
[19:15] have this granted. The reasons being that the variance is minor in nature as
[19:19] the increase to the maximum front yard is 2 meters. The impact on the
[19:23] neighborhood and adjacent properties is negligible and the proposal will not
[19:27] affect privacy and is consistent with surrounding development. The intent and
[19:32] purpose of the zoning bylaw is met. The intent and purpose of the official plan
[19:36] is met. The proposal is desirable for the appropriate development of the land
[19:41] as the 8 meter frontyard setback is compatible with the varied streetscapes
[19:45] and provides functional benefits while maintaining the character of the area.
[19:49] The application is granted without prejudice to any other application in
[19:52] the town of Pelum and the committee of adjustment considered uh the written and
[19:56] oral comments and agrees with the minor variance report and recommendations uh
[20:02] subject to the comment that I made that this application meets the planning act
[20:06] tests for minor variance and the conditions again to repeat them uh
[20:10] there's one condition that all necessary building permits are obtained prior to
[20:14] construction commencing to the satisfaction of the chief building
[20:17] official and the Second condition as amended is that the applicant resubmit
[20:22] all required documents and application forms for the alteration of the 50 mm
[20:27] force main located at 1171 Maple Street to the satisfaction of the director of
[20:32] public works.
[20:40] » I mean I'll go ahead and make a motion to vote on the amendment.
[20:44] » What do we need to second? Do we need to second?
[20:46] » We need a second. Oh, I will second it. Sorry.
[20:49] » We did it. We proceeded a bit unusually here. Okay. Yeah.
[20:52] » So, second. Now we can uh do the do the motion. Yes.
[20:57] » Go ahead. >> All those in favor?
[21:00] » Yes. >> Yes.
[21:01] » Yes. >> Thank you.
[21:04] » Okay. Um so then that uh closes the first part. So that's so we voted on a
[21:09] little bit. It's a little bit convoluted, but just procedurally that
[21:12] was the first uh that was A. So now we're going to do B. Um so uh we're
[21:17] welcome to proceed to the uh to be uh Mr. Vir you're you're welcome to come
[21:23] back if there's uh any comments or any different uh comments on this site if
[21:27] you'd like to make those if that's unnecessary. It's fine not to do so as
[21:30] well. It doesn't look like you're going to you're going to come up. I'll just
[21:33] confirm uh with Mr. Lema again that your comments apply to this uh excuse me uh
[21:39] your comments apply to to this site as well. I presume through you Mr. Chair.
[21:43] Yes, it does apply as well. >> Okay, thank you. Um, anybody else in the
[21:47] room? I wouldn't expect so, but want to ask for to make sure I'm absolutely
[21:51] clear that there's no one else wants to speak to this item. Doesn't look like
[21:54] that. Okay. Um, should we uh close the the public portion of the meeting?
[22:01] » I motion to close the public portion. >> I second.
[22:04] » Okay. So, that's closed. Any comments from the committee?
[22:07] » No. >> Okay. Um,
[22:11] do you want to read should I read the this motion as well for consistency?
[22:16] » Sure. >> Okay. All right. Um, give me a moment.
[22:19] We'll go back through it. Um, and uh,
[22:25] uh, so this is for file A6 um, 2026 relating to 1169B
[22:31] Maple Street, Pelum. And um this will proceed um uh and I'm going to move as
[22:37] part of this motion that application A62026P
[22:41] be approved subject to the conditions in the staff report as amended. Uh spec but
[22:47] with a that condition two be revised to read as follows. that the applicant
[22:51] resubmit all required documents and application forms for the alteration of
[22:56] the 50 mm force main located at 1171 Maple Street to the satisfaction of the
[23:01] director of public works. Uh so to read the entirety of the motion uh the
[23:06] application is made for minor variance uh of a maximum front yard setback of 8
[23:10] mters whereas the bylaw requires 6 m. Move that the application is granted.
[23:16] Reasons being that the variance is minor in nature as the increase to the maximum
[23:20] front yard is 2 meters. The impact on the neighborhood and adjacent properties
[23:24] is negligible and the proposal will not affect privacy and is consistent with
[23:28] surrounding development. Uh the purpose and intent of the zoning bylaw is met.
[23:33] The purpose and intent of the official plan is met. The proposal is desirable
[23:37] for the use of the land as the 8 meter frontyard setback is compatible with the
[23:42] varied streetscape and provides functional benefits while maintaining
[23:45] the character of the area. The application is granted without prejudice
[23:48] to any other application in the town of Pelum. The committee of adjustment
[23:52] considered the written and oral comments and agrees with the minor variance
[23:55] report analysis and recommendation that this application meets the planning act
[24:00] test for minor variance. um subject to the following two
[24:04] conditions. That all necessary building permits are obtained prior to
[24:07] construction commencing to the satisfaction of the chief building
[24:10] official and that the applicant resubmit all required documents and application
[24:14] forms for the alteration of the 50 mm force main located at 1171 Maple Street
[24:20] to the satisfaction of the director of public works.
[24:24] And is there a seconder for my motion? >> I second.
[24:28] » Thank you. Okay. And we want a vote as well, I think.
[24:31] » Yes. Yes for me.
[24:36] » Yes. >> And yes for me as well.
[24:39] » Okay. Uh so that closes those two items. Uh those uh variances are approved on
[24:43] both sites subject to the uh revised conditions as noted. And uh with that we
[24:48] can move to the next item uh on the agenda being the uh 198 Canborough Road
[24:55] uh which is the consent B5 2026P.
[25:04] Okay. So for file B5 2026P relating to 198 Cambero Road part 4, application is
[25:12] made for consent to convey 1562 meters of land being part 4 to be added to the
[25:19] abuing property to the west being part 8 204 Campo Road. Part one is to be
[25:26] retained for continued residential use of the property.
[25:30] To date, the following comments have been received from public works,
[25:34] building department, tax department, and Bell Canada. No comments. Niagara region
[25:39] has provided a comment stating regional infrastructure planning and development
[25:44] staff offer no objections to the proposed consent application as reviewed
[25:49] and no public comments were received at the time of writing the planning report.
[25:54] Planning staff are of the opinion that the proposed consent application is
[25:58] consistent with the provincial planning statement and conforms with provincial
[26:02] Niagara and town official plans and are appropriate for the development and use
[26:08] of the land and should be approved subject to the recommended conditions.
[26:12] Planning staff recommend that application number B52026P
[26:17] be approved subject to the following conditions. that the applicant merge
[26:22] part four entitle with part eight and provide a solicitor's undertaking to the
[26:27] secretary treasurer that the necessary steps to implement conveyance will be
[26:32] taken together with a registerable legal description of the subject parcel and
[26:37] the consolidated parcel. provide a copy of the deposited reference plan for use
[26:43] in the issuance of the certificate of consent and provide the final
[26:47] certification fee for the file in the amount of $454
[26:53] and through you Mr. Chair the agent is here from Upper Canada Consultants.
[27:03] » Okay. Thank you. Um could you please start with your name for the record uh
[27:07] and then uh you may proceed. Thank you. >> Thank you, Mr. Chair. My name is Ethan
[27:11] Lamman. I'm a planner with Upper Canada Consultants. Um, so this is a bit of a a
[27:15] unique situation. This was an application that was originally approved
[27:18] by this committee um back in 2021 along with um a few uh uh lot creation
[27:24] applications as well. Um and when we get the final certificate from the secretary
[27:29] treasurer, we have two years under the planning act to affect that um that
[27:33] transaction with the land registry office. And unfortunately, we just for
[27:37] whatever reason ran out of time and and the decision lapsed. And so, uh, we're
[27:41] here before you again to to ask for the the permission once again. Um, I would
[27:45] also point out that the the parts one, two, and three, those three lots have
[27:50] been registered and created, so those aren't part of the application. Um, and
[27:54] the road widenings as well have been dedicated. Um, we just simply reused the
[27:58] previous uh, severance sketch back from 2021. Um, apart from that, I'm
[28:03] supportive of staff's anal analysis and recommendation and don't have any
[28:07] concerns with the conditions. Um, and I'll be happy to answer any questions.
[28:13] » Yeah. Thank you, Mr. Mom. Um, any comments or questions?
[28:18] » No, I think you're presenting the same pretty much situation that you did back
[28:23] when uh this first went through. So, no questions for you specifically. Thank
[28:28] you.
[28:32] I have none. >> Nothing for me either. Yeah. Thank you.
[28:38] Uh okay. Uh anybody in the room that would like to speak to this matter like
[28:43] to speak to the application. Doesn't look like that. Okay.
[28:49] Uh presume nobody online either. No. No one registered for this. All right. Um
[28:55] Okay. Well, um, there's no Should we close the public meeting?
[29:01] » I move the motion >> and I second it.
[29:05] » Okay, so that closes the public portion. Uh, many comments.
[29:11] » Um, my only comment is, you know, to the town and I'm not sure specifically has
[29:16] anything changed or, you know, there's been some time that has gone by. Um, are
[29:21] are all the conditions still the same? I mean obviously they're they're here
[29:24] again but just to confirm that from the town
[29:28] » you Mr. Chair I can confirm that staff it's a new application and so staff has
[29:32] reviewed it in the context of all of the current policies and um requirements
[29:37] that are in place and so the report that you see before you and the
[29:40] recommendations in it reflect all the current standards.
[29:45] » Great. Thank you very much.
[29:50] » Yeah. Yeah, no uh no substantive kind of
[29:54] comments for me as well. I appreciate what Miss Lorac said although it's a
[29:57] fresh application. Um you do have new standards. There's I think there' be a
[30:02] new kind of PPS for example that's in place and some other standards that may
[30:06] have changed slightly, but none of that I take it to be material here in terms
[30:10] of changing the view that this is appropriate um notwithstanding the the
[30:14] the consent lapsing. So I'm happy to support it. I it satisfies the test as
[30:19] set out by planning staff in their report. So, no problem uh from my point
[30:23] of view to satisfy those tasks. Okay. Ready for a motion?
[30:30] » Yes. I motion to close at this point. >> Would you like me to read it?
[30:37] » Sure. I'll >> Okay. All right. File B5 2026P 198 Cro
[30:45] Road, part four on the sketch, just so everybody knows. Um application for
[30:50] consent is to convey 1,562 square meters of land to be added to the
[30:55] abuing property to the west. We move that it's granted. The above
[31:01] decision is subject to the following conditions. To the satisfaction of the
[31:05] secretary treasurer merge part four in title with part 8 providing a
[31:11] solicitor's undertaking to the secretary treasurer that the necessary steps to
[31:15] implement conveyance will be taken. provide a registerable legal description
[31:20] of the subject parcel and the consolidated parcel and deposited
[31:25] reference plan. And the third is provide final
[31:30] certification fee of $454.
[31:34] This decision is based on the finally following reasons. The application
[31:39] conforms to and complies with the town official plan, the Niagara official
[31:44] plan, provincial planning statement, and the town zoning bylaws. This decision is
[31:50] rendered having regards to section 5124 and 5125 of the planning act. The
[31:57] committee considered all written and oral submissions and finds that subject
[32:01] to the conditions, this application meets planning act criteria and is
[32:06] consistent and complies with provincial Niagara and town planning policies.
[32:12] And that is it. >> We have a second on that.
[32:16] » I second. >> Thank you.
[32:20] » Okay. And a vote. >> Uh yes from me.
[32:24] » Yes. >> Yes for me as well.
[32:26] Okay. So that uh uh closes off that item. The uh consent is approved and I
[32:32] think that takes us near the end of the agenda. There is minutes I think uh Miss
[32:36] Ki. So is there any comments discussion on the minutes or should we move to a
[32:40] vote uh on that? >> Nope.
[32:46] » I think we're fine. >> Okay.
[32:48] » Comment motion motion to approve the minutes.
[32:51] » Yeah. >> Approved. I approve. I second.
[32:56] » Okay. Uh motion to adjurnn. >> Motion to adjurnn.
[33:00] » I second. Okay. >> Thank you.
[33:03] » It's ajourned. Yeah. Thank you.
