would you please begin this meeting with

the land recognition statement?
>> Yes. The town of Pelum is situated on
[0:55]
treaty land steeped in the ris rich rich
history of the first nations such as the
[1:00]
Haduender Hodenosi and the initab
including the missagas of the credit
[1:06]
first nation. This territory is covered
by the upper Canada treaties and is
[1:11]
protected by the dish with one spoon
wampom agreement. Today many first
[1:16]
nations mate and Inuit people from
across turtle island live and work in
[1:21]
Niagara. The town of Pelum stands in
solidarity with all indigenous peoples
[1:26]
past and present acknowledging that our
high standard of living is a result of
[1:31]
the resources and lasting friendship of
indigenous peoples. Through you, Mr.
[1:35]
Chair, you may proceed with your
introduction.

» Yeah, thank you. Uh so in terms of staff
that are here today, there's three
[1:45]
members of the committee that will be
hearing uh the matters in front of us
[1:49]
today. There's John Kappa, Sue Sarco,
and myself, Isaiah Banick. Um, we have
[1:53]
the assistant secretary treasurer Jodi
Conte, um the legislative coordinator,
[1:58]
Alex Lewis, planning manager, Shannon
Lorac, and engineering technician, Jim
[2:03]
Leisma.
This is a hybrid hearing of the
[2:06]
committee of adjustment for the town of
Pelum. Everyone present will be given an
[2:10]
opportunity to comment on the
applications being heard. Agencies
[2:14]
commenting on applications may request
that certain conditions be imposed
[2:19]
should an application be approved.
Voicing objections to these conditions
[2:23]
will not adversely affect the
committee's decision.
[2:27]
The purpose of the application and
relative correspondence will be heard
[2:30]
following which the applicant will be
given the opportunity to address the
[2:34]
application. During the public portion
of each application, we will hear from
[2:38]
anyone wishing to submit verbal
comments. Comments received following
[2:42]
the public portion will not be
considered. At the conclusion of the
[2:46]
discussion, the committee will render a
decision and advise of any applicable
[2:50]
conditions.
Specific wording for conditions may be
[2:54]
determined by the committee following
the hearing.
[2:58]
Copies of decisions will be mailed to
the applicant and agent and members of
[3:02]
the public that have submitted comments.
Notices of decision can also be obtained
[3:07]
by request to the assistant secretary
treasurer. Committee members are asked
[3:11]

application today. This um is file

relating to a request for minor variance
[4:10]
at 1169A
Maple Street. And we'll note that the
[4:16]
committee is considering application A5.
Uh the assistant secretary treasurer
[4:21]
will present this matter relating to
1169A Maple Street as well as file A6
[4:30]
relating to 1169B Maple Street together
as they relate to adjacent semi-
[4:37]
detached dwellings and seek identical
reductions to the required front yard
[4:41]
setbacks and have received the same
agency comments. While the applications
[4:46]
are under separate ownership, they will
be addressed concurrently for the
[4:49]
purposes of staff presentation.
And notwithstanding that we're going to
[4:54]
do this combined presentation, each
application will be considered
[4:57]
separately and will require its own
comments, discussion, and decision by
[5:01]
the committee.
Okay. So with that, uh, Miss Conti,

should we, uh, read this summary
presentation?

Okay. For committee of adjustment
hearing,

the town of Pel.

[5:26]
committee of adjustment hearings. A
hybrid hearing involves a mix mixture of
[5:31]
inperson and remote attendance and
participation. The following
[5:35]
presentations are based upon the town of
Pelum's planning department report
[5:39]
analysis. Please note that no decisions
have been made prior to this public
[5:43]
hearing. All comments received from
commenting agencies and the public have
[5:48]
been forwarded in full to the committee
of adjustment members for their
[5:51]
consideration and will appear
summarized.
[5:55]
Decorum. The committee of adjustment is
a formal public hearing requiring
[5:59]
decorum. All comments are to be made
through the chair. If you have
[6:03]
pre-registered to speak virtually or are
participating in person, you will be
[6:07]
given an opportunity to address the
committee at the public portion of the
[6:11]
meeting. If someone ahead of you has
made the same comments you wish to make,
[6:15]
there is no need to repeat. Please keep

during the public portion of the

A5 relates to 1169A Maple Street. The
[6:46]
subject land is located on the east side
of Maple Street lying north of Camber
[6:50]
Road. Legally described as part 7 East
Side Maple Avenue, plan 703, being parts
[6:57]
three and four on reference plan 59R1
18183.
[7:02]
municipally known as 1169A Maple Street.
For file A62026P,
[7:09]
this relates to 1169B Maple Street. The
subject land is located on the east side
[7:15]
of Maple Street, lying north of Camber
Road, legally described as part 7 East
[7:21]
Side Maple Avenue, plan 703, and being
parts one and two on reference plan 59R
[7:28]
1801 183. The applications seek relief
from section 6.1.3
[7:36]
zone requirements for a semi- detached
dwelling for the maximum front yard to
[7:41]
permit a maximum front yard setback of 8
m whereas the bylaw requires 6 meters.
[7:48]
To date, the following comments have
been received from public works.
[7:52]
Per the town CLI ECA process, it is
required that all alter alterations to
[7:59]
the town sanitary collection system be
approved prior to installation by the
[8:03]
town of Pelum. The application was
incomplete and a force main was
[8:08]
installed in April 2025 without the
town's approval. As of the time of this
[8:14]
application, the town has not received a
complete application for the alteration
[8:18]
of a 50 millimeter force mane installed
at 1171 Maple Street. The town requires
[8:25]
resubmission of all documents and
application forms for the alteration of
[8:30]
the 50 millimeter force main and the
applicant is required to pay a fee of
[8:36]
$1,820
for review and approval of the
[8:39]
alteration and no public comments were
received at the time of writing the
[8:44]
report.
Minor variance test one. The variance is
[8:48]
minor in nature. Yes, the variance
proposes an additional 2 meters to the
[8:53]
maximum front yard. The impact on the
surrounding neighborhood and adjacent
[8:58]
properties is negligible given the
prevailing pattern of development along
[9:03]
Maple Street where larger and varying
front yard setbacks are common. The
[9:08]
proposed setback does not create adverse
impacts on adjacent properties in terms
[9:12]
of privacy. Test two, is the variance
desirable for the development or use of
[9:18]
land? Yes, a front yard setback of 8
meters allows the new dwellings to
[9:22]
integrate well into the streetscape,
which is characterized by varying front
[9:26]
yards. Locating the dwellings further
back on the lot may offer functional
[9:32]
benefits such as enhanced landscaping
opportunities and an improved interface
[9:37]
with adjacent properties and additional
parking opportunities. From an urban
[9:42]
design perspective, the proposal
respects and reinforces the character of
[9:46]
the area, which is a key objective of
appropriate development.

Test three. Does the variance maintain
the general intent and purpose of the
[9:56]
zoning bylaw? Yes. The general intent of
the maximum front yard setback provision
[10:01]
is to regulate the placement of
buildings to ensure compatibility with
[10:05]
surrounding development and maintain
high quality and consistent streetscape.
[10:10]
Although the variant seeks relief from
the prescribed maximum setback, it
[10:15]
upholds the broader intent by aligning
the new dwellings with the existing
[10:19]
pattern of development on adjacent and
nearby lots. By permitting a greater
[10:24]
setback, the proposal avoids the future
dwelling
[10:28]
projecting greater into the front yard
relative to neighboring homes. Test
[10:33]
four. Does the variance maintain the
general intent and purpose of the
[10:37]
official plan?
Yes, the subject property is designated
[10:42]
urban living area in the official plan
which permits lowdensity residential
[10:46]
uses including semi- detached dwellings.
Permitting the increased front yard
[10:51]
setback facilitates a design that is
contextually appropriate and contributes
[10:56]
to a cohesive streetscape.
Based on the analysis, staff is of the
[11:01]
opinion the variances are minor in
nature, conform to the general policies
[11:06]
and intent of both the official plan and
zoning bylaw, and are appropriate for
[11:12]
the development and use of the land.
Planning staff recommend that
[11:16]
application number A52026P
be approved subject to the following
[11:21]
conditions and that application number
A62026P
[11:26]
be approved subject to the following
conditions.
[11:30]
Obtain all necessary building permits
prior to construction commencing to the
[11:35]
satisfaction of the chief building
official
[11:38]
and resubmit all required documents and
application forms for the alteration of
[11:43]
the 50 millimeter force man located at
1171 Maple Street and pay a fee of
[11:49]

for review and approval to the
[11:53]
satisfaction of the director of public
works.

will be invited to do so afterwards as

» So I'm Jesse and this is my dad
Lawrence. And uh just a little
[12:39]
background on the project is um my dad
had the adjacent property and we severed
[12:46]
it about a year ago and we're going to
be building a semi- detached residence
[12:51]
together to
on the parcel that we seed and about a
[12:56]
year ago we installed the force man and
uh I talked to Jim earlier this morning
[13:02]
because uh like I just don't agree with
the comment that we did it without
[13:06]
permission um just because we did go
through all the process we had the
[13:11]
pre-construction meeting with the city
and uh we hired a reputable contractor
[13:16]
with Silver Line and I think just the
that transpired was that uh we were just
[13:24]
missing a bit of information and I
talked to Jim this morning and he talked
[13:28]
with Jason Mah and we're going to get
them that information because I haven't
[13:32]
talked to our engineers since May of
last year. So I I didn't really know
[13:36]
that this information was out.

» I appreciate appreciate that comment. Um
uh perhaps we'll get some uh
[13:47]
clarification from staff as well, but I
wanted to invite the committee if
[13:50]
there's any comments or questions
before that or if you have the same same
[13:55]

about the uh confusion around the uh uh
[14:10]
the force main and the condition
relating to that. if you'd like to

[14:22]
spoke uh earlier regarding the um um
with this matter um last year. This uh
[14:29]
this project um uh it came through a
committee as well uh for the severance
[14:33]
of the the project and it went through a
uh development um agreement with uh with
[14:39]
the town and the the owners. Um there
were some communication or
[14:44]
miscommunication between the um the
engineer and um I should say
[14:50]
with the engineer because we the town
had communicated a couple of times and
[14:55]
tried to confirm and try to get that
information from from the engineer.
[14:58]
However, we're not successful of
obtaining that um um uh that that
[15:04]
document that we require. So um from our
communication earlier with uh with Jesse
[15:09]
I think uh once we get that uh
information then we can get that cleared
[15:14]
that condition cleared.
I see. So just as a matter of kind of
[15:19]
confirmation here what the condition um
relates to is
[15:25]
a resubmission of documents and
application forms. That's kind of part
[15:32]
one. And then part two to it is paying a
fee relating to that. So is it your am I
[15:39]
understanding correctly that it's your
view that the first part of the
[15:43]
condition should remain and the second
part of the condition relating to the
[15:46]
fee is not necessary anymore or did I
misunderstand what you're saying?

» Yes, that is correct. Uh I got
confirmation from uh from our director
[15:54]
that that can be waved um
with uh with the uh uh applicant
[16:00]
submitting those additional informations
regarding the uh the force main.

prejudice to any other application in

the town of Pelum and the committee of
adjustment considered uh the written and
[19:56]
oral comments and agrees with the minor
variance report and recommendations uh
[20:02]
subject to the comment that I made that
this application meets the planning act
[20:06]
tests for minor variance and the
conditions again to repeat them uh
[20:10]
there's one condition that all necessary
building permits are obtained prior to
[20:14]

amended is that the applicant resubmit

204 Campo Road. Part one is to be

retained for continued residential use
of the property.

To date, the following comments have
been received from public works,
[25:34]
building department, tax department, and
Bell Canada. No comments. Niagara region
[25:39]
has provided a comment stating regional
infrastructure planning and development
[25:44]
staff offer no objections to the
proposed consent application as reviewed
[25:49]
and no public comments were received at
the time of writing the planning report.
[25:54]
Planning staff are of the opinion that
the proposed consent application is
[25:58]
consistent with the provincial planning
statement and conforms with provincial
[26:02]
Niagara and town official plans and are
appropriate for the development and use
[26:08]
of the land and should be approved
subject to the recommended conditions.

Planning staff recommend that
application number B52026P
[26:17]
be approved subject to the following
conditions. that the applicant merge
[26:22]
part four entitle with part eight and
provide a solicitor's undertaking to the
[26:27]
secretary treasurer that the necessary
steps to implement conveyance will be
[26:32]
taken together with a registerable legal
description of the subject parcel and
[26:37]
the consolidated parcel. provide a copy
of the deposited reference plan for use
[26:43]
in the issuance of the certificate of
consent and provide the final
[26:47]
certification fee for the file in the
amount of $454
[26:53]

Consultants. Um, so this is a bit of a a
[27:15]
unique situation. This was an
application that was originally approved
[27:18]
by this committee um back in 2021 along
with um a few uh uh lot creation
[27:24]
applications as well. Um and when we get
the final certificate from the secretary
[27:29]
treasurer, we have two years under the
planning act to affect that um that
[27:33]
transaction with the land registry
office. And unfortunately, we just for
[27:37]
whatever reason ran out of time and and
the decision lapsed. And so, uh, we're
[27:41]
here before you again to to ask for the
the permission once again. Um, I would

have changed slightly, but none of that
I take it to be material here in terms

of changing the view that this is
appropriate um notwithstanding the the

the consent lapsing. So I'm happy to
support it. I it satisfies the test as

set out by planning staff in their
report. So, no problem uh from my point

of view to satisfy those tasks.

square meters of land to be added to the

We move that it's granted. The above

decision is subject to the following
conditions. To the satisfaction of the

title with part 8 providing a

solicitor's undertaking to the secretary
treasurer that the necessary steps to

implement conveyance will be taken.

rendered having regards to section 5124
and 5125 of the planning act. The

committee considered all written and
oral submissions and finds that subject

to the conditions, this application
meets planning act criteria and is
[32:06]
consistent and complies with provincial
Niagara and town planning policies.
