some budget constraints, which leads

out to Scott uh just to double-check
that we could approach companies that

would help us to apply for grants and
help our funding.

the meeting, that was decided. So, we're

going to go ahead and move forward with
that. Also reassuring the public and the

town board too that we will not be
paying anything to those said companies.

The only time that they will collect a

is when their services actually get us
the grant.

Whereas the Town of Science Hill
recognizes the threat that natural
[9:28]
hazards pose to people and property
within the Town of Science Hill and
[9:31]
whereas the Town of Science Hill has
adopted a multi-hazard mitigation plan
[9:34]
hereby
known as the Monroe County Mitigation
[9:37]
Plan in accordance with federal laws
including the Robert T. Stafford
[9:40]
Disaster Relief and Emergency Assistance
Act as amended, the National Flood
[9:44]
Insurance Act of 1968 as amended, and
the National Dam Safety Program Act as
[9:48]
amended. And whereas the Monroe County
Mitigation Plan identifies mitigation
[9:52]
goals and actions to reduce or eliminate
long-term risk to people and property in
[9:56]
the town of Stinesville from the impacts
of future hazards and disasters. And
[10:00]
whereas adoption by the town of
Stinesville demonstrates its commitment
[10:04]
to hazard mitigation and achieving the
goals outlined in the Monroe County
[10:07]
Mitigation Plan.
Now, therefore, be it resolved by the
[10:11]
town of Stinesville in that Section 1 in
accordance with IC 36-3-4-8,
[10:16]
the town of Stinesville adopts the
Monroe County Mitigation Plan while
[10:19]
contents related to the town of
Stinesville may require revisions to
[10:22]
meet the plan approval requirements.
Changes occurring after adoption will
[10:26]
not require the town of Stinesville to
re-adopt any further ear-
[10:31]
iterations of the plan. That's a new
one. Subsequent plan updates following
[10:36]
the approval period for this plan will
require separate adoption resolutions.

adopting the provisions of Indiana Code
36-7-9, titled Unsafe Building Law,

whereas the town of Stilesville
the town council of Stilesville, Monroe
[11:45]
County, Indiana, is committed to protect
and promote the physical and mental
[11:48]
health and social well-being of the
citizens
[11:51]
and to prevent and control the incidents
of light and communicable diseases, to
[11:55]
reduce environmental hazards to the
health and safety, and to regulate
[11:58]
privately and publicly owned buildings
for the purpose of maintaining adequate
[12:02]
sanitation and public health by
establishing
[12:05]
legislation which provides for the
administration and enforcement of
[12:08]
minimum standards
for safety from fire and accidents, and
[12:12]
use, location, and amount of space for
human occupancy, and the determination
[12:16]
of owners, operators, and occupants of
buildings. And whereas the town council
[12:21]
of Stilesville being the legislative
body of the town may adopt Indiana Code
[12:24]
36-7-9, titled Unsafe Building Law, by
ordinance.
[12:28]
And whereas the ordinance must specify
the executive department of the unit
[12:32]
responsible for the administration of
Indiana Code 36-7-9 or establish such a
[12:36]
department.
And whereas the ordinance must also
[12:39]
incorporate by reference the definition
of substantial property interest. Now,
[12:43]

town council of Stilesville, Monroe
County, Indiana, that the following
[12:49]
ordinance is hereby adopted. Section 1,
adoption of the Indiana Unsafe Building
[12:54]
Law and the provisions of Indiana Code
36-7-9 as it reads currently and as may
[12:59]
be amended from time to time, there is
hereby established the town of
[13:03]
Stilesville Unsafe Building Law, Indiana
Code 36-7-9-1 through Indiana Code
[13:07]
36-7-9-29
are hereby adopted by
[13:12]
reference as the town of Stilesville
Unsafe Building Law in all proceedings
[13:16]
within the town for the inspection,
repair, and removal of unsafe buildings
[13:20]
shall be governed by this law and the
provisions of this subchapter. In the
[13:24]
event the provisions of this subchapter
conflict with the provisions of 36-7-9-1
[13:28]
through Indiana Code 36-7-9-29,
then the provisions of the state statute
[13:32]
shall control.
Administration, the town marshal of the
[13:35]
town of Stilesville or its designated
representative, who shall be hereinafter
[13:39]
referred to as the inspector, is
authorized to administer this ordinance
[13:42]
in accordance with provisions and
procedures set forth in the Indiana
[13:46]
Unsafe Building Law,
shall be the town's enforcement
[13:49]
authority and shall proceed under the
provisions of this ordinance to order
[13:52]
the repair or removal of any buildings
found to be unsafe as specified herein.
[14:03]
Uh section three, definition. The terms
unsafe building and unsafe premises
[14:07]
shall have the definition set forth in
Indiana Code 36-7-9-4
[14:11]
and are hereby supplemented to include
without limitation any building or
[14:15]
structure that has any or all of the
following conditions or defects provided
[14:20]
that such conditions or defects exist to
the extent that life, health, property,
[14:24]
or safety of the public or its occupants
are endangered. One, whenever any door,
[14:29]
aisle, passageway, or any means of exit
is not of a sufficient width or size or
[14:33]
is not so arranged as to provide a safe
and adequate means of exit in case of
[14:38]
fire or panic.
Whenever the walking surface of any
[14:42]
aisle, passageway, stairway, or any
other means of exit is so warped, worn,
[14:46]
loose, torn, or otherwise unsafe as to
not provide safe and adequate means of
[14:50]
exit in case of fire or panic.
Whenever the stress in any materials,
[14:55]
members, or portions thereof due to all
dead and live loads is more than one and
[15:00]
one half times the working stress or
stresses allowed for new buildings of
[15:04]
similar structures, purpose, or
location.
[15:07]
Whenever any portion thereof has been
damaged by fire, earthquake, wind,
[15:11]
flood, or by any other cause to such an
extent that the structural strength or
[15:15]
stability therefore is materially less
than it was before such catastroph-
[15:21]
catastroph- Oh my goodness, catastrophe
and is less than the minimum
[15:25]
requirements for new buildings
similar structure purpose or location.
[15:30]
Whenever any portion member or
appurtenance thereof is likely to fail
[15:35]
to become detached or dislodged or to
collapse and therefore injure persons or
[15:40]
damage property. Whenever any portion of
a building or any member appurtenance or
[15:46]
ornamentation on the exterior thereof is
not of sufficient strength or stability
[15:51]
or is not so anchored, attached, or
fastened in place so that they're
[15:55]
capable of resisting a wind pressure of
1/2 of that specified for new buildings
[15:59]
of similar structures, purpose, or
location without exceeding the working
[16:03]
stresses permitted for such buildings.
Whenever any portion thereof has racked,
[16:09]
warped, buckled, or settled to such an
extent that the walls or other
[16:12]
structural portions have materially less
resistance to wind or earthquake than is
[16:16]
required in the case of similar new
structure construction.
[16:20]
Whenever the building or structure or
any portion thereof because of
[16:23]
dilapidation, deterioration, or decay,
faulty construction, the removal,
[16:28]
movement, or instability of any portion
of the ground necessary for the purpose
[16:32]
of supporting such buildings.
The deterioration, decay, or inadequacy
[16:37]
of its foundation or any other cause is
likely to partially or completely
[16:41]
collapse.
Whenever for any reason the building or
[16:43]
structure or any portion thereof is
manifestly unsafe for the purpose for
[16:48]
which it is being used and whenever the
exterior walls or other vertical
[16:52]
structure members lifts, leans, or
buckles to such an extent that the plumb
[16:56]
line passing through the center of
gravity does not fall inside the middle
[17:00]
of 1/3 of the base.
[17:05]
When
Whenever the building or structure is
[17:09]
exclusive of the foundation shows 33% or
more damage or deterioration of its
[17:14]
supporting member or members or 50%
damage or deterioration of its
[17:19]
non-supporting members enclosing or
outside walls or coverings.

Whenever the building or structure has
been so damaged by fire, wind,
[17:26]
earthquake, or flood or has become a
dilapidated or deteriorated so as such

to become an attractive nuisance to
children or freely accessible to persons

for the purpose of committing unlawful

Whenever any building or structure has
been constructed, exists, or is
[17:43]
maintained in violation of any specific
requirement or prohibition prohibition
[17:48]
applicable to such buildings or
structure provided by the building
[17:52]
regulations of this town.
Or of any law or ordinance of the state
[17:57]
or town relating to the condition,
location, or structure of buildings.

Whenever any building or structure
which, whether or not erected in
[18:05]
accordance with all applicable laws or
ordinances, has any non-supporting
[18:09]
parts, members, or portion less than 50%
or in any supporting part, member, or
[18:14]
portion less than 66% of the strength,
fire resisting qualities, or weather
[18:19]
characteristics, or weather resisting
qualities or characteristics required by
[18:22]
law in the case of a newly constructed
building of like era, height, and
[18:26]
occupancy in same location.
Whenever building or structure used or
[18:31]
intended to be used for dwelling
purposes because of inadequate
[18:34]
maintenance, dilapidation, decay,
damage, faulty construction, or
[18:39]
arrangement, inadequate light, air, or
sanitation facilities, or otherwise is
[18:43]
determined to be unsanitary and fit for
human habitation or in such a condition
[18:47]
that is likely to cause sickness or
disease.
[18:51]
Whenever any building or structure,
because of obsolescence,
[18:57]

deterioration, damage, inadequate
[19:01]
exists, or lack of sufficient fire
resisting construction is determined to
[19:05]
be a fire hazard.
And when any portion of the building or

structure remains on a site after the
demolition or destruction of the

or whenever any building or structure is

abandoned for a period in excess of 6
months so as to constitute such building

attractive nuisance or hazard to the

as may be amended and is hereby
[19:34]
incorporated by reference here in as if
copied in full.

Hearing authority the town council shall
serve as the hearing authority and safe
[19:43]
building fund and then safe building
fund is hereby established in operating
[19:46]
budget of the town in Zionsville in
accordance with Indiana code 36-7-9-14.

Declaration of public nuisance unsafe
buildings and unsafe premises are hereby
[19:55]
declared to be public nuisance and are
therefore also subject to enforcement
[19:59]
abatement fines and penalties.
Penalties any person violating any
[20:04]
provision of this chapter shall be
subject to a fine being the first
[20:07]
violation fine shall be $500 with the
next violation of $1,000 and then all
[20:11]
violations after being $2,500. The
assessment of a monetary penalty shall
[20:17]
in no way limit the operation of the
penalties provided elsewhere in this
[20:21]
ordinance. Any person violating the
provisions of this ordinance commits a
[20:24]
class C infraction for each day such
violation continues. This ordinance
[20:29]
shall be in full force and effective
upon passage of the town council of
[20:32]

according to law passed and adopted by

An ordinance to amend ordinance 2012-7
[21:47]
establish regulations concerning the
confinement of dogs within the town
[21:50]
limits. Be it ordained and adopted by
the town council of Santa Ana Indiana as
[21:54]
follows. Ordinance 2012-7 is hereby
amended to read as follows. Section 1,
[21:58]
all dogs must be kept on their owner's
property. If taken off the owner's
[22:01]
property, all dogs must be on a leash or
under supervision. No owner or keeper of
[22:06]
any dog shall permit the dog to run at
large upon any street, alley, or public
[22:09]
place within the town. All owners of
dogs must be able to provide proof of
[22:13]
vaccinations.
Section 2, female dogs while in heat
[22:16]
must be confined in an enclosed area.
Section 3, dogs running loose will be
[22:20]
subject to being picked up by the Monroe
County Animal Control or any other law
[22:24]
enforcement officer including Santa Ana
Police Department. Dogs owner will be
[22:27]
responsible paying all fines imposed by
the ordinance to the town or any animal
[22:31]
shelter fees before the animal is
released from the shelter.
[22:35]
Section 4, every person keeping an
animal in town shall see that such
[22:38]
animal is one, is kept in a clean,
sanitary, and healthy manner and is not
[22:42]
confined as to be forced to stand, sit,
or lie in its own excrement.
[22:46]
Persons responsible for animals shall
regularly and as often as necessary to
[22:51]
prevent odor or health and sanitation
problems to maintain all animal areas or
[22:56]
areas of animal contact.
Two, has food that is appropriate for
[23:00]
the species in adequate amounts to
maintain good health, fresh potable
[23:04]
drinking water where appropriate,
shelter and ventilation including
[23:08]
quarters that are protected from
excessive heat and cold and are
[23:11]
sufficient size to permit the animal to
move about freely. Any person who
[23:15]
harbors, feeds, cares, houses, etc. a
dog for 3 days shall be presumed to be
[23:19]
the owner and shall comply with this
ordinance.

Section 5, any person who violates any
provisions of this ordinance shall be
[23:25]
fined $50 for each violation and
separate offense shall be deemed
[23:28]
committed upon each day during which a
violation occurs or continues.
[23:34]
Section 6, shall any law enforcement
officer or any other person having
[23:38]
authority to impound animals who has
probable cause to believe there has been
[23:41]
a violation of this ordinance or IC
15-21-4,
[23:46]
dog bite liability criminal offense,
may take custody of the animal involved
[23:51]
and transport it to the nearest shelter.
Section 7, it shall be unlawful for any
[23:56]
person to own, keep or harbor any dog
which is by loud and frequent barking,
[24:00]
howling or yelling shall cause annoyance
or disturbance of any to the citizens of
[24:04]
the town.
Section 8, no dog shall be allowed in
[24:07]
the playground area of the Scienceville
Community Center at any time. Section 9,
[24:11]
no dog shall be allowed at

Cynthiana, Indiana as follows. Section
[26:32]
one. It is declared that public policy
of the town to prohibit unreasonable,
[26:36]
unusual, unnecessary, excessive, and
offensive noises which are prolonged in
[26:40]
their time, place, and use and which are
a detriment to the public health,
[26:44]
comfort, convenience, safety, welfare,
and prosperity of the residents of the
[26:48]
town. Section two. For the purpose of
this ordinance, unreasonable noise shall
[26:52]
mean sound that is of a volume,
frequency, or pattern that disrupts,
[26:56]
injures, or endangers the health,
safety, or comfort of a reasonable
[26:59]
person of ordinary sensitivities within
the town given the time of day or
[27:03]
environment in which the sound is made.
Section 3, except as otherwise provided,
[27:07]
it shall be unlawful for any person to
make, continue, or cause to be made or
[27:12]
continued any unreasonable, unusual,
