[Gavel]
[1:05]
>> good morning.
[1:08]
This is the city of port st.
[1:09]
Lucie special magistrate hearing
[1:10]
for wednesday, SEPTEMBER 2,
[1:11]
2026.
[1:13]
It's just after 9:00 in the
[1:17]
morning and my name is keith
[1:17]
davis.
[1:18]
I'm the special magistrate
[1:19]
appointed by the city to preside
[1:21]
over today's hearing.
[1:23]
I would ask everyone to silence
[1:25]
their cell phones so they don't
[1:26]
interrupt our proceedings.
[1:27]
That would be appreciated.
[1:29]
I will invite you to stand and
[1:30]
join me in reciting the pledge
[1:35]
of allegiance.
[1:36]
I pledge allegiance to the flag
[1:37]
of the united states of america,
[1:38]
and to the republic for which it
[1:40]
stands, one nation, under GOD,
[1:42]
indivisible with liberty and
[1:50]
justice for all.
[1:52]
>> swear the city staff and code
[1:53]
officers who will be testifying
[1:55]
on the agenda items that we have
[1:56]
today.
[1:58]
>> please raise your right hand.
[1:59]
Do you swear or affirm the
[2:00]
testimony you are about to give
[2:00]
is the truth, the whole truth
[2:01]
and nothing but the truth?
[2:11]
>> thank you.
[2:13]
>> where was I?
[2:13]
Okay.
[2:15]
So I have previously review and
[2:17]
approved hearings minutes from
[2:21]
JULY 1 and JULY 8.
[2:23]
For today's agenda, do we have
[2:25]
any late abatements or
[2:28]
postponements to note?
[2:40]
>> number 22, case number
[2:42]
2603058, respondent address 233
[2:44]
southeast seafurry lane.
[2:50]
>> ok.
[2:52]
Is that abatement or
[2:53]
postponement?
[2:53]
>> abatement.
[2:55]
>> with that abatement, the
[3:07]
agenda for today is approved.
[3:08]
All right.
[3:11]
Are we going straight to cases
[3:13]
with people present in the room?
[3:15]
Thank you for being here.
[3:16]
Take the table and chair and
[3:18]
microphone is over to my right,
[3:19]
I'll be able to seeened a hear
[3:20]
you from there.
[3:22]
The way I'm going to proceed
[3:24]
with each case is when it's
[3:25]
called, I'll hear from the city
[3:25]
first.
[3:28]
I'll hear the testimony from the
[3:30]
city's code enforcement
[3:32]
officers, and any other
[3:34]
witnesses that the city calls.
[3:36]
Typically the city will display
[3:37]
photographic evidence of the
[3:39]
alleged violations on the
[3:41]
monitors around the room, so
[3:42]
you'll have an opportunity to
[3:43]
see that.
[3:46]
Once the city has concluded the
[3:47]
presentation, made my
[3:48]
recommendations to me on how it
[3:50]
believes the matter should be
[3:51]
resolved, at that point I will
[3:52]
come over to you.
[3:54]
Have you worn in, and I will be
[3:55]
happy to hear from you.
[3:56]
If you have any questions for
[3:58]
the city's witnesses, you're
[4:00]
entitled to ask those questions.
[4:02]
If you brought any additional
[4:04]
documents or photographs with
[4:05]
you that you believe are
[4:06]
relevant to the case, so that
[4:08]
will be the time to produce
[4:08]
those.
[4:12]
And after I've heard everything
[4:16]
from everybody on the matter, in
[4:18]
all likelihood, I will enter an
[4:20]
order in the matter of the case.
[4:22]
Sometimes cases are continued,
[4:24]
but that is how we will proceed
[4:27]
with the case.
[4:30]
Let's call the first case that
[4:31]
we're going to hear.
[4:35]
>> number 7, officer mendoza,
[4:42]
case 26-11444, respondent
[4:43]
matthew pelton and ivonne
[4:55]
hernandez, respondent address
[4:58]
931 southwest Mcconkle avenue.
[5:00]
>> good morning, your honor.
[5:04]
Code officer mendoza, previously
[5:04]
sworn.
[5:08]
>> good morning.
[5:10]
>> this case concerns the
[5:14]
property t a 931 southwest
[5:15]
Mccomkle.
[5:17]
An inspection was done and
[5:18]
photos taken showing the
[5:19]
following violations.
[5:22]
Section 158.211, open storage or
[5:25]
accumulation of materials of
[5:28]
materials and waste materials
[5:29]
prohibited.
[5:31]
Inoperative vehicle.
[5:33]
The photos depict an accurate
[5:33]
representation of the property
[5:34]
at the time the photos were
[5:35]
taken.
[5:37]
A notice of violation was issued
[5:39]
7-9-26 and the respondent had
[5:42]
until 7-19-26 to bring the
[5:43]
property to compliance.
[5:44]
Compliance was not achieved and
[5:46]
a notice of hearing was
[5:49]
furnished by certified mail.
[5:50]
On 8-22-26 proper service was
[5:52]
achieved by posting the property
[5:53]
with the notice of hear.
[5:54]
The city requests the
[5:55]
respondents be ordered to comply
[5:57]
with the cited provisions of the
[5:59]
city of port st. Lucie code by
[6:00]
9-19-26 and if not in compliance
[6:02]
by that date, then a hearing be
[6:04]
held to determine a fine to be
[6:06]
imposed against the subject
[6:07]
property.
[6:08]
As you can see, there is some
[6:11]
open storage here by the
[6:14]
driveway and in the back of the
[6:15]
truck.
[6:19]
That is the left side, front
[6:19]
side.
[6:21]
This is open storage in this
[6:23]
truck on this vehicle is the one
[6:24]
that the tag is expired as well
[6:32]
as you can see there.
[6:34]
That vehicle as well has an
[6:35]
expired tag.
[6:37]
There's the posting.
[6:38]
More open storage.
[6:43]
That is all I have, sir.
[6:44]
>> okay.
[6:45]
You're asking for SEPTEMBER 9
[6:46]
compliance date?
[6:47]
>> correct.
[6:47]
Sorry.
[6:49]
>> thank you.
[6:50]
Okay.
[6:52]
Is there anybody hear on behalf
[6:52]
of the respondent?
[6:54]
Come on up.
[6:55]
Like I asked everybody to, sir.
[6:57]
I'll be happy to --
[6:58]
>> you said you would hear the
[7:00]
city first, so I was waiting.
[7:01]
>> okay.
[7:02]
Let me get you sworn in, and
[7:13]
I'll be happy to hear from you.
[7:14]
Let me get you sworn in and I'll
[7:16]
be happy to hear from you.
[7:17]
Please raise your right hand.
[7:18]
>> do you swear or affirm the
[7:20]
testimony you offer today is the
[7:21]
truth and nothing but the truth?
[7:22]
>> sure.
[7:25]
>> and please state your name
[7:26]
for the record.
[7:28]
>> I am here on special
[7:29]
appearance because I do not
[7:31]
agree with this proceeding.
[7:38]
My name is matthew pelton, marx
[7:39]
--
[7:40]
I am a living man.
[7:42]
>> MR. Davis, that microphone is
[7:43]
not recording.
[7:45]
You need to go to the podium.
[7:47]
>> come up to this microphone.
[7:48]
>> this is such a clown show.
[7:49]
You guys don't even know what
[7:54]
you're doing.
[7:56]
>> you don't need to slam things
[7:57]
down, MR. Pelton.
[7:58]
I'm right here.
[8:01]
i can see and hear you.
[8:02]
If you'll please again state
[8:02]
your name for the record, and
[8:04]
the floor will be yours to ask
[8:05]
questions or simply tell me
[8:08]
about what's going on with the
[8:09]
case.
[8:20]
>> my name is matthew pelton.
[8:20]
M-a-t-t-e-w, p-e-l-t-o-n.
[8:22]
I am a living man and here on
[8:23]
the ground of this appearance
[8:25]
because I do not agree with the
[8:25]
proceeding.
[8:27]
>> I don't know what that means.
[8:29]
>> you're the magistrate.
[8:30]
--
[8:32]
>> did you take an oath to the
[8:32]
constitution?
[8:34]
>> the floor is yours --
[8:38]
>> did you take an oath to the
[8:39]
constitution?
[8:43]
>> the floor is yours.
[8:45]
>> this man has veer zero right
[8:47]
to be on my property.
[8:50]
There is no trespassing.
[8:51]
That is more than obvious he is
[8:52]
on my property.
[8:54]
I want charges pressed now.
[8:57]
>> I'm sure I've got a couple of
[8:58]
law enforcement officers in the
[8:58]
room.
[9:00]
I am sure they heard that
[9:00]
request.
[9:02]
>> not like you guys actually
[9:04]
take care of that.
[9:05]
>> MR. Pelton, I am not going to
[9:07]
sit here and do this with you.
[9:08]
If you have anything else to say
[9:11]
about the case, say it,
[9:13]
otherwise I'm ready to enter my
[9:13]
order.
[9:15]
>> yeah, that truck runs.
[9:17]
Yes, my other truck t plates
[9:18]
were expired.
[9:20]
My wife has ordered the plates.
[9:20]
Should be in any time.
[9:22]
You want to check it out with
[9:25]
D.M.V., it's there.
[9:27]
These people do nothing but go
[9:30]
around and harass people, okay.
[9:31]
he's up on my property after
[9:34]
being told -- and I have tried
[9:35]
to file complaints against this.
[9:38]
You don't have a right to be on
[9:40]
my property after being told.
[9:40]
This is trespassing.
[9:42]
This is invasion of privacy.
[9:44]
Show me the contract and I want
[9:45]
to see it on the record for the
[9:46]
record that says the city has
[9:48]
the right to be all over my
[9:49]
property after they have been
[9:51]
told no trespassing.
[9:53]
Also show me the contract that
[9:55]
shows that the frontage of my
[9:57]
property is taken care of by me
[9:59]
and that you have the rights to
[10:00]
take over anything and anything
[10:01]
on my property.
[10:03]
Show me where that's under
[10:04]
contract.
[10:06]
>> so if I heard you correctly,
[10:08]
you acknowledge that the
[10:09]
registration on this vehicle is
[10:09]
expired.
[10:14]
>> I said on the other truck.
[10:15]
>> okay.
[10:17]
>> I also said that it's already
[10:18]
been redone.
[10:20]
I'm just waiting for the sticker
[10:20]
to show up.
[10:22]
Unless you want me to beat on
[10:23]
the door of the D.M.V.
[10:25]
>> I'm not telling you to do
[10:25]
anything.
[10:26]
I'm simply --
[10:28]
>> isn't that why I am here so
[10:30]
you can tell me what to do?
[10:32]
>> no, you're here so you have
[10:33]
an opportunity to present
[10:34]
whatever evidence you feel is
[10:36]
relevant to the case.
[10:37]
>> these people harassing me and
[10:39]
other people in my neighborhood.
[10:40]
>> I have heard that four times.
[10:42]
I'm not the smartest guy in the
[10:43]
world, but I usually get the
[10:44]
first time you say it, so I
[10:46]
don't need to hear that again.
[10:47]
Is there anything else you would
[10:49]
like to place into the record
[10:50]
before I enter my order?
[10:51]
>> yeah.
[10:53]
>> please proceed.
[10:53]
>> I want charged --
[10:55]
>> okay, I've heard that twice
[10:56]
as well.
[10:57]
>> I want to make sure it's on
[10:58]
the record.
[10:59]
>> pretty sure it is.
[11:01]
We all heard it, twice.
[11:02]
So is there anything new you
[11:03]
would like to place into the
[11:04]
record before I enter my orred
[11:04]
sner
[11:06]
>> yeah, I would like to press
[11:08]
charges against you as well.
[11:08]
>> okay.
[11:10]
Here's what I am going to do.
[11:11]
I find proper notice.
[11:15]
MR. Pelton is present.
[11:16]
And according to his own
[11:17]
testimony, alive, so
[11:18]
congratulations on that.
[11:19]
>> does that bother you?
[11:21]
Was that a threat towards me?
[11:22]
>> no, not at all.
[11:25]
You're just the first person in
[11:26]
all the years I have ever served
[11:29]
as a magistrate to tell me
[11:29]
they're alive.
[11:31]
I usually get that when they're
[11:32]
standing there to talking to me.
[11:35]
Based on the testimony and the
[11:36]
everyday --
[11:37]
>> is this maritime law or law
[11:37]
of the land?
[11:39]
>> an I will find the property
[11:40]
remains in violation as cited.
[11:42]
I will grant the relief
[11:43]
requested by the city including
[11:45]
compliance date of SEPTEMBER 9.
[11:46]
If this needs to be brought back
[11:48]
for anything further, the city
[11:49]
can notice for a future hearing.
[11:51]
>> all right.
[11:52]
Thank you very much.
[11:54]
Thank you for being here, MR.
[11:54]
Pelton.
[11:55]
Have a nice day.
[11:58]
>> what a disgrace.
[12:00]
>> all right.
[12:01]
Where to next?
[12:08]
>> number 10, officer o'malley,
[12:14]
case 26-02459, respondent una
[12:17]
brady, respondent address 1674
[12:37]
southwest aledo lane.
[12:39]
>> good morning, sir.
[12:42]
Officer o'malley, previously
[12:42]
sworn.
[12:44]
>> hang on.
[12:45]
Let me just give --
[12:46]
sorry.
[12:47]
Is it MS. Brady?
[12:48]
You're coming up.
[12:49]
Let me give you a second to get
[12:51]
up here and get settled before
[12:53]
we proceed.
[14:00]
Take your time.
[14:01]
>> good morning, ma'am.
[14:05]
Thank you, MR. Armstrong.
[14:06]
Okay, you can go ahead whenever
[14:07]
you're ready.
[14:08]
>> this case concerns the
[14:11]
property at 1674 southwest aledo
[14:13]
lane, port st. Lucie, florida.
[14:14]
On FEBRUARY 13, 2026, an
[14:15]
inspection was done and photos
[14:18]
taken showing the following
[14:20]
violations.
[14:21]
Section 41.08,h1, exterior
[14:23]
property areas, obstructions in
[14:24]
swale prohibited.
[14:28]
The photos depict an accurate
[14:29]
representation of the property
[14:30]
at the time the photos were
[14:30]
taken.
[14:32]
A notice of violation was issued
[14:33]
FEBRUARY 13, 2026.
[14:34]
The respondent had until
[14:37]
FEBRUARY 21, 2026 to bring the
[14:38]
property into compliance.
[14:39]
Compliance was not achieved by
[14:41]
such date, and so a notice of
[14:43]
hearing was furnished on JULY
[14:46]
10, 2026, by certified mail.
[14:48]
On AUGUST 19, 2026, proper
[14:49]
service was achieved by posting
[14:52]
the property with a notice of
[14:52]
hearing.
[14:53]
the city requests that the
[14:54]
respondents be ordered to comply
[14:56]
with the cited provisions of the
[14:58]
city of port st. Lucie code by
[15:00]
SEPTEMBER 9, 2026, and if not in
[15:01]
compliance by that date, then a
[15:03]
hearing be held to determine a
[15:07]
fine to be imposed against the
[15:08]
subject property.
[15:11]
So this is the left side of the
[15:11]
property.
[15:13]
You can see the obstruction in
[15:14]
the swale right here.
[15:18]
The pavers.
[15:21]
The front of the property.
[15:25]
There is a closeup of it.
[15:31]
That is the posting.
[15:32]
>> pardon me.
[15:36]
And that wall is not on the
[15:39]
property owner's line?
[15:41]
It's in the city's right-of-way?
[15:42]
>> correct.
[15:44]
I did confer with public works
[15:45]
department yesterday regarding
[15:46]
that situation.
[15:48]
That wall is wholly on city
[15:49]
property.
[15:51]
It's not a permitted wall in any
[15:51]
way.
[15:54]
It would be a decorative feature
[15:55]
that would have to be holy on
[15:56]
private property.
[16:00]
>> it looks like it's actually
[16:02]
holding back like a retaining
[16:02]
wall.
[16:05]
>> yeah, so it would have to be
[16:08]
depending on the circumstance
[16:09]
for the city to permit any type
[16:12]
of retention wall within the
[16:17]
city right-of-way.
[16:17]
>>
[16:20]
>> I believe the wall functions
[16:25]
primarily decorative, but the
[16:29]
land is built up behind it
[16:32]
specifically.
[16:33]
>> okay.
[16:34]
>> well, I don't think SEPTEMBER
[16:36]
9 is a realistic compliance date
[16:38]
no matter what we do here, so
[16:41]
let's keep that in mind.
[16:46]
and let me -- are you MS. Brady?
[16:46]
Yes, ma'am.
[16:48]
Let me get you sworn in, and
[16:52]
I'll be happy to hear from you.
[16:54]
>> please raise your right hand.
[16:57]
>> do you swear or affirm the
[16:58]
testimony you offer today is the
[16:59]
truth and nothing but the truth?
[17:01]
>> yes.
[17:02]
>> please state your name for
[17:04]
the record.
[17:05]
Just your name.
[17:08]
>> juna brady.
[17:12]
>> thank you, MS. Brady.
[17:15]
So what can you tell me about
[17:16]
this wall and what's going on
[17:17]
with this?
[17:20]
>> okay.
[17:21]
I'm really slow because I am
[17:22]
recovering from a stroke.
[17:23]
>> yes, ma'am.
[17:24]
>> so bear with me.
[17:26]
>> I'm glad you're recovering.
[17:27]
That's good news.
[17:29]
But yes, take your time.
[17:34]
>> I did go to the city and ask
[17:40]
them over on the other side, if
[17:44]
I need a permit, the reason why
[17:48]
I did that was -- I'm on the
[17:50]
corner --
[17:54]
>> I see that.
[17:59]
And everything -- everything was
[18:11]
on the property and the sewer --
[18:13]
you know, the dirt blocks
[18:17]
everything.
[18:25]
You can't get out because of the
[18:25]
dirt.
[18:26]
>> every year I have been
[18:27]
putting two loads of dirt on
[18:30]
there because when it rains,
[18:31]
everything --
[18:32]
>> washed out?
[18:33]
>> okay.
[18:37]
>> so I came to the city over
[18:44]
and asked them if I need a
[18:45]
permit to prevent --
[18:46]
my husband is sick.
[18:49]
I am recovering from a stroke,
[18:52]
but before then, it was very
[18:59]
hard for us when we call the
[19:00]
city, four, five times they get
[19:01]
stuck there.
[19:09]
Everything is there at the
[19:09]
corner.
[19:12]
So they are telling me I don't
[19:13]
need a permit.
[19:16]
I didn't ask how far and they
[19:19]
didn't tell me.
[19:22]
>> let me ask you --
[19:26]
>> they didn't tell me how far
[19:27]
in I could go.
[19:29]
So I come and I waited a little
[19:34]
bit and then I put it --
[19:37]
since I put the wall, there's no
[19:40]
cars stuck in there.
[19:45]
I don't have -- my husband don't
[19:46]
have to come out every time and
[19:48]
call the city.
[19:50]
If they look, they could see how
[19:52]
many times my neighbor call the
[19:57]
city because it affect her, too.
[20:02]
So when I get this, the lady
[20:05]
came and told me I should be 2
[20:08]
feet in, but I says, but I
[20:11]
didn't know that.
[20:14]
They -- I should have asked the
[20:15]
question, yes, but they should
[20:22]
have told me, yes, there is no
[20:23]
permit, but you should be --
[20:26]
>> when did the wall go in?
[20:27]
Do you know about how old it is?
[20:28]
>> the wall?
[20:31]
>> yes, ma'am.
[20:38]
>> an it's about two years now.
[20:39]
And as you see, we have a lot of
[20:40]
rain now.
[20:47]
>> we sure have.
[20:49]
>> it keep washing the dirt
[20:50]
down.
[20:51]
So the wall keeps the dirt from
[20:53]
coming down.
[21:01]
It's also beautiful in the
[21:02]
neighborhood.
[21:06]
>> so I mean, here's what I am
[21:06]
seeing.
[21:09]
This does violate the city's
[21:10]
code based on what I have seen
[21:12]
and whey eve heard this morning.
[21:13]
But this is not going to be a
[21:19]
simple fix.
[21:32]
the way that the grading is and
[21:34]
so I am going to make a finding
[21:35]
that the wall violates the
[21:37]
city's code, but I'm reluctant
[21:40]
to set a compliance date today
[21:45]
because this is going to require
[21:47]
you and the city to put their
[21:48]
heads together and try and come
[21:51]
up with a reasonable solution
[21:55]
that fixes it, and this is going
[21:56]
to take time.
[21:58]
So in lieu of setting a
[22:00]
compliance date, does the city
[22:03]
have any suggestions on how to
[22:04]
--
[22:05]
>> I did meet with the deputy
[22:06]
director of public works
[22:08]
specifically to discuss this
[22:09]
property yesterday.
[22:11]
So we're not opposed to
[22:13]
additional time.
[22:16]
And then we can work offline
[22:18]
with the respondent to come up
[22:20]
with a time frame for when the
[22:23]
wall can be -- it's about -- the
[22:24]
wall would have to be basically
[22:27]
even with the other landscaping.
[22:29]
Give or take 5 feet, depending
[22:30]
on the location.
[22:30]
>> all right.
[22:32]
To be moved back.
[22:36]
>> let me ask, in -- as we sit
[22:42]
here this morning, is the city's
[22:44]
drainage system functioning
[22:45]
here?
[22:48]
>> I do believe it is.
[22:50]
I don't know -- so they didn't
[22:52]
say this was causing a direct
[22:55]
hazard to the system as of
[22:55]
today.
[22:57]
Their fear was the wall was
[22:58]
built without a permit.
[22:59]
>> sure.
[23:00]
>> one would never be granted
[23:04]
for this realistically in the
[23:05]
city right-of-way.
[23:06]
So they don't want to say that
[23:11]
the wall is necessarily okay,
[23:11]
and as it is because they
[23:12]
haven't inspected that.
[23:17]
>> no, just if there was
[23:19]
actually -- if it was impeding
[23:24]
the functionality of the system,
[23:25]
that is
[23:27]
>> as of today, it is not
[23:29]
backing up the storm water
[23:29]
drainage.
[23:30]
>> I understand the comment no
[23:34]
permit, no inspection, no way to
[23:35]
know the stability of the wall.
[23:36]
>> if tomorrow it washes out.
[23:38]
>> right.
[23:39]
Well, I'm not even sure what the
[23:41]
appropriate time frame is.
[23:45]
If you want to bring this back,
[23:46]
like, for -- do we need to bring
[23:47]
it baing?
[23:49]
I am going to -- today I am
[23:51]
going to find proper notice and
[23:52]
make a finding of violation, but
[23:54]
I'm not sure, like I said at the
[23:55]
beginning of this, SEPTEMBER 9
[23:56]
is certainly not the appropriate
[24:01]
compliance date.
[24:03]
>> so realistically to have the
[24:05]
wall relocated, how much time
[24:08]
would you need for that?
[24:09]
At least to -- are you going to
[24:13]
do it yourself or look to do it
[24:16]
or hire someone?
[24:18]
>> you're going to hire someone
[24:19]
and you will need time for that
[24:27]
and to get with someone.
[24:29]
>> is this like 120 day kind of
[24:30]
thing?
[24:31]
>> that is what I am thinking in
[24:36]
terms of a four-month period.
[24:36]
Into JANUARY.
[24:38]
>> very busy back and forth to
[24:42]
doctor with my husband and I.
[24:46]
So we need some time.
[24:50]
>> so I think the 120 days would
[24:51]
be sufficient.
[24:52]
If we get to that point and
[24:53]
there is no movement, we can
[24:55]
have a conversation with that.
[24:57]
If you have hired a contractor
[24:58]
but maybe don't have a specific
[24:59]
date, we can work that out
[25:01]
together.
[25:03]
so it will give you enough time
[25:05]
to at least secure a contractor
[25:06]
and to have conversations with
[25:07]
them to maybe schedule
[25:08]
something.
[25:09]
And then we can work offline
[25:11]
with you guys in terms of if
[25:13]
there is additional time
[25:14]
depending on when the schedule
[25:15]
and if we have a hurricane or
[25:22]
something like that.
[25:26]
>> the officer that came out
[25:28]
said 2 feet back.
[25:30]
>> yeah, we can work with you in
[25:31]
terms of where the wall needs to
[25:34]
be placed.
[25:36]
We can have public works speak
[25:40]
to you and show you specifically
[25:42]
where the property line is.
[25:46]
It is likely to be --
[25:51]
right up against that landscaped
[25:52]
area.
[26:02]
Give or take.
[26:04]
>> that is not 2 feet, so we
[26:05]
have to have another 2 feet or
[26:10]
--
[26:12]
>> we can work on the specific
[26:14]
placement prior to you guys
[26:15]
speaking to a contractor.
[26:16]
We can have our staff and public
[26:19]
works meet you at the property.
[26:21]
We can go over it specifically
[26:23]
where the wall needs to be
[26:25]
relocated to and get you the
[26:28]
specific measurements, okay?
[26:30]
>> that way that will give the
[26:30]
contractor guidance.
[26:36]
I'm going to put a four-month
[26:37]
compliance dates on this, which
[26:43]
is JANUARY 6 of 2027.
[26:44]
Right?
[26:44]
Yeah.
[26:49]
It is not my intent in this case
[26:52]
to push this towards a situation
[26:55]
where daily fines are start
[26:56]
running.
[26:58]
I want to see this succeed in
[26:59]
getting fixed correctly.
[27:00]
The important thing is to stay
[27:05]
in touch with the city, with the
[27:08]
code enforcement division.
[27:11]
Have that meeting where they can
[27:12]
show exactly where the wall
[27:14]
needs to be placed in order to
[27:17]
be in compliance with the city
[27:19]
code and then stay in touch as
[27:24]
you hire your contractor and
[27:27]
assuming that will need to be
[27:28]
permitted.
[27:30]
>> so the decorative wall does
[27:31]
not need to be permitted.
[27:32]
It is just landscaping that
[27:33]
we're discussing.
[27:35]
>> that makes it a little easier
[27:37]
if you don't have to deal with
[27:38]
building permits and that sort
[27:39]
of thing.
[27:40]
>> it would just be a
[27:41]
landscaping wall.
[27:42]
>> okay.
[27:44]
So the only other thing, MS.
[27:45]
Brady, that I would tell you is
[27:48]
if you are getting close to
[27:50]
JANUARY and it doesn't look like
[27:52]
it's going to be done in time,
[27:54]
just, again, stay in touch.
[27:55]
If you need to come back and ask
[27:59]
for additional time, I will be
[28:00]
happy to consider that.
[28:02]
I will tell you the way I
[28:05]
typically handle those sorts of
[28:08]
things if I see good faith
[28:10]
effort on your behalf, I'm
[28:11]
unlikely to deny that.
[28:14]
If I see that nothing has
[28:17]
happened and since today,
[28:18]
probably not.
[28:20]
So that's how I deal with that.
[28:23]
The city MAY work with you
[28:25]
behind the scenes on timing as
[28:25]
well.
[28:27]
If this has to be brought back t
[28:29]
city will f to provide notice
[28:33]
and a new hearing date.
[28:35]
So my hope is that it all just
[28:36]
gets handled after today without
[28:39]
having to have you come back.
[28:41]
Is there anything else that you
[28:43]
would like to tell me?
[28:44]
Before I enter my orreder in
[28:52]
this case?
[28:52]
All right.
[28:54]
Anything else from the city?
[28:56]
>> we have proper notice.
[28:59]
MS. Brady is present at today's
[28:59]
hearing.
[29:00]
Based on the testimony and the
[29:01]
evidence, the property remains
[29:03]
in violation as cited.
[29:04]
JANUARY 6, 2027 as the
[29:05]
compliance date.
[29:06]
If this needs to be brought back
[29:08]
for any other reason, the city
[29:10]
will renotice it and put it on a
[29:11]
future agenda.
[29:12]
Good luck, ma'am.
[29:15]
Thank you for being here.
[29:19]
I appreciate it.
[29:20]
>> excuse me.

[30:13]
>> good morning, good morning.
[30:14]
>> whenever you're ready, you
[30:15]
can proceed.
[30:16]
>> officer wise, I have been
[30:17]

[30:19]
This case concerns the property
[30:23]
at 3280 southeast monte vista
[30:24]

[30:27]
A violation hearing was held on
[30:28]
JUNE 17, 2026.
[30:30]
Based on the everyday presented
[30:31]
on that date, the special
[30:32]
magistrate found that the
[30:34]
violations existed and ordered
[30:38]
compliance be achieved by JULY
[30:40]
1, 2026.
[30:42]
For the following violations.
[30:44]
Section 158.211, storage or
[30:46]
accumulation of material,
[30:47]
refuse, and waste materials
[30:50]
prohibited.
[30:51]
Per neighborhood services
[30:53]
department records, compliance
[30:55]
was not achieve by JULY 1, 2026,
[30:57]
and neighbor services maintains
[30:58]
a copy of the entire case file
[30:59]
as public record.
[31:03]
The photos taken truly and
[31:04]
accurately represent the scene
[31:06]
as it appeared on the dates of
[31:07]
the inspections.
[31:09]
Due to the respondents failure
[31:10]
to comply with the deadline set
[31:13]
forth at the violation hearing,
[31:14]
the city requests that the
[31:15]
special magistrate impose a fine
[31:18]
and order the respondent to pay
[31:19]
a fine in the amount of $25 per
[31:22]
day up to a maximum of $50,000.
[31:25]
Finally t city requests the
[31:27]
respondents be ordered to pay
[31:33]
administrative costs in the
[31:33]
amount of $411 representing
[31:36]
reasonable cost and
[31:38]
investigation of this case.
[31:40]
That was the original door
[31:41]
hanger back in FEBRUARY when the
[31:44]
case was opened.
[31:47]
This is what is remaining is
[31:48]
open storage in the backyard.
[31:51]
>> what was the date of this
[31:51]
photograph?
[31:53]
>> this was on last week on the
[32:01]
27th of AUGUST.
[32:02]
On the right side of the house,
[32:07]
shutter rs and items behind the
[32:10]
trash can.
[32:17]
This is the trailer parked in
[32:19]
the front of the home with item
[32:20]
on it.
[32:22]
>> has there been any
[32:23]
improvement in circumstances
[32:24]
since the JUNE violation
[32:25]
hearing?
[32:26]
>> there has.
[32:30]
There was another violation of
[32:32]
inoperative vehicle and I
[32:34]
believe the unregistered R.V. As
[32:34]
well.
[32:35]
Both of those have been taken
[32:36]
care of.
[32:38]
The only thing remaining now is
[32:41]
the open storage.
[32:41]
>> okay.
[32:44]
Is there anything else you need
[32:45]
to put into the record?
[32:46]
>> no, sir.
[32:47]
>> all right.
[32:49]
Let me get you sworn in, sir.
[32:50]
>> please raise your right hand.
[32:51]
Do you swear or firm the
[32:52]
testimony you offer today is the
[32:55]
truth and nothing but the truth?
[32:56]
>> please state your name for
[32:57]
the record.
[32:59]
>> darwin grande.
[33:00]
>> thank you, MR. Grande.
[33:01]
The floor is yours.
[33:02]
If you have any questions, you
[33:03]
MAY ask them, otherwise tell me
[33:05]
about what's going on with the
[33:06]
case.
[33:08]
>> and if I get you a little
[33:09]
closer to the microphone, that
[33:13]
will help me hear you.
[33:15]
>> getting rid of most of the
[33:17]
trash tomorrow.
[33:20]
Tomorrow is the when they pick
[33:24]
up bulk.
[33:25]
>> okay.
[33:29]
>> and I can do everything he
[33:31]
asked for today.
[33:32]
By friday.
[33:34]
>> I mean, what's been the
[33:37]
holdup?
[33:38]
This has been going on for -- I
[33:41]
mean t hearing was in JUNE.
[33:42]
That's been almost three months.
[33:45]
There's been a lot of garbage
[33:47]
pickup days between then and
[33:48]
now.
[33:50]
Why haven't -- what is the
[33:50]
delay?
[33:52]
>> bulk is only once a month,
[33:55]
and I was fixing up inside the
[34:01]
house so I have some stuff
[34:03]
outside.
[34:16]
Like furniture.
[34:19]
>> so you are telling me is --
[34:22]
>> what is covered is the
[34:24]
barbecue, is that fine there?
[34:26]
>> the grill can stay outside.
[34:27]
>> right.
[34:29]
>> everything else, yeah.
[34:32]
>> well, here's what I'm going
[34:42]
to do.
[34:44]
>> an is there a way to
[34:46]
structure the order by friday
[34:47]
and if it's not in compliance by
[34:49]
close of business, the fines
[34:50]
start to accrue without bringing
[34:51]
this back?
[34:52]
>> it would be one of two
[34:53]
options.
[34:55]
The first is the continuance or
[34:58]
the second we can hold the order
[35:00]
before we -- once we give the
[35:01]
fine, they prefer the lien.
[35:04]
>> I prefer the latter.
[35:05]
I am not interested in
[35:06]
continuing this.
[35:08]
There is no reason this
[35:11]
shouldn't have been done.
[35:17]
This is getting rid of stuff.
[35:19]
I am going to find proper
[35:20]
notice.
[35:22]
You are here at today's hearing.
[35:26]
Property did not comply with the
[35:30]
order from the JUNE 17 violation
[35:30]
hearing.
[35:31]
Compliance was not achieved by
[35:33]
JULY 1, so I am going to certify
[35:36]
the fine as requested by the
[35:36]
city.
[35:38]
I am going to direct the city to
[35:40]
hold that order from being
[35:42]
recorded as a lien and giver you
[35:43]
until the end of the week, like
[35:43]
you said.
[35:46]
But if it's not in compliance by
[35:51]
the end of the vehicle, then the
[35:53]
fine is certified and you'll
[35:55]
have in all likelihood a lien on
[35:57]
your property which will accrue
[35:59]
daily at $25 a day until it is
[36:00]
cleaned up.
[36:01]
So we'll do it that way.
[36:04]
All right.
[36:08]
Thank you very much for being
[36:08]
here.

[37:30]
A violation hearing was held on
[37:32]
JUNE 17, 2026.
[37:33]
Based and the evidence presented
[37:36]
and that date, the special
[37:37]
magistrate found the violations
[37:38]
existed and ordered compliance
[37:41]
be achieved by JUNE 24, 2026 for
[37:42]
the following violations.
[37:50]
Section 41.08, subsectiona,
[37:51]
alpha.
[37:51]
Per neighborhood service
[37:52]
department records, compliance
[37:55]
was not achieved by JUNE 24,
[37:57]

[37:58]
maintains a copy of the entire
[38:01]
case file as public record.
[38:05]
The photos taken and truly and
[38:07]
accurately represent the scene
[38:11]
as it appeared on the dates of
[38:12]
the inspection.
[38:15]
The city requests that the
[38:16]
special magistrate impose a fine
[38:19]
and order the respondent pay a
[38:21]
fine in the amount of $25 per
[38:24]
day up to a maximum of $50,000.
[38:26]
Finally the city requests the
[38:31]
respondent be ordered to pay the
[38:32]
administrative cost in the
[38:33]
amount of $411 representing
[38:33]
reasonable cost of the

>> NOVEMBER last year and the

[38:49]
This is the posting done two
[38:51]
weeks ago on AUGUST 1 and this
[38:52]
is as recently as last week on
[38:53]
the 27th.
[38:55]
This is the damaged driveway
[38:56]
area here.
[38:59]
And it's above the culvert pipe.
[39:02]
the pipe being here.
[39:05]
This is all up here.
[39:09]
Just different angles of it and
[39:12]
this is a little further up on
[39:17]
the left side up here and then
[39:23]
this is the front of the home.
[39:25]
We spoke with public works.
[39:26]
The culvert pipe is fine.
[39:28]
Doesn't need to be replaced or
[39:28]
anything.
[39:30]
It's just the driveway that
[39:31]
needs to be repaired.
[39:35]
And with its location above the
[39:36]
pipe, I believe a permit would
[39:38]
not be required.
[39:40]
>> that is all good news.
[39:45]
Has there been any change in the
[39:46]
circumstances since the JUNE 17
[39:49]
violation hearing?
[39:51]
Has any forward progress been
[39:51]
made?
[39:52]
>> no, sir.
[39:56]
It's stayed pretty much the
[39:57]
same.
[39:57]
>> okay.
[39:57]
All right.
[39:59]
Anything else you need to put
[40:00]
into the record?
[40:01]
>> not at this time.
[40:02]
>> let me get you sworn in, sir,
[40:05]

[40:25]
it.
[40:26]
>> how much more time are you
[40:27]

[40:28]
>> until JANUARY.
[40:30]
>> I need until JANUARY, yes,

[40:41]

[40:45]

[40:47]
I just got a job -- I am three
[40:49]
months behind my own payment on
[40:49]

[40:52]
What else can I tell you?
[40:54]
That's exactly where I am at
[40:55]
right now.
[40:56]
>> if I have to give you proof
[40:58]

[40:59]

[41:00]

[41:02]

[41:06]

[41:07]

[41:08]
I am happy to --
[41:10]

[41:12]
>> I guess the process would be

[41:15]

[41:17]
>> it would have to be a

[41:20]
If we certify it -- yeah.
[41:30]
So we would continue it.
[41:30]
>> so I don't think we've -- I
[41:31]
don't think we've set the 2027
[41:33]

[41:35]
we'll make an educated guess
[41:38]
that it's going to be
[41:38]
wednesday's.
[41:39]
JANUARY 6 is the first wednesday
[41:39]

[41:41]
>> I would is an I the 13th.
[41:44]
>> JANUARY 13th is the second
[41:45]
wednesday of the month.
[41:48]
Why don't we set this for that.
[41:49]
That should be --
[41:50]
>> sounds good to me.
[41:52]
I appreciate it.
[41:53]
>> we'll just continue this
[41:54]
until JANUARY 13.
[41:56]
Hopefully by then you'll be done
[41:58]
and won't have to worry about
[41:58]
it?
[41:59]
>> all right.
[42:00]
That's it.

[42:45]
>> hello again, sir.
[42:48]
>> this case concerns the
[42:50]
property at 1731 southwest
[42:51]
lofgren avenue, port st. Lucie,
[42:52]
florida.
[42:53]
On JUNE 25, 2026, an inspection
[42:55]
was done and photos taken
[42:58]
showing the following
[42:58]
violations.
[43:01]
41.08e, exterior areas,
[43:02]
inoperative vehicle.
[43:03]
Exterior property areas
[43:05]
unmaintained structures.
[43:07]
41.09b, swimming pools, spas,
[43:09]
and hot tubs, unsecured pool.
[43:13]
The photos depict an accurate
[43:16]
representation of the time the
[43:17]
photos were taken.
[43:19]
The respondent had until JUNE
[43:22]
26, 2026 to bring the property
[43:22]
into compliance.
[43:23]
Compliance was not achieved and
[43:25]
a notice of hearing was
[43:28]
furnished by AUGUST 26, 2026 by
[43:28]
certified mail.
[43:31]
On AUGUST 21, 2026, proper
[43:33]
service was achieved by posting
[43:36]
the property with a notice of
[43:37]
hearing.
[43:38]
The city requests that the
[43:39]
respondents be ordered to comply
[43:42]
by SEPTEMBER 3, 2026, and if not
[43:44]
in compliance by that date, a
[43:45]
hearing be held to determine a
[43:47]
fine to be imposed against the
[43:48]
subject property.
[43:51]
In addition if the respondent
[43:53]
fail comply by SEPTEMBER 3,
[43:54]
2026, the city requests the
[43:55]
special magistrate authorize the
[43:59]
city pursuant to 162.085 florida
[44:00]
statute to enter upon the
[44:01]
property to bring the property
[44:02]
into compliance and specifically
[44:04]
to abate the unsecured pool by
[44:06]
securing it with a pool cover,
[44:07]
the cost of which will be
[44:11]
charged to the respondent at a
[44:13]
later hearing.
[44:13]
.
[44:15]
As you can see this is part of
[44:20]
the fence that is in disrepair.
[44:20]
.
[44:22]
>> that is one side holding up
[44:22]
the fence there.
[44:24]
The fence is tied up.
[44:28]
That is the only way it's pretty
[44:37]
much being fixed.
[44:38]
This is behind the neighboring
[44:41]
property and it was fixed and
[44:44]
was tied up, so it's not being
[44:44]
fixed.
[44:46]
That is the front of the
[44:49]
property.
[44:58]
Inoperative vehicle.
[45:00]
That is that inoperative
[45:00]
vehicle.
[45:01]
And that is tied together.
[45:07]
That is all I have, sir.
[45:08]
>> please raise your right hand.
[45:10]
Do you swear or affirm the
[45:11]
testimony you offer today is the
[45:15]
truth and nothing but the truth?
[45:16]
>> I do.
[45:19]
>> please state your name for
[45:19]
the record.
[45:20]
>> the floor is yours for
[45:23]
questions or to tell me about
[45:24]
the case.
[45:28]
>> as far as the fence, I have
[45:29]
contacted alligator fence
[45:30]
company to replace the fence.
[45:31]
I just need some time to get
[45:34]
that done, but I will replace
[45:35]
the entire fence.
[45:35]
>> okay.
[45:39]
>> as for the inoperative
[45:42]
vehicle, I have been trying to
[45:44]
get rid of that.
[45:46]
My wife has a bit of an
[45:47]
emotional connection with the
[45:49]
truck because it is our first
[45:49]
lexus.
[45:51]
All three of our children were
[45:53]
taken home from the hospital in
[45:53]
it --
[45:55]
>> I see.
[45:57]
>> and when her mom died last
[45:59]
year, that truck was in front of
[46:03]
her house.
[46:04]
Some drunk driver came up and
[46:05]
smashed the side of the truck.
[46:08]
It was operable for a little
[46:08]
bit, but because of the
[46:09]
collision and stuff, the
[46:11]
transmission has gone out.
[46:12]
We have had it sitting in front
[46:13]
of the house.
[46:15]
I have tried numerous times to
[46:17]
get my wife to take the
[46:18]
settlement and have them take
[46:18]
the car away.
[46:21]
And she's just having a really
[46:21]
hard time with that.
[46:24]
So it's been a lot of conflict,
[46:31]
so to speak.
[46:33]
I would have loved to have got
[46:35]
rid of the truck months ago, but
[46:36]
working with my wife to get that
[46:38]
taken care of.
[46:39]
Trying to convince her
[46:41]
especially with this hearing and
[46:45]
all that we need to get it done
[46:47]
despite her emotional
[46:48]
attachments to it.
[46:50]
But I'm just asking for a little
[46:51]
bit more time to take care of
[46:53]
the truck and convince my wife
[46:55]
to get rid of it.
[46:58]
>> yeah.
[47:00]
Honestly, the vehicle is not a
[47:01]
big concern of mine.
[47:03]
What is a big concern of mine is
[47:03]
the --
[47:06]
>> the unsecured swimming pool.
[47:07]
>> I do have a pool fence.
[47:09]
Would bit okay if I put the
[47:11]
little pool fence up around the
[47:12]
pool --
[47:18]
>> let me see, MR. Armstrong.
[47:19]
>> one that we got with the
[47:19]
pool.
[47:22]
>> if so, definitely put that
[47:22]
in.
[47:23]
Let us know.
[47:25]
You would still be required to
[47:26]
repair the fence for sure.
[47:27]
>> we're definitely looking to
[47:28]
do that.
[47:30]
>> would you be able to do that
[47:31]
today?
[47:33]
How soon can you get that gate
[47:34]
installed --
[47:36]
>> I can put the pool fence up
[47:37]
probably after I get off work
[47:38]
today.
[47:40]
>> that would be fantastic.
[47:44]
Because I am -- if you get the
[47:45]
pool secured, that satisfies my
[47:47]
sense of urgency.
[47:49]
I am happy to give you time to
[47:51]
get the fence done and the
[47:52]
vehicle done.
[47:55]
As long as the pool is secured
[47:55]
right away.
[47:57]
>> how long would you need for
[47:58]
the fence?
[48:00]
>> I would think a month.
[48:02]
I don't know what -- I've been
[48:05]
in touch with the -- basically
[48:08]
got an estimate on and I'm in
[48:08]
talks with it.
[48:11]
And I have to give the guy a
[48:11]
deposit.
[48:12]
I don't know what their time
[48:14]
frame to how soon they can do
[48:14]
it.
[48:16]
But I would think within the
[48:17]
next two months would be
[48:18]
reasonable.
[48:20]
>> and the same for the vehicle.
[48:22]
>> you could technically
[48:23]
register the vehicle if you
[48:27]
wanted to go that route, if --
[48:29]
it might cost you a lot less to
[48:33]
just put a tag on it and get it
[48:34]
registered than to, you know, go
[48:34]
that route.
[48:41]
So it's up to you, though.
[48:44]
>> I am trying to tell my wife
[48:47]
it's not helping us having it
[48:56]
there at all.
[48:59]
>> my thinking is this.
[49:03]
Again, because the pool is not
[49:05]
secured right now.
[49:07]
In terms of for the bifurcation,
[49:09]
can we -- is it easier to do
[49:19]
that, or is it easier for one?
[49:20]
If you can have it tonight, we
[49:22]
can inspect it tomorrow.
[49:25]
>> the pool?
[49:27]
>> yeah.
[49:29]
>> will you be available
[49:29]
tomorrow?
[49:31]
>> at the least, I can have the
[49:32]
fence open for them to inspect
[49:33]
it.
[49:35]
>> if I have the fence up and
[49:35]
ready.
[49:36]
The poo fence.
[49:40]
>> yeah, I would prefer that.
[49:42]
Just so we can see it.
[49:43]
>> the neighbor in the back, and
[49:45]
le let me in the back.
[49:47]
I can see it from there if
[49:47]
possible.
[49:48]
And he's just concerned because
[49:50]
he has two kids that run around
[49:51]
the house.
[49:53]
That is why he wants to get this
[49:54]
taken care of as soon as
[49:54]
possible.
[49:58]
>> what if we retain the 24-hour
[50:01]
for the secured pool.
[50:02]
We can inspect tomorrow and make
[50:03]
sure the pool is secure.
[50:08]
We can do 30 days on -- at least
[50:09]
to obtain a permit with the
[50:09]
fence.
[50:11]
>> if I do contract with them,
[50:12]
they will be dealing with the
[50:13]
permit.
[50:15]
>> they will deal with that.
[50:17]
>> whatever company you hired.
[50:19]
If you produce some type of here
[50:21]
is my invoice and I pay them a
[50:21]
deposit or something.
[50:24]
We can use that to push the
[50:27]
fence off -- while the fence is
[50:29]
the concern, but the pool is the
[50:30]
number one concern.
[50:32]
if you can secure that in 24
[50:34]
hours, that would be ideal.
[50:35]
We will work offline with them.
[50:37]
And I think realistically, let's
[50:39]
say a30-day compliance for the
[50:42]
fence and the inoperable
[50:46]
vehicle, and that is just to
[50:50]
obtain a company or at least
[50:52]
some sort of communication.
[50:53]
>> it might take three months to
[50:54]
install the fence, but if you
[50:56]
have that, we're not going to
[50:58]
move anything forward.
[50:59]
The pool is the top concern.
[51:00]
>> you understand what the city
[51:01]
is suggesting?
[51:02]
>> yes.
[51:03]
>> sound like you are in
[51:04]
agreement with that as well.
[51:06]
>> yes, secure the pool and the
[51:08]
fence will get the ball rolling
[51:08]
on that.
[51:09]
Yes, sir.
[51:10]
>> is there anything else that
[51:13]
you would like to tell me, MR.
[51:13]
Nelson?
[51:15]
>> awe no, sir.
[51:19]
Thank you for your time.
[51:21]
>> anything else from the city?
[51:22]
>> no, sir.
[51:25]
>> find proper notice.
[51:27]
The property remains in
[51:28]
violation as cited.
[51:32]
Do we need an abatement order on
[51:33]
this?
[51:34]
>> again, just for the sake of
[51:36]
if there is no communication and
[51:40]
nothing is done, I think we
[51:41]
would prefer
[51:43]
>> this is typically what I do
[51:46]
and a belt and suspender
[51:51]
approach because I have no
[51:51]
reason not to believe this is
[51:53]
going to be secured, but I am
[51:56]
going to make a finding that the
[51:57]
unsecured swimming pool
[51:59]
constitutes a threat to the
[52:01]
public health, safety and
[52:02]
welfare, so SEPTEMBER 3 as the
[52:05]
compliance date to have the pool
[52:05]
secured.
[52:07]
If that is not achieved, I am
[52:09]
authorizing the city to enter
[52:10]
the property, abate that
[52:11]
violation and assess those
[52:13]
costs, which means if it is not
[52:14]
secured -- if you don't do it
[52:20]
within the next 24 hours, the
[52:21]
city has the legal authority to
[52:23]
enter the property and secure it
[52:24]
themselves and typically that is
[52:27]
a cover that goes over the pool
[52:29]
and they will bill you for that.
[52:31]
So you don't want that to
[52:34]
happen, so get that pool barrier
[52:35]
up.
[52:36]
And for the rest, 30 days to get
[52:41]
the inoperative vehicle complied
[52:47]
and get a contractor online, on
[52:50]
board to do the fence.
[52:52]
The fence doesn't have to be
[52:57]
done by then, but we want to see
[52:57]
a contractor.
[52:58]
The contractor order.
[52:59]
Thank you for being here.
[53:01]

[54:53]
property areas, unmaintained
[54:59]
swale liner.
[55:01]
The photos depict an accurate
[55:03]
representation of the photos at
[55:08]
the time they were taken.
[55:09]
The respondent had until MARCH
[55:11]
16, 2026 to bring the property
[55:11]
into compliance.
[55:15]
And so a notice of hearing was
[55:18]
furnished on JULY 3, 2026 by
[55:19]
certified mail.
[55:22]
On JULY 31, 2026, proper service
[55:24]
was achieved by certified mail,
[55:25]
return receipt received.
[55:27]
The city requests the
[55:28]
respondents lorraine sullivan
[55:31]
and gerald desmarais be ordered
[55:34]
to comply with the cited
[55:35]
provisions of the city of port
[55:37]
st. Lucie code by SEPTEMBER 9,
[55:38]
2026, and if not in compliance
[55:41]
by that date, then a hearing be
[55:43]
held to determine a fine to be
[55:45]
imposed against the subject
[55:46]
property.
[55:52]
So this is the original door
[55:52]
hanger.
[55:56]
And this was last week.
[56:05]
This is the open storage, the
[56:08]
generator and more buckets.
[56:12]
This is part of the property,
[56:13]
maintenance, mildew and blight
[56:14]
on the side of the house.
[56:16]
And more across the gutters on
[56:19]
the front and the sides of the
[56:19]
home.
[56:23]
Up here.
[56:24]
Here is another picture of the
[56:31]
open storage, gas cans, filters,
[56:31]
buckets.
[56:32]
Chipped paint.
[56:41]
And more mildew right here.
[56:46]
This jeep has an expired tag of
[56:50]
JUNE 2026 and the same with this
[56:52]
vehicle here, an expired tag of
[56:56]
APRIL 2026.
[56:59]
this is the cracked driveway and
[57:04]
with it down, it creates a
[57:05]
hazard.
[57:09]
This is the unmaintained swale
[57:11]
line we are the dirt and debris
[57:15]
that needs to be cleaned out.
[57:18]
And we had public works check
[57:19]
the culvert pipe.
[57:20]
There are no issues with that.
[57:22]
So when it comes to the repair,
[57:24]
it is the driveway repair closer
[57:27]
to the house and then the track
[57:29]
there and then all the debris
[57:31]
into the swale liners that need
[57:42]
to be cleaned out.
[57:44]
>> does the driveway, is that
[57:46]
something that can just get
[57:48]
fixed?
[57:52]
Is that a permit situation?
[57:55]
>> this portion up here, I
[57:56]
believe you don't need a permit
[57:57]
to do that.
[58:00]
>> doesn't look like there's
[58:03]
anything in this case that would
[58:06]
require a building departments
[58:07]
permit or anything like that.
[58:09]
>> anything else you need to put
[58:10]
into the record at this time?
[58:14]
>> not at this time, no.
[58:16]
>> good morning, man.
[58:19]
>> do you swear or affirm the
[58:20]
testimony you offer today is the
[58:21]
truth and nothing but the truth?
[58:23]
>> absolutely, yes.
[58:24]
>> please state your name for
[58:26]
the record.
[58:28]
>> lorraine sullivan.
[58:29]
>> the floor is yours for
[58:31]
questions or tell me about what
[58:31]
is going on.
[58:32]
>> sure.
[58:33]
I have a lot to say.
[58:34]
>> okay.
[58:36]
>> and bear with me because I
[58:37]
only have one eye here.
[58:39]
>> if I can get you as close to
[58:40]
the microphone, that will help
[58:41]
me hear you.
[58:43]
>> I'm sorry.
[58:46]
>> you're good.
[58:51]
>> so I guess as far as the
[58:57]
start, the swale, I did pay my
[58:59]
landscaper $50 right after -- he
[59:00]
works for the city as well.
[59:04]
>> so that can be proved.
[59:07]
And he took the sand back and
[59:09]
dumped it into the backyard.
[59:10]
>> that's been cleaned out?
[59:12]
>> well, and then I had -- I
[59:14]
have pictures.
[59:16]
At&t fiber optic came along and
[59:18]
tore up my whole front yard if
[59:22]
you want to see the pictures.
[59:24]
And actually broke my sewer main
[59:25]
line.
[59:26]
You can see where the swales
[59:30]
were cleaned, and I told them
[59:32]
make sure you clean them because
[59:33]
I just paid to have them done.
[59:36]
What appears to be happening, I
[59:37]
inspected my whole front yard,
[59:40]
there is a lot of sand in it.
[59:42]
>> like loose -- I'm not a
[59:43]
floridian, but you know what I'm
[59:45]
talking about throughout the
[59:47]
yard.
[59:51]
It is sliding down.
[59:52]
I did clean and it pulled out
[59:53]
some last night.
[59:57]
I am -- so that's the situation
[59:57]
with that.
[1:00:01]
My landscaper, I will -- he will
[1:00:01]
be continuing to help me with
[1:00:07]
that.
[1:00:10]
>> the neighbor has a cracked
[1:00:12]
liner and that is affecting a
[1:00:13]
little bit of it.
[1:00:15]
So I have asked them to fix
[1:00:15]
that.
[1:00:22]
And it's not fixed yet.
[1:00:25]
>> I am on that.
[1:00:26]
I can't control mother nature --
[1:00:29]
the wall looked like a great
[1:00:31]
idea, but now I know that is not
[1:00:32]
on the other house.
[1:00:40]
As far as the attic, that is not
[1:00:42]
wood rot and I have been paying
[1:00:45]
$100 a month for a painter
[1:00:47]
coming DECEMBER.
[1:00:52]
Jackie mentales contracted.
[1:00:53]
we have to make payments --
[1:00:55]
>> what is going to get painted?
[1:00:56]
>> the whole house.
[1:00:57]
>> that is in DECEMBER?
[1:00:58]
>> yes.
[1:00:59]
>> we have been making payments
[1:01:01]
because we can't afford it up
[1:01:02]
front.
[1:01:03]
>> okay.
[1:01:04]
>> as far as the car, they're
[1:01:10]
both legal and running.
[1:01:11]
>> I have proof of that --
[1:01:12]
>> are the registrations up to
[1:01:14]
date now?
[1:01:15]
>> absolutely, 100%.
[1:01:19]
>> if I forgot to put the jeep
[1:01:21]
sticker on, I swore I did.
[1:01:23]
But I will get to why I might
[1:01:24]
have forgotten.
[1:01:25]
>> okay.
[1:01:27]
>> I will tell you, usually when
[1:01:31]
I see these kind of expired
[1:01:32]
registration, they are years
[1:01:33]
old.
[1:01:34]
Admittedly t one was JUNE and
[1:01:36]
one was APRIL of this year, so
[1:01:37]
they were --
[1:01:39]
>> both of these cars are fully
[1:01:41]
insured and fully registered.
[1:01:42]
>> okay.
[1:01:45]
>> and have been to D.M.V.
[1:01:48]
Probably five times in the past
[1:01:50]
couple of months because of my
[1:01:50]
eye.
[1:01:54]
I had to be issued a permit and
[1:01:58]
had to pass a test, so they're
[1:01:58]
completely legal.
[1:02:00]
>> okay.
[1:02:06]
>> so then on to the generator,
[1:02:07]
everything in front of the house
[1:02:08]
is moved.
[1:02:11]
The generator, it's been on
[1:02:13]
record it caused gas and almost
[1:02:17]
fire in my garage.
[1:02:18]
We're waiting to -- it's gone
[1:02:22]
off the driveway and gone off
[1:02:22]
the residence.
[1:02:24]
It was a fire hazard.
[1:02:26]
And the fire department a year
[1:02:29]
ago confirmed that.
[1:02:32]
as far as the side of the house,
[1:02:33]
the mildew --
[1:02:34]
>> yeah.
[1:02:36]
>> I tried to hand scrub it and
[1:02:37]
with my hose, which is all still
[1:02:39]
sitting out there if you want to
[1:02:40]
go look.
[1:02:43]
I did order something called 30
[1:02:43]
cleaner.
[1:02:49]
That is the best I can do.
[1:02:51]
My painter said the best thing
[1:02:53]
would be the power wash and then
[1:02:56]
the painting, but I have been
[1:02:58]
out there in the heat.
[1:03:00]
>> when the painters come in
[1:03:02]
DECEMBER, that should get taken
[1:03:03]
care of --
[1:03:04]
>> I wanted to let you know I
[1:03:06]
was out there and my neighbor
[1:03:08]
saw he scrubbing.
[1:03:09]
What are you doing?
[1:03:12]
With the strub.
[1:03:21]
So the cars, my pool cage is a
[1:03:23]
peck which you are that was
[1:03:24]
taken that is zoomed in and is
[1:03:26]
not mildew.
[1:03:28]
The bottom of the pool cage had
[1:03:32]
a film on it from the ultra
[1:03:33]
sunlight and is faded out.
[1:03:35]
Do you know what I am saying?
[1:03:36]
>> I know exactly what you are
[1:03:37]
talking about.
[1:03:39]
>> it looks darker, but it is
[1:03:40]
pure screen now.
[1:03:41]
It is see through.
[1:03:42]
It doesn't have that -- and that
[1:03:44]
is many screens that happens to.
[1:03:48]
It is not dirty whatsoever.
[1:03:52]
So my pool is maintained by
[1:03:56]
puddle pool.
[1:03:59]
And it is
[1:04:01]
immaculate.
[1:04:03]
We recently did the pool
[1:04:05]
mechanics filter area might look
[1:04:08]
on a certain day a little messy.
[1:04:14]
We did have to replace every
[1:04:14]
single park because we were
[1:04:16]
afraid we had a leak
[1:04:16]
underground.
[1:04:19]
Puddle pool helped us with that
[1:04:21]
to replace the main cage, the
[1:04:22]
pump, and we don't have an
[1:04:23]
underground leak.
[1:04:26]
>> that is good news, yeahs.
[1:04:29]
There is -- it's perfectly clean
[1:04:33]
over there right now.
[1:04:35]
>> now, I was here in FEBRUARY
[1:04:37]
speaking to someone explaining
[1:04:38]
my situation.
[1:04:43]
And then obviously we know that
[1:04:45]
-- and we all deal with it and I
[1:04:50]
have the utmost respect for all
[1:04:57]
of you, your honor.
[1:04:58]
The heat, I have a heart
[1:05:01]
condition, I have a widow maker.
[1:05:02]
Ic not be out this -- I cannot
[1:05:04]
be out in the heat this week.
[1:05:06]
I have been this week, and I am
[1:05:07]
paying the price.
[1:05:08]
Since FEBRUARY, it has been a
[1:05:09]
while, yes.
[1:05:12]
I have had three eye surge ris.
[1:05:15]
I can give you all this
[1:05:16]
documentation with each eye
[1:05:22]
surgery at baskin palmer
[1:05:24]
institute and from organ donors
[1:05:26]
and strict instructions not to
[1:05:29]
bend or be in the glare.
[1:05:32]
And this is quite a financial
[1:05:34]
burden to save my eyesight.
[1:05:35]
>> I have no reason to not take
[1:05:36]
your word for that.
[1:05:38]
I don't want to take the -- I
[1:05:41]
don't want to make those public
[1:05:42]
record.
[1:05:43]
>> I didn't want you to think I
[1:05:44]
was being lazy.
[1:05:46]
>> I understand.
[1:05:47]
>> when brandon did first come
[1:05:52]
out, or second, whatever, I was
[1:05:53]
in the bedroom and the windows
[1:05:55]
are close to the driveway.
[1:05:57]
I saw on my camera someone I
[1:05:59]
didn't recognize and I panicked.
[1:06:01]
I have been in a situation where
[1:06:03]
that would make me panic in my
[1:06:03]
past.
[1:06:05]
I told my husband to go outside.
[1:06:06]
My husband did -- we have
[1:06:08]
cameras all over our house.
[1:06:12]
so some of these pictures were
[1:06:15]
taken on our property.
[1:06:17]
My husband did get loud with
[1:06:18]
brandon and for that he did go
[1:06:21]
back and apologize.
[1:06:23]
I don't condone that, but the
[1:06:25]
way the whole situation inside
[1:06:29]
the house went, there's a before
[1:06:33]
-- it was wrong, but I had fired
[1:06:34]
him up.
[1:06:36]
He does feel like we have been a
[1:06:37]
little bit targeted.
[1:06:38]
And I am just saying that
[1:06:43]
because it's my right to because
[1:06:46]
I have walked the neighborhood.
[1:06:49]
And adjoining, two side streets
[1:06:52]
and another street and I have 78
[1:06:56]
houses here, over 200 pictures
[1:06:58]
of violations worse than mine
[1:06:58]
and atrocious.
[1:07:00]
All colored pictures.
[1:07:02]
Pand right next door to me two
[1:07:07]
houses down, five houses down,
[1:07:11]
so when on my cameras I see code
[1:07:12]
enforcement drive by my house
[1:07:13]
and -- you know what I'm saying?
[1:07:14]
I am not trying to complain.
[1:07:16]
>> I understand what you are
[1:07:16]
saying.
[1:07:18]
>> it just feeling -- this is
[1:07:20]
all legitimate time stamped
[1:07:20]
pictures.
[1:07:23]
>> I get it.
[1:07:27]
My response to you on that topic
[1:07:29]
would be that -- and I sit up
[1:07:30]
here at least twice a month,
[1:07:37]
sometimes three times a month.
[1:07:40]
With -- typical agenda has 50
[1:07:41]
cases on it.
[1:07:43]
And usually none of them are
[1:07:43]
you.
[1:07:47]
So my point is, the code
[1:07:50]
enforcement is out there -- it
[1:07:52]
is entirely likely that the
[1:07:54]
cases -- the violations that
[1:07:56]
you're seeing in photographing
[1:08:00]
and MAY have case numbers and I
[1:08:02]
have them in the pipeline.
[1:08:05]
>> a few MAY, yes, and some of
[1:08:07]
these people have told me they
[1:08:09]
would be witnesses.
[1:08:10]
They haven't.
[1:08:11]
And because they feel bad.
[1:08:13]
They know I try hard.
[1:08:18]
They see me in the yard
[1:08:19]
struggling.
[1:08:19]
>>
[1:08:20]
>> I can tell you care.
[1:08:24]
>> I am trying my best.
[1:08:26]
Mu help is not with me on that,
[1:08:28]
but I am trying.
[1:08:31]
>> as far as the driveway, yes,
[1:08:32]
it is cracked.
[1:08:35]
It is not -- it's obviously a
[1:08:35]
violation.
[1:08:36]
>> do you think you could have
[1:08:38]
that taken care of by the time
[1:08:39]
the house gets painted?
[1:08:42]
>> I am saying definitely --
[1:08:45]
that's a lot because I am on
[1:08:46]
ssd.
[1:08:49]
So I have a fixed income.
[1:08:50]
So that's why we have had -- and
[1:08:53]
I can't just go to a credit card
[1:08:56]
and -- you know what I am
[1:08:58]
saying?
[1:09:02]
My husband's paycheck goes
[1:09:04]
directly to pay the bills.
[1:09:08]
I worked all my life and got
[1:09:09]
injured.
[1:09:11]
I have a government -- you know
[1:09:12]
what I'm say.
[1:09:14]
Finances -- we are constantly
[1:09:15]
fixing something, but it's
[1:09:24]
always one thing at a time.
[1:09:26]
Awe one of the guys might drive
[1:09:29]
by and see a big mess, but it's
[1:09:31]
a work in progress, so it's hard
[1:09:32]
on both sides.
[1:09:35]
There is a project and they are
[1:09:38]
seeing a mess and all this --
[1:09:39]
>> the joyce of home ownership
[1:09:41]
-- the joys of home ownership,
[1:09:42]
right?
[1:09:42]
I understand.
[1:09:43]
>> we're trying.
[1:09:45]
>> does the city have any
[1:09:47]
objection to setting a late
[1:09:48]
DECEMBER compliance date for all
[1:09:49]
this stuff?
[1:09:51]
>> no, we don't.
[1:09:53]
>> that is what I am inclined to
[1:09:55]
do.
[1:09:57]
Kind of put this in sync with
[1:09:58]
what you are paying the schedule
[1:10:05]
is.
[1:10:06]
>> I understand.
[1:10:08]
I am going to ask you to do your
[1:10:11]
best on that.
[1:10:13]
And make your best effort.
[1:10:16]
And I will ask you if it's
[1:10:18]
getting to early DECEMBER and
[1:10:19]
looks like you're not going to
[1:10:23]
hit the target on the driveway,
[1:10:26]
stay in touch with the city,
[1:10:29]
explain the circumstances and
[1:10:32]
ask for the opportunity to get
[1:10:34]
more time on that.
[1:10:36]
I am thinking I will set the
[1:10:38]
compliance date in conjunction
[1:10:44]
with the painting and then we'll
[1:10:45]
be cautiously optimistic and see
[1:10:47]
where you are at the end of the
[1:10:47]
year.
[1:10:49]
>> I don't know if we can do it
[1:10:53]
ourselves or even had a
[1:10:53]
professional.
[1:10:56]
>> I am pretty sure I can't do
[1:10:59]
that myself.
[1:11:02]
>> listen, I appreciate
[1:11:05]
everything you explained.
[1:11:09]
>> I can tell when somebody is
[1:11:09]
trying.
[1:11:17]
Happy to give you that time.
[1:11:19]
So I will give you that time.
[1:11:23]
>> don't come on the property
[1:11:24]
unless an emergency to avoid
[1:11:26]
seeing a different face in the
[1:11:27]
camera.
[1:11:28]
I have had an incident where I
[1:11:29]
have been broken in on and that
[1:11:32]
is why I moved to florida.
[1:11:39]
I understand emergency,
[1:11:39]
obviously.
[1:11:40]
It's just a little scary.
[1:11:44]
>> everybody is here and heard
[1:11:45]
what you said.
[1:11:47]
>> the property has been flagged
[1:11:49]
so all communication wills take
[1:11:50]
place via mail.
[1:11:50]
>> thank you.
[1:11:51]
That is wonderful.
[1:11:52]
>> thank you so much.
[1:11:53]
>> anything else the city needs
[1:11:54]
to put into the record?
[1:11:56]
>> in this case I will find
[1:11:57]
proper notice.
[1:12:01]
Based on the testimony and the
[1:12:03]
evidence t property remains in
[1:12:03]
violation.
[1:12:06]
I will set DECEMBER 16, 2026, as
[1:12:09]
the compliance date.
[1:12:10]
If this needs to be brought back
[1:12:11]
for any reason, the city can
[1:12:14]
notice it and bring it back as
[1:12:15]
needed.
[1:12:16]
Like I said, stay in touch with
[1:12:17]
them.
[1:12:18]
And if you feel like you're
[1:12:20]
going to need more time as we
[1:12:21]
get close to the end of the year
[1:12:22]
--
[1:12:22]
>> absolutely.
[1:12:27]
It will be cooler then.
[1:12:29]
>> do you want me to show
[1:12:30]
pictures from this morning?
[1:12:31]
>> I don't need them.
[1:12:37]
I get what is going on.
[1:12:40]
And again, set the compliance
[1:12:41]
date for DECEMBER 16 at the end
[1:12:42]
of the year.
[1:13:27]
>> good luck, ma'am.
[1:13:28]
>> good morning.
[1:13:32]
>> give me one second, I'm
[1:13:32]
sorry.
[1:13:52]
>> okay..
[1:13:55]
>> officer wise, previously
[1:13:56]
sworn.
[1:13:57]
>> this case concerns the
[1:14:00]
property at 3101 southeast
[1:14:01]
morningside boulevard, port st.
[1:14:02]
Lucie, florida.
[1:14:04]
A violation hearing was held on
[1:14:05]
JULY 1, 2026.
[1:14:06]
Based on the evidence presented
[1:14:10]
on that date, the special
[1:14:11]
magistrate found the violations
[1:14:12]
existed and ordered compliance
[1:14:16]
to be achieved by JULY 8, 2026
[1:14:18]
for the following violations.
[1:14:23]
section 4158.211, storage or
[1:14:24]
accumulation of material,
[1:14:27]
refuse, and waste materials
[1:14:28]
prohibited.
[1:14:31]
Section 41.10, subsection b,
[1:14:33]
exterior structure, exterior
[1:14:37]
structure in need of
[1:14:37]
maintenance.
[1:14:38]
Per neighborhood service
[1:14:38]
department records, compliance
[1:14:41]
was not I a chooefed by JULY 8,
[1:14:43]
2026 -- not achieved by JULY 8,
[1:14:44]
2026.
[1:14:45]
Neighborhood services maintains
[1:14:46]
a copy of the entire case file
[1:14:48]
as public record.
[1:14:51]
The photos taken truly and
[1:14:51]
accurately represent the scene
[1:14:53]
as it appeared on the dates of
[1:14:54]
the inspections.
[1:14:56]
Due to the respondent's failure
[1:14:58]
to comply with the deadline set
[1:14:59]
forth at the violation hearing,
[1:15:01]
the city requests that the
[1:15:03]
special magistrate impose a fine
[1:15:05]
and order the respondent to pay
[1:15:07]
a fine in the amount of $50 per
[1:15:09]
day up to a maximum of $50,000.
[1:15:11]
Finally t city requests the
[1:15:14]
respondents be ordered to pay an
[1:15:15]
administrative cost in the
[1:15:16]
amount of $411, representing
[1:15:17]
reasonable cost of the
[1:15:20]
investigation and prosecution of
[1:15:23]
the case.
[1:15:27]
So this was the original door
[1:15:30]
hanger back in APRIL.
[1:15:34]
The posting from AUGUST 21.
[1:15:36]
And then last week on the 27th,
[1:15:40]
the open storage in the bed of
[1:15:43]
the truck.
[1:15:45]
All this on the outside as well
[1:15:54]
as here on the inside.
[1:15:56]
This is a top for a hot tub, I
[1:15:58]
believe, put over to the side
[1:16:02]
and miscellaneous items.
[1:16:06]
And the exterior maintenance is
[1:16:08]
this along the roof line and the
[1:16:12]
chipped paint.
[1:16:16]
See it again there.
[1:16:18]
here is a foe foe from the front
[1:16:24]
of the house.
[1:16:26]
Those are all the photos I have
[1:16:26]
now.
[1:16:27]
>> has there been any change in
[1:16:28]
the situation since the
[1:16:30]
violation hearing in JULY?
[1:16:33]
>> there has.
[1:16:38]
So the exterior maintenance
[1:16:39]
along with the stuff up top down
[1:16:41]
here along the bottom was also
[1:16:43]
chipped up, but that portion has
[1:16:44]
been painted and repaireded.
[1:16:47]
The only remaining is along the
[1:16:47]
roof line.
[1:16:48]
>> very good.
[1:16:49]
All right.
[1:16:50]
Anything else you need to put
[1:16:51]
into the record?
[1:16:52]
>> no, sir.
[1:16:53]
>> okay.
[1:16:56]
Let me get you sworn in, ma'am,
[1:16:58]
and I'll be happy to hear from
[1:16:59]
you.
[1:17:00]
>> please raise your right hand.
[1:17:01]
Do you swear the testimony you
[1:17:02]
offer today is the truth and
[1:17:03]
nothing but the stroout?
[1:17:05]
>> kelly dakis.
[1:17:07]
>> the floor is your.
[1:17:09]
>> not to tell you my life's
[1:17:11]
story but I have been in and out
[1:17:12]
of lake worth, deerfield area.
[1:17:17]
I got married and in the process
[1:17:20]
of a divorce, since the APRIL
[1:17:22]
photos, back story on why I have
[1:17:25]
accumulation is a., I am the
[1:17:26]
busiest person you met.
[1:17:27]
I work 120 hours a week and I am
[1:17:28]
a chef.
[1:17:30]
I closed my restaurant on the
[1:17:32]
boulevard and brought everything
[1:17:34]
back to my house.
[1:17:35]
Since then I am a single mom
[1:17:36]
struggle life.
[1:17:37]
There is no excuse.
[1:17:42]
I am getting my stuff together.
[1:17:43]
I have had violations for a
[1:17:47]
little while, so I understand
[1:17:49]
what's going on here.
[1:17:50]
focus on the problem, the
[1:17:52]
problem increases, so I am
[1:17:54]
focussing on the solution.
[1:17:55]
The solution is I have removed
[1:17:56]
some of the things.
[1:17:57]
Actually, this morning I was a
[1:18:00]
minute and a half late for court
[1:18:01]
to wash my hands coming in
[1:18:03]
because I did remove some of the
[1:18:03]
accumulation.
[1:18:04]
I have photos to prove that.
[1:18:05]
As you can see t house was
[1:18:06]
yellow t a one point.
[1:18:09]
Now it's blue.
[1:18:11]
In this 100 degree weather, I
[1:18:13]
have been in and out of painting
[1:18:14]
the house myself.
[1:18:17]
And so that's what brandon was
[1:18:19]
mentioning about the bottom
[1:18:21]
chipped paint.
[1:18:22]
Since then, I was a victim of
[1:18:24]
the tornado and I didn't even
[1:18:24]
know.
[1:18:26]
>> that tornado from a week ago?
[1:18:27]
>> that just happened like a
[1:18:28]
week ago.
[1:18:30]
>> and the reason I didn't know
[1:18:31]
is because primarily my work is
[1:18:32]
down south.
[1:18:35]
I am not saying I'm -- I am
[1:18:37]
renting down there because it is
[1:18:38]
easier to not travel every
[1:18:38]
single day.
[1:18:43]
I still do reside at that
[1:18:43]
location.
[1:18:45]
And in the legal way I need to
[1:18:45]
and whatnot.
[1:18:47]
My mail goes there, everything.
[1:18:50]
I visit every once in a while,
[1:18:53]
but the accumulation of the door
[1:18:55]
hangers, I don't go through that
[1:18:55]
door.
[1:18:57]
I go through the car port.
[1:18:58]
The table I was told back in the
[1:19:00]
day that the table I was told
[1:19:02]
could stay there, but I will
[1:19:04]
remove it within the next -- I
[1:19:05]
don't know.
[1:19:06]
I just can't physically do it
[1:19:09]
myself only because it's a big
[1:19:09]
table.
[1:19:11]
But everything else I am working
[1:19:11]
on.
[1:19:14]
That hot tub, the top blew off.
[1:19:16]
I think when one of our storms
[1:19:18]
in the last coup of weeks.
[1:19:21]
So I will take care of that.
[1:19:22]
And I am asking for a
[1:19:23]
continuance or whatever you can
[1:19:24]
give to me.
[1:19:26]
A., I will continue to paint the
[1:19:27]
house the way it need to be
[1:19:27]
done.
[1:19:31]
But the reason I know about the
[1:19:34]
roof is my pest control lady --
[1:19:35]
I have pictures of the tornado
[1:19:36]
damage as well.
[1:19:38]
The pest control lady said your
[1:19:40]
house is messed up.
[1:19:41]
Yeah, girl, I know.
[1:19:43]
I am in the process of the
[1:19:43]
remodelling.
[1:19:44]
I know it is crazy in there
[1:19:46]
because I am getting ready to
[1:19:48]
sell the home.
[1:19:49]
I wasn't sure because of the
[1:19:51]
divorce, I didn't want to do
[1:19:53]
anything legally until I seeked
[1:19:54]
counsel.
[1:19:57]
So without telling you my life
[1:19:58]
story, where we're at today, I
[1:19:59]
will continue to paint the
[1:20:00]
house.
[1:20:04]
It is yellow and green and blue
[1:20:05]
and all sorts of crazy.
[1:20:08]
I did take the shutters down
[1:20:09]
that were visibly an eyesore.
[1:20:11]
And I did change the numbers
[1:20:15]
which one of them was broken.
[1:20:16]
I fixed the blinds.
[1:20:19]
I need to weed the pineapples
[1:20:21]
and put the mulch down and the
[1:20:22]
car port area.
[1:20:24]
I will work as hard and fast as
[1:20:25]
I can.
[1:20:27]
It's just been life on life's
[1:20:27]
term.
[1:20:29]
There is no excuse expect I am
[1:20:32]
asking for more time.
[1:20:36]
I did remove that debris or
[1:20:41]
whatever with the things we are
[1:20:42]
going through.
[1:20:43]
Step one was to see you guy.
[1:20:46]
I didn't know I had all these
[1:20:50]
accumulations of the letters.
[1:20:51]
I didn't go into the front door.
[1:20:54]
Step one was to see you and step
[1:20:56]
two is to make the phone call to
[1:20:57]
the insurance for the roof.
[1:20:59]
I will need a new roof.
[1:21:00]
There is obviously significant
[1:21:03]
damage if I can, I will show you
[1:21:05]
the photos of the tornado
[1:21:05]
damage.
[1:21:12]
And you can probably see it
[1:21:12]
there.
[1:21:14]
I know I need to clean up the
[1:21:16]
property faster than I have
[1:21:16]
been.
[1:21:17]
And that is all I got for you.
[1:21:19]
I will work on it and continue
[1:21:19]
to work on it.
[1:21:21]
Now there is a significant
[1:21:24]
burden with the tornado damage
[1:21:33]
on the roof.
[1:21:34]
I will be able to take as much
[1:21:37]
time as I clean up the rest of
[1:21:53]
the outside parameters.
[1:22:21]
I am not sure if that be the
[1:22:23]
>> the table itself, you can't
[1:22:25]
move the table itself.
[1:22:26]
That can stay.
[1:22:26]
But everything needs --
[1:22:28]
>> everything is off the top.
[1:22:30]
>> and then remove the things
[1:22:31]
that are under --
[1:22:33]
>> like produce crates that are
[1:22:34]
underneath.
[1:22:35]
>> move those out today.
[1:22:36]
>> if the table is empty, you
[1:22:37]
are fine.
[1:22:40]
>> it is bulk pick up day, so I
[1:22:40]
pulled everything up front and
[1:22:42]
try and get that punching bag up
[1:22:44]
front as well.
[1:22:45]
>> do you think you can get this
[1:22:46]
code enforcement stuff done
[1:22:47]
within the next 30 days?
[1:22:50]
That is not the roof.
[1:22:55]
That's just the -- just to be
[1:22:58]
clear, if I just paint -- puff
[1:23:00]
is it okay my house is two
[1:23:04]
color, four colors, whatever it
[1:23:04]
looks loik
[1:23:05]
looks like?
[1:23:07]
>> we don't enforce colors.
[1:23:09]
>> whatever I can do to comply.
[1:23:11]
>> and so the open storage, how
[1:23:12]
long for everything --
[1:23:14]
>> can I show you what I did
[1:23:15]
this morning?
[1:23:21]
>> we can inspect -- let's say
[1:23:22]
some of it still remains.
[1:23:24]
Let's say how long to remove?
[1:23:26]
>> if you tell me what I can
[1:23:28]
really remove, I can tell you
[1:23:28]
today.
[1:23:30]
>> we can meet you at the
[1:23:30]
property.
[1:23:32]
>> can I show you this real
[1:23:34]
quick?
[1:23:35]
>> sure.
[1:23:36]
>> that is what's left this
[1:23:36]
morning.
[1:23:40]
And sweep it and make it better.
[1:23:43]
>> and get rid of the table
[1:23:43]
stuff.
[1:23:49]
>> I will try and call somebody.
[1:23:51]
>> lawn mower there.
[1:23:53]
>> and those, that is this
[1:24:05]
morning.
[1:24:07]
I know there might be plants and
[1:24:11]
stuff and all wild and crazy.
[1:24:12]
>> how about this?
[1:24:14]
>> we can work offline and have
[1:24:15]
officer wise meet you at the
[1:24:16]
property, tell you exactly what
[1:24:20]
needs to be removed.
[1:24:22]
And then so if we grant the
[1:24:25]
continuance for 30 days, would
[1:24:27]
that be sufficient to get this
[1:24:28]
--
[1:24:29]
>> I'll go buy a paint brush
[1:24:31]
right now.
[1:24:31]
>> perfect.
[1:24:34]
The city is not opposed to a
[1:24:36]
30-day continuance on this and
[1:24:37]
prefer not to certify the fine
[1:24:39]
if we don't have to.
[1:24:42]
And we can work with brandon and
[1:24:43]
when you can meet at the
[1:24:45]
property whether it's today,
[1:24:46]
tomorrow, or whatever is
[1:24:46]
convenient.
[1:24:48]
And go through all those items
[1:24:49]
that need to be removed.
[1:24:51]
Once you remove them, let him
[1:24:53]
know, we inspect, and get the
[1:24:53]
case closeed.
[1:24:55]
>> great.
[1:24:59]
>> can I make sure you have my
[1:25:00]
number?
[1:25:05]
>> I will get that after.
[1:25:05]
>>
[1:25:07]
>> OCTOBER 14 agenda.
[1:25:10]
>> I don't expect this to come
[1:25:13]
back.
[1:25:14]
>> yeah.
[1:25:16]
>> to be clear, paint, remove
[1:25:18]
everything, and I don't have to
[1:25:19]
come back on OCTOBER 7 or 14.
[1:25:23]
>> correct.
[1:25:23]
And no fine is assessed.
[1:25:23]
If we have to come back, there
[1:25:24]
will be fine.
[1:25:26]
>> I'll get it together.
[1:25:26]
Okay.
[1:25:27]
>> thank you very much.
[1:25:29]
>> thank you.
[1:25:31]
>> I will find proper notice.
[1:25:32]
The property remains in
[1:25:35]
violation -- actually, we're
[1:25:37]
just, sorry, going to continue
[1:25:42]
the hearing completely so no
[1:25:45]
findings, no order other than
[1:25:46]
continuing this to the OCTOBER
[1:25:46]
14 agenda.
[1:25:48]
And hopefully it will be done
[1:25:51]
before then and we won't have to
[1:25:53]
be back for this.
[1:25:53]
Okay.
[1:25:54]
Good luck.
[1:25:58]
>> thank you for being here.
[1:26:01]
>> appreciate it.
[1:26:04]
>> where to next?
[1:26:06]
>> there are no more parties
[1:26:07]
present to be heard.
[1:26:12]
We will move to the violation
[1:26:14]
hearing section of special
[1:26:15]
requests.
[1:26:21]
>> number 13, officer bender,
[1:26:22]
26-09143, respondent address
[1:26:37]
1866 southwest davis street.
[1:26:54]
>> good morning.
[1:26:59]
>> officer bender, previously
[1:26:59]
sworn.
[1:27:01]
>> this case concerns the
[1:27:03]
property at 1866 southwest davis
[1:27:04]
street, port st. Lucie, florida.
[1:27:06]
On JUNE 4, 2026 an inspection
[1:27:07]
was done and photos taken
[1:27:10]
showing the following
[1:27:11]
violations.
[1:27:13]
Section 41.08b, exterior
[1:27:15]
property areas, high grass and
[1:27:16]
weeds over 12 inches.
[1:27:20]
The photos depict an accurate
[1:27:21]
representation of the property
[1:27:25]
at the time the photos were
[1:27:26]
taken.
[1:27:27]
The notice of violation was
[1:27:38]
issued JUNE 4, 2026.
[1:27:41]
A notice of hearing was
[1:27:42]
furnished JULY 23.
[1:27:45]
On AUGUST 19, proper service was
[1:27:46]
achieved by posting the property
[1:27:47]

Based and the evidence provided

[1:54:13]
And the city took steps to abate
[1:54:14]

[1:55:13]
You can see the grass was
[1:55:17]

[1:55:19]
And this here is the -- looks of
[1:55:21]
the overgrowth being taken care
[1:55:26]
of and the grass being cut.
[1:55:27]
>> all right.
[1:55:29]
So you already have an abatement

order.
[1:55:31]
You don't need another one, I
[1:55:31]

[1:55:31]

cite and did
[1:55:46]
not comply with the JUNE 3, 2026

order finding violation.
[1:55:53]
Therefore, that is probably

where the abatement order is.
[1:55:59]
Now the property is in

compliance because of the
[1:56:01]

[1:58:30]
Let's see, respondent is not

[1:58:34]
However, the city has proper
[1:58:34]

[1:58:36]
based and the testimony and the

[1:58:39]
did not comply with the order of
[1:58:41]
finding of violation from the

[1:58:47]

[1:59:45]
A violation hearing was held
[1:59:46]
JUNE 17, 2026.
[1:59:48]
Based on the evidence provided
[1:59:49]
and that date, the special
[1:59:50]
magistrate found that the
[1:59:52]
violations existed and ordered
[1:59:55]
compliance be achieved by JUNE
[1:59:56]
24, 2026.
[1:59:58]
And if compliance not achieved,
[2:00:00]
then authorize the city to bring
[2:00:01]
the property into compliance.
[2:00:03]
The following violations are
[2:00:05]

And per neighborhood services

department records, compliance
[2:00:33]
was not achievered by JUNE 24,
[2:00:34]
2026.
[2:00:40]
The city took steps to abate the
[2:00:45]
violation and abated and JULY

[2:00:58]
Due to the respondent's failure

[2:01:53]
>> okay.
[2:01:54]

[2:01:57]
So other than the abatement,
[2:01:58]

[2:01:59]
still remains.
[2:02:01]
>> and will get daily fines on
[2:02:04]
that.
[2:02:06]
So respondent is not present at
[2:02:07]
today's hear.
[2:02:10]
However, the city has proper

[2:02:17]
Based on the testimony and the

[2:12:09]

[2:12:22]

[2:12:24]

[2:12:26]
Respondent is not present this
[2:12:29]

[2:12:29]

[2:12:32]
I will make a finding that the
[2:12:34]
respondent did not comply with
[2:12:36]
the JULY 8 order finding
[2:12:36]
violation.
[2:12:39]
And that the property remained

[2:12:48]
Therefore, I will order and

A violation hearing was held on
[2:13:34]
JUNE 3, 2026.
[2:13:36]
Based on the evidence provided
[2:13:37]
on that date, the special
[2:13:38]
magistrate found that the
[2:13:40]
violations existed and ordered
[2:13:43]
compliance to be achieved by
[2:13:44]
JUNE 10, 2026.
[2:13:46]
And if compliance not achieved,
[2:13:47]
then authorize the city to enter
[2:13:50]
upon the property to bring the
[2:13:52]
property into compliance.
[2:13:53]
The following violations were
[2:13:55]
section 41.08b, exterior
[2:13:58]

[2:14:22]

[2:14:24]
Due to the respondent's failure
[2:14:26]
to comply with the deadline set
[2:14:29]

[2:14:31]
the city requests that the

[2:15:06]
this morning.
[2:15:10]
However, the city has proper
[2:15:10]

[2:15:11]
I find the respondent did not
[2:15:13]
comply with the order finding

[2:15:19]

JULY 14, 2026, when the city
[2:15:24]
