[3:00] No, Mr. Chairman.
[3:01] Excellent.
[3:02] Next item is unfinished business.
[3:03] There is no unfinished business, so we'll move right on to new business.
[3:07] Item D1 application 2026-0403 for the property located at 1311 Lancaster Avenue, a variance
[3:16] application.
[3:17] Staff, I'm ready for your report.
[3:18] Thank you, Mr. Chairman. As you said, application number 2026-0403. The application type is
[3:24] a variance for an accessory structure for the square footage. The application is Kevin
[3:28] Thompson for Mark Osment. The property is located at 1311 Lancaster Avenue. It consists
[3:34] of one parcel, zoned O-R-D-N, Old Reynoldsburg Neighborhood District, and the variance
[3:39] section is 1105-05-A-V-I-I-5. Before you is an aero of the subject site. Here
[3:47] Here is an image of the floodplain and floodway located on the applicant's parcel.
[3:52] Here's the zoning map of the subject site.
[3:55] Here's a Google Street view of the site off of Lancaster Avenue.
[3:58] The parcel is 0.56 acres and currently contains a dwelling detached single family.
[4:03] The existing home was built in 1900 and there is significant floodplain and floodway
[4:07] on the parcel.
[4:08] The applicant is requesting a variance to section 11.055A VII-5 to allow an additional
[4:14] 206 square feet for an accessory structure on the site.
[4:17] There is currently no accessory structures on the subject site.
[4:21] Here is a plan provided by the applicant showing the location of the proposed new garage in
[4:26] the rear yard along with the location of the existing home.
[4:31] The existing house is 2088 square feet.
[4:34] Based on section 1105,05A, VII 5, only 50% of the principal structure square footage
[4:41] is permitted for accessory-structured square footage, which is 1,044 square feet.
[4:47] The applicant is proposing an accessory structure that would be 1,250 square feet, which is
[4:52] 206 square feet over the permitted area.
[4:55] The applicant states that their hardship is due to not having a garage.
[4:58] The owners want and need a garage that holds four cars with sizable storage space and
[5:03] has a workshop for personal hobbies.
[5:05] The applicant states that a standard garage that conforms to the current zoning standard
[5:08] does not large enough for these uses.
[5:12] Here is the variance findings of facts.
[5:16] The applicant is requesting a variance from section 11.05.05AVII5, which states, in residential
[5:22] districts, a lot coverage of accessory structures shall not be more than 50% of the finish
[5:27] floor area of the main structure.
[5:29] The principal building is 2,088 square feet.
[5:32] The permitted accessory structure, square footage is 1,044 square feet.
[5:37] the applicant is proposing a 1,250 square foot accessory structure which exceeds the permitted
[5:42] accessory structure square footage for the site by 206 square feet. The variance requested from
[5:47] the applicant is to allow a garage to be 60% of the house space which would be 1,252.8 square feet
[5:54] and the variance factor is one of the criteria for review is that the minimum variance is
[5:58] requested to accomplish the purpose of the variance. The applicant is not requesting the
[6:02] minimum variance necessary but more than what is needed. Therefore the applicant is not
[6:06] requesting the minimum variance for section 110911DVI.
[6:10] Staff also believes that based on the applicant's statement of hardship and evaluation of the
[6:13] factors, the variance request appears to be a matter of convenience that is self-created.
[6:18] The applicant has not described in their documents how other possible alternatives
[6:22] or solutions were evaluated such as building an attached garage onto the primary structure.
[6:27] And the applicant has also not explained how the site is unique and how granting
[6:30] the variance would not confer them special privileges that are unduly denied by this
[6:34] code to other properties within the city.
[6:37] Finally, staff believes that granting this variance
[6:39] would set a precedent for future residential
[6:41] accessory structures being built.
[6:43] Based on these reasons listed above
[6:44] and in the project review, staff recommends denial
[6:47] of the variance request, Mr. Chairman.
[6:50] Thank you.
[6:51] At this time, I now invite the applicant
[6:52] to come to the podium
[6:53] and you may give whatever presentation you wish.
[6:56] The board may have some questions for you.
[6:58] I'll just ask that you please speak into the microphone.
[7:01] Please adjust the microphone if you need to
[7:02] so that you can speak into it
[7:03] and please state your name and address for the record before doing so.
[7:08] Thank you.
[7:18] Hello.
[7:19] My name is Mark Osmond.
[7:20] I'm obviously the owner of the property that we're trying to develop here.
[7:24] Basically, we're just trying to get a little more room for ourselves and our stuff.
[7:29] We want to duplicate the house in itself, the sense of the structure, how it looks,
[7:35] how the materials are used.
[7:37] We just want it.
[7:38] And you can see we're back a ways with this.
[7:40] so it's not like it's impeding the views.
[7:44] There was another point of our issue
[7:45] was that making sure our neighbors and us
[7:47] still had that nice view in the backyard
[7:50] where we can see the creek and stuff.
[7:51] And that's why we're going along.
[7:54] Proposal was to attach to the garage, to the house,
[7:57] but then in our limits, our access to the backyard.
[8:00] And we do a lot of stuff in the backyard.
[8:02] We do a lot of entertaining,
[8:03] and we have family and friends that come by.
[8:06] So basically we're just asking for another 206 feet,
[8:09] whatever that might be.
[8:09] I'm not sure what it was just to try and get the room that we need for three vehicles
[8:15] I got a tractor I got a you know
[8:18] We got a half an acre land I got a zero turn mower that I got in there
[8:21] So stuff I'm storing that I need to store inside and not outside underneath the tarp which I have right now and
[8:29] That's basically it
[8:31] Thank you. Thank you for your time
[8:34] Are you sir if you would yeah, please say sorry, I'm sure we're gonna have some questions for you sure
[8:39] I'll just say, you know, I'm sympathetic to your situation.
[8:43] My house is 50 years older than yours and I live in your neighborhood, so I understand
[8:46] the issue of not having a garage.
[8:48] I don't have one either.
[8:50] But I will say here that just understand that when you ask for a variance in the way that
[8:56] yours is stated, you're essentially asking us to rewrite the law, which is not a power
[9:02] that this board has.
[9:03] So, the point of the variance factors which are our only sole decision making here as
[9:11] required by the zoning code is to give us a framework which to understand your request.
[9:17] And we are required to analyze your submission and see if it meets those variance findings.
[9:27] And, you know, particularly here in your application, when you speak of, you know, needs or wants
[9:35] or things like that, you know, what we would typically would like to hear is a demonstration
[9:41] on why it's absolutely necessary, why you couldn't use your structure existing property
[9:48] for its intended purpose, which is a residence in a residential neighborhood if this variance
[9:53] variance wasn't granted. That's the hardship element. So, based on your application, I'm
[10:01] not necessarily convinced that you have met the hardship requirement, so perhaps you could
[10:07] go into that in a little more detail. I mean, I'd like to grant you a garage, but it seems
[10:12] like if you just asked for one that was a little smaller, a variance wouldn't even
[10:15] be necessary.
[10:16] Sure. It may we do, we turn around and we go back and we redo this, you know,
[10:20] the graphics and maybe we bring it down and because you know that's what we need to do is we need to get up that 200 feet.
[10:27] Yeah, I mean it looks like what staff said I think 1044 square feet would be the allowable maximum so you know if you
[10:35] just came down just a little bit on the garage you wouldn't even need to be here.
[10:39] Okay, we'll do that.
[10:42] Is there any other questions for the applicant?
[10:45] Now, well, that having been said, sir, you know, would you like to withdraw your application
[10:51] at this time?
[10:53] Based on the applicant's testimony then, I understand this application would like to
[10:59] be withdrawn.
[11:01] And I so move.
[11:02] Second.
[11:03] Second.
[11:04] Second by Mr. Benner.
[11:05] Staff, please call the roll.
[11:08] Thank you, Mr. Chairman.
[11:10] Ms. Ward.
[11:11] Yes.
[11:12] Mr. Twalmo.
[11:13] Yes.
[11:13] Yes.
[11:13] Mr. Brask.
[11:14] Yes.
[11:16] Ms. Barnhart.
[11:17] Yes.
[11:18] Mr. Benner.
[11:19] Yes.
[11:19] Mr. First.
[11:20] Yes.
[11:21] Thank you, sir.
[11:21] Thank you.
[11:22] Next item is D2 application 2026-0453 for conditional use application.
[11:30] Staff.
[11:32] Thank you, Mr. Chairman.
[11:34] One second.
[11:39] You said the application is for conditional use.
[11:42] The application number is 2026 0453.
[11:45] The application type is for a conditional use for a child daycare center.
[11:48] The applicant is Niba Valentine and Omar Neuro of J. Hawkins Learning Academy for Blacklic
[11:54] Properties Bishoff Company.
[11:56] Properties located at 6549 East Livingston Avenue consist of one parcel and is currently
[12:01] zoned CC Community Commercial.
[12:03] Before you is an aerial of the subject site and the parcel is 4.12 acres.
[12:08] Here's a zoning map of the site.
[12:10] Here's a Google Street view of the subject tenant space.
[12:13] The tenant space was previously used as a child daycare center.
[12:17] The applicant is requesting to use the subject tenant space as a child daycare center, which
[12:22] is a conditional use in the CC Community Commercial Zoning District.
[12:25] Here's a closer view of the front of the tenant space.
[12:28] The applicant intends to operate a daycare from 6 a.m. to 6 30 p.m. Monday through
[12:32] Friday with the anticipated total number of employees of 8 to 10 employees with
[12:37] a maximum of 98 children.
[12:40] Here's the site plan provided by the applicant.
[12:42] On it a playground and dumpster
[12:45] Area are drawn in the applicant states that the outdoor playground area is to the right of the rear exit door
[12:50] And that it is free from traffic making the move me moving of children's safe
[12:55] However staff has concerns considering the playground area is partially identified over concrete
[13:00] It is unclear how this area will be used only for the playground area and finally
[13:05] How will traffic move in the rear of the building ensuring that there are no loading or parking spaces near the outdoor play area?
[13:11] meeting one of the additional conditions required
[13:13] for child daycare centers.
[13:15] Here is an image of the rear of the tenant space
[13:18] with the applicant proposing a dumpster
[13:20] to be located on the grass
[13:22] within the gated closed-off area near the ballard.
[13:25] Staff has concerns about how the refuse
[13:28] will be safely accessed along with how other traffic
[13:30] in the rear of the site will be utilized.
[13:32] The applicant states that they will not be undergoing
[13:34] any inside or outside building modifications.
[13:38] Here is a list of the conditional use standards.
[13:41] Here is a list of the child care standards that also need to be met for the proposed
[13:45] conditional use.
[13:47] Child daycare center found in section 110513H of the code.
[13:52] Staff has reviewed the application and based on the information provided, there does not
[13:56] appear to be enough information provided to show that the additional regulations
[14:00] for a child care center found in section 110513H has been met along with issues
[14:06] regarding the site plan and dumpster location and meeting all requirements of the zoning code.
[14:11] Staff has concerns regarding the location of the outdoor play area in relation to its proximity
[14:15] to other loading areas due to it being located behind the building where loading spaces generally
[14:21] tend to be located along with providing more information about the outdoor play area whether
[14:26] new or existing to ensure there is adequate fencing so that children are safe due to this
[14:30] area having vehicular circulation in the area and the playground area being shown to be
[14:35] located over paved areas of the site.
[14:38] Staff also needs the applicant to clarify and provide, sorry, the required information regarding
[14:44] the new dumpster location since it is currently shown over a grassed area, however it should
[14:49] be located on a hard surface and if the applicant intends to increase the impervious surface
[14:54] on the subject site, staff needs to ensure that the maximum impervious surface area
[14:59] is not exceeded.
[15:00] Or variance could be needed. The applicant also needs to address in their statement how condition 11-05-13-H-I is met, and while the site appears to meet this requirement based on the city's GIS aerial view, staff would like the applicant to address this in their application to ensure all requirements are met.
[15:17] Therefore, based on the reasons mentioned above and in the project review of the staff
[15:21] report along with Section 110513H and conditional use standards, Section 110913D, the IEI of
[15:28] the zoning code having not been met, staff recommends denial of the conditional use application
[15:32] for a child daycare center.
[15:34] Staff would be amenable to placing the application on hold if the Board chose to
[15:38] do so.
[15:39] Please know that if the application is placed on hold, the applicant would
[15:42] have to come back to the Board within 60 days of this meeting for determination
[15:45] unless the applicant agreed to place his application on hold.
[15:48] The latest meeting in this case could come back before the Board
[15:52] without the applicant agreeing to the application being put on hold
[15:56] this September 17th, 2026, Mr. Chairman.
[16:00] Thank you.
[16:00] I now invite the applicant to please come to podium at this time
[16:03] and I'll just ask that you please state your name and address for the record.
[16:10] You're welcome to give whatever presentation you like.
[16:12] please I don't know my English maybe not that clear because I don't really speak
[16:21] the American English but what I really understood from what is on there on the
[16:28] staff denial something of that I'm what I can I can recommend is that I
[16:38] I may see how you can redress all these issues and then concerning the trash, where the trash
[16:48] is located is where there's normally the trash service that comes by to pick the trash.
[16:56] That one that was located there is just like a temporary location for trash because the
[17:03] trash service or usually comes in the in the mornings on Wednesdays to pick out
[17:09] trash at the phone and then concerning the playground I believe that's an
[17:16] existing daycare that was being approved by the City of Reynoldsburg. The same day
[17:22] I'm a playgrounder is the is the same one we're gonna use. That's an existing
[17:27] daycare that we just, I'm moving my existing daycare from Lancaster to there. So the daycare
[17:36] that was existing there, the lady no longer wants to operate the daycare. So I wish to
[17:41] do a transfer of my daycare to that location. I don't change anything. Nothing changes there.
[17:48] It's just for me to go and start operating there.
[17:52] Thank you. I think all that makes sense. But as I read staff's report, I think you could
[17:59] probably solve these problems just with some photos of the existing site. Ms. Bathay, could
[18:05] you go back to the photo that shows the ballards, please? Yeah, that one there. So our main
[18:11] concern here, and we have rejected daycare applications based on these concerns, is that
[18:17] you see those tracks that, if you look overhead, you see those tracks there. There's clearly
[18:21] vehicular circulation here. Vehicles come through, right? And if, based on your application,
[18:26] it looked like the playground was in that grassy area there where vehicles clearly
[18:32] come through. So I think you could solve both problems showing where the trash is going
[18:38] to be and where the playground is going to be just with some photos of the existing
[18:42] site.
[18:43] I think where I located the playground is after the grass. It's found towards the trees
[18:51] there. It's not found in front of the grass.
[18:54] Yeah, that's just not really clear from the materials that you provided. So I think a
[19:01] efficient solution here would be to, if you'd be willing, is to just place this application
[19:08] on hold and then you could just snap some photos of where the playground is going to be where the
[19:12] trash is going to be and you know perhaps talk to staff see if they have any additional concerns
[19:18] and if that would be sufficient for their purposes. Okay so. Chair first. I think I have a few
[19:24] questions that might need clarified here. Go ahead. Sir my name is Mr. Schuch. I'm the
[19:29] city attorney here in Manelsburg. I'm quite familiar with this property and with the
[19:35] commercial landlord, as I'm sure is Mr. Benner.
[19:40] And you may not be as familiar with him. It
[19:44] would be helpful if Mr. Bischoff could come in and explain how it is that this site layout
[19:49] is going to work. Because part of the problem here is that the proposed playground is
[19:58] not located immediately to the rear of your tenant space, which means that the children
[20:04] would need to walk a significant distance behind other businesses in their leases to get to that
[20:10] playground space. One other issue that we would hope to get clarification from Mr. Bischoff on
[20:15] is that in the past the city has cited Mr. Bischoff for his refusal to construct dumpster
[20:23] enclosures for dumpsters at the rear of that property and instead of actually constructing
[20:29] dumpster enclosures. He just removed the dumpsters and then stuck it to the tenants to fill up regular-sized trash cans, which were overfilling, and then it was becoming kind of a littering problem in that area as well.
[20:43] So when we look at the rear of this property as it relates to the proposed application that you submitted, you might not be in the best position to be able to answer all these questions.
[20:51] Mr. Bischoff probably would, so if we do continue this hearing, I would ask that Mr. Bischoff
[20:58] be here to answer those questions so that we can get some clarification on what he's
[21:02] actually intending to do with the rear of this property. We've had difficulty, and that's
[21:07] putting it mildly, with him in the past.
[21:12] Okay, sir.
[21:16] Obviously, you're not Mr. Bischoff. You can't speak for him. But is there a period
[21:20] of time that you'd like to place this application on hold for? We typically don't like them
[21:25] to be open-ended. So would something like bringing this back to us in no more than 90 days be
[21:35] suitable?
[21:36] Yes, sir.
[21:37] Okay.
[21:44] Give me one second, Mr. Chairman.
[21:52] While staff is conferring their records, are there any additional questions for the
[21:56] applicant while we have an open meeting?
[22:05] This is the calendar, Mr. Chairman, for the rest of the year. If there is a specific
[22:09] date that you and the applicant can agree upon we're happy to. Yeah is there a
[22:16] specific date here that worked for you the dates in orange I'm not sure yeah I
[22:20] guess it does show orange there on the screen those are the dates of our
[22:22] meetings. Please know that you have to turn in anything additional three weeks
[22:29] prior to so the August 20th meeting that you see which is the next one the
[22:33] deadline for that was today so the next possible one after that is
[22:38] September 3rd the deadline to submit stuff for that packet would be August 13th
[22:47] okay if I'm a this mr. Benner
[22:54] anticipating whether or not we can
[22:57] actually get mr. Bishop to show up I would extend this as far as you could you
[23:06] can always come in earlier earlier yes okay as long as you're three weeks
[23:11] ahead of time, ahead of the meeting. You can come in early, but I just feel like it's not
[23:18] going to be a slam dunk for you to get him to come in here and testify to us. So you might
[23:23] want to take that into consideration.
[23:25] I think what I would recommend, if you're willing, is that it be no later than the
[23:30] regular meeting scheduled on December 17th. Would that be suitable for you?
[23:39] Please, I wish to ask whether if it needs me to do any modification, can I do it by myself?
[23:46] No, that's a question for staff.
[23:50] Yeah, the short answer to that is probably no.
[23:53] The long answer is you'd have to describe what you're doing review and we're also not the building department but if you're able to tell us what you're trying to do we can route you to the right people but I will tell you that
[24:04] usually without getting the zoning approval it can be tough to get a
[24:07] building permit so I think typically the zoning is is addressed first unless
[24:14] there's like structural issues that have to happen just to maintain the
[24:18] building so the short answer is probably no the long answer is you'd have to
[24:22] write out what you're doing in an email we could direct you to the right
[24:24] people what I would say and just to say this very clearly December 17th
[24:31] would be the latest that you could come back. You could come back sooner than that. The intent
[24:36] is to give you as much time. So if you've met the – gave us materials and said, hey,
[24:41] you could be here, for example, at the September 3rd meeting, that would be acceptable. What
[24:45] I believe the Board is trying to do is give you enough time to work with Mr. Bischoff
[24:49] to get here so you're not coming back and asking for extension after extension.
[24:53] So I think that's the intent here. So if you agree to the December 17th meeting
[24:58] being the latest you could come back at any of those what one two three six or
[25:04] seven meetings as long as you met the three-way deadline in advance and let us
[25:08] know so I would well I'm not allowed to advise you but that might be your best
[25:15] shot here is what I would suggest and to your other question we'd be happy to
[25:20] look at what you intended to do if you give it to us in writing but usually it
[25:25] requires zoning approval and less in special circumstances
[25:29] with the building department.
[25:30] But if you give it to us in writing,
[25:31] we can direct you to the right folks to do that,
[25:34] but we need it in writing.
[25:36] Thank you, Mr. Meyer, that was exactly my intent.

[34:26] Mr. Brask.
[34:27] Yes.
[34:27] Ms. Ward.
[34:28] Yes.
[34:28] Mr. Tuomo. Yes. Ms. Barnhart. Yes, Mr. First. Yes. Thank you. Next item is E1
[34:38] zoning code. This is everyone's favorite topic. I am absolutely ready to hear what
[34:43] you have to say, Steph.
[34:47] So we're working on at the last last year we had a
[34:51] want to call it a workshop where we brought a PowerPoint and just looked
[34:54] out some images of stuff we wanted to get direction from the board on. Do we
[34:59] want to address it, not address it, do more work. So we've got, it's about a 65 page PowerPoint
[35:05] right now. We'll try to cut it down as much as we can, but the intent is that the August
[35:11] 20th meeting, we bring it, some of them might have specific language in the code to change,
[35:16] but a lot of it is just, here's a picture of the issue, here's the direction we're
[35:20] thinking is the board supportive, not supportive, is there consensus, not consensus? So it's
[35:26] trying to workshop some of that and then to refresh everybody on the board the
[35:31] process for the zoning code update is staff and draft zoning code changes we
[35:36] present with a city council city council then sends them back to the plan
[35:39] or sends them to the planning and zoning board and then the planning and zoning
[35:41] board votes out recommendations to city council then city council would then
[35:45] vote on those typically we try to do that on an annual schedule that ties
[35:49] that with our budget process we have two meetings a year in December
[35:54] December, typically, one of them is scheduled. It's December 14th. My understanding from
[35:58] the clerk or council is she thinks the other meeting will be December 7th, but it's not
[36:02] guaranteed. So the intent is to talk about this on August 20th, get some direction on
[36:07] key things, work on writing changes, get it to city council probably in early October,
[36:12] and then get that to you folks. We've got some time to look at it. So that's
[36:16] the intent. To be clear, we're not going to have written changes for everything,
[36:20] but we just want to talk about it. An example is, you know, the City Council
[36:24] directed us based upon the appeal we had about a launch rematch. We're talking
[36:28] about adding that as a use in some areas, things like that. So that's
[36:32] what's coming in the 20th. And then it's on
[36:36] the next slide. It wasn't from the agenda, but here is what's going to be
[36:40] happening in City Hall at the City Council chambers. So this is a
[36:45] drawing of the chambers. You'll note in the back
[36:48] If that area is going to be ripped up and turned into a conference space with kind of
[36:52] like a folding glass door that can shut to make a meeting space that can also be open
[36:57] up to use for meetings, I say this because that work will be starting at the end of
[37:01] August and will not be done until December.
[37:04] So my understanding is we'll still be using this space for meetings, but you folks will
[37:09] be dealing with that during planning and zoning board meetings.
[37:12] The work will not be going on, but there will be some disruption.
[37:16] So I wanted to give you folks a heads up.
[37:18] next meeting will not be underway but the one in September it will so I figured
[37:22] I would give you folks a heads up so you know that it's starting in September
[37:26] you'd be walking into a construction site so thank you Mr. Meyer thank you for
[37:31] not springing a surprise 65 page PowerPoint presentation on us this
[37:37] evening Mr. Banner I assume you don't want to meet at the Hickory House
[37:42] instead we'll
[37:48] keep that under advisement is there any additional
[37:50] business before the board. Hearing none, this meeting is adjourned at 6.37. Thank you.
