[4:26] plan 42R 22881. The planning act requires a statutory
[4:32] public meeting be held to receive these comments and to allow for the public
[4:36] input before council decides whether or not to pass the bylaw. The public
[4:40] meeting is conducted as follows. The clerk administrator will advise as to
[4:44] when, how, and to whom notice of the public meeting was circulated and will
[4:47] confirm proper notice was giving given. She will then list the written
[4:51] submissions received regarding the proposed amendment and provide
[4:54] background on the application. After the clerk administrator has provided an
[4:58] overview of the application, the applicant may make presentation. The
[5:02] public meeting is not a public debate on the matter, but the public will be
[5:05] afforded the opportunity to provide their comments or questions.

[6:44] yard of 11 m for a garage. The reasonzoning is a condition of consent
[6:49] applications B 2925, 3025, and 3125

[6:59] lots, part two has an existing 37.2 meter storage and part three has an
[7:05] existing 98.8 square meter dwelling and existing 194.7
[7:11] meter garage with an 11 m front yard. This application will bring all proposed
[7:17] newly created lots into compliance with zoning bylaw 201421.

[15:06] right beside North Cliff, formerly North Cliff Lodge. I currently reside um at
[15:11] 2395 Delaware Avenue, Space 74, Santa Cruz, California.
[15:17] Um I had a question about the 30 meter setback and what the purpose is of it
[15:25] and how we decide that it's okay to to be within that setback.

[15:35] » Sure. >> So, one of the one of the reasons is if
[15:38] under new development, uh it would be restricted to be at least uh 30 mters
[15:43] back from the shore road uh from the shore.
[15:48] One of the things that happens is when we're de when we're going into uh
[15:52] development of properties that already have been developed on um and this is
[15:57] partic in this case it's also a building already the structure that's been there
[16:02] for many many years has been used as a cottage and I believe now they're using
[16:06] it as a as a home and when the township looks at this we look at where where
[16:11] exactly it is located on the lot and and uh a lot of times we'll find that on a
[16:18] lot of the lots today around lakes there's only one location you can put a
[16:21] building on on the lot because of uh just the topography of the lot the land
[16:26] itself um and it's also one of the things where
[16:29] if we start pushing people back a lot further than the other cottages on the
[16:34] lake it kind of offsets the cottage so suddenly there's a somebody looking in
[16:38] the backyard or somebody's cottage next door all the time so we can we try to
[16:43] keep it pretty consistent that where it is now it lines up with the other
[16:46] cottages probably within that area on the on the shore road. So that's why we
[16:51] have a a look at how we're developing and where it's going and whether or not
[16:55] it will be um accepted under those terms.
[17:03] » So if I was to build an on the north cliff lot which is right beside it, I
[17:09] would have to also be that close to the lake so that I'm not looking in his back
[17:16] window. No, no. I believe there's actually part of a lot between some of
[17:21] your lot and where that lot is. You would be required to stay back the the
[17:26] 90 m, >> the 100 feet, I should say. 30 mters.

[17:40] existing building where on my lot. No, because your existing building's

[17:58] that going to be allowed? >> You're saying that we have to be all
[18:03] kind of in the same area? Yeah. North Cliff where the lodge was was up on the
[18:08] hill. So, it set back even more than 30 meters.

[18:42] dock on the lot? Like I think it might be on that part of the which is a whole
[18:49] other issue for me, the chunk of property that is missing essentially
[18:54] from our my lot. Um I was never notified that that was going up for tax sale and
[19:02] it's literally half my shoreline. Um, and so that that's a a separate
[19:08] issue, but I just wonder like what are the rules about docks? Like
[19:13] » maybe for >> can you have as many docks as you want?
[19:17] » No, the dock actually is also in falls under the building code where it's added
[19:22] into the square footage of when you're building on your lot today.

[19:30] couple things on that. When you're talking about your specific lot, I'd
[19:34] have to look at the size of your lot because we do have some exceptions that
[19:37] are built into the zoning bylaw that do allow a 25% redu reduction if you're an
[19:43] existing undersized lot. Sometimes the lots on Clear Lake are that. So that
[19:47] would allow a 22.5 meter um distance from the lake. So that's something that
[19:53] can be looked at specifically when we're looking at your property.
[19:57] um the other property that you're referring to, that is a separate um lot.
[20:01] So, I don't have information tonight to specify um what is existing on that
[20:05] property because the property we're talking about is the property to the
[20:09] south of it. So, it's a separate one. Um our zoning bylaw does specify um the
[20:15] number of docks that you can have and you have to have extensive amount of
[20:20] shoreline to allow for um more than one dock on the property. And there are very
[20:26] specifics on the maximum size, how far it can go out, that's all outlined in
[20:31] the zoning bylaw. So if you're prepared and you want to come forward with a
[20:34] development, we can go over a lot of that at that time.

[20:43] » like set out right. So the and the other thing too um with
[20:50] that property, a dock is an accessory structure to a principal use. So you
[20:57] can't have a dock on a property if you don't have the principal use. Having
[21:02] said that, there may be specific properties at one time they've had had a
[21:06] dock or might have had a dwelling and the dwelling's been since tore down and
[21:09] the the dock sitting there would be considered um like a legal legal
[21:14] non-complying use. But, uh generally speaking, like sheds, garage, docks,
[21:19] things like that are are accessory to the principal dwelling. So, if you're if
[21:25] you're looking at um anything on your particular property, that could give
[21:29] that information as well. Yeah. Okay. No, I was thinking about the
[21:35] lot beside. I don't know where the second dock is. I can't see it on the
[21:39] site plan. Um, so I'll look into that. Um, the fish habitat part of this
[21:46] because it is zoned fish habitat one according to your zoning bylaws. Is that
[21:53] does that how does that factor into anything or does it not?

[22:03] in the official plan. And generally speaking, any like new lot creation, any
[22:07] new development on a property, and when we speak of new development, it would be
[22:11] a vacant lot um with specific work. Having said that, if somebody was moving
[22:16] forward and they were wanting to build a boat house, wanting to do substantial
[22:20] work within the water, then you'd have to look at it. This particular property,
[22:25] they're looking at building one for one. they're they're tearing down and
[22:28] building on the similar footprint. They're not working within the the
[22:33] shoreline area um per se. So, it wouldn't so much apply in this
[22:40] circumstance. >> Okay. Okay. I'm just, you know,
[22:45] concerned about what was happening on the lake obviously, um, with it getting
[22:52] built up and also curious, which I I guess I'd have to reach out to someone
[22:57] to find out if my lot aside is considered vacant because the lodge has
[23:04] been torn down for, I don't know, 35 years or something, not 50, but it has
[23:10] been down for a while, but there's still footings and everything up
[23:14] um like you can see where it was. So I'm just curious what that
[23:20] » what that's going to look like too. >> So go ahead,
[23:22] » Mayor H. So in that particular instance, it if there's not a structure on the
[23:27] property, then EMPAC has probably been out. It's probably on your tax bill
[23:32] would show as vacant land. And um generally you lose your status of a
[23:38] structure after a year's time once it's been demolished. So then you'll be
[23:42] making application as though the land's vacant with the building department when
[23:46] you decide to proceed. >> Okay. So it's vacant land. So then it
[23:51] needs that 30 m set act. >> Right. Unless I have that
[23:56] » provided that like I said we can have a look at your specific property. We're
[24:00] we're dealing with a different zoning but with your particular property we can
[24:03] look at it. If it happens to have if it's undersized then there are 25%
[24:08] reductions um allowance and we can go over that with a pre-conultation.

[24:20] » these new developments happen, we're not actually creating new lots. The lots are
[24:24] there for many many years and it's it's been a registered lot for many years.
[24:27] But I think council looks at when we do get people coming in and want to upgrade
[24:32] and take an old building down, it's a real benefit to the township and the
[24:36] lake, I think, because under that when they do that now, we're we're looking at
[24:40] new septics, uh, everything new. There's less leeching into the water from the
[24:45] septic beds, um, all of that. So, there's a lot to take into consideration
[24:49] when the council looks at these proposals. I think one of the big things
[24:54] is is we're not adding square footage really to buildings around the lake, but
[24:58] we're also improving the the land around the lake by
[25:01] » in getting rid of the old septic systems that that uh can be leeching into the
[25:05] lake for for years. So that's how it
[25:11] » I appreciate you mentioning that and I I appreciate the time that you've allowed
[25:16] me and I just want to make one comment that that lake like I think we growing
[25:23] up on it probably took it for granted um how beautiful it was and it was when I
[25:30] moved to Michigan and saw what the lakes were like there that I began to get
[25:38] really concerned about what would happen because all the lakes there unless
[25:44] they're in the middle of nowhere people build right up to the shoreline you know
[25:48] within 30 probably within I don't know 20 meters of the shoreline and there
[25:56] sidewalks and docks it looks like a suburb with a bunch of water in the
[26:01] middle of it and I just am concerned I don't want Clear Lake to turn into that.
[26:07] And I understand nicer homes and it's great and it looks nice, but I like
[26:12] looking around at a lake and seeing some trees and not just everybody's fancy
[26:18] house because >> you know it's a lake.
[26:20] » And I would have to agree with that 100%.

[26:26] So that's that's kind of where I'm coming from because I've seen that what
[26:30] happens when you're not um paying attention.

[26:43] saying if people are shortsighted, they don't see what's happening. Um and
[26:48] before you know it, their their beautiful lake is is just a city with a

[27:34] the following email from Dominic. Dear Beth, I received notice from amends
[27:38] bylaw 2014 21 for part 30, plan 167. I have some questions about what is being
[27:44] proposed and how it will impact my adjacent property and the well-being of
[27:48] the lake, the habitat surrounding the lake and life on the lake. Could you
[27:52] provide building plans to show location of the proposed structure and deck and
[27:55] any dog plans as well? I'm still digesting that I was never notified when
[27:59] the shore allowance piece was put up for tax sale and I do not want to allow any
[28:03] more crowding of my lot. Of even greater concern is regarding the lake being
[28:08] building at building capacity. So any development that proposes to cut the
[28:13] required setback by more than half from 30 m to 12.8 m is irresponsible in my
[28:19] opinion in my opic thinking. This is also type one fish habitat as shown on
[28:24] your zoning maps which should further restrict shoreline development. Laneway
[28:28] access may also reduce the size of a dwelling. What is their access to that
[28:32] property? As I recall, they have to cross other lots to get to it. Any

[29:46] for clarifying that the lake itself is not at capacity, but if you understood
[29:50] you correctly, there are no new lots being added to the lake. I did think
[29:53] that what is being at capacity is could you explain what being at capacity means
[29:58] and how close to the lake is to capacity. I have been researching about
[30:02] lakes that are designated as fish one habitat.
[30:06] fish habitat one because section of Clear Lake where the below lot is is
[30:09] designated as fish habitat one. Would it be possible for you to share the
[30:12] environmental impact assessment that would have been completed before this
[30:16] can be approved? I do plan at the attend the council meeting via Zoom and I would
[30:20] like to formally register my concerns about needing to see an environmental
[30:23] assessment before we vote on this zoning uh resoning application. Thank you. On
[30:29] January 13th, staff received an email from Domicki requesting the township
[30:33] staff report for propos zoning bylaw amendment. On January 14th, do Jordan
[30:37] Ross de development and planning coordinator intern responded to
[30:40] Dominic's email. Thank you for providing us with your additional questions and
[30:44] concerns. I will be including them in the report to council for the zoning
[30:48] battle amendment. Our staff have reviewed your questions and provided
[30:51] response below. Thank you for clarifying that the lake itself is not at capacity.
[30:55] But if I understood you correctly there are no new lots being added to the lake.
[30:59] I did think um that that is what at capacity is. Could you explain what it
[31:04] means and how close lake is at capacity? Staff response. Hutcherson Environmental
[31:09] Services completed a lakeshore capacity assessment for Clear Lake on behalf of
[31:13] the Clear Lake Property Owners Association in 2013 which assessed the
[31:17] capacity of Clear Lake for additional shoreline development based on Lake
[31:21] Shore capacity assessment. Their analysis concluded that Clear Lake is
[31:25] presently over capacity with respect to total phosphorus concentration and the
[31:29] would recommend against further development within 300 meters of the
[31:33] lake's shoreline. The review also concluded that Clear Lake exceeds the
[31:37] one definition of social crowding. At the time that the official plan was
[31:42] approved, the only lakes in the township that were subject to formal traffic
[31:47] monitoring and assessment were Lake Trout Lakes, Bay Lake, and Mdale Lake.
[31:51] Council supportive of lake associations undertaking traffic state assessment and
[31:55] analysis and sharing the results of this work with the township for consideration
[31:59] of future planning policy to ensure that all water bodies are protected. The
[32:03] township's official plan outlines that any new lots to be created have a
[32:07] specification that septic tile fields be located a minimum of 300 meters from any
[32:12] shoreline. The official plan also outlines the policies for shoreline lot
[32:16] creation in section B 2.3.4. It outlines that larger lot requirements
[32:21] will be required for new lots where sensitive fish habitats or other
[32:25] environmental or physical constraints are identified. Note that development
[32:29] for cap capacity would be for the creation of new lots. This does not
[32:34] apply to existing lots of record as they would have been considered within the
[32:38] lake capacity studies as a developed lot i.e. your existing vacant lot or other
[32:44] lots proposing demolition and reconstruction etc at the time of
[32:48] completion of the studies. question. I have been researching about lakes that
[32:53] are designated as fish habitat one because the section of Clear Lake where
[32:56] the below lot is is designated as fish habitat 1. Would it be possible for you
[33:00] to share the environmental impacts assessment that would have been
[33:03] completed before this can be approved? Response. The amendment to the zoning
[33:07] bylaw that was requested by the applicant is regard to a proposed single
[33:11] detached dwelling. There will be no alterations to the existing dock and no
[33:14] work within the fish habitat. The proposed dwelling will be situated in
[33:18] the same location as the existing dwelling located on the lot. The
[33:21] footprint will increase. However, the structure will generally be the same
[33:25] distance from the shoreline. The existing dwelling has a front yard of
[33:28] 13.97 m. The proposed dwelling will have a front yard of 12.8 m. Having the
[33:34] proposed dwelling in the same location as the existing dwelling will ensure no
[33:39] furthered vegetation is disrupted on the lot. Both the existing and proposed
[33:43] dwellings have attached decks that encroach into the front yard. As this
[33:47] zoning bile amendment will not introduce any new uses on the lot and will not
[33:51] impact the current vegetation, staff have not requested an environmental
[33:54] study impact study be completed. Occupying the proposed dwelling will
[33:58] have similar impact on environmental concerns as continuing to occupy the
[34:02] existing dwelling would have. Is a possible question. Is it possible for me
[34:06] to see township's planning report that speaks to this application before the
[34:09] meeting? The agenda for the January 21st meeting will be available to the public
[34:15] on January 19th. Once the agenda is public, I will send you the report to
[34:19] council that was prepared for the zoning bylaw amendment.
[34:23] On January 15th, staff received the following email from Don McCloni. Hi,
[34:27] Jordan. I've been thinking that I will be able to speak at the council meeting,
[34:30] but in case I cannot, in addition to the environmental concerns, the lake turning
[34:34] into an Americanstyle suburb with a lake in the middle, the fish habitat, also
[34:38] like to register my concerns about any erosion the work they could do have on
[34:42] my property, either erosion of the shoreline or of the hill to the west end
[34:46] of my property. The lodge was called North Cliff for a reason. Let's not mess

[1:01:14] going to their meeting um tomorrow night uh is proposing a fee schedule for uh
[1:01:21] services uh that municipalities can purchase on. So for instance, if they
[1:01:25] want to utilize uh ACE for grant writing only, then there would be a fee that
[1:01:30] they would pay to get that service. Um and then they had like different levels
[1:01:35] and that's >> nonparticipating members, right?

[1:02:16] decisions to make as in the future. I know we we're going to have a quite a
[1:02:21] discussion at our meeting tomorrow night. Um, but um, economic development
[1:02:27] is something I've always felt it you don't do it just by yourself. Um it's
[1:02:33] um so I just I'm grateful that Perry is wanting to stay in it for the time being
[1:02:40] and we'll um see where it goes and I hope we can stay in for a little while

[1:03:28] let's try this as a group." And as council male has alluded to, there's
[1:03:31] been people that have pulled out or felt different ways, but in the end of it,
[1:03:35] the way I look at it is you're going to pay for economic
[1:03:39] development one way or the other. So, if you're a municipality that doesn't want
[1:03:43] to be involved with this group and you want to grow your municipality, you're
[1:03:47] probably going to have to get someone involved with economic development and
[1:03:50] you're going to pay that person a fee, right? So, what this this a is that
[1:03:57] we're stronger as a as a a shared service with these services going
[1:04:02] forward and and pitching in and and making this this this time stick and
[1:04:07] this time work. I I know it sounds silly and I took me a little bit at the first
[1:04:12] time my first time counselor to be dragged to the table of believer
[1:04:16] believing in the the medicine that we're swallowing right now, but I do I I have
[1:04:20] seen positive action with ACE. They have got traction in this area and they're
[1:04:25] doing good things for this community or and for this region. So
[1:04:31] for the municipalities that have jumped out, all I can say is that yeah, I am
[1:04:34] happy. It's an election year, so the ball's up. It might change, you know,
[1:04:39] the municipalities and have they all wanted to be in it. Well, here we go.
[1:04:42] It's 2026 and maybe new councils and new faces. Maybe they'll feel differently
[1:04:47] and maybe they'll give it a shot. And I am I'm excited for that. That's that's

[1:04:55] where the cards hold cuz next year it's a different story. I felt no shame in
[1:04:59] going in with Margaret and going to different municipalities and selling

[1:08:02] building up throughout the day, so they're coming in the afternoons and
[1:08:06] doing some of that maintenance again because the morning route just isn't
[1:08:09] just enough now, right? Um they've had some struggles with that ice uh rink
[1:08:14] this year because they just get the ice built and then it goes into a saw and
[1:08:19] then there's there's individuals that are going out onto the ice and then they
[1:08:22] damage the ice and then there's they've got to be able to check and make sure
[1:08:26] it's safe because there could be pockets where there's holes into the ice. So
[1:08:32] it's been a it's been a challenge for them with the ice making. And that's
[1:08:36] that's um one positive. when we were speaking about this new Novar rink build
[1:08:41] is that um with having that refrigeration is that once the the team
[1:08:46] gets the ice built, it'll be there for the season. Whereas unfortunately um
[1:08:52] with the regular outdoor rinks that you do face like open enclosures and and I
[1:08:57] know that's frustrating to the residents, but we're at the mercy of the
[1:09:00] of the weather, right? learning for me. >> So,

[1:09:07] sooner get a good layer of ice there and three days later it's got water puddles

[1:25:40] to land for recreational tourism and hunting, gathering purposes, water
[1:25:44] contamination, and concern about the effects on human health. And whereas
[1:25:49] municipalities have limitability to address the issue of the aerial spray of
[1:25:54] glyos glyophosphate particularly on crown land and require provincial
[1:26:00] leadership and regulation. And whereas the province of Ontario has a
[1:26:04] responsibility to protect the environment and public health and must
[1:26:08] take action to reduce the harm caused by the aerial spray. Now therefore, be it
[1:26:13] resolved the council of the corporation of township of Perry hereby urges the
[1:26:16] federal and provincial governments to take immediate action to end the aerial
[1:26:20] spraying. Uh, councelor Sar, do you move?
