[2:35] Thank you.
[2:36] All right.
[2:40] Next item on the agenda is a public hearing item.
[2:44] It is for subdivision 2025-009
[2:48] and tenant parcel map for TPM 2025-168.
[2:56] The recommendation is that the Planning Commission adopt resolution number 4558 approving
[3:03] subdivision 2025-009 and TPM 2025-168 to authorize the subdivision of an existing 13.56 acre
[3:16] parcel a lot into two separate lots.
[3:20] Tonight we have a presentation from Jonathan Kwan,
[3:23] Senior Planner Consultant, Jonathan.
[3:28] Good evening, Chair Mason,
[3:30] fellow members of the Planning Commission.
[3:31] My name is Jonathan Kwan,
[3:32] I'm with CSU Consultants,
[3:33] and I'll be presenting the application
[3:35] for subdivisions 2025-9
[3:37] and 10 different parcel map 2025-168.
[3:42] The project site is 1100 Puancy Avenue
[3:44] and 11-01 Bell Avenue. The request is to approve the subdivision and tentative
[3:51] parcel map.
[3:58] I don't have control of the slideshow.
[4:09] I'll just say next slide.
[4:11] The request is to approve a subdivision and tentative parcel map to subdivide an
[4:17] existing 13.56 acre site into two lots. There is no construction or demolition
[4:22] proposed with this project. Next slide.
[4:26] The site is zoned industrial and also has a general
[4:30] plan land use designation of industrial. The existing site consists of two existing industrial
[4:36] warehouse buildings, approximately 305,000 square feet of industrial warehouse, including its
[4:42] associated parking and other improvements, all of which were improved back in 2022. The site is
[4:50] by or accessed by Bell Avenue and Valencia Avenue and about the 55 freeway.
[4:58] Next slide.
[5:00] Surrounding uses are generally industrial uses to the southwest and southeast. We have industrial
[5:07] uses. And then to the northeast, we have a vacant site. And then to the northwest, we have
[5:13] the 55 freeway. Next slide.
[5:18] The proposed tentative parcel map would divide the existing property
[5:21] into two. In red, we have parcel one in approximately 6.38 acre site or property. And in green,
[5:29] we have parcel 2 and approximately 7.16 acre parcel. Both parcels would maintain access to
[5:40] public roadway with parcel 1 being accessed from Bell Avenue and parcel 2 being accessed
[5:47] from Valencia Avenue and that is shown in orange on the slide here. In purple we have existing
[5:55] getting gates that restrict both vehicular and pedestrian access and this restricts access
[6:00] to the truck, truck yards associated with the existing industrial buildings.
[6:09] Effectively the proposed subdivision would separate the existing buildings onto two separate
[6:14] parcels. It includes a variety of easements including utility easements, road drainage, rail
[6:21] road and public agency easements, and they are also proposing easements for drainage and
[6:27] emergency access.
[6:29] The code requires CCNRs for parcels with shared access and infrastructure.
[6:36] So as conditioned, the CCNRs will include but is not limited to provisions for access,
[6:42] ongoing maintenance, drainage facilities, and parking.
[6:45] In terms of code compliance, the proposed center-forcel map complies with code and this
[6:51] subdivision map act with the exception of parking next slide.
[6:58] The proposed subdivision will result in a deficit of five parking spaces on parcel two.
[7:05] To address the parking deficiency, there are options written into the conditions of approval.
[7:11] The first option, the applicant can install five new parking spaces on parcel two and show on the site layout that it can still accommodate safe truck movements.
[7:24] In option two, they can apply for a joint use parking or shared parking agreement to share parking across property lines.
[7:32] This agreement would need to be recorded to, excuse me, to ensure that there's sufficient parking in the future.
[7:41] In terms of CEQA, the proposed project is categorically exempt under SQL Guidelines Section 15315.
[7:49] This is class 15 for minor land divisions.
[7:52] The proposed project divides a single parcel into two parcels, two conforming lots with no construction demolition or physical alteration of the site.
[8:01] Next slide.
[8:04] With that said, staff is recommending that the planning commission adopt resolution
[8:08] number 4558 for subdivision 2025-9 and tenant parcel map 2025-168 subject to the findings
[8:17] and conditions contained therein.
[8:20] Next slide.
[8:22] That concludes staff's presentation.
[8:24] I also want to note that Mike Sylvie from the applicant team is here in the audience in
[8:28] case there are additional questions.
[8:33] So before I open the public hearing, does anybody have any questions for staff?
[8:40] To the chair.
[8:41] What's the current status of the buildings, are they occupied, or are they still vacant, is there a tenant?
[8:49] I do not have background information on that, but the applicant is here to answer if there is information to provide.
[8:59] I am just curious.
[9:02] There are no other questions for I open the public hearing, we can invite the applicant up.
[9:07] I have a couple questions. Okay. What's causing this to be subdivided at this time?
[9:13] I believe that they are just when it was originally approved, it was meant to be subdivided
[9:22] at that time and they are basically moving forward with that process now.
[9:28] I think with that, you know, I think that's a newer building that we have to solve for the
[9:31] parking. I get that it has to be the code, but how has that not been done as part of this
[9:36] just before coming to this point.
[9:38] Before subdividing it, the parking would have complied.
[9:41] It's just when it was divided into the parking did not separate exactly in half based on the square footages of the building.
[9:53] I just seem like we knew we had to solve for it, maybe it could have been built that way, but I don't think the five spaces will be a deal breaker to this.
[10:00] Thank you. Right. No questions. Okay, open the public comment. And with the applicant like to come up and speak. Or ask, answer some questions.
[10:16] Thank you, Chairperson. Yeah, we're just looking forward to getting this moving. Into the final parcel map question. I think that Commissioner Higuigi had asked was whether or not the buildings are currently occupied. They aren't, but they're working on, on tenants.
[10:32] there and some of the reasons for the split is either to allow for leases to different buildings or potential sales as they opportunities arise for the owner.
[10:47] Any other questions?
[10:49] Anyone else?
[10:50] I'm clarifying questions.
[10:51] All right, we have any.
[10:52] Thank you.
[10:53] Thank you, sir.
[10:55] Any request to speak on this item?
[10:58] Chair there, man.
[11:00] Thank you.
[11:03] So I'm going to close public comments and bring it back to the commission for deliberation.
[11:11] Any additional thoughts?
[11:14] I'll make motion to approve as drafted for staff's recommendation.
[11:18] We have a second.
[11:19] A second.
[11:20] All right.
[11:21] So the motion and a second.
[11:24] Vera, you want to go ahead and do a roll call.
[11:27] Commissioner Higuichi.
[11:29] Aye.
[11:30] Commissioner Golo.
[11:31] Aye.
[11:32] Commissioner Deltit.
[11:34] Aye.
[11:34] Chair Pro Temco-Zach and Chair Mason.
[11:37] Aye.
[11:38] Motion passes 5-0.
[11:40] Thank you.
[11:40] All right, great.
[11:41] Thank you.
[11:41] Congratulations.
[11:42] Thank you for coming in.
[11:46] All right.
[11:47] The next item on the agenda is a regular business item and it's going to be the 2026 mid-year
[11:53] in review.
[11:54] From the Community Development Department and the recommendation is that we receive and
[11:58] file this report and we have a presentation from Assistant Planner, Angela for Dolphie.

[24:11] and the project is currently under construction.
[24:14] Thank you, commissioners. That concludes my presentation and I'm available for any questions.
[24:21] Wow. That was great presentation.
[24:25] Any comments from my fellow commissioners?
[24:28] Excellent. Does it?
[24:31] I have some questions, not comments.
[24:35] Maybe for me, who's newer, can you explain with plan check review and entitlement review?
[24:38] Are you sure? Yeah. So when something is in the entitlement review,
[24:43] that's when it's coming into the planning division and reviewed by the planners first and it is
[24:48] brought, you know, before you guys, before the planning commission, or before city council.
[24:53] When something is going through plan check, that's when they're submitting for their building permits.
[24:58] And so it's already most likely been reviewed.
[25:00] By planning commission or city council. And they're in the building permit process. I don't know if staff is anything to add but.
[25:11] If I may, I would just, I would just add that not everything needs to be reviewed by the planning commission or the city council certain things are entitled by right but the entire process ensures that that they meet the standards of that regardless. So you know if they're administratively approved. There's there's typically still some sort of a process there before they move over to building and submitting for their building permits. Thank you.
[25:33] A couple other questions that one you showed on Newport that was approved in 2018, the dentist, do we know why it was delayed?
[25:41] I don't know exact reasons. There's been various issues over time.
[25:48] Yes, clearly there's been various delays. It was back in 2018 because of the size of the lot or the way that the lot is configured.
[26:00] the plans didn't necessarily meet what was being built out on the site.
[26:06] There was also, I believe, some changes in owners during that time.
[26:10] So there were some delays there, delays with also with utilities, getting utilities set up as well.
[26:21] So there's been a slew of delays, but the city has been working side by side with the owner,
[26:27] the current owner just working with them to see what we can do to reduce any
[26:31] roadblocks to finishing that project.
[26:36] One more question. In the parklets that are
[26:38] on that are going to open an old town. So we're going to issue temporary use
[26:41] permits before they become permanent. I've asked this before when I'm going to keep
[26:46] basket. Do we have any requirement that people who have strollers and dogs and
[26:49] whatnot on the city own parklets can bring their dogs onto that space?
[27:06] I have no questions at this time, I'm excited to see some of the future projects coming for the commission, but man, you guys are busy.
[27:17] One thing I appreciate about this presentation and about the developments going on in the city is that it is going through every corner of the city.
[27:24] There really wasn't one area that has been left out as far as our revitalization and the investment in our city.
[27:34] So I think that's a testimony of our code.
[27:39] That, you know, it's not just one area that is attracting the investment. It's all areas.
[27:43] And then I think it's testament to you guys and your hard work. So good job.
[27:53] It's amazing. A lot of projects out there. The in and out, that makes our third in and out.
[27:59] It's awesome. Keep those retail dollars flowing in. I am worried about the queuing there.
[28:04] So just to heads up, please do us a favor and make sure we explain that to the citizens of Tussle pretty well.
[28:11] But that's awesome. And then also that's, you know, we've got two cascos in Tussle and so that's kind of the envy of the county.
[28:18] I think, and it's great to see that they're re-investing or doubling down into us, and it'd be a great job.
[28:22] It's pretty amazing, actually.
[28:26] Go, Tim, Kozak.
[28:27] To chair, yeah.
[28:29] Great presentation, and I like how the map tracked kind of like going through there.
[28:36] That was cool just to track that, and yeah, I agree.
[28:41] I mean, they're just projects going everywhere, and that was the first thing I thought too,
[28:46] when I saw the end and out, I was thinking of the Q and potential traffic, but it's exciting
[28:55] to see all the development in just, yeah, there's a lot of stuff going on, so good job.
[29:07] This is my 10th year on the planning commission, so I'm having flashbacks to the dental office.
[29:12] I've been tracking that one like nobody's business
[29:15] because I have to drive through there.
[29:17] There's been a lot of drama around that.
[29:19] So very happy to see that that is shaking loose.
[29:23] Takaria Oy, I also have a little flashback about that.
[29:27] That was when we were not here in Chambers
[29:30] and we were having our meetings from home.
[29:35] I may be thinking of a Red Hill Takaria,
[29:38] but wasn't there a drive through?
[29:40] And then at what point can you just decide not to knock down and use and I mean it really is a
[29:48] Someone who worked for Taco Bell for a very long time. I appreciate the old Taco Bells
[29:53] But they also look like old Taco Bells
[29:56] So I'm just curious as to what that process is that you go from
[30:00] I'm having a brand new building too. Another one, an existing one.
[30:06] Chair Mason, yes. Your memory is correct. This was, I previously approved for a brand new building.
[30:14] The applicant was going to demolish the Taco Bell building and create another drive-through building to suit his business.
[30:23] Due to financial reasons, he needed to pivot and decided to use the existing building.
[30:30] It's a pre-existing legal building, so he is able to use the site.
[30:37] He's not making any changes, so he is able to use the building or he's making some minor changes that are allowed by code.
[30:43] But he's going to be used the existing site as it's proposed and just do a lot of rehabilitation to the building.
[30:51] and use the building for TACRE alloy.
[30:55] So it'll be, hopefully we're hoping
[30:57] to see that under construction, hopefully
[30:59] and by sometime next year.
[31:01] So that's just going, that's, there's no additional,
[31:04] I'm just, and again, God bless every small business owner.
[31:09] But it is, it's kind of enchambles to be honest.
[31:13] So when you say it's rehabbed, like I'm sure
[31:14] that it's gone through the appropriate plan check
[31:17] that even the parking lot is, anyway, you know what I'm saying, it's messy, it's not at all
[31:26] what we had spent, oh, by the way, it was probably one of the longest planning commission meetings
[31:30] we had had because we had lots of discussion about the drive-through. So anyway, that is just my question
[31:36] as much as it is a comment, and I've been wondering where that Popeyes was going to pop up because it's
[31:43] and nothing over there on the corner.
[31:45] And then tell us what the, we're in an outfailing,
[31:48] my son is a manager there.
[31:50] What's the plan for an in and out?
[31:53] Because I mean, you can say I wanna be there,
[31:55] but you have lots, very exciting,
[31:57] but lots of questions on queuing,
[31:59] and that is an already very, very jammed up.
[32:04] Right, so we just received that application,
[32:06] I would say about a month ago.
[32:09] It just started, the review is gonna be,
[32:12] We can, the first review is going to be concluding in the next week or two.
[32:17] So there are comments, the applicant has been working, did a lot of pre-work, working closely
[32:24] with our traffic division and the planning department to see what requirements were necessary
[32:32] to incorporate into the plans.
[32:34] So we're reviewing that, we're looking at queuing, we're looking at how the traffic runs,
[32:40] are how the traffic flows as well so our eyes are on it but they're they have
[32:46] some comments so we'll be looking forward to their second review hopefully in
[32:51] the next couple months. Okay so what's there right now? Right now it's a FedEx
[32:57] building. Okay exciting and then last comment I know that we have it still to do
[33:05] the public comments but it's so nice to see all this development on the side of the
[33:09] city. Again, it's been a decade and I've seen a lot, this is the first time I've really seen
[33:17] the focus on Red Hill over. And you guys are very busy, so thanks for all your hard work.
[33:24] So I will, unless there are any other questions?
[33:28] Through the chair.
[33:29] Yes.
[33:29] I forgot to ask regarding that dentist's office that I was approved back that we were talking
[33:36] about. Is there a proposed finish date, completion date on that now?
[33:44] I can tell you it's closed. As Raymond alluded to, there have been some struggles with the
[33:50] electrification of the site, and so we have been working very closely with our Public Works
[33:54] Department and Southern California Edison in order to facilitate that. That really is the last
[34:00] step to get them electrified, then they can test their elevators and just close out all of their
[34:05] permit. So they are very close. We just need to get them across the finish line with Southern
[34:11] California Edison. We've had a moving date for that and it hasn't been firmed up yet.
[34:18] We are still very hopeful that it will be this month.
[34:22] Thank you.
[34:24] All right. I'll go ahead and open it to a public comment.
[34:27] Vera, are there any comments for this?
[34:31] Chair there are none.
[34:33] Thank you.
[34:33] Okay, and if no one else would like to speak, I will close this.
[34:38] We will not be taking a motion, as this is just a receive and file item, but great job
[34:46] on the presentation and great job too, staff.
[34:49] We can move on to other business, Alexa, our community development director.
[34:56] Thank you very much, Chair, I apologize, I don't know why I have so many problems getting
[34:59] in this button to turn.
[35:00] The last council meeting, the council considered a couple of items. The first was moving forward on the process for the Clearwater testing legacy project, which is the senior project that this board reviewed a couple meetings ago. So that is moving forward and on its way through the development disposition process. It's got a couple more steps to go, but this was a nudge forward. And then also proceeded to direct staff to move forward with a second
[35:29] around the competitive process for 44 acres that test and legacy is only just south of where the flight
[35:35] development is so that kind of swath of land that forms kind of a large L under there. So that will
[35:42] move forward with the real property division and looking forward to seeing where that goes as I'm
[35:46] sure you are will be bringing things forward to you here at the legacy in the next couple of years
[35:50] pretty rapid fire I imagine. That's my report. Thank you.
[36:02] Tim, who is that?
[36:03] No comments from you tonight.
[36:05] Thank you.
[36:06] I'm sure you can move out.
[36:08] One comment first.
[36:09] Thanks, staff for that presentation.
[36:10] I was going on a test and it's awesome.
[36:12] I think if you just did put that on social media
[36:14] with Angela's narration, if these people ask what's going on,
[36:17] it could be like a cool part of our outreach.
[36:19] Very cool.
[36:20] I know we just had some talk about another chain burger
[36:22] restaurant in Old Town.
[36:24] For anyone watching this, you can always check out American Grub
[36:26] and Peters Gourmet.
[36:28] Shout out to our local businesses.
[36:30] Yeah.
[36:30] Yeah.
[36:33] No comment. I'm going to rewind because I've realized I didn't ask the question of the beer garden. May I put that in my comments. It's just. Do we have an operator or are we just building it?
[36:48] We do have an operator. It is a submitted proposal. Yeah. So the city is working with them to, you know, try to facilitate this because it is a little bit different than what we've tried before. But yes, there's an operator.
[37:00] My other comment was actually going to be I was really thinking after our last meeting about everything going on over in legacy and development and traffic and roads and I was driving and now I'm thinking, oh my god, it's all over here now.
[37:16] So I am curious if there has been any further discussion or movement on parking here in the old town area.
[37:26] yeah.
[37:30] Broadly speaking we talk about it all the time. Has there been a specific movement
[37:35] to change anything that we're doing at this point? No. But potentially in the future.
[37:41] And that's a parking garage, correct? Is that on the table? Correct. The city is a partial
[37:48] owner of the parking structure that exists and where that goes in the future is I think
[37:54] still a big conversation. It's really interesting, especially as we look to do these infill parcels
[37:59] and add in to the vibrancy of old town what what that means. So we're certainly working through
[38:04] the projects very closely with our traffic engineer and trying to understand how we can make all of
[38:09] this work roundabouts.
[38:15] Okay, so I'll go ahead if no one else has any more comments. I'm going to go
[38:21] had an adjourn tonight's meeting and the next regular meeting of the planning
[38:26] commission is scheduled for Tuesday, September 22nd. Thanks everyone.
