[3:15] engagement I appreciate the opportunity

[3:16] to present to you all tonight

[3:19] um for those of you mostly familiar

[3:22] faces I think that have had the pleasure

[3:23] or perhaps the pain of sitting through

[3:25] this presentation before I thought we'd

[3:27] do things just a little bit differently

[3:28] we did bring or I did bring a hard copy

[3:32] of the audit reports with us um through

[3:35] over behind Lisa so you can grab a hard

[3:37] copy after the presentation or after the

[3:39] meeting tonight I think you already have

[3:41] an electronic copy but I thought we

[3:43] would just walk through the smaller

[3:44] presentation file that I handed out

[3:46] before the meeting started

[3:49] so we'll jump straight to page two of

[3:52] the presentation file

[3:54] this essentially just goes over the

[3:56] three different types of Auditors

[3:57] reports that are included in your

[3:59] financial statements the first report is

[4:01] the independent Auditor's report this is

[4:04] essentially where we State whether we

[4:06] think the numbers is presented are

[4:07] materially correct in accordance with

[4:09] generally accepted accounting principles

[4:11] if you guys have a clean and modified

[4:13] opinion that just means that we think

[4:15] that the numbers as shown in the report

[4:16] and all the related disclosures are in

[4:18] fact materially correct in accordance

[4:21] with all of the applicable standards

[4:23] the next type of Auditor's report

[4:25] relates to compliance and other matters

[4:27] this is what I usually call the yellow

[4:29] book report here we take a look at

[4:31] internal controls and we let you know if

[4:33] there are any significant deficiencies

[4:35] or material weaknesses we also take a

[4:38] look at compliance related matters that

[4:39] the auditor of Public Accounts for

[4:41] Virginia tells us that we're required to

[4:43] test to make sure that you're compliant

[4:45] with the code of Virginia we had no

[4:48] material compliance related matters as

[4:50] part of our procedures we did have audit

[4:53] adjustments that were proposed as part

[4:55] of our procedures to make sure that the

[4:57] numbers were in accordance with

[4:58] accounting principles so that is

[5:01] included in your report that's not an

[5:03] uncommon finding it's been in the report

[5:04] for a couple of years now I think

[5:07] um the standards of the standards have

[5:09] gotten very complex your reporting time

[5:12] frame is limited meet the deadline of

[5:14] December 15th so it's not really an

[5:17] audit concern per se but we are required

[5:19] to include it in the report

[5:22] um the last type of Auditor's report

[5:24] that's included relates to uniform

[5:26] guidance

[5:27] because you receive and expend over 750

[5:30] 000 in federal funds every year you're

[5:33] required to undergo a single audit

[5:35] um so here's sort of like the yellow

[5:37] book report we take a look at internal

[5:38] control related to those Federal

[5:40] programs and then compliance related

[5:42] items so you guys have a clean

[5:44] unmodified opinion related to uniform

[5:47] guidance that just means we didn't have

[5:48] any non-compliance or any internal

[5:50] control related matters for the federal

[5:52] programs that were tested

[5:55] on page three is a general fund summary

[5:59] this will match exhibit five of your

[6:01] report once you get a hard copy or the

[6:03] electronic copy if you've reviewed it

[6:05] essentially this is the income statement

[6:07] for the general fund on a modified basis

[6:10] of accounting it's scheduled out for the

[6:12] last five years so that you can see how

[6:14] revenues or expenditures have either

[6:16] grown or declined you've got an

[6:18] annualized compounded growth rate off to

[6:21] the side that's meant to smooth the

[6:23] effects of any outlying transactions

[6:25] that occur in any given year so that you

[6:27] can see incrementally how those numbers

[6:29] have grown or declined

[6:32] um I'll try not to get too much into the

[6:34] numbers I know that I could probably

[6:35] talk about them for hours but nobody

[6:37] really wants to listen to that I'm sure

[6:39] um so I just thought I would point out a

[6:41] few things to you

[6:42] um you will see that intergovernmental

[6:44] revenues went up pretty significantly in

[6:46] 22 from 2018 but it was down from 2021

[6:50] that's the cares and arpa funding last

[6:52] year you had five million of cares funds

[6:55] that you received and expended in 22 you

[6:57] had 1.5 million of arpa funds I expect

[7:00] that that number will go up as you

[7:01] continue to utilize the arpa funds that

[7:03] are that you've received

[7:07] um the only other thing that I really

[7:09] wanted to talk about on this page is

[7:11] down towards the bottom with the yellow

[7:13] highlight and the blue Highlight

[7:15] we've calculated your reserve balances

[7:17] you probably remember that when we look

[7:19] at your reserves we look at your

[7:21] unassigned fund balance and then your

[7:22] cash balances as it relates to

[7:25] expenditures we take the general fund

[7:27] expenditures plus the school fund

[7:28] expenditures take out the transfer in

[7:31] between so that it doesn't get

[7:32] duplicated and then you've got your

[7:34] reserve balances down there at the

[7:35] bottom gfoa recommends that you have two

[7:38] months of reserves on hand that's about

[7:41] 16 17 percent so you can see that you're

[7:44] just over those Reserve balances and you

[7:47] can also see which I was pretty

[7:49] pleasantly surprised that over the last

[7:51] five years those balances have grown

[7:53] incrementally every year that's what we

[7:56] like to see I tend to be risk-averse so

[7:59] I would prefer that those balances

[8:00] continue to grow just a little bit more

[8:02] but um you know I like to see that

[8:04] they're growing step by step every year

[8:08] um what can help lead to that you'll

[8:09] notice your revenues are slightly

[8:11] outpacing your exposure so that's

[8:13] helping to incrementally grow that fund

[8:15] balance every year

[8:17] um one thing I wanted to mention on this

[8:20] page if you try to tie your cash and

[8:22] investment balance to the report itself

[8:24] it's not going to tie that's because in

[8:27] this presentation I took out the

[8:29] unearned arpa funds that you've received

[8:31] but haven't extended yet because that

[8:33] kind of inflates your cash balances so

[8:36] they don't match but that is intentional

[8:38] and you can see that your cash balances

[8:40] and your unassigned fund balance as a

[8:42] percent of expenditures are kind of

[8:44] growing hand in hand and trending

[8:46] together just like we would expect

[8:49] the next couple of pages are just parts

[8:53] of your revenues and your expenditures

[8:55] from 2018 compared to 2022. I won't talk

[8:59] about these too much I just think it's

[9:00] interesting to see that they don't

[9:02] really change very much over the course

[9:04] of the years so as you work on trying to

[9:06] generate more revenues or potentially

[9:09] cut expenditures if you have to do that

[9:11] at some point you can see where you

[9:13] generate the most Revenue which pieces

[9:15] of the pie you have control over and

[9:17] then you can see where you spend most of

[9:19] your money

[9:21] on page six is a summary of long-term

[9:25] obligations for the governmental

[9:28] activities so the general fund and the

[9:30] other governmental activities that you

[9:31] all report

[9:33] um the component Unit School Board and

[9:34] then the water and sewer fund

[9:38] here we have actual debt issuances along

[9:41] with net pension and oped liabilities

[9:44] compensated absences and things like

[9:46] that a couple of things that I think

[9:49] people have really noticed this year you

[9:51] can see that your net pension liability

[9:53] dropped significantly it actually went

[9:56] to an asset this year that's solely a

[9:59] function of the fact that vrs had a

[10:01] really good year on their investments in

[10:04] 2021 so the market was down in 2020 2021

[10:08] it came back up so your net balance of

[10:11] your pension went down significantly if

[10:14] you look at your financial statements

[10:16] though that amount is offset with a dirt

[10:18] outflow and a deferred inflow and so

[10:20] there's really not much of a net impact

[10:22] on net position your outflows and

[10:24] inflows are amortized in over four years

[10:27] to offset those large fluctuations when

[10:30] there are swings in the market so that

[10:32] it doesn't fall all the way to net

[10:33] position people see that and either get

[10:36] really excited or really scared about it um so I just wanted to mention that

[10:40] otherwise you had a debt issuance in

[10:43] your general fund of 2.6 million for

[10:45] some capital projects I think the

[10:47] transfer station if I remember correctly

[10:49] and otherwise it was just routine debt

[10:52] payments um from there

[10:55] the next couple of pages are required

[10:57] communication with governance letter you

[10:59] guys have a pretty standard boilerplate

[11:01] letter that's what you want nothing of

[11:04] significance to really go over the

[11:06] school board did Implement gassy 87

[11:09] related to leases leases for the county

[11:11] were evaluated but were determined to

[11:13] not be material and therefore they were

[11:15] not reported we do have a management

[11:18] comment a couple Pages back that we

[11:21] recommend or are recommending to all

[11:23] localities or all governmental entities

[11:25] really to evaluate your capitalization

[11:28] thresholds particularly for leased

[11:30] assets a lot of places are implementing

[11:33] a higher threshold for leased assets

[11:34] because they are so much more cumbersome

[11:36] to record in your books and I do have an

[11:39] example that I can provide if you all

[11:41] are interested

[11:43] otherwise nothing really to mention or

[11:46] note that we haven't already discussed

[11:49] the next few pages are the proposed

[11:51] journal entries I won't go over those

[11:53] but those are there for your

[11:54] informational purposes if you wanted to

[11:56] take a look at them

[11:58] same on page 17 or the management

[12:01] recommendations or the audit

[12:03] recommendations as the part of the

[12:05] procedures that we performed I don't

[12:08] typically go over these but they're here

[12:10] so that you all have them and you're

[12:11] aware of any audit recommendations that

[12:13] we had

[12:14] and then the last few pages are the

[12:17] upcoming gassy standards it seems like

[12:20] every year we've got three or four new

[12:21] Gatsby's that need to be evaluated so

[12:23] that we can implement or determine if

[12:26] their material to be implemented so this

[12:28] is just to get you guys out in front of

[12:30] that so that you're aware of the

[12:31] upcoming standards

[12:33] if anybody has any questions I'd be

[12:37] all that I had to go over with you all

[12:45] reviewing the reports or the

[13:18] so they can pay the bills on time so to

[13:20] speak is that going to create a lot of

[13:22] problem trying to implement that but is

[13:24] it going to be worth the bite to do that um to be honest I'm

[13:29] not sure what the rationale behind that

[13:30] was it was my understanding that it was

[13:32] because all of the schools at one point

[13:33] had their own not all of the schools had

[13:36] their own cafeteria but like centrally

[13:37] within each location they had their own

[13:40] and then it all got brought into one and

[13:42] it's our understanding that if they're

[13:44] centralized like that it should be with

[13:46] the treasurer I can't imagine that there

[13:48] would be

[13:49] um a delay in paying the bills I mean as

[13:51] far as I'm aware the school board itself

[13:53] doesn't have an issue with paying the

[13:55] bills in a timely manner um but I'm not

[13:59] sure if that I'm not involved in the

[14:02] day-to-day so I don't know

[14:04] yeah yeah

[14:06] I think that is um I've talked to the

[14:08] school board about it I don't know that

[14:09] we've spoken about it but um it's almost

[14:11] seems like it's one of those things that

[14:13] will agree to disagree on that we feel

[14:14] like it should be with the treasurer but

[14:16] the school board

[14:17] I agree with the school yeah yeah

[14:21] because it's it's important we pay our

[14:23] bills on things like that on time oh

[14:25] yeah we've been through that over the

[14:27] years

[14:28] I just think it's you know we're not

[14:30] dealing millions of dollars out of it

[14:31] but we are saving a lot of interest yeah sure yeah I just while you were

[14:37] here in front of me yeah

[14:39] it's a little bit of a catch-22 right

[14:42] because if you did move it and you paid

[14:43] your bills late I'd probably be here

[19:08] um for years we've had the music and

[19:10] Festival ordinance and it's required all

[19:12] applicants to come in and file an

[19:14] application and we set up the public

[19:15] hearing oftentimes with very little

[19:18] Fanfare very little concern

[19:21] um and so the idea with this proposed

[19:23] amendment was to um to make an

[19:25] Administration administrative approval

[19:27] process by which someone could come in

[19:29] apply we would send letters to all the

[19:32] adjoining property owners if there are

[19:34] no concerns then we would approve it

[19:36] um administratively if there are

[19:38] concerns then that doesn't necessarily

[19:40] deny the application that just then sets

[19:43] the rest of the ordinance in motion and

[19:45] we would set up a public hearing with

[19:46] the board and let the board ultimately

[19:48] vote

[19:49] so that's the goal of this proposed

[19:51] amendment

[19:52] did anyone sign up to speak no sorry

[20:10] so this proposal is a result of

[20:13] basically

[20:14] the protocol that we've historically

[20:17] practiced not necessarily what the

[20:18] ordinance says if you read the nuisance

[20:20] ordinance literally every time we

[20:23] receive a nuisance complaint we're

[20:25] supposed to set up a public Hearing in

[20:26] front of the board and oftentimes a lot

[20:29] of these can be handled with a simple

[20:31] letter uh to the property owner and so

[20:33] we're just asking that the nuisance and

[20:35] we've done that historically if we get a

[20:37] complaint I will send a letter to the

[20:38] folks and oftentimes they'll step up and

[20:41] they'll they'll take care of the

[20:42] situation so not necessarily needing to

[20:45] evolve to you know bring the board into

[20:48] it in every single case we thought that

[20:50] we would suggest amending the ordinance

[20:51] to allow for us to at least send that

[20:53] initial letter if we don't get a

[20:55] response or they just refuse to comply

[20:57] then we follow the standard protocol we

[21:00] set up a public hearing like we'll have

[21:01] for two properties in just a minute

[21:04] so that's the proposal for the for the

[21:06] change to the nuisance organs

[21:09] all righty did anyone sign on speak on

[21:25] Sewer fees

[21:35] with water and sewer connections

[21:37] currently we require all land owners to

[21:40] put water and sewer Connections in their

[21:42] name and you all

[21:45] got a glimpse of this a month ago when

[21:48] we had the folks over in Saltville that

[21:49] were unable to get a water service and

[21:52] so this proposed change would fix that

[21:53] situation it would allow anyone that

[21:55] wants to to basically you know get

[21:57] public water or sewer the ability to

[21:59] come in and apply for service

[22:02] the other change would be that we now

[22:04] require deposit

[22:06] um so kind of following in line with

[22:07] most public utility companies where you

[22:09] pay a deposit you don't pay your bill

[22:10] then your deposit offsets that and and

[22:13] we go through that process

[22:16] 100 it's a 100 deposit yes

[22:19] is the proposal and I don't think anyone

[22:22] signed up to speak but I did receive one

[22:24] letter

[22:25] um and I promised the the gentleman that

[22:27] I would read that uh here tonight at the

[22:29] hearing it's just the board of

[22:30] supervisor

[22:32] 121 Bagley Circle Marion Virginia to

[22:35] whom it may concern I recently learned

[22:37] that Smith County is considering an

[22:38] update to their water billing system as

[22:40] an owner of a mobile home park the

[22:42] current Billing System is not working

[22:43] the billing system for my property is

[22:45] set up where each tenant is on their own

[22:47] meter but yet I am responsible for the

[22:49] bill the system is not working and I

[22:51] support a revision of the system so the

[22:54] tenant is responsible the current system

[22:55] is hard to manage with constant problems

[22:57] the bill is sent to the owner of the

[22:59] property rather than the tenant

[23:00] occupying the unit if there is an error

[23:03] or leak it makes more sense for the

[23:05] actual customer of the utility to

[23:06] receive the bill this is more consistent

[23:08] with standard billing practices of other

[23:10] utilities internet providers and billing

[23:12] in general as an owner of mobile home

[23:14] parks in other states the more

[23:16] traditional system of tenant

[23:17] responsibility for their own bill works

[23:19] much better respectfully Roger Wilson

[23:22] senior owner of the saltwell mobile home

[23:24] park

[23:26] and that's all received in regards to

[23:28] this matter

[23:29] anyone president want to speak on this

[23:31] issue

[23:34] here you know I'll close that public

[23:36] hearing now we'll get into the

[23:39] okay proposed noise ordinance as all of

[23:42] you recall we once had a noise ordinance

[23:44] on the books uh it was deemed on

[23:46] enforceable and and you all voted to

[23:48] repeal it earlier this year that has

[23:50] been brought back up with this proposed

[23:52] amendment

[23:54] um in short The Proposal is to adopt a

[23:57] plainly audible language uh as opposed

[23:59] to to setting a specific limit and

[24:01] requiring decimal meters and training

[24:03] and that protocol

[24:06] um and hopefully you've all had a chance

[24:08] to rate it you see what activities are

[24:11] prohibited

[24:13] um typically during the night hours so

[24:15] there's a Time range that applies here

[24:16] and then the goal is to to basically

[24:18] prohibit these sounds what's spelled out

[24:20] in the ordinance from crossing the

[24:22] property line there's also a number of exemptions that was a popular

[24:27] topic during uh during the committee

[24:29] meeting and then some of the calls that

[24:31] we've gotten since then so I would

[24:33] encourage you to read the exemptions and

[24:35] see what activities are exempt from the

[24:37] noise ordinance

[24:38] if you have any specific questions I'll

[25:14] the day when you pull up to a traffic

[48:57] they do our billing for it because with

[48:59] some policy enough that

[50:53] turnover issues and vacancies they

[50:57] requested that we allow them to roll

[50:59] over those funds to the current fiscal

[51:10] thousand dollar range that they have not

[51:11] billed us for so it's almost a give and

[51:18] committee was recommend allowing them to

[51:21] roll it over which would hopefully

[51:22] result in another Surplus this coming

[51:24] fiscal year following discussion Mr

[53:24] CDL A's Class A drivers for semi trucks

[53:30] applications for with folks who have

[53:32] cdlb which can drive a roll off but not

[53:36] with a not a trailer

[53:38] following the the lead of several law

[53:41] enforcement agencies they

[53:44] that we came up with a draft contract

[53:47] for basically if we hire a cdlb

[53:50] um paying for the training necessary to

[53:53] bring them up to a cdla with the

[53:55] agreement that they will work for the

[53:57] county for a set period of time and if

[53:59] they leave prior to that they owe us for

[54:01] the cost of the of the training and the

[54:05] one of the conversations we had during

[54:08] that during the meeting was should we

[54:11] have them pay us for the cost of the

[54:13] salary also so the law enforcement

[54:15] contracts do have that provision where

[54:17] they they reimburse for the salary and

[54:19] the cost of training and anything else

[54:21] related so we can add that language in

[54:24] if we needed following discussion

[54:27] supervisor Sturgill made a

[54:29] recommendation to approve the

[54:30] reimbursement contract for training

[54:31] expenses for online applicants regarding

[54:34] the hiring of cdla drivers as amended to

[54:37] include a session for the provision to

[54:40] um oh I'm sorry let me take a step back

[54:43] the other item that they just discussed

[54:45] was what if they failed the class do

[54:47] they owe us for that cost and I think

[54:50] that needs to be included into it in the

[54:52] committee too so to include the amended

[54:56] section four for the provision of

[56:54] update on our Smith County EMS station

[56:56] in Atkins Mr Mr Crawford provided an

[56:59] update on that station

[57:01] and discuss the goals of the agency in

[57:04] advance of the Fire EMS location would

[57:06] be a backup for all the agencies within

[57:08] Smith County

[57:10] uh Mr utt said that the primary goal of

[57:12] the agency would be providing EMS

[57:14] support and Mr Crawford discussed the

[57:17] radio frequency and paging that would be

[57:19] used and noted that if it became

[57:20] burdensome burdensome it would be moved

[57:23] to a different Channel

[57:25] Chief keezling from Marion Fire EMS was

[57:27] here in Aspen County if if the Fire EMS

[57:30] station in Atkins would be able to do

[57:32] extrication and Mr Crawford noted that

[57:34] the county would not have that ability

[57:36] initially and would still need to lean

[57:39] on marrying a fire department like we

[57:41] currently do now Chihuahua District

[57:43] supervisor Mr Sturgill advised that the

[57:45] new training facility located in

[57:46] Chilhowee First Responders could be

[57:49] cross-trained there and they advised

[57:51] that he would find that it would be

[57:52] extremely beneficial for all of the

[57:55] Departments across the county

[57:57] in your packet you'll see starting on

[58:00] page 128 is a map of all of these

[58:05] assignments for the county I discussion

[58:07] was had with Mr Rush from the town of

[58:09] Marion regarding those DSN assignments

[58:13] and ask if the Atkins ESN would benefit

[58:15] the group Mr Crocker advised that he

[58:17] would have the changes drawn up and

[58:20] distributed for approval showing the

[58:21] Atkins esn's of 560 538 and 559 changed

[58:26] to reflect the County EMS as the primary

[58:28] agency instead of Rural Retreat and man

[58:34] the next item and discussion was the

[58:36] Smith County and expectations Mr shared

[58:39] a handout to summarize the expectations

[58:40] for EMS operations and accounting and

[58:42] the next steps that will be taken moving

[58:44] forward he advised the CIS agreements

[58:47] progress progresses whether County

[58:49] operated agency or contracted with each

[58:51] town or a combination specific

[58:53] expectations would be identified and

[58:55] create create goals for each agency

[58:58] the list of expectations was discussed

[59:00] in Mr advised that the full agreement

[59:02] would be drafted using these bullet

[59:03] points for further review and Mr Rush

[59:06] noted that he felt all the points were

[59:08] manageable and he supported the effort

[59:09] and you will find that list of both

[59:11] points on page 127 and those are for EMS

[59:17] agencies with a call load of over 500 or

[59:20] 5 500 things about money 500 calls per

[59:23] year

[59:24] so that would basically be chillowing

[59:26] and yeah

[59:28] so our three towns so and us and in the

[59:32] county yes

[59:33] so those bullet points are staffed with

[59:35] ALS Advanced life support service 24

[59:38] hours a day at 90 of the time that's an

[59:41] average over a quarterly period ALS

[59:43] transport capable ambulance in route or

[59:46] moving towards an initial call within

[59:47] three minutes for first cause of being

[59:49] dispatched at least 90 of the time and

[59:52] that's also an average of over a

[59:54] quarterly period answer initial call 90

[59:57] of the time again average over a

[59:59] quarterly period and partner

[1:00:01] participating in Smith County Fire and

[1:00:03] Rescue Training Academy programs initial

[1:00:05] training provided at no cost and levels

[1:00:07] above basic classes may have a cost but

[1:00:10] at a reduced rate for system

[1:00:11] participants daily operation report

[1:00:13] provided provide daily shift reports to

[1:00:17] dispatch psap to include shift

[1:00:19] assignments which is ALS versus BLS to

[1:00:22] help with coordination of incoming calls

[1:00:24] throughout each day and possibly using a

[1:00:27] web-based app and then having a point of

[1:00:29] contact so they would provide the chief

[1:00:31] or designee to serve as a point of

[1:00:34] contact with the County Emergency

[1:00:35] Management coordinator and the public

[1:00:37] safety department to resolve any

[1:00:38] administrative issues that may arise on

[1:00:40] a day-to-day basis and this person would

[1:00:42] be available at minimum during normal

[1:00:45] business hours throughout the week

[1:00:47] the next item of discussion was the

[1:00:49] Smith County auto aim discussion which

[1:00:51] you all know

[1:00:52] how passionate I am about that and I'm

[1:00:54] thankful to say that I think we are

[1:00:56] finally coming to an end and all finally

[1:00:59] working together the discussion start

[1:01:02] with Mr Crawford minister of providing

[1:01:04] maps and a quick overview of the auto

[1:01:06] Aid concept Mr Crawford noted that all

[1:01:08] agencies are on board with the plan

[1:01:11] except for the town of Marion discussion

[1:01:13] ensued about logistics and expectations

[1:01:15] of the project and Mr Crawford confirmed

[1:01:17] that the town of Marion would have

[1:01:18] certain equipment that would only

[1:01:20] provide services to specific locations

[1:01:22] in Atkins sugar grove and the ad wolf

[1:01:24] areas and would not be responding with

[1:01:26] all equipment to all fires further

[1:01:28] discussion ensued and Mr Jim Barker from

[1:01:31] the Marion Town Council requested a

[1:01:33] formal presentation at the next town of

[1:01:35] Marion council meeting on December 5th

[1:01:37] Mr edavis that would be a great

[1:01:39] opportunity to answer questions or

[1:01:41] concerns by the Town Council I think

[1:01:43] upon completion of that presentation

[1:01:47] the Town Council had been misinformed

[1:01:49] about what the program looked like I

[1:01:51] think they have a better understanding

[1:01:52] of that now and they seem to be on board

[1:01:54] yeah they asked for a copy of the

[1:01:56] agreement that we've emailed them the

[1:01:58] copy of the full agreement so I think

[1:01:59] the next council meeting they'll vote on

[1:02:01] it will be good for toward the end of

[1:02:04] December moving forward county-wide

[1:02:07] and since the time Marion was not

[1:02:09] participating by default that excluded

[1:02:12] Atkins and Sugar Grove from being able

[1:02:14] to participate because Marion was a big

[1:02:15] hole in the center so thankfully with

[1:02:18] them coming on board now can be a full

[1:02:20] county-wide auto aid program that better

[1:02:23] serves our citizens which is the whole

[1:02:25] point of this whole thing

[1:02:27] so our vision for Smith County public

[1:02:30] safety was the next item of discussion

[1:02:32] and Mr Crawford provided a document of

[1:02:34] that Vision which is in your packet and

[1:02:37] it begins on page 135 it is an excellent

[1:02:41] document so if you have not reviewed

[1:02:43] that I highly recommend that you do so

[1:02:45] it includes a vision of moving forward

[1:02:48] with station two which is the former

[1:02:50] Marion lifestyle recruit building on

[1:02:52] Park Street in Marion we're considering

[1:02:55] using that as a Dispatch Center and

[1:02:58] Emergency Operations Center and we have

[1:03:01] quite a deep discussion about that

[1:03:04] and with no further risk to discuss will

[1:06:11] to discuss a wire line upgrade

[1:06:13] um so Mr Williams had reported that he

[1:06:16] was approached by the town of Marion

[1:06:17] regarding the upgrade to water lines on

[1:06:19] West Chilhowee Street

[1:06:22] the town had asked the county if they

[1:06:25] were interested in paying for the

[1:06:26] upgrade from it they're replacing the

[1:06:28] line with a new two inch line they

[1:06:30] suggested maybe it'd be a smart

[1:06:32] investment on for us to pay for the

[1:06:34] difference from a two inch to a six inch

[1:06:37] we sent an email out to the Lane group

[1:06:40] to review the project to see what kind

[1:06:43] of benefit we could have the town

[1:06:45] thought it would be a a cost of thirty

[1:06:49] thousand dollars after reviewing

[1:06:51] everything we realized that the county

[1:06:53] line on the mat on the on paper said

[1:06:56] that we went across the creek and were

[1:07:00] within a few feet of the town of Marion

[1:07:02] which in reality we're about 900 feet

[1:07:04] away from the creek

[1:07:06] sort of the creek correct um so the cost

[1:07:09] went from a 30 000 estimate to about 150

[1:07:11] 000 so because he had a bore under the

[1:07:13] creek

[1:07:15] um so they'll know that that's uh

[1:07:18] as it as advantageous because of uh we

[1:07:21] were hoping that we could spend thirty

[1:07:23] thousand dollars and be able to get fire

[1:07:24] flow in different parts of the county

[1:07:26] um I think if it's going to spend 150

[1:07:28] 000 we wanted to take a step back and

[1:07:30] see where we could put that in better

[1:07:31] spots to get more fireflow capability

[1:07:34] that was more of an informational item

[1:07:39] the next item we talked about were two

[1:07:43] DEQ sewer grants that we were at applied

[1:07:46] for we applied for one on Staley Creek

[1:07:48] route 16. we had a sewer line at father

[1:07:51] Staley Creek that is in Parts in the

[1:07:56] creek or under the creek and the

[1:07:57] manholes are are leaky and we have when

[1:08:01] it's when it rains we the town of Marion

[1:08:04] treats a lot of water for us a lot of

[1:08:05] sewer for us because it's just the rain

[1:08:08] water it's not it's not the good thing

[1:08:10] is the sewer's not yet now it's the

[1:08:12] rainwater getting in

[1:08:13] um so we we did have a uh an offer of

[1:08:17] 500 600 from DEQ for a zero percent

[1:08:20] interest loan over over a period of 30

[1:08:23] years

[1:08:24] um I think the rli is going to make

[1:08:26] sense for that one uh and uh in late

[1:08:30] spring we should hear whether there's

[1:08:32] some Grant funds available

[1:08:34] they did they the state didn't want to

[1:08:37] make the grant funds available yet

[1:08:39] because they haven't they don't have

[1:08:40] anything finalized from the federal

[1:08:42] government on the clean water portion of

[1:08:44] their funds but there's a chance that we

[1:08:46] can have

[1:08:48] is called forgivable

[1:08:50] principal forgiveness they can't call it

[1:08:52] grants they call it personal forgiveness

[1:08:53] but I think we do have a good project

[1:08:57] there no action was necessary yet the

[1:09:01] second project we talked about was a bit

[1:09:03] larger project to get sewer out at gross

[1:09:06] close exit 54 I think we've looked at

[1:09:09] this several times over over the past

[1:09:10] several years the initial project ranged

[1:09:15] from 3.8 million dollars to 6.3 million

[1:09:18] the offer from DEQ was at the initial

[1:09:21] 3.8 million dollar range with a 0.5

[1:09:24] interest rate over 30 years the problem

[1:09:27] there is that's that project only has 20

[1:09:30] customers that you can't get cash flow a

[1:09:34] 4 million dollar project with 20

[1:09:36] customers you're talking twelve thousand

[1:09:38] dollars a month just for that service

[1:09:41] looking at the larger project of closer

[1:09:43] to the Six Million Dollar Mark that gets

[1:09:46] us upwards of 100 plus customers and if

[1:09:49] we get some principal forgiveness that

[1:09:53] might start making some sense so we're

[1:09:55] going to hit the pause button on that

[1:09:57] hoping that we get a hefty principle

[1:10:00] forgiveness amount offer for that again

[1:10:03] just informational at this point and

[1:10:06] that no further business the meeting was

[1:10:09] just adjourned at 10 13. go ahead

[1:10:14] have a conversation with Senator

[1:10:16] pillion's office about this project and

[1:10:19] they indicated that they would like to

[1:10:21] support us on this however they can in

[1:10:28] him quite a bit and I think they

[1:10:30] understood they're they're encouraging

[1:10:32] for the potential for commercial

[1:10:35] development

[1:10:38] with the the cash flow I think that he

[1:10:40] understood so he was going to try and

[1:10:42] encourage as much principal forgiveness

[1:10:44] as we as he could muster also

[1:10:47] how much interest is mustard Lumber

[1:10:49] Company showed in uh

[1:10:51] needing the sewer there have they shown

[1:10:53] any not as much lesser but the property

[1:10:56] owner Mr Bunn he's offered to to put

[1:11:00] some some money into it but I don't

[1:11:03] expect seven figures to break it down I

[1:11:05] mean

[1:11:06] um it would have to be a substantial

[1:11:08] amount of cash to to bring it down to

[1:11:10] where it's cash flowable but they are

[1:11:13] interested in getting sued because we

[1:11:15] can do a lot with uh well it's there's

[1:11:17] some beautiful restaurant sites up

[1:11:19] through there too if we had a sewer in

[1:11:21] that area and the the 6.3 million dollar

[1:11:24] version that brought

[1:11:27] that took the sewer line up up the hill

[1:11:31] east of the exit a fair a fair way to

[1:11:35] get some residential connections and it

[1:11:38] also caught the residential connections

[1:11:40] following around 11 all the way down to

[1:11:41] the space side

[1:11:43] um the 3.8 when that's just the pump

[1:11:45] station that pumps along the rail the

[1:11:48] train tracks and doesn't get any

[1:11:49] residential connections past the

[1:11:52] Brickyard now is it the one that comes

[1:11:53] is it still coming down from the

[1:11:55] convenience station on the interstate or

[1:11:57] is it actually coming up this would be a

[1:12:00] follow the railroad okay

[1:15:58] things rolling on there with Medicaid

[1:16:05] card before the horse it is which

[1:16:07] doesn't make any sense but but even

[1:16:09] after we get approved for Medicaid

[1:16:11] building building

[1:16:15] revenues for four months usually three

[1:16:17] to four months after we start so

[1:18:37] are a lot further down the road we're if

[1:18:41] you live out in the rural area and you

[1:18:42] need help be it fire rescue or what that

[1:18:46] we had Fairly good in the past I'm

[1:18:49] hoping it's better now and we're working

[1:18:51] to make it even better and I I

[1:18:53] appreciate the public bearing with us

[1:18:55] that we've gone through some trying

[1:18:56] times but I think we're getting there

[1:18:59] and I think this board for making some

[1:19:01] decisions has helped us move there and

[1:19:04] when it was first brought up three four

[1:19:06] years ago there was some significant

[1:19:07] dollar figures thrown out there that was

[1:19:10] going to have to spend who's going to

[1:19:12] have to spend immediately and I think we

[1:19:15] have got the job done without spending

[1:19:16] that we spent a lot of money but not the

[1:19:19] huge amount at one time like they had

[1:19:21] suggested and I think we've got more

[1:19:22] than we thought we could get so

[1:19:24] appreciate the public bearing with us on

[1:19:26] that we hope to continue to improve it

[1:19:30] um

[1:19:31] otherwise I hope our board member who's

[1:19:33] not who's not with us tonight did

[1:19:35] illness gets to doing better and get

[1:19:37] back with us next month I hope everyone

[1:19:39] has a nice Christmas and remember the

[1:19:42] reason for the season

[1:19:44] all these Hallmark shows on TV talk

[1:19:47] about love and everything else but it's a baby in a cradle in a Manger

[1:20:23] I'm not going to shut up about it

[1:20:25] especially if it best serves our

[1:20:27] citizens so thank you all for

[1:20:30] um standing standing together and

[1:20:32] working to better serve our citizens and

[1:20:35] I I too am thankful to see the things

[1:20:37] that we've been able to accomplish

[1:20:38] without

[1:20:40] calls in the dollar figure to to

[1:20:43] increase we are going to have to invest

[1:20:44] some more money however we started off

[1:20:47] in a good direction

[1:20:48] yes it has been managed properly so

[1:20:51] kudos to our Public Safety folks

[1:20:54] um and I just want to say in looking at

[1:20:56] our audit report I was very pleased to

[1:21:00] see how much we have successfully been

[1:21:03] able to add to our reserve it was kind

[1:21:06] of a slow steady growth there for a

[1:21:09] couple years but these last couple years

[1:21:11] we've we've really done a good job of

[1:21:14] having more there in reserve and I and I

[1:21:16] want to commend the leadership of this

[1:21:18] board and the leadership of this County

[1:21:19] for investing in ourselves and I feel

[1:21:22] like that's where it's gotten us you

[1:21:24] know sometimes the mentality of cut cut cut your nose off despite your

[1:21:28] face but if you invest in yourself to do

[1:21:31] more

[1:21:32] um it's better for the citizens it's

[1:21:33] better for

[1:21:35] future citizens or future Generations

[1:21:37] like my children who are hopefully going

[1:21:39] to grow up and live here

[1:21:41] investing in ourselves

[1:21:44] to better serve our citizens has has

[1:21:46] proven to be successful so thank you all

[1:21:48] for your leisure for that staff and

[1:21:50] board

[1:21:52] um I do like to wish everybody a Merry

[1:21:54] Christmas and enjoy the holidays with

[1:23:58] the County Administration office

[1:24:00] employees and I want to wish everybody a

[1:24:22] number one

[1:24:24] John Northwood just some of our schools

[1:24:26] great volleyball Seasons with Joe

[1:24:28] howey's girls finishing make it to the

[1:24:30] state quarterfinals uh North and uh

[1:24:33] north of the girls volleyball had a

[1:24:35] great season also uh

[1:24:38] in the seniors highest golf team

[1:24:40] finished second in the state

[1:24:42] and uh the one I play is heading to the

[1:24:45] state tournament their District region

[1:24:46] Champions so we've had a lot of good

[1:24:48] things going on and Blake Hall from

[1:24:50] Marion Middle School is the national fly

[1:24:53] fishing Champion so we have the national

[1:24:55] fly fishing champion at Smith County so

[1:24:57] congratulations to Blake we're proud

[1:25:00] this is on the south yes that's right

[1:25:04] and uh also you probably saw in the

[1:25:08] newspaper did a great job covering it we

[1:25:09] had fentanyl Awareness Day at the high

[1:25:11] schools and uh which it's sad that that's where we

[1:25:16] are in our schools now that we have to

[1:25:18] do that but I you know teaching students

[1:25:21] how to use Narcan hopefully you know if it saves one life

[1:25:26] it but it's it's like when you make a

[1:25:29] great you try to do something to help

[1:25:31] there's

[1:25:32] you're they're always one move ahead of

[1:25:34] you and what they're going the other

[1:25:35] direction but anyway

[1:25:37] we had uh 540 total students get trained

[1:25:41] to administer Narcan 162 Choi High

[1:25:44] School 292 at Marion senior and 86

[1:25:47] Northwood High School so

[1:25:49] hopefully and I appreciate Dr Carter and

[1:25:53] also Linda Austin

[1:25:54] who's with Appalachian substance abuse

[1:25:58] coalition to help that did

[1:26:01] help get this foot together and my wife

[1:26:04] Kim helped do a whole lot with it and

[1:26:05] also Susan hope and our director of

[1:26:07] nursing so

[1:26:08] I think that was a good thing and great

[1:26:11] participation of the sheriff's

[1:26:12] department and so many Community

[1:26:13] agencies were there to help out and like

[1:26:17] I said I think the kids I mean we like

[1:26:19] it went really appreciate what they

[1:26:22] learned and so I think it was a real

[1:26:24] good thing

[1:26:26] um also looking forward to EMS to the

[1:26:29] training center opening and I think

[1:26:31] it'll be and I'm hoping that we can all

[1:26:33] go down and visit as soon as it gets

[1:26:35] open because uh

[1:26:37] for those that have taken a visit back

[1:26:39] when it was just about halfway finished

[1:26:40] the thought process that went in

[1:26:44] designing it is amazing and I think

[1:26:47] you're going to be amazed at what you

[1:26:48] see and what a functional building that

[1:26:50] is

[1:26:52] um so and I think it'll be a great help

[1:26:54] to our fire and EMS people in Smith

[1:26:56] County

[1:26:57] uh also of ours already had the

[1:27:00] opportunity to go by Courtney's house

[1:27:01] and see his Christmas lights if you

[1:27:04] haven't done that I suggest you do so

[1:27:07] yes and he takes all over yes that's

[1:27:09] right

[1:27:49] anybody that's that's shown appreciation

[1:27:52] will do that I think it's so we're just glad that we can make a small

[1:27:57] token of our appreciation to them and I

[1:28:00] also like to reiterate what we said

[1:28:02] earlier Merry Christmas to everyone and please observe the true reason for

[1:28:07] Christmas and I think that uh that's the

[1:28:11] foundation of our country and I and I

[1:28:13] think that we need to stick by it thank

[1:31:24] of Supervisors from Debbie Thomas John

[1:31:25] Edmonston and the Harris Lane neighbors

[1:31:27] uh this is in reference to the noise

[1:31:30] ordinance due to Prior scaling

[1:31:32] appointment John and I cannot attend the

[1:31:34] Thursday December 8th meeting in Smith

[1:31:35] County Florida supervisors meeting

[1:31:37] however we would like to address an

[1:31:38] issue of a noise ordinance and

[1:31:41] unreasonable noise is defined as noise

[1:31:43] that unreasonably and substantially

[1:31:45] interferes with the use or enjoyment of

[1:31:47] a home and or injures health or is

[1:31:50] likely to enter health for residential

[1:31:52] environments any noise exceeding 70 DB

[1:31:54] is considered disturbing we have tried

[1:31:57] to bring about an ordinance for years

[1:31:59] because of the problems we and our

[1:32:01] neighbors have incurred but to no avail

[1:32:02] in the neighborhood there are buildings

[1:32:04] structures that produce radios played to

[1:32:07] top volume drop is being played so loud

[1:32:09] it rattles the windows loud cars and

[1:32:12] motorcycles allow people dogs barking

[1:32:14] fireworks ignited within close proximity

[1:32:16] of houses and people cursing according

[1:32:19] to code Virginia Section 15.2-80 civil

[1:32:23] penalties for violations employees

[1:32:24] ordinances any locality made by

[1:32:26] ordinance adopt a uniform schedule of

[1:32:28] civil penalties for violations of that

[1:32:31] locality's noise ordinance this

[1:32:33] provision shall not apply to noise

[1:32:34] generated in connection with the

[1:32:36] business being performed of on

[1:32:38] industrial property civil fines will not

[1:32:41] exceed 250 for the first offense and 500

[1:32:43] for each subsequent offense the locality

[1:32:46] May authorize the chief law enforcement

[1:32:48] officer to enforce any civil penalties

[1:32:50] adopted pursuant to the provisions of

[1:32:52] the section the provisions of this

[1:32:54] section shall not apply to railroads no

[1:32:56] ordinance of any locality shall apply to

[1:32:58] sound emanating from any area permitted

[1:33:01] by the Virginia Department of energy or

[1:33:03] any division thereof we are requesting

[1:33:05] that you as a board Implement and or

[1:33:07] enforce a noise ordinance for the Harris

[1:33:09] Lane residential area and other areas

[1:33:11] that citizens of Smith County request

[1:33:13] thank you for your time and

[1:33:15] I mean I wanted to read that for the

[1:33:17] record and I will forward that to you

[1:33:35] we don't have to worry about the decimal

[1:33:37] benefits if I didn't like hearing it

[1:34:33] or eight pieces of property in Rich

[1:34:34] Valley that have already been

[1:34:36] deeded over and development has started

[1:34:39] as a solar facilities

[1:34:41] we need to get some ordinance in place

[1:34:43] as to how revenue is generated

[1:34:47] because once it becomes a solar facility

[1:34:52] we no longer can tax them like another

[1:34:54] piece of property they become utility

[1:34:55] property taxed by the state a lot less

[1:34:58] from it we get a lot less than you would

[1:35:00] if we is farmland

[1:35:03] so if we don't get on the ball we're

[1:35:05] going to be under the ball

[1:35:07] with nothing that we can do about it

[1:35:09] so I would encourage us to let's move

[1:35:11] forward on this quickly I will say that

[1:35:14] we have every attention of having an

[1:35:16] ordinance Committee in January with a

[1:35:19] draft solar ordinance for for the

[1:35:22] Warriors committee's room review

[1:35:23] absolutely and I apologize for not

[1:35:26] getting this to you earlier but I'm

[1:35:27] going through this it popped in down I

[1:35:29] gotta make notes anymore and I just I

[1:35:32] want to just be sure and say that we

[1:35:33] needed to because it can be a good thing

[1:35:35] for us if the neighbors are happy with
