[23:14] has been very instrumental

[23:18] to us this is like an echo

[23:22] it's been very instrumental to us uh san miguel coming

[23:27] with legislative issues that we've had these past two years

[23:30] uh one one perfect example was last year

[23:36] i received a call from victor

[23:38] on a saturday morning asking me what

[23:42] miguel county's priorities were and you know we were able to

[23:47] identify those priorities and when it was all said and done the

[23:51] priorities that we identified to victor were in fact appropriated by the by the

[23:57] legislature we came out with almost a million

[24:01] dollars from that

[24:03] uh most recently we had a cdbg hearing

[24:07] and victor was the chairman of the cdc council

[24:12] and you know we were soliciting money for

[24:15] a community development block grant in my in my district which is country acres

[24:20] and we were able to secure 750 000 through

[24:25] the assistance of victor and so those are two examples of

[24:30] of how san miguel county has been able to benefit

[24:34] uh with funds for capital improvements for san miguel county

[24:38] in addition to that victor has

[24:42] become very involved with us with the cobed situation that we've had

[24:48] our our city mayor uh louis trujillo has had

[24:52] quite a few virtual meetings and uh

[24:55] mr uh reyes has been at those meetings and

[25:00] there's been a lot of involvement from from him with assistance to us

[25:06] uh and so i'd like to read this back

[25:09] and then i'm gonna ask for a picture to say a few words

[26:05] deepest parts of my heart the work that i've been able that we've been able to

[26:09] accomplish together throughout the past two years is something that's remarkable

[26:13] you know each and every one of you stand up to to make sure that your

[26:16] constituents have what they need that they're not over that they're not

[26:20] overlooked making sure that the infrastructure needs that our

[26:23] communities depend on are met and during this pandemic this community rose up in

[26:29] a way that needs to be commended and recognized throughout the entire state

[26:33] you were proactive you were aggressive and with the work that you did

[26:37] undoubtedly saved lives i'm so proud to have had the opportunity to work with

[26:41] san migo county and communities across the state throughout the last two years

[26:45] of my service with governor michelle lujan grisham i'm very honored to be

[26:49] able to be here today you know i've said it before but

[26:53] i don't i believe that that that family isn't just the people

[26:58] that you share that you share blood with it's truly the people that you build a

[27:02] community with so people who open their table and open their arms and i consider

[27:08] i consider this group to be like family i consider this community

[27:12] and communities across the state to be family for me and so being able to

[27:16] advocate for communities across the state throughout this pandemic making

[27:20] sure that nobody lacks the resources they need and to be

[27:24] able to um to provide that voice for you whenever i can is something that has

[27:30] been an honor for me i thank you for the work for the public

[27:33] service that you do you know public service is an honor given and trust and

[27:37] you earn that single that trust each and every day thank you for doing that for

[27:42] for demonstrating what remarkable public service and leadership is i'm truly

[27:46] honored and humbled to receive this plaque in this award um it means the

[27:50] world to me thank you so much mr chair thank you victor thank you and i don't

[27:54] know if you could see it but this is the plaque that we're presenting

[27:58] to us um good luck good luck to you victor

[29:13] detention center uh serving the public keeping the public

[29:17] safe keeping individuals who were in our custody safe

[29:21] most of her career was spent in the customer service area where she not only

[29:26] dealt with the detainees but she dealt with the public attorneys families

[29:31] friends she's gained

[29:34] massive respect from everyone that she's met

[29:39] and everyone she's dealt with uh in the community i wish her well along with her

[29:44] retirement we will be retiring her badge that's number 220 is officially retired

[29:51] along with mr linda romero and congratulations

[30:01] i just want to say thank you for me being here

[30:06] it was a good experience for me i learned a lot

[30:09] and i got to know a lot of people and i just want to say thank you to

[30:14] everybody

[30:32] every time that i that i'd go to the county jail i'd have

[30:36] to go through minister linda and you know every time that we

[30:40] that i was there she was always very cordial

[30:43] and very i was busy dealing with mail or dealing

[30:46] with with issues there but always greeting us

[30:50] as well and i'd like to say thank you on behalf

[30:52] of of san miguel county orlinda and we're going to miss you

[31:18] when i'd go by and and visited she was always very professional

[31:38] wouldn't let me do anything that i wasn't supposed to do she was the boss

[31:43] she knew it and people respected her because

[31:47] it's a area where the security is so critical

[31:53] and making sure you know who you're dealing with

[31:57] and what the person is there for and she was the first person

[32:01] that we as citizens and professionals when we walk into the jail we see her

[32:07] she smiles she makes us welcome she explains for those of us that don't

[32:12] understand what the procedure is what the process is why it is so important uh

[32:19] and and being a local she has that understanding of

[32:24] how families come in very emotional to jails maybe to visit

[32:29] friends relatives children and how [Music]

[32:33] some behavior should not be allowed what other behavior is allowed and trying to

[32:39] make it as comfortable place for the both the innocent and

[32:44] guilty as they go through the process uh the legal system the law enforcement

[32:48] system uh a real professional thank you mr romero

[33:31] okay uh moving on to regular business item one is resolution in support of

[33:36] establishing a state public bank and we have

[33:42] uh madam vice chair uh janice varela and commissioner to

[33:46] here trujillo who are co-hosting sponsoring this particular item so i'll

[34:03] could defer to mr trujillo is in the chambers and i'm expecting the gambles d

[34:08] and george campbell to present they did present this idea to the commission

[34:14] last year about five six months ago

[34:17] and i thought it was very interesting i've been a mem i was a on the board of

[34:21] the new mexico community loan development fund

[34:24] that provided loans and opportunities for individuals and non-profit

[34:29] organizations who banks would not touch and help so this is a wonderful

[34:34] opportunity i think we need to look at this to see how we can provide

[34:38] opportunities for our people in our community who will need to serve banking

[34:42] services so um commissioner trujillo do you have

[34:45] anything to add before we go to our presenters

[35:28] came by and gave us this presentation i was very intrigued and

[35:34] actually relieved that there's another option for residents and small

[35:38] businesses in new mexico to have another avenue to

[35:43] obtain capital to sustain their businesses and and their and their

[35:47] livelihoods um

[35:49] and i and i see that this um

[35:52] this movement if you will has has taken hold and and there's actually a couple

[35:58] of bills um or or a bill at the legislature right

[36:02] now recognizing this effort um i believe it's sponsored by senator

[36:07] steinborn and i i applaud him for for taking that

[36:12] on and i think um you know in his wisdom he can see also

[36:17] that um there's a there's a big need

[36:20] um for this kind of banking in in small communities and across the state

[36:26] there's a lot of people in need that sometimes banks won't uh

[36:31] you know won't touch as as you said madam meister

[36:34] and and some of these people are are credit worthy they're as worthy as

[36:39] anybody else they have vision they have potential in some of these community uh

[36:45] banks state banks um they see that potential and they're not uh as a

[36:50] as reluctant to loan money to somebody in

[36:53] need and and that's that's why it intrigued me enough to support this idea

[36:59] and and um you know i if if anybody i'm sure

[37:03] the gamblers are here to answer questions and as well as

[37:07] miss lehan so i will turn it over to you folks

[37:32] uh i just i'm dee gamble and this is my husband

[37:35] george and

[37:37] we're uh we're outreach volunteers with the alliance for economic prosperity

[37:43] which is a statewide nonprofit that is uh

[37:47] supporting this campaign for a state public bank in new mexico

[37:54] as mentioned the bills to establish the new mexico public bank have been

[37:58] introduced in the current legislative session

[38:01] sb 313 sponsored by jeff steinborn and hb 236 it's the identical bill is

[38:09] sponsored by representatives patricia roybel caballero and elizabeth thompson

[38:16] we have endorsements from the cities of las cruces albuquerque and santa fe

[38:22] and the county of santa bay also the new mexico credit union

[38:26] association and the new mexico food and agriculture

[38:30] policy council and numerous other organizations have

[38:34] endorsed this idea our leadership has worked for nearly 10

[38:39] years to study the value of such legislation and engaged in discussions

[38:44] with state treasurer the state economic development department and others to

[38:49] determine the pros and cons of a state bank for new mexico

[38:53] with the anderson school at unm we have developed a plan for how the bank might

[38:59] be structured how it would be capitalized and how it

[39:02] would operate in partnership with community banks credit unions

[39:07] municipalities tribal entities

[39:10] cdfs and across the state with numerous organizations

[39:16] we're motivated to promote a public bank in part by our visits across the

[39:21] counties in our volunteer area where we see the

[39:24] need for boosting the vitality of every town

[39:28] and village also we

[39:31] like you are determined to raise new mexico up

[39:35] from low measures it constantly receives from every

[39:40] indicator of family well-being new mexico is not a poor state and we

[39:46] all have to work to change that perspective

[39:49] by finding ways to invest in resources in culturally appropriate social and

[39:55] economic development your chairperson

[39:59] has given us several questions to respond to and maybe if that's all

[40:04] right with all of you we'll start with responding to those

[40:08] questions yes please do okay

[40:14] and then after we respond to those questions

[40:17] we'd be happy to respond to any other questions

[40:22] first how will the locally owned banks be

[40:27] affected by this proposed state bank you're requesting us to support

[40:35] currently las vegas

[40:37] sun mcgill county currently has two locally owned banks

[40:42] well a public bank is not a retail bank a public bank is a banker

[40:50] it is it is not a bank in which you or i could open up an account

[40:56] it is a bank that works in cooperation with

[41:00] local community banks credit unions municipalities tribal entities

[41:07] cdfis regional economic development districts

[41:12] it could provide school district

[41:16] school districts or municipalities

[41:22] financing opportunities rather than them requiring

[41:28] a bond issue the conditions of the relationship

[41:32] between the state public bank and community banks

[41:36] is one of partnership that is spelled out in the bills that are submitted

[41:47] the next question uh shall i i'll go on from there unless you yes want to

[41:51] interrupt now go ahead and go ahead and proceed okay uh the next question was

[41:56] how many states in the u.s actually have state-owned banks and how have the

[42:02] states having the state bank benefited from having a state bank

[42:06] well as a matter of fact the only state that has a state-owned bank is in north

[42:13] is north dakota and it's just over 100 years old

[42:18] in recent months the states of washington oregon and new york have

[42:22] introduced legislation to establish a public bank as well as the cities of

[42:27] philadelphia and san francisco other states and cities have groups

[42:32] that are moving toward this idea and it's been it's been a rather strong

[42:38] movement since 2008 and there are all kinds of studies propo

[42:43] and proposals for legislation you can google the bank of north dakota

[42:48] to explore their reports from recent years here's what we know from their

[42:52] reports and research from other financial institutions

[42:57] in 2020 the bank of north dakota was able to extend

[43:02] 1.7 billion in ppp loans

[43:06] through community banks to small businesses

[43:10] that is roughly 2 200

[43:14] per resident of north dakota in the same period community banks and

[43:19] credit unions in new mexico did lend 1.2 billion in ppp loans to

[43:27] small businesses coming to about

[43:31] 570 dollars per resident in in new mexico community banks did

[43:38] help 9500 small businesses but in north dakota 20 000 small

[43:45] businesses were able to get help thanks to early efforts of the bank of

[43:50] north dakota and those relationships that community banks and credit unions

[43:55] already had established with the residents of their counties

[44:00] community banks and credit unions are in fact

[44:04] invested in their communities they know their communities and want to see their

[44:09] communities prosper and that is exactly why the public bank partners with them

[44:18] go ahead how do municipalities and counties

[44:23] benefit from a state bank

[44:26] municipalities and counties always have needs for infrastructure for buildings

[44:32] to house health centers schools child care centers farmers markets etc

[44:39] rather than taking out a loan i'm sorry taking out a bond that costs

[44:46] much more because of the many service fees why not borrow money from a state

[44:52] public bank the best part is when that loan

[44:56] at a very low interest rate is repaid the return on on investment comes back

[45:03] to the public bank which then provides more money to be

[45:08] invested in your community or another new mexican community

[45:13] new mexico grows resources for investments rather than allowing

[45:19] them to leak out of the state to corporate bank shareholders

[45:27] also when community banks can expand their

[45:31] customer base by providing access to more loans the whole community gains

[45:36] more money is circulated locally and pretty soon

[45:40] main street starts looking brighter well the next question was how will a

[45:46] state-owned bank be started and how will it be able to sustain

[45:52] itself the plan

[45:54] uh from both the bill and and the earlier earlier

[45:59] business business plan

[46:02] uh is that the public bank would be capitalized with 50 million

[46:07] from the state severance fund then a second to 50 million would be

[46:12] deposited by the state from funds it currently has deposited in global banks

[46:19] the original the original deposit would be used to leverage as much as 10 times

[46:25] the amount to offer the first loans the interest paid from those loans is

[46:32] what sustains the bank and builds a foundation of funds to be reinvested in

[46:38] thousands of projects all across the state of new mexico

[46:45] last question how strong do you feel about being

[46:50] endorsed by the locally owned banks with your efforts

[46:55] have you requested their support if so what are the results regarding

[47:00] support or lack thereof

[47:04] we would very much like to have the support and endorsement of community

[47:09] banks just as we have the endorsement of the new mexico state credit union

[47:14] association we have requested their support and our

[47:18] leadership has tried to gain the support of the new mexico independent community

[47:24] bankers association however that organization is currently

[47:29] rejecting the idea of a public bank because they believe erroneously that a

[47:36] state bank would be their competition we are not certain how many new mexico

[47:43] community banks are actually members

[47:46] of the new mexico independent community bankers association

[47:51] only five are listed on their website as affiliate members

[47:56] we believe that that means

[48:00] that they mean well but just do not understand the way this

[48:05] legislation could actually help them grow

[48:09] just as has happened in north dakota north dakota now has

[48:15] more community banks per capita than any other state in the

[48:21] union new mexico like many other states has

[48:25] been losing community banks to big corporate banks

[48:32] and that's the end of us addressing those five questions we would

[48:38] welcome the opportunity to elaborate on those questions or answers and anything

[48:44] else that you have and also perhaps pat would like to speak with regard to local

[48:50] interest

[48:55] yes thank you um just briefly um harold those are great questions that

[49:00] actually covered the ground that i was going to cover so that makes my job

[49:03] easier so what i'll do is just briefly tell you that our 12 year old intern

[49:08] aydah at the peace and justice center um wanted to present to you today but i

[49:13] couldn't work out the logistics so i'll just convey to you what she had to say

[49:18] she has studied this for months the public banking

[49:21] act and the north dakota model and she really wants to see it for new mexico

[49:27] and there are some really specific reasons why she's amazing she says she

[49:32] wants you all to take the circle or loop approach

[49:36] rather than the straight line because the straight line model

[49:40] is our money

[49:43] immediately leaving the state potentially up to half

[49:47] of what a project could cost leaving the state and going into the pockets of wall

[49:52] street investors she wants you instead to take

[49:55] the circle model as the one you support where the money stays right here there

[50:00] aren't fees and

[50:02] interest that go off out of state to other people it all stays here and we

[50:07] can save a lot of money and make projects up to 40 percent more

[50:12] affordable so ada asks what's a project in san

[50:16] miguel county that

[50:18] we're really committed to that we need money for and right away i mentioned the

[50:23] the treatment and recovery center that you all have recently voted to be the

[50:27] fiscal agent for thank you for that this is something since 2003 the peace and

[50:33] justice center has been asking for and working towards along

[50:37] with a lot of others so that's an example of a project so how

[50:41] would that work through our banks ada and her friends would come to you the

[50:45] county would say yep we're going to fund a portion of that let's look into that

[50:48] let then you will go to our local bank then they will go on our behalf to the

[54:28] in house bill 4 of the first session of the 55th legislature urging the new

[54:32] mexico legislature to provide more resources for behavioral health

[54:37] prevention and treatment since behavioral health issues are at the root

[54:41] of root cause of many civil rights claims against local governments and

[54:45] recommending damage on any new civil rights cause and

[54:49] actions as funding for any increased costs associated with this and so we

[54:55] have miss our manager melinda gonzalez to present

[55:00] ms gonzalez

[55:26] house bill 4 has been introduced to the legislature that would allow

[55:32] caps to be removed for lawsuits against law enforcement and would allow people

[55:37] to sue individuals in actions that they do

[55:41] on behalf of the counties or local governments that they

[55:45] um that they served

[55:48] um and what this bill is going to do is

[55:51] because that there's open-ended amounts of monies that could be claimed

[55:56] on these axes it's going to make the counties uninsurable

[56:00] and so in association with the association of counties

[56:04] and with other counties we're sub we're asking for this

[56:08] resolution to be passed opposing house bill 44.

[56:13] house bill four sorry and i could read the resolution if you

[56:19] would like me to i'm sure please

[56:23] whereas in law's 2020 first special session chapter one

[56:28] in house bill 5 in response to certain high-profile

[56:31] civil rights violations by law enforcement officers in other

[56:35] states the new mexico legislature created the new mexico civil rights

[56:39] commission to develop policy proposals for law

[56:43] for the creation of a civil right of action for the deprivation by public

[56:47] body or person acting on behalf of or under the authority of a public body of

[56:53] any right privilege or immunity secured by the constitution of new mexico and

[56:58] whereas the divided commission voted by board to recommend that the legislature

[57:02] create a new state law cause of action for violations of the new mexico

[57:06] constitution that would not include a cap of

[57:09] compensatory damages which is a break from a lost long-standing balance struck

[57:14] in the new mexico towards claim act between compensating those harmed by

[57:18] government action and the public good and it would mandate reward of

[57:22] litigation expenses and attorneys fees for prevailing plaintiffs which can

[57:26] exceed the damage awards to plaintiffs and are based upon hourly rates over 450

[57:31] an hour and whereas the commission's recommendation

[57:35] legislation was largely introduced into the first session of the 55th

[57:39] legislature of the state new mexico as house bill 4

[57:42] and whereas a new cause of action is unnecessary to address new mexico's

[57:47] constitutional deprivations by law enforcement officers including detention

[57:52] officers at county jails since the tort killing act already waived sovereign

[57:57] immunity for such claims in qualified immunity is not a defense to such claims

[58:03] and whereas the parts claim act allows plaintiffs to recover damages awards up

[58:08] to one million fifty thousand and does not allow for the recovery of litigation

[58:13] expenses and attorney fees and whereas the new mexico towards claim

[58:17] act balances compensating those damages by

[58:21] government action and the public good since the insurance premiums and

[58:25] uninsured claim costs take money that would otherwise be available for

[58:29] essential government services and whereas research by the new mexico

[58:33] counties presented to the commission demonstrated that new mexico one of the

[58:38] poorest union already allows for some of the highest damage awards in the county

[58:43] for state law claims against law enforcement officers and whereas

[58:47] eliminating caps and mandating the award of litigation expenses and attorney fees

[58:51] will increase the cost of claims and will likely encourage more claims to be

[58:55] filed and whereas new mexico counties and other governmental entities also

[59:00] demonstrated that a new cause of action would cause reinsurance and other

[59:04] insurance coverage to no longer be available to the new mexico county

[59:09] insurance authority and whereas the inability unavailability of reasonably

[59:14] priced insurance will cause local governments to self-insure significant

[59:18] risk which will divert scarce resources from

[59:21] the very services that proponents of the new cause of action are trying to

[59:25] improve to individual claimants and their

[59:28] attorneys and whereas the new cause of action

[59:31] carries the risks of unintended negative consequences including the elimination

[59:36] of services or the privatization of services

[59:39] whereas uninsured judgments that cannot be satisfied through existing resources

[59:43] will be paid by our citizens through property taxes levied to meet the

[59:48] judgment whereas many challenges faced by local

[59:51] law enforcement and county jails stand for concurring

[59:55] substance abuse and mental health disorders in the population with

[59:59] which they interact and whereas instead of diverting resources to individual

[1:00:04] claims the legislature should be providing more resources to serve this

[1:00:08] population which would minimize their interaction with law enforcement and

[1:00:12] keep them out of county jails and whereas information presented to the

[1:00:16] commission demonstrated that the new mexico law

[1:00:19] enforcement academy needs additional resources to better train law

[1:00:23] enforcement officers and timely discharge its goal of investigating law

[1:00:27] enforcement officers accused of misconduct

[1:00:30] and whereas timely removing the certification of so-called bad cops

[1:00:35] would more effectively and quickly meet the goal of improving law enforcement by

[1:00:39] avoiding the recycling of such bad actors among law enforcement departments

[1:00:44] and whereas a new cause of action would apply to any public body defined as

[1:00:48] state or local governments an advisory board a commission an agency or an

[1:00:53] entity created by the constitution of the new mexico

[1:00:57] of new mexico or any branch of government that receives public funding

[1:01:00] including political subdivisions special tax districts school districts and

[1:01:04] institutions of higher education or a person acting on its behalf

[1:01:09] where such a broadly drawn cause of action could have far-reaching

[1:01:12] ramifications in areas not duly considered by the commission

[1:01:16] including actions by former students against

[1:01:19] school districts for failing to provide adequate education as recorded as

[1:01:23] required by article 7 section 1.

[1:01:27] now therefore be resolved by the board of county commissioners

[1:01:30] of san miguel county it opposes house bill 4 in its current form since it is

[1:01:35] unnecessary because victims of state constitutional violations by law

[1:01:39] enforcement officers including detention officers can already

[1:01:43] bring lawsuits for money damages for violations of the new mexico

[1:01:47] constitutional rights under existing law it will not address the root cause of

[1:01:52] any claims against local governments namely the lack of adequate state

[1:01:56] resources to treat substance abuse and mental health

[1:01:59] disorders in our community it will further harden the public liability

[1:02:03] insurance market requiring local governments to self-insure more risk in

[1:02:07] creating the real possibility that property taxes will need to be imposed

[1:02:11] to meet uninsured judgments it will likely be ineffective at driving

[1:02:15] reform or otherwise improving law enforcement or other services

[1:02:19] because it will divert resources from law enforcement and detention officer

[1:02:23] recruitment retention and training and other critical services to claims and it

[1:02:29] may be unintended negative consequences such as limit eliminating critically

[1:02:34] high risk services reduction of resources to educate

[1:02:37] students in a return to privatization of detention facilities to transfer risk to

[1:02:42] private companies if a new state law cause of action for

[1:02:46] the deprivation of the new mexico constitution right is enacted it urges

[1:02:51] the legislature to enact caps on compensatory damages comparable to those

[1:02:56] in the tort claims act and not allow the award of litigation

[1:03:00] expense and attorney fees to prevailing plaintiffs which will increase the cost

[1:03:04] of all claims and will likely encourage more claims to be filed including those

[1:03:08] with minimal damages it urges the legislature to invest in

[1:03:12] behavioral health prevention and treatment to address the root cause of

[1:03:16] many law enforcement claims against local governments

[1:03:19] and revamping and improving the operations of the new mexico law

[1:04:07] and with legislation like this it could deplete the funds in that self-insurance

[1:04:12] fund to a place where we would not only

[1:04:18] jeopardize our being able to go out into open insurance markets but it would

[1:04:22] deplete the self-insurance fund to a point where

[1:04:26] we won't be able to recover from from you know many lawsuits without any caps

[1:04:32] and and uh and it would i think it would cause

[1:04:36] uh i think it would cause a huge deficit in

[1:04:40] the state's budget uh including the association of the county self-insurance

[1:04:44] fund and for that reason i i support this resolution opposing house bill 4 or

[1:04:50] senate bill 4. thank you thank you commissioner trujillo i i also

[1:04:56] agree with commissioner trujillo and our manager

[1:04:59] this is a very creative way

[1:05:02] to defund our law enforcement in new mexico and i

[1:07:32] start off by uh thanking all our agencies uh that have assisted us in

[1:07:36] step uh to get our county one day closer to

[1:07:40] the end of this pandemic uh it's been a long road we've been doing this for

[1:07:43] about a year we're all aware of that wearing our masks and washing our hands

[1:07:47] and seeing socially gifts from our families and friends

[1:07:50] but again i wanted to thank our summing guild fire department our sheriff's

[1:07:55] office the city of las vegas fire department

[1:07:58] the city of vegas police department

[1:08:02] our nmdot las vegas senior center uh

[1:08:10] i can't remember the other group name uh rotary club i'm sorry rotary club

[1:08:15] um also uh we'd like to also thank our east and west school districts for

[1:08:19] allowing us to use some of their facilities during our testing and

[1:08:22] vaccination sites uh also i wanted to to thank our hardest

[1:08:27] workers during the pandemic which is miss dominique martinez and her staff at

[1:08:31] the public health office also miss melinda uh carson bailey

[1:08:36] and all her life at home is the hospital mr matt probst uh at uh centro now

[1:08:43] they've all been working tirelessly uh almost seven days a week at all hours

[1:08:47] trying to get tests done and now moving into vaccinations for all our our

[1:08:52] community uh now we can move into some of the data i think uh uh

[1:08:57] mr trujillo uh uh supplying us with some gender that i

[1:09:00] sent him uh globally we're looking at just over 106 million

[1:09:06] cases of coronavirus right now globally as you can see further down here in the

[1:09:12] united states we're sitting just over 27 million cases which is more than double

[1:09:17] the next country yeah 10 million cases also we wanted to move into our our next

[1:09:24] page there if you would mr uh trujillo this is our local

[1:09:29] this is our local numbers for new mexico uh we're sitting at 177 uh um

[1:09:36] uh cases i'm sorry uh if you slide down on

[1:09:40] the screen uh obviously everybody knows that we are one of the few counties

[1:09:44] that are in the yellow one of six counties uh there's two criteria to get

[1:09:49] us into either yellow or green we in the last two weeks or the two weeks prior to

[1:09:55] this two weeks we did meet one of the criteria was uh having a positive case

[1:10:00] rate of less than five percent uh the new update for this will come out

[1:10:05] tomorrow and we're hoping that we'll still stay in the yellow

[1:10:09] i don't believe that we'll meet the green just yet but things are looking

[1:10:12] good if you look at all our cases throughout the state statewide there's

[1:10:16] been a few days that we had any cases here in new mexico

[1:10:22] part of the part of what makes up the the case count is how many tests are we

[1:10:27] doing here locally uh department of health and alta vista we're doing tests

[1:10:33] up to this past week so now we're moving into doing a

[1:10:37] curative test uh if you click on one of those uh next

[1:10:41] testing sites up on the top if you would so we've moved into curative oral saliva

[1:10:47] testing we're doing that four day week at our las vegas recreation center

[1:10:53] it's a very less invasive system that we do you

[1:10:57] schedule prior to going to the the site on thecurative.com website they ask you

[1:11:02] some general questions insurance information or if you don't have

[1:11:05] insurance they also ask you that um again it's an oral swab it's we ask

[1:11:11] the actual patient themselves to do the swabbing

[1:11:16] it comes in a little uh case like this it comes with the

[1:11:20] swab and a vial we then ask the patient to take the swab

[1:11:26] out of the out of the casing swab inside the right cheek for five

[1:11:30] seconds the left cheek for five seconds under the tongue for five seconds and

[1:11:34] the roof of the mouth for five seconds

[1:11:39] then we send it we put it in the uh enclosed um

[1:11:43] vial and we overnight them to a lab and the patient would receive the results

[1:11:48] within 48 hours of the day that they tested we took this over from the

[1:11:54] department of health so that they could primarily also off the vista hospital so

[1:11:59] that they could primarily focus on vaccination sites

[1:12:04] so like i said alta vista hospital and the department of health has ceased to

[1:12:09] do tests and that is taken on now with our departments and with the

[1:12:15] partnership of city of las vegas we're doing that at the recreation center

[1:12:18] again monday through thursday nine o'clock to

[1:12:21] 12. if you click on one of the other uh

[1:12:30] i believe that's one of the others so

[1:12:34] this is the site that i want to talk about

[1:12:37] on screening and testing if you click if you close into san

[1:12:42] miguel county or the city of las vegas it will show you the two testing sites

[1:12:49] if you pull down on the search bar there and you search by city location if you

[1:12:54] slide down further down if you would

[1:13:00] search by city

[1:13:05] and you scroll down further it's going to give you the two sites that are

[1:13:08] showing for testing availability in the city which is the city of las vegas

[1:13:13] recreation center which is a site that we are taking on

[1:13:16] and the other would be centro family health which is primarily focused

[1:13:21] towards their patients again there is testing available at the

[1:13:27] echoes valley medical center i'm not too familiar exactly how many

[1:13:31] days a week that they are doing it but it is available in that region

[1:13:35] obviously a lot of our constituents that live in the western part of the county

[1:13:39] frequent to santa fe to get tested

[1:13:44] so that's pretty much uh the testing part and challenge if we can move into

[1:13:49] vaccination now on one of the other so this first screen is the department

[1:13:55] of house registration screen uh we asked all the individuals if you would click

[1:13:59] there on the first uh tab create a new profile

[1:14:03] you fill out general information if you slide further down on

[1:14:08] just go ahead and slide down if you would

[1:14:12] general information contact information if you further down it's going to ask

[1:14:17] you for medical medical information this is the portion

[1:14:21] that is critical for individuals and constituents to to fill out if they're

[1:14:25] not honest with the system and have one of these qualifying underlying

[1:14:30] health conditions then it's going to be a little longer

[1:14:34] for them to get the event code for one of our vaccinations

[1:14:38] we have a lot of individuals that come to our sites and say i filled it out

[1:14:42] i haven't received a site i haven't received an event code

[1:14:46] then i ask them if i can help them with it come to find out that they still have

[1:14:50] some boxes that are read in their profile so it's it's crucial that if you

[1:14:55] if you have any trouble filling out this digitally

[1:14:59] somebody help you so that they can we can confirm that

[1:15:02] your profile is completed so that you do get the uh event code when we do have

[1:15:08] one of our qualifying vaccination sites our vaccination sites again are by

[1:15:15] appointment only we're doing vaccination sites at

[1:15:19] memorial middle school on on tuesdays and thursdays

[1:15:23] and we have different dates for the vaccination sites that we do at alta

[1:15:28] vista hospital also el centro is doing vaccination

[1:15:32] sites as well but they're trying to target their

[1:15:35] 75 and over audience which they have quite a bit of

[1:15:39] or or patience that fall into that criteria again when we do our our sites

[1:15:44] they are uh

[1:15:47] by appointment only so let's say we have an appointment like today we had an

[1:15:51] appointment i'm actually sitting here at our vaccination site at memorial middle

[1:15:55] school you would have received if you're in the qualifying

[1:15:59] you would have received that event code the week prior

[1:16:03] so on a vaccination site like this at memorial middle school we vaccinate

[1:16:07] 300 individuals on a given day so that event code gets broadcasted to six seven

[1:16:14] eight hundred individuals the first 300 individuals that get in there and

[1:16:18] schedule their appointment are the individuals that we get the list

[1:16:22] for to give vaccines to again department of house vetted vets those

[1:16:27] individuals to make sure that they're in the qualifying groups the qualifying

[1:16:31] groups right now we're finishing off anybody else that's left in 1a which is

[1:16:35] direct patient care direct medical care first responders

[1:16:39] and then we've moved into the first portion of 1b

[1:16:43] 1b is 75 and over

[1:16:46] and 16 and over with qualifying

[1:16:50] underlining health conditions it's going to be some time before we

[1:16:54] move into the the second part of 1b

[1:16:58] and then obviously moving into further down down the road 1c which would be

[1:17:02] probably not until the supreme portion it's hard for us to move into new

[1:17:06] populations because not only are we trying to to do first doses we still

[1:17:11] have to to vaccinate for the second dose or booster shot how they say

[1:17:16] uh for all these individuals so it takes some time to get through and

[1:17:20] get into new populations does anybody have any questions

[1:18:10] really good and they're they're ready for this vaccine

[1:18:15] and ready for this nightmare to be over so uh any any indication from from doh

[1:18:21] or from from the fed or anybody so if if uh mr trujillo populate that

[1:20:44] county um they have they have determined that to be based off of population

[1:20:50] obviously the metro and bernalillo county has a higher population donald

[1:20:54] county has a higher population so we're getting those vaccines to our

[1:20:59] constituents into our sites

[1:21:03] and no vaccine has gone wasted uh there's sites where

[1:21:08] we have a few things left over and we ask

[1:21:23] yes sir and

[1:21:25] anybody else have any questions yes thank you mr maestas for this update

[1:21:31] it's always informative and uh and um always learn a

[1:21:36] lot about what's going on but sometimes the more we learn this more we're

[1:21:39] confused so i was hearing conflicting information

[1:21:43] about when a member an individual who's tested positive

[1:21:47] can uh go out in public if they've been in isolation for 10 to 14 days if they

[1:21:53] could go out and not necessarily have to wait to get a negative test back is that

[1:21:58] the case of what the protocol is for behavior

[1:22:03] yes so the isolation period after a known

[1:22:07] positive is is 10 days after you test positive or

[1:22:12] 10 days after your last symptom

[1:22:16] i'm sorry 10 days after your first showed symptoms

[1:22:20] so 10 days of your positive test taken or 10 days from the first time you

[1:22:25] showed uh symptoms

[1:22:28] and you do not so

[1:22:32] you do not need to get a negative test to return to work

[1:22:36] because what we're seeing is that some individuals will will continue to test

[1:22:40] positive for two and three months after they've after they've uh

[1:22:44] acquired a positive test so it seems like that is new information

[1:22:49] or that we don't need to be worried that

[1:22:52] those people are going to be contagious or carrying

[1:22:55] the virus to others is that right yes that that's where the 10-day

[1:23:01] shedding period comes into effect okay not for okay thank you and i have

[1:23:05] one more question and that is about the um

[1:23:09] schools we know that uh it's up to the school districts whether or not they'll

[1:23:13] return in person and i'm asking about the pecos schools and i guess for all of

[1:23:18] our schools in our county uh what about the teachers and the school staff um

[1:23:23] are they in group 1b or would they be uh 1c

[1:23:28] unless they have underlying healthcare

[1:23:31] right so again one one a is uh direct patient care

[1:23:37] so that any type of uh physician dentist

[1:23:41] physical therapy anybody direct patient care one b

[1:23:45] is uh again cater is we have a chart or a ladder then one b

[1:23:51] and doc um i'm sorry uh um

[1:23:56] teachers and uh students well i mean not teachers uh teachers and

[1:24:02] uh child care i'm sorry teachers in child care fall under 1b

[1:24:07] we are we are targeting the first part of 1b uh on the direction of department

[1:24:12] of health and the state government to target those those groups primarily

[1:24:16] first uh when we first started

[1:24:20] um our 1b category not all our sites had uh

[1:24:25] access to the department of house website to send us a list of who's

[1:24:29] qualifying the first day we did a large site at

[1:24:32] alta vista hospital we did target all the groups in 1b which is essential

[1:24:37] workers which was

[1:24:40] teachers direct

[1:24:42] child care 75 and over and 16 and over after we did that site department asked

[1:24:48] the whole state to not do that to only go off of the 75 and over in 16 and over

[1:24:54] that's how a few of our teachers were able to get their vaccine

[1:24:59] on that first go-around okay thank you for that

[1:25:04] it's been a continuing evolving situation every week things change from

[1:25:08] department of health direction where we go with things so um stay tuned every

[1:25:13] week like i said can things can change thank you i have one more follow-up

[1:25:52] site code for a vaccine site are based off of primary residents

[1:25:57] so if you're a resident of pecos which we see tons of people coming in from

[1:26:01] pecos and they have a hard time finding our vaccine sites because they're not

[1:26:04] familiar with our area as well you would get it from from

[1:26:09] our only county so if you're registered in from santa fe

[1:26:13] county you shouldn't be receiving a vaccine code for a vaccine site in san

[1:26:18] miguel county thank you so we'll be getting it for

[1:26:22] some first uh san miguel which will be to vegas that answers my question thanks

[1:36:27] last adopted salary schedule that

[1:36:31] has been approved by the commission just based on like the cost of living

[1:36:38] um and that is something that i really feel

[1:36:41] strongly and so does meeting with ms cedillo that we need to really work on

[1:36:46] and that goes hand in hand with really looking at the job descriptions making

[1:36:50] sure again we know what people are doing and what their expectations are and then

[1:36:56] at some point in time we would like to do a study to

[1:37:01] make sure that the

[1:37:04] pay scale is accurate and commence it

[1:37:08] and i guess if we compare it with other counties or

[1:37:12] with other jobs within the county that we make sure that we're on par with pay

[1:37:18] across the board all right yeah that's that that's one concern that i share uh

[1:37:23] i know that you know classifications are

[1:37:26] are identified based on the job duties of individuals and the ranges are

[1:37:31] classified by the duties of individuals and i know that that's become an issue

[1:37:36] most recently uh where

[1:37:39] where um classification is not really used

[1:37:44] or maybe not maybe i'm not using the right words but

[1:37:49] we really need to look at that and and try to update that because so that

[1:37:54] there's consistent pay range based on on duties

[1:37:59] by each division so thank you thank you for including on

[1:43:47] good afternoon um our communication project is is off

[1:43:52] the ground uh we made an award to code three incorporated out of albuquerque to

[1:43:59] uh update if you will our communication

[1:44:02] system throughout san miguel county through code 3 uh incorporated out of

[1:44:08] albuquerque we're using a company called uh codan who is a supplier who is a

[1:44:14] manufacturer and and engineers that design systems for such

[1:44:19] agencies such as the military and the fbi or some other big customers so uh we

[1:44:25] have uh we have confidence with this company that they're going to do as

[1:44:30] good a job as possible for for us rural new mexico and san miguel county

[1:44:35] up on the screen if you see the the tower sites that we use

[1:44:41] those in yellow turkey mountain pacheco tower

[1:44:46] apache trujillo and quintus sites those are the

[1:44:49] sites that are going to be upgraded at this time uh we are repeat replacing our

[1:44:54] existing simulcast system uh which is an

[1:44:58] analog system that's at least 20 years old we're gonna replace that system with

[1:45:03] a digital and analog system so the system will

[1:45:08] have the capability uh here uh with san miguel county fire and the sheriff's

[1:45:13] office we have the capability of of talking on a digital level so we'll be

[1:45:18] using that system but we wanted to also have

[1:45:21] the the ability to talk in analog with our partners such as the city fire

[1:45:26] department which are using analog radios we didn't want to have we didn't want to

[1:45:31] lose that capability so we're going to upgrade this system

[1:45:36] not only are we upgrading the system it's going to upgrade our coverage area

[1:45:41] and so we should have almost the entire company covered with

[1:45:45] this upgrade we are looking at the future for

[1:45:49] for the western part of the county there's a because of the mountainous

[1:45:53] areas in that area we do have some difficulties at times getting

[1:45:57] communications in some of those areas but we have uh

[1:46:01] identified a couple of possibilities but that is uh the

[1:46:06] one of the features of the new system is that we can expand uh in the future

[1:46:12] without uh having to go back and redesign the system so we've identified

[1:46:17] you know right now we have one of our frequencies one of our towers up on elk

[1:46:21] mountain that seems like that would be a very

[1:46:24] uh suitable site to add to this simulcast system

[1:46:30] we've started some talks with the us forest service that's their tower

[1:46:36] we do have one of our repeaters on there um we want

[1:46:40] to uh [Music]

[1:46:42] change that repeater site and and bring it into the simulcast system

[1:46:47] um so

[1:46:49] and to explain a little bit what the simulcast system does is is as you're

[1:46:53] driving throughout the county uh

[1:46:56] in in our radio system uh say um you know from here from the office if i talk

[1:47:00] on my radio it's probably gonna hit the pacheco's

[1:47:04] site because it's closest but as i'm driving through the county it

[1:47:08] automatically detects which site is stronger for me to use so it gives its

[1:47:13] it simul it'll simulcast it'll simultaneously transmit to another site

[1:47:19] that's stronger closer without me having to do anything on my end which is a is

[1:47:24] is great for us uh you know there's there's other systems that you have you

[1:47:28] manually have to change channels as you travel throughout large areas with this

[1:47:33] system we don't need to do that it does it automatically

[1:47:37] so you know we're very excited to see this project uh off and running right

[1:47:42] now they're in the engineering uh engineering and purchasing of

[1:47:46] equipment phase hopefully within the next three months

[1:47:50] or so they'll start putting together that system so this company will do

[1:47:54] they'll they'll build our system

[1:47:57] at an off site location at their at their location they'll build our entire

[1:48:01] system test that take it all apart bring it

[1:48:05] down here and put it up in our top in the towers that we use

[1:48:09] um the towers that we're using none of uh

[1:48:12] the trujillo site tower is the only tower that we own uh all the other sites

[1:48:17] and i'm sorry about that concha site is well owned that tower as well but turkey

[1:48:22] mountain uh pacheco apache uh and elk mountain we we rent space on

[1:48:28] those towers uh from from the uh tower owners uh most towers now are owned by

[1:48:33] american tower company uh so we all we rent space on those towers the trujillo

[1:48:38] site we rent the land but the tower itself is ours uh same with conchas will

[1:48:43] own the tower site um and and that one's going to be a new site that'll tie into

[1:48:48] this existing system the total project hopefully

[1:48:53] hopefully in the next eight months will be completed

[1:48:57] um so we're you know we're really excited to move into

[1:49:00] some new digital age technology i have a question mr duran

[1:49:07] this particular project is one of my pet projects that i

[1:49:12] gave to the manager two years ago when i took office um my district is up

[1:49:18] in gaines cover is a good part of gaines how how can we be assured uh to the

[1:49:25] to the people in gaines in pecos in gonzalez

[1:49:31] and up in the area near laba and and tapia how can we assure them

[1:49:37] that this service is going to be something that they can depend on uh

[1:49:42] particularly our emergency response uh providers for example our sheriff's

[1:49:48] office the fire departments the ambulances how can we be assured that

[1:49:52] this is going to be the best possible

[1:49:57] project that we're working on to address the safety issue regarding

[1:50:02] the entire county

[1:50:07] uh chairman greece yeah we they've provided us coverage maps

[1:50:12] showing us the improvement that we'll see

[1:50:14] uh when this project is completed um we've uh if we uh me along with the

[1:50:20] emergency manager the sheriff's office have been in contact with the vendor and

[1:50:24] he provides us these coverage maps that shows us where we are to where we were

[1:50:28] today and where we will be uh once this project is completed and we will have a

[1:50:34] large portion of the county cover you know the western part of the county is

[1:50:39] is a little more difficult just based on the terrain

[1:50:43] because of the radio waves as they travel across the air um it is a little

[1:50:48] more difficult but right now that that area of the county

[1:50:52] has good coverage from the santa fe site that part of the county is dispatched

[1:50:57] out of santa fe regional dispatch center so there is good coverage in that area

[1:51:02] from the santa fe side but eventually we want to tie that into

[1:51:06] our our central location here in las vegas uh uh conscious side the eastern

[1:51:11] part of the county was another part of the county that the sheriff's office

[1:51:15] especially you know they once they traveled so far from las vegas they lose

[1:51:20] all communication with the guests with artist 5 center um

[1:51:24] once we get this conscious site up and running over the entire project we'll

[1:51:28] have coverage all the way down into the eastern part of the county as well of

[1:51:32] course a little more flat in that area but um

[1:51:35] this this this project will improve communications uh

[1:51:40] quite a bit okay and then one more question there's

[1:51:45] there's a tower that was installed at the pueblo fire station uh is that tower

[1:51:51] already being used and is that tower and other potential for the communication

[1:51:56] that we're we're talking about now i

[1:52:00] uh chairman garcia correct there is a an atm t tower that was built

[1:52:04] on us on one of our fire station sites out there

[1:52:08] right now we are not using that um we

[1:52:12] the pueblo fire department um wanted to use

[1:52:16] that for their own channel out in that area

[1:52:19] i think the best the best interest overall is is to wait and see how we

[1:52:25] can either tie in that that site or the elk mountain site or both into our

[1:52:31] existing simulcast system rather than it rather than being rather than using that

[1:52:36] tower for a one channel site for a specific department if it's if it'll

[1:52:41] work to tie it into our simulcast system it would not only benefit that

[1:52:46] department but it would benefit all our departments including the sheriff's

[1:52:50] office the vendor is aware of that site

[1:52:54] they will they will be running some coverage maps from that location and as

[1:52:58] well as elk mountain and uh and also there's also a power up on romesa that's

[1:53:04] owned by the uh uh faa i believe so that they'll run

[1:53:08] coverage maps and from there we'll we can decide which will be the best option

[1:53:13] on those three sites to tie into the system

[1:53:51] can can we expect this this vendor to be to be there uh for us and and to get you

[1:53:58] guys up and running quickly

[1:54:06] using this vendor for several years we have a a maintenance contract with

[1:54:10] them they may they currently maintain our system now um one of the

[1:54:16] advantages of the new system is is so at each site there's

[1:54:20] what's called a rack and that rack has if you will the brains of the system

[1:54:25] well when we now that we're doing our new system they will actually house a

[1:54:30] spare rack at their shop and if one of our racks goes down it'll

[1:54:34] be a matter of them driving that rack to the site and replacing that and we'll be

[1:54:39] we'd be back up and running uh in a matter of

[1:54:43] the time it takes them to replace that rack

[1:55:43] uh system for their uh

[1:55:45] out in that area okay

[1:55:50] but there's not like anything else like such of the cell phone services or

[1:55:54] anything that could be on there

[1:55:58] right now no one has approached us of uh of that need um the other towers that we

[1:56:03] have that sure not that we have that we have our

[1:56:07] equipment on such as pacheco and and turkey mountain those sites are being

[1:56:12] used by multiple companies from cell phone to gp

[1:56:15] but it's not from they're not leasing from us they're just

[1:56:19] on the same tower

[1:56:54] commonly used a plateau that they would um

[1:56:57] lease or use this tower to improve cell phone reception for people there

[1:57:08] is it is a atm t tower they built the tower for their service

[1:57:14] so that that area should have seen a huge improvement from atm t

[1:57:20] coverage area

[1:58:25] emergency fund that we have for for fire services that was also used to cover

[1:58:30] this cost sounds good thank

[1:58:40] mr chair also for the record part of the monies that were transferred to the

[1:58:43] emergency funds for this tower came from

[1:58:47] general sources from the general county from the i don't know if it was from the

[1:58:51] general fund or from one of our grocery seat taxes that are outside of the fire

[1:58:54] departments so 150 000 was transferred to those

[1:58:59] um to allow for um

[1:59:02] this project to take off also and thank you chief duran for all your

[1:59:06] expertise in this area thank you madam manager and thank you

[1:59:11] fire chief duran for the exceptional presentation today any any other

[2:00:21] is providing a stipend to our law enforcement and our detention center

[2:00:26] personnel since they're out in the community and

[2:00:30] are around people or have the possibility of

[2:00:34] being around people who might be positive with covid so it was provided

[2:00:39] as a stipend and given to a number of employees in

[2:02:10] canyon fire district the

[2:02:12] site is going to be at the marbusa springs hatchery uh we did receive

[2:02:18] i believe there was a total of six bids uh surprisingly you know we you know we

[2:02:24] sometimes we don't receive a lot of bids or a lot of interest in

[2:02:27] these projects but we did receive six bids for this project

[2:02:31] all the bidders met the the requirements during the bid

[2:02:35] opening the lowest bid was submitted by new image construction

[2:02:41] we did receive one additional bid that was uh emailed to the architect

[2:02:46] but that was uh excluded based on the definitions outlined in the bid packets

[2:02:52] that uh identified that bids had to be

[2:02:55] delivered to our administration office building and

[2:02:58] could not be emailed to the uh

[2:03:01] architect um i

[2:03:04] the the total uh the base bid project uh the

[2:03:08] bid from new image construction is 774

[2:03:13] 904 dollars um

[2:03:17] we have we ask for your approval and awarding this bid to new image

[2:03:20] construction uh we are hoping that once this award is made and

[2:03:26] and permits are obtained the construction will start uh shortly

[2:03:30] thereafter i believe the the uh architect included a 160 day build

[2:03:37] time for this project so hopefully we can have a new fire station uh in a few

[2:03:41] in a couple of short months thank you mr duran

[2:03:46] madam manager um have you reviewed this and are you

[2:03:50] good with the budget uh how does it reflect

[2:04:06] this project will be funded through several different funding options we did

[2:04:11] have uh the department did receive a state fire grant

[2:04:17] and they they also have a 501c3 which has also

[2:04:22] contributed a significant amount of money to this project and with savings

[2:04:27] that they had over the years within their own

[2:04:30] budget planning for this project so we are within budget for the project

[2:04:36] as far as far as our finances matter manager

[2:04:41] um mr chair and commissioners um yes we are later on during the meeting we're

[2:04:45] going to be as part of our mid-year budget request we're going to be

[2:04:49] asking for approval of an additional seventy five thousand dollars 501c3

[2:04:54] probably two months ago they had committed to give a hundred thousand

[2:04:57] they kicked in an additional seventy five thousand plus our fire chief has

[2:05:01] allowed a internal loan from some of the grocery

[2:05:05] seat tax resources that they have tied to fire excise tax

[2:05:09] which will be backed by the pecos volunteer fire department over a seven

[2:05:13] year period um this pretty much does um

[2:05:17] will wipe out their operating budget but again they'll begin next year with that

[2:05:21] and they'll be able to provide funds back to the fire chief for that portion

[2:05:25] but yes once that budget adjustment is approved yes and we shall have

[2:05:31] sufficient funds sounds good thank you very much thank

[2:07:23] give you an update and i know leo and possibly arnold will give you probably a

[2:07:27] little bit more information but i want to give you an update on just the

[2:07:30] technology bridge um just as of today i talked to leo maestas in regards to the

[2:07:36] bridge and we got state and fema approval to move forward on the bridge

[2:07:41] um i talked to miller engineering who is the engineering firm on site for this

[2:07:46] project and they sent uh an advertisement form to melinda today

[2:07:52] so we can move forward in the advertisement uh probably the

[2:07:56] albuquerque journal and the in the optic uh we're looking at the

[2:08:00] advertisement going out february 17th and then and then we have to because

[2:08:06] it's a federal project we have to advertise for three weeks

[2:08:09] so we're looking at opening up packages bid packages march 11th

[2:08:14] um and then um then we come back to

[2:08:18] commission uh to award uh the the contractor based on our bids

[2:08:24] uh april 13th at the commissioners uh meeting april 13th for the contractor

[2:08:30] um as you remember this bit this bridge did go out to um

[2:08:34] to bid once before but it was a full construction

[2:08:38] uh presentation and we were well over budget of what was allowed this round

[2:08:43] we're going with the original scope of work

[2:08:45] uh to stay into budget uh which is about 750 000

[2:08:50] and um and so we're keeping uh our concrete

[2:08:54] abutments and and so the scope of work has changed but we have rece received

[2:08:59] approval uh as as the design for the engineer so we got

[2:09:04] approval that from and that was confirmed by leo

[2:09:08] so that that's pretty much i want to give

[2:09:10] you some dates uh for a timeline for that bridge i know uh this is this has

[2:09:16] been in the works for a few years to try to get that bridge repaired

[2:09:21] and uh honestly with federal money it takes a little bit longer and the

[2:09:24] process is longer so um i'll have any questions and if need be

[2:09:29] leo or the road forming arnold lopez can and

[2:09:33] touch baseball anything that about the project

[2:09:37] i i'd like to make a few comments mr garcia and i'd like to maybe

[2:09:43] ask questions of you you know this project

[2:09:48] as far as i'm concerned is a very important project it's

[2:09:51] it's it's a bridge that was declared a disaster back in 2014

[2:09:57] almost seven years ago you know we declared a fema

[2:10:02] declaration a federal emergency management declaration

[2:10:06] and i'm a bit concerned that it's taken almost seven years to get it

[2:10:11] done can you go over the timeline

[2:10:15] and then also being that this is such a

[2:10:20] crucial piece of public works uh in san geronimo

[2:10:26] area you're providing that i'm not an update

[2:10:29] but it it's not a written update and so it's hard for us to digest

[2:10:36] this update because it's already followed by

[2:10:39] three or four previous updates that have not been

[2:10:43] uh fulfilled

[2:10:45] and so how can we be assured uh with it being as long as it's been

[2:10:50] how can we be assured that this is going to be the final

[2:10:53] uh time this that this comes before us

[2:10:58] and that it goes into construction so that we can finally have this bridge

[2:11:03] addressed seven years later and i'm asking that question of you mr

[2:11:07] garcia

[2:11:10] so so i

[2:11:13] i certainly uh

[2:11:17] share your concern chairman garcia 2014 when there was this disaster that there

[2:11:23] was some serious damage

[2:11:26] uh to the bridge and uh and with with care miller

[2:11:30] engineering has looked over it and uh tried to see the process of

[2:11:36] some of the recommendations that honestly were prior done to me you know

[2:11:40] and i think the processes that mr maestas has taken through fema to

[2:11:45] secure funding uh federally to try to help that because

[2:11:51] some of these bridges are expensive to repair and uh and i have

[2:11:55] been given an insurance from uh mili engineering that there are no costs on

[2:12:00] his end

[2:12:02] uh to move forward for

[2:12:05] for the engineering services and and the state and the and according to mr maya's

[2:12:10] the state and fema are going with the recommendation of our of our engineer

[2:12:14] and we are moving forward uh with it and um and so

[2:12:19] i don't know if we could call that the scope of work has been uh reduced but we

[2:12:23] are keeping the concrete abutments now that would we that would give us

[2:12:28] move the project into budget um this last presentation that we had

[2:12:32] back in november where it didn't meet budget because it was like

[2:12:38] 250 000 over budget

[2:12:42] um at least that i'm sorry we must have an emergency uh

[2:12:45] thing on our phones um uh so we the scope of work is supposed to be within

[2:12:51] budget and move the project forward

[2:12:57] okay well uh what i would like to do is have money

[2:13:04] can add to inside of the budget and the of the approvals that were given from

[2:13:09] state and fema and fema

[2:13:23] [Music]

[2:13:28] mr chair and commissioners um regarding this particular project at the time that

[2:13:32] the agenda was put together we had not received any notification from the state

[2:13:36] of new mexico whether they had approved this change of services or

[2:13:41] whether they had authorized us to continue with going out

[2:13:45] for bid this is just something that was just

[2:13:48] very recent a matter of fact leo called me during the lunch hour

[2:13:52] indicated that he'll be forwarding that information to me i'll be looking at it

[2:13:56] to make sure that i fully understand what's going on with the project and

[2:14:00] that we address anything right away that needs

[2:14:03] to be addressed there's been several extensions for this particular project

[2:14:07] and just to kind of give you some brief um

[2:14:10] background on it and i might error in some of this but when the bridge was

[2:14:15] actually declared as disaster most of the time that fema provides you with

[2:14:19] funding they'll provide you funding to get something restored to its original

[2:14:23] um situation too where it's original um building verb

[2:14:29] thank you there's the word and at the point in time the engineers that we were

[2:14:33] working with um had indicated that it would probably be

[2:14:37] in the best interest of the county to actually build a new bridge so at that

[2:14:41] point in time our office of emergency manager was working

[2:14:45] with fema and our county manager at the time

[2:14:49] and they had approved a bridge could be built and that's really something that's

[2:14:53] out of the norm but then there was a lot of turnover

[2:14:56] with fema and we had turnover internally as well and when the project got

[2:15:00] readdressed it was determined that that's no longer going to be the case

[2:15:04] that the county would have to go with the existing structure and bring it back

[2:15:08] to its current condition since then several extensions have been

[2:15:13] requested of the state i believe in leo correct me if i'm wrong i believe the

[2:15:17] current extension is through april no an extension cannot be requested until we

[2:15:22] get closer to like a 30-day period within that particular point in time at

[2:15:26] that time leo will reach out to the state and request another extension of

[2:15:30] course the state knows where we're at because they had to

[2:15:33] provide the approval to proceed with

[2:15:36] going out for bid again and again i'll be looking at that documentation and

[2:15:41] we'll make sure that we're meeting collectively

[2:15:44] the office of emergency management the road department and myself to make sure

[2:15:47] that we're on top of what's going on and to make sure that we report to you and

[2:15:51] let you guys know if there's any concerns or just to kind of let you know

[2:15:54] what the status is thank you thank you madam manager

[2:15:59] the concern that i have is the the safety of the bridge you know i know

[2:16:04] uh i was here when we declared that bridge of disaster

[2:16:08] uh i was here almost a year after the disaster

[2:16:13] and we had to do some temporary repairs to the bridge

[2:16:17] which which we did and i understand those temporary repairs

[2:16:22] are still on it in the meantime you know here we are seven years later

[2:16:26] and it still hasn't been done so i i must say that i do share that concern

[2:16:30] and it without without

[2:16:34] me sharing the concern it would not be me doing my job and so

[2:16:38] um i appreciate that this is getting done i appreciate that you're

[2:16:42] keeping us updated melinda uh this is something that we've been wanting for a

[2:16:46] while and i appreciate that it's finally getting done and let's hope that the

[2:16:50] state uh gives us the extension after april

[2:16:53] because if they don't then we're going to be in in worse in a worse situation

[2:16:57] so uh thank you and thank you gerald also for presenting

[2:17:09] taking up a scope of this work can you elaborate on that and see uh

[2:17:28] aware of any part of the work um is going to be uh part of the

[2:17:32] county's responsibility everything um

[2:17:36] uh and you can correct me if i'm wrong arnold on this but as far as i know all

[2:17:41] the work is gonna be part of the bid process

[2:17:44] uh in construction um the design is done and so

[2:17:49] the it'll be bidded out and that would be part of the contractor's

[2:17:52] responsibility for this project san miguel county uh public works will

[2:17:58] bear no responsibility in any of the of the work

[2:18:46] transportation district 4 for san miguel county public works division to

[2:18:51] participate in the in the lg rf which is our local road

[2:18:55] form uh road uh fund for 20 21 22 which is even

[2:19:01] next year's um

[2:19:03] i'm asking you to discuss and decide on three road projects which is the cap the

[2:19:08] school bus and the sp projects i need to submit by march 15th a scope

[2:19:13] of work unnecessary cost and quantities a match waiver

[2:19:18] and uh before the deadline of march 15th they

[2:19:22] i was on a zoo meeting last week with them and they would prefer if i could

[2:19:25] get that sooner to them than march 15th um i know last year we had a discussion

[2:19:30] uh with the commission uh about road projects for the lgrf and i'd like

[2:19:36] for you to have a discussion and talk about what your

[2:19:40] priorities are for the lgrf 2021 to all the way to 22.

[2:19:46] uh mr garcia do you or mr lopez have any roads that you would

[2:19:51] like for us to consider before i make a recommendation or before

[2:19:55] i make a request for for a road in my district uh do you or

[2:19:59] mr lopez want to present i'm going to have arnold lopez present

[2:20:07] good idea what are some of what he would like to see as a road project and then

[2:20:12] um whatever the commission decides uh that's what i will

[2:20:58] recommend one in every single district but um you know

[2:21:03] there are many needs but if you would consider pavement as priority i would

[2:21:07] appreciate that well i i i have one road in my district

[2:21:13] gerald that i'd like to request consideration of of course the county

[2:21:16] commission is going to be the final decision on where we go but i'd ask for

[2:21:22] my peer commissioners to consider

[2:21:25] uh funding for uh los fegiles in my district as one of the local government

[2:21:31] uh road fund uh considerations

[2:21:35] are there any other uh considerations or recommendations by

[2:21:39] the commission

[2:21:47] as a chief seal i think it's my favorite

[2:22:41] we're putting band-aids on on a deteriorating road and and i think you

[2:22:46] know it's it's high time that we we finish that road it's a

[2:22:51] very well used road people hundreds of people use it every day yeah

[2:22:56] winter and summer and i think it it's a worthy uh worthy project thank you

[2:23:14] has been started and we're off to and i would like to see that uh area

[2:23:19] completed and as well as uh a26a uh la manga

[2:23:24] that uh that's also a paved word uh road that could use some attention

[2:23:40] amount of money and we all have tremendous need i would like to see

[2:23:44] completion of the road in san ysidro i appreciate that we got funding

[2:23:48] the last year and they've been waiting a long time and then we could just finish

[2:23:52] that road for them and they could have a finished project that would be ideal

[2:23:56] also crb 56 i believe it's across from the dairy

[2:24:00] queen it's a paved road and it's in pretty bad shape but um those two would

[2:24:05] be my priority for um for funding

[2:24:10] okay uh daryl did you get those those

[2:24:15] roads that we've mentioned to you

[2:24:22] uh so it looks like we have two from commissioner senna one from

[2:24:53] one for co-op and one for school bus correct there are three projects and

[2:24:58] then we get to apply for the match waiver well typically historically we

[2:25:02] have always applied for the match waiver for the highest

[2:25:06] highest contracted bids so so if something comes up pretty high we try to

[2:25:11] go for our match whatever and and quite honestly we've been pretty successful in

[2:25:15] getting those match waivers yeah

[2:25:18] yeah if i hadn't just picked one i would pick sonny sidrow for now

[2:25:22] okay and and so arnold can i can i uh ask you to

[2:25:28] to based on those names that you've been

[2:25:31] given on roads uh can you tell us the status of each of

[2:25:35] these roads sir

[2:25:39] so in los vegas for example i'll start there

[2:25:43] that portion of of paved road is in dire need it's a very good uh choice

[2:25:50] good candidate for this funding

[2:25:54] um before you know their small amount

[2:26:00] i've always maybe stacking

[2:26:04] some of the grf's together we've done that

[2:26:09] utilize two one

[2:26:12] in order to really accomplish something and not not just create a small

[2:26:17] band-aid as per say but that is a a very good uh

[2:26:23] consideration there on panda rays

[2:26:27] in commissioner trujillo's district also is one that that we started

[2:26:33] san ysidro was started we have an lgrf for um bernal area

[2:26:39] and uh so forth i mean it's it's hard for me really just to

[2:26:44] um designate you know an area

[2:26:48] in all fairness to commission um we could always draw

[2:26:52] straws

[2:26:56] but any of those they're all good selections it's very difficult to to

[2:27:00] prioritize one they all hold a high priority

[2:27:04] in my opinion

[2:27:08] well i'm i'm i'm going to i'm going to extend

[2:27:12] a request for consideration for my district in las vegas

[2:27:17] and i hope that i can garner support for one fund for that particular project

[2:27:22] and i'll go ahead and say why you know that

[2:27:26] district one is a highly traveled

[2:27:30] district you know there there's there's traffic

[2:27:34] that goes through there on a daily basis school buses that go to

[2:27:38] their uh emergency units that go through there

[2:27:42] of course it happens uh at all the other roads as well

[2:27:46] um but i would i would venture to say that the traffic the amount of traffic

[2:27:51] that goes through my district there in los vegas

[2:27:55] is amazing on a daily basis and you know this project was

[2:28:00] was done way back probably 20 24 years ago

[2:28:04] when we first started at the county and if we don't continue with the upkeep

[2:28:09] of it uh we're going to end up having to do

[2:28:13] prayers to it and so i'm i'm going to solicit

[2:28:18] support from the commission on that and i'm willing to to um

[2:28:23] consider two other roads uh if

[2:28:27] if the commission is up to it uh mr chairman

[2:28:32] yes sir mr medina does that

[2:28:36] are you including that extension on eighth street gets back there

[2:28:41] in the winter times or even summer rain will that include that too

[2:28:47] is it the one north of it's like almost by williams drive that

[2:28:51] so that no that particular road uh

[2:28:55] there's been a debate it would be in the las vegas area yes

[2:28:59] sir i like i'm proud to be that i was part

[2:29:02] of that paving back in 2006 around there so i will give you my

[2:33:05] is really in two parts on the ambulance service

[2:33:10] the first part is a public discussion as as by the

[2:33:15] agenda to give the public an indication of what's been going on

[2:33:20] and and where we are going what some of the

[2:33:24] issues are the second portion

[2:33:28] will be done in executive session because it's a negotiation as provided

[2:33:33] for by the open meetings act

[2:33:37] a negotiation as to the the terms of the agreement the

[2:33:42] negotiation between the city and the county the negotiation

[2:33:46] between the county and the ambulance providers in this particular

[2:33:52] case at this point in time there was an rfp

[2:33:58] a request for proposals for ambulance service providers

[2:34:02] and there were two uh responses

[2:34:07] by superior ambulance

[2:34:11] and amr

[2:34:14] the rfp

[2:34:18] and the analysis and the interviews have occurred

[2:34:23] uh and some of the questions and considerations

[2:34:28] by for example the criteria

[2:34:32] was how much experience do each one of these

[2:34:36] companies have in the field of emergency medical

[2:34:40] service how well do each one of these companies

[2:34:44] have in the knowledge of the city of las

[2:34:47] vegas and of san miguel county uh technical implementation of the

[2:34:54] actual ambulance service a past record of performance

[2:34:59] by the applicants

[2:35:03] those are some of the evaluation issues

[2:35:07] uh that were provided the um

[2:35:14] i think that that the concerns that i have

[2:35:19] stem from the

[2:35:24] rfp the initial request for proposals intentionally

[2:35:31] eliminating the village of pecos and the pecos

[2:35:35] canyon and how are we going to use

[2:35:40] the ambulance that is located in that area

[2:35:46] the and i'm still very concerned because

[2:35:53] i real and it's hard to explain this but much of what goes on through this rfp

[2:35:59] and this negotiation some of it it can be publicly discussed

[2:36:03] and some of it all some of it has to be privately discussed on an executive

[2:36:08] session as the process goes so what i'm trying

[2:36:11] to do here is is discuss as much as i can that can be

[2:36:15] publicly discussed so

[2:36:18] what i see is a negotiation

[2:36:25] between the the city and the county

[2:36:28] as far as how much is it going to cost

[2:36:34] how much is the city going to pay how much is the county going to pay

[2:36:40] uh and how does that compare with previous years

[2:36:45] uh sometimes in previous years we had the city and the county each having

[2:36:50] their own separately negotiated contract the proposal here is to have the city

[2:36:56] and the county join together and select

[2:37:00] the provider

[2:37:03] based on some of the factors i talked about earlier

[2:37:06] and then try to decide how are we going to

[2:37:12] balance out the cost for example

[2:37:16] the city uh will have a majority of use by the ambulance service because they

[2:37:24] have the majority of the population the county

[2:37:29] stretches all the way to conchas rociada

[2:37:35] pecos the vianueva valley the pecos valley

[2:37:40] and so service there

[2:37:44] is critical um because everybody needs to be able to

[2:37:48] feel comfortable about being able to call the ambulance

[2:37:52] and have somebody and some professionals arrive

[2:37:57] even when the location of the family

[2:38:02] might be 30 to 45 minutes away

[2:38:06] the question becomes that we're

[2:38:09] dealing with is where the ambulance is going to be stationed

[2:38:14] and

[2:38:17] should the

[2:38:20] cost be born as fairly as possible and what is fair

[2:38:25] it's it's it's it all depends uh from what viewpoint you have if you're

[2:38:32] if you're on the county you don't want to be

[2:38:34] paying uh more for less service if you're in the

[2:38:38] city you don't want to be paying more for the same thing less service

[2:38:45] my biggest issue is

[2:38:50] this process has gone on basically without pecos and the pecos

[2:38:54] valley and i'm concerned about how do we

[2:38:59] continue service there

[2:39:03] and how much is it going to cost pecos to get involved in this

[2:39:09] three-way arrangement and where are those ambulances going to

[2:39:14] be stationed at that

[2:39:17] is something that i think where we will move now into or later on in this

[2:39:22] meeting to executive session uh to talk about the

[2:39:26] the financial details and the negotiation details

[2:39:34] nothing further at this point okay all right uh

[2:40:48] miguel county public is operating a solid waste transfers

[2:40:53] within the anton chico land grant

[2:40:58] we are trying to enter into an agreement

[2:41:02] between san miguel county solid and dimensions of guadalupe county solid

[2:41:09] waste department and the anton chico land grant

[2:41:13] so the purpose of this mou is we were approached by the members of

[2:41:19] um the land grant there in te colotito the anton chico land grant board

[2:41:25] so we've been operating there for for numerous years and i don't know how many

[2:41:29] exactly but it's been uh the operation there has been just a

[2:41:34] portion of the land grant it's not uh improved it's not fenced

[2:41:39] it's just a piece of property that is being utilized as a as a

[2:41:44] transfer location

[2:41:47] and uh we we have another mou established with guadalupe county and

[2:41:52] they're the ones that manage the solid waste collection you know within that

[2:41:56] area but uh when they approached us uh they're wanting improvements made to

[2:42:02] this area and what they're requesting of course is going to require some

[2:42:07] some dirt work some subgrade prep and then also some

[2:42:11] surfacing which will surface with our base cores we'll we'll utilize our

[2:42:15] equipment to do the dirt work within the arion

[2:42:19] and in their request they're requesting a fence a three-sided fence structure

[2:42:25] to contain trash and debris um they're kind of fed up with with the trash being

[2:42:30] blown all over that that area of the land grant and into neighboring

[2:42:35] properties so it's come to the point that we do

[2:42:38] need to do something for that area to contain the the trash

[2:42:43] so um when they approached about these improvements being that we do not have

[2:42:47] an mou established there and there was no time frame that we

[2:42:51] could utilize the property for i requested from them an agreement an

[2:42:57] mou that secures the property for so many

[2:43:01] years that way when we do the improvement

[2:43:05] we don't get pushed out of the property within a year or two

[2:43:10] the most that they would go on this mou is seven years they will let us utilize

[2:43:14] this property at no cost and um within the seven years um they

[2:43:20] can make some changes but it secures the property for seven years and then after

[2:43:26] that we'll have the option into entering into another agreement

[2:43:32] okay is there any

[2:44:11] so we're and this has already been improved also by our attorney so i think

[2:44:15] we're set to go with the mou it is going to come at a cost of

[2:44:21] erecting that chain fence chain fence that he mentioned and that's been

[2:44:24] included in our mid-year budget also public works will be able to

[2:44:28] enhance the crew and the equipment to be able to do the movement of the land to

[2:44:33] build the berms that are required for the mou so we're good to go

[2:46:09] snow removals we've been in in cow creek applying quite a bit of base course

[2:46:14] material um our concentration has been a lot this

[2:46:18] month on roadside safety which included uh deep

[2:46:22] bar ditches um within uh certain areas of the county

[2:46:27] and uh for example um we had some some concerns over on

[2:46:33] br b-27 in the myers uh

[2:46:37] montoya los montoya's area so we went in there and

[2:46:41] we filled in some deep bar ditches and did a bunch of improvement there held a

[2:46:45] bunch of material borrow material and have addressed those issues

[2:46:50] currently we're over on a um 26 a which is in la manga

[2:46:56] one of the roads there in commissioner senna's district

[2:47:01] also d bar ditches we went and did some roadside thinning of the trees first of

[2:47:06] all today we started applying materials and addressing those deep bar ditches um

[2:47:12] we're building check dams out of rock to to prevent further erosion in the hopes

[2:47:17] of once we we install this new material and and make those uh roadsides safe um

[2:47:22] they will stay in place for for a long period of time

[2:47:27] so um so currently i have uh johnny trujillo

[2:47:32] one of our blade men in that area addressing that

[2:47:36] um peter vege is over in in the pecos area still on

[2:47:40] on the road over to lower colonias we we've been applying base course there

[2:47:44] juan macias he's on the other motor grader he's over on the eastern part of

[2:47:48] the county he's addressing some roads in in trujillo and uh if this storm misses

[2:47:54] us i'll then i'll move him into conchas and he'll be there next weekend

[2:47:58] conscious um doing a routine maintenance out there

[2:48:02] i'll stand for questions or requests

[2:50:48] because i got another comment about um and they didn't fix the road in senna

[2:50:53] where they were supposed to where they dug it up so you could just keep your

[2:50:56] eye on that thank you

[2:51:08] being able to utilize our right-of-ways they are required in the permit to

[2:53:33] good afternoon um so in early september um

[2:53:38] we received a petition from samantha sandoval

[2:53:43] and company which which would be the the adjacent residents

[2:53:49] for a petition of adopting a stretch of county road

[2:53:54] at about 0.5 miles

[2:53:59] and our ordinance 67-5-5

[2:54:04] calls for any alteration establishment of a county road to have a petition of

[2:54:11] 10 freeholders we received a petition of 16.

[2:54:16] they provided their deposit to the planning and zoning

[2:54:22] so this request is basically to request approval from the commission or

[2:54:27] disapprove to

[2:54:30] conduct a road viewing so that we could come back and provide a

[2:54:34] recommendation to the county commission uh regarding this

[2:54:38] road so this road begins um

[2:54:42] if you take uh southbound i-25 and you get off and take a lot

[2:54:46] and you go under the underpass and then once you cross the underpass

[2:54:51] you head east it starts uh probably about 200 yards

[2:54:56] from from that intersection where mr kunisovich lives and then ends

[2:55:02] at the end where samantha sandoval lives so it's approximately half a mile

[2:55:08] uh it's a well maintained road

[2:55:12] so the action requested by the commission

[2:55:14] today is to approve and authorize the road viewing

[2:55:19] and direct the county commission to allow the county road viewers

[2:55:23] to conduct a road viewing so at this time i'll stand for questions

[2:57:02] and prior to making any kind of recommendation to the commission will

[2:57:06] ensure that the land grant is well informed of what's taking place and give

[2:57:10] their blessings if it's the recommendation is to adopt it

[2:58:15] to this and maybe that's an answer that our

[2:59:00] work that is being done by the county for all of us the

[2:59:05] basic rule is if i have a conflict of interest if you

[2:59:09] have a conflict of interest if you're going to benefit from

[2:59:13] county action directly or indirectly then what we do

[2:59:17] is we just raise our hand we tell the rest of the

[2:59:20] commissioners that as far as this agenda item is concerned

[2:59:25] i may have a conflict of interest because

[2:59:28] uh maybe i have a business concern i'll be benefiting financially or maybe

[2:59:33] because it's my primo who has is getting the contract or

[2:59:38] or because maybe i live in in

[2:59:41] tekkorote and so this road is really going to help me

[2:59:46] uh and the neighbors get in and out but that doesn't as long as it's been

[2:59:51] disclosed and everybody knows about it then

[2:59:56] u.s commissioners can go ahead and vote

[3:00:02] on the matter and

[3:00:06] with the knowledge of the potential conflict we can always through our

[3:00:10] manager uh

[3:00:13] supervise a little bit closer uh that

[3:00:17] that advantage or that benefit isn't being taken advantage of so

[3:00:21] my concern is not high with regard to

[3:00:26] [Music] employees

[3:00:29] benefiting directly or indirectly

[3:00:32] or even commissioners benefiting directly or indirectly as long as it is

[3:00:38] disclosed and as commissioners

[3:00:41] once it's disclosed you can vote on a matter that benefits you as long as you

[3:00:45] disclose it but probably the the safest way to go

[3:00:50] is disclose the conflict of interest and then abstain and let the rest of the

[3:00:54] commissioners decide whether it's in the best interest of the county

[3:06:24] may obtain like through the dfa quarterly report or

[3:06:28] through our normal budgeting report the information provided here is on a cash

[3:06:32] basis so

[3:06:34] it may not directly tie into our financials which is on a modified

[3:06:38] accrual basis and it's for informational purposes and

[3:06:42] i stand for any questions

[3:07:01] uh 20 resolution 2021 0209 f1 and we have our company manager to

[3:07:07] present mr chair and commissioners um i met with

[3:07:12] all the departments regarding the mid-year budget adjustments and it was

[3:07:16] just to get an idea of where we are if we needed additional resources to

[3:07:19] continue through the year to look at the revenues

[3:07:23] to see if we have any potential savings various items like that as far as the

[3:07:28] general fund i'm not sure if you want me to go through all these particular

[3:07:31] adjustments but in the general fund we did increase the revenue by a hundred

[3:07:35] and five thousand dollars and it's primarily tied to an increase in grocery

[3:07:40] taxes through a house bill that was passed by the state number of years ago

[3:07:44] where we're in the second year of the two-year funding and we're getting a

[3:07:47] double proportion there's also some expenditures that we

[3:07:50] decreased in the general fund and again we're just trying to see if there's any

[3:07:54] potential savings in the event that there's something that we need

[3:07:57] some of the expenditures that were reduced in the general fund um are tied

[3:08:01] to the sheriff's office it's capital outlay monies that we're

[3:08:05] hoping to put in fund 222 which is their capital outlay grow

[3:08:09] fund instead just to give them extra time to spend in the event that they

[3:08:12] don't expend it by the end of the fiscal year

[3:08:16] we have some changes in the road fund an increase of 70 thousand dollars in

[3:08:21] gasoline tax and this is really just to kind of give you some information when

[3:08:25] we worked on the fiscal year

[3:08:28] budget initially what the state knew because of this

[3:08:32] whole covid situation is that we're not going to be able to get together and

[3:08:35] really do what we normally do so for this year they allowed us to make a copy

[3:08:39] of what we did the prior year and and submit that as the approved

[3:08:44] budget so we tweaked it a little bit and some of the tweaks were just in case so

[3:08:49] we had decreased some of our gross receipt tax revenue because we just were

[3:08:52] not sure whether we would keep at the

[3:08:55] point that we were and we had reduced our gasoline tax and the gasoline tax

[3:09:00] was reduced based on what we received

[3:09:03] actually in may because we weren't sure exactly what the covet impact would be

[3:09:08] so we reduced it trying to be conservative but now that we look back

[3:09:12] back at it it's kind of gone back to its normal numbers and so we're increasing

[3:09:16] that some other changes is i know um gerald

[3:09:20] had mentioned about the match waivers for the lgrf we received notification

[3:09:24] that we had two match waivers on rlgrfs so we're reducing the transfer that's

[3:09:30] needed for to fund 202 by 70 000 um let's see if i wrote it down here

[3:09:37] it's also i have two forms the one that talks about the changes in words and and

[3:09:41] then this one where you could see the actual numbers

[3:09:45] but we have a additional

[3:09:48] revenue that will be coming in from the state of 70444 which um

[3:09:53] which allowed us to decrease the transfer that was needed for those algae

[3:09:57] rfs there's some other changes i talked

[3:10:00] about the fun2282 we had some reduction of cost in our crusher fund

[3:10:06] we had some adjustments with some of our dwy grants

[3:10:12] let's see our fire fund from 403 again is loaning

[3:10:18] the pecos volunteer fire department 50 000

[3:10:22] so we are

[3:10:23] adjusting for that transfer and reducing their expenditures since we're going to

[3:10:27] be money out we are

[3:10:30] also going to be receiving a waste isolation um

[3:10:33] to amount to seven thousand dollars and we've actually already received that

[3:10:37] we'll be reimbursing the fire marshal for some costs that he

[3:10:41] incurred on behalf of that um let me just go over some other items

[3:10:46] in our lodges tax again when we went and we created the budget we weren't really

[3:10:52] sure exactly what was going to happen with lodging so we had reduced the

[3:10:55] lodging to about 75 of what was normally received um and looking at the budget

[3:11:00] we're actually going to increase our request that the budget be increased by

[3:11:04] 20762 we're just going to leave that in cash

[3:11:08] right now our indigent fund i did budget an

[3:11:12] additional 50 000 um

[3:11:14] in anticipation of a negotiation but that 50 000 is for that and some other

[3:11:21] bills that we might have to be paying in the near future

[3:11:24] um for our 703 fund that's our detention center fund

[3:11:28] um we had a small reduction in income of 15 000

[3:11:33] and that pretty much was tied to a drop in correction fees and just

[3:11:39] shifts in housing revenues and then we also had a decrease of expenditures of

[3:11:43] 61 842 which is which is tied to a lot of

[3:11:48] different savings or projected savings in different various line items

[3:11:52] um we also have our 703-125 which is our rise which is a

[3:11:58] department that was created to account for a rise grant but we're not going to

[3:12:02] receive this fiscal year so we're zeroing out that budget

[3:12:06] we also have in our 703 our detention center budget a department number 130

[3:12:11] that accounts for the intervention grant and there was an

[3:12:16] increase in revenues and expenditures tied to additional services

[3:12:20] that were reimbursed for the county and now we can utilize those funds for

[3:12:24] related activity there was a change to one of our gross

[3:12:30] receipt tax debt service funds just to shore it up to what's

[3:12:36] to the gross receipt taxes that we're expecting

[3:12:39] there are some changes in our housing budget and those are just based on we

[3:12:44] get on a monthly basis we get some kind of projections as to how much we're

[3:12:47] going to be receiving in the next few months so we

[3:12:50] adjusted the budget accordingly and i'll continue to work with bernalillo county

[3:12:55] on those numbers to monitor them and make sure that we're okay

[3:12:58] and then finally our solid waste we're increasing revenues um

[3:13:03] tied to grocery seat taxes by ten thousand dollars um we have

[3:13:07] increased expenditures of close to forty five thousand dollars some of which are

[3:13:11] tied to the um to the fence that i was talking to you

[3:13:16] about for the teculopita area as well as increased costs and disposal fees or

[3:13:21] disposal fees that we have which is going to require a 35 000

[3:13:26] transfer in order to um not let the fund get into

[3:13:31] a deficit cash balance and those are basically the changes that

[3:13:36] are summarized can i stand for
