purposes submitted by Josh Spence. This
is unanimously recommended denial by
[19:17]
planning commission. This is the third
of three readings.
[19:20]
» Mayor, I move that the city council deny
this zoning re application based on
[19:26]
findings and reasons that the planning
commission brought forward to deny. We

need to read first.
>> We'll need a reading first I believe
[19:34]
before we can deny either if I think
don't we have to read it and then you
[19:40]
would either not make a motion or you
could let it die or you could make a
[19:44]
motion to deny it. Am I correct, Mr.
Parliamentary? So,
[19:49]
would you make a motion? Would you make
a motion for reading, Mr. uh Gray?
[19:54]
» Because we have to read it before we
deny short read by title only with

[20:15]
I have a motion in a second to suspend
the rules read by the title only with a
[20:20]
short explanation for the third
third of third three three ratings third
[20:26]
[laughter] three reason I'm sorry all in
favor
[20:29]
» any opposed sir ordained certain really
in the city of Russell Arkansas for the
[20:34]
purpose of the past would reszone
property at 120 east main street from C1
[20:39]
central business district to C2 highway
commercial
[20:44]
mayor I move that the city council deny
this reszoning
[20:50]
item based on the findings and reasons
of the planning commission and their
[20:53]
unanimous denial of said item.
>> Have a motion in a second to deny this
[21:00]
motion.
>> So would it be?
[21:03]
» So any discussion have Okay. I
>> so I if uh I remember correctly from one
[21:12]
of the trainings at a municipal
conference when uh we're talking about
[21:16]
zoning and denying something that the
preference is instead of a yes vote
[21:23]
being essentially denial. So, a yes
being a no and a no being a yes to
[21:29]
actually phrase a motion either to just
vote on it or to or to phrase it for
[21:36]
approval and then everyone vote no. So,
there's no confusion as to whether a yes
[21:40]
is a no and a no is a yes.
[21:50]
» Yeah.
>> And then
[21:51]
» I'm clear either way, but if y'all want
to make a different motion, fine. We can
[21:56]
do either way. I just would that that
was the that was
[22:02]
» I think I think
>> Yeah.
[22:05]
» Yeah. Or you if you do resend your mo if
you do resend your motion can Mr. Gray
[22:11]
resend his motion and it die.
>> Well, I've got a motion and a second.
[22:19]
» I made a motion to deny.
>> Okay. So if you're voting to deny if we
[22:24]
if we state it
>> deny
[22:26]
» you you vote.
>> Yeah. So because we've already got the
[22:29]
motion out there. So and it's clearly
we'll state that voting yes is denial of
[22:35]
this motion. Are you comfortable with
that Mr. If we if we make it clear
[22:39]
» I'm perfectly fine. I'm just saying that
was the guidance from the municipal.
[22:42]
» So next time we will we will try to
remember in future. Yeah. Okay. Due the
[22:47]
fact that it's an ordinance I am going
to ask for a roll call. Miss uh
[22:50]
» course
>> once again voting yes is to deny this.
[22:55]
» Yes ma'am.
>> Mr. Gray
[22:57]
» yes to deny
[23:01]
» Mr. George.
>> Yes.
[23:03]
» Miss Wetszel.
>> Yes.
[23:06]
» Miss Young.
>> Yes.
[23:07]
» Mr. Olsen?
>> Yes.
[23:09]
» Mr. Bradley?
>> Yes.
[23:10]
» Mr. Pearson?
>> Yes.
[23:11]
» Mr. Keller?
>> Yes.
[23:13]
» Got eight yeses to deny it.
>> [clears throat]
[23:17]
» this uh consideration uh will fail. All
right, moving on. Item two,
[23:21]
consideration ordinance approving the
private club permit for Mel's Mexican
[23:24]
Grill Club Incorporated
[clears throat] required for the state

to the Arkansas Alcoholic Beverage

Control Division per Arkansas code
annotated 3-9-222.
[23:39]
Okay, this will be the second of third
reading. Mayor, I move we suspend the
[23:45]
rules. Dispense with the reading
requirement, read by title only with
[23:48]
short explanation for the second and
final reading.
[23:53]
» Okay. I have a motion and a second to
suspend the rules. Read by title only
[23:59]
with a short explanation for this second
and final time.

amending the current Russville historic

for other purposes the sorts of pass
would make the amendments to the current

subchapters or subsections that would
increase the fee to $100 and shift the

[29:46]
East 2nd and 2,120
East 2nd Street. This is city of
[29:53]
Russville. For other purposes, this is
submitted by Henderson Specialties on
[29:56]
behalf of CNC Machinery.
[30:00]
» Second.
>> Have a motion and second to adopt. All
[30:04]
in favor? I
>> any opposed? All right. So, we have a
[30:07]
public hearing next uh next month. Item
three will be a consideration ordinance
[30:13]
reason earning certain realy in the city
of Russville, Arkansas for other
[30:17]
purposes. This is submitted by Susan
Heinden.
[30:22]
U if you gentlemen would you just tell
us the location of this and the location
[30:27]
is not there so we have a
an idea. Don't have to tell us a lot but
[30:31]
just the location.
>> Absolutely. Yes. This is at 150 South
[30:34]
Tulsa Avenue. It's immediately east of
the uh existing Walmart neighborhood
[30:39]
market.
>> Okay. So, oh, this is where Bartlett
[30:43]
Dental Dental is. Yes, there is. We're
reszoning that. He has a he has a
[30:47]
dentist office has a little bit of a
small parcel there that's R1 and he's
[30:51]
just shoring up and cleaning up the the
zoning in that to make his his his piece
[30:56]
of property all C4 if I'm No, C2. C4.
C4. C2. C4. Yes.
[31:01]
» Yeah. It was a um a vacated alley. Yes.
>> Okay. And so he's just kind of shoring
[31:04]
up and piecing squaring up that piece so
that it's all the same zoning. Correct.
[31:08]
Cleaning. Doing some clean up. Okay.
Yeah.
[31:16]
» Yeah.
>> Yes.
[31:17]
» They're going to be here for the next
all of them because the rest of them
[31:22]
» I was about to camp out up here. So
[laughter]
[31:26]
» u So we can we get So that's good. We
get a motion on that if you guys are
[31:32]
» do you do both? Okay. So, okay. Item
four. So, we do item four
[31:36]
» is consideration ordinance reszoning
certain realy in the city of Russville
[31:39]
other purposes. That's Carol Collins who
also has she has practiced there for 20
[31:44]
years thinking she had a uh a C2
property and she found out when she was
[31:50]
doing something it's an R1
>> and so it's it's R2 and so she uh
[31:55]
» so it's currently R2 I guess um right
before she had purchased a property some
[31:59]
20 plus years ago um they had reszoned
it uh from C4 to R2. We can't really
[32:06]
discern as to why that happened. Um, but
she was under the impression that it was
[32:10]
a C4 property until about a month ago
when she discovered and we've been
[32:14]
moving her through the process since
then.
[32:16]
» And so that fits in line with everything
we've got going on. There's no issue.
[32:20]
» Yep.
>> Fits the prescription. It works for for
[32:22]
us.
>> Okay.
[32:28]
» May I move we suspend the rules dispense
with the reading requirement on item
[32:32]
three. read the first of three readings
by title only with short explanation.
[32:37]
» You have a motion uh and a second from
Mr. Mr. Keller and Mr. Bradley to
[32:44]
suspend the rules read by title only
with a short explanation
[32:48]
uh for the first of three readings. Is
that what you said Mr. Keller? Okay. On
[32:52]
item three. Yes, sir. All in favor?
>> Any opposed? All right. Thank you, sir.
[32:58]
Nor is certain really in the city of
Russell Arkansas and for other purposes
[33:02]
of pastries on a property located at 150
South Tulsa Avenue, Russell, Arkansas
[33:06]
from R12C4.
[33:12]
Mayor for item four, I move we suspend
the rule dispense with the reading
[33:15]
requirement read for the first of three
readings by title only with short
[33:19]
explanation.
>> Have a motion in a second for item four
[33:24]
to suspend the rules. by title only with
a short explanation for the one f first
[33:30]
of three readings.
[33:34]
All right. All in favor?
>> Any opposed? Sir,
[33:40]
an ordinance resing certain real city of
Russell Arkansas and for other purposes
[33:44]
is ordinance if pass resone property
located at 2802 West Main Street,
[33:49]
Russellville, Arkansas, currently from
R12C
[33:53]
to highway commercial.
[33:57]
All right, moving on to item five, which
is consideration for an ordinance
[34:00]
resoning certain realy in the city of
Russville, Arkansas for other purposes
[34:04]
submitted by Barrett Associates on
behalf of Janie and Laura Lee Morris
[34:08]
Walker. I believe this is on Highway six
or it's on 16th Street right across from
[34:13]
uh Hickey Park. There's a been a couple
buildings that have not been in use. Uh
[34:18]
and we're grateful that these people are
wanting to buy that piece of property
[34:21]
and put some mixeduse, possibly some
residential in there for us, which is
[34:25]
much needed.
Is that 16th Street?
[34:29]
» Yes. Right across from Hickey Park
there. I believe it's where I don't know
[34:33]
if you're old enough to remember, but
I'm thinking that's where the
[34:37]
» Well, no. I think it's the No, it's the
old uh Red Cross back in the day. It
[34:41]
used to be the Red Cross right across
there, I believe. So,
[34:44]
» do you remember that? I didn't know. I
>> I didn't I didn't know if you were old
[34:48]
that old enough, Laura. I'm giving you
credit for being young. So, or
[34:51]
Councilwoman Wessel. So, so that Yeah,
that's where this property is. and there
[34:55]
wanted to do some uh mixeduse
residential there. So,
[35:01]
» may I move we suspend the rules dispense
with the reading requirement read the
[35:04]
first of three readings by title element
with short explanation.
[35:08]
» I got a motion in a sec. Was the second
for Mr. Bradley? Yes, sir. I got a
[35:12]
motion and a second uh reading uh
suspending the rules read by title only
[35:17]
with a short explanation for the first
of three readings.
[35:24]
All in favor?
>> Any opposed?
[35:27]
Thank you, sir.
>> Reserve in certain rel Arkansas and for
[35:31]
other purposes this past resort on
property located at 20 at 1311
[35:38]
1315 East 16th Street, Russellville,
Arkansas from the current zoning of C2
[35:44]
High commercial to R2.
>> All right. Thanks, Sharon. Item six is
[35:50]
cons consideration ordinance reszoning
certain realy in the city of Russville
[35:54]
Arkansas for other purposes. This is
submitted by Barrett associates on
[35:56]
behalf of real practices. This is the
property located at Parkway in Phoenix
[36:01]
on the southwest corner. Uh there will
be a walk there real practices want to
[36:06]
put in a walkable neighborhood there
which will definitely be good.
[36:10]
» This is off of um Chesty Polar Drive um
right behind the um the St. Mary's
[36:15]
Medical Complex.
>> Did you
[36:19]
get any resolution on the the issue I
brought up like future facing 30 40 50
[36:25]
years from now.
>> We did explore kind of what potential if
[36:29]
there were potential improvements that
needed to be made to the overpass that
[36:33]
is either if it had to had to shift left
or east or west. Um there would be move
[36:41]
uh room likely to add another lane
without having to substantially shift
[36:46]
the um shift the in a way that it would
damage the or or prevent the entry to
[36:52]
chest polar that access. There's also
potentially future forward where the
[36:57]
parking lot is at the um you have to
forgive me adjacent to the um both this
[37:03]
property in question as well as the St.
Mary's Medical Complex for a potential
[37:07]
future access. But again, if we're
talking in scale of moving the overpass,
[37:11]
» I just brought up the fact that 50 years
from now, 40 years from now,
[37:15]
» rebuild an overpass like this one. We it
to the east
[37:19]
» probably going back to the west if
you're going to have to rebuild one. I
[37:22]
just wanted to see just thinking that
because I didn't I'm sure plenty of
[37:25]
people be cussing me 40 years from now
but
[37:28]
» we will remember you fondly because I I
[laughter] don't I don't well actually
[37:31]
none of us will probably be here 50
years from now.
[37:33]
» I know if you sat [clears throat] in
this seat very long you some past
[37:36]
counselors are like why did they do
that? So why didn't they think of that?
[37:39]
So anyway I just wanted to bring it up.
It was a good concern.
[37:42]
» Appreciate it.
>> I'll entertain a motion.
[37:44]
Mayor, move we suspend the rules
dispense with the reading requirement.
[37:47]
Read for the first of three readings by

There uh was uh suspend the rules. Read
[37:57]
by title only with a short explanation
for one of three readings.
[38:03]
All in favor?
>> Any opposed?

[38:53]

your packet.
[38:57]
» May I move we suspend the rules dispense

[39:14]
with a short explanation for one of
three readings.
[39:18]
All in favor?
>> Any opposed?
[39:21]
» All right. An ordinance submitting the
current zoning code for the city of
[39:25]
Russellville, Arkansas, adopted by
ordinance number 2443. And for other
[39:29]
purposes, the sort and sift pass would

amending articles on vehicle on

premises, the standards of sidewalks,
off streetet parking requirements,
