[0:09]
Good afternoon, everyone.
[0:09]
Welcome to our July
14 board meeting.
[0:11]
Please join us in the Pledge.
[0:13]
I pledge allegiance to the flag
of the United States of America,
[0:17]
to the Republic for
which it stands.
[0:20]
One nation under
God, indivisible,
[0:23]
with liberty and
justice for all.
[0:25]
Roll call.
[0:26]
Supervisor Wilhelm here.
[0:28]
Councilman McCarthy here.
[0:29]
Councilwoman Noah here.
[0:30]
Councilwoman zarella
here, Councilman Lowman.
[0:34]
Yeah all right.
[0:35]
We will begin this afternoon.
[0:37]
We have two site plans
Mr. Trotter, you're up.
[0:43]
Good afternoon, supervisor,
members of the town board.
[0:45]
I'm Liam Trotter with
the planning department,
[0:47]
and I have two site plans
to present to the board
[0:49]
this afternoon, acting as the
board of site plan review.
[0:52]
The first application is called
Vincent's woodfired pizza.
[0:55]
The subject site is
located on the Southeast
[0:58]
corner of Lake Avenue and
Woodlawn Avenue in ST James.
[1:02]
The proposal is for
a change of use from.
[1:05]
First floor office
to food retail.
[1:07]
Facade alterations.
[1:08]
Demolition of existing detached
garage and a parking lot.
[1:12]
Expansion a new curb cut on Lake
Avenue and associated site work.
[1:16]
So this is the
proposed site plan.
[1:18]
A lot of the parking along
the East side of the building
[1:22]
currently exists.
[1:23]
The parking lot expansion
will occur on the South side
[1:25]
of the building, and
there'll be a new curb cut
[1:29]
exit driveway onto Lake Avenue.
[1:31]
There currently is a drop curb
that was installed with the Lake
[1:35]
Avenue restoration project.
[1:37]
So they'll be utilizing
that existing drop curve.
[1:39]
So there won't be
any new disturbance
[1:41]
of the sidewalk on Lake Avenue.
[1:45]
This is a Street
view from Woodlawn.
[1:48]
This is the Garage that
will be demolished.
[1:51]
And there will be new head in
parking along the East side
[1:54]
of the property.
[1:56]
Because there is a neighbor
directly to the Middle East.
[1:58]
The applicant will be proposing
a new PVC fence and plantings
[2:02]
along that property line
to mitigate any noise
[2:04]
and visibility impacts.
[2:07]
And this is the Street
view from Lake Avenue.
[2:10]
As you can see right here,
this is that existing drop
[2:12]
curve that will be accessible
with this new parking lot
[2:16]
addition.
[2:18]
And the applicant has
agreed to five conditions
[2:20]
of site plan approval.
[2:22]
The first condition is
that the applicant obtain
[2:24]
the necessary permits from
the town building department,
[2:27]
and that any
proposed ground sign
[2:29]
shall be a monument style with
a 2 to three foot masonry base.
[2:32]
Not to exceed a total
height of 8 feet.
[2:34]
The second condition is that
the applicant shall install
[2:37]
a tree preservation
fence around all trees
[2:39]
to be preserved on site.
[2:41]
The third condition
is that the applicant
[2:42]
shall obtain a road opening
permit from the town
[2:45]
highway department.
[2:46]
The fourth condition is that
prior to the issuance of a CEO,
[2:50]
the town of Smithtown drainage
on the corner of Lake Avenue
[2:52]
and Woodward Avenue shall be
located, identified and shown
[2:55]
on the final as built survey
and easement shall be submitted
[2:59]
and approved by the
engineering department
[3:01]
and then filed with the
town for future maintenance
[3:03]
of these structures.
[3:04]
So there's an existing
drain on the corner,
[3:08]
and there might be some
structures that might
[3:10]
be on the subject property.
[3:11]
So all the engineering
department is asking for that.
[3:13]
Those structures be
identified and any easements
[3:16]
put in place if necessary.
[3:19]
And the last condition is that
the landscaping and site work
[3:22]
shall be modified in
accordance with the master
[3:24]
plan prepared by the planning
department dated July 7, 2026.
[3:27]
Which is this plan.
[3:29]
What we were asking for
is the species of plants
[3:34]
that the applicant had specked
out along the North side
[3:36]
of the parking lot.
[3:37]
They were proposing red
Cedars and arborvitae, which
[3:40]
are taller of a
species and may not
[3:42]
be appropriate for this area,
what we were asking for is
[3:46]
a boxwood or similar
mid-sized shrub
[3:48]
that's mainly to screen any
cars that might be parked there.
[3:52]
And we're also
asking for a walkway
[3:55]
connection from the
South parking area
[3:58]
to the entrance of the building.
[4:01]
And lastly, this is the
proposed facade alterations.
[4:05]
The building will be
resided with a white board
[4:07]
and batten and a new
faux chimney, which is.
[4:10]
This will be facing the
Woodward Avenue elevation.
[4:16]
Does the board have any
questions on this proposal.
[4:18]
I do have a question.
[4:19]
I'm having a really
tough time envisioning
[4:21]
that piece of property
becoming a pizza place.
[4:24]
When the time comes.
[4:28]
I remember when 7-eleven was
coming in and they came and they
[4:31]
gave us the photo of
what they were doing,
[4:34]
which was really a help because
we got to have some input and it
[4:37]
turned out to be beautiful.
[4:40]
When it's ready, might
they bring that into us
[4:44]
so we could look at the facade.
[4:46]
And if there was something
we weren't happy with,
[4:50]
maybe talk about it, would
that be something we could do.
[4:53]
That's a possibility.
[4:54]
Yeah I can ask architect to
provide us better renderings
[4:57]
so you can better visualize the.
[4:59]
Yeah, because we
did that with 7:11
[5:03]
and we had little ideas and that
they might want to talk to them.
[5:07]
Yeah that would be my concern.
[5:10]
Would you like that to be
a condition of approval.
[5:12]
I would like to see it.
[5:13]
Yes OK.
[5:14]
If the board is OK with that.
[5:16]
Well, what are if that's the
case, we can't vote on it today.
[5:21]
We can either.
[5:22]
All right.
[5:23]
So it doesn't have
to be a condition.
[5:24]
Maybe we could see it.
[5:26]
And it doesn't have to
be written in stone.
[5:28]
We cannot vote on
this either way.
[5:31]
This is the proposed.
[5:33]
We can put a condition on that
says the architecture should be
[5:37]
subject to a site plan
addendum, and then you
[5:41]
still can't vote on it today.
[5:44]
We can vote on it.
[5:45]
We just won't have
the building permit
[5:47]
be issued until the
I would recommend
[5:49]
I would make a recommendation.
[5:50]
Councilwoman, if you want
to table this or table it
[5:54]
because I don't see how we vote
on this site plan as it exists.
[5:58]
If there's questions
about it, we
[5:59]
should just table it and leave
it alone and let's vote on it.
[6:02]
Excuse me.
[6:03]
It's OK.
[6:04]
Leave it alone.
[6:04]
Let's vote on it.
[6:05]
It's all right.
[6:06]
I mean, I trust the
proposed architecture.
[6:08]
Yeah we did.
[6:10]
We had discussions with the
architect during the site plan
[6:13]
review and.
[6:13]
OK, from what the
building looks like now
[6:17]
it's just blue horizontal
siding with black window.
[6:23]
Familiar the first floor
windows have white trim,
[6:26]
the second floor of Black trim.
[6:28]
Everything with this
proposal will be consistent.
[6:31]
I mean, it's more
of a white building,
[6:32]
but it's the siding
is consistent.
[6:35]
The window trim is consistent.
[6:36]
What color will the siding be.
[6:38]
It's white.
[6:39]
Yeah white board.
[6:40]
Oh, good.
[6:40]
One question is Vincent
going to be living upstairs
[6:44]
or is he renting that out.
[6:47]
I know the second floor
will be maintained
[6:49]
as an accessory apartment.
[6:50]
I don't know if the owner
will be living there,
[6:52]
or if he has someone
else renting it.
[6:53]
Do we know who's Vincent
and Liam on the corner.
[6:58]
That looking for the
drainage structure.
[7:00]
We identify all
drainage structure
[7:02]
when we reconstructed
Lake Avenue,
[7:04]
so that should be
pretty easy to find.
[7:05]
We just look at those plans.
[7:07]
Everything was marked out.
[7:08]
We can consult with the
engineering department on that.
[7:10]
All right.
[7:13]
Any other questions.
[7:15]
No OK.
[7:16]
Thank you.
[7:17]
The next application
is Scotsman auto body.
[7:25]
The subject site is
located on the Northeast
[7:27]
corner of Middle Country road
and Whyte Avenue in ST James.
[7:32]
The proposal is the construction
of a new 2,400 square foot,
[7:35]
one story repair garage building
with associated site work.
[7:40]
As you can see right here
where I have highlighted,
[7:42]
this is the location of
the proposed building.
[7:45]
There are three other
existing structures
[7:47]
on site for the
repair in business,
[7:53]
there was actually a
single family dwelling
[7:56]
within this location that
was recently demolished
[7:59]
within the last year.
[8:00]
I'll pull up a Street
view from Whyte Avenue.
[8:03]
Yeah, this is the dwelling that
was previously there again.
[8:06]
It was taken down
several months ago.
[8:10]
And this is the proposed
rendering for the new structure.
[8:15]
It will have a masonry water
table, white windows, door.
[8:21]
One of those prefab
metal buildings.
[8:24]
The applicant has agreed
to four conditions
[8:26]
of site plan approval.
[8:27]
The first is that
the applicant obtain
[8:28]
the necessary permits from
the town building department.
[8:31]
The second condition is that the
applicant shall obtain a road
[8:33]
opening permit from
the town highway
[8:35]
department for improvements
along Whyte Avenue.
[8:38]
The third condition is that
the applicant shall submit
[8:40]
physical building material and
color samples to the planning
[8:43]
department, and
the last condition
[8:45]
is that the property shall
not be utilized for the sale
[8:47]
or rental of Motor Vehicles.
[8:49]
Mobile homes, boats
or similar articles.
[8:52]
And that condition is the
same condition that the BCA
[8:54]
enacted with their approval.
[8:58]
Any questions on this proposal.
[8:59]
Questions by the board.
[9:01]
No the landscaping
will be sprinkled.
[9:03]
What is sprinkled so it
doesn't all die and stuff.
[9:05]
We can verify that.
[9:06]
Yes because there
was a BCA condition
[9:09]
that the row of evergreens
along the North property line
[9:14]
be maintained.
[9:15]
There was a few dead ones that
needed to be replaced with this.
[9:17]
With the site plan application,
which they're proposing to do.
[9:20]
Thank you.
[9:21]
Any other questions.
[9:25]
OK thank you, Mr. Trotter.
[9:27]
We will be voting
on those site plans
[9:29]
at the conclusion of the agenda.
[9:31]
Thank you.
[9:31]
You're welcome.
[9:32]

[22:46]
Bob semprini 11.
[22:47]
Delmar lane komack, President,
komack community association.
[22:51]
Good afternoon, everybody.
[22:53]
As the previous two meetings,
I did mention the heavy truck
[22:56]
traffic problem we've
been having on town
[22:58]
Road for quite some time now.
[23:01]
I had mentioned that
superintendent Jordan Cox is
[23:04]
going to write you
all a letter, and you
[23:07]
would think it would be
as easy to write a letter
[23:09]
and send it out.
[23:10]
But every organization has
their protocols and all that.
[23:14]
So it's already been
approved by the school board
[23:19]
and it had to go through legal.
[23:21]
Now they want everybody on
the school board to sign it.
[23:24]
So you should be
receiving that letter
[23:26]
request in removal of that truck
traffic sometime in August.
[23:34]
In addition, for that, to
get some updated information
[23:38]
in regards to the traffic
flow North and South
[23:41]
of townline road.
[23:42]
We are asking for an updated.
[23:44]
I'll just call it
metering of traffic.
[23:46]
I'm not sure what the
proper terminology
[23:48]
is that through whatever
department that might be.
[23:53]
Also asking again for
the reconstruction
[23:56]
of an area of townline road,
as I mentioned last time,
[23:58]
is townline road at the
intersection of Havemeyer,
[24:02]
where the road is
literally collapsing there.
[24:05]
If you haven't had the
opportunity to drive that road,
[24:10]
I highly suggest that you do.
[24:11]
You get a real view of exactly
what we are talking about.
[24:15]
And in addition to that, I had
also given you last meeting
[24:21]
a copy of the Oyster
Bay codes in regards
[24:23]
to nuisance, particularly
the burning of wood
[24:30]
in one's backyard.
[24:33]
Councilwoman Lynn Novick.
[24:37]
Thank you for your time.
[24:38]
You spent this woman right
here, Sylvia Strauss.
[24:42]
It is her home.
[24:44]
They are dealing with
one minute remaining.
[24:46]
Thank you.
[24:47]
They're dealing with exceeded
air qualities that burning
[24:54]
wood coming into their.
[24:56]
Into their yard 8 to 10
hours a day on the weekend,
[25:01]
which is, bad health
on their side there.
[25:06]
She will probably talk here in
a couple minutes when chosen.
[25:10]
Did anybody have any questions.
[25:13]
Anything that you can say
to me either now or after in
[25:17]
regards to Indian head
road or anything else
[25:20]
that I just brought
to your attention.
[25:23]
Anybody traffic monitoring
on town line Mr. Sabrina,
[25:27]
you should contact the
traffic safety department.
[25:30]
That's who handles that.
[25:31]
Is that going to
be Mitch Crowley.
[25:33]
That's correct.
[25:34]
The repair of town Road.
[25:36]
You should report that to
the highway superintendent,
[25:38]
Mr. Robert Murphy.
[25:39]
OK I'm very familiar
with him as well.
[25:42]
Anything in regards to the code.
[25:48]
Anybody look.
[25:49]
Look at that information.
[25:50]
I believe the town attorney
is looking into that.
[25:56]
The codes that you
sent, et cetera.
[25:57]
But I don't know if we have a
conclusion at that point yet.
[26:01]
OK thank you.
[26:03]
Yes intersection.
[26:05]
You said the road was
half a mile Half a mile
[26:07]
and half a mile.
[26:09]
And town Road itself.
[26:10]
Yes so it's only when
you're going northbound.
[26:14]
So once you come northbound
over Commack road,
[26:17]
you go past the
cemetery and all that.
[26:20]
The first light that you will
come to is Havemeyer lane.
[26:23]
And you will see what
happens to that road.
[26:26]
You're like this, and
then you're like this.
[26:29]
Yeah town line and Havemeyer.
[26:30]
OK thank you.
[26:34]
Julia Julia Strauss.
[26:36]
Julia Strauss.
[26:38]
Hello thank you.
[26:39]
Can I please just excuse me.
[26:42]
Yes, you have to.
[26:45]
Submit that to the clerk.
[26:46]
It's OK.
[26:47]
No problem.
[26:48]
Thank you.
[26:50]
Please state your name and
address for the record.
[26:53]
17 Harry Klein.
[26:55]
Commack hello to all.
[26:58]
You all know me by now.
[27:00]
I send email to everybody.
[27:02]
I have nothing to change.
[27:04]
But just today, I got an email
from a scientist who read the.
[27:10]
Purple air device
that I have in my home
[27:13]
and just will show you
how dangerous is it.
[27:16]
As a health matter
to me and my family,
[27:19]
we do not sit outside
on the weekends and.
[27:24]
It's really upsetting.
[27:26]
We have granddaughters.
[27:27]
We have family.
[27:29]
I really want to believe that
my neighbor is a kind man.
[27:33]
I really want to
believe because he was.
[27:36]
And all these issues
started when we really
[27:39]
asked over and over, could
you please not burn or burn
[27:43]
two hours at the
moment that we started,
[27:47]
he just decided that
we're harassing him.
[27:50]
So please take it to your heart.
[27:54]
Thank you.
[27:55]
Thank you.
[27:58]
No others.
[27:59]
