[2:54]
as we allowed everybody that we can to
[2:56]

[2:59]
when you have a question
[3:01]
you of course will raise a paddle uh a
[3:04]
yellow paddle for a question
[3:06]
and the yellow jackets i'll be walking
[3:08]
away from the microphone
[3:10]
to uh scholar these individuals to see
[3:14]
who
[3:14]
meets my attention and who wants to come
[3:16]
and speak to this
[3:18]
uh next i'd like to thank uh

[4:09]
uh green would you like to read the

[4:51]
the following
[4:52]
article as initiated by a citizen's
[4:54]
petition
[4:55]
due to the quoted 19 pandemic there was
[4:57]
a concern that there would not be
[4:59]
a plan to go forward with today's
[5:00]
meeting the people select were voted at
[5:03]
their daily notice february the 22nd
[5:05]

[5:13]
as allowed in the act of 2020 relative
[5:16]
to municipal
[5:17]
governance thank you
[5:26]
i guess at this particular uh uh point
[5:28]
in time we can
[5:29]
uh call for the question
[5:33]
somebody have a motion
[5:50]
um
[6:05]
uses the minimum statutory refinement
[6:07]
and effectively restricts the number of
[6:09]
retail marijuana shocks that may be
[6:10]
permitted to one
[6:12]
this amendment increases the allowed
[6:14]
number of retail marijuana shops
[6:17]
which exceeds the required
[6:33]
now to ask a question
[6:36]
or to speak to it
[6:40]
at any time use a yellow placket to be

recognized by any of the
[6:44]
individuals in the yellow vessel jackets
[6:47]
when they come time to vote or to cast a
[6:49]
vote let me get to that point
[6:51]
uh green placket is i or yes
[6:54]
uh the red or orange placket is uh
[6:57]
or no so do you want to speak to the
[7:00]
article
[7:02]
uh explanation presentation
[7:06]
yeah i'm sorry i didn't know that
[7:09]
already
[7:13]
all right so i call for questions at
[7:15]
this particular point in time
[7:18]
oh i'm sorry yeah good point uh the

[7:23]
there's a planning board

[8:57]

[8:59]
there is some confusion as to whether

the number of operating workers slash
[9:04]

[9:05]
in the town of couple three will refer

the proposed changes to the language and

[10:48]
figure to be rounded to the next whole
[10:50]
number and replace it with the following
[10:53]
the number of marijuana retailers shall
[10:55]
not exceed two
[10:57]
additionally in section 6650
[11:00]
the application required means the first

sentence will be revised

c138 subsection 15 for retail sales
[11:17]
of alcohol baggage not to be drunk on
[11:19]
premises only place with two
[11:22]
the rationale behind this amendment is
[11:24]
that the existing wording is confusing
[11:27]
and the timing the number of marijuana
[11:29]
retail establishments to the number of
[11:30]
liquor licenses
[11:31]
is arbitrary and leaves the number of
[11:34]
marijuana retailers
[11:35]
open-ended since the number of liquor
[11:37]
license can be increased
[11:39]
replacing this sentence with the number
[11:41]
two fixes the number of native 100
[11:44]
to a set number two which can only be
[11:48]
verified through through tile meeting

clinton cutler 43 bacon street the
[12:30]

[12:38]
uh the finance committee voted for
[12:41]
nothing
[12:42]
and four to zero to approve the
[12:44]
amendment
[12:46]
thank you
[12:58]
meeting held on february 26th 22nd 2021
[13:18]
uh the time to be recognized
[13:21]
there's a bit of a delay where there
[13:24]
will be a bit of a delay
[13:25]
i have to walk away from the microphone
[13:27]
and recognize
[13:29]
every ladies and gentlemen in yellow so
[13:32]
if now is the time uh this is
[13:34]
more of a question or
[13:37]
point to make so let's go over that now
[14:42]
um so one thing about this this
[14:47]
article is that it would increase the
[14:49]
number of licenses we currently have
[14:50]
from one to two
[14:52]
um let's kind of look at some recent
[14:54]
studies for massachusetts news
[14:56]
one uh dispensary for over a hundred
[14:58]
thousand people
[15:00]
and the place in the state really is
[15:02]
around one probably six thousand people
[15:04]
so
[15:05]
this article would go and increase the
[15:07]
number of licenses and people to one of
[15:09]
the highest
[15:10]
densities in the state and you know i
[15:13]
know there's a lot of business people in
[15:14]
the audience so you're thinking
[15:15]
how can we go and sustain that sort of
[15:17]
business
[15:19]
and the answer is really simple it's
[15:20]
right over the border you know so
[15:25]
thousand hundred um people so right
[15:26]
there here the number of people who will
[15:28]
be coming across
[15:30]
and will be your your uh market for
[15:32]
these additional license
[15:33]
so um you know one thing you really need
[15:36]
to think about when you're according to
[15:38]
this question is where are these people
[15:40]
going to come from to go into spain two
[15:42]
little
[15:43]
two marijuana licenses in this town so
[15:46]
if we want people coming across from new
[15:47]
hampshire
[15:48]
to come and buy here and then they know
[15:51]
it's illegal to go and take the box and
[16:07]
potentially taking up the time to our
[16:08]
police officers to go and support
[16:11]
the top habits of people from new
[16:13]
hampshire
[16:16]
thank you
[17:16]
um
[17:29]
i have somebody right here that's uh
[17:32]
going first thank you
[17:52]
um
[17:55]
i'm not sure about the statistics that
[17:57]
we just heard about to um
[18:26]
uh
[18:40]
um
[18:54]
initially thank you
[19:22]
um
[19:31]
anyone else
[20:14]
it's great to see all these people out
[20:16]
here today
[20:29]
come to us
[20:45]
everyone has done a lot less damage
[20:54]
thank you next week
[21:14]
okay
[21:56]
um
[21:58]
to know
[22:03]
very similar minutes on the marijuana
[22:10]
business
[22:24]
because from um research it looks to me
[22:27]
like
[22:28]
when the public was asked what type of
[22:30]
um
[22:37]
there was no mention of more retail
[22:41]
market
[22:52]
um
[23:11]
my question is simply this
[23:14]
i'm confused i think a lot of other
[23:16]
people are confused
[23:17]
or whether or not we're voting on one
[23:22]
or two i think a lot of people feel
[23:25]
true is not is too much but it's very
[23:28]
confusing
[23:29]
that's very funny i think if someone
[23:32]
could try to
[23:33]
explain that to it to me
[23:45]
do you want to speak to that
[24:02]
question no okay
[24:08]
my question is how do you vote
[24:11]
if you want to just if you've already
[24:14]
approved
[24:14]
one in a time and you
[24:24]
how do you vote yes or no that's why i
[24:27]
think i'm confused a lot of other people
[24:29]
are confused
[24:57]
once we open the door here what this
[24:59]
gentleman is asking
[25:02]
correct
[25:13]
that yes your question all right george
[25:15]
uh i believe that
[25:16]
yeah you should come to the mic okay
[25:28]
if if you are opposed to increasing the
[25:31]
number of
[25:31]
establishments to true you would vote no
[25:35]
thank you very much that was my whole
[25:37]
question
[25:40]
thank you
[25:54]
marijuana establishments as part of the
[25:56]
economic development chapter
[25:59]
the master plan for the town took over
[26:02]
two and a half years to develop
[26:04]
many topics were discussed economic
[26:06]
development land use
[26:08]
housing uh transportation
[26:11]
the massive thing has written has a lot
[26:13]
of different recommendations in it
[26:15]
and are referenced in other sections
[26:18]
while the
[26:19]
minister plan committee did call out
[26:21]
certain establishments
[26:22]
it was not
[26:37]
economic development uh specifically in
[26:40]
the uh
[26:40]
downtown area is needed uh in this this
[26:43]
type of establishment would also benefit
[26:47]
the vacancies in that section of the
[26:50]
town
[27:04]
uh
[27:32]
we've got a couple so whoever comes
[27:46]
first
[27:57]
where's the closest one
[28:02]
while we wait for the question to come
[28:04]
to the mic
[28:05]
uh everybody take a moment and pray that
[28:08]
we don't have to do this
[28:11]
i can't imagine it for 25 questions
[28:28]
um
[28:43]
have done a lot um research on this and
[28:45]
i've
[28:46]
gone to a lot of facilities throughout
[28:48]
the states
[28:50]
and cannabis right
[28:53]
dispensaries they're run very
[28:55]
professionally
[28:57]
done by importance only
[29:00]
there's not a lot of traffic involved in
[29:03]
it
[29:04]
um these dispensaries are very very
[29:08]
professional
[29:10]
there's not to
[29:19]
people need to understand that
[29:22]
a lot of people come from medicinal
[29:24]
purposes
[29:25]
we do not have enough medicinal cannabis
[29:29]
uh places around in new england right
[29:32]
now
[29:32]
it should when we opened up cannabis
[29:35]
places
[29:37]
originally they were supposed to be for
[29:39]
medicinal purpose only
[29:42]
adult shops have opened up
[29:46]
all over new england we've got hundreds
[29:49]
of adult use service places all over
[29:54]
uh they're popped up everywhere um
[29:58]
basically for revenue and uh
[30:01]
the town's needed and the couple needs
[30:04]
it
[30:05]
and we need the revenue the two
[30:09]
uh voting on the two
[30:12]
um canvas places is going to be a big
[30:15]
shot in the end for purple
[30:18]
i think we all need to relax a little
[30:21]
bit
[30:22]
and understand that these places are
[30:24]
very professional
[30:26]
and that's my opinion and
[30:30]
i just wanted to share that with you
[30:31]
because i have spent five years
[30:36]
all of this uh in our nature uh because
[30:40]
my grandchildren live there
[30:42]
and that's why in the future
[30:45]
after i've
[30:49]
taking care of all the bills in new
[30:50]
hampshire to make sure that they're all
[30:52]
safe
[30:53]
and the bills are in place uh
[30:56]
they're not going to help massachusetts
[30:59]
but um i think that this is
[31:02]
good for purple and i just wanted you
[31:06]
all to know
[31:07]
the benefits of the experience thank you
[31:12]
not sure
[31:30]
um again i would just ask the two of my
[31:33]
fellow towns people to
[31:34]
allow our one permitted
[31:38]
retail marijuana adult use shop to open
[31:42]
and please let's take a look at what the
[31:45]
impact if any
[31:46]
is on our town our infrastructure on our
[31:49]
police force
[31:50]
on our emergency services maybe it's
[31:53]
nothing
[31:54]
then we can come back and revisit this
[31:57]
at another time meeting
[31:59]
the law is flexible that we're not
[32:02]
closing the door
[32:03]
by limiting it to one we're simply
[32:06]
taking a less
[32:08]
a slower approach to planning
[32:12]
and commercial development in our town
[32:15]
and my question for the master plan um
[32:19]
basically is the reason for the master
[32:23]
plan
[32:23]
is to gather what the community wants
[32:26]
gather
[32:29]
and the people did not ask for retail
[32:33]
marijuana
[32:34]
they asked for other types of businesses
[32:37]
and my final thought is
[32:39]
aside from retail marijuana business
[32:42]
there are
[32:43]
other options um there is cultivation
[32:46]
which i believe is more in line with
[32:49]
agricultural
[32:50]
history so there are options for that
[32:53]
there are options for um testing jobs
[32:57]
there are multiple options for marijuana
[32:59]
businesses retail
[33:01]
the big one and that's why we're here
[33:04]
please
[33:05]
tell us explore thank you
[33:22]
um
[33:27]
the difference between one and two is
[33:29]
not really going to make much of a
[33:31]
difference in terms of your
[33:32]
envisioning stoners roaming the streets
[33:35]
i don't think that's what's going to
[33:36]
happen
[33:37]
i think the important aspect to focus on
[33:40]
is the revenue that it will bring into
[33:41]
the town
[33:42]
and a lot of people are worried about
[33:45]
what new facilities we need for the
[33:46]
emergency management services and the
[33:48]
police
[33:49]
those are all things that are going to
[33:50]
bring in money yes we'd like other types
[33:52]
of businesses
[33:53]
sure bring those on too but right now
[33:55]
the proposal is for another business
[33:57]
that could bring in
[33:58]
money that would help this town rise us
[34:01]
up
[34:01]
i don't think the concerns about people
[34:03]
from flocking over the borders are
[34:05]
really valid if you
[34:06]
read the marijuana website you have to
[34:09]
present an id
[34:10]
you can't just wander into a pot shop
[34:12]
and brown bag a bottle of whiskey like
[34:14]
you do at a liquor store and then just
[34:16]
go on the street smoking pot that's not
[34:18]
what's gonna happen
[34:19]
i don't smoke it i personally don't care
[34:21]
but i certainly want money for this town
[34:23]
and i think as other people do too
[34:25]
you have to put your personal feelings
[34:27]
aside about what it
[34:29]
basically represents to you and picture
[34:31]
what it's for what it's going to bring
[34:33]
to the town
[34:34]
so it's not it's not going to be a
[34:36]
dangerous thing i have a child too it's
[34:37]
not going to be some crazy thing that we
[34:39]
have to worry about because
[34:40]
10 years 20 years down the road we'll
[34:42]
realize it was a good thing after all
[34:44]
so i'm just trying to get everybody to
[34:46]
see the bigger picture
[34:48]
don't worry about people flocking from
[34:49]
out of state kingsborough does it just
[34:51]
fine i lived in kingsborough before here
[34:52]
that shop is beautiful i've never gone
[34:54]
in it
[34:55]
but i don't see traffic i don't see
[34:57]
problems i do see money for downtown
[34:59]
and i'd like some of that for us thank
[35:01]
you
[35:03]
next
[35:08]
name and street mark lost 53 seattle
[35:14]
street
[35:16]
make a motion to amend the petition as
[35:18]
follows
[35:20]
the maximum number of marijuana
[35:22]
establishments
[35:23]
in the town of pepper shall be limited
[35:25]
as follows
[35:28]
the number of marijuana retailers shall
[35:30]
not achieve one
[35:33]
and section six six five
[35:36]
zero provides the third sentence
[35:39]
to read as follows with pollution thrown
[35:42]
by strikethrough
[35:44]
while the special granting authority is
[35:46]
authorized to approve special permits
[35:48]
for marijuana resellers
[35:50]
and amount up to but not exceeding
[35:54]
one the zoning bylaws shall not be
[35:57]
construed to obligate
[35:59]
spga to approve any particular
[36:02]
application
[36:03]
for a special permit just because the
[36:06]
national number
[36:07]
of special permits has not been approved
[36:24]
oh
[36:38]
so
[36:43]
okay we have a motion uh to amend
[36:46]
the main motion uh
[36:50]
as it's being
[37:06]
i see a hand all right discussion on
[37:09]
just this amendment before we get back
[37:12]
to the main motion
[37:15]
uh yeah
[37:20]
i just i wanted to
[37:26]
that the standard was arbitrary um
[37:30]
and this amendment no longer makes it
[37:33]
arbitrary
[37:34]
and it also excuse me
[37:38]
uh does not make a major change
[37:41]
to the existing current conditions um
[37:44]
in this odd circumstance
[37:51]
town meeting where everybody has a
[37:53]
chance to have a site
[38:30]
oh yeah i think you should stay
[38:34]
uh clinton caller 43 business street i
[38:37]
believe this verse is unnecessary
[38:39]
if the citizens choose to keep the
[38:41]
number of
[38:42]
marijuana establishments to one
[38:58]
i'll
[39:12]
the motion to amend uh start at one
[39:16]
that's what we've got
[39:17]
now um let's when the establishment
[39:20]
comes in
[39:21]
get set up we'll see how it works out
[39:24]
and if it works out well
[39:25]
we can always go back and raise it
[39:39]
did i see somebody else that wanted to
[39:41]
speak to this
[39:46]
i just wanted to address the comment of
[39:48]
a novo
[39:50]
um in the
[39:53]
original um petitioning
[39:57]
as being the same as for one dispute
[40:00]
that's not
[40:01]
true because no vote on that
[40:05]
to the extent that we added more looking
[40:07]
licenses
[40:08]
we would
[40:22]
yep
[40:27]
oh yeah yeah just don't leave that area
[40:30]
yeah
[40:33]
hi 18 prospect street
[40:37]
former member of the master planning
[40:38]
committee um
[40:40]
i i request that you vote no
[40:44]
on this um this amended motion
[40:48]
um we have um
[40:51]
the reason that the planning board
[40:54]
um and the um finance committee and this
[40:56]
reform
[40:57]
approve having two is because
[41:01]
if we stay tied to the percentage of
[41:04]
liquor licenses
[41:06]
we could have an unlimited amount of
[41:09]
marijuana businesses coming to town
[41:13]
and want to get a profit for them so we
[41:16]
want to limit it to true
[41:18]
and i would say don't uh vote
[41:21]
for this amended motion limiting it to
[41:23]
one because
[41:25]
um again these two businesses are going
[41:27]
to contribute to our
[41:29]
local economy um there's a very
[41:32]
generous percentage of the gross
[41:35]
proceeds for both of these businesses
[41:37]
that will cover
[41:39]
any um aspect of public safety
[41:44]
traffic anything like that that's what
[41:48]
is supposed to be useful so um
[41:51]
i urge you to vote now in the amended
[41:53]
motion get back to the original motion
[41:56]
and vote yes or no please thank you
[42:10]
good morning my name is chris esimone
[42:13]
five wheeler
[42:24]
and i'm not opposed to the use of
[42:25]
marijuana in fact they voted for the
[42:28]
legalization of marijuana in the state
[42:30]
of massachusetts
[42:32]
but i strongly believe that one is
[42:34]
enough
[42:35]
if we have people in this town who need
[42:37]
it for medicinal purposes
[42:39]
certainly one is enough and certainly
[42:41]
one is enough for local users
[42:45]
look we're a very rural community
[42:49]
state with a major city within 10 miles
[42:53]
any additional revenue we may
[42:57]
through realize stores is going to go
[42:59]
for additional traffic control do you
[43:01]
know what the traffic will be like
[43:03]
for people pouring in from manchester
[43:05]
and groton and
[43:06]
other towns around us we're gonna need
[43:08]
more policemen
[43:10]
the roadways are going to take a beating
[43:13]
we're not going to
[43:14]
make money on this so please vote for
[43:17]
the amendment
[43:18]
and against the main motion thank you
[43:38]
on street
[43:52]
dispensary and i don't think the finance
[43:56]
committee
[43:56]
has actually done a thorough job in
[43:59]
proving to the council
[44:00]
that that it is going to bring more of
[44:03]
you
[44:04]
i believe it's going to actually create
[44:07]
more expensive
[44:32]
okay margarita
[44:38]
okay so i don't
[44:41]
have a history or great knowledge of
[44:44]
really good business for
[44:46]
non-prescription now
[44:47]
but my question is either one whether
[44:50]
it's
[44:51]
the amendment or the original
[44:54]
what exactly happens at a
[44:58]
recreational place recreational
[45:01]
marijuana use
[45:03]
establishment what is that for
[45:07]
is it to just get your marijuana
[45:10]
legal legally prescription or not
[45:15]
or is it a place because
[45:27]
i can honestly tell you i don't know
[45:44]
you can buy
[45:57]
big countryside road
[46:13]
back in uh 2018 uh we always envisioned
[46:17]
the calculation
[46:18]
and we had a cylinder wrongfully assumed
[46:21]
that the calculation would result in an
[46:23]
accounting of two
[46:25]
establishments being authorized whether
[46:28]
it's one or two the planning board will
[46:30]
still have to
[46:32]
issue a special permit and other things
[46:34]
would have to
[46:35]
take place after that but i would
[46:37]
recommend that
[46:40]
this amendment
[46:46]
thank you
[47:08]
uh
[47:23]
new um and we should move the question
[47:26]
and let's get voted
[47:50]
okay
[48:05]
the amendment which would uh
[48:08]
as it's been presented and as it uh
[48:11]
has been explained and debated uh raise
[48:15]
your
[48:16]
green power now
[48:26]
scott in some confusion people are
[48:28]
confused as to what we're voting on
[48:30]
right now
[48:46]
is
[48:56]
maximum number of marijuana
[49:00]
establishments
[49:03]
the maximum number of marijuana
[49:05]
retailers shall be limited to one
[49:08]
section section six six five zero
[49:12]
third sentence amended as follows but
[49:16]
not to exceed wrong
[49:22]
okay the main motion which we're not
[49:25]
voting on
[49:26]
uh address two this one is limiting it
[49:29]
to
[49:29]
one so i hope that can like explain this
[49:32]
exactly
[49:33]
not to exceed one right
[50:08]
at the moment
[50:24]
yes
[53:04]
okay are all opposed please pull out
[53:08]
your package
[53:26]
okay
[54:08]
so
[56:14]
uh
[56:42]
so
[57:00]
all right sorry for the delay um the
[57:02]
emotion
[57:03]
goes as far the emotions
[57:08]
108 no the motion does not carry back to
[57:12]
the main
[57:12]
question are there any more comments or
[57:15]
questions on the main motion
[57:24]
here
[57:29]
during the break i was asked a question
[57:31]
about um
[57:32]
the difference between one and two and
[57:34]
how it came about
[57:36]
well the original bylaw was being
[57:38]
written by the planning board
[57:41]
the number of what could be authorized
[57:45]
with the license in the count of
[57:46]
pepperoni was eight
[57:49]
so if you do the b uh you take 20
[57:52]
percent of eight
[57:53]
gives you two uh after the uh was passed
[57:57]
when we
[57:58]
got more into the details uh it was
[58:01]
determined uh that it was a number of
[58:04]
liquor licenses that were issued by the
[58:06]
county couple which was three
[58:08]
which would then limit it to to one so
[58:12]
it all depends on how uh you know when
[58:14]
the cleaning board was originally
[58:15]
looking at this
[58:16]
we're always envisioned that the
[58:17]
calculation would be true
[58:19]
this amendment is
[58:35]
a further process will still have to go
[58:37]
take place
[58:38]
uh all of the restrictions or all of the
[58:41]
uh requirements
[58:42]
of uh will have to be
[58:46]
put in place traffic studies will have
[58:48]
to be done uh
[58:50]
parking lots will have to be reviewed
[58:52]
there's still a lot of work to do and
[58:54]
there's no guarantee that the final
[58:55]
couple would have two
[58:57]
that will be defiled by a special permit
[59:00]
which would be issued by the planning
[59:01]
board
[59:02]
again the whole
[59:10]
establishments issued was eight
[59:12]
multiplied by the percentage of
[59:14]
twenty percent which would give you two
[59:16]
and that's that's
[59:31]
comments or questions now
[59:53]
i got somebody right here
[1:00:11]
uh now
[1:00:25]
while we're doing this
[1:00:37]
don't use recreational marijuana
[1:00:40]
establishments in sub-section
[1:00:43]
6640.5
[1:00:46]
the guys clause
[1:00:50]
3ds with deletions shown by
[1:00:52]
strikethrough and additions from the
[1:00:54]
underlying
[1:01:11]
mgl section 138 subsection 15
[1:01:15]
for retail sale in alcohol not to be
[1:01:18]
drunk on the premises in the tiny people
[1:01:21]
save 20 rounded up to the next whole
[1:01:24]
number
[1:01:25]
replace that with the number of
[1:01:27]
marijuana retailers shall not
[1:01:29]
exceed two
[1:01:33]
in section 66 30 56
[1:01:43]
authority is authorized to approve
[1:01:51]
special
[1:01:52]
permit preventing authority is
[1:01:54]
authorized to approve special permits
[1:01:55]
for marijuana retailers in an amount up
[1:01:57]
to but not exceeding
[1:01:59]
20 of the number of licenses issued
[1:02:01]
within the town
[1:02:02]
pursuant to mgl section 138
[1:02:18]
is
[1:02:28]
just because the maximum number of
[1:02:30]
special permits
[1:02:31]
has not yet been issued
[1:03:14]
mr
[1:03:42]
please
[1:03:52]
this requires two-thirds
[1:03:56]
vote majority for passages
[1:05:49]
this
[1:06:09]
what's up
[1:06:44]
so
[1:07:54]
right
[1:08:07]
all the right is as follows
[1:08:11]
112 in favor 62 against
[1:08:15]
again as i stated earlier this requires
[1:08:18]
a two-thirds vote
[1:08:19]
uh and we did not out instead of
[1:08:22]
the 66
[1:08:25]
uh percent we get 55 so the motion does
[1:08:28]
not carry the main motion
[1:08:30]
so uh a motion to adjourn
[1:08:35]
uh no seconded
[1:08:38]
all those in favor aye thank you so much
[1:08:40]
for your patience
[1:08:41]
and understanding and hopefully we don't
[1:08:45]
do it this way in the spring
[1:08:48]
thank you
[1:08:53]
[Music]
[1:09:15]
you
