[4:24] to establish an outdoor vehicle storage yard associated with a towing company,
[4:30] located at 476 Whitney Street, APN 778-743-23, Zoning District, IG.
[4:42] May we please have the staff report?
[4:55] Good evening, Chair and Commissioners.
[4:57] My name is Felipe Morfin Martinez.
[4:58] I'm the project.
[5:00] Planner of the item before you, project number PLN 250031. This is a request for a conditional use permit to establish an outdoor vehicle storage art associated with a towing company at 476 Whitney Street. Tonight, I will be providing an overview of the proposal, staff analysis and recommendation.
[5:21] The applicant and owner, Parvanise Chond present here today is requesting a conditional use permit to establish an outdoor vehicle storage art at 476 Whitney Street.
[5:31] within the 22,500 square-foot lock the applicant proposes to use the
[5:36] existing gated area at the rear of the property for outdoor vehicle storage
[5:40] use.
[5:43] The site is located on the west side of Whitney Street between Adam
[5:46] Avenue and Addison Avenue within the industrial general zoning district and is
[5:51] not adjacent to any residential zones or use. Adjacent uses include warehouse
[5:56] light manufacturing as well as professional offices. The broader area contains a
[6:02] a variety of industrial uses, including warehouses,
[6:04] contractor yards, manufacturing facilities,
[6:07] and professional business offices.
[6:09] The proposed use fits within the context
[6:10] of the surrounding area and is not expected
[6:13] to impact adjacent uses.
[6:17] The 22,500 square foot lock contains
[6:20] an existing four-unit commercial building
[6:22] of approximately 9,800 square feet.
[6:25] Of those four units, one is used as a storage unit
[6:27] and the rest are vacant, but were previously occupied
[6:30] as office spaces.
[6:32] The site currently contains 17 parking spaces and a gated area towards the rear of the
[6:36] lot.
[6:39] The applicant proposes to use the fan-stuff area highlighted here and blue on the site
[6:44] plan for the vehicle storage use.
[6:46] This space is approximately 5,400 square feet.
[6:50] The connected unit highlighted in purple, 476 Whitney Street, would be used as the administrative
[6:55] office for the towing company.
[6:57] Sign improvements include restriping of the parking lot without reducing existing parking
[7:02] count, upgrading existing fencing and security gates, and installing approximately 72 square
[7:08] fee of new landscaping within planter boxes.
[7:14] Moving on to operations, vehicle deliveries
[7:16] may occur at any time 24 hours a day, seven days a week, with an anticipated two tow truck trips
[7:23] per day. All vehicle deliveries will be conducted within
[7:28] the indicated area. The secure outdoor storage area would
[7:32] accommodate up to 20 vehicles on a rotating basis. As seen in
[7:36] the image, vehicles would be stored in a tandem when the
[7:39] vehicle yard is at capacity.
[7:43] The storage and retrieval within
[7:44] the skated yard would be limited to train staff and not
[7:47] accessible to the general public. The local towing service
[7:51] would operate with two employees during regular business hours,
[7:55] 8 a.m. to 5 a.m. Monday through Friday.
[7:58] Vehicle retrievals will only occur during these standard hours.
[8:04] The project complies with industrial general zones and meets all parking requirements.
[8:09] It is compatible with its surroundings and it is consistent with the general plan
[8:13] by supporting an industrial land use and transportation related services.
[8:17] The project, which the project with its limited operations does not anticipate
[8:22] to cost significant traffic or public service impacts.
[8:27] To ensure the project maintains compatibility, staff has recommended a number of conditions
[8:31] of approval, some of which include use limitations to towing operations only with car rituals
[8:36] during standard business hours.
[8:39] Maintenance of the site, keeping the site in orderly fashion, upkeeping landscaping, ensuring
[8:43] noise is minimized.
[8:44] Environmental compliance for vehicle fluids, hazardous materials, ensuring proper assessment,
[8:50] containment and disposal of hazardous materials.
[8:53] Staff has amended condition of approval number 24
[8:56] to include language regarding storm water management
[8:58] and ensuring compliance with Alameda County-wide
[9:01] clean water programs, best management practice
[9:03] for towing and out of storage.
[9:05] This amendment has been provided to you all tonight.
[9:08] And I would also like to highlight a condition
[9:10] to install one bicycle space on site.
[9:15] Given the proposed project complies with all applicable code,
[9:18] It will not impact any residential use and adheres to the general plans desire to maintain
[9:24] and protect industrial uses within an industrial zone.
[9:28] Staff recommends the Planning Commission approve conditional use permit PLN 25-0031 based
[9:35] on the findings of fact to establish an outdoor vehicle storage yard at 476 Whitney Street.
[9:40] This concludes staff presentation and staff is available to answer any questions.
[9:44] If needed, the applicant is also here to answer any questions.
[9:47] Thank you.
[9:47] Thank
[9:51] you for that. Appreciate it. Does the commission have any questions for staff?
[9:55] See Commissioner Rich?
[10:03] Turn this light. Here we go. Thank you. Thank you for the presentation. Thank you for the report. I appreciate the revision to condition 24. I think that's really important. And I'm also excited about the bicycle spot. I do have a question and it may be for the applicant regarding after hours drop off. I understand that the facility has opened 24 hours a day, seven days a week for drop off and that there is approximately 40 hours a week when it
[10:33] available for customers to come in and take up their car.
[10:37] The condition 24 provides objective criteria for storm water pollution prevention.
[10:45] Once a vehicle is inside the 20 spot area, I'm interested in what the procedure is when
[10:52] someone drops off after hours.
[10:55] So for example, if it was open now, when the car was dropped off tomorrow, Friday at midnight,
[10:59] Does that vehicle go inside those 20 spots or does it sit outside that fence?
[11:06] And if it sits outside the fence, is there any protocol procedures planned for containment of potentially hazardous fluids from vehicles for specifically a vehicle that has been an accident and then got to that.
[11:23] Okay, so it's kind of a two-part question.
[11:26] Yes, so the vehicle, the vehicle storage area is within the fence-top area, so any drop-off
[11:32] of any vehicle within any time frame would have to go within the gated, inbound area.
[11:38] So regardless if it's to in the morning, it would be within that gated area and actually
[11:43] per the code, the parking requirements, the two available parking spaces outside of that.
[11:50] So, you can see here 11 and 12. They're associated with 476. Those are for pickup purposes.
[11:59] Thank you. Those are my only questions. Okay.
[12:08] Any other questions for staff from the commission?
[12:12] Nope.
[12:15] Okay. Seeing none. Move
[12:20] on to public hearing. Thank you for the presentation.
[12:24] Is there anyone from the public who wishes to speak on this item? Do we have any speaker cards?
[12:29] Okay,
[12:32] no speaker cards, do any commissioners wish to discuss the item,
[12:42] in that case do I hear a motion to adopt a resolution?
[12:50] I move to adopt a resolution with the revision to condition 24 that was distributed to us today.
[13:04] Okay, it has been moved by Commissioner Rich and seconded by Commissioner Solis to adopt a resolution approving a conditional use permit to establish an outdoor vehicle storage yard.
[13:16] associated with the towing company located at 476 Whitney Avenue, inclusive of the revisions
[13:23] that were part of our commission or packet or planning commission packet today.
[13:31] Please cast your votes on screen.
[13:40] Motion passes unanimously, six yeses.
[13:48] Decisions of the planning commission are final unless appealed to the city council by filing
[13:53] a form to the city clerk within 15 days of the date of this action.
[13:58] The form shall specifically state the reason for the appeal and an appeal to be is required.
[14:09] All right.
[14:10] Next item on the agenda, Commissioner report and announcements.
[14:16] Does the staff have any, does the staff have any updates under this item?
[14:20] Not this evening.
[14:24] Okay.
[14:25] Are there any announcement that members of the commission would like to make?
[14:30] Commissioner Rich.
[14:31] I actually have a question and I hope that's okay at this point in the agenda and that
[14:37] is regarding our pipeline, our development pipeline.
[14:41] Are there any proposals for data centers in San Leandro in our pipeline currently?
[14:50] We have now received the applications for data center in the city.
[14:54] Thank you.
[15:01] Anyone else from the commission with announcements? The time is now 715. I think this is a record. This meeting is adjourned.
