[3:25]
of Adjustment and consent. My name is Mark Klug and
[3:27]
I'm the chair of this committee. The five members of
[3:29]
this committee are citizens of the Town of Milton and
[3:31]
are appointed by Town Council for a four - year
[3:33]
term. We are appointed to Actuad Matters respecting the Committee
[3:36]
of Adjustment and consent in accordance with sections 44 and
[3:39]
45 of the Planning Act. The other committee members and
[3:42]
attendants are Mr. Tyler Slatt, Mr. Salmon - Alahi, Mr.
[3:45]
Chris John Bino and Ms. Comfort - Ooh - N
[3:47]
- Gallaja. Agenda announcements and amendment. Any amendments? There are

of our meeting dated Thursday, June 25th, 2026. I have

a motion moved by comfort in Gallaja and seconded by

Tyler Slatt that the minutes from the Thursday, June 25th,
[4:15]
2026 Committee of Adjustment MINI be approved. Any discussion on
[4:19]

So just some housekeeping items before we get started. Tonight's
[4:33]
meeting is set in the agenda. Only those matters before
[4:35]
the committee will be discussed. This meeting is not the
[4:38]
appropriate form to discuss property standards issues, property taxes, or
[4:41]
any other general complaints to the town. Please contact the
[4:44]
town during normal business hours to discuss these and in
[4:47]
the other matters. All written correspondents provided the Secretary Treasurer
[4:51]
has been issued to the members and is now part
[4:53]
of the public record and hereby read into evidence. In
[4:57]
order for the Committee to approve an application, the majority
[4:59]
of the members present must satisfy themselves at the application
[5:02]
satisfies the applicable requirements of the planning act. If there
[5:06]
is a tie vote, which shouldn't happen tonight, the application
[5:10]
is denied. Applicants or their agent will automatically receive a
[5:13]
copy of the Committee's decision. If anyone else would like
[5:16]
a copy of the decision, please contact Secretary Treasurer. And
[5:21]
if I don't mention it, all decisions are subject to
[5:23]
a 20 - day appeal period, during which time any
[5:25]
decision could be appealed by only the applicant the municipality,
[5:30]
certain public bodies, and the minister to the Ontario land
[5:33]
tribunal. If you wish to appeal a decision, please contact

the Secretary Treasure. So we're on to number five, which
[5:40]
is items for consideration. First application is A26 - 029M387
[5:46]
Campbell Avenue East. If the owner or representative could please
[5:50]

Sure. My name is Shane Edwards from Houston Studio and
[6:08]
where the applicant on behalf of the owner for 387
[6:11]
Campbell Avenue East. Great. If you could tell the committee
[6:13]
what variances you're applying for and explanation of the purpose
[6:16]
and reasons for the application and why you feel it's
[6:18]
minor in nature. And you have the floor for five
[6:20]
minutes. Thank you, Mr. Chair. So yes, so this application
[6:25]
is rather straightforward. We're requesting three variances. So I'll just
[6:29]
quickly run through those. The first is to permit a
[6:32]
second garage, whereas zoning bylaw permits a maximum of one
[6:36]
garage per lot. This is for a residential dwelling, by
[6:39]
the way. The second variance is to permit a maximum
[6:42]
garage door height of 2. 74 metres, where the bylaw
[6:46]
permits a maximum of 2. 4 metres. And the third
[6:50]
is to permit a residential driveway having a width of
[6:53]
22. 42 metres to exceed the width of the proposed
[6:56]
three - car garage, where the zoning by - law
[6:58]
states that the residential driveway leading to a three -
[7:01]
car garage shall not exceed the width of the garage
[7:03]
face. So with this, I just want to clarify that
[7:09]
we did defer from the June hearing, and we worked
[7:11]
with staff to kind of make some amendments to the
[7:14]
proposal. Um, I'm not sure, are we able to bring
[7:16]
up anything on the screen or is it just. Could
[7:20]
we bring up figure. One, please. Just while I explain
[7:29]
the variances, it might help to see. Yes.

into kind of the middle there.

A little bit further, if you could. Perfect.

Okay, thank you. So just some background, as I mentioned,
[9:30]
we did work with planning staff since the previous deferral
[9:33]
to work through some comments. The most notable were from
[9:36]
the NEC. There were some comments on the, I guess,
[9:39]
the length of the driveway. As you can see coming
[9:41]
from Campbell Avenue to where the dwelling is, it's rather
[9:44]
central in the large. Property. Um, so they had some
[9:48]
comments with regards to the amount of impervious surface that
[9:52]
we were proposing. And the other comments were from the
[9:55]
Fire Department, and basically they were saying that we need
[9:58]
to have a fire access route because of the distance
[10:00]
of the dwelling away from Campbell Avenue. So we did
[10:03]
satisfy those comments. We did alter the driveway. So as
[10:06]
you can see, there is a fire root. Now it
[10:08]
is meet the minimum width. And we do meet the
[10:11]
minimum, um, turning radius required, as well as the hammerhead
[10:15]
provided for maneuverability of the Fire Truck on the property.
[10:18]
And to address the surface, uh, treatment we did propose,
[10:21]
you can see the different hatches of the driveway. The
[10:24]
solid hatch is the obviously an asphalt impervious that's beneath
[10:28]
the fire root. But all other areas of the driveway
[10:31]
are, uh, paverstone obviously will allow some previous pass -
[10:35]
through of water. Um, so just getting back to the
[10:38]
variances. So as you can see here, there is an
[10:41]
attached garage in the main portion of the dwelling on
[10:44]
the left. And you do see the second garage on
[10:46]
the right there. So that's the second garage. There are
[10:49]
two garages. One is a two car in the main
[10:51]
portion of the dwelling. And the, what looks like a
[10:54]
detached three car garage. I just wanted to point out
[10:57]
that there is a breezeway connecting that to the main
[11:00]
dwelling. So even though it looks like it's detached and
[11:02]
it is, I guess, detached from the rest of the
[11:05]
floor plan, physically it is attached to the main dwelling.
[11:08]
So it is part of the main dwelling. It's not
[11:10]
a detached freestanding garage. Um, and if you can kind
[11:14]
of see the dimensional line from the back right corner
[11:17]
of that second garage to the back right corner of
[11:20]
the main dwelling, that's that 22. 42 metre dimension. That's
[11:24]
the maximum technical driveway width. So just to point out
[11:27]
as well that that's not the full driveway with leading
[11:30]
down to the road. That is the minimum six metre
[11:32]
required for the fire root. Um, and so those are
[11:36]
pretty much variance number one in variance number three. Variance
[11:40]
number two is just the increase of, uh, garage door
[11:43]
height from 2. 4 to 2. 7, basically eight feet
[11:46]
to nine feet, which just architecturally and aesthetically matches the
[11:49]
design of the dwelling a bit more. So that's basically
[11:52]
it, Mr. Chair. I'll turn it over to yourself in
[11:54]
the committee and I'd be happy to answer any questions.

quick brief. Uh, I just want to know that this
[12:05]
detached garage is connected with a breezeway. Right. Correct. So
[12:09]
it's, it's a detached garage in the sense that it's
[12:12]
disconnected from the rest of the floor plan, but it
[12:13]
is attached with the full breeze way. So it is
[12:15]
part of the main dwelling structure. And there is no
[12:19]
access to the garage from the breezeway, correct? No, the
[12:24]
breezeway is an outdoor. It's just covered. So it's basically
[12:26]
like a, like a covered over breezeway that connects the
[12:29]
two, but the passage between the two. And what is
[12:33]
the height of the garage. The height of the garage?
[12:37]
If we call up figure four, you can kind of
[12:39]
see the architectural elevation that will show that. I can
[12:45]
see that it is eight metres. It's quite high. It's
[12:48]
basically the same height of the main dwelling. It's a
[12:50]
bit more, uh, it'll be clear in the, sorry, figure
[12:53]
three, I apologise. Figure three page.

I can see that in the drank, it is nine
[13:13]
metre from grade level. So it is quite high. So
[13:16]
it's basically not connected. It's basically the same. It's connected
[13:19]
and it's basically the same height as the main dwelling.
[13:21]
So it's part of the main dwelling. The only thing
[13:23]
is there's a pass through underneath a breezeway that gets
[13:26]
to the rear portion that was shown on the site
[13:28]
plan. It's if we could pull up the elevation, it
[13:31]
would be a bit more clear. Thank you. I got

the, um. Because it's attached, it meets the height, like
[14:11]
where everything else is. It's just these, the minor variances
[14:14]
are going to creep up at building permit stage to
[14:16]
your knowledge. Through you, Mr. Chair, that's correct. So there
[14:20]
are different zoning provisions for attach versus detached garages since
[14:23]
the breezeway connecting this garage. It essentially has the same
[14:26]
high restrictions as the primary dwelling.

seconded by Salmon Al - Ahi. Be it resolved that
[14:43]
the application for minor variants under section 45, one and
[14:46]
two of the planning act, file A26029M for 387 Campbell
[14:51]
Avenue East in the town of Milton. Be approved subject
[14:54]
following conditions. Excuse me. One, that the devil elevelment shall
[14:58]
be constructed generally in accordance with the site plan prepared
[15:01]
by US designed studio and dated and stamped by Town
[15:04]
Zoning on July 9th, 2026, and the elevations prepared by
[15:08]
Huey's design studio and dated and stamped by Town Zoning
[15:12]
on May 22nd, 2026. Two, that a Building Permit be
[15:15]
obtained within two years from the date of the decision.
[15:18]
Three, that prior to issuance of a building permit, an
[15:20]
entrance permit shall be obtained for the new driveway. Four,
[15:23]
that prior to the assurance of a building permit, the
[15:25]
applicant shall obtain a building and land use permit from
[15:28]
the Ministry of Transportation of Ontario. Five, that the applicant
[15:32]
shall obtain all necessary clearance from the conservation halten and
[15:36]
shall submit the most current application materials to conservation Halton
[15:40]
to ensure that previously issued development clearance letter remains consistent.
[15:45]
Six, that prior to the issuants of a building permit,
[15:47]
the applicant shall provide confirmation of the proposed cut and
[15:50]
fill volumes and locations to assess whether a site, alteration
[15:53]
permit is required for the post scope of work. Seven
[15:57]
that the owner shall plant and maintain trees as shown
[15:59]
on the approved site plan. And finally, eight that the
[16:02]
approval will be subject to an expire of two years
[16:04]
from the date of decision. If the conditions are not
[16:06]
met, if they're proposed development does not proceed and or
[16:09]
a building permit is not secured. Any discussion on the
[16:13]

Kumar Goshi. I'm the applicant. If you could tell the
[17:02]
committee what variances you're applying for and explanation of the
[17:04]
purpose and reasons for the application and why you feel
[17:07]
it's minor in nature. And you have the floor for
[17:09]
five minutes. Sure. Uh, so this 1401er guy is detest
[17:17]
value unit with two car garage. Homeowner wants to have
[17:23]
a basement apartment and they submitted the building permit application
[17:26]
for the same around three months back. And we were
[17:29]
advised that to have this minor variance application because just
[17:36]
to clarify, so there is existing side door entrance. Which
[17:42]
we are proposing to use, to be used as a
[17:45]
main entrance for the basement apartment. To meet the Ontario
[17:49]
Building Court requirement, we need to provide a fire rated
[17:52]
corridor in the garage. So because of that corridor, the
[17:57]
available length in the garage reduces to 4. 93 metre.
[18:01]
Which is less than the city's menu requirement of 6
[18:04]
metre. And that is the reason why we are proposing
[18:07]
a manuaryance here. Also would like to confirm that we
[18:13]
are still meeting the three parking requirement, one in garage
[18:16]
and two on the driveway. Requesting the approval, because this
[18:23]
is the most feasible, practical and cost effective way for
[18:27]
the homeowner to have this basement apartment. And happy to
[18:30]

is Laura LaVell Panzeropolis. Don't worry, you won't be quizzed

Big Leary group. And I'm here as the agent for
[20:36]
the owner. Great. Uh, if you could tell the committee
[20:39]
what variances you're applying for, an explanation of the purpose
[20:42]
and reasons for the application, why you feel it's minor
[20:44]
in nature. And you have the floor for five minutes.

All right. So this application for 7211 5th line is
[20:53]
for a warehouse building that's in existence, um, it is
[20:57]
approximately 255, 000 square feet. It has 175 surface parking
[21:03]
spaces currently. No changes are being proposed to the site.
[21:06]
So the look at today in terms of a site
[21:09]
plan, um, it's only a change to a parking rate
[21:12]
that we are proposing. So this site from a planning
[21:16]
context is within the urban area, industrial area employment area
[21:20]
and zoned for, uh, industrial uses with an exception that
[21:24]
limits the types of industrial uses that are on this
[21:27]
particular site. So the application is straightforward. We are seeking
[21:31]
relief from the zoning bylaw requirement that parking for industrial
[21:36]
and warehouse uses on the site be calculated based on
[21:39]
the number of tenants or units within the building. Instead,
[21:44]
we are requesting that it be calculated based on the
[21:46]
entire building GFA. Um, so this will provide flexibility for
[21:51]
in the future. Um, the building, the existing building as
[21:55]
it is to accommodate additional tenants while maintaining the existing
[21:58]
site layout. So that's the purpose here. Parking justification has
[22:02]
been provided by Crozier and finds that this proposed rate
[22:07]
meets the, uh, that's already met by the existing supply
[22:10]
of 170 spaces is sufficient to support anticipated parking uses
[22:15]
for even a multi - tenant building, considering the existing
[22:19]
permitted uses in the zone. Um, in our opinion, the
[22:23]
application is consistent with the four tests under section 45
[22:27]
planning act for minor variances. It maintains the intent of
[22:30]
the official plan. Um, since employment areas are intended to
[22:34]
support a diverse range of uses and make efficient use
[22:37]
of employment lands. It maintains the intent of the zoning
[22:42]
bylaw, which is to provide appropriate parking for the use,
[22:47]
which is demonstrated in crosures parking analysis. And it's desirable
[22:51]
and appropriate because it allows the property to respond to
[22:54]
changing market demands and supports employment uses in the town.
[22:58]
Finally, it is minor in nature. Um, the proposed changes
[23:02]
to the site. Nothing you would see on the outside.
[23:05]
No proposed changes to the uses. Um, and there have
[23:09]
also been identical variances approved on other similar properties in
[23:13]
the area, um, to allow it to be, um, evaluated
[23:16]
by the building and not by the tenants and also
[23:20]
other similar rates that would be equivalent. And I can
[23:24]
go into more in depth if you are interested in
[23:27]
that minutiae. But for now, thank you so much for

them like for like, just wanting to confirm that. Through

you, Mr. Chair. Uh, yes, in this scenario, they did
[24:31]
review, um, previous parking data that they had looked at
[24:35]
for the actual usage of parking, um, areas incomparable industrial
[24:40]
warehouse sites. Um, and our transportation staff were satisfied by
[24:45]
the comparables that were provided that they do translate to
[24:48]
an appropriate assessment of this site as well. Sorry about
[24:53]
that. Did want to stay full discussion. I apologise. Moving

I'm a planner and we are the agent representing the
[26:17]
current owner Broccolini for the site at zero James Snow
[26:21]
Parkway. Um, we did have some visuals and it would
[26:24]
be helpful if I could get number three up or
[26:28]
slide three up. Um, as we go through it. As
[26:31]
part of this minor variance application, we're also working with
[26:34]
staff, uh, throughout a site plan application. And so that's
[26:37]
what brought us here today. We're here to bring forward
[26:40]
four minor variances. Um, as part of this application, the
[26:45]
first one being a request to increase the maximum driveway
[26:49]
with a two - way driveway width. That's the one
[26:51]
that you see in magenta at the left - hand
[26:53]
side. The second minor variance we're requesting is the parking
[26:57]
area setback. In blue. And then the green is to
[27:02]
permit a trash compactor. Outside of the primary dwelling. And
[27:10]
that one's in green. And then the fourth one is
[27:12]
an accessory building, which is like specifically it's a smoke
[27:17]
shelter. Um, in the front yard, um, you'll see through
[27:20]
this figure that it is three frontages that we are
[27:24]
dealing with in terms of exposure to the right of
[27:26]
way, uh, but the front yard is considered through a
[27:29]
site specific zoning bylaw as James Snow Parkway. And, uh,
[27:36]
from a planning perspective, um, all four variants do align
[27:41]
with the general intent of the town of Milton Official
[27:44]
Plan and the town of Milton Zoning bylaw. These are
[27:47]
site - specific requests that we're making in order for
[27:50]
the prospective tenant, which is Mad Lodge Farms to function
[27:53]
on the site from a traffic perspective, um, and from,
[27:57]
uh, like a user's perspective as well. Um. Just to
[28:02]
go back to the variances as well. We are seeking,
[28:06]
um, like minor reductions and the numbers are included there
[28:09]
from where we are revising them. So just to go
[28:12]
from left and right again, it's from 15 metres to
[28:14]
a roar requesting is 25. 2 metres, 1. 5 metres
[28:19]
to 1. 2 metres. It's a minor request. And then
[28:23]
the other two aren't quantified. From planning perspective from the
[28:30]
planning act, uh, and against the minor variance for tests,
[28:33]
we do believe that the four variances do maintain the
[28:37]
general intent and purpose of the official plan, general intent
[28:41]
and purpose of the zoning bylaw. And we do believe
[28:44]
that the variances are desirable and appropriate within the proposed
[28:49]
industrial use. Uh, and that they are minor in nature.
[28:54]
And again, this application is part of a broader site
[28:58]
plan application that we're continuing to work with staff. And
[29:00]
so, um, things in advance for all the assistants, uh,
[29:05]
to get us to this point, uh, but I'm happy
[29:07]

decision. And three, that the approval be subject to an

expiry of two years from the date of the decision

of the conditions are not met. If they're proposed development

an existing driveway that kind of brought you deep into

the property. We're about 50 metres or so off of
[32:47]
the road. Um, and so the driveway is just, it
[32:51]
stays kind of where it was. And then we just
[32:53]
finished building a new build residential home. And now the
[32:58]
backyard of the house is now technically the front yard
[33:00]
of the property. So we're kind of in this weird
[33:03]
little position. Um, where the pool is now in the
[33:06]
front yard technically speaking from the road, the absolutely no
[33:11]
view of the pool or the house currently. Um, if
[33:14]
you drive by, it's full evergreens all year round. Um,
[33:17]
so you would never kind of have that in position
[33:19]
that you would in that urban setting. Um, but yeah,
[33:22]
so we're looking to be granted that pool in the
[33:26]

sump location and discharge point. E a note stating silt
[34:57]
controls are to be in place prior to the start
[34:59]
of site works and be maintained for the duration of
[35:01]
construction. F a note stating. The contractor is fully responsible
[35:06]
to ensure that all erosion and sedimentation resulting from the
[35:09]
proposed works is controlled and contained within the work site.
[35:13]
And five that the approval will be subject to an
[35:15]
expiry of two years from the date of the decision.

If the conditions are not met, if they're proposed development
[35:20]
does not proceed and or a pool permit is not
