[2:38] uh related to the new tiny zoning bylaw um we're gonna start off today with um
[2:46] a presentation um walking everybody through
[2:50] how the interactive zoning map works to find the zoning of a property and then a
[2:54] presentation of the highlights of the changes
[2:57] and then we'll get into questions and answers
[3:01] um so just want to introduce the project team
[3:04] i'm sean person director of planning and development with the township tiny
[3:09] um with me from tiny um is also sandra matson our planner roberts cesaro
[3:16] our gis it specialist and pamela zimmerman
[3:21] our planning administrative coordinator um that's the the tiny team as well we
[3:27] also have uh mr west crown and mr jamie robinson
[3:31] from mhbc planning um we're our consulting team
[3:36] uh who are prepared to bylaw and uh leading the project
[3:41] so i've kind of already spoken about the presentation we're gonna review how to
[3:45] view the new zoning by law um we're going to walk through the key
[3:49] directions um in the new bylaw and then we'll open it up to questions and
[3:54] comments um so with that this virtual open house
[3:59] um regarding the new zoning bylaws persuaded to section 34 of the planning
[4:03] act the township has identified
[4:07] the township and council has identified community consultation and participation
[4:12] as key priorities for this project all participants are expected to adhere
[4:17] to the following governing principles and guidelines tonight
[4:21] statutory public open house will maintain a welcoming inclusive
[4:25] atmosphere at all times regardless of any individual's perspective
[4:29] all participants will be treated with respect and courtesy
[4:33] the focus will remain on principles before personalities
[4:38] it's going to be a one-hour session if we go over because of questions we
[4:43] can definitely accommodate that uh comments and questions will be
[4:47] accepted uh during the open house solely through
[4:51] the zoom question and answer function and oral responses will be provided so
[4:57] at the bottom of your tablet or computer you'll see a q a
[5:01] um just click on that and you can type in the questions and we'll read each one
[5:05] and answer them the open house will be cared by myself
[5:11] and every effort should be made to keep the questions and comments on topic of
[5:15] the new zoning bylaws specifically that's why we're here tonight questions
[5:19] and comments that fall outside of the scope of the biola may not be answered
[5:24] questions and comments will be read out loud followed by an oral response every

[7:18] through the presentation this is the actual text of the bylaw
[7:22] um that provides all the um the key uh regulations but related to uh
[7:28] the zoning pilot itself the actual document and so what i want to feature
[7:32] the new interactive zoning map so i'm just going to click on

[7:49] there's a number of ways you can search for a property um you can type in the
[7:53] address or if there is no address in the case of a vacant lot for example
[8:00] you can type in the roll number that's the long number on
[8:05] your that you'd find on your tax bill that starts with four three six eight
[8:10] so i'm just gonna i'm just going to type in the
[8:13] township a tiny municipal building address here
[8:17] that's 130 on beach road west and you can see that
[8:22] that as you type in the address it will automatically come up so
[8:26] i'm just going to hit enter

[9:40] ridge overlay and uh wes and jamie will be touching on that in the presentation

[9:56] so we can see what these different codes are and these all correspond in the
[10:00] actual text bylaw as well as over here this purple color

[10:14] property just using the map so in this case i'll just click on
[10:19] perkinsfield park and if i zoom in i can see it's zoned os
[10:24] which in the case of this property is open space
[10:28] and the address of the property will
[10:31] actually come up with the roll number so that that's that's how the that's how
[10:36] the zoning tool works when you're trying to find out what is the zone what is
[10:39] going to be what is the new zoning of my property
[10:50] so with that i will turn things over to wes and jamie to walk us through the
[10:55] powerpoint presentation that they prepared for us tonight
[10:59] and um and then at the end like i said we will
[11:03] we will be reading all the questions and answers so if you have a question
[11:07] that you think of through the presentation please type it in and then
[11:10] we'll address them all at the end
[11:16] thank you thanks sean um so i'm gonna take the first part of
[11:20] the presentation and then wes we'll back clean up and finish things off
[11:24] uh just to start off what we've completed so far project was initiated
[11:29] back in 2021 there was an initial council workshop followed by a technical
[11:35] memorandum that outlined some of the key aspects to be considered
[11:38] as part of the zoning bylaw update there was a survey conducted and a subsequent
[11:43] technical memorandum completed that provided an overview of some of the
[11:48] responses to that survey and then most recently the
[11:53] first draft of the document has been released that's the purpose of today's
[11:56] meeting is to provide the public with some of the highlights
[12:01] of the of the first draft of the official plan and provide an opportunity
[12:05] for some questions and answers as we complete today's exercise sean or wes
[12:11] right in terms of uh the reason why the zoning
[12:16] bylaws being being completed if the planning act requires that whenever a
[12:22] municipality undertakes an official plan review or updates its official plan that
[12:26] within three years of that exercise the municipality is also required to
[12:32] update their zoning bylaw and that's precisely the process that's being
[12:36] undertaken here the new official plan was adopted in 28
[12:40] november of 2018 by the township council and then the
[12:45] approval authorities the county of simcoe for the official plan and the
[12:49] county approved that document in december of 2021.
[12:54] so again this document is implementing that this document will repeal and
[12:58] replace the current official current zoning bylaw
[13:02] and it does include a number of
[13:06] modifications to the text to deal with um
[13:10] with current planning issues also to implement the new policies that
[13:15] are contained within the within the official plan
[13:18] and also there's updates to the zoning schedules to more closely align the zone
[13:23] schedules with the with the new updated official plan
[13:27] schedules
[13:32] you'll notice when you review the two documents both the official plan and
[13:36] zoning bylaw the structure of the mapping is is is similar
[13:41] uh the official plan is a is a document that provides policy direction and a
[13:46] snapshot of what the municipality uh it's its land use characteristics
[13:51] will be uh in the next 20 years that's what the
[13:54] objective is where the zoning really recognizes what's on the land today
[13:59] and uh you will notice in reviewing the zoning bylaw that there is some new
[14:04] nomenclature in some of the zones and that nomenclature closely aligns with
[14:09] the uh with the nomenclature and the official plan
[14:13] one example of this is that there's now a green land zone in the zoning by-law
[14:18] which there wasn't in the current zoning by-law but that's consistent with
[14:23] the terminology in the official plan next slide was
[14:29] in terms of how the uh how the bylaws structured there is a
[14:34] user's guide at the outset of the by-law which which will inform the reader on
[14:39] how to how to use the bylaw and where to look up
[14:42] their property on the schedules and how to navigate through the different
[14:46] sections i know most people don't use a zoning bio until
[14:50] they're proposing to build it build a new building on their
[14:53] property either a new house or an accessory building and that's when when
[14:58] the rules come into play and and the bylaws tries to be user friendly to
[15:02] provide a guide to that there's a number of illustrations and also definitions in
[15:07] the bylaw which help to guide the user and provide examples of of what the
[15:12] bylaw is referring to and it speaks to different yards and how heights measured
[15:16] for example and those sorts of things from the structure of the bylaw i won't
[15:21] review the whole the complete structure a few things i
[15:25] just want to highlight on are section two dealing with general provisions
[15:29] these are provisions that that apply to every property in the municipality
[15:34] so regardless of what zone your property may be in or the property you're
[15:38] interested in those general provisions could apply so it's important to
[15:42] review those when evaluating how your property may be used
[15:49] section 4 outlines permitted uses and it's provided in a tabular format
[15:54] so for each zone there's a series of permitted uses and how the bylaw
[15:58] functions is that if the use isn't specifically identified as permitted
[16:03] then it's it's not allowed in the bylaw so the bylaw functions in a permissive
[16:09] context section 5 outlines zone standards so
[16:13] that's the section that establishes
[16:17] what the front yard setback is how high your building can be how much law
[16:21] coverage you can have those sorts of things so that's where
[16:24] the that's what the zone standards does and then the remaining sections outline
[16:28] exceptions for unique properties and definitions that apply through bylaw
[16:34] one point just with respect to exceptions
[16:37] the current zoning bylaw contains a number of exceptions
[16:41] uh we along with staff at the township have been through all of their
[16:45] exceptions and identified which ones
[16:48] should be maintained and which ones could be removed there's a number of
[16:52] instances where structures specific
[16:55] exceptions may have been provided to construct
[16:59] a dwelling or a building at a specific reduced setback or in a specific
[17:03] location on the lot once those buildings are constructed
[17:07] there's really no need for those exceptions moving forward so there's
[17:10] many instances we've where we've reduced the number of exceptions in this new
[17:14] bylaw west
[17:18] uh this sec this just in this slide intends to provide an overview of the
[17:22] format and structure of the bylaw you can see that
[17:26] we've included exceptions in a table format as opposed to the the
[17:32] current current format
[17:36] there's a couple of reasons for this it provides it's very easy to see what
[17:40] additional uses or what or only what uses are permitted on
[17:44] specific properties and specific zone requirements it makes it easy to craft
[17:49] amendments to the bylaw and it makes it easy to update the zoning bylaws so
[17:54] there's a few administrative tools that are
[17:56] we find the tables are are quite handy wes
[18:02] uh one point of that's always interesting with the zoning bylaw is how
[18:07] does it the bylaw treat existing uses that might predate the passing of the
[18:12] zoning bylaw and
[18:14] probably everybody's heard of the term grandfathering so that's what we're
[18:18] talking about we're talking about legal non-conforming uses and legal
[18:21] non-complying structures is structures that predated the passing
[18:26] of the zoning bylaw we see a lot of these structures in areas along the
[18:30] shoreline where are the current bylaw
[18:33] and even the proposed bylaw proposed setbacks
[18:39] that are fairly substantial or historically
[18:42] developed and may have been constructed closer to the shoreline than what the
[18:46] bylaws actually permit so the
[18:49] the pilot does establish specific dates in it for
[18:53] when structures would be considered legal non-complying and where they would
[18:57] be grandfathered wes
[19:01] in terms of transition provisions and wes used this term this afternoon so i'm
[19:06] going to steal it we tried to establish a principle of fairness in establishing
[19:10] this bylaw and and
[19:14] and one of those items of fairness is that if someone had received a minor
[19:19] variance under the current zoning bylaw basically we've proposed a five-year
[19:24] grace period under the proposed bylaw which would allow that variance to stay
[19:29] in effect and they could get their building permit within that five-year
[19:32] time period we do think it's important that there is so there is a sunset
[19:36] clause at the end of the day these things can be
[19:40] difficult from an administration perspective if too much time lapses so
[19:44] the second area of transition was related to specifically building permits
[19:48] so if you have that minor variance application or if you have a site plan
[19:52] application that's been executed if you do have a transition period in
[19:57] which to obtain building permits for those
[20:00] instruments as well plus
[20:05] the other piece of fairness that's been proposed is
[20:08] relates to the ep zone boundaries we wanted to provide a little bit of
[20:12] flexibility in the bylaw with respect to the limits of these boundaries and not
[20:16] require zoning amendments for i will call it
[20:20] refinements to those zone boundaries so for example if
[20:24] an ep zone boundary crosses an area of a landscape lot adjacent to a house for
[20:30] for example in an additions proposed that house or a
[20:34] or a deck is proposed to be added where justification is provided and
[20:41] where it's obvious that there's no environmental feature in that area the
[20:45] bylaw does permit refinements to those zone limits without an amending zoning
[20:49] vial application to be applied for
[20:54] there's four overlay zones that are proposed to be added to the zone to this
[20:58] new zoning bylaw the first one deals with the nipissing ridge and that's
[21:02] implementing the feature that we've included in the official plan as well
[21:06] what it establishes is [Music]
[21:09] it's basically to ensure that development could proceed
[21:15] in proximity to that nipissing ridge or or
[21:19] slightly within it provided that there's no
[21:23] clearly no impact on that feature so provides that there needs to be a review
[21:28] of that feature it's really kind of like a yield sign or a caution sign
[21:32] that needs to be demonstrated that there won't be any impact prior to development
[21:36] proceeding similarly the next two items wellhead
[21:40] protection area and issues contributing area those are items that are have been
[21:44] included through an amendment to the current zoning bylaw when the
[21:47] municipality undertook uh a implementation exercise related to the
[21:53] source water protection plan for
[21:56] um lake simcoe and south southern georgia bay
[22:00] and those policies have been included in the currents or sorry those regulations
[22:05] have been incurred included in the current zoning bylaw and the mappings
[22:09] also been updated again it's somewhat of a caution sign that
[22:13] that's that says that if you're proposing certain uses
[22:17] within these wellhead protection areas there may need to be some further review
[22:22] and some some site plan control for example
[22:26] applied to ensure there's no impact on these wellhead features in order to
[22:30] protect municipal drinking water supplies that's the focus and then
[22:34] finally with the airport this is an overlay and to ensure the proper
[22:39] functioning of the airport so would would apply to uses and heights of
[22:43] buildings and structures in proximity to the airport
[22:50] additional dwelling units now you'll see in brackets secondary units that's the
[22:54] term that's used in the official plan the province has recently updated the
[22:59] planning act of ontario to allow for
[23:04] up to two accessory units within with any dwelling unit in this in a
[23:09] single-family home or within a semi-detached unit or row houses as the
[23:13] case may be so that's why the terminologies change to
[23:17] additional dwelling units the what's
[23:20] important from this bylaws perspective is that additional units are not
[23:24] additional dwelling units are not permitted in the shoreline zone or the
[23:28] limited service uh shoreline zone
[23:32] uh that implements the policies that are contained in the official plan
[23:36] and there's a number of reasons for that firstly shoreline areas are areas that
[23:43] exist primarily because of recreational
[23:46] development and there's also potential concerns with
[23:49] density intensity of use of properties if etc or if secondary units are
[23:54] permitted or additional units are permitted on shoreline properties
[23:57] and this approach to not permitting additional dwelling units and shoreline
[24:01] properties is a an approach that's employed by a
[24:05] number of shoreline municipalities across the province because there's
[24:08] often late capacity concerns and those sorts of things
[24:12] related to the servicing of of shoreline properties
[24:17] additional dwelling units are permitted as of right in
[24:20] in most other zones within the zoning bylaw where
[24:24] uh where dwelling units are permitted there are however some standards that
[24:29] are outlined in the zoning bilo that must be met in order to be able to
[24:34] develop an accessory dwelling unit and there's also some size limitations
[24:38] associated with them as well next slide was
[24:43] so i think this is where you're taking over wes

[24:57] uh to go through and then we'll get to the
[25:00] questions that people are posting on the q a function uh don't forget if you've
[25:05] got questions post them there and and once the presentation's done
[25:10] sean will moderate and review each of the questions and either
[25:15] ask jamie or i or or sean himself will respond to the questions so that we
[25:20] respond to each and every question that's posted uh through this open house
[25:26] so uh the draft bylaw
[25:30] that's currently under consideration proposes
[25:34] no changes to the current prohibition on backyard chickens both in the zoning
[25:39] bylaw and in the municipalities uh livestock
[25:42] bylaw as well and there are a number of reasons that
[25:46] we've done that if you have reviewed the technical
[25:50] memorandums number one and two you'll note that we identified to
[25:55] council that if they wish to choose to establish a
[26:00] uh a backyard chicken or an urban chicken
[26:03] program in the municipality that we recommended that the municipality
[26:08] consider a temporary use bylaw approach to establish a pilot program
[26:14] in the municipality and subject to the public input that we
[26:18] received tonight and up to the closing of the comments on
[26:23] the first draft of the public meeting council may provide further directions
[26:28] to its staff and its project team to reconsider
[26:34] the backyard chicken program either within this bylaw
[26:38] or in another approach in the municipality there were a number of
[26:42] concerns that uh that we identified both by
[26:47] uh the simcoe county federation of agriculture and the provincial minister
[26:51] of agriculture and the concerns that the backyard chicken programs had
[26:56] on commercial
[26:59] poultry operations in the municipalities and those amongst others were some of
[27:03] the concerns why we thought at this point in time anyways we would
[27:07] not change the current prohibition and looking for public further public
[27:12] comment and input as we get through and go through this
[27:17] process
[27:23] so uh this is a new element that we've added into the bylaw for boat docks and
[27:29] boat lifts this is contained in uh section 2.4 of the bylaw
[27:34] uh tiny has not previously
[27:38] regulated boat docks or boat lifts and as a result of some recent court
[27:43] decisions municipalities are moving into providing
[27:48] zoning regulations for docs in particular
[27:52] the provisions that are contained in in 2.4
[27:56] set out setbacks for docs as part of a maximum extension into the
[28:03] into the water and of course as you know as required by the bylaw you must be the
[28:08] legal owner of the lands where the docks are constructed and connected uh to the
[28:14] shoreline
[28:18] the bunkie provisions in the current bylaw are carried forward into the new
[28:23] bilo so the provisions and definition definitions
[28:26] are pretty much left the same again
[28:30] bunkies are not permitted for rental or commercial purposes
[28:35] much like the existing and current bylaw however we've provided clarification in
[28:41] the bylaw that washrooms will be permitted under
[28:45] the new bylaw in bunkies when it's approved uh by council
[28:52] you'll note in the bylaw that there is a placeholder
[28:57] in the draft by law with respect to cannabis production and
[29:02] we're looking for and waiting for further council direction
[29:06] um council has decided to undertake a review policy review policy and
[29:11] regulatory review with respect to cannabis production as part of a
[29:15] separate process and we'll be holding a separate public consultation
[29:20] meeting as part of that as well you'll note that there is a staff report that's
[29:25] noted here where a preliminary direction for
[29:30] contents for the proposed official plan amendment and zoning by law amendment
[29:34] have been identified but generally the
[29:39] cannabis production would be permitted in the industrial agricultural and rural
[29:44] designations in the official plan but subject to a zoning bylaw amendment
[29:50] application process and public consultation as a result
[29:54] so cannabis production would not be
[29:57] permitted based on these preliminary directions as of right in the
[30:01] municipality zoning bylaw so if you're interested in that aspect
[30:06] of planning regulation and policy in tiny
[30:10] you can go to the municipalities website and search that that particular staff
[30:16] report and follow along with the the process as the municipality
[30:21] considers establishing new policies and regulations uh for legal cannabis
[30:26] production in the municipality
[30:29] um we've added new uh definitions and provisions
[30:34] for outdoor residential lighting to the proposed bylaw
[30:39] and we've included limited regulations requiring dark sky compliant residential
[30:45] lighting in section 222 of the draft bylaw municipality have a number of
[30:52] tools that are available to them to regulate outdoor lighting and we've
[30:58] chosen to at this point to include some new provisions for outdoor lighting and
[31:02] looking for public review and public comments on the provisions that we've
[31:07] proposed so far we've also added
[31:12] new provisions to the proposed bylaw dealing with retaining walls currently
[31:17] the the current bylaw does not contain any standards or regulations with
[31:21] respect to rain retaining walls um we're proposing to establish regulations
[31:28] that will work with the requirements of the ontario building code with respect
[31:32] to when you do or don't need a permit for retaining walls and the proposed
[31:38] setbacks for the retaining walls that are contained in the new zoning bylaw
[31:41] are based on the height of the proposed wall so for retaining walls that are
[31:46] less than a meter in height they would be permitted
[31:49] on the property line for retaining walls that are one meter
[31:54] in height or greater they must meet the setbacks for accessory structures and
[31:59] these are all set out in section 228 of the new proposed zoning bylaw
[32:07] the existing bylaw has a number of provisions with respect to
[32:12] steep slopes that are not mapped on the municipality's zoning schedules this is
[32:18] different than the nipissing ridge which in the new
[32:22] bylaw is a specific overlay zone and has some very specific and detailed
[32:27] regulations the current bylaw has setback standards
[32:31] from steep slopes but they are currently defined as one to three slope or about
[32:37] 73 percent the proposal in the draft bylaw is to establish the
[32:45] same uh setback 15 meters from most deep slopes but for a three to one slope or
[32:50] 33 percent so any slope that's greater than a three to one or thirty three
[32:55] percent uh all new construction and development will have to be set back
[33:00] uh 15 meters uh from that slope of course recognizing that uh you know
[33:06] this this is imposing a greater standard in
[33:09] the proposed new bylaw we've included a
[33:13] provision in the bylaw that will allow a lesser setback
[33:18] without an amendment to the bylaw where it's approved by the municipality and in
[33:22] particular where sufficient technical and or survey and engineering
[33:27] information is submitted to the town's engineering
[33:31] department for their review and approval and that
[33:35] would permit the municipality to approve a lesser setback
[33:40] storage containers are currently storage containers or sea
[33:45] containers are currently prohibited in the township
[33:49] of tiny and the proposed bylaw will continue
[33:54] that pres that prohibition in all residential zones so uh storage
[33:59] containers as uh storage structures uh will be prohibited in the new bylaw but
[34:06] they will be permitted in other zones for personal use up to a maximum of
[34:12] three storage containers subject to the standard requirements for building
[34:17] permits building fees development charges and of
[34:21] course compliance with all the relevant setbacks of the the appropriate zone
[34:26] um temporary use of storage containers are permitted in residential zones but
[34:33] associated with construction projects and as soon as the permit or the
[34:37] construction is complete uh the uh storage container will have to be
[34:42] removed but they are only permitted to exist on
[34:46] the property up to a maximum of one year i know we had a question this afternoon
[34:51] about applications for the use of sea cans or
[34:55] storage containers for residential dwellings and if they
[34:59] are part of a building permit application
[35:03] they could be repurposed for that use
[35:07] subject to the full requirement of the ontario building code and the zoning
[35:11] bylaw typically that would also require
[35:15] retaining a engineer to confirm you know the compliance of those
[35:22] repurposed structures to the minimum requirements of the
[35:26] ontario building code
[35:31] we've all been uh dealing with the new county waste bins
[35:36] um and in particular in a rural municipality like tiny
[35:40] finding a locations of those that work for homeowners where they may
[35:45] have longer driveways and where the homes are significantly set back
[35:50] from the roads themselves we've proposed new provisions in the
[35:54] bylaw to permit encroachments into the
[35:57] required front yard to allow the construction of a storage
[36:01] structure uh to support this you know the
[36:05] the keeping of these county waste bins and so a three meter
[36:10] so this storage structure will be permitted within three meters of the
[36:15] front lot line again not within the road allowance but on the private property
[36:19] they need to be set back uh one meter from the side lot lines and a
[36:24] maximum size of five square meters uh is proposed in section 217 of the draft
[36:32] by-law and we're looking for comments um on whether we've we've got these
[36:36] proposed regulations right whether we need to make further refinements uh to
[36:41] recognize that we've gone to this new uh county waste bin system
[36:47] you'll see much like the cannabis production
[36:50] the draft bylaw has a placeholder for short-term rental regulations
[36:57] and we will
[36:59] update the bylaw once council direction with respect to short-term rentals has
[37:05] been provided for those of you that haven't been following along councils is
[37:10] has established a specific task force who's been requested
[37:15] to develop a comprehensive response to short-term rentals and that task force
[37:20] includes local residents and members of council and staff as well
[37:25] once the task force reports back to council
[37:29] and the proposed direction both a policy and regulatory one
[37:35] the bylaw will be updated based on those decisions of counsel
[37:40] and and
[37:42] appropriately amended to reflect those directions from council if you're
[37:46] looking for more information with respect to the short-term rental
[37:50] work that's currently underway in the municipality uh we've provided the
[37:55] link to the in the municipalities website uh for short-term rentals
[38:00] um there are two new zone categories the ep1 and ep2 in the
[38:07] zoning bylaw the ep1 zone recognizes the
[38:12] provincially significant wetlands that are designated environmental protection
[38:17] in the new official plan the ep2 zone
[38:21] includes all other evaluated wetlands in any other wetland uh in the municipality
[38:28] that is two hectares or greater for both of the ep1 and ep2 zones buildings and
[38:34] structures and site alteration are not permitted
[38:38] the ep2 zone does not have a specific setback that's required
[38:44] to it there is a setback of i believe 30 meters to the ep1 zone that's contained
[38:49] in the draft bylaw and i think as jamie had indicated
[38:53] earlier we've included a provision in the bylaw that allows refinements to the
[38:57] ep2 zone without amendment to the bylaw
[39:01] subject to sufficient information being submitted to the municipality and
[39:06] the township approving that there is a new zoning
[39:11] zone in the municipality that reflects the green lands
[39:15] designation in the official plan and that's the gl zone it excludes all the
[39:21] wetlands that are contained within the greenland's designation but it includes
[39:25] all other lands that are
[39:28] designated greenlands in the official plan and recognizing that this is a
[39:33] major new initiative in the official plan
[39:37] the official plan included
[39:40] a limited range of uses that would be permitted as of right within the green
[39:45] land zone and that's what we've carried forward into the new zoning bylaw so the
[39:50] gl zone permits and recognizes existing uses
[39:54] as legal uses and it would also permit the construction of new single detached
[40:00] uh residential dwellings and accessory uses that go along with that residential
[40:05] dwelling as of right within the gl zone
[40:10] um one of the major changes with respect to
[40:14] performance standards in the bylaw relates to the
[40:17] interior side yard setbacks particularly uh
[40:21] in the shoreline residential zone where
[40:24] the new proposed interior side yard setback for new dwellings is three
[40:29] meters on one side and 1.8 meters on the other side and that does not change
[40:36] based on the number of stories if you're at all familiar with the existing bylaw
[40:40] you'll know that there's a step back provision that as the height of the
[40:44] building increases you're required to be set back further from the uh the side
[40:49] lot lines and we remove removed that for a number of reasons particularly
[40:54] because it was resulting in uh significant increases in height of
[40:59] dwellings within the within the shoreline area
[41:02] there is a provision in the proposed bylaw that would allow
[41:05] attached garages and card ports to encroach into the 1.8 meter side lot
[41:12] line up to one meter subject to meeting the requirements of
[41:16] the zoning bylaw we've added new provisions to the bylaw
[41:20] to regulate the location of private sports courts uh in the municipality so
[41:26] tennis courts pickleball courts basketball courts etc so this is a new
[41:30] provision and there's a new definition and the requirement in the bylaw is that
[41:36] the location of new sports courts must meet the same setback standards
[41:41] that are established for accessory structures within the applicable
[41:46] zone and there's also some specific fencing and lighting
[41:50] provisions related to private sports courts that are contained within the
[41:56] proposed bylaw as well as i indicated earlier one of the issues
[42:01] that we identified in the review of the current bylaw in particular a review of
[42:06] the historic minor variances and building
[42:09] permits was that the height of buildings was
[42:12] particularly in the shoreline area was beginning to creep up
[42:16] and so the current bylaw defines maximum building height as the midpoint between
[42:22] the peak and eaves of the of the slanted or sloped roof
[42:26] structure and what we've uh what we've proposed in the for in the new bylaw
[42:32] is to define maximum highest the highest point of the roof structure which we
[42:37] think is uh complementary to some of the other changes that we've made in the
[42:41] bylaw that will help control uh the massing and built form of structures
[42:46] within the shoreline area uh in the municipality
[42:50] so that's our uh very brief uh presentation which i think
[42:55] captures some of the main major new items in the bylaw and
[42:59] the highlights of the bylaw the next steps in this process
[43:04] we're looking for in addition to the comments that we'll be uh considering
[43:09] shortly but comments can continue to be
[43:12] submitted to the municipality by march 17th and those that are
[43:18] submitted to the new zoning bylaw at tiny.ca
[43:22] email address those will be considered when we look at
[43:26] the first draft first public draft of the bylaw and consider further
[43:30] refinements to it that will lead us to prepare a what we
[43:35] heard report and recommended revisions to the draft by law that will then go to
[43:40] council for their instructions and directions to the project team
[43:45] the next step of the process obviously is the scheduling of the statutory
[43:49] public meeting where additional public input and comments can be received and
[43:53] then the last step of the process is to prepare the bylaw for consideration uh
[43:59] and passing by council so uh i think that wraps up the
[44:04] presentation sean just a reminder to everybody the uh the

[44:59] questions if there if there's some questions i
[45:03] notice there's a lot of questions a lot of interest in the first session too
[45:06] with regards to backyard chickens and why there are uh no provisions in the
[45:10] new biola with regards to that west did touch on that so we will uh the first
[45:14] question here deals with that but if we're if we're answering the same
[45:17] question we will we'll skip over the same ones
[45:20] um similarly quest mentioned with regards to the short-term rental i know
[45:24] there's a lot of interest in the township right now with regards to that
[45:27] issue and uh that task force is working
[45:30] towards um making recommendations to council on that so we're not going to be
[45:34] answering specific questions on the church and rental
[45:38] task force and the work that they're doing
[45:40] we just recommend folks that they uh go to the
[45:43] short-term rental web page that the township has which has
[45:47] all the agendas the minutes and all the live stream um
[45:52] youtube feed for all the meetings and all the information can be found in one
[45:55] location there so okay so i'll start off
[45:59] first question i would like to know why the results of
[46:02] the public survey are being cherry picked specifically why are the 68
[46:06] percent of residents in favor of backyard chickens being dismissed when
[46:09] other favorable survey results are being proceeded with included in the draft by
[46:13] law updates requiring residents to further demonstrate their support by
[46:17] email seems unjust in the ways of both residence time and township resources
[46:20] wes you touched on this a little bit in the presentation as to the reasons why
[46:24] we didn't include it so maybe if you just want to reiterate that and then
[46:27] provide any other information with regard to that
[46:30] um i see a number of other questions with regards to the backyard chicken so
[46:34] this will be uh we'll prove we'll try to provide a fulsome uh response here sure
[46:39] thanks sean um if uh if anyone had a chance to review
[46:46] the earlier uh reports that were prepared as part of this process
[46:50] we identified a number of issues with uh with respect to the backyard chickens
[46:57] and we did recommend to council that if they
[47:00] wanted to proceed with a backyard chicken or urban chicken
[47:05] program that they may want to consider a temporary use bylaw approach
[47:12] and a regulatory or licensing bylaw approach as well as an option to
[47:17] consider we felt based on
[47:21] our environmental scan our review of what what's happening out there in other
[47:26] municipalities and what other you know the concerns if you will
[47:31] with respect to backyard chickens that we would not include it um in the draft
[47:36] by law at this time but that's subject to
[47:40] public review and comment and continued support
[47:44] for the request that we would go back to
[47:47] council and seek their direction instructions as
[47:50] to how they want to proceed do they want to proceed by way of
[47:54] including it in this by-law do they want to include as we originally had
[47:58] recommended to include it in a temporary use by-law approach and
[48:03] licensing bylaw approach all of these would require
[48:09] concurrent amendments to the municipalities
[48:12] and sean i'm going to call it the livestock bylaw
[48:15] but there's another bylaw that currently regulates the keeping of livestock
[48:20] in residential zones in the municipality and it would require amendments to that
[48:25] bylaw as well if council choose to uh to go that route and so
[48:30] you know the purpose of this public meeting
[48:33] is to test the proposal within the new zoning bylaw
[48:40] to get public comment and input on it and if the direction is is clear then
[48:46] we'll we'll discuss this with council and seek their further instructions on
[48:51] how they want us to proceed it's not been uh you know it's not being
[48:56] eliminated if you will um at this point it's just not been included in this
[49:00] draft by law and uh subject to the comments from the
[49:05] public we'll uh we'll uh canvas council and see where
[49:08] they want us to go

[49:58] um i can answer that i think what this question is referring to is um
[50:03] searching the interactive zoning map by typing in
[50:07] a legal description that that is not an option when you're when you're searching
[50:12] a property there's only two options one is to type in
[50:16] the address of the property and like i noted in the demonstration if
[50:21] if there is no address of the property you can type in
[50:25] the roll number and you can find the roll number
[50:28] on your tax bill it's the number that starts with 4368
[50:33] and then it's quite a long number but if you type that in
[50:37] the tool will bring you to the property
[50:44] okay here's a question um we have another one on buy kirk chickens
[50:47] i'll just uh i'll just bypass that one based on west's response
[50:52] are there any disadvantages drawbacks when we live at a lot now greenbelt
[50:57] which will be declared ep 2 under the new bylaw
[51:01] there will still be all town services etc it would just not be possible to
[51:06] build any new structure in the future question mark

[51:22] the one um unique things about zoning bylaws is
[51:26] that they don't act retroactively so if you have an existing
[51:31] property with existing buildings and structures on that property if the
[51:35] property is rezoned to ep2
[51:39] then your existing structures would be legal non-conforming and or legal
[51:45] non-complying and they would continue to be permitted
[51:49] on the property we indicated in the presentation that
[51:54] recognizing that uh that through the official plan in the
[51:58] zoning by-law is not an exact science of defining
[52:03] the location of the ep1 or the ep2 zone lines that we've included a provision
[52:09] that allows some refinement of those lines in particular the ep2 line
[52:14] through you know the production of additional
[52:17] information or site inspections i know sean and his team is working with the
[52:22] seven sound environmental association on um the process and procedure for how the
[52:29] municipality will uh allow and undertake the refinements
[52:33] of the ep2 zones so it's not necessarily that
[52:39] you would not be permitted to construct a new structure
[52:42] but there would need to be a direct discussion with the municipality uh
[52:48] around those questions um and i'm gonna suggest janine that
[52:53] you know if you can send us an email to the
[52:56] new tiny bylaw at uh a new zoning bylaw at tiny.ca
[53:02] with a specific address for the property we can look into it a little bit further
[53:06] and provide you a more a more detailed response with respect to
[53:10] your particular property thanks wes next question is how
[53:15] or why does an area acquire the ep2 standard
[53:19] is it possible to know what exactly is being protected and boundaries of the
[53:22] area i can take this question so just similar to what wes was just talking
[53:25] about maybe just a little bit of background when we when when the
[53:29] township prepared new official plan
[53:32] we had the severance sound environmental association
[53:35] um prepare a comprehensive natural heritage study which mapped
[53:40] all features um including significant woodlands significant valley lands
[53:46] um and um as well as other wetlands uh which is which is a specific direction
[53:53] from the province um for us to map
[53:56] those specific areas so there's two ep categories there's an ep1 which is a
[54:02] provincially significant woodland that mapping comes specifically from the
[54:06] province to the ministry of natural resources
[54:09] and then the ep2 zone that specifically relates to the other
[54:13] wetlands and that was done through uh aerial image
[54:18] interpretation and
[54:20] and and review so
[54:22] you know i we know that we didn't get all of those
[54:26] ep 2 zones correct and that's why we've set up a refinement process that does
[54:32] not require owners to do site-specific zoning amendments to
[54:36] refine that ep 2 zone category for example if an ep2 zone
[54:43] is on somebody's
[54:46] landscape lawn and it's very clear that it's incorrect refinements can be made
[54:51] to correct those situations
[54:55] um next question our property is on gl is it buildable
[55:01] you want me to take that or sure so the zoning bylaw if if you have
[55:09] a look at the permitted uses table in the zoning bilo under gl which is
[55:14] greenlands it does identify that there that a
[55:18] a dwelling unit is a permitted use on those existing vacant lots so there is
[55:22] an opportunity within that within a vacant lot that's current that's
[55:25] proposed to be sewn gl to construct your dwelling and
[55:31] accessory buildings on them
[55:35] thanks jamie you have another backyard question
[55:40] backyard chicken question but i believe that that's been answered at this point

[55:47] here's one why is there no wellhead protection for
[55:51] the aquifer providing water to shoreline areas
[55:54] maybe i'll take that just because i was involved with the source protection
[55:58] implementation documents so specifically what's included
[56:03] in the wellhead protection areas is specifically related to municipal
[56:07] drinking water supplies and the reason that a reason for that is
[56:12] that the
[56:15] legislation so the clean water act specifically applies to municipal
[56:19] drinking water supplies it doesn't apply to individual wells
[56:23] so what we've done is really here implement the official planned policies
[56:29] and the official planned mapping that relates to source water protection so
[56:34] that's that's the the short and the long answer of it is it's municipal water
[56:38] supplies and it's it flows from the um
[56:43] from the clean water act through the source protection plan
[56:46] into the official plan and then ultimately implemented through the bile
[56:50] so it's a municipal drinking water supply

[57:14] and this is in the letter f section of the by-law

[57:22] related to floor area and so you'll find the definition for floor area gross or
[57:28] gross floor area in that section on that page of the bylaw
[57:33] take a look at it there are three different terms for floor area and
[57:36] there's different ground
[57:38] a gross floor area so take a look at those

[57:54] beach ownership and beach property lines thank you for your apply
[57:58] so i can take this um so we we actually didn't uh
[58:02] didn't speak to beach ownership and beach property lines in this in the
[58:07] presentation because it's not it's not an issue or it's not it's not an item
[58:12] that's dealt with in the zoning while the zoning pilot does not um define
[58:16] boundaries of properties that's that's that's illegal
[58:20] um that's a legal matter the zoning biola only deals with land use
[58:26] anything else to add to that jamie or wes
[58:30] no just the oh i guess the only thing would be that if someone's interested in
[58:34] understanding which property line is their front property line or their rear
[58:39] property line or interior side property line there's specific definitions
[58:44] in the bylaw that that refer to and you'd go to lot line first so it says
[58:49] lot line front lot line side lot line rear and from that you can determine
[58:54] what your required setbacks are for accessory buildings and principal
[58:57] buildings and the illustrations in the user's guide at the bylaw that shows you
[59:03] in relation to a number of different typical lots
[59:07] where the front rear side etc of the property is good point yes

[59:18] i'll if we've answered you have a short term
[59:21] rental question again please visit the township attorney webpage with regards
[59:27] to short-term rentals um to get all the updated information
[59:31] relative to the task force work
[59:36] issues contributing areas with respect to legally existing and municipally
[59:40] serviced hamlet residential zones please advise how this newly included overlay
[59:46] will impact the property owner's ability to obtain a building permit and install
[59:51] a septic system suitable for residential purposes
[59:56] i can take that um so the
[1:00:00] the mapping that's included within the source protection
[1:00:04] planning documents and then implemented through the zoning bylaw
[1:00:08] is uh is not focused on residential
[1:00:12] development it's focused on non-residential development and
[1:00:16] non-residential uses so your ability to obtain a septic
[1:00:20] system permit uh provided it complies with the ontario
[1:00:24] building code it wouldn't affect your ability to obtain a septic system and
[1:00:29] we've jamie we've included a very specific provision which comes right out
[1:00:32] of the source protection plan that says for lots of record that exist on the
[1:00:38] date of the approval of the source protection plan
[1:00:40] a small on-site sewage system is permitted
[1:00:44] so that that's reflected in the proposed bylaw as well

[1:00:52] um next question what is our u zone mean i can take that
[1:00:57] uh the ru zone is the rural zone and uh that that would be that would be
[1:01:03] mapped in compliance with the official plan also being rural so
[1:01:08] if you're interested in seeing the permitted uses or zone standards
[1:01:14] um in the ru zone please um review the text
[1:01:19] uh of the of the zoning bylaw if you have any questions please let us know
[1:01:27] referring to the notice of today's meeting would you currently provide
[1:01:30] complete clarity around what one needs to do in order to preserve the right to
[1:01:34] appeal the new zoning bylaw or become party to an appeal where one has no need
[1:01:39] to comment on the current draft there may be a need to comment on subsequent
[1:01:43] draft when short-term accommodation provisions are included
[1:01:50] so in order to preserve your appeal rights
[1:01:53] uh one would have to comment on the zoning bylaw it could be the first draft
[1:01:57] it could be the second draft it could be at any point leading up to and including
[1:02:02] the public meeting uh what is also important however which
[1:02:06] has changed is that in order to be notified of the decision of counsel with
[1:02:11] respect to the bylaw an individual has to specifically request to be notified
[1:02:16] of that decision so if it's if you want to be notified of
[1:02:19] this decision you should make that request to uh
[1:02:23] um to either the the web page or to the clerk that uh you would like to be
[1:02:28] notified of that this specific decision so
[1:02:32] to summarize as long as you provide comments throughout the process you
[1:02:36] would have the ability to appeal thanks jamie so just to be clear
[1:02:41] robert doesn't need to provide comment on this draft craft one if there's no
[1:02:46] need to but future draft if he would like to he should provide

[1:03:33] point there it was like oh sure it was an item that just i think one poor
[1:03:37] portion of that was why have they not received any comments on the comments
[1:03:42] that have been provided so an individual's provided feedback on the
[1:03:45] process and they haven't got a response to their comment
[1:03:49] just in terms of how this process typically unfolds is
[1:03:54] that individual responses to each comment
[1:03:57] aren't provided as they come in however
[1:04:01] what we are undertaking is preparing a comment summary table that outlines all
[1:04:06] the comments that are provided in writing through this process
[1:04:10] provides a response to those comments and that gets included
[1:04:14] in the staff report that ultimately goes along with the bylaw to counsel so
[1:04:20] there's a clear understanding of the relationship
[1:04:23] between the comments and how they've been considered and
[1:04:26] ultimately what changes have been made are not made with respect to the bylaws
[1:04:30] so you shouldn't expect a comment a reply to every email that you send in on
[1:04:34] this but you're you can we can assure you that they're being
[1:04:38] tracked and they're being included in a comment summary table thanks jamie and
[1:04:42] just just for everybody's knowledge when once once you submit a comment
[1:04:46] um to the to the uh project email address you will get an auto response
[1:04:51] which means we've received it and it will be included in the review
[1:04:55] if it's a question or clarification you will get a response back from us on
[1:05:00] those types of questions
[1:05:08] um next question uh why are tourist establishments not permitted in
[1:05:13] shoreline zones
[1:05:17] you want me to take that one jamie um
[1:05:22] so the uh
[1:05:24] tourist establishments as defined by the zoning bylaw existing
[1:05:29] ones are recognized uh within the proposed new bylaw
[1:05:35] but the establishment of new ones um the policy framework is set out in
[1:05:40] the official plan and it would require an application to amend the zoning bylaw
[1:05:45] to establish new tourist establishments in the municipality through that
[1:05:51] application process and in accordance with the policy guidance that's
[1:05:54] contained within the official plan so we're
[1:05:58] typically not in the habit of pre-zoning properties for
[1:06:03] new uses it is an application driven process and it would be up to the
[1:06:08] property owner to determine whether they wanted to proceed
[1:06:12] with an application of that basis

[1:06:23] the township's new official plan states conditions for a second dwelling unit
[1:06:27] however none of the restrictions contained in the township's new zonium
[1:06:31] biologists section 2.2 are contained here
[1:06:35] why
[1:06:38] i will take take that
[1:06:43] so in terms of second dwelling units the op does the sort of the official
[1:06:48] plan does contain policies that provide some direction to the zoning bylaw
[1:06:54] uh the zoning bylaw does include in section 2.2
[1:06:58] a number of um a number of regulations that do apply to
[1:07:02] secondary dwelling units or accessories sorry
[1:07:05] additional dwelling units i keep getting that terminology mixed out but it's
[1:07:10] additional dwelling units so there is a number of
[1:07:12] restrictions and and limitations included in the zoning model
[1:07:17] that flow from those greater greater policies in the official plan
[1:07:27] we do have a question about another one about backyard chickens they
[1:07:30] specifically ask about um what the concerns are around backyard chickens
[1:07:34] wes i believe you touched upon that already uh with regards to to that
[1:07:39] sure and just to
[1:07:43] list if you will the concerns that were identified based on
[1:07:48] our best practices review
[1:07:51] questions around legal non-conforming use
[1:07:55] agricultural community concerns animal disease
[1:07:59] costs public health and groundwater concerns one of the things that we found
[1:08:05] very clearly in our review was that many of the municipalities that were
[1:08:10] permitting backyard chickens like guelph toronto
[1:08:14] kitchener were municipalities that were provided with full municipal water and
[1:08:20] full municipal sewers
[1:08:22] and obviously tiny not having that
[1:08:27] benefit relies on groundwater
[1:08:30] for all of its
[1:08:33] you know drinking water supply both municipal systems and private systems
[1:08:38] and obviously concerns about allowing
[1:08:42] additional you know
[1:08:45] backyard chickens if you will in residential zones particularly where

[1:08:58] of the thinking uh why at least at this point we had not included it as a
[1:09:02] general permission in the proposed new bylaw but again

[1:09:12] it is something that we will go back to council with and seek their instruction
[1:09:16] and direction as to how they want to proceed thanks wes
[1:09:21] uh the next one's with regards to a short-term rental question again um
[1:09:26] this is uh something we're just we're not we're not dealing with tonight
[1:09:29] that's not the purpose of tonight's meeting but we will get because
[1:09:34] specifically working on that project
[1:09:40] next question can blue water beach dunes be declared as zone ep2
[1:09:49] i can maybe take that question um
[1:09:52] ep 2 zone currently as sean mentioned reflects other wetlands
[1:09:58] that's not to say it couldn't include other environmental features so if that
[1:10:02] if there are features that individuals would like included in
[1:10:06] in um in the ep 2 zone they can certainly provide comments to that
[1:10:10] effect and we could review those comments and
[1:10:14] and consider uh whether they whether it would be appropriate or not to include
[1:10:20] those features i like we can't provide you with an absolute yes or no tonight
[1:10:24] but it's certainly something that we could look at

[1:10:42] the zoning by law

[1:11:24] you know that's located in the water is that something that's regulated by the
[1:11:26] zoning violence something i i don't have a quick answer for sean
[1:11:30] unfortunately okay thanks i can just confirm that some bylaws do
[1:11:34] include provisions related defense but often it's left to offense by law which
[1:11:39] is enacted under the munis black but certainly something as west mentioned
[1:11:44] could be uh or should be looked at in more detail
[1:11:52] yeah i can't confirm that the current donating by law deals with the height of
[1:11:57] a fence not not not with regards to the specific
[1:12:01] um location on the property unless we're in the wall and not in water not in the
[1:12:06] water yeah where we don't have jurisdiction
[1:12:14] uh were detached dwellings not allowed on the previous ep2 lands that are now
[1:12:20] zone gl
[1:12:24] so maybe i can answer that question um so if if you if you had a property
[1:12:30] that was previously zoned if we didn't have an ep we don't have an
[1:12:35] ep2 zone in the current bylaw we have an ep-1 zone in the current file uh
[1:12:39] the current ep1 zone in the current bylaw deals with all wetlands
[1:12:44] um and and and through the detailed mapping that was done through the seven
[1:12:48] sovereignty environmental association it's true that additional lands have now
[1:12:54] been zoned with an ep but i will say that there are other properties in the
[1:12:59] township that were historically zoned ep-1 that are now zoned green lands
[1:13:04] because it was determined that there's no wetland feature on those properties
[1:13:08] so in the in the current bylaw if you have a property that's ep one and you
[1:13:13] cannot you would not be allowed to build a dwelling if you're going to be zoned
[1:13:19] gl or greenland and then you buy a lot you would be allowed
[1:13:23] to build a dwelling on that property
[1:13:36] okay here's a question uh one last question is it possible to
[1:13:40] have our property excluded from the zoning change or is there nothing we can
[1:13:45] do and then in brackets from green belt to green lands and mostly ep2
[1:13:55] maybe i'll respond to that one uh sean
[1:14:01] jeanine submits comments to the website and very specifically asks us to look at
[1:14:06] the zoning of the property we can do that as part of this process
[1:14:10] right now obviously we're guided by the
[1:14:13] designations in the new official plan that's been recently approved uh finally
[1:14:18] approved by the county in december of last year um but based on uh you know
[1:14:23] the comments that we receive we can look at it and see whether there's some
[1:14:27] refinement that can happen at this stage in the process
[1:14:32] and just to that point it may be helpful if
[1:14:35] you could provide some evidence to the effect of why it shouldn't be included
[1:14:39] as ep2 for example if you've got photographic evidence or or certain any
[1:14:44] information you can provide that details what what you believe a more appropriate
[1:14:49] zone should be for that person thanks jimmy
[1:14:53] yeah just just just another point with this one if it's if your property is
[1:14:58] currently his own green belt um it will be likely going to green
[1:15:02] lands that's not that that that that is in compliance with the new official plan
[1:15:07] because the new official plan does not have a green

[1:15:13] uh but it has a green lands designation um but if yeah please send us an email
[1:15:18] with regards to any information you have with regard to the ep
[1:15:22] because like i said earlier we didn't get all of them correct and
[1:15:25] there is a refinement process we can and if we can deal with it before the bile

[1:17:31] just have existed it would need to have been a continuous use
