[1:11] be having six more weeks of fog, unfortunately. Well, I appreciate

[1:15] everybody getting here safely in the fog. Uh we are going to start our

[1:19] meeting this morning with the pledge of allegiance led by Supervisor Vanderpool

[1:23] and then a moment of silence.

[2:02] is Supervisor Matters and I will start with Supervisor Mccari.

[2:09] » Well, good morning everyone. Uh, you know, there's not a lot going on this

[2:12] last week. Just a lot of constituent uh concerns and calls. We talked to them

[2:16] and and got them connected. I want to thank staff, RMA, HHSA, everybody's been

[2:20] great. Uh, GSA, you've been really good and great and thankful. We're thankful

[2:25] for all you do. We really appreciate our county employees and you work so hard

[2:29] and you're very diligent getting on that. I think the biggest thing that we

[2:32] have is just some congratulations to Nick Nave. He was just recently uh this

[2:36] week appointed to department of public safety director at the city of Lindsay.

[2:41] Nick was with the Lindsay Police Department a long time and worked his

[2:43] way up. So, congrats to him. And then our good friend Johnny Amarell is the

[2:47] CEO of Front Water Authority. He just got that a couple days ago. It's good to

[2:51] have someone local that knows our concerns in our areas in charge of such

[2:55] a large facility with containing water to see what he can do to bring to us.

[3:06] » All right. Good morning everyone. Uh uh last week had a ribbon cutting over in

[3:12] Porterville with the Portville Chamber of Commerce um at a a new gym in town

[3:17] called Anytime Fitness. So it's nice to have another uh another option over

[3:22] there for uh for getting out and getting fit. Uh also we had our local agency

[3:28] formation commission meeting right here. Um had a government affairs committee

[3:32] also with Porterville Chamber. uh very productive meeting uh setting a lot of

[3:36] the goals for what that committee wants to do in uh in up in this upcoming year.

[3:43] And then I had a check-in with our HHSA group. Uh that's always a great

[3:47] discussion with so much going on in the health and human services world. So it's

[3:53] always very instructive for me. Uh this week um Thursday have an Eastern Tuli

[3:58] Groundwater Sustainability Agency meeting at 2:00 over at Porterville City

[4:03] Council Chambers. Uh on Friday at 7 o'clock there's a in the morning there's

[4:08] a first Friday coffee and this month will be hosted by Vesper Energy uh solar

[4:14] outfit and uh and then this uh the next week coming up we'll have the opening

[4:18] ceremony at the Agra Center uh for the international a show and so always look

[4:23] forward uh to that and because of that we push our meeting here into the

[4:28] evening so it'll be right here at six o'clock on next Tuesday and that's all I

[4:37] » Thank you, Chair. >> Well, good morning, Terary County. Um, I

[4:41] want to thank Jennifer Fox along with department representatives for

[4:45] participating in our Traver town hall last week. We had a very successful

[4:49] attendance by the community with informative reports from HHSA, fire,

[4:54] sheriff's, RMA, and animal services. I [clears throat] also attended the

[4:59] California Rural Legal Assistance ribbon cutting. It was a it was a great event

[5:04] um and the ability to learn about their programs and services and connect with

[5:08] other agencies there to support this great organization. CRLA is a nonprofit

[5:13] law firm founded in 1966 to provide free civil legal services to lowincome

[5:20] residents of California's rural counties. On Saturday, we had over 20

[5:24] volunteers help clean graffiti in Cutler Rosi. We started off the morning morning

[5:29] morning with a powerful message on service and community and ended our day

[5:33] with pizza to thank our volunteers for a great job beautifying Cutler Arosi. Last

[5:38] night I had the opportunity to attend the Seroptimus Ruby Awards with uh our

[5:42] chair Shucklean. This uh this night is always special for me as the

[5:47] organization recognizes powerful, compassionate and courageous women who

[5:52] have journeyed through life's difficulties but have mustered through

[5:55] them. Parenting Network received the Making a Difference for the Community

[5:58] Award, while our very own former well, our former Tillery County employees, now

[6:04] COOS affiliated, uh, Courtney and Miriam Salam, received the Making a Difference

[6:09] for Women Award. So, congratulations to all recipients who received awards last

[6:14] night. I have the following meetings and activities this week. We have the Monson

[6:18] Sultana Playground ribbon cutting ceremony along with our Taller County

[6:22] Forest Alliance meeting. I have a Latino caucus of California counties meeting on

[6:27] Thursday and then I will be attending the 65th annual Woodlake Awards along

[6:31] with the Proteus Gala and then a Badger ribbon cutting on Saturday for its new

[6:36] senior fitness center. And that is all I have chair.

[6:42] » Thank you, Madam Chair. Uh a few items that I wanted to go over for this week

[6:46] upcoming uh some public meetings and events. Um I've got a meeting of the Tar

[6:50] County Employees Retirement Association tomorrow at 8:30. that is off of the

[6:54] normal second and fourth week of the month uh schedule and that's due to the

[6:59] World Egg Expo which we are accommodating with uh changing that

[7:02] meeting. Um got meetings with various constituents and departments throughout

[7:06] the week. Uh Friday is wear red Friday in Tallery County to advocate for heart

[7:11] health. So I want to encourage everyone to uh wear red and support that message

[7:16] in our county. um got a meeting on Monday for the Greater Kuia Groundwater

[7:20] Sustainability Agency at 1:00. Uh also at 3:00 that day, we've got a meeting of

[7:26] the Ter County Water Commission. And then on Tuesday, uh the World E Expo

[7:32] kicks off at uh 8:00 is the actual ceremony. You can get there at 7:00 and

[7:37] have uh a continental breakfast and socialize uh for the World E Expo. It's

[7:42] a huge event in this county. uh brings in over 1,400 different exhibitors in

[7:47] various a industries and our very own uh grower county tourism will be there with

[7:53] their booth. Um and there are over 100,000 attendees throughout the week.

[7:59] So, it's a a very significant uh uh event for this county, this valley. Uh

[8:05] there are hotel rooms that are booked all the way up to Fresno and down to

[8:08] Bakersfield to accommodate our guests. Um and one more thing I wanted to

[8:12] mention. Uh, go Patriots. Okay. >> Definitely not a Patriots fan. Not a

[8:19] Seahawks fan at all. >> That's good.

[8:21] » Yeah. All right. Um, thank you, Supervisor. A couple things uh from last

[8:26] week. Uh, Supervisor Valero and I actually had a meeting with the new um

[8:30] executive director of the Sanwaqen Joint Powers Authority. That is, um, the Joint

[8:36] Powers Authority is the administrator for the Amtrak. uh used to be called the

[8:41] Sanwa Keen, now the Goldrunner. Uh so that was a good meeting to meet him. And

[8:46] then also, as Supervisor Valero said, I attended the Ruby Awards last night. Um

[8:52] this afternoon there is a mental health board meeting. Then I will be traveling

[8:55] to Fresno. Um I was invited to the Fresno Chamber of Commerce's first LGBTQ

[9:01] mixer up there. Tomorrow I will be attending a ribbon cutting for Nirvana

[9:07] Wellness Center here in Vicelia.

[9:12] And then also, as was already mentioned, next week is the A Expo. We will be

[9:17] having a night meeting here in these chambers at 6:00. I will then be heading

[9:22] um to Sacramento on Wednesday uh for the SEESAC Challenge Awards. And on

[9:28] Thursday, I have my SESAC uh board of directors meeting which I sit on

[9:32] representing this board. And then we will be dark the following week uh for

[9:37] President's Day. So with that, thank you all for that. And our next item is a

[9:43] very exciting item. We have a special guest here today, Willow. Willow walked

[9:49] around a bit. Willow is a 2-year-old female shepherd with, as you can all

[9:54] see, the sweetest soul. She's great with other dogs and absolutely enjoys

[9:58] people's affections. Pet and praise are her love language. Mine, too. Um,

[10:05] Willow loves heading out to the yard to play and explore, and when she's done,

[10:10] she'll happily try to walk herself back to her kennel like the polite little

[10:14] girl she is. Gentle, affectionate, and well-mannered, Willow is a truly sweet

[10:19] girl who would make a wonderful companion for someone looking for a

[10:23] loyal and loving friend. Jessica, if you wanna you want to come up and um tell us

[10:28] a little bit about the process and what's happening at animal service. Look

[10:32] at that picture. >> Good morning, uh chair members, um CEO's

[10:39] office, county council, thank you for inviting us, um to bring Willow here

[10:43] today. Um she is a great dog, as everybody can see. She's been with us

[10:48] since January 13th, and she's looking for her forever home. She's great with

[10:53] other dogs. loves loves people. Um, as far as adoption, if anybody's interested

[10:59] in adopting her, her adoption fee is only $25. She is up to date on all her

[11:04] vaccines, microchipped, and is scheduled for her space surgery later this week.

[11:09] Um, you are welcome to come into the shelter and meet with her. We can take

[11:13] her out to the playyard. As well as if you have other dogs that you want to

[11:17] introduce her to at the shelter to make sure they get along, we can do that as

[11:21] well. >> Okay. Is she available like um to

[11:24] foster? >> Yes. Yes, we can do foster. Uh how

[11:28] adoption usually works with us is uh because we are limited on spay and

[11:33] neuter um surgeries each week. She will go out on what we call foster to adopt.

[11:39] So she will go out on foster, she will go home with a surgery date. You'll

[11:44] bring her back for her surgery. Um and you'll pick her up the same day. When

[11:48] you pick her up, the adoption will be finalized at that time.

[11:51] » Okay. And how are things doing out at the

[11:54] shelter? Was she a stray or >> She was a stray. Yes. Okay. Things are

[11:58] good. Um we are getting ready to um actually we started our adoption

[12:04] promotion yesterday. So for our Valentine's Day adoption promotion, uh

[12:10] the adoption fee for dogs is $20. So in that case, Willow's adoption fee will

[12:14] also be $20. >> That's great. 20 bucks. I'll tell you

[12:18] what, if somebody adopts her here today, I'll pay the 20 bucks. All right. All

[13:02] » Good morning board. Um and everybody here. My name is Thomas Mugana. I'm an

[13:07] SEIU local 2015 IHS provider here in Terary County. I've been a a provider um

[13:13] since 2014. I became a provider to take care of my

[13:16] parents who recently passed away. Um I recently got two new providers. Um two

[13:23] more recipients that I take care of. I love the work I do. It's difficult at

[13:28] times to make ends meet here in Terary County.

[13:31] My clients live in one lives in Wood Lake, the other one lives in Hampford,

[13:35] so I commute to from house to house. I know it's in two different communities.

[13:38] I mean two different um areas, but I I love the work I do.

[13:43] Um, everything is expensive here in Terary County. Groceries, housing, um,

[13:49] raising cost of living, everything is hard to to keep up with.

[13:54] We currently have over 8,000 providers here in Terary County and need the and

[13:59] the need of care continues to grow every day. I go to I'm an organizer too and I

[14:05] go and um and I in every orientation we have about

[14:10] 20 to 25 uh new providers that become um I just providers every Tuesday and and

[14:15] Fridays. What will happen to the older adults and

[14:21] those with disabilities who depend on the quality um of home care? It's

[14:25] essential care that here in Tiller County, we are 8,000

[14:31] strong.

[14:34] We ask you board of supervisors to remember that providers have families,

[14:38] too. We do our work out of love and at times it can be risky, but we keep we

[14:45] keep um worrying about keeping our roof over our heads and food on our tables

[14:50] each month. We need this community to show us that our work that we do is

[14:54] valuable and paying us valuable wages by increasing in investing in care

[15:02] because we do save the community a lot of money. Um the work we do is not easy.

[15:08] It's it's very difficult and um we do do it out of love. Um if we didn't get paid

[15:14] for it, we would still probably take care of the people we take care of.

[15:18] my union siblings and I need your support to so that people

[15:25] we need your support. So please work with us, be a care champion and pass a

[15:29] strong contract to keep us um to keep our community safe. Thank you. Thank you

[15:53] CEO, council, clerk. Uh Tom Tucker, Clary County a commissioner. And uh this

[16:00] turned out to be a a fantastic uh day to come and uh speak a little bit about our

[16:06] detector dogs throughout California. Uh each of you have a a calendar and there

[16:13] are some out in the lobby should anybody uh want one.

[16:18] Just in short, California ad commissioners throughout the state uh

[16:22] use these dogs in uh different areas, usually the postal centers, uh uh

[16:28] international hubs, and they will inspect packages for any type of

[16:34] invasive pests or uh plants, matter, anything that shouldn't be coming in in

[16:40] that manner. And uh I just wanted to bring attention to it and uh keep in

[16:47] everybody's mind that if they happen to have friends or family overseas or even

[16:52] out of state that maybe want to ship them some fruit that you know maybe they

[16:57] don't normally see or get or little tree cutings or whatever. Think twice about

[17:03] it. and because they very often have pests and that's probably the number one

[17:09] way in which these pests come into this country and this state for that matter.

[17:14] So anyway with that uh if you have questions um

[17:18] » appreciate that Tom we did get copies of it yesterday and I spent quite a bit of

[17:22] time going through each month and I think everyone is a Labrador retriever.

[17:27] Go figure. Um, but also you're right. I do watch

[17:32] catches to catch a smuggler. So, um, there there are a lot of that happening.

[17:36] Um, does I know we don't have a detection dog and I know uh CEO Britt is

[17:43] probably looking at me funny right now, but do not saying we need one, but do we

[17:48] have access like does the, you know, CDFA or or anybody have a dog that, you

[17:54] know, we can use from time to time for this purpose?

[17:58] » Uh, you know, we do. Uh the ad commissioner in Fresno County has been

[18:03] very gracious over the years and when we get into a situation where we feel we

[18:08] should have a a uh the ability to have a dog, you know, sweep some packages, uh

[18:16] more than willing to allow us to use the dog or have the team come down and help

[18:22] us out. >> That's great. Um, and like I mentioned,

[18:25] it's usually in the international hubs, which Fresno's a bit of one, and and of

[18:29] course our larger Orange counties and those,

[42:34] TSM25-00004.

[42:37] And this is the applicants are Dorothy and Elwood Grizzle. And they are in the

[42:41] audience if we have any questions for them later.

[42:46] Uh the subject property is outside of any urban area boundaries or urban or

[42:50] hamlet development boundary but is subject to the foothill growth

[42:53] management plan with the land use designation of development corridor. The

[42:57] proposed development is located 1,400 ft west of the intersection of road 276 and

[43:02] avenue 176 souththeast of Strathmore and approximately 3 miles north of the city

[43:08] of Porterville.

[43:11] Uh since it's not located entirely within an UDB or UAB, the planning

[43:16] commission is only advisory and the board takes final action on all these

[43:21] matters. The property is zoned PDFM and contains two car ports, two wells, and

[43:27] power poles. Currently, surrounding properties are all zoned PDFM and

[43:31] contain subdivided parcels consistent with the proposed subdivision and

[43:35] contain rural residences.

[43:40] In regards to our code and how this is applied to this subdivision, access

[43:46] wise, a private road serving parcel ones through eight of this subdivision is

[43:51] required to be constructed to a class one county road standard as defined in

[43:55] the improvement standards of Tery County. It's also consistent with the

[43:59] private streets requirements, our general requirements for lots, size,

[44:03] shape, uh including those in mountainous areas. Um it will include drainage. It

[44:10] will have fire protection, sewage disposal, domestic water and is in the

[44:15] plan foothill zone which has additional requirements as well.

[44:22] Uh notice uh was prepared and given out and mailed to surrounding property

[44:27] owners and published in the exit sun gazette with a 10-day public comment

[44:31] period before today's supervisor's meeting and no comments were received.

[46:05] All right. Item five is a public hearing to consider proceeding to form Gan

[46:10] Village East Landscaping and Lighting Assessment District number one. The

[46:14] public hearing is now open

[46:19] and we will hear staff's presentation. Good morning.

[46:23] » Good morning uh chair, supervisors, CEO, council, and

[46:28] clerk. I'm Rob Abraham, the county surveyor, and I'm going to present on

[46:33] behalf of the Ter County Resource Management Agency for the Gan Village

[46:37] East Landscaping Lighting District, which will include this public hearing

[46:41] and a vote uh by mail.

[46:48] So just to kind of outline the general process here, we the actions that kind

[46:52] of preceded this public hearing was the board reinitiated the proceedings on

[46:57] December 16th, 2025 by resolution 2025 uh 1128. It was reinitiated. Our initial

[47:06] proceedings were had to be reinitiated because there was a tabulation error or

[47:12] there's an error in the ballots that were sent out. So we had to resend out

[47:16] the ballots with the correct assessed amounts.

[47:19] Um but as part of the uh proceeding initiating proceedings we the board

[47:27] approved the engineering report the proposed boundary approved the notice

[47:31] letter and ballots that were sent out declared the intent to levy and set this

[47:36] public hearing. Staff then published posted and mailed

[47:40] out notices of this public hearing in accordance with law. Um staff mailed

[47:45] ballots to each lot owner of record based on the assessment roles uh within

[47:51] the subdivision of track number 835 benefiting from the district on November

[47:57] December 18th which is greater than 45 days before this hearing which is the

[48:03] requirement under the law.

[48:08] All right. So today we're going to have um kind of the process. Today is the

[48:13] staff presentations, public comment, supervisor question and comments. Um

[48:17] owners may submit any outstanding ballots. If any if anyone is hasn't

[48:21] mailed them in, they may submit them by the end of the public hearing. Um and

[48:26] then afterwards and we will tabulate the ballots at the end of the meeting.

[48:34] So just a little background on the track. This is subdivision track number

[48:38] 835. It's located between Rian Avenue and Avenue 310 west of road 76 in the

[48:45] community of Gan. It was originally a 35 acre lot that was divided. Um includes

[48:52] included is streets improvement, storm water collection, park and landscaping.

[48:57] The road the streets and storm water collections already have assessment

[49:00] districts formed on them.

[49:05] Uh this was broken up into four four primary phases.

[49:10] Phase one was the multif family uh apartment complexes. Phase two and three

[49:15] was the residential single family residential a lot includes the pocket

[49:20] park that is part of this district and those are currently under construction.

[49:26] Phase five was the multifamily uh salt and light neighborhood village

[49:31] development. um mobile home park on the um that was

[49:36] previously developed and pretty much fully built out.

[49:42] Um as this pro this project and this site is still under development, the

[49:47] assessments are going to be broken into two phases. Basically phase A is the

[49:52] stuff that is currently constructed or under construction and anticipated to be

[49:58] um completed by the time the any assessments actually are levied.

[50:05] Uh this will include um landscaping along the frontage of

[50:12] Avenue 312 between the sidewalk and the curb on road 76 between the sidewalk and

[50:19] the curb. And then on Avenue 310 fronting the residential including three

[50:25] landscape lots and the parkway lots and additionally the parkway lot on fronting

[50:32] the uh mobile home park.

[50:38] All right. Um phase B will be constructed at a later date as that

[50:44] those lots are developed. Um which will consist of parkway improvements on

[50:48] Avenue 312 and Road 76. Um let's see what the improvements and

[50:56] services will consist of in this district will be landscaping primarily

[51:01] tree shrub bush and vine maintenance weed management and abatement mowing of

[51:07] turf in the pocket park um infrastructure and maintenance

[51:12] graffiti abatement sidewalk ADA hardscape repairs um all the

[51:16] improvements are not funded under the district as far as their construction

[51:20] only their maintenance ments and services. Um also the maintenance of the

[51:25] irrigation system, any pest control, uh util including and utility and

[51:30] administrative costs for water, electricity and then the cost of and

[51:35] the administrative cost with running the district.

[51:41] Uh the engineering report breaks down the cost into the two

[51:45] phases. what's being approved today, if

[51:49] approved, will be the total here. But phase A is $24,380

[51:56] a year. Um phase B is $3,120 with the total being 27500 $27,500.

[52:06] As mentioned, the phase B costs will be assessed after these improvements are

[52:10] done. um they will be a new annual report be brought to the board when

[52:16] those are done to show they're done and then we can start loving those when

[52:20] those improvements are built out. Um the table at the bottom right is just a

[52:25] breakdown of the various [snorts] service areas and the

[52:30] associated costs. Um this district will be formed with an

[52:36] assessment adjustment so that the prices the cost can be increased and to

[52:42] compensate for inflation. Um the formula basically used it's going to be the

[52:46] consumer price index 5% but not more than the actual cost of maintaining the

[52:51] district.

[52:55] Uh the basis for calculating how much each lot will be assessed

[52:59] is based on the equivalent dwelling unit which is used as a single family home as

[53:04] a baseline. Each each land use is assigned a ED effect

[53:09] proportion to how many people occupy or use it. So for instance single family

[53:17] home is considered to have 2.9 people and apartments have fewer. So they get

[53:22] assessed less per unit. Um and similar with mobile home parks commercial it's a

[53:28] little harder to judge but we do it on an acreage basis depending on what the

[53:31] use and 9.3 is kind of a standard for un for mixed use. So there's a basic

[53:39] calculation if you have two acres 9.3 and then by the total assessment divided

[53:45] by the total um number of edus or equivalent dwelling

[53:49] units you get a assessed value for that amount of acres.

[53:54] So when it comes to ballot tabulation each vote will be tabulated that is

[53:59] received as either yes or no. Ballots are weighted according to the property

[54:04] owner's proportional financial obligation, which in this case is the

[54:07] proposed assessed dollar amount. Uh, tabulation shall occur in a location

[54:14] accessible to the public and by an impartial person designated by the

[54:18] agency. In this cl was the clerk of the clerk of the board. The assessment

[54:23] district will be will not be created if a majority protest exists. Uh for the

[54:29] purpose of this majority protest exists if the number of ballots submitted in

[54:32] opposition exceed the ballots submitted in favor of the assessments.

[54:40] So the requests upon uh tabulation option A if the yes votes exceed the no

[54:47] votes then it requested that the approve the engineers report approve the

[54:52] assessment di diagram declare the board of supervisor intent to levy and collect

[54:56] assessments direct the clerk of the board to record the notice of assessment

[55:01] with the clerk recorder approve the formation of the assessment district and

[55:06] imposition of assessments approve the odd 308 form estab Establishing a budget

[55:11] for assessment district. This requires a four-fifth vote.

[55:15] Or option B, if the no votes exceed the yes votes, then the Goan Village

[55:21] uh land Landscaping Lightning Assessment District number one is not formed.

[55:27] Uh thank you. And just as a reminder, if anyone has any outstanding ballots, they

[55:31] can be submitted before the end of the meeting. So,

[55:43] all these things listed, none of that happens.

[56:05] must be received by the clerk by the end of testim public testimony. Any ballot

[56:09] received after the end of public testimony portion of this hearing will

[56:14] not be considered during the tabulation of the assessment ballots. Do we have
