[5:58] They may not come up and speak.
[6:00] I'm Tom DiPoli.
[6:04] All right.
[6:05] Good evening, Mayor.
[6:06] Members of the City Council, City staff, business owners, and fellow members of our community.
[6:10] My name is Moses Asparzo and I am the owner of Sanger Live LLC.
[6:13] Before anything else, thank you to our mayor, city council, city staff, attorneys, parks and
[6:19] regs, public works, first responders, local businesses, nonprofit organizations,
[6:24] senior schools, youth programs, and every resident who puts energy into making
[6:28] Sanger better. That kind of commitment matters. When I started Sanger Live, it was just
[6:33] streams of incidents and breaking news across town. Over time, those broadcasts turned into
[6:37] real relationships with residents, business owners, and nonprofits and families.
[6:41] What started a small grew into a platform aimed at supporting our community and none of that happens without your trust and for that I am truly grateful listening across our city
[6:50] I hear pride and real concern and every story deserves respect. There's one topic. I'd like to address the signal that Bethel and Oman the tragedy there changed lives forever. My heart remains with those families and friends that are affected by it.
[7:03] The city heard the call, the city heard the call, worked the process and completed the project, and that effort deserves things.
[7:11] Recently, another incident happened there. I mentioned that to underscore a simple truth. Infrastructure helps, yes, but no improvement replaces personal responsibility.
[7:20] Safety is built on and practiced. You have done your jobs by improving our streets, and now it's time to improve our habits.
[7:27] I want to thank everyone who saw that project through.
[7:30] There's one more thing that I'd like to address.
[7:32] We've gotten two comfortable tearing each other down
[7:34] instead of building each other up.
[7:36] We don't need to agree on anything or everything,
[7:39] but we should be able to respect one another
[7:41] and our thoughts and opinions.
[7:43] Lately, people outside Sanger ask me about our conflicts
[7:46] and once things even more is when our youth
[7:48] ask me about the same.
[7:50] They're watching and they're learning from us.
[7:53] We won't be here forever.
[7:54] the city will one day be there to lead.
[7:58] And so we have to ask ourselves,
[7:59] what example are we setting?
[8:01] Are we cheating on that disagreements mean division
[8:04] or that strong community self problems together?
[8:06] I believe in a kinder and stronger singer.
[8:09] If each of us chooses to lead by example,
[8:12] not as individuals, but as one community,
[8:14] we can lead behind a city for our kids and grandkids
[8:17] that they will be proud of.
[8:19] Let's be remembered for unity and not arguments.
[8:21] for coming together and not falling apart.
[8:24] Thank you for your time, your service,
[8:26] and your commitment to Sanger.
[8:28] God bless you and the Sanger community.
[8:31] Thank you, sir.
[8:34] Anybody else wish to come public comment?
[8:37] Please come to the podium.
[8:43] Good evening, Sherry Gumbra Carter, Sanger.
[8:48] I'm here on behalf of the Sanger Chamber of Commerce.
[8:51] And I have a couple of announcements
[8:53] I'd like to make tonight.
[8:55] First one I'd like to tell everybody about is the annual trunk or treat. It's
[9:02] back. It's almost here. We're ready for it. It's going to be Thursday, October
[9:07] the 29th. Line up is at five. The event is from six to eight. If you want to
[9:14] hand out candy, we do need an application. You can get one from a Sanger Chamber of
[9:23] The next one is, this is a new one, this sounds pretty cool, the Sanger Chamber and Eagles are getting together and it's going to be Sanger Chamber Eagles Thursdays.
[9:37] The first one is going to be September 17th and the second one will be September 24th.
[9:45] hours or five to nine is going to be in the parking lot and there will be lots
[9:50] of vendors there. That's all for tonight, but I will be reporting next week on a
[9:57] couple of more things that the chamber's going to be doing. Thank you.
[10:02] Thank you, ma'am.
[10:14] Because I ran out of time, I'm
[10:19] still very curious about how this EO of the chamber could be gone.
[10:26] And then all of a sudden after that we have no more chamber to commerce.
[10:32] You know his speech about getting together sounds really good, and it was good.
[10:38] But you know getting together when you guys double at sunk a hundred-year tradition you
[10:44] put it in the toilet.
[10:46] You guys voted however you did to make this happen but I can't get a word from anybody.
[10:55] I can go to the barbershop and learn more about what's going on in Sanger than I can right here.
[11:03] So, again, I find out why the chamber got dumped.
[11:09] I'm a chamber member.
[11:14] I don't expect you to say anything. It's all tongue-tied.
[11:19] You know, you kill 100-year tradition.
[11:27] And this form of government is where most people come.
[11:32] You don't really deal with the state, all they do is collect taxes.
[11:36] You don't deal with the Fed. They collect taxes.
[11:39] But if you guys can't respond at this level, who the hell are you working for?
[11:47] It's amazing. I said here through the mayor.
[11:52] This is just a reminder for the benefit of the public.
[11:55] This is public comment time, not city council, comment time.
[11:58] So this is opportunity for the city council to listen to your comments.
[12:01] Thank you so much.
[12:02] It was one of the way that the community activist found there a single youth bucking
[12:07] up many years ago, 45 years ago.
[12:11] I just want to congratulate you guys, saying it was looking a lot better with a construction.
[12:17] Thank you.
[12:18] Now, a fraction of the streets.
[12:27] As early as the public comment,
[12:31] there was anybody on the top, okay, the public comment is closed.
[12:36] We'll go ahead and move on to the consent calendar.
[12:38] Matters listed on the consent calendar are considered routine and will be enacted by one motion
[12:43] and one vote.
[12:44] There will be no separate discussion of these items.
[12:47] If discussion is desired, a member of the audience or a council member may request an item
[12:51] be removed from the consent calendar and it will be considered separately.
[12:55] Is there any items you guys would like to move?
[12:59] No. Anybody from the public wish to remove any items from the consent calendar?
[13:07] Seeing none, was there anybody on Zoom?
[13:12] Okay, with that said, we've got to the consent calendar to have a motion to approve.
[13:18] We have a motion.
[13:21] I'll second.
[13:22] We have a motion and a second. All this is a favor signify by saying aye.
[13:25] Aye.
[13:26] All those opposed hearing none that motion carries unanimous.
[13:29] Item G, public hearing, to public hearing, to consider annexation, number 8, track 6531,
[13:38] serenade 2, into community facilities district 2005-1, is now before the City Council.
[13:45] We'll staff provide report.
[13:48] Thank you, Mayor and Councilmembers, up to present this.
[13:49] We need Dr. Josh Goggins.
[13:58] Good evening, Mayor. Members of the City Council, Dr. Goggins,
[14:02] Community Development Director here with the City of Sanger. Tonight the item
[14:07] before you is G1. This item is to consider annexation number 8 into our
[14:16] Community Facilities District number 2-0-05-0-1 for Track 65-31, simply known as
[14:26] as serenade 2, this project is being developed by DR Horton, and it consists of 48 single
[14:34] family residential units located in southwest corner of North and Greenwood as a standard
[14:42] condition of approval or subdivision developments here in Sanger.
[14:47] Property owners are required to annex into the city's community facilities district, the
[14:54] the CFD being a public services
[14:57] Melarou's district prior to record.
[15:02] So, in quick overview of it, this district ensures that new developments offset rising operational costs or public safety, emergency services and park maintenance. Our projection for a fiscal year, 27, the assessment is $759.52 per unit, projecting $36,000 per unit.
[15:29] 457 in annual revenue with CPI adjustments at zero cost to the general fund.
[15:37] We believe as staff, this action is necessary and is a routine step that enables the successful progression of track 6531
[15:47] while guaranteeing our essential public safety, parks, maintenance services, their ability to let those be fully funded as our community grows.
[15:58] and we as staff recommend approval of these resolutions and I am available to answer any questions that the council mayor might have.
[16:08] Thank you.
[16:10] At this time I declared the public hearing open.
[16:17] Is there anybody from the public wanting to speak on item G1?
[16:24] Seeing none, it was there anybody on zoom. There was none. Thank you.
[16:31] The public hearing is now closed. Council, do you have anything, Dad?
[16:37] Anything?
[16:38] So for the council, this is part of me. This is going to be a two-step process.
[16:42] We'll ask you to adopt the resolution first, and we'll hold the election, and then we'll adopt the second resolution. Thank you.
[16:48] Okay.
[16:50] So I'll accept the motion.
[16:53] Sorry.
[16:54] I'll second, Mr. Mayor.
[16:55] We've got a motion to second. All of this favor signify by saying, right?

[17:04] The public hearing to consider proposed annexation of property within track six five three one

[17:22] do that mayor can we do the election portion of the previous item so sorry about that.
[17:27] I thought, okay, I thought this one was for this, we're good.
[17:31] Does it, has the city clerk received any ballots in response to the election for item G1?
[17:47] Let me double check, I thought there was an election for G2.
[17:52] Did you receive anything for item G1?
[17:55] We're going to hold off on G2, or G1, that portion would go to G2 if that's okay for you.
[18:00] That's what we do this, we'll skip up to the next one, yes please.
[18:03] Anything?
[18:04] Item G2.
[18:05] Thank you.
[18:07] Mayor, I now open the public hearing regarding the annexation of territory to Sanger Landscaping

[18:19] City Clerk.
[18:24] I declare that the notice of public hearing was published on August 13th, 2026.
[18:30] Staff, please proceed with your staff report.
[18:34] We can just have them in it.
[18:36] There's consulting legal counsel.
[18:40] Yeah, there's a little script we have to follow.
[18:43] So kind of bear with his.

[18:58] We can go ahead on.
[19:00] Item and assues were done on this item will circle back to G1.
[19:03] I think we got it.
[19:04] Okay, thank you.
[19:08] Great.
[19:09] Good evening.
[19:11] Mayor and members of the city council.
[19:12] Dr. Goggins, Community Development Director here.
[19:16] The item before you tonight is item G2.
[19:20] This item is to consider the annexation of property within track 6531, simply known as
[19:29] serenade 2 into the city's landscaping and lighting maintenance district number 2 area 1.
[19:35] As discussed earlier, this development is being built by DR Horton, and comprises 48 single-family residential lots.
[19:47] As a standard condition of approval for subdivision development, the property is required to annex into our landscaping and lighting maintenance district prior to recordation of the final map.
[20:01] The purpose of the LLMD is to maintain local infrastructure and cover the ongoing costs of street lights, landscape areas, irrigation systems, and special amenities within the public right away in easements, such as masonry walls, stormwater holding ponds and roundabouts, adequate lighting and well cut landscaping, directly enhance neighborhood safety, quality of life, as well as
[20:30] the property values. Each annex lot will be subject to the current fiscal year assessment rate
[20:37] of $116 per lot, totaling $5,568 annually for all 48 proposed lots with future adjustments
[20:48] governed by CPI approved by the City Council. No assessments will be levied or collected
[20:55] that against these laws for the current fiscal year, the first collection officially commencing
[21:01] in fiscal year 2027-2028.
[21:04] This action by the Council ensures that new residential growth property, properly contributes
[21:12] to the maintenance of our public infrastructure without placing additional burdens on our
[21:17] city's general fund staff, recommends approval of the resolution and I'm available to answer
[21:25] any questions? Thank you. I now open the hearing to protest comments and questions from anybody interested in this item.
[21:39] There's no there's no comments.
[21:50] We'll move to the if's anybody on zoom city
[21:56] clerk. Are there any written protest?
[22:00] Do you have any declarations?
[22:07] declare the sole property owner, DRHORNCA3, Inc., has filed a written waiver that expressly
[22:14] waives the resolution, reports, notices of hearing, and write a majority protest and
[22:18] consent to the public hearing and adoption of a resolution by the City Council, ordering
[22:23] annexation and levy of the property, and said waiver expressly waives any requirement to
[22:29] We have a ballot and majority protests proceeding per government code section 53753 or as may be permitted by the Landscaping and Lighting Act of 1972 and no written protests were received by the city.
[22:46] Thank you. And now close to public hearing. Is there any discussion from council?
[22:58] Is there a motion?
[23:01] Is there a motion to adopt the resolution?
[23:06] We have a motion.
[23:07] Some move, Mr. Mayor.
[23:09] We have a motion and a second.
[23:10] All those in favor signify by saying aye.
[23:12] Aye.
[23:13] Aye.
[23:13] All those opposed?
[23:15] Oh, wait.
[23:16] The motion to adopt the resolution confirming ordering annexation into
[23:19] Sanger landscaping and lighting maintenance district.
[23:21] Number two area one and establish a levy of assessment for the annexation.
[23:26] Tire Tory has passed.
[23:32] Oh, yeah.
[23:32] Do we do a vote?
[23:35] I think we're good to go on this item.
[23:37] However, the council wouldn't mind going back to the previous item item G1 for the second resolution. We also have a waiver that was submitted for that one as well, including with regards to the vote.
[23:50] So city clerk, would you mind reading item 7a again and 7a and then I'll give you the language for 7b. We're going to do this on the fly.
[24:09] declare the sole property owner, DRHORNCA3, Inc., has filed a written waiver that expressly
[24:16] waives the resolution, reports notices of hearing and write a majority protest, and consents
[24:22] to public hearing an adoption of a resolution by the City Council ordering annexation and
[24:27] levy of the property.
[24:29] Thank you, City Clerk. Do you also declare that said waiver expressly waives any requirement to have a ballot and a majority protest for the government code hours may be permitted by the community,
[24:39] community facilities district act as well? Yes. Have any written protests been received by the city? No. Thank you very much. Now we can close it and have the vote on the second resolution. Okay. Thank you.
[24:53] So this item G1 is closed item G2 to have a motion to approve.
[24:59] It would be G1 second resolution.
[25:02] G1 second resolution.
[25:04] Exhibibility.
[25:04] We're going to get this one.
[25:05] There you go.
[25:10] Item G1 second resolution.
[25:15] Okay.
[25:17] Do I have a motion to approve?
[25:21] Some move, Mr. Mayor.
[25:24] We have a motion.
[25:26] I have motion to second all the favor, second, five per say nine.
[25:30] All right.
[25:31] All those, all those opposed hearing none.
[25:33] That motion is unanimous.
[25:34] Now we do G2.
[25:37] G2 is already done.
[25:38] Yes.
[25:39] So go to age one.
[25:41] All right.
[25:44] Up to present item H1 approval of final map agreements and covenants for track 6531 is city engineer Josh Rogers.
[25:56] I don't have to do all the repetition on the projects because Dr. Goggins already talked
[26:01] about the project. This item is for that same subdivision or approval of the final subdivision
[26:08] map, subdivision agreement, improvement in credit, reimbursement agreement, and several
[26:12] covenants and a separate agreement that's tied to that subdivision.
[26:16] Again, a 10 acre property, 48 single family residential lots, final map and improvement plans were submitted as required by the conditions of approval for that project when we approve the tentative map.
[26:30] And since all the required improvements have not been approved at the time of our recognition of the approval map, we then require a subdivision agreement which stipulates all the requirements associated with that track, which is
[26:43] fairly mostly common, most subdivisions don't proceed without a subdivision agreement.
[26:50] So the developers executed that agreement, which is attached to your adopting resolution,
[26:57] provided commitment to provide the required securities, insurance, etc.
[27:04] The conditions of approval and addition to standard subdivision improvements,
[27:08] like curb gutter sidewalk streetlights did require the construction of some storm drain infrastructure
[27:14] in accordance with the city's storm drain master plan. Those improvements are eligible for fee
[27:19] credits or reimbursements estimated in the reimbursement agreement to be about $120,000 to be
[27:27] after completion and acceptance of all improvements creditable against future
[27:33] payment of impact fees or crediting their own impact fees, which is shown in the various
[27:39] tables in the subdivision agreement and the reimbursement agreement.
[27:44] The requirements also, the conditions also required the CFD and LLD annexations, which
[27:50] are just completed as a prerequisite to approve of the final map.
[27:54] And then finally, there is an existing private irrigation pipeline that runs along North Avenue,
[28:00] which has been required for replacement and relocation by the developer by consolidated irrigation district and due to the location of that easement and the city's desire to place it an area overlapped by sidewalk and landscape improvements.
[28:17] We are needing to enter into an agreement for common use of the pipeline agreement, the pipeline and the city's landscape and sidewalk. That's also included as one of the attachments to your resolution.
[28:32] So, again, they've submitted all the required paperwork on all the things necessary for us to find their map to be correct.
[28:40] and we're recommending you approve of that through the resolution along with all the subdivision
[28:44] agreement, the covenants for a right to farm, landscape lighting, community facilities district,
[28:52] and then the agreement for common use of easements with CID. I can answer any questions. Yep.
[28:58] Great. Thank you. Any council have any questions for Josh?
[29:08] I'll open it to public comment.
[29:10] Is anybody in the public pushing to hear?
[29:25] I do have a question regarding all this financing that's being proposed by DR Horton.
[29:31] I know this is a resolution.
[29:33] But at some point, they have or will be entering or have entered into some agreements.
[29:38] some of which have not been fulfilled on the first and second phases of their current or their just finished development.
[29:46] I mean, from what the city was selling me is that their street sweeping was supposed to be done by them.
[29:51] The city is charging the residents in those properties, the monthly credits also include.
[30:00] For the street sweeping. And at some point, somebody, either the city collecting those charges are, I would consider theft or outright negating their responsibility by DR Horton. So whenever you guys are going to consider allowing them an expansion, you guys should definitely consider keeping them to their word because there's a lot of reimbursements that they're talking about here. And I mean, I think they could scrounge up a few hundred bucks.
[30:30] that's a month to fulfill their commitment.
[30:34] So I'm not against the expansion, I'm not against that proposal, but
[30:38] please hold them accountable to what was expected.
[30:41] Otherwise, the city is at least stealing that those charges to the residents.
[30:49] Now going on on three years of theft.
[30:51] So those are services not rendered for services charged.
[30:55] And I believe it's illegal in the state of California.
[30:58] Thank you.
[30:58] Thank you, did you manage it?
[31:04] Yeah, so this is a subdivision in Councilmember Montolongo's district.
[31:08] He has raised the concerns with me several times.
[31:12] We have had ongoing communication regarding street sweeping is probably the biggest thing.
[31:17] The street sweeping wasn't kept up so last month we contracted and had mid-valley go in.
[31:24] Yes, the city did.
[31:25] Just a clarification public comment. This is not the time for it. We listen to you. Then you listen to us and we'll get it done. So thank you very much.
[31:36] Because if you're not, you may have to be escorted from the room because we need to get the public business done. I recognize I'm being the bad guy.
[31:43] But we need to be courteous and respectful. The City Council is respectful for you.
[31:47] Let's listen to the city manager to complete his statements. Thank you very much.
[31:51] So, yes, it is on the developer to keep the streets swept.
[31:55] And I would say that that was one area we had some concerns with where we just didn't execute.
[32:01] So a month ago, we sent in on the city's behalf.
[32:05] I've also worked up all the credits to refund those individuals, the $1.43 a month they're charged for streets sweeping.
[32:12] So they'll be receiving probably within the next 30 days.
[32:15] They still need to come to council to get the permission to do it, but that's the plan.
[32:18] It's about a $3,000 credit back to all those residents.
[32:22] We have scheduled a meeting with, we have another meeting with DR Horton next week Wednesday to kind of talk about these things.
[32:28] But there's been a lot going on with that subdivision and I know the residents are upset but we've had some litigation going on over the work on North and Greenwood.
[32:39] The road's been torn up multiple times.
[32:40] We've had traffic, you know, traffic lanes, traffic control, they're quite often.
[32:47] Well, unfortunately, the cities in a, in a, in a standoff with the developer.
[32:54] We had an agreement about two, three weeks ago.
[32:56] And then when they left the room, they changed their mind on the agreement.
[32:59] So not the developer, but our contractor we had.
[33:03] So that being said, we've already, last week given the, this week given the direction
[33:08] to go get the quotes to finish the project outside of the area because the air hortons
[33:14] been been contacting the city about because they want to finish the sidewalks. They want
[33:18] to finish their landscape outside. They've got some concrete work inside to do but they're
[33:21] waiting to bring the the crews in. So, um, short of the streets we think thing. I think we've
[33:29] got to buy some some good options here but the city is taking action. We are going to talk to
[33:34] D.R. Horton again next week, but as far as the residents go, you should see street sweeping
[33:40] twice a month from mid-valley. We're also going to be on D.R. Horton for their construction
[33:44] stuff to make sure they're cleaning that up, but a typical street sweeper is twice a month
[33:47] in an area.
[33:50] And was there anything else you might want to know?
[33:53] No, it almost seems like a question that we've prior a lot more than we could do here right now.
[33:59] How would you be, we have the gentleman I'm open for to talk to anybody, but I also
[34:06] did send today communication to council regarding this and I've asked to clerk when she submits
[34:13] this package to put my letter to you to the council in the handout for this agenda and
[34:18] it was questioned supposed to me by council member Montelango and I believe it's three pages
[34:23] as long with the questions and the responses.
[34:26] Okay.
[34:27] But I'd be happy to meet you as well.
[34:30] Is there any other questions regarding item H1?
[34:35] Yes, public comment is still open.
[34:49] I'm just Kevin Carter.
[34:52] It seems to me questionable why we would enter into another agreement with this company.
[34:57] When I'm hearing we have multiple situations that are going becoming a problem.
[35:04] it seems to me like maybe we try to rectify the problems we have before we just
[35:09] okay another subdivision move on and hope for the best. Thank you. Thank you.
[35:19] Is there any public comment
[35:20] in regards to item H1?
[35:25] So you know public comment? Is there any okay? The public comment is
[35:31] close. Item each one, you guys have any comments?
[35:38] Do you mind if I jump in really quickly or
[35:42] Josh can? We'll do rock paper scissors but I'm happy to jump in if you like. Under state law,
[35:51] if you have problems with the developer and phase one and they come to you with phase two saying,
[35:56] a move or final map, under state law you are limited as a city council to deny that final map.
[36:04] And the reason is it is considered almost a ministerial act. So the question before the
[36:10] city council tonight is does this map as being proposed as a final map, is it consistent with
[36:18] the tentative map that was approved by the planning commission? And you've had your city engineer
[36:23] You've had your city planner review it, you have your city attorney review it, and all of them are saying to you yes, it is consistent.
[36:31] So there is an exception to that rule, and then I'll get to the next one.
[36:35] The exception to that rule is basically when there are exigent and extreme threats to public health safety and welfare that you didn't know about when you did the tentative map.
[36:48] And that's usually like, hey, as we're building this out, we found phase two is on a toxic waste dump, something like that that you would say it's probably not a good idea to put houses on top of radiation. That's a bad idea.
[37:02] We would have great difficulty improving that right now if the Council
[37:07] was inclined not to approve this final map. And my suggestion to you is that
[37:11] the criteria have been met based on your staff have said that those minimum
[37:16] criteria, the states mandated it, they taken away your freedom, they basically say
[37:20] you've got to approve this. That being said, there are other tools in your toolbox
[37:26] If you are concerned about enforcement, I'd like to say phase one, and the city manager has put together a list as to what some of those circumstances are, and I would encourage anyone in the public who is curious to look through that list that the city clerk will have an even talk to the city council city manager so you can have a more candid conversation and you have the opportunity to talk back and forth a lot easier rather than a more formal process because we want to have that answer.
[37:54] So today, before you, the only question you have as a matter of law is, is the final map
[38:01] consistent with the tentative map? Thank you. Thank you.
[38:16] After that, this question is for staff for city attorney.
[38:20] The actual, the other items listed
[38:27] on between one and seven. I mean, do those are, are those required to be voted on tonight? Is that part of the final map completion or approval process?
[38:40] And if not, then what are our options?
[38:44] All of those items are prerequisite to the map approval as a condition or on the subdivision
[38:56] map act.
[38:57] So as City Attorney stated, they filed a tentative map, tentative map was approved and now they
[39:06] have conditions of approval to me of ratify that approval, they've met those and they've
[39:13] filed the subdivision map that conforms to the tentative.
[39:16] So that's where the state law, and I think it depends on the staff report, it says City
[39:22] Code 62-97 states that the City Council shall approve the final map.
[39:26] If it were conformed to all the requirements of this chapter and the map act applicable at
[39:30] the time of approval or conditional approval and any rulings made there under, or if it
[39:34] does not so conform, then you disapprove the map.
[39:37] And so the related items here are
[39:41] to make that map approval consistent with the conditions
[39:44] and consistent with the map act.
[39:46] So, they all go together.
[39:50] Okay, no further questions for now.
[39:55] Is that any questions?
[39:57] And may I pretend that I haven't?
[40:00] Hello.
[40:03] So the gentleman that came up is correct.
[40:06] I actually been meeting with him and residents probably
[40:10] for almost two years now regarding some of the issues
[40:14] at hand with the dear Gordon the phase that's not this one
[40:18] and have been speaking with staff about the issues.
[40:22] And so I did and I think he sent everything to you guys
[40:25] some of the questions I have had because I knew
[40:28] this was going to be on today and how we'll let effect the vote and this afternoon I spoke to
[40:34] the city attorney because I really knew that we had no choice because the state took that away
[40:40] from us. But is this disappointing because again when the state does that and we have an issue with
[40:48] the developer we could scream all over into a crowd and then we still got to do what we got to do
[40:57] because the state says so, but everything that the gentleman said, everything that the
[41:02] city manager said has been quite honest.
[41:05] It's been a frustrating as Council District 4 for this particular area.
[41:11] And I'm willing to fight it all the way, even that we have to vote on this.
[41:16] But I want to make sure we keep them accountable.
[41:19] And so some of the things that City Attorney told me by using our code enforcement and so
[41:23] on.
[41:23] I do want to make sure our staff is doing the hardest thing to make sure that that area of deer hoarding is done correctly before we do their final when it comes to us with then I guess a couple of months.
[41:37] And I know that there is a punch list that the city manager told me about.
[41:41] I think we included many of those things as well that they talked about.
[41:46] I had city manager numerous time goes to me and drive the track to see what's going on.
[41:56] I think one time we even had four or three of our staff members go with us and we actually
[42:01] walked certain areas where there was concerns.
[42:04] So I'm happy that the resident came today to shed light to what I've been trying to work
[42:11] with with him and some of the residents.
[42:14] And I'm looking at you as a counsel for your help to help us guide the staff to make sure that we get some things done because I think it's time that we all part of foot down saying that is enough knowing that we have to say yes to this because I knew that and I don't want to hit what the state is but we have to fight the state to we have to stop with the state's doing so it's it's a frustrating thing that they have more rights a developer than we do now.
[42:43] and that wasn't there before, you know.
[42:45] But I'm glad that City Madras sent you guys information
[42:48] that I've been dealing with for almost two years.
[42:50] Okay.
[42:51] So in regards to H1 or the approval of the final map,
[42:59] the other questions.
[43:00] So City Attorney, do you have a question?
[43:02] So you did say we don't have the option of stopping them,
[43:06] but would we have the option of postponing them
[43:08] until these issues are resolved
[43:10] or that would not be an option for us.
[43:13] That is not the mechanism.
[43:16] If we were to go down that road, I would like to privately council the council on that or give you a private memo, but if I don't have time for that.
[43:26] So the continuance is not a legal option that's really available to us that creates certain issues that I would not want to address on the stand right now.
[43:36] But that's a very good question, and I understand where you're going, but that the, this, unfortunately, the state has really bound our hands, and it's, and it's one of the council members has said it's very frustrating.
[43:47] Then the question is this is kind of like when you go into the DMV, having met the requirements, if you can read the lines, if you can read the numbers up there to whatever your vision is, they're going to issue driver's license.
[43:57] And that's kind of where you are right now is if the requirements have been met, the state mandates that you
[44:03] issue the final map and these other covenants that are associated with that actually make sure that
[44:09] the developer pays their fair share. And so and complies with the conditions of approval approved by
[44:15] the planning commission. So I hate to give you the attorney thing of saying it depends, but your safer
[44:21] for legal approaches to approve at this evening.
[44:24] Thank you.
[44:25] I want to bring it back.
[44:27] Okay, regardless of each one to have motion to approve.
[44:31] Mayor, I'd like you to make a motion to postpone.
[44:37] Bless you.
[44:39] Oh, I'll second that.
[44:42] And is that to postpone to the next regular meeting?
[44:44] Yes, sure.
[44:45] Thank you.
[44:49] Be okay.
[44:51] Legally?
[44:52] I would not want to say anything on the public record
[44:55] as to whether or not that is something
[44:57] that's okay legally. Your safest legal approach.
[45:00] Approach would be to approve the city.
[45:04] Mayor, I have a question for the city attorney. Motion. Okay, I vote on it. Yep. Yes, you have a first and a second. Yes. And unless one of them decides to withdraw or modify their motion, then there's a vote.
[45:22] You know, all the favors signify by saying aye?
[45:24] Aye.
[45:26] All opposed?
[45:27] No.
[45:28] No.
[45:31] And the motion fails because it did not receive more than a majority vote, Mayor.
[45:35] Thank you.
[45:36] Here you go.
[45:37] I have a motion to approve.
[45:38] Item each one.
[45:39] Oh.
[45:39] I have a question.
[45:45] So I want, well, I don't want the city to get into a fight of legal battle with what state
[45:54] is going to do.
[45:56] But I am going to bring back something if this council, during my comments, to get consensus
[46:03] from the council regarding the actual problem. This one is not. It's the actual problem
[46:09] I want to get into. And I can't talk about it now, but I will bring it up at my comments.
[46:15] Yes. And that's where I'm going to need your full support at. That's where I'm talking about.
[46:19] Okay, so in regards to item each one, we have motion to approve and this must be at least three affirmative votes on this one in order to pass. Thank you.
[46:29] We have motion to approve.
[46:31] Some moves, come here.
[46:33] We've got a motion.
[46:35] I'll second. All the favorites to go by by saying aye.
[46:38] Aye.
[46:39] I was opposed.
[46:42] You're in that motion carries 4 to 1.
[46:45] Let's move to item H2.
[46:52] Good evening, Mayor and Councilmembers.
[46:54] This item before you, tonight is a purchase of a new vehicle for the Fire Department.
[46:58] We're asking you to adopt Resolution 2026-83, authorizing a budget amendment in the amount
[47:04] of $75,000 for the purpose of purchasing a new vehicle from Sequoia Chevrolet and upfitting
[47:10] the necessary emergency equipment and approve the purchase of the vehicle from the dealership
[47:15] the amount of $66,793 in authorized the city manager to sign the sales documents on behalf of the city.
[47:23] So this vehicle in question is the fire chief's Tahoe.
[47:28] The current Tahoe is an excess of 100,000 miles shortly after the budget passed, it lost the transmission.
[47:34] So we had to put a transmission into it and it's no more what they would consider conducive to public safety service.
[47:39] So that's it. It went before the COC and they they approved the purchase as a good purchase of the public safety sales tax funds, and we're here tonight to get approval of council to buy the vehicle.
[47:59] Regarding time each two when there were any council coming
[48:05] Sequoia Chevrolet
[48:07] It's starting singers to say that we're on a piggyback contract, OK. Yeah, and keep mandate somebody wrote it
[48:13] Yeah, we get a mo魔 Go From what I love right love Green parcel. I love been GM seed and we have content
[48:21] Old time, I know that way
[48:24] But no that's all I have I won't get into my die try
[48:28] but it being an electric vehicle at this time,
[48:31] but I think you guys all know how to do that.
[48:33] There is a limitation on the way to the fire.
[48:35] Yeah, there is a limitation on the public agency
[48:37] and so how much they could take in a year
[48:39] from that type of grants.
[48:41] And this vehicle does go out of town
[48:43] on like strike missions and different means
[48:45] and things like that.
[48:46] So if they're out on a strike mission,
[48:48] they don't really want to have to stop to charge it,
[48:50] but understand, we're buying hybrids
[48:53] in electric where we can.
[48:54] There you go.
[48:55] Appreciate that.
[48:56] Well, thanks to
[49:01] public item H2 where any public comment seeing none was there any zoom comments. No
[49:11] Thank you public comment is closed
[49:14] There are a motion to approve item H2
[49:18] I'll
[49:21] second mr. Mayor. We have a motion the second all of the favor signify by saying aye
[49:25] Hi, I was opposed hearing on that motion carries unanimous
[49:31] I am a city manager.
[49:33] Getting mayor and council members first up tonight with department report is Doug Bolton, parks and wreck director.
[49:44] Union mayor council, Doug Bolton director, parks recreation.
[49:47] Some updates of things we have going on with the city.
[49:51] Some things I've left for your packets.
[49:54] Starting with, we're having what we're following our last for raw for the summer, where there are aquatics division.
[50:00] We're offering a free swim from four to eight on Saturday and then a final movie in the park on Saturday as well for showing of Superman. So hopefully those want to get that last.
[50:11] Swim in can come out Saturday before to eight and then stay for the movie as was also the last week into the splash pad.
[50:18] But we're carrying it through Saturday Sunday and Monday the holiday and then we'll be shutting down the aquatics or the fall season.
[50:26] Glad you know, too, we have opened up our youth basketball signups.
[50:31] They are online and ready to be going and as anything, as we've talked about before
[50:37] with some of the other sports issues, we rely very much on our volunteers.
[50:43] So to make our things successful, we look at having approximately 400 kids coming out
[50:49] to play basketball, and we have some great dedication from some parents.
[50:53] So if some parents are going to coach three teams for their three kids, then we may unfortunately fall short sometimes and not having those coaches.
[51:00] So again, we reach out to your constituents and the public at large for those who just have a heart for kids in heart or serving the community to potentially come and do it.
[51:11] They can do it online.
[51:12] We do have QR codes and come into the office.
[51:15] If they need help with doing that again, those who can help with our program will be one.
[51:24] Oh, here's a big one.
[51:27] We are in dire need of a boxing coach, a head boxing coach to run the boxing program.
[51:31] For those of you who don't know, we've had this as an open recruitment since January.
[51:36] I could feel it daggers in the back of my head right now.
[51:42] We've had an open recruitment to fill this position since January of 2025 and we've been able
[51:50] to be lucky to have it with volunteers who have been willing to do it.
[51:54] but our last volunteer has been handling it was his last day and one position with the city as he
[52:00] moves over to the police department and becoming officer there. So we are in very high need of a
[52:06] boxing coach. This is going out online with just this so I can try to get a little more exposure for
[52:12] it. Anybody would like to take a picture of this or have be able to take it that it also can be
[52:18] apply for online again as an open recruitment on our city website. Anybody has any people they might think would be interested. Again, certifications are important USA boxing and things like that. We wish we could just take anybody up the street as a hard for kids, but this unfortunately is a position that has to have certain certifications legally and for safety reasons under USA boxing.
[52:38] We know there's people out there, we've had some people come in, we've had some great candidates come in and some of them just decided that they couldn't fit it in with their schedule.
[52:47] So we're calling out to the public and anybody who might have any of those who would like to do that.
[52:52] Again, we do need volunteers as well to help with the program.
[52:55] But again, we are looking for that head boxing coach to be able to run the program on to fit their schedule as well.
[53:02] So any other further questions about that? I'd be glad to answer any of those about the boxing program as well.
[53:11] a couple of things we have coming up.
[53:14] We have at the request of the owner of Autry Plumbing,
[53:18] who is coming back into the city.
[53:21] We're gonna be hosting his ribbon cutting
[53:23] on September the 18th at 4 p.m.
[53:27] He wanted a later evening one.
[53:28] He'll be handling a lot of the festivities going on there.
[53:30] It sounds like it's gonna be a pretty good time,
[53:32] but please come out and join for a welcome Autry Plumbing
[53:36] back to the city of Sanger for that ribbon cutting.
[53:38] again Friday the 18th at 4 p.m.
[53:47] And also this coming Tuesday we'll be having a ground
[53:50] breaking for a new storage facility coming in store local storage and the significance
[53:57] of this is kind of to celebrate and we think about ground breaking is like what about
[54:01] a ground breaking this is to celebrate the cities move to the north moving towards that 180
[54:07] corridor. It's at 55 Academy. So starting that move north for the city moving towards that
[54:13] area that everybody wants that growth to go to towards the 180. So we're going to open that up
[54:18] and celebrate that business coming into the town who wants to help with that growth moving towards
[54:24] the north end towards the 180 interchange.
[54:30] Forget about national night out 4 p.m. September 19th.
[54:36] I know police department is handling a big part of that. Any questions for the questions about that?
[54:40] You can reach out to Kim Jones with the police department. Anybody would like to be a vendor or
[54:44] have a booth or anything there for whatever reason they might have to display their business
[54:48] or things then they're more welcome to to do that.
[54:56] Is there any questions regarding any of those items which I brought up?
[55:01] Thank you for handling all this stuff.
[55:07] I'm sorry, I do have one more thing.
[55:09] We're lucky that we did finally able to secure our parks and facility supervisor.
[55:14] He'll be starting on this coming Tuesday after the holiday and will be introduced at the next council meeting.
[55:20] So we'll get that going and get him on board, get some staff hired for him to have and get running and gunning on the parks and facilities for the care of the thing.
[55:29] Thank you, sir.
[55:32] Thank you, Doug.
[55:32] Yeah, just a couple things. So I'll be reaching out to the four recipients of the Public Safety Sales Tax and asking them to present to the COC in August, and then probably the second meeting to or October, sorry, and then in October, present to the council as well. So that'll be forthcoming.
[55:53] I was going to read kind of stuff about deer horn, but we covered that and I know the council members going to talk more about it.
[56:00] And then we are closed on Monday, an observation on Labor Day.
[56:06] So nobody's going to be here if you come down to the city.
[56:10] And that's it for now, thank you.
[56:15] All right, go move right on, there we go.
[56:18] Item J, reports and matters initiated by city council members.
[56:22] This portion of the meeting is reserved for the mayor and council members.
[56:25] To make brief reports on boards, committees, and other public agencies and
[56:29] that public events to initiate new matters and to request updates and to initiate new agenda items
[56:35] under this section the council may also take action on any other specifically agendas and
[56:40] which meet other requirements for action. Mayor Proktaugh, you see boards and I don't have anything
[56:49] to report as far as any other boards or committees. I do just want to kind of give a shout out to public
[56:54] works. I saw the grounds crews kind of going through some of the neighborhoods in District 3
[57:01] but the mediums and the roundabouts did a really good job. A lot of that stuff was getting overgrown,
[57:05] you know, due to the summer and stuff, so it looks really great, trimmed back. I do want to
[57:10] mention Veterans Park. If you guys haven't gone out there recently, construction is really
[57:15] hidden, you know, a good stride there. I mean, there's literally no less than five or six cars there
[57:20] every day working on that project. So it's really coming along. They put up the flag poles today.
[57:25] Some of them are a little bit crooked, but I think that has to do with either way the
[57:29] concrete is poured or something but it looks great. So I hope we're looking forward to having that project completed.
[57:35] That's all I have.
[57:37] Great. Thank you. Tell us more about her title.
[57:39] I think her report. Thank you.
[57:41] I'll just remember one to long group.
[57:44] I'm not full of things, but the one I'm going to talk about right now and just get a consensus R is the
[57:49] the issue with the D. R. Orden, the one that's currently
[57:52] the finalized construction.
[57:54] So all the homes are ready to build.
[57:57] And before we finalize things,
[57:58] the CM has a list of things for them to do
[58:02] before it comes back to us for actual final vote.
[58:06] I do want to consensus that I'll talk into the city attorney
[58:11] to direct staff to start using code enforcement out there now.
[58:15] I'm happy that the city manager did tell me
[58:17] that we're gonna go ahead and reimburse the residents
[58:20] and it has to come to us for the reimbursements for the
[58:25] street sweeping and we're going to start it, but somehow we have to start keeping them accountable
[58:30] before they get to this level. And I'm going to ask the consensus to follow that
[58:34] staff makes that happen, starts working with them, starts
[58:38] looking at all the issues that we have and start
[58:43] making sure the list goes smaller and smaller before it comes to us.
[58:47] and I would like a body week report since it's happening
[58:51] of how it's going with the Oregon staff.
[58:54] That's my consensus to direct the staff.
[58:56] Do that.
[58:57] And I will have, I did speak to the citizen or citizens
[59:01] and told them that I will be having the meeting with them again
[59:04] with the city manager and probably some of the staff
[59:07] that they could have in the clear understanding.
[59:09] And I know there's some stuff, I don't know if you want
[59:11] to read some of the stuff that you gave back to me
[59:13] to this council, what we're doing.
[59:14] You already mentioned some of it.
[59:15] One of the main concerns I have to and I'm going to bring it up is the concern about the green wood and the north.
[59:25] Not having the forward stop yet and I know we're waiting for an hour to finish the infrastructure to get there.
[59:32] That's the concern they have, the concern I have, that's concern that many citizens have because of the traffic flow that's going out there.
[59:37] So it's been a major concern for a while and hoping that that will come to fruition pretty quickly
[59:43] I think city manager told me I never can sport six months. We're getting close
[59:47] But we get it closer that'll be nice
[59:50] What was what's taking place?
[59:53] It's just the more traffic it's out there the more concerned people are having
[59:56] You know and stuff and including myself
[1:00:00] The administration is, because I do get the calls a lot, and my directing for the city of
[1:00:04] Madula and Melissa is going on, but the calls are coming frequently, frequently. I do talk
[1:00:09] to everybody, and I wish I had a better answer for them. I think this time, with us directing
[1:00:15] it will kind of help me out, kind of help the citizens as well, and just the overall function
[1:00:20] in that area. To me, it's groaning pains, but there's some things that we shouldn't have
[1:00:25] to fill the pain of it. They should have been done. And this is something that I won't fault
[1:00:32] anybody, but all the process, you know, that body went through. And the last thing I did as
[1:00:38] city manager, it looks like they were kind of very quickly, is even though we're having issues in that
[1:00:42] area with the, what is it, the, the sort, the, the, the, the station, some of the issues there are
[1:00:51] the horizon that smells from time to time.
[1:00:54] It looks like he did tell staff that they're going to ask
[1:00:57] quickly as possible to resolve that issue.
[1:01:00] And it stems from, again, that typical area,
[1:01:03] which is not Dear Horton.
[1:01:04] It's now the contractor that you guys saw.
[1:01:07] So with that being said, I'm asking for support and consensus
[1:01:11] to direct staff to work very hard with Dear Horton and get
[1:01:15] these resolved as soon as possible, including the part
[1:01:18] which has some issues and that's definitely some of the issues on.
[1:01:22] And if I make a council member, so if I'm understanding you correctly,
[1:01:26] your directing staff will provide you with a bi-weekly report of the efforts taken to enforce
[1:01:31] and resolve the issues out there, including the park, the lift station,
[1:01:35] the construction of the sidewalks, and to give updates on that.
[1:01:38] Is that correct?
[1:01:39] Yes, including the streets weeping.
[1:01:42] Anything else that would miss Nathan, you think we should be tossed in there,
[1:01:46] or that the council member may be open to?
[1:01:48] Yeah, just one clarifying point.
[1:01:51] When I talk punch list,
[1:01:52] the majority of the punch list items
[1:01:54] are due from the contractor industry with on the outer area.
[1:01:59] And that is what's holding up a lot of DR Horton to do.
[1:02:03] So DR Horton's frustrated with us too,
[1:02:07] just due to the nature of that intersection.
[1:02:10] So they have been talking to us, like I said,
[1:02:13] but we will definitely,
[1:02:14] We're meeting with them next week.
[1:02:16] We'll be straight sweeping, but we'll definitely put the heat on them to clean up their construction sweepers daily.
[1:02:22] And that was heard loud and clear, I think, here. So we'll take care of that.
[1:02:26] Okay.
[1:02:27] But I have no issue given to the biweekly updates.
[1:02:29] The biweekly is not from the outside of the contract or the problem. It's the inside of.
[1:02:36] I have brought up that I know that I have not done yet.
[1:02:39] So those are the issues that I'm bringing up to make sure that we does not have to be a by the board to the council at a council meeting, but surely by a email to us that we all know it's going on.
[1:02:54] Mayor, if there's a consensus, we've got a consensus.
[1:02:58] I appreciate your support.
[1:03:02] A couple more things.
[1:03:03] City, Mandra, that solar company,
[1:03:09] it's still, all their stuff is still out there.
[1:03:10] And I brought two weeks ago, and then I gave you the number.
[1:03:13] So they're not compliant.
[1:03:14] I don't know, I guess we have this.
[1:03:15] Sight them, but it's still all of our city.
[1:03:17] OK, and that's a no, no.
[1:03:21] I mean, people that are on for city council
[1:03:22] are following the directions of where to put signs,
[1:03:25] but seems like these people, you know, and it's everywhere.
[1:03:30] There was a gentleman at the last meeting they came up and made a comment.
[1:03:33] And it was basically saying that, in essence, the city manager was the one that appointed me or the mayor to an adult committee in regards to the same chamber of commerce.
[1:03:44] And I want to read from the minutes of the meeting of the city council meeting of April 16, 2026, where it says city council by consensus directive staff to designate an out of committee.
[1:03:58] Consensus of the mayor and Americans dollars and councilor Montolando. So it was not the city of Andrew. It was actually us and it was a most consensus to work.
[1:04:09] So just wanted to be clarity of what was said, just make sure it's clear on that the documentation
[1:04:14] what we did. So I want to make sure that was brought up because of course I'm on the committee
[1:04:19] and in no way or form, I'm going to have to sit in that and tell me what to do. It's where the
[1:04:23] bosses do the fight and let him know and that's exactly what was proven today by the consensus.
[1:04:29] So we did it then, we did it today. Other than that, I just don't want to remind everybody about
[1:04:35] but the 9-11 events in high school at the 10 o'clock.
[1:04:39] Hopefully all council people could be there
[1:04:41] and hopefully the public could be there.
[1:04:43] Police have fired and invited a lot of guests.
[1:04:45] It's going to be an exciting time and if you have time,
[1:04:48] you can move on to the Clovis Veterans Memorial District
[1:04:52] and Clovis at 5 p.m.
[1:04:54] where our guests will be there as well
[1:04:56] and doing a lot of guests to them.
[1:04:58] Thank you, Mr. Mayor.
[1:05:00] Thank you.
[1:05:01] Liz.
[1:05:02] Thank you.
[1:05:03] Thank you, Mayor.
[1:05:04] Okay so this past Saturday I did have a meet and greet. I had the opportunity to give out school supplies and speak to a few of our community members. I do want to think those who did attend.
[1:05:16] I also had the opportunity to attend a meeting with the sobering center who is an organization that works with our unhoused community.
[1:05:24] So, they did want to meet with us and they do want to let us know what programs and opportunities they may be able to offer our community here in Sanger.
[1:05:34] So, hopefully city manager will have the opportunity to meet with them soon as well as our police department. So, hopefully that happens.
[1:05:44] I attended last night event for the Sam Academy. It was a really nice event.
[1:05:48] It's nice to see our children and our community dancing and everything that they're doing and I really do want to think those community members
[1:05:56] I do invest in them because that is always a great way to keep them off the streets and keep them busy.
[1:06:03] I will be attending a Fresno Chaffee Zooey event. It's called Toss the Tusk.
[1:06:10] It's an educational event to raise awareness about working together to save wildlife so I look forward to that.
[1:06:18] And since I do see a lot of new faces, I would like to invite you guys and encourage you to volunteer for the Youth Basketball and our Boxing Club because we do need community members to be a little bit more involved.
[1:06:32] And that's it. Thank you, Mayor.
[1:06:33] Great, thank you.
[1:06:37] Senator Chamber.
[1:06:39] Thank you for keeping up the tradition of the chunk of tree.
[1:06:45] I know, I know that Senator Chambers and is in good hands.
[1:06:52] And that Eagles event, I'm kind of looking forward to.
[1:06:55] I like going to Eagles Hall.
[1:06:58] I did do a tour of Diablo Canyon.
[1:07:01] It was put together by the Fresno area Hispanic foundation
[1:07:05] connection with PG&E, and it was just a little high opening, you know, the nuclear facilities
[1:07:12] everybody has is this really bad conception of, and the way they run that thing was amazing
[1:07:17] to see. And not only the operation there is, but finding out that some of that power does
[1:07:24] reach all the way here to Fresno. So that was a really good tour that I went on, and it was
[1:07:29] just, you know, in conjunction with the Fresno Area Hispanic Foundation, who I go and
[1:07:35] meet on a monthly basis. And the memorial plaza, we have some great aerial views from
[1:07:46] Sangrelive. We're going to put those out here pretty soon. And we might have to go get
[1:07:50] some new ones because I think the work that was done when we first did it is far surpassed
[1:07:56] What is there now because I didn't I didn't know the flag polls were in.
[1:08:00] All right, so we'll go get some more aerial views and I know you're busy.
[1:08:07] So well, with that said, and there being no further business, this meeting is adjourned at 724.
[1:08:17] or...
[1:08:18] PIEF!
