[8:04] that point uh there was a presentation that was made that uh concerning various

[8:10] arrests on February 7, 2024, September 9, 2024. Both times the same

[8:17] individual Ashish Brumbat

[8:21] and then another arrest on September 6, 2025, Chinloo. All of these for unlawful

[8:27] dealing to a child uh selling tobacco to minors. These arrests were made by the

[8:32] first precinct. Um there's also a list. Um I don't think it's necessarily into

[8:37] the record. It'll be part of the record, but you have at least one, two, three,

[8:42] four, five, six, seven, eight uh arrests similar issues going in 2024.

[8:50] Uh our recommendation is to uh >> and then the most recent is a warrant

[8:56] that was executed by the first precinct on June 25th,

[9:02] 2026. >> Yes. supervisor that uh warrant was

[9:05] obtained signed by judge Saxs uh where uh allowed us and the first precinct uh

[9:12] first pre executed it and as you can see to the to the board's right my left over

[9:18] 2,217

[9:22] flavored vapes were confiscated at the location. These were after community

[9:27] complaints of of of selling the flavored vapes which are uh against the law in

[9:34] New York State. They were also against town code that had been adopted. Uh

[9:40] these flavored vapes were found on the property on that date.

[9:47] And what we find is that um the on the last date in October 2025

[9:54] and as you can see as you're pulling those out supervisor they're they're

[9:58] meant to attract um younger uh folks you got you got bright colored packaging

[10:06] flavors of whether it's strawberry banana or any anything you can think of.

[10:12] Um and and these are meant to which has been recognized by the state

[10:17] [clears throat] and the town of Babylon that they're meant to uh attract uh

[10:22] younger folks into becoming addicted to nicotine.

[10:33] We on the last occasion in October 2025, it was adjourned for uh for compliance

[10:41] and furthering um whether they were going to begin to comply with the rules

[10:47] in terms of cing um um individuals making sure that tobacco is being sold

[10:53] to only adults. Uh but what we've found that um that has not been abided by. Um,

[11:00] in order to get the warrant, we had to send in a minor who did purchase uh a

[11:06] flavored uh uh vape from the location. The individual is under uh 21 years old

[11:13] and that was attached to the warrant which was shown to Judge Saxs who then

[11:18] signed the uh warrant. >> Okay. If I could just interrupt you for

[11:24] a sec. So did you say that there was an agreement and then there was an

[11:29] adjournment because of the agreement to kind of comply with the law and then

[11:33] they violated the agreement which led to the warrant and here we are to Is that

[11:37] what you said? >> Correct, Councilman? That is correct.

[11:40] That's exactly what occurred and uh so as you can see um they they hadn't

[11:45] abided by the agreement that they told the town board that they were going to

[11:49] do. So um the warrant was executed and all this was found and the

[11:53] recommendation town attorney's office is to uh keep the place closed as they

[11:58] haven't been able to comply and they've the business has shown to have

[12:04] been uh an example of what a a public nuisance is. the, you know, it's it's

[12:09] attracting young folks to something that's so dangerous and just leads them

[12:16] to a life of being addicted to nicotine and is

[12:21] and again it's it's unlawful and itself.

[12:24] » Any other comments or questions? >> Just just that when I was a county

[12:29] legislator, I sponsored the legislation with K. Browning to expand the 2-year

[12:34] 48month requirement to 36 months. So, this is an issue that's been very

[12:38] important to me that we get this nuisance

[12:42] um at bad actors and give localities the time frame to really capture these

[12:49] individuals and and do what the law is intended to do. So,

[12:54] » absolutely. And and again, the intention is to protect our our our youth, our

[12:58] children, and make sure that that's not being sold. In addition to these items

[13:02] being sold, one of the complaints we got was that uh um uh gummy worms type stuff

[13:09] with THC and it was also being sold and and the email that we received months

[13:14] ago when we started our reinvestigation of the property was that that was being

[13:18] sold as well and that was also found. >> Would would you be able to put a dollar

[13:22] amount value on? >> Yes. This is about uh close to we

[13:27] estimate about $60,000. >> 60

[13:30] » 60,000 >> 60,000 and then what would it be sold?

[13:34] » They go from depending on the vape. Tyson vapes usually sell for about uh

[13:39] $30. Other vapes about 25. >> What's the markup? What would he be

[13:43] making? >> Uh I actually don't have that answer. Uh

[13:47] supervisor, my apologies. >> I I just do know that it's

[13:51] » it's more than milk. It's a lot more than milk. And um

[13:55] » and and again, this this property is is a nuisance that's been complained. We've

[14:00] received numerous complaints from the community.

[14:37] a very good job representing his client. Um, it's important for his client to

[14:42] have representation here. Um, I told him that the town board is very upset. In

[14:49] fact, I've spoken to both school district superintendent who cover the

[14:54] area in Deer Park and North Babylon, and I'm sure if I spoke to the others,

[14:58] they'd have the same concerns um of what they've seen uh over the last few months

[15:05] in schools. We've spent money through our ARPA

[15:09] program to uh have Lynenhurst and Weanch school districts p purchase vape

[15:17] detection systems that have been installed in the bathrooms and locker

[15:22] rooms in various buildings in those school districts. I know other districts

[15:27] have had to invest money to do that to do just that to deal with with this

[15:33] which has become a massive problem. Um, and I told him at this point his client

[15:39] doesn't have I mean in my in my eyes zero credibility, but I would say

[15:44] there's really no credibility in terms of him being able to manage this

[15:49] business. He should go into maybe a legal business that sells products like

[15:56] this. Um, but that it would be in his best interest, his clients, and he'll

[16:01] have to obviously speak to his client. Um, but I think what I would recommend

[16:05] is that we have Michael work with the town attorney's office to hammer out an

[16:10] agreement that is going to allow him to sell the property in a very short period

[16:16] of time. And I'm sure a property on 231 in North Babylon is going to catch a

[16:24] bunch of people because if it's run properly and legal in legal fashion, it

[16:29] can do very well. um people aren't going to people are going to want to run into

[16:34] what we've done over the years, running in quick to get the the necessities or

[16:40] essentials that you need. So, I would recommend that we allow him that we

[16:46] table this today until August 5th. >> August 5th.

[16:51] » August 5th is the next meeting that we table this today. um that we have him

[16:57] meet with the town attorney's office either today or tomorrow and hammer out

[17:01] hammer out an agreement that is going to have him listing the property

[17:06] immediately for sale providing the town attorney's office with that agreement

[17:12] either through a broker or for sale by owner not dictating how you do your

[17:18] trans your personal uh the commercial transaction. Um, and then we put a time

[17:22] limit on when that sale's got to be consummated. Um, we're going to have to

[17:29] if we're going to allow him to open up because obviously the sale is going to

[17:34] be based on whether or not there's an operation going on there. So, that

[17:40] operation's got to be strictly monitored um where we're going to have inspections

[17:47] almost daily as to what products are in the building. and he's going to have to

[17:51] agree to allow our people to go in there um and then get this thing sold right

[17:56] away because he needs to be out of this business. There's not there's nothing

[17:59] else that we can talk about and there's even though you're a great attorney,

[18:03] there's nothing else that you can come up with that's going to convince us that

[18:08] he can do this. So, I think that that would be a reasonable compromise. Um,

[18:14] and I think that we need to get that all hammered out so that the board can vote

[18:18] on that at the August 5th meeting. I think that gives us more than enough

[18:23] time. It's about a month to do that. Um, does that sound reasonable to you?

[19:56] the expiration of the current moratorum on battery energy storage systems and

[20:00] not extend it to support the responsible appropriately sized deployment of these

[20:04] systems within the town. Battery storage is essential for the strong for storing

[20:09] and integrating excess energy from the grid as well as for providing reliable

[20:12] power during extreme weather or periods of peak or periods of peak demand. These

[20:17] systems reduce reliance on fossil fuel plants, support New York energy's clean

[20:20] goals, clean energy goals, create good paying local jobs in the clean energy

[20:24] sector, and help tacking tackle the growing affordability crisis by

[20:28] stabilizing the price of energy. We understand that local municipalities,

[20:32] including yourself, have had concerns over the safety of these deployments.

[20:35] However, Modern Best facilities are designed and operated under some of the

[20:39] strictest safety safety codes in the nation. The New York State Fire

[20:42] Prevention and Building Codes Council issued updated safety guidelines for

[20:45] best deployments in July of 2025, reflecting the latest best practices in

[20:49] fire safety, system design, and emergency response. In support, six

[20:53] former FDMY leaders, including retired Commissioner Thomas Van Essen, has

[20:57] affirmed that battery energy storage can and should be safely integrated into our

[21:01] communities. By either rejecting this clean and safe technology outright, or

[21:05] thoroughly overly or creating overly restrictive codes, we are missing an

[21:08] opportunity to provide energy security, grid resilience, local construction

[21:12] jobs, and more stable utility bills for residents. Babylon has taken the time

[21:16] over the past six months to create a working group and study this issue

[21:19] closely. And now it is time for residents to see the results of this to

[21:22] allow for this technology to be safely and appropriately placed in their

[21:25] communities. We ask for you to take the necessary steps to update your codes and

[21:29] embrace this technology. We're open to providing education or discussing this

[21:32] topic further with your office in order to achieve cleaner, safer, and a healthy
