[3:48] permitting of private water well. Whereas the town of Reynolds requires

[3:53] applicability for the purpose of this chapter. Private water well means any

[3:57] drilled driven point dug, board or jetted well constructed for the purposes

[4:01] of obtaining groundwater which is owned by any private person or entity. The

[4:05] regulations requiring private water wells set forth in this chapter do not

[4:09] apply to m municipal drinking water wells or any other water wells owned or

[4:14] maintained by the town. Whereas the town of Reynolds requires permitting of

[4:18] private water wells. Private water well permits shall be issued by the clerk

[4:22] treasur's office only after the following conditions have been met. A,

[4:26] all private water wells shall be located so that no danger of pollution from

[4:30] flooding or unsanitary surroundings exists. And B, all private water well

[4:34] shall be located at least 50 ft from any property line of applicants property.

[4:38] And C, any person acting as a private water well driller must hold a license

[4:43] in good standing issued by the Indiana Department of Natural Resources pursuant

[4:47] to Indiana code 25-39 and 312, Indiana Administrative Code 13

[4:53] and D. Each proposed private water well, private water well location and private

[4:59] water well design shall meet each condition established by the Indiana

[5:02] Department of Natural Resources and the Indiana Department of Environmental

[5:06] Management. D. Each private water well permitted applicant shall be first shall

[5:12] first agree as a part of the permit application to consent to the inspection

[5:17] of the private water well drilling process and shall additionally consent

[5:21] to annual inspections and testing of the private water well site in addition to

[5:26] any potential crossconnection locations with the Reynolds public water system

[5:31] and the Reynolds sanitary sewer system. And F, any water to be produced from any

[5:37] private water well drilled within the town's limits of Reynolds shall be used

[5:42] exclusively for irrigation and or agricultural purposes only. Whereas the

[5:48] town of Reynolds may issue an exemption from permit requirements.

[5:52] A private water well driller or any person maintaining or operating private

[5:59] water well may seek an exemption from the permit condition and requirements

[6:03] set forth above filing a written request for exemption to the town council.

[6:08] Industrial wells which which require noncllorinated non-flloridated water for

[6:14] production will be considered for such exemptions as well as any other requests

[6:18] upon good cause shown. The town council should cons shall consider the input or

[6:24] recommendation if any of the utility superintendent before reaching its

[6:28] decision with respect to any request for exemption. Whereas a town of Reynolds

[6:32] requires prevention of contamination of public water supply and cross

[6:37] connection. A each person maintaining or operating private water well within the

[6:41] town limits shall install and maintain a backflow prevention device acceptable to

[6:47] the utility superintendent of the town of Reynolds on the water line

[6:50] immediately adjacent to any town water meter serving the property on which such

[6:54] private well is located in a manner sufficient to prevent contamination to

[6:59] the Reynolds water supply by private wellwater in the event that the private

[7:03] well system were to be inadvertently cross-connected to the town water

[7:08] system. Such a device shall be annually inspected and certified in operable

[7:12] condition by a licensed operator and such purpose and certification provided

[7:17] to the town. B. It shall be unlaw lawful to crossconnect any private water well

[7:22] in the town to any pipe or line intended to or capable of carrying town municipal

[7:27] water. C. It shall be unlawful to print water discharge from a private water

[7:33] well in the town to flow into or be diverted into the municipal sanitary

[7:39] sewer system without prior consent of the town. And it in the event that the

[7:43] town determines that private well water is being discharged into the town

[7:48] sanitary sewer system. The applicant shall be deemed in its application for a

[7:53] private water well permit to have consented to or authorize the town of

[7:57] Reynolds to install a metering device upon the private water well and shall

[8:01] thereafter pay a regular municipal charge for sewer treatment for all water

[8:06] produced by the private water well. In such event, the applicant shall install

[8:10] a meter and remote read out apparatus upon the private water well at the

[8:15] applicant's expense. The town shall invoice the applicant thereafter for the

[8:20] cost of sewer treatment regularly charged other town residents for all

[8:24] water produced from the said well in the event that the applicant fails to pay

[8:28] and said sewer charges in accordance with regular sewer billing and payment

[8:34] policies of the town. The town may disconnect municipal water service to

[8:38] the Appalach property and may also enter upon the Appalach property and disable

[8:43] the private water well so as to prevent water from being produced there from the

[8:49] responsibility for any damage to the private water well in such event shall

[8:53] remain solely the responsibility of the applicant. D. Each applicant for a

[8:59] private water well permit shall as a condition of the permit authorize each

[9:04] act of the town of Reynolds authorized in this chapter. Each application shall

[9:07] reference the application ordinance and the applicant shall be entitled to

[9:11] receive copy of this chapter at the time of application. The representations and

[9:15] agreements of the applicant shall run with the private water well and upon

[9:19] sale or transfer of any property on which the private water well is located.

[9:23] been trans. The transfer shall be required to complete and file with the

[9:27] clerk treasurer an application to transfer private water well permit by

[9:31] which the transfer of the private water well permit shall agree to be bound to

[9:35] the agreements and authorizations of the original applicant. Whereas the town of

[9:40] Reynolds requires permit fees and inspections. A each private water well

[9:45] permit application including applications to transfer private water

[9:49] well permit and written requests for exemption from permit conditions and

[9:54] requirements shall be accompany accompanied by a fee of $75. B. The

[10:00] Reynolds utility superintendent or his design may conduct an inspection of the

[10:04] premises upon which any private water well is located. send inspection may be

[10:09] conducted to ensure that the private water well is being maintained in a safe

[10:13] and wholesome manner and that all municipal, state and federal regulations

[10:17] are being met. Said inspection may include but is not limited to

[10:21] confirmation that no cross connections to either the municipal water s system

[10:25] or the sanitary sewer system has occurred and a determination that the

[10:30] backflow prevention device or devices are in proper working order. Whereas the

[10:35] town of Reynolds, the town of Reynolds requires application to existing private

[10:40] water wells. In order to protect the health and safety of the citizens of the

[10:44] town of Reynolds, the provisions of this chapter shall apply to all existing

[10:48] private water wells. Whereas a town of Reynolds may apply penalties. Any person

[10:52] firm or cooperation who violates any provision of this code for which another

[10:56] penalty is not specifically provided shall upon conviction be subject to a

[11:02] fine. not exceeding $2,500. A separate offense shall be deemed committed on

[11:09] each day during which a violation occurs or continues. This ordinance shall be

[11:13] effective on upon passage. And then we've got the date accepted and

[23:02] do a brief description. The project the way it is now um is a uh three pressure

[23:10] filters uh composite type filters still with two softers. The plant capacity

[23:16] would be 260 gallons a minute with those three filters expandable up to 450

[23:21] gallons a minute if you added two additional filters in the existing

[23:24] building. We just need to pipe uh two additional filters in.

[23:29] You could run one your high capacity well by itself or your two low capacity

[23:36] wells together to provide water to the filter and the softness. uh as as well.

[23:42] Um it has a terator. The tension the tension can be expanded by removing a

[23:48] ring, putting another ring in, blowing it back together. So you can also expand

[23:52] that to 450 gallons a minute with existing footprint. And then we have a

[23:56] salt brine tank. To fill that back up a truck with an auger fill top, make some

[24:01] brine takes care of the soft. soft things primarily for the mobile.

[24:06] Um then you have some facilities for an office for training. You have an office

[24:12] and a laboratory. Uh you have a restroom with the proper towers and safety

[24:17] equipment in there. Um then you have chemical addition. Um you

[24:24] have primary chemical addition will be chlorine. We also have side streams for

[24:29] sodium bicarbonate to get rid of some of the ammonia if they don't. soft work,

[24:32] which they will, but we're going to put it in anyway. Um, and then there are

[24:36] some Boser some some other chemical addition rooms. Now, the building will

[24:41] be a block building. We've done more samples on the site out there to

[24:45] understand what groundwater is. Groundwater is very high. It's a 3 ft.

[24:48] So, now we know how to design the foundation so it doesn't crack. We'll

[24:52] put a water spread putter out there under the foundation to handle all that.

[24:56] Uh, so now we've tested the water for going on a year and a half now. So,

[25:01] we're pretty confident after all the tests and the floor samples and the

[25:06] chemists and everything else we've had involved in this that we we've got a

[25:10] solution for you that will give you constant clean water. The other part of

[25:15] the projects is we're going to ice pig 5,000 ft of water man. We're going to

[25:19] freeze water partially and then introduce it into the water manes and

[25:23] buff it down the main the scour the bofilm I believe was in those water

[25:27] manes. That will take care of that bofilm because when you're just flushing

[25:31] your hydrants, you just got water send ice down through there and scour that

[25:35] out without damaging your pipes. We'll replace seven or eight hydrants with

[25:39] valves and then we'll clean the inside of your tower. Um completely clean to

[25:43] get rid of all the buildup iron that may be sitting there. If you want a video of

[25:47] that tower, we have one. Um be happy to show it to you while we got it. But that

[25:52] will take care of all the iron in your existing distribution system. Get out of

[25:54] the tower, get out the water mans, replace the hydrants, put new clean

[25:59] water through there, and that should take care of big part been what's been

[26:04] ailing to town for a number of years. Um, we're waiting on the savior funds to

[26:11] proper their offer. Is that right, Mr. Attorney? I'd say is that a proper way

[26:16] to say that? I'm not sure. Um, on subsidized funding and we hope that

[26:21] they'll give you you scored very well. uh you're just just at the subsidized

[26:26] rate subsidized cut off. So you scored very well. So we're just waiting on the

[26:30] final a final um offer by the city while we want to score

[26:36] that in six months. So I've said a lot and sorry if I said things

[26:43] in a way that probably been a little clear, but as it sits right now, it's

[26:48] scheduled to go to bid August 7th.

[28:34] lot of want hardness adjusted. Way this plant's been designed, you'd be able to

[28:38] meet those water quality parameters. I'm not sure Mr. Straw understands that

[28:42] because I don't think he has the experience to know when a big company

[28:44] comes in other than what Carol County but a lot of times companies will say

[28:48] here's my water quality requirements and you go down through there and then

[28:52] they'll say hardness I say soft water I say iron manganesees whatever quality in

[28:57] there this plant can meet virtually virtually everything so so um again I I

[29:03] don't mean to talk bad about your county officials but uh this is a very

[29:07] competent plan is a very technically casable

[30:05] prosecuting attorney's office yesterday around 1:00.

[30:09] Um I told him I had a complaint on some officers and he said stop right there.

[30:13] He goes, "I can tell you it's Wayne Wford." I said, "You're correct." So we

[30:18] had a long conversation um on a lot of different aspects. I've

[30:23] told him everybody I've contacted. I've contacted the state attorney general.

[30:28] I've contacted the inspector general. the inspector general sent me to the e

[30:32] ethics commission. Um, I've called IRS. I've talked to the state board of

[30:37] accounts. I've talked to an Indiana State Detective.

[30:43] So, and I told him exactly where I was

[30:47] going. And I'm going to explain to you what I explained to the prosecutor. He

[30:52] agrees. The problem we have is there's a conflict of interest with the judges,

[30:56] the prosecutor, with the officers. They work hand in hand. I also have a

[31:00] conflict because I've done business with the judges and others. So I can't

[31:05] there's a conflict here but we like I told Mark Delgado I would like to see a

[31:10] special prosecutor and a special judge brought in. So that that starts this

[31:15] out. Now I'm going to tell you a little bit of the backstory.

[31:19] I posted on Facebook a comment and where it started is there's a young man from

[31:24] Monon that's been his car has been searched a couple several three times.

[31:29] Once in front of my house, once in my driveway. The last time in my driveway

[31:33] and the kid is kid's Hispanic. He's in my driveway. My son comes home

[31:38] and he says, "Well, they got him again. He's got his three-year-old,

[31:44] four-year-old son sitting on his shoulders while the car is being

[31:46] searched again. never find anything. I'm looking out my kitchen window. I never

[31:51] see a license or registration handed back to the guy and he's off his on his

[31:56] way. Ice comes to town. Our marshall goes to moan on and guess

[32:02] who he has a conflict with? An arrest. The same young man that's had his car

[32:07] searched three times with his three-year-old son with him and never

[32:10] found a drug, never got a ticket, nothing.

[32:14] So, I posted on Facebook and I said, "I hope the kid gets an attorney and I hope

[32:19] he sues this town for $4 million." And I made a mistake because if I was on the

[32:23] jury, I'd give him $40 million cuz that little kid right now is probably

[32:28] thinking every cop out there is a piece of dirt. But anyway, so that that's part

[32:32] of it. So, that that kind of started the ball

[32:36] rolling. So, then the county officer and our marshals got a guy pulled over in

[32:41] front of my house. They're searching the car.

[32:44] I walk out to my mailbox and they're like, "Sorry, we're in your way."

[32:49] Actually, they impeded traffic and impeding traffic's a felony, but we'll

[33:10] well he had a prior pot conviction that is not probable cause to to search a

[33:15] vehicle. The county officer was in his car gone

[33:20] so fast in 3 seconds he's gone. He understood

[33:24] what I was saying. So my ex-mother-in-law and her daughter

[33:29] was in a bad wreck and they were in the University of Chicago. Doesn't matter.

[33:34] Last Thursday night, July 9th at about nine o'clock, she text me and asked if I

[33:38] wanted a half a watermelon. So, I went to her house and got it. I come home

[33:43] with a money bag that her mom out of her mom's house and this watermelon.

[33:48] I take him inside. I grab some rags. I come out and I clean my truck. I throw

[33:53] them in my trash can. One of the deputies is with him, points me out.

[33:58] He's head first in the car searching and the deputy points me out and he comes

[34:03] out and he puts a hand on top of the car and one on the door and he pulls himself

[34:06] up and he yells across the highway and I measured it. It's 267 ft and he says,

[34:14] "If you impede my investigation, I'm taking you to jail."

[34:19] And exactly what you said and I want your body cam because you were in the

[34:22] middle of an arrest. Please, my my attorney is going to get

[34:26] that. So, I um I feel that is a threat and

[34:32] it's a threat on my first amendment rights because I spoke my my voice and

[34:36] he didn't like it cuz somebody pointed him out.

[34:41] So, in all this, I've talked to all these people and now I just realized

[34:45] something. I I started talking to some business owners. Chad Mayill and Dave

[34:49] Mayill have been harassed by them. Jean Wilkerson, his wife, their mechanics all

[34:54] been stopped. The mechanics had his car searched.

[34:59] Um, he called the state police on Jean's truck.

[35:04] Um, there's a lawsuit coming from the truck driver that owns Spark Kelly's old

[35:08] building. So, apparently they don't like business owners.

[35:11] And there's a lawsuit going there. And after I got done talking to Mark Delgado

[35:16] yesterday, he goes, "I'm going to review four cases right now because I don't

[35:19] think I've got all the facts." So he's reviewing some cases that are coming up

[35:23] and the trial with the truck driver is like August 29th or something. But

[35:26] anyway, so there there's a pattern here of of

[35:30] business owners. Talk to the gas station guy and he goes, "I don't want to say

[35:34] nothing cuz I don't want retaliated against

[35:37] and he was explaining to me again today how he's lost customers and the customer

[35:41] stopped and said, "Every time somebody pulls in," and this happened because I

[35:44] watched it happen. I stood there and they they were sitting across the

[35:47] street. Somebody pulls in, they whip over, they get their license plate, they

[35:49] go around the corner, then they pull them over since they leave or they or

[35:53] they get them in the parking lot. They've arrested 12 people. We can sit

[35:55] in this parking lot. And I said something to Carol one day about them

[35:59] sitting in the liquor store parking lot. How many people you think's going to

[36:02] stop and buy liquor from a business when the police are sitting in the parking

[36:05] lot or sitting right across the street watching? They've ruined businesses in

[36:10] this town. Dirt Fleck run him off the pro his property at 500 North. He was

[36:16] trying to sell a trailer and Dirt Fleck went over and said, "You buying my

[36:19] trailer?" And they said, "No." And he said, "Then get off my property because

[36:21] nobody's stopping to buy my trailer when you guys are out sitting up here 5 miles

[36:25] north of Reynolds." So then I got photos. There's a there's

[36:30] a traffic stop in Monon at the front door. Casey's the old man

[36:36] they had arrested. I think they should have checked his pulse because he didn't

[36:39] look like he was very lively. He's probably 85 years old and 105 lbs. Two

[36:44] county deputies had him pulled over at the front door.

[36:48] The the deputy had him could have folded him up, put him in his pocket, take him

[36:52] to jail. The guy's that frail. Two Monon police officers there.

[36:58] Our two said that the fuel pumps block him fuel pumps so they can't get fuel.

[37:04] And then Roger Young shows up with his personal vehicle. We got seven police

[37:08] officers. I don't think ours needed to respond to every call in the county.

[37:13] And over the holidays, you guys all heard that there was a tragedy of a kid

[37:16] getting us killed by fireworks. Guess who shows up? 350 North out out on 39

[37:23] going toward Buffalo. Our county marsh or our town Marshall.

[37:29] I had a farmer stop at my shop and he says, "Hey, what kind of clown show you

[37:33] guys running?" He's from Chambers, lives west of Chambers. I come to eat supper

[37:38] one night at the restaurant in Reynolds. And he said, "Everybody's warning me

[37:42] when I left. Watch out. You're going to probably get pulled over. They're

[37:45] working tonight." And I'm like, "This is incredible. This

[37:50] this just keeps going on." And the more business people I talk to, the more and

[37:53] more people say how they're getting harassed.

[37:58] And I know Chad Chad Mayhill's asked you guys to stay off his property.

[39:52] called in as a reckless driver. They requested us hold that vehicle for state

[39:56] DOT to get there next. Again, all this is recorded. Um, so again, wasn't there

[40:02] for the July injury, quit sitting at the liquor store, and the stop you're

[40:06] referring to where we searched that car was county stop. So he didn't rush away.

[40:10] It was his own stop. He called us for the canine. Canine hit on it. The lady

[40:14] that was driving the car said, "Yeah, I smoked marijuana yesterday." Of course,

[40:17] we're going to get a canine hit on it. There was nothing in there. I tried to

[40:19] tell that to you, but she walked away. >> Gene Wilkerson, his wife. The reason

[40:24] that people think they're being harassed is because no one's done anything in

[40:27] this town before. She was driving over 90 miles an hour when we had the start

[40:31] of that construction. Blew a stop sign on 125 East and I charged her with

[40:35] reckless driving. All those public records, we can pull that up. It's not

[40:38] harassment. It's people making these these decisions to break the law in our

[40:43] town and we're holding them accountable. That's the officer that was there with

[40:46] me that night when I said just so you know, she's going to jail. She had over

[40:49] 8 ounces of marijuana. K9 hit. She went to Michigan, purchased a bunch of

[40:53] marijuana I believe to sell. She disagrees. And there you go. So, I mean

[40:57] like every single one as far as the Monon, we went up there to serve a

[41:00] warrant to assist with them not long ago. Can't remember the last time we've

[45:46] able to pump around our lift stations were present.

[45:55] Um under storm water, GNS will be working on that bruner drain as soon as

[45:59] their schedule allows and they'll also be re reshaping that

[46:06] ditch probably next month. there crossing the ball field

[46:20] Street and South Main and 24 today. We ran out of material.

[1:01:53] of rounds on the counter on Main Street, we we are averaging 50 or uh

[1:02:01] 415 vehicles per day down Main Street. That

[1:02:07] totals up 57,670 trucks per year. That doesn't include

[1:02:13] filling the elevator three times. That's another 18,000 trucks. So roughly

[1:02:17] there's 75,670 semis go by down Main Street every year

[1:02:24] and roughly 100,000 cars and probably as busy as our highways.

[1:02:31] Just throw that out there by the figures. We're going to remove that

[1:02:35] thing. I think that we bought and it's going to get worse because of the new

[1:02:40] sighting down at the Bird Seed factory. Trains are going to be stopping for

[1:02:45] extended periods of time. >> Oh, rip. What's

[1:02:50] » they got new siding down there to put in stuff from be more trains disconnecting
