Okay, we are now live.
[0:03]
>> Okay, thank you. I'll look to my clerk
[0:05]
for a roll call, please.
[0:09]
» Welcome to the August 20th, 2026 special

[0:13]
premotion resolution framework versus
[0:16]
town of Pepperra Aall 2026 and SC1662
[0:20]
HRTO file number 2026 67479I,
[0:24]
notice of application and appointment of
[0:26]
interim treasurer. We'll begin with roll
[0:27]
call council. Mayor Clark
[0:30]
>> present.
[0:31]
>> Deputy Mayor Bell
[0:33]
>> present.
[0:35]
>> Councelor Snutch
[0:36]
>> present.
[0:38]
>> Councelor Fischer
[0:39]
>> present.
[0:41]
>> Councelor Tu
[0:42]
>> present.
[0:44]
>> Councelor Goff
[0:45]
>> present.
[0:46]
>> Councelor Bell
[0:47]
>> present.
[0:49]
>> Thank you. We have quorum.
[0:51]
>> Okay. Thank you. I don't think we have
[0:53]
to play the spiel today, do we? Uh,
[0:55]
Madame Clerk,
[0:57]
>> we have no public at this meeting.
[1:00]
>> Uh, to the chair, yes, that's correct.
[1:01]
We do have uh we don't have public at
[1:04]
this meeting. It's being live streamed
[1:05]
on our YouTube channel.
[1:07]
>> Okay. So, do you want to play the uh
[1:09]
recording or is it necessary?
[1:14]
» Um, try to think what the exact wording
[1:16]
is, but I believe we can play it just to
[1:18]
make sure we're covered if that's all
[1:20]
right.
[1:20]
>> Perfect. Perfect. Yep.
[1:25]
This meeting is being streamed live on
[1:27]
the Township of Rome YouTube channel. Be
[1:30]
advised that by attending a public
[1:32]
meeting of the Council of the Township
[1:34]
of Rome, you are consenting to your
[1:36]
image, voice, and comments being
[1:39]
recorded and will form a part of the
[1:41]
public record. The chair, CAO, and/or
[1:45]
clerk have the discretion and authority
[1:47]
to terminate or interrupt the live
[1:49]
streaming in exceptional circumstances
[1:51]
where the content of debate is
[1:53]
considered inappropriate to be
[1:55]
published. Thank you.
[1:57]
>> Thank you. Uh Madame Clerk, do I need to
[1:59]
read the purpose of the meeting or that
[2:01]
was posted on the agenda?
[2:04]
>> Uh through the chair, yes, we should
[2:05]
read the purpose of the meeting.
[2:07]
>> Okay.
[2:09]
So, the purpose of this meeting is for
[2:11]
council to discuss a proposed pre-motion
[2:14]
resolution framework for the legal
[2:15]
matter regarding Bertrren versus
[2:17]
Township of Rome uh 20262
[2:24]
and to discuss the notice of application
[2:25]
to HRTO file number 2026-67479-1
[2:32]
and to appoint an interimm treasurer
[2:34]
prior to the restricted acts period. Of
[2:37]
course, as many of you know, uh we will
[2:39]
be lame duck here in a couple days and
[2:41]
then we wouldn't be able to pass any of
[2:42]
these motions at that time. And I
[2:45]
believe we're lame duck. And madam
[2:46]
clerk, you can clarify because there's
[2:48]
only a potential of five counselors
[2:49]
returning. Correct.
[2:52]
>> Um through the chair, yes. At this time,
[2:53]
we're anticipating we'll be in the
[2:55]
restricted acts period effective
[2:57]
tomorrow at 2 p.m. Um, as he noted right
[3:00]
now, we would have potentially five U
[3:02]
members who were feasibly able to return
[3:04]
based on nominations of our offices
[3:07]
being sought. So, at that point, that
[3:09]
would put us below the restrict the
[3:10]
threshold. So, that's our anticipated um
[3:13]
movement at this time. However, we do
[3:15]
have until tomorrow at 2 p.m. for that
[3:17]
to fully take effect. And just if I can
[3:20]
go back up one item, when you have the
[3:22]
chance, Mr. Mayor to adopt the agenda.
[3:24]
>> Oh, I'm sorry. Yes. Uh, go ahead and
[3:25]
read the motion to adopt the agenda.
[3:32]
At the special council meeting regarding
[3:34]
proposed premotion resolution framework,
[3:36]
Bertrand Deal versus Township Ever AL
[3:38]
2026 OSC1662
[3:41]
HRTO file number 2026 67479I
[3:45]
notice of application and appointment of
[3:46]
interim treasurer agenda dated August
[3:48]
20th 2026 be adopted as amended to
[3:51]
include the ones report for item 5.2.2
[3:54]
HRTO file number 2026 67479I
[3:58]
notice of application.
[4:01]
>> Thank you. Can I have a mover and a
[4:02]
seconder for that? Moved by councelor
[4:04]
Goff, second by councelor Snutch. Any
[4:06]
questions on the agenda?
[4:08]
Not seeing any. All in favor?
[4:11]
Any opposed? That is carried. Thank you.
[4:15]
Um, disclose your pecuniary interest by
[4:17]
anyone. I I will have one. Oh, go ahead.
[4:20]
C. I I'll do mine first. It's item 5.22
[4:23]
of the in camera file. I am one of the
[4:25]
name parties. Councelor Bell.
[4:28]
>> Also item 5.22. Uh again it doesn't name
[4:31]
anybody but uh I will recuse from that
[4:34]
as well.
[4:35]
>> Any other declarations? Counc
[4:39]
>> uh the same item.
[4:40]
>> Councelor Bell.
[4:42]
>> Same item
[4:43]
>> or deputy mayor Bell I apologize. And
[4:45]
counc
[4:46]
>> same item.
[4:47]
>> Thank you. So then I'll remind council
[4:49]
there will still be two counselors left
[4:51]
which is fine and legal. They can deal
[4:53]
with the matter. However, after camera
[4:55]
when we excuse ourselves, the council
[4:58]
must remain in the meeting because we'll
[5:01]
need to reconvene and pass the
[5:03]
adjournment bylaw and the uh the
[5:05]
important one that we always have to get
[5:07]
the confirmatory bylaw. So, even though
[5:09]
we'll leave the breakout room, we'll
[5:11]
just have to wait in the waiting room
[5:13]
until we're let back into council to
[5:15]
wrap up the day. So, so with that, I
[5:18]
will look for a motion to move into
[5:20]
close session. Madame Clerk,
[5:24]
>> that pursuant to section 2394 of the
[5:26]
Municipal Act 2001, SO201, chapter 25,
[5:30]
notice is hereby given that council
[5:32]
intends to hold a close session meeting
[5:33]
virtually via Zoom at 2:06 p.m. uh to
[5:37]
deal with item 5.2.1 regarding proposed
[5:39]
premotion resolution framework virt662
[5:46]
and item 5.2.2 2 regarding HRTO file
[5:49]
number 2026 67479I
[5:51]
notice of application being matters
[5:53]
pursuant to sections 2392E litigation or
[5:56]
potential litigation F advice subject to
[5:58]
solicitor client privilege and K a
[6:00]
position plan procedure criteria or
[6:02]
instruction to be applied to any
[6:04]
negotiations of said act
[6:06]
>> thank you may I have a mover and a
[6:08]
seconder moved by councelor Fischer
[6:10]
second by councelor Tu all in favor
[6:14]
that is carried so I'll wait until I get
[6:16]
the approval we're camera. I'm going to
[6:17]
grab a drink of water.
[6:34]
You can let me know when I can proceed.
[6:37]
Oh, here we are.
[2:40:18]
Oh god.
[2:40:27]
» Uh David, your sound is on.
[2:40:30]
>> Yeah. Do you want it on?
[2:40:32]
>> No, we are still not in the meeting.
[2:48:19]
Are we coming back, folks?
[2:48:28]
Are we We're We're coming back live. Uh
[2:48:30]
Rebecca
[2:48:31]
>> for the cherry. Yes, we are coming out
[2:48:33]
of close session.
[2:48:35]
>> Okay. I got a text from Council Goff. uh
[2:48:38]
he had connected. We lost him and he
[2:48:40]
isn't able to get back in. So, he's
[2:48:42]
having technical difficulties, but I
[2:48:44]
believe we still hopefully have a
[2:48:46]
quorum. Yes, looks like we do. But I
[2:48:49]
will confirm he texted me his regrets. I
[2:48:53]
just want to reopen our agenda.
[2:49:00]
Me a second.
[2:49:08]
open agenda. Okay.
[2:49:12]
So, did you do an emotion to rise or do
[2:49:14]
we do that now?
[2:49:16]
>> Uh through the chair. No, we still need
[2:49:17]
to do that.
[2:49:19]
>> Okay. If everybody if you can confirm I
[2:49:21]
that I have a quorum, then I will uh get
[2:49:24]
that motion.
[2:49:26]
>> Uh yes, I can confirm we have a quorum.
[2:49:29]
>> Thank you. And if you would kindly read
[2:49:30]
the motion
[2:49:33]
>> that council rise from close session at
[2:49:35]
4:50 p.m. and we convene in open session
[2:49:37]
and report.
[2:49:39]
>> Can I have a mover and a seconder? Moved
[2:49:42]
by deputy mayor. Second by councelor
[2:49:44]
Bell. All in favor?
[2:49:48]
Opposed if any. That is carried. Uh
[2:49:50]
>> sorry. Mr. Mayor, can you see me on the
[2:49:52]
screen?
[2:49:52]
>> No. Uh you're here, David, but we can't
[2:49:55]
see you.
[2:49:56]
>> Oh wow. Okay. I see your camera.
[2:50:00]
>> Yeah. Can you maybe get his camera on
[2:50:02]
there, Rebecca?
[2:50:05]
>> There. There you are. Okay.
[2:50:07]
>> All right. Perfect. Thank you.
[2:50:09]
>> So, now I have some motions. Um Rebecca,
[2:50:12]
the first one rising from a closed
[2:50:31]
Are you ready?
[2:50:33]
>> Chair. Uh so the first motion is related
[2:50:35]
to the proposed premotion resolution
[2:50:37]
framework for Bertrand Day versus
[2:50:38]
Township of Rome AL 2026 OSC1662.
[2:50:43]
This motion is that report CS2526
[2:50:46]
regarding proposed premotion resolution
[2:50:48]
framework for Trindale versus Santa Fra
[2:50:50]
ale 2026 OSC1662
[2:50:53]

[2:51:02]
council's confidential direction and
[2:51:05]
that staff be directed to prepare
[2:51:06]
confidential information memos to be
[2:51:08]
shared with the Lagoon City Parks and
[2:51:09]
Waterways Commission following any close
[2:51:11]

[2:51:12]
of this litigation.
[2:51:14]
>> Okay. Can I have a mover and a seconder?
[2:51:17]
Moved by councelor Fischer, second by

[2:51:29]
>> Okay. A recorded vote has been requested

on item 6.1 being proposed. Premotion

[2:51:38]
the requesting member. Council Snatch
[2:51:42]
>> opposed.
[2:51:44]
>> Deputy Mayor Bell
[2:51:46]
>> in favor.
[2:51:48]
>> Councelor Bell
[2:51:49]
>> in favor.
[2:51:51]

[2:52:03]
>> And Mayor Clark

>> in favor.
[2:52:06]
>> The motion has carried.
[2:52:08]
>> Thank you. And on the second motion, uh,
[2:52:11]
most of us did declared. So, I'm just
[2:52:12]
going to shut my camera off until I hear
[2:52:14]
that. So, that way I can't be construed
[2:52:16]
as trying to interfere. I would suggest
[2:52:18]
all the other counselors that declared
[2:52:20]
do the same.
[2:52:36]
Okay. So this uh motion is reporting
[2:52:38]
back on item 6.2 HRTO file number 2026
[2:52:42]
67479I
[2:52:43]

[2:53:11]
and that up to $400,000 be allocated to
[2:53:14]
defend the township and all necessary
[2:53:15]

the chief administrative officer in
[2:54:06]
respect of this matter in accordance
[2:54:08]
with section nine of the said bylaw.
[2:54:14]
Uh so as we have uh the chairs has
[2:54:17]
declared a conflict uh we we'll need a
[2:54:19]
mover move by councelor Fischer and
[2:54:23]
seconded by council to

[2:54:37]
now
[2:54:39]
and we have a bylaw that as soon as I I
[2:54:42]
think everybody's back again. And so if
[2:54:44]
you can read the bylaw and this is a
[2:54:45]
case as I think we're all aware uh we
[2:54:48]
need a treasur and again we can't
[2:54:49]
appoint those positions while under lame
[2:54:51]
duck. So we would give that authority to
[2:54:53]
the CEO on until the new council can
[2:54:56]
arrive and appoint a treasurer. So go
[2:54:59]
ahead Rebecca
[2:55:01]
>> the chair. Yes. The motion is that bill

[2:55:14]

[2:55:17]
Moved by the deputy mayor, second by
[2:55:20]

[2:55:28]
That is carried. Thank you. and the

[2:56:19]

Thank you everyone. On short notice I
[2:56:54]
had to do the same with county this
[2:56:55]
morning because of the lame duck period.
[2:56:57]
So thank you. Enjoy the rest of your
[2:56:59]
day.
