Call the meeting to order. City of
[0:08]
University Heights City Council meeting
[0:10]
today, September 8th, 2026. Welcome
[0:14]
everyone. Um I call the meeting to order
[0:18]
and for council are present. Uh Doug
[0:21]
Swales is not present tonight. Um so
[0:25]
with that, we'll go to approval of
[0:27]
minutes. the August 11th minutes. Um,
[0:32]
the minutes were circulated by our city
[0:35]
clerk. Are there any additions,
[0:36]
corrections, or objections
[0:40]
to any of the minutes? Hearing none, the
[0:42]
minutes are approved by unanimous
[0:43]
consent. Thanks everyone. We'll go on to
[0:46]
administration or public input. We have
[0:50]
some members of the public uh in would I
[0:54]
mean other than the the Johnson County
[0:56]
officials. Would anybody like to speak
[0:58]
to the C? Okay. Why don't you come up
[1:00]
here to the music stand?
[1:05]
Welcome. Can you state your name and
[1:06]
address?
[1:06]
>> Yes, I'm Aaron Shrivever and I live at
[1:08]
100 Sunset Street. So, I wanted to thank
[1:10]
you all for the wonderful work you're
[1:12]
doing for the city. Of course, I don't
[1:13]
come on the day to tell you what a
[1:15]
wonderful job you're doing. I'm here to
[1:16]
ask for your help. Um, I am looking for
[1:19]
some followup on the construction,
[1:21]
parking, and new short-term rentals at
[1:22]
104 Sunset Street. Um, my husband and I
[1:25]
sent emails last week, and we really
[1:26]
appreciate the responses from Mayor
[1:28]
Prom, and Miss Dwire, thank you for
[1:29]
responding to our emails. We understand
[1:31]
that there's going to be a report that
[1:33]
was generated, and we're looking forward
[1:34]
to hearing about that. um we're uh about
[1:37]
this uh you know R1 single family
[1:39]
residence that is now advertised as a
[1:41]
two-bedroom RB Airbnb and is alluding to
[1:44]
the fact that there will be uh three units in this uh single family
[1:48]
home. So we're looking for information
[1:50]
is three units actually legal what you
[1:52]
know what what are the legal
[1:53]
implications of that? What are the
[1:54]
rules? Um and looking forward to hearing
[1:57]
what you have to say there. I also um
[1:59]
understand that the uh owner told uh
[2:02]
Terry Gorks that uh he was going to
[2:04]
widen the the driveway by one to two
[2:06]
concrete pavers but in fact added two
[2:08]
parkings two to three parkings but if
[2:10]
that is true we're just wondering if
[2:12]
there what's the status on the
[2:13]
permitting and if you misrepresent your
[2:15]
intentions as city are there any
[2:17]
implications for that so thank you very
[2:18]
much for the work that you're doing and
[2:20]
we appreciate it.
[2:21]
>> Thank you Erin. Now, our city building
[2:23]
inspector will be on Zoom.
[2:25]
>> Okay.
[2:26]
>> And he's coming in, but not right at the
[2:29]
He had something to do. And I'll text
[2:31]
him and see what time he's come. Could
[2:33]
you
[2:34]
>> just coming in right now?
[2:36]
>> Yeah.
[2:36]
>> Thank you, Baron.
[2:39]
>> Would anyone else like to speak to the
[2:41]
council tonight? Oh, Brenet. Welcome,
[2:44]
Brennan.
[2:44]
>> Thank you.
[2:45]
>> Bren's a former council member.
[2:47]
>> That is true. Now I'm an empowered
[2:49]
citizen with a folder.
[2:53]
Look out. Uh, Brennan McGrath, 327 Koser
[2:56]
Avenue. Um, I'm also here seeking some
[2:59]
assistance. Um, our next door neighbors
[3:02]
at 325 Koser uh were residents there for
[3:06]
many years. Uh, they've moved out about
[3:08]
four years ago and have converted the
[3:10]
house into a rental. We're on our fourth
[3:14]
uh group of of renters. They've had uh
[3:17]
multiple issues at the house. Um, not to
[3:21]
get too deep into the history of it, but
[3:23]
uh, I always tried to lend a hand over
[3:27]
there. Um, they were raising a young
[3:30]
child and, uh, the father was away quite
[3:32]
a bit. Um, and so I I tried to assist
[3:35]
and the regular maintaining of the yard
[3:38]
and keeping the snow cleared on the
[3:40]
sidewalk and the driveway. Um, but since
[3:42]
it's been a rental, um, I've tried to
[3:45]
kind of give the new renters the lay of
[3:47]
the land and whatnot, but it's become
[3:50]
very apparent that this house, uh, is
[3:52]
just never really maintained at all. And
[3:55]
so, the the newest occurrence of that
[3:58]
unfortunately led us into a situation,
[4:00]
which brings me here tonight. Um I
[4:03]
believe it was the last full week of
[4:05]
June. Um the owner uh did stop by and
[4:09]
notify us that they were going to be
[4:11]
redoing their the main sewer line into
[4:13]
the house. And uh being a visual person,
[4:16]
I'll just leave you or show you what we
[4:18]
were left with um with that project. Of
[4:22]
course, they unearthed all the clay
[4:24]
that's underneath our top soil here and
[4:28]
kind of left it there and I became
[4:30]
concerned and asked her through text
[4:32]
messaging if someone was coming back to deal with the landscaping and she
[4:37]
said she was told by Rotorooer that she
[4:39]
needed to let the ground settle for at
[4:41]
least a month or two uh before any
[4:44]
landscaping was done. Um, so I ended up
[4:48]
uh after the we kind of got into that
[4:51]
second month. Um, that's when I
[4:53]
contacted the building. Actually, I
[4:55]
reached out to Tim. He directed me to
[4:56]
the building inspector, which was
[4:58]
helpful. He basically came over and
[4:59]
looked at it and said there was really
[5:01]
nothing he could do. Um, there was
[5:02]
really no violations. U, my main concern
[5:06]
was uh just the aesthetics of the
[5:08]
overall project and where it where it
[5:10]
lie. And um there was one one item in
[5:13]
particular which I'll get to, but he he
[5:15]
basically said there's really nothing I
[5:16]
can do. Um you know, if there were some
[5:19]
kind of erosion situation here, uh maybe
[5:21]
I could I could talk to him about that,
[5:22]
but we're on top of a hill, so that
[5:25]
that's not going to be a problem. Well,
[5:26]
the rain came and it all just washed
[5:29]
into the sidewalk in the street. So I
[5:31]
took some pictures and and sent them to
[5:33]
the inspector. He notified her and of
[5:36]
course 3 weeks transpired. He gave her a
[5:39]
timeline to mitigate this uh this
[5:42]
erosion problem and this was her
[5:44]
solution. Um our orgi uh Lily here is
[5:48]
inspecting the work, but it was
[5:50]
basically two sandbags and two wooden
[5:53]
blocks. Um which in no way was going to
[5:57]
mitigate any erosion at all. But again,
[6:00]
then when I talked to the building
[6:01]
inspector, he says there's actually
[6:03]
nothing in the ordinance that says
[6:05]
exactly how they need to mitigate it. So
[6:08]
this was her attempt and that was
[6:09]
basically the best that uh she could do
[6:12]
and and I guess that was going to be
[6:13]
acceptable. Um luckily we didn't get
[6:16]
that's kind of when the dry season came
[6:18]
and we didn't get any rain. But um she
[6:21]
did end up having a company come and do
[6:23]
um landscaping. And basically what they
[6:25]
did is they tilled up the soil, threw
[6:28]
down a bunch of seed and some straw. Um
[6:31]
and then they threw down rock which
[6:33]
around the area that I was most
[6:34]
concerned about which are these drainage
[6:37]
uh cleanouts that are in front of the
[6:39]
house. And um these are actually being
[6:43]
used in several projects that I've seen
[6:46]
uh around the city. Um, but typically
[6:48]
what people do is they then cut those
[6:50]
off at the ground level so you don't see
[6:52]
them. Um, so I saw this and thought,
[6:56]
well, maybe she's going to plant shrubs
[6:57]
around it to kind of hide that. Um, I
[7:00]
talked to the city inspector about it
[7:02]
and that's what brought me here tonight
[7:04]
is that he said there was nothing in the
[7:05]
ordinance that said that those that
[7:08]
those need those cleanouts needed to be
[7:10]
cut. They could just stay at that
[7:12]
length. That there was nothing in the
[7:13]
ordinance that he could do to enforce
[7:16]
that. So, I don't I I leave it to you to
[7:19]
uh come up with something creative if
[7:21]
it's an aesthetic issue. U but as I
[7:24]
mentioned, um they tilled up um the
[7:26]
ground and they put down the seed, which
[7:28]
will be great. Um they're not watering
[7:30]
it or anything, so we're probably going
[7:32]
to have to wait till spring to see any
[7:34]
new grass. But uh my main concern are
[7:38]
those cleanouts. And it's unfortunate
[7:40]
that there's not something existing in
[7:42]
the ordinance. But I guess I would chalk
[7:44]
it up to common sense and how people
[7:46]
would aesthetically pleasing that um I
[7:49]
guess that that's not the situation in
[7:51]
this in this moment. And what she's had
[7:55]
done is had rock put down uh around the
[7:58]
pipes. So now nothing will grow. And
[8:01]
unless that uh you know she was to dig
[8:04]
up that rock and plant some shrubs
[8:05]
around it at a later date, I don't know.
[8:08]
But I I don't at this point really want
[8:09]
to get more involved in this situation
[8:11]
than I already am. And so I I leave it
[8:14]
to you and and hopefully by bringing
[8:16]
this to your attention. I don't know if
[8:18]
we can mitigate this situation, but
[8:20]
maybe future situations um would require
[8:23]
a change. So I'll leave that to you.
[8:26]
Thank you for the time that you given.
[8:28]
>> I appreciate you explaining it to
[8:29]
council. We did try to go through
[8:31]
channels that you know and I think we
[8:34]
can uh talk with Troy, our city
[8:36]
administrator, too, and we'll take it
[8:38]
over from here now that we're aware
[8:41]
>> of this and maybe Brian Jensen can help
[8:43]
too. And I don't know if it's Steve
[8:45]
Ballard, our city attorney, has any
[8:49]
>> any issues with that at all, but uh
[8:52]
we'll work on it from here on out. Thank
[8:54]
you.
[8:55]
>> Yeah. And from my experience, I know a
[8:56]
picture says a thousand words. So u
[8:59]
hopefully that helped as well.
[9:00]
>> It does help. Thank you very much.
[9:04]
>> Okay. Does anyone else like to speak to
[9:06]
the council tonight?
[9:09]
>> Okay. Now, uh we have visitors here from
[9:13]
Johnson County. The officials, this is
[9:15]
their annual visit and uh we just are so
[9:19]
grateful that you're coming tonight. I
[9:21]
see we've got, you know, four officials.
[9:25]
Does anyone want to start talking?
[9:27]
Scott, you want to start?
[9:29]
>> Sure.
[9:29]
>> Well, thank you.
[9:30]
>> Yeah. Um, five years from Well, when we
[9:33]
hit our fifth year, I plan to bring
[9:34]
presents for everybody
[9:36]
>> to commemorate.
[9:37]
>> Just make sure everybody knows you.
[9:39]
>> Oh, yeah. Scott Finson. Um, I'm the guy
[9:42]
who you all send money to every year,
[9:45]
several times, uh, to keep things
[9:47]
running. So, I'm the treasurer. Um, so,
[9:51]
thanks for having us. We started this a
[9:52]
couple years ago. uh want to make sure
[9:54]
we get out to hear what you guys want to
[9:56]
tell us as much as we can tell you where
[9:57]
things are going in the county. Um one
[9:59]
thing that happened two weeks ago is we
[10:00]
changed the name of our eponym to Mural
[10:03]
Lulu Johnson. Um I don't know if any of
[10:05]
you got to come out to that ceremony,
[10:06]
but it was actually quite nice and I
[10:08]
just thought I'd bring this for you guys
[10:09]
to keep. Uh but this is the history of
[10:12]
the person who our F&M's after.
[10:14]
>> Oh, thank you.
[10:14]
>> Yeah, for sure. If you have a coffee
[10:16]
table somewhere, feel free to slap that
[10:17]
on there. Enjoy. Um, big news from
[10:20]
treasur's office. Our electronic updates
[10:24]
of payments has become fully realized.
[10:27]
You can now set up an account on Iowa
[10:29]
tax and tax. You can set up uh payments
[10:33]
by month as long as your full taxes are
[10:35]
paid. And we do aes to pull from your
[10:37]
account without you doing anything.
[10:38]
It'll update the next year as long as
[10:40]
you keep your your information current.
[10:42]
And so we're fully in the 21st century
[10:45]
since uh I've been at the job for 17
[10:47]
years. So pretty proud accomplishment
[10:49]
for that. Um and the auditor may talk
[10:53]
about this more but just for you all
[10:55]
just like for us just be aware we talked
[10:57]
about this last year that's coming to
[10:58]
more fruition. Uh the state's putting
[11:01]
some rather
[11:03]
uh hard collars on local governments to
[11:07]
be aware of. Uh are the amount we can
[11:09]
ask for is collared and then also the
[11:12]
amount we can carry forward is now being
[11:13]
collared too. So just have your staff
[11:16]
look at that. make sure they're aware of
[11:17]
those uh hindrances moving forward
[11:21]
financially for all of us. And with
[11:23]
that, I'll pass on the next person.
[11:25]
>> Thank you, Scott.
[11:27]
>> Hi, Julie.
[11:28]
>> Well done. Hello. Um I'm Julie
[11:32]
Personsons. I'm the county auditor. Uh
[11:34]
if you didn't know, there is an election
[11:37]
in less than two months. Um, we will
[11:40]
start voting on October 14th and we will
[11:43]
have voting available every single day
[11:45]
of the 20 days, every Saturday, Sunday.
[11:47]
Um, we're doing three evenings. We're
[11:49]
going to have our drive-through open.
[11:50]
We're going to have nine different
[11:51]
satellites out in the county. So, we're
[11:53]
giving everybody the opportunity to vote
[11:55]
in person this year. Um, I know a lot of
[11:57]
people are very, very concerned about
[11:59]
what's going on with the mail and the
[12:01]
potential for the mail and all ballot
[12:03]
issues. Um, so if people are really
[12:06]
worried about that, they can vote early
[12:08]
in person. Um, again, our drive-thru,
[12:10]
you can sit in your car, so you can you
[12:12]
don't have to be around people if it's a thing like that. Um, also, um,
[12:19]
we're going to have our Dropbox open 24
[12:21]
hours a day. It is under camera
[12:23]
monitoring. So if people don't trust the
[12:26]
mail, they don't want to put it back in
[12:27]
the mail, if they have a mail ballot,
[12:29]
they can drop it off at our building
[12:31]
right in the dropbox and know that that
[12:33]
is going to go straight into our office.
[12:35]
So um as you're talking to people,
[12:38]
everybody's been talking about it. The
[12:39]
more we can as elected officials help
[12:42]
each other spread the word. Um if they
[12:44]
have questions, stop by our office.
[12:46]
We're always willing to talk to people.
[12:48]
Um, but we're really going to be here
[12:50]
and try to make sure everybody gets the
[12:52]
chance to vote for September voting. So,
[12:55]
um, big election this year will be a lot
[12:57]
of fun. Uh, other than that, as Scott
[12:59]
was saying, uh, a lot of a lot of
[13:02]
changes with property taxes that also
[13:04]
changed some of the laws around TIF. Um,
[13:07]
we are waiting on the Department of
[13:09]
Management to finalize some stuff and
[13:10]
then they're going to be giving us
[13:11]
training on it. So, by the time we do
[13:13]
TIF for you guys in December, uh, Tara
[13:16]
will know everything. she'll be able to
[13:18]
work with Mike like she always does and
[13:20]
make sure we can answer the questions
[13:22]
because we want to make sure all of our
[13:23]
towns get all the right tiff money. Um
[13:26]
it's very important because you guys do
[13:27]
really great work with that. So um we
[13:29]
are here if you need us. Um does that
[13:32]
talk?
[13:33]
>> Thank you Julie. And we have Rachel.
[13:39]
Uh Rachel Zimmerman Smith, Johnson
[13:41]
County attorney. Um, I spend more than
[13:43]
my fair share at University Heights,
[13:45]
think you all know, mostly at Maggie's
[13:47]
and Sidekick at this point. Um, the
[13:51]
county attorney's office is very busy.
[13:53]
Um, we had about 3,700 indictable cases
[13:57]
last year. Um, we currently have four
[13:59]
pending murder cases. Um, I know that's
[14:02]
not a sunny way to start. Um, but it's
[14:05]
just important for everybody to know
[14:06]
that we have, you know, very serious
[14:08]
responsibilities. We have a great staff
[14:10]
um that handles it and great
[14:12]
partnerships with local law enforcement
[14:13]
including your own uh chief Chris Acres
[14:16]
who um I see at least once a month at
[14:18]
our chief's meeting and really
[14:19]
appreciate having him um be a part of
[14:22]
it. Uh I am also very busy um
[14:25]
representing my office represents all
[14:27]
folks back here and every county
[14:29]
department and the board of supervisors.
[14:31]
So as you can imagine that that
[14:33]
continues to keep us busy. Um, so I just
[14:36]
want to thank you for what you all do
[14:38]
and hope that you know my office is
[14:40]
always here to help. I'm really proud to
[14:42]
serve all of you and you know where to
[14:44]
find me.
[14:45]
>> Thank you very
[14:54]
Hey guys, Brad Con, Johns County
[14:55]
Sheriff. Um, I'm supposed to watch you
[14:58]
for some reason. That's what I was told
[14:59]
before I came in here.
[15:02]
>> I can't tell you where my information
[15:03]
came from. Um, normally I just stand
[15:06]
here and tell you how good of a job I'm
[15:07]
doing and I could certainly do that.
[15:09]
But, uh, the other big thing I have in
[15:11]
my world thinking bird is we're trying
[15:12]
to get a bond referendum passed for a
[15:15]
sheriff's office in jail. So, in
[15:17]
addition to everything else going on in
[15:19]
the midterms in November is the the
[15:21]
bond. Uh, as a lot of you know, the
[15:23]
county's tried this before. The last
[15:25]
bond referendum in 2013 for a justice
[15:27]
center that was about a 43.5 million
[15:30]
bond that failed to hit 60%. It got 54%
[15:35]
of the vote, but wasn't enough to get to
[15:37]
the 60. So, here we are again um 13
[15:40]
years later trying a new project, kind
[15:42]
of a different angle. This time, now a
[15:44]
standalone sheriff's office and jail to
[15:46]
be located just west of here on IWV. Uh
[15:50]
the jail component of the building would
[15:52]
have 140 bed capacity and then the
[15:54]
sheriff's office piece of it would be
[15:56]
the remainder of what my operation does.
[15:59]
Um, I have 112 employees at the
[16:00]
sheriff's office and a little less than
[16:03]
half work in the jail. Everybody else
[16:05]
does the rest of the work for the
[16:06]
sheriff's office. So, we're a big agency
[16:08]
and it's important to know that when
[16:10]
you're talking about this or hearing
[16:11]
about or have questions that it's not
[16:13]
just the jail. This isn't a bond
[16:14]
referendum for the jail. It's the
[16:16]
sheriff's office and the jail. Uh, the
[16:18]
price tag on the bond referendum is
[16:20]
$94.5 million. that covers construction,
[16:24]
furnishing, and also um paying back
[16:27]
essentially to the county what they
[16:28]
spent purchasing the property. Uh the
[16:30]
bond would be for 12 years. Um the tax
[16:35]
increase would be $88 per $100,000 of
[16:38]
taxable value. That's very important to
[16:41]
understand. It's the taxable amount, not
[16:43]
your assessed amount. Uh the county has
[16:45]
a great website called Johnson
[16:46]
CountyJailbond
[16:49]
or I can't remember.
[16:51]
Uh there's a tax calculator on there to
[16:53]
look at. So you can look at your parcel,
[16:55]
look at that tax number, put that in,
[16:57]
and that will show you what uh the tax
[16:59]
increase would be. I think on average is
[17:02]
about $20 a month per Johnson County
[17:05]
resident. Um the the idea is to not only
[17:09]
meet the needs that we have right now,
[17:11]
but 30 years, 40 years, 50 years down
[17:13]
the road. Um our current building at 511
[17:16]
South Capital is 45 years old. It's kind
[17:19]
of falling apart around us. We're
[17:20]
currently spending 3.2 million just to
[17:23]
keep it habitable. Um, keep the
[17:26]
structure secure as well as the roof and
[17:27]
the HVAC, but no matter what, that
[17:30]
doesn't address any of the other
[17:31]
operational or growth um or overcrowding
[17:34]
problems that we have. We the jail was
[17:37]
built with 46 beds. Uh we have 92 beds,
[17:41]
but that doesn't mean we hold 92 people.
[17:43]
My operational capacity is 65. So to
[17:46]
manage that number, we house out a
[17:48]
county. Right now I have about 40
[17:50]
inmates out of county. Um and last year
[17:52]
we spent about $420,000
[17:54]
on out of county housing. Uh the other
[17:57]
thing I leave with a bit of trivia. What
[17:58]
do uh what do Delaware, Lee, Washington,
[18:02]
Henry, Musketine, Lynn, and
[18:09]
» get up up to seven. What do all those
[18:11]
counties have in common?
[18:13]
>> You get a check from Johnson.
[18:15]
>> That's exactly right. Those are all the
[18:17]
counties I'm housing inmates in right
[18:19]
now because we don't have enough space
[18:20]
in our jail. So, we have to house out of
[18:23]
county. Um, so we're as far away as Lee
[18:25]
County, Delaware County, uh, then
[18:27]
anywhere else we can. That problem's
[18:29]
getting worse because of some law
[18:31]
changes and also over time the jail
[18:33]
population is doing this. We spend
[18:36]
millions in this community in the world
[18:37]
of jail diversion. And a lot of those
[18:39]
things work really, really well. And I
[18:41]
think that's why our day-to-day
[18:42]
population is growing at this rate and
[18:45]
not this rate. And a lot of those
[18:47]
programs really work and we need to have
[18:49]
the capacity for today and 30 years down
[18:51]
the road. So, um you're welcome to come
[18:54]
take a tour sometime. I do tours pretty
[18:56]
regularly if you're ever interested in
[18:58]
coming to see for yourself. You probably
[18:59]
seen some of the signs popping up around
[19:01]
town, but otherwise um happy to answer
[19:04]
any questions you may have sometime.
[19:05]
Shoot me an email. If you want to come
[19:07]
take a tour, let me know. either we can
[19:09]
go through Troy, you can organize it or
[19:11]
something, but welcome anytime. So,
[19:13]
thanks for what you do. Thanks for
[19:14]
having us.
[19:16]
>> Thank you, Sharon.
[19:19]
>> Any questions for any of them?
[19:22]
>> Thank you very much for coming tonight.
[19:24]
We really appreciate your annual
[19:26]
reports. Thank you. Thanks again. You
[19:29]
can stay as long as you want.
[19:33]
» Thanks again. So, uh, I see that Terry G
[19:37]
is here now. He zoomed in. And so, if
[19:41]
council's okay, we'll have a report from
[19:44]
Terry. Uh, Terry, can you hear? Okay.
[19:48]
>> Uh, yes. Yes, I can.
[19:51]
>> Can you turn him up a little?
[19:53]
>> I am loud as we can go.
[19:56]
>> Okay.
[19:57]
Well, anyway, uh I'd like you to go
[20:00]
through some of the history of the of
[20:04]
the property owner that people are
[20:07]
questioning, you know, 104 sunset,
[20:09]
whether they're following our ordinances
[20:12]
and what they're doing.
[20:15]
>> Sure. Sure. So, what uh I uh received a
[20:19]
phone call probably three weeks ago from
[20:21]
this gentleman. Uh he was looking at
[20:24]
buying the property.
[20:25]
>> Terry just meant actually here tonight
[20:29]
too. So
[20:29]
>> yes.
[20:32]
>> So So I I went through things with him
[20:35]
and uh at first he was only going to go
[20:38]
ahead and widen his driveway by one
[20:40]
foot. Well, if you know 104 Sunset, he
[20:44]
probably has more u lot frontage than
[20:48]
any property in town. Uh, I think he's
[20:51]
well over 250 lineal feet of lot
[20:54]
frontage. Okay. So, I figured by only
[20:58]
adding a foot to his existing driveway
[21:01]
was no big deal. I And I decided I
[21:04]
wasn't going to mess with the building
[21:05]
permit for one foot. Um, that was
[21:09]
probably two weeks ago. Uh well, when uh
[21:15]
Saturday, two weeks ago on Saturday, uh
[21:18]
they went ahead and they were going to
[21:19]
start doing the work and they added a
[21:22]
little bit more than what was uh we
[21:24]
talked about. He did put a parking pad
[21:28]
in the front yard.
[21:30]
Um so I had stopped there. I was out of
[21:33]
town. I stopped there and uh talked to
[21:36]
the actual contractor who was really
[21:38]
nice. He says, "Yeah, we're just putting
[21:39]
a parking pad there." Uh, and we were
[21:42]
widening out the driveway probably 2
[21:44]
foot instead of 1 ft and they were going
[21:46]
to put a a walking path around to the
[21:48]
back side of the house which would front
[21:50]
on on Melrose.
[21:53]
Um, I said, "Well, you're you're
[21:54]
probably going to need to get a permit
[21:56]
to do this." So, I called up Nick and uh
[22:00]
boom, he went ahead and uh applied for a a building permit. I've
[22:06]
got it sitting here right on my desk. um
[22:09]
ready to approve it. Um he is well
[22:12]
within the 1/3
[22:16]
uh that he can go ahead and pave. I mean
[22:20]
so that's not an issue.
[22:22]
So I don't see an issue with it.
[22:27]
But that's how all this trans
[22:29]
transpired.
[22:39]
Does anybody have any questions on any
[22:42]
of that or be more than happy to to
[22:46]
answer?
[22:48]
>> Um, I guess I'm going to bring up Erin's
[22:50]
question about it becoming potentially
[22:52]
three units in a single family home. And
[22:55]
maybe that's more directly towards Steve
[22:57]
than you. I'm not sure. But what does
[22:59]
that look like if that
[23:04]
It's not. It's I talked to the owner. I
[23:06]
talked to Nick. He's there. Um Nick is
[23:08]
going to use that as a single family
[23:10]
dwelling. Um my understanding he might
[23:13]
use it as a what do they call that? BBO
[23:15]
or whatever. You know, he might rent out
[23:17]
a room. Uh he might rent out the
[23:19]
basement for a short term. He's not
[23:22]
converting it to a duplex.
[23:25]
No way could he convert it to a duplex.
[23:28]
the way that house was built. I mean,
[23:30]
you'd have to put in a separate furnace
[23:32]
to make it into a duplex.
[23:35]
You'd have to provide 1 hour separations
[23:37]
to make it into a duplex. And that's
[23:39]
kind of hard to do when you have an
[23:41]
existing structure,
[23:54]
you know, I I I don't uh I don't get
[23:58]
into a lot of the BROS or whatever
[24:00]
they're called in the rental portion of
[24:02]
it. You know, uh my counterpart Brian
[24:05]
Jensen does. He's very schooled in it.
[24:08]
Um, and I'm sure he would be on top of
[24:11]
it if uh it turned into, you know, maybe
[24:15]
a a uh you know, a unit, a rental unit
[24:19]
of some sort someday. But, uh, the owner
[24:22]
assures me that he's going to be living
[24:23]
there.
[24:31]
I I guess I don't um you know I'm I'm sure the neighbors were wondering
[24:36]
what was going on when they started
[24:38]
seeing uh some of the bushes and and
[24:41]
other things being moved and some dirt
[24:44]
being moved. But, uh, as far as I'm
[24:46]
concerned, he's he's well within the,
[24:49]
you know, requirements for,
[24:52]
uh, installing some some pavers and and
[24:56]
parking. Uh, you know, um, my
[24:59]
understanding was that that quote
[25:01]
unquote parking pad out front was so
[25:04]
they could back up and and actually
[25:08]
drive out into onto Sunset instead of
[25:11]
backing out because you've got cars
[25:13]
coming across Melrose
[25:17]
at a decent speed that he didn't want to
[25:20]
create an accident of any sort.
[25:33]
But
[25:44]
» so I mean I'm more than
[25:47]
>> Oh, sorry. I was going to say thanks for
[25:49]
your explanation on everything. I think
[25:52]
um from my perspective this week, I had
[25:55]
a lot of neighbors uh just come to me
[25:58]
with with this house in particular, but
[26:00]
I don't necessarily think it's
[26:03]
even the fact that it's this house. I
[26:04]
think it's just the ongoing trend we
[26:06]
keep seeing in the neighborhood of homes
[26:09]
being purchased and then either turned
[26:11]
into a rental or an Airbnb and kind of
[26:14]
the
[26:17]
idea of how can we better preserve our
[26:21]
maintenance standards in our
[26:23]
neighborhood. Um, and so
[26:26]
Steve, I've been putting together a lot
[26:28]
of questions and we'll meet with you,
[26:30]
but just wondering like are there ways
[26:32]
that we can be a little bit more strict
[26:34]
on certain things so that maybe um maybe
[26:38]
we're and don't say deterring people
[26:42]
from purchasing homes for rentals
[26:44]
because we h we have some great renters.
[26:46]
We have some great rental properties. I'
[26:48]
I've
[26:50]
young families and enjoyable folks that
[26:53]
really keep up their yard and
[26:54]
everything, but um I know the state kind
[26:57]
of has us tied uh their their hands tied
[27:00]
as far as capping rentals, but at some
[27:03]
point I feel like when has the
[27:06]
neighborhood just turned into
[27:09]
a a tailgating spot for the city to
[27:12]
utilize it and no longer a neighborhood?
[27:14]
Uh what does that look like? So, I I I'm
[27:17]
going to personally do some digging and
[27:19]
hopefully I'll work with you, Steve.
[27:21]
Terry, I may reach out to you, but I
[27:22]
kind of wanted to get everyone else's
[27:24]
opinion. Um, like I said, I got a lot of
[27:27]
feedback from neighbors kind of over
[27:29]
here on the north side, but would love
[27:31]
feedback from everyone else. I think
[27:34]
Troy wants to comment if I might just
[27:36]
offer a little perspective to council in
[27:38]
regards to this specific property. uh
[27:42]
this owner did not come in and and just
[27:45]
start to do this without making any
[27:46]
notification to the city. This owner
[27:49]
when he was considering buying the
[27:50]
property, contacted the city about the
[27:53]
rules uh both as
[27:56]
potential rental rental property and
[27:58]
some of the changes that would need to
[28:00]
be done to the property. Uh he was
[28:02]
referred to appropriate staff. He was
[28:05]
referred to Terry Garrett. just referred
[28:07]
to uh the city clerk regarding getting
[28:10]
accurate information on any allowed use
[28:14]
of it as a rental property or VRBO and
[28:16]
necessary necessary steps that would
[28:19]
need to be that would need to be done.
[28:20]
So, uh it may seem like to to Aaron or
[28:25]
some of the others that this just has
[28:27]
happened overnight, but this has been
[28:29]
ongoing. He's been asking questions
[28:31]
before he purchased it and wanting to
[28:34]
know first of all, can I make these
[28:36]
changes and second of all, I want to
[28:37]
make sure that I'm doing them in
[28:39]
accordance to any rules and regulations
[28:41]
in the city before I purchase this
[28:43]
property. So, I just in in relation to
[28:46]
this specific property, I I just wanted
[28:48]
to make sure council was aware that that
[28:51]
Meth has has tried to do everything.
[28:53]
He's he's made the right angle and he's looked for the information to do
[28:57]
things about the boarding law since his
[29:00]
regulations.
[29:02]
>> I live on the other side so I know Nick
[29:04]
um I don't know if you want to He came
[29:06]
in after the public comment. I don't
[29:09]
talk.
[29:10]
>> Yeah, maybe just a quick comment.
[29:12]
>> You want to come up here and state your
[29:14]
name and address and
[29:17]
>> yeah
[29:19]
people call me Nick but uh yeah. So
[29:22]
maybe I'll just quickly say I have no
[29:24]
intention of turning this into a
[29:25]
multiplex. It's my home.
[29:28]
>> It'll never have any renters.
[29:30]
I do travel a lot.
[29:32]
>> Oh, are you the new owner?
[29:33]
>> Yes.
[29:35]
>> I'm the troublemaker that everyone seems
[29:36]
to hate.
[29:38]
>> I don't know what I did, but for some
[29:39]
reason I'm the most hated person within
[29:41]
a week and a half. But anyways, um yeah,
[29:44]
I uh travel a lot for work and there are
[29:48]
a lot of other people that seem to be
[29:50]
doing what I intended to do, but for
[29:53]
some reason me doing it is creating a
[29:55]
lot of havoc, which is kind of
[29:57]
interesting and I'll just point that
[29:59]
out. Um when a family rents out their
[30:03]
home because like I don't watch
[30:05]
football. I I I hope that's not a
[30:07]
sacrilegious thing to say. I like
[30:09]
wrestling. I don't like football, but I
[30:11]
do
[30:12]
uh I'll take that weekend and, you know,
[30:16]
rent it out to people who want to come
[30:17]
and watch the Iowa State game and I'll
[30:19]
go do something else. Like I'm not sure
[30:21]
what is criminal about that. Hopefully
[30:24]
there is not a any now or ever will be
[30:26]
and but you can come and look at it, you
[30:30]
know, two months from now, six months
[30:31]
from now. There will never be any
[30:33]
renters. There will never be any
[30:35]
multiplex. And for the record, Airbnb,
[30:39]
as many Airbnbers do, you can choose to
[30:42]
rent your whole home or you can choose
[30:44]
to rent a room or you can choose to rent
[30:47]
your basement. There is nothing. I'm not
[30:50]
segmenting my home. I'm offering it
[30:52]
because sometimes somebody's coming to
[30:53]
town as an individual. I don't need a
[30:56]
whole your whole five- bedroomedroom
[30:57]
home. I just need a room to rent and I
[31:00]
want to come and see the game. Or there
[31:02]
may be a group of six people and they
[31:03]
want to stay in the bigger. So I offer
[31:06]
it in different configurations depending
[31:08]
on who's coming to town for the games or
[31:12]
a medical conference or whatever it is.
[31:14]
So that's kind of the extent of the
[31:15]
story.
[31:17]
I have a and just on the just on the
[31:19]
other parking front and again I looked
[31:22]
at this very carefully
[31:24]
I have 125 square foot
[31:28]
125 lot uh frontage as far as I'm aware.
[31:32]
I looked at the ordinance. It says front
[31:34]
set. It's 1/3 of front setback. And I
[31:36]
talked to Terry about this weeks before
[31:38]
I bought 125 * 25 / 1/3 is 1,041
[31:45]
whatever square ft. I have two when I
[31:48]
bought this home. I have technically 280
[31:51]
not no 260 square foot frontage.
[31:55]
With all due respect to Nick, he has
[31:57]
almost his whole frontage is his is
[31:59]
part. I mean, you know what I mean? Like
[32:01]
with the wife. So, I'm just trying to
[32:02]
understand why this home is not allowed
[32:06]
what other homes are allowed very
[32:08]
clearly. And so, that's I'm trying to
[32:11]
get to the bottom of that.
[32:12]
>> Sure.
[32:13]
>> And so,
[32:15]
I think everyone here should be aware,
[32:17]
including the attorneys and so on. If I
[32:20]
get the impression, and I'll just say
[32:22]
this for the record, if I get the
[32:23]
impression that I'm being
[32:26]
non-uniformally treated,
[32:28]
I will have to treat that accordingly.
[32:31]
So, I that's all I want to say. If
[32:33]
there's any questions, I'm happy to
[32:34]
address them. But as far as I've been
[32:37]
talking to Terry, I've been chasing
[32:38]
Terry for at least 6 weeks before I
[32:40]
bought this property. And Mike will tell
[32:42]
you, I couldn't get a hold of Mike
[32:45]
because I was trying to get the thing
[32:46]
registered. I called the the University
[32:49]
of University uh police department and
[32:52]
asked the officer. I said, "Dude, how
[32:53]
does a city work?"
[32:55]
>> I call, I leave messages. No one returns
[32:58]
my call. Is there anyone that actually
[32:59]
works in the city? And I'm not saying
[33:01]
this is a bad thing, but I was like,
[33:02]
"Can you help me get a hold of this
[33:04]
guy?" because I'm told that you have to
[33:06]
register your property before you even
[33:09]
put it up as I'm sure he so again I've
[33:12]
been trying my best to adhere to
[33:13]
everything but for some reason it's like
[33:16]
a title wave as soon as I came on board
[33:18]
so it doesn't make any sense to me I'll
[33:20]
stop there but like that's kind of the
[33:22]
story
[33:22]
>> well you know the Belgos owned that
[33:25]
property since 1964
[33:28]
and so for over 60 years the families
[33:32]
had that property and when the neighbor
[33:34]
neighborhood goes through some changes
[33:37]
the you know it's like oh this is
[33:40]
different we have some question we want
[33:42]
to make sure everything's done legally
[33:44]
and properly and I'm sorry you feel
[33:48]
attacked by it and you know by that I
[33:51]
don't think people intended that they
[33:53]
wanted to find out more information
[33:55]
>> well somebody literally parked in front
[33:57]
somebody literally
[33:58]
>> your name what is your name
[33:59]
>> Naveen Naven
[34:01]
>> oh okay nice call Okay.
[34:04]
>> Yeah, no problem.
[34:05]
>> Thank you. And my on the website, my
[34:09]
phone number's there, too. Okay. You can
[34:11]
reach me if you want.
[34:12]
>> Okay.
[34:12]
>> But people in the neighborhood had
[34:15]
concerns when things go under, you know,
[34:17]
new changes and things, and we want to
[34:19]
make sure everything's done right. And
[34:21]
I'm glad that you're here and we'll
[34:23]
explain that to the council and we
[34:26]
really appreciate that. and I want to
[34:28]
welcome you to the city and uh glad to
[34:32]
have you and uh we we just wanted to get
[34:35]
some answers and I know it feels I I
[34:39]
understand that people stopped by and
[34:42]
talked to you and you know when when
[34:45]
changes were coming you know
[34:48]
>> well somebody literally blocked my
[34:50]
driveway and started interrogating me
[34:52]
and they had no city official title
[34:54]
>> I think her name is Caroline I'm not
[34:56]
sure who she is but apparently she's
[34:58]
has this reputation, but I'm sorry if
[35:00]
you come to my property in an unfriendly
[35:02]
manner and you interrogate me and you
[35:04]
have no official role here, that's not
[35:06]
exactly the best way to endear me
[35:09]
towards you. And so again, this is and
[35:12]
this is less than 24 hours of me owning
[35:14]
this property. So again, I'm trying to
[35:17]
understand and I was jokingly saying
[35:19]
this to Terry, like I'm like,
[35:22]
did I come to University Heights or am I
[35:25]
being sent to Guantanamo Bay? Like this
[35:27]
is what this last this last week has
[35:29]
felt like. I'm not going to lie.
[35:31]
>> Yeah. Yeah. Anyway,
[35:32]
>> city minister, will you tell me I don't
[35:34]
name names, but have you had any
[35:35]
negative contact with any city official?
[35:38]
>> No. That's what I one thing I will be
[35:40]
very clear and I and the email I said
[35:42]
was very clear. Mike's been great.
[35:44]
Troy's been great. Terry's been great. I
[35:46]
will never speak ill of anyone because
[35:49]
but also try to understand from my
[35:51]
perspective.
[35:52]
>> I do
[35:52]
>> like I literally approached the city and
[35:54]
said, "I'm thinking about buying. Can
[35:56]
you tell me? Because everyone warned me
[35:57]
about University. Literally, everyone's
[35:59]
like, "Don't buy there. They're crazy."
[36:02]
Literally, everyone said this. They're
[36:05]
like, "They're crazy. They're they're
[36:06]
hyperontrolling and all this kind of
[36:08]
stuff." And I talked to Terry. And I
[36:10]
talked to Mike. I'm like, "No, they seem
[36:12]
normal." In fact, Terry and I will hold
[36:14]
Terry to this comment. He said, "Don't
[36:15]
worry. Our bark is worse than our bite."
[36:18]
And I'm just standing here before you
[36:19]
saying, "Sorry, that bite feels pretty
[36:21]
strong to me. It feels like a freaking
[36:22]
pitbull at the moment." But anyway, so all I ask is like either be straight
[36:27]
with your rules.
[36:28]
>> I believe
[36:29]
>> if the rules if the rules are no Airbnb
[36:31]
allowed, no anything. I should have been
[36:33]
told that ahead of time, right?
[36:34]
>> Because I wouldn't have bought here.
[36:36]
>> Nav
[36:38]
I believe the city has been consistent
[36:39]
in that,
[36:40]
>> right?
[36:41]
>> Some community members may not have been
[36:43]
consistent in that. May wish that it was
[36:44]
otherwise or maybe misinformed.
[36:47]
Well, my fear is that this these the
[36:49]
public pressure is somehow going to
[36:50]
influence the city, which I hope it will
[36:52]
not. But again, I'm trying to adhere to
[36:54]
the ordinances that as I read, read them
[36:56]
and understand them. And I want to
[36:59]
believe that the public pressure is not
[37:01]
going to somehow color the decisions
[37:04]
that are being made. And that's what I
[37:05]
hope will not be the case going forward.
[37:09]
>> Nick, I had a similar situation when I
[37:12]
moved to town and started doing some
[37:14]
work on Coser Avenue.
[37:16]
Um because I'm a new once an architect
[37:19]
and we were building this complex which
[37:22]
was a big deal and um there was work I
[37:29]
was doing some work and I had some
[37:30]
ground thawing machines overnight.
[37:34]
Uh, one of the council members called me
[37:36]
and threatened to have me arrested that
[37:38]
night and and it went on and on and on,
[37:41]
but they got
[37:44]
>> over
[37:49]
it's I guess it's a hazing ritual. I'm
[37:51]
joining a fraternity as a hazing ritual,
[37:53]
but I hope at some point it ends because
[37:55]
the hazing is a little bit it's wearing
[37:57]
me out.
[37:58]
>> Nick, you see it? I I appreciate you
[38:00]
coming in because I think this is
[38:02]
helpful, you know. Uh with my driveway
[38:04]
for example, I came to council, talked
[38:07]
about it. You know, on MROS, it's very
[38:10]
busy. So getting turned around was very
[38:12]
important to have a driveway like that.
[38:15]
I think, you know, you weren't here
[38:16]
during public comment, but I think a lot
[38:18]
of the concern related to
[38:21]
three different bookings on Airbnb. I
[38:24]
think that was the concern is that
[38:26]
>> No, no, but did you look at them closely
[38:28]
or no?
[38:29]
>> Yeah, there Yeah, the the
[38:30]
>> No, no, no, but just so you understand.
[38:32]
So, one is basically if you want to just
[38:34]
rent a master bedroom. As I said in
[38:37]
Airbnb, you're allowed to take the whole
[38:39]
home, you're allowed to take part of the
[38:41]
home or you're allowed to take a room in
[38:44]
a home. And I think I in my email I
[38:47]
there's actually an ordinance I think
[38:49]
it's I don't remember off the top of but
[38:51]
I think it's 110.2 two I mean I I wrote
[38:54]
an email to um but like it literally
[38:57]
said that basically and it's applicable
[39:00]
to a dwelling part of a dwelling or a
[39:03]
habitable room. So again, I'm trying to
[39:06]
understand. You're a lawyer, right?
[39:09]
>> I'm trying to understand what about this
[39:11]
am I doing wrong because
[39:14]
>> because I don't need to offer. There's
[39:16]
nothing in the ordinance says you have
[39:17]
to offer only your whole or nothing.
[39:20]
Right?
[39:20]
>> It either it needs to say that or it
[39:23]
needs to not say that. And right now I
[39:25]
can confirm to you affirmatively that it
[39:28]
does not say that you're only allowed to
[39:30]
offer your whole home. Yeah. And I'm
[39:32]
just trying to tell you just what she
[39:34]
had missed is and I'm not the lawyer in
[39:37]
here. I've got a city attorney. So I
[39:39]
don't look at me as being a lawyer in
[39:41]
here. Um but the concern was the text on
[39:45]
your postings allude to the ability of
[39:48]
having three separate
[39:51]
renters at the same time. I think that
[39:53]
was what concerned people. And then I
[39:55]
think seeing the the sidewalks to the
[39:57]
different entrances. So again, I'm I'm
[40:00]
explaining this not because I know the
[40:01]
rules on Airbnb because I I know
[40:03]
probably the least in this room about
[40:05]
Airbnb. I'm explaining it because that
[40:07]
is what the concern was. And I don't
[40:10]
think it was an unreasonable concern for
[40:12]
people. It seems like they were, you
[40:14]
know, very clear like, okay, we see now
[40:16]
three entry points. Now we look on
[40:18]
Airbnb and there's you can rent the
[40:20]
whole house. You can rent the where
[40:23]
Kathy used to live or her her bedroom.
[40:26]
And then there was it was implying you'd
[40:28]
also be able to potentially at some
[40:29]
point rent the the basement.
[40:30]
>> No, no, that's not true.
[40:32]
>> Well, I mean the text on there says
[40:35]
>> something to the effect of if you if you
[40:37]
rent the main space know that there are
[40:38]
two other spaces basically. And so on
[40:42]
the
[40:42]
>> Well, that's more so to tell the person
[40:44]
that I might that's more so to tell the
[40:46]
person that I'm going to keep I'm I'm
[40:48]
going to keep the basement for myself.
[40:50]
There's no basement listing there. For
[40:52]
the record,
[40:54]
>> if I choose to rent out the the main two
[40:56]
floors of my house, that doesn't mean
[40:57]
that I'm somehow renting out the
[40:58]
basement,
[40:59]
>> right? And again, this is coming from
[41:00]
some nothing about Airbnb. It it was
[41:03]
just to just so you hopefully feel
[41:05]
better that people weren't out to get
[41:06]
you. It just from from the outside
[41:08]
perspective. Three different entrances
[41:10]
are created. It appears there Airbnb
[41:14]
signals three different units. So that
[41:16]
is where this No, but again as a lawyer
[41:19]
no as
[41:20]
>> it looked like we're going to be like
[41:21]
are we going to be housing 16 people in
[41:23]
this house? How is like how is this
[41:26]
working?
[41:26]
>> Okay. Can you look at the Melrose house
[41:29]
like four doors down from him? They
[41:30]
literally rent out the whole home to
[41:32]
like a group of small people. Like I'm
[41:34]
just trying to understand what is
[41:36]
different about that house than my
[41:37]
house.
[41:38]
>> I think these might be Steve questions.
[41:39]
I like I'm trying to understand like
[41:41]
>> I don't know. I'm just trying to get
[41:43]
perspective of people. No, no, no. I
[41:44]
understand. But can you point to the
[41:45]
ordinance that says there's a
[41:47]
>> now there's a safety issue.
[41:50]
>> If you could say, well, there's a fire
[41:52]
hazard. Then tell me what ordinance
[41:54]
points to in rentals that say this is
[41:57]
the number of people you're allowed to
[41:59]
have in your home. In fact, every room
[42:01]
is over 100 square ft, which is
[42:03]
habitable for two two plus people. So
[42:05]
again, we can go into the legality of it
[42:07]
if you want because I've studied this
[42:09]
pretty reasonably. I'm not looking to
[42:10]
debate it here, but my point is
[42:14]
I'm trying to understand like like what
[42:17]
exactly like unless you can point to a
[42:19]
specific thing I'm doing wrong,
[42:21]
>> I don't think I don't think you are
[42:22]
doing anything wrong. I think just there
[42:24]
was a perspective that what is going on
[42:27]
and now that you come and we all are
[42:29]
going to be able to relate to your
[42:31]
neighbors um we'll be you'll feel very
[42:33]
welcome community and neighborhood.
[42:35]
women need to be welcomed. Like, how
[42:36]
about I mean, I don't know how to say
[42:38]
this, but I just want to be left alone.
[42:40]
Like, not by you people, but like by the
[42:42]
people who are who are like blocking my
[42:44]
driveway and like interrogating me.
[42:47]
>> Like, at this point, just leave me
[42:48]
alone. Like, that's kind of where I'm
[42:49]
at. I had to police. I know. I know
[42:52]
that. I agree. I don't think the city is
[42:54]
I had to do two police service calls
[42:56]
because people were stalking my home
[42:59]
>> and the city's been consistent and that
[43:00]
you're haven't done anything wrong. the city inspectors.
[43:04]
>> I agree with you. I agree with you.
[43:05]
>> So So I think the city and the ordinance
[43:08]
>> the ordinances and the counselors have
[43:10]
been consistent.
[43:11]
>> I agree with you.
[43:12]
>> I can't I can't
[43:15]
stop somebody in the community from
[43:16]
coming up and exp express expressing
[43:18]
displeasure with what you're doing. I
[43:20]
absolutely agree with you. The city
[43:21]
needs to be consistent. The city needs
[43:23]
to follow its ordinances and they need
[43:25]
to be consistently appi applied across
[43:27]
the community. I would say that they are
[43:29]
unless you can give me the example that
[43:31]
they aren't.
[43:32]
That doesn't mean that there's not going
[43:33]
to be somebody on your street or across
[43:35]
town that's upset with it, but I believe
[43:38]
we are acting as fairly and consistently
[43:40]
as we can toward No, I I totally agree
[43:42]
with that.
[43:42]
>> Okay.
[43:43]
>> I guess it's it's more I'll stop.
[43:46]
>> The neighbor was here. This is exactly
[43:48]
what I was hoping to get is what is the
[43:50]
law? Are we are somebody allowed to have
[43:52]
three discrete Airbnbs in a home? Four,
[43:55]
five, is there any limit? What is, you
[43:57]
know, that's what I was asking. Yes.
[44:00]
>> Okay. Do you know that, Steve? I mean,
[44:02]
do you are you an Airbnb person?
[44:06]
>> Sure.
[44:09]
>> There's there's like no state
[44:11]
regulations. I mean, that it goes into
[44:12]
like there's and you could probably say
[44:15]
more, but yeah, it goes into like the
[44:18]
city can regulate things where there's
[44:20]
no banquet all, no events. I don't
[44:23]
really know what constitutes an event um
[44:26]
like within the Airbnbs and then
[44:28]
obviously all that safety things, but
[44:30]
really there's not much that we could
[44:33]
say on as a city.
[44:36]
>> Okay.
[44:38]
Sorry.
[44:39]
>> Were you going to stay?
[44:42]
You don't have anything to add right
[44:44]
yet? Or do you have anything to comment
[44:46]
on before we end this?
[44:50]
>> I do not. Now we have a better
[44:52]
understanding and you know who we are
[44:55]
and where we are and how to contact us,
[44:58]
right?
[44:58]
>> Yeah. I hope you don't I hope no one
[45:00]
here feels like I'm attacking them
[45:02]
>> cuz like I like like Troy said like the
[45:04]
city the city itself has been great. The
[45:07]
sorry the city administration has been
[45:09]
great.
[45:09]
>> Thank you.
[45:10]
>> I just don't know how to interpret like
[45:13]
I've lived in many parts of the US.
[45:16]
>> The Northeast, the South. I've never
[45:18]
experienced this. This is supposed to be
[45:20]
Iowa nice.
[45:22]
>> Like like I don't get it. So anyway,
[45:24]
I'll leave I'll leave it there. Thank
[45:26]
you.
[45:26]
>> Thank you very much for coming tonight.
[45:28]
Thank you. And thank you, Aaron.
[45:30]
>> Okay. So, uh, we'll go on to, uh,
[45:33]
mayor's report and, uh, as Troy said in
[45:37]
his report about the, uh, Swisser Woods
[45:43]
Trails Project, the first order is
[45:45]
consideration a motion to set a public
[45:48]
hearing on September 22nd at 7 p.m. for
[45:51]
the Swisser Woods Trail Project. And
[45:55]
since this is a procedural thing, uh,
[45:59]
I'm going to put it under mayor's
[46:01]
report. And so, is there a motion?
[46:04]
by Lisa. Is there a second?
[46:07]
by Nick. Thank you. Um, any
[46:12]
discussion?
[46:14]
All in favor say I.
[46:16]
>> I.
[46:17]
>> Does anyone oppose? Same. N. Okay.
[46:21]
Motion carries. 401 absent.
[46:25]
Thank you. Troy will talk more about it
[46:28]
during his report. And then we have the
[46:30]
uh consideration of a motion to
[46:32]
reimburse the reimburse the property
[46:34]
owner at 300 koser one half the cost of
[46:38]
removing a dying tree in the rightway.
[46:42]
and Steve spoke with him and
[46:45]
communicated and as you know the city
[46:48]
has paid 50% of partially dead trees for
[46:53]
the homeowner and so Steve spoke with
[46:56]
him. Did you have anything to add?
[46:58]
>> No, he was he was happy
[47:01]
and happy to
[47:03]
>> Yeah. So we can proceed with that. It's
[47:06]
on the corner of Cozer and Sunset.
[47:09]
And so, uh, is there a motion?
[47:13]
by Lisa. Is there a second?
[47:16]
by Nick. Um,
[47:19]
any discussion?
[47:22]
All in favor say I. I. I. Is anyone
[47:25]
opposed?
[47:27]
Okay. Motion carries. 41
[47:30]
absent.
[47:32]
And then uh Steve, did you have anything
[47:35]
to add tonight?
[47:36]
>> No, I meant to send an email saying I
[47:38]
didn't have anything to add tonight, but
[47:40]
I don't.
[47:42]
>> Thank you. Any questions for Steve?
[47:45]
We'll go on to Troy's report.
[47:48]
>> Sure.
[47:48]
>> Thank you.
[47:49]
>> I want to touch briefly on some of the
[47:51]
items in my report and then there's a
[47:52]
second matter we need to discuss also. I
[47:54]
first of all appreciate council's
[47:58]
understanding of some of the issues that
[47:59]
took me away from from the city here in
[48:02]
the last month. My report's relatively
[48:04]
short because of that. Mostly I wanted
[48:06]
to update you on the Swisser track
[48:08]
trails development. Uh
[48:11]
city engineer Ryan, the mayor and I met
[48:13]
with the design team. The final design
[48:15]
is complete. I had sent out along with
[48:18]
my report to uh council and staff and
[48:22]
the mayor the final construction
[48:25]
documents which includes some imagery of some of the features as well as some CAD drawings of of the project. Uh
[48:34]
the trails project is will be bid or
[48:37]
presented as two separate projects. They
[48:40]
differ enough in construction. One is
[48:42]
basically a sidewalk and the other is
[48:44]
soft trails. Uh the sidewalk here to the
[48:47]
north of OUP will be bid as one project
[48:50]
and then all of the soft trail system as
[48:52]
a second. Uh we're going to do the same
[48:55]
we're going to co or do the timing
[48:58]
of it all the bidding and the issuance
[49:00]
at the same time just to cut down on
[49:02]
special meetings and because they do
[49:04]
intertwine. However, in talking with uh
[49:08]
Bolts and Mink,
[49:10]
it's likely that there will be different
[49:12]
biders for each project because they're completely different
[49:18]
scope and process. Uh the bid packages
[49:22]
were prepared by Pton M by Bolton M and
[49:25]
sat down and Ryan was particularly Ryan
[49:27]
Poy was particularly good to have there.
[49:30]
uh even though some of this falls
[49:31]
outside of what his area of experience
[49:34]
and expertise is, he was able to help
[49:36]
tremendously with timelines and saying
[49:38]
this is a piece that the city can handle
[49:40]
and this is a piece that it' be better
[49:42]
that maybe Bolts and Mink took care of.
[49:44]
The opinion of probable construction
[49:46]
costs for the entire project uh are come
[49:49]
in right around $700,000 and those are
[49:52]
the construction costs. That doesn't
[49:54]
include the fees that we pay for design
[49:56]
or any fees that for a contract that we
[49:59]
enter into as far as helping assess the
[50:02]
bids and oversight of construction. I
[50:06]
know the mayor and I thought maybe she'd
[50:07]
talk about it in her report, but I know
[50:09]
the mayor has been exploring uh some
[50:12]
options for maybe soliciting some donor
[50:15]
funding for various
[50:17]
>> talked about that a little. Yeah.
[50:19]
>> Yeah.
[50:20]
>> Tenative timetable. I wanted to update
[50:22]
this since I was not able to do it last
[50:25]
month's report. Uh notice will go out
[50:28]
this week on the public hearing.
[50:30]
September 22nd will be the public
[50:32]
hearing which will require a special
[50:33]
council meeting. Bids will be due. I
[50:37]
believe my timeline's correct. Bids will
[50:38]
be due October 20th. Uh those bids will
[50:42]
be open then and assessed and a special
[50:46]
meeting will occur on o October 27th at
[50:49]
which time hopefully we'll award bids.
[50:52]
Preliminary work on the trails could
[50:55]
begin as early as November. Uh that
[50:58]
could you know involve coming in and
[51:00]
doing some clearing some staging things
[51:02]
like that. But the bulk of the work is
[51:04]
actually now expected to occur between
[51:07]
April of next year with substantial
[51:10]
completion date by June 15th, final
[51:14]
completion date by July 15. That's our
[51:17]
current timetable. The projects may not
[51:19]
move in parallel with each other once
[51:22]
bids awarded.
[51:24]
Again,
[51:26]
depending on how they're awarded and who
[51:28]
gets it, somebody might come in and do
[51:29]
all the work early. Somebody might come
[51:31]
in later. They might be going on for the
[51:33]
same time. Uh contractual
[51:36]
considerations.
[51:37]
Bolton Mink is currently engaged to
[51:39]
complete the final design and prepare
[51:41]
the bid package, which is now two
[51:42]
separate bid packages. Once they
[51:44]
complete that work for us, they're done
[51:47]
contractually with what we engage them
[51:51]
to do uh in reviewing process. Now, as
[51:55]
to what happens next, uh city staff and
[51:58]
particularly the city engineer are
[52:01]
heavily involved in some other
[52:03]
substantial projects right now in
[52:05]
University Heights, uh kind of running
[52:07]
at capacity as far as the ability to do
[52:10]
the oversight on this. And while the
[52:13]
sidewalk portion of it is something that
[52:15]
Ryan said he is familiar with and could
[52:18]
potentially handle, the soft trails
[52:20]
again just falls out of that area of
[52:24]
experience and area of expertise. Uh and
[52:28]
conversation with city staff and with
[52:30]
the mayor. Uh I think I think that
[52:34]
council should consider further engaging
[52:36]
Bolton Mink to assist with a bid
[52:38]
evaluation and the construction
[52:40]
oversight. Uh, I spoke with Ryan
[52:42]
Anderson of Bolton, one of the design
[52:44]
chairs that we we've been dealing with,
[52:46]
and I asked him to provide a proposal to
[52:49]
me to present to council to fulfill that
[52:51]
role. I do not have that yet, but in
[52:54]
conversation with Ryan today, uh, for
[52:57]
both projects
[53:00]
and doing the work that we talked about
[53:01]
when we last met, uh, he expected costs
[53:05]
to be around $55,000
[53:08]
for that bid evaluation, assist with us
[53:11]
with bid bid evaluation and then
[53:14]
oversight of the actual construction.
[53:16]
Again, I'm not asking for approval or
[53:19]
presenting them to council, but I just
[53:20]
want them to be aware.
[53:22]
>> Do you know off the top of your head
[53:23]
when Josh talks about like the Corville
[53:25]
trails up by Wickham and when they did
[53:27]
those? Did did Bowman name do see a full
[53:29]
bill? Do you know if they saw a whole
[53:31]
project through that? I guess most of
[53:32]
that was in
[53:34]
>> I do not know if they're city
[53:37]
engineering.
[53:38]
>> I be I do not
[53:39]
>> just be curious to know if uh what
[53:42]
Backyard Trails had a role in that
[53:44]
actually. I think they did some of the
[53:46]
construction of that if I'm remembering
[53:47]
correctly.
[53:48]
>> Backyard trails was under contract with
[53:51]
Bolton Mink to come out and state this
[53:53]
and and has had a role in getting this
[53:56]
project as far as it as it is is right
[53:58]
now. Uh I think that one of the
[54:00]
considerations that Bolton Mink had is
[54:05]
would backyard trails be a bidder or
[54:07]
would they be willing to cons to stay on
[54:10]
as that oversight role since they know
[54:12]
what they're doing and making sure that
[54:13]
it's done right. But I don't know who was in motivated.
[54:17]
>> Okay. I I mean I just
[54:19]
>> Yeah. So that's the information that I
[54:21]
wanted to just bring you up to speed on.
[54:23]
I had no update on you that for that
[54:25]
last month. I do have additional
[54:27]
materials. I have the project manuals
[54:30]
for each project. Uh they're 50-page
[54:33]
documents.
[54:35]
They're something that I wasn't sure
[54:36]
council would be interested in. If you
[54:38]
would like to see those, I certainly can
[54:40]
get that information to you. But I
[54:42]
thought the construction documents
[54:44]
probably had most of the pertinent
[54:46]
information that council wanted to see.
[54:48]
Are there any questions on the trail
[54:50]
system other than the one Mackenzie
[54:51]
already asked?
[54:53]
>> It's exciting. It's all on us
[54:55]
>> and and I also think it's exciting. I I
[54:58]
think that the city and staff and I just
[55:02]
think we've done a really good job of of
[55:04]
building momentum on this and and
[55:08]
building enthusiasm for it. So, thank
[55:09]
you, Mackenzie. I wanted to touch
[55:12]
finally on one other item and that's my
[55:15]
port. There's a property down there and
[55:17]
I don't need to call it out. If you want
[55:18]
to go down there and see it, you're
[55:20]
welcome to. Uh the homeowners have two
[55:24]
small children. They live on the inside
[55:26]
radius of Mahaska port. They are
[55:29]
concerned with speed of vehicles. If you
[55:32]
are in that area ever, uh they have a
[55:34]
couple signs along the rideway that ask
[55:37]
to slow down. uh they approximately six
[55:40]
weeks ago spoke with a fence installer,
[55:44]
a contractor, and expressed a desire to
[55:46]
put in a fence in the front yard. And
[55:50]
they looked with the contractor. They
[55:52]
were assured that what they were doing
[55:53]
could be done. They were told they could
[55:56]
have up to a 48 in fence. They didn't
[55:58]
want a 48 in fence. They cut it down to
[56:00]
42. It's a white pickup fence. I think
[56:03]
it's a very attractive fence. It's been
[56:06]
there for six weeks, more than six weeks
[56:08]
now. Uh, at some point recently, the
[56:12]
female property owner, Christina,
[56:15]
began to doubt whether the fence was in
[56:17]
compliance, and she contacted me. The
[56:20]
city had not received any calls from any
[56:22]
neighbors. They not received any
[56:24]
complaints. She had not received any
[56:26]
complaints. She just began to doubt
[56:29]
whether there was in compliance. And the
[56:32]
issue is it's on the public right away.
[56:35]
It's a side of the street that does not
[56:37]
have a sidewalk and they took it up to
[56:39]
approximately one foot off the curb. Uh
[56:44]
she was interested in potentially
[56:45]
obtaining a variance
[56:47]
and our ordinance allow variances for
[56:50]
fences don't go to our board of
[56:52]
adjustment. They come to council. But I
[56:54]
spoke with the city. I spoke with Terry
[56:57]
and confirmed with Terry and Terry said
[57:00]
he would he could not support a variance
[57:02]
that he would he would say that the city
[57:05]
could not issue one. Uh this basically
[57:07]
the rideway is part of the roadway. It's
[57:09]
just not paved and there were all sorts
[57:12]
of issues including liability
[57:14]
uh problems with snow removal
[57:17]
things like that. I contacted the owner
[57:20]
and told her that the owner is a
[57:22]
self-described rule follower. She was
[57:24]
obviously disappointed. The fence
[57:26]
remains there now, but arrangements are
[57:28]
being made to either be located or
[57:30]
remove it. I wanted council to be aware
[57:32]
of it in case you of it now that it's in
[57:36]
by the city, but that's my other.
[57:39]
Any questions about that?
[57:41]
Then the last thing that I would like to
[57:43]
address isn't included in my report, but
[57:45]
it's consideration of a request for
[57:47]
amplified sound for a concert at 1009
[57:51]
Melrose Avenue from 2:00 p.m. to 5:30
[57:54]
p.m. on September 12th, 2026. That's
[57:57]
next Saturday. That's the Iowa Iowa
[57:59]
State football game. Uh, and just as a
[58:03]
refresher to council, or maybe they're
[58:06]
all aware of this and maybe they aren't,
[58:09]
our noise ordinance, which was adopted
[58:12]
in 2007, if I remember correctly, is
[58:14]
prohibitive.
[58:16]
It it says that activities can't like
[58:20]
this cannot happen. Uh, really, it
[58:22]
breaks things down into I mean, the
[58:24]
purpose excessive noise is a serious
[58:26]
hazard to public health and welfare and
[58:27]
the quality of life. The purpose of this
[58:29]
ordinance is to establish standards for
[58:31]
control of noise pollution that
[58:33]
interfere with the comfortable enjoyment
[58:34]
of life, property, recreation or the
[58:36]
conduct of business. And then it goes
[58:38]
into specific activities provide are
[58:40]
prohibited and there's three under the
[58:44]
ordinance. One is construction equipment
[58:46]
and it says it gives period of operation
[58:50]
for construction equipment. And the
[58:52]
second the largest section section B is
[58:55]
no person shall you shall use operate
[58:58]
cost to be used operate any radio player
[59:01]
stereot and it goes on that any sort of
[59:04]
amplified sound amplifying sound upon
[59:07]
public streets or in any building upon
[59:09]
any pre premises public or private. And
[59:12]
it goes on and it talks about that. And
[59:15]
then the section C, the third one is
[59:18]
basically any other loud noises that are
[59:20]
prohibited. And it talks about that.
[59:23]
Again, it's prohibited. It doesn't give
[59:25]
it doesn't outline any process to apply
[59:28]
for a permit for it to happen. It just
[59:30]
says thou shalt not under special
[59:33]
exceptions. It talks about FARs. It
[59:36]
talks about
[59:38]
the city. uh the city if they wanted to
[59:41]
have a concert in the park they could. I
[59:43]
mean the city is allowed to make any
[59:45]
kind of noise that it wants in the
[59:46]
conduct of it of its business. But
[59:49]
nowhere in the exceptions does it say
[59:51]
anything about amplified music.
[59:54]
The
[59:56]
instruction
[59:58]
part of it oh shoot where did that go?
[1:00:01]
the it talks about
[1:00:04]
if I'm doing construction and for some
[1:00:06]
reason I can't conduct
[1:00:09]
the construction that needs to be done
[1:00:11]
during those hours then I can come
[1:00:14]
specifically to city council and I can
[1:00:16]
try to explain that and I can try to get
[1:00:18]
an exemption but that is only for the
[1:00:21]
construction noise the amplified music
[1:00:26]
it talks about
[1:00:28]
close to me so I can open it back up
[1:00:32]
Thank you. Uh
[1:00:42]
don't mind that section. Okay.
[1:00:45]
>> It talks about
[1:00:48]
that somebody can shoot. Hold on just a
[1:00:51]
second. I apologize for this. I had the
[1:00:53]
shut down.
[1:00:59]
So under the construction unless aa
[1:01:01]
permit thereafter has been obtained from
[1:01:03]
the city of university height city
[1:01:04]
council that's specifically for
[1:01:06]
construction equipment under the
[1:01:09]
amplified music
[1:01:19]
you remember Chris said it was I think
[1:01:24]
So, Steve Lynchure.
[1:01:26]
All right. Here. Uh, so it talks about
[1:01:29]
all the amplified music, whether it's
[1:01:31]
tape deck, etc., etc., uh, unless the
[1:01:36]
person has a permit or express
[1:01:38]
permission from the city. Now, in my
[1:01:40]
five years as police chief, when
[1:01:42]
somebody called in and asked about
[1:01:44]
having an event that included amplified
[1:01:46]
music, I'm thinking of cases where they
[1:01:49]
asked for a DJ or a wedding, a small
[1:01:52]
family wedding if they were hosting the
[1:01:54]
reception in their backyard or a
[1:01:56]
graduation party and they wanted to play
[1:01:57]
music in their backyard. Those requests
[1:02:00]
went to the police department. That
[1:02:02]
inquiry went to the police department
[1:02:04]
and much like a permission to park uh
[1:02:09]
contrary to posted signage, those
[1:02:12]
requests go to the police department and
[1:02:14]
the police department would assess the
[1:02:15]
situation and say this isn't going to
[1:02:18]
work or what exactly were you thinking
[1:02:20]
of as far as amplified music? How can we
[1:02:23]
help you make this be a success?
[1:02:26]
understand that the ordinance is still
[1:02:28]
in effect and if you try to do this and
[1:02:31]
if we get complaints
[1:02:33]
I'm going to send an officer down and
[1:02:34]
the officer is going to tell you
[1:02:36]
reposition your speakers turn it down or
[1:02:38]
shut it off and if we continue to get
[1:02:40]
you're going to have to shut it off but
[1:02:42]
the requests that were considered were
[1:02:44]
always the ones that I have personal
[1:02:46]
experience with were for some personal
[1:02:49]
event that was happening on the property
[1:02:51]
and it was relatively small scale I am
[1:02:54]
told by Mike the city clerk and by the
[1:02:57]
mayor that in the past requests have
[1:03:00]
gone to city council for events such as
[1:03:02]
this. Uh and again the ordinance doesn't
[1:03:06]
give a process for obtaining the permit.
[1:03:09]
It's prohibited but it says unless the
[1:03:12]
city expressly allows it. So when Mike
[1:03:16]
was approached by the organizer of this
[1:03:20]
event,
[1:03:22]
Mike referred him, we contacted the
[1:03:24]
mayor and referred him to city council
[1:03:26]
as far as having it put on the agenda
[1:03:30]
for council to consider.
[1:03:33]
Council certainly can do whatever they
[1:03:35]
want. This is exactly the type of an
[1:03:38]
event that we as a individual person
[1:03:42]
think that it'd be great to attend on a
[1:03:44]
football Saturday. But as city
[1:03:46]
administrator and reading through the
[1:03:48]
ordinances, again, I read this to be
[1:03:50]
prohibitive. This event is not uh the
[1:03:54]
organizer. This is a a young and
[1:03:57]
upcoming band that that they would like
[1:04:00]
to promote and get some exposure. The
[1:04:02]
property that they are proposing putting
[1:04:04]
it on is down the corner of Boer and uh
[1:04:09]
Melrose. Will it excessively contribute
[1:04:13]
to the noise that is already going on on
[1:04:15]
the other side of the bridge on a
[1:04:16]
football Saturday? No, I don't think so.
[1:04:18]
I don't think that it will. Will it
[1:04:20]
contribute to fun in the streets? Yeah,
[1:04:23]
I think that it probably will. But I
[1:04:25]
still think the ordinance is prohibitive
[1:04:27]
from a staff perspect
[1:04:29]
perspective. I think the ordinance is
[1:04:31]
prohibitive and having dealt with this
[1:04:33]
before when for example the hotel wanted
[1:04:37]
to and did host a band out there. I mean
[1:04:39]
I think that I believe that the purpose
[1:04:45]
of the ordinance was so that council did
[1:04:47]
not have to consider these on a
[1:04:49]
case-byase basis and set some very rigid
[1:04:52]
guidelines.
[1:04:53]
uh it does allow somebody to come in and
[1:04:56]
petition council uh and it is certainly
[1:04:59]
within council's prerogative to approve
[1:05:02]
this but I just wanted to share the
[1:05:04]
history and the thank you my orders. I
[1:05:08]
think that we have council approved
[1:05:12]
football rules and regulations and I
[1:05:14]
asked Mike to put them up and I thought
[1:05:17]
putting this on the agenda might be good
[1:05:20]
at the beginning of the season so people
[1:05:23]
can see that this is what council likes.
[1:05:27]
And if you look down to maybe number
[1:05:31]
five or so or
[1:05:33]
>> it quotes ordinance 159 which is the
[1:05:35]
ordinance that I was reading and then it
[1:05:37]
specifically calls out that there's no
[1:05:39]
amplified music.
[1:05:40]
>> Yeah. No amplified music. So, I think
[1:05:44]
that answers the question and this is,
[1:05:46]
you know, football, but Troy, it's good
[1:05:50]
to go through the history of it and what
[1:05:52]
our ordinance says and uh I think it
[1:05:56]
doesn't need to go in front of the
[1:05:58]
council.
[1:05:59]
>> No, a council
[1:06:00]
>> with uh
[1:06:01]
>> council certainly has the prerogative to
[1:06:03]
do whatever they want. So, I want to
[1:06:05]
make sure that they're aware of that and
[1:06:06]
the petitioner in this case was referred
[1:06:09]
to. So, I'm letting I'm letting that
[1:06:12]
happen. I mean, I I I did not send it to
[1:06:14]
Chris.
[1:06:14]
>> The other thing that's happened was some
[1:06:16]
outdoor vending of merchandise or food
[1:06:20]
on private property and that also
[1:06:24]
happened this game. And so I think it's
[1:06:27]
good to bring this to the attention of
[1:06:30]
all the residents in a public meeting
[1:06:33]
that these things are not allowed and uh
[1:06:37]
unless council wants to consider this
[1:06:43]
» this
[1:06:44]
request
[1:06:49]
or a speaker
[1:06:50]
>> not an ampi speaker
[1:06:53]
>> what's the difference there I a regular
[1:06:56]
like they're the regular speakers aren't
[1:06:59]
going to last like my TV speakers might
[1:07:03]
get really loud but not to
[1:07:06]
>> Right. Well, it can get pretty loud.
[1:07:09]
>> Yeah. on
[1:07:10]
>> we've we've had other experiences
[1:07:13]
>> houses you know I mean we have several
[1:07:15]
houses that we've had
[1:07:18]
on both sides of that have big steepers
[1:07:22]
I mean the red practices on grand avenue
[1:07:26]
that uses amplifiers
[1:07:29]
>> you can't they're they don't use the
[1:07:32]
fire department but like you have you
[1:07:34]
have to like walk at the there
[1:07:37]
>> point of this is
[1:07:38]
>> I I'm just asking
[1:07:39]
>> we said that you know I'm paying but
[1:07:43]
day there's a reason that we have
[1:07:45]
business
[1:07:48]
that the council for Nick Avenue
[1:07:51]
>> I I have a good question the outer
[1:07:53]
vending merchandise is food included in
[1:07:56]
that if I'm paying for all of it and
[1:07:58]
just the people
[1:08:03]
» you're allowed you're allowed to sell or
[1:08:04]
bend any any item that is
[1:08:07]
>> or that is prepared on their body. So
[1:08:10]
technically
[1:08:12]
>> like Maggie's game last year, we got ice
[1:08:14]
people coming this
[1:08:15]
>> the Girl Scouts couldn't go buy water
[1:08:18]
from the store and
[1:08:21]
>> yet they could make lemonade and sell
[1:08:22]
lemonade. So, uh, and as far as the in
[1:08:25]
application, Tim, as far as the noise
[1:08:28]
ordinance, I mean, the noises that are
[1:08:29]
allowed on football game because it's to
[1:08:31]
the disturbance of the neighborhood are
[1:08:33]
different than what would be allowed on
[1:08:36]
a Tuesday night because if I'm down on
[1:08:39]
in Mike's backyard on golf, I have to be
[1:08:43]
able to be heard over the sound that is
[1:08:44]
coming, you know? So, it's it's not like
[1:08:46]
there's some riskreward that's in in
[1:08:48]
effect, but it is to the disturbance of
[1:08:50]
the neighborhood. And in this case
[1:08:53]
particular it's it's a it's a band that
[1:08:57]
is is playing purely or being asked to
[1:09:00]
perform purely to promote
[1:09:03]
the band.
[1:09:04]
>> Yeah. And that event but there's nothing
[1:09:07]
there's no admission being charged. Let
[1:09:08]
me be clear of that. There's no
[1:09:09]
admission being charged. It is purely
[1:09:12]
for exposure for the van.
[1:09:14]
>> Are the owners of the property are they
[1:09:15]
there that day?
[1:09:16]
>> They are not. It is a rental property.
[1:09:19]
uh that the owners I've not talked to
[1:09:21]
them but Mike has confirmed that they
[1:09:23]
>> I have spoken to them and they're aware
[1:09:26]
of the resident and the owners
[1:09:31]
that there's
[1:09:33]
>> the owner was approached by the
[1:09:35]
organizer promoter of this event and
[1:09:37]
said hey could I do this and you and the
[1:09:39]
owners of the property said we don't
[1:09:42]
care
[1:09:44]
in the concert a couple years ago Kitty
[1:09:46]
corner
[1:09:48]
That was a city function. So that's
[1:09:50]
different.
[1:09:51]
>> That is allowed and it wasn't Yeah.
[1:09:58]
» I asked the police to look at how
[1:10:02]
>> I mean it's on a postage staff property.
[1:10:05]
>> Yeah.
[1:10:05]
>> In the center of the city with thousands
[1:10:10]
of people going by and the space they'd
[1:10:13]
have whether they'd be in the front yard
[1:10:14]
or the backyard. And you said you'd
[1:10:17]
check out this last game what they were
[1:10:20]
doing and I guess you took some pictures
[1:10:23]
>> and before Chris chats just also for
[1:10:25]
perspective of council
[1:10:28]
there's point there has been a change in
[1:10:30]
how Stella is doing service across the
[1:10:33]
street they were directed by city to
[1:10:36]
push their outdoor bar five feet I'm
[1:10:38]
sorry 3 feet I believe closer to the
[1:10:40]
building in part because the city was
[1:10:43]
concerned about the congestion on the
[1:10:45]
sidewalk. up in the street and the
[1:10:47]
ability of people to move freely past.
[1:10:51]
>> I think that same concern comes in if
[1:10:54]
you've got a band.
[1:10:55]
>> When I walk by the Yeah. You're looking
[1:10:58]
and I shared at that point. Yeah.
[1:11:00]
>> I think that it's reasonable to have
[1:11:02]
that same concern if a band is playing
[1:11:05]
>> across the street.
[1:11:06]
>> Yeah.
[1:11:08]
>> Well, anyway, Chief, if you were going
[1:11:09]
to report, you have some pictures.
[1:11:11]
>> I've got four photographs. Uh, three of
[1:11:14]
the backyard. Uh, the backyard is
[1:11:18]
pretty well eaten up by parking. Uh,
[1:11:21]
when I went back there, there was
[1:11:22]
probably,
[1:11:24]
I'm going to guess, we're estimating
[1:11:26]
between 50 and 75 people, maybe a few
[1:11:29]
more in there. Uh, parking, like I said,
[1:11:32]
it eliminated
[1:11:34]
the cars are only one deep, but, uh, it
[1:11:38]
ate up a lot of the parking stall. Um
[1:11:41]
the front of the building has got had a
[1:11:46]
recent remodel. Um
[1:11:49]
if it were to occur there, the backyard
[1:11:53]
would be the better choice of the two.
[1:11:57]
Uh but with the parking,
[1:12:00]
I don't think that's I don't think
[1:12:01]
that's possible. Uh, and the Bright
[1:12:05]
Yard, I think, would do something similar to what Stellas would
[1:12:10]
do where it's pushing people out,
[1:12:12]
especially if there was any attendance
[1:12:14]
at all. Um, and there, my understanding
[1:12:17]
is the gentlemen that are in this band
[1:12:20]
are local, so they would have, I would
[1:12:23]
imagine, a small
[1:12:25]
a following of sorts.
[1:12:27]
So that's uh that would be the front
[1:12:30]
yard
[1:12:31]
uh as it was set up on Saturday
[1:12:38]
and there is some parking some vehicles
[1:12:40]
parked there but also a number of people
[1:12:43]
tailgating and and picnicking.
[1:12:47]
>> The bottom line is that thinks it's a
[1:12:48]
fun event but that it's contrary
[1:12:54]
» green thanks for that sheet. Thank you.
[1:12:57]
Uh, does council want to consider this?
[1:13:02]
Sorry. Interested in considering this or
[1:13:07]
it's not just this and it's in front of
[1:13:09]
them. It's precedent and then we go back
[1:13:12]
to where we were going to put my house
[1:13:15]
on.
[1:13:18]
» Well, and you're saying so future people
[1:13:22]
will say, well, they had how can we say
[1:13:24]
no to them? Exactly. Or they won't even
[1:13:28]
bother. They'll just say, "Oh, they had
[1:13:30]
a bandwidth." I mean, they know this has
[1:13:33]
happened. And my concern was just that
[1:13:36]
we've already said the trust. We haven't
[1:13:40]
we still have the ability to have people
[1:13:43]
complain about what they're being
[1:13:45]
stirred by. We have to say something to
[1:13:47]
you. But if we kind of lose that, we
[1:13:50]
say, "Oh,
[1:13:52]
I don't
[1:13:56]
I think that Nick could say you're not
[1:14:00]
dis I think that yeah the president is
[1:14:03]
you
[1:14:04]
can make noise but if you have a
[1:14:06]
neighbor um complain then it'll get shut
[1:14:10]
down
[1:14:11]
>> and that is much easier to do when the
[1:14:14]
police have had contact with them first
[1:14:16]
and it's again a speaker in the backyard
[1:14:19]
for a graduation party as opposed to a
[1:14:21]
band that's playing. It's an advertised
[1:14:23]
event for people that come listen to the
[1:14:25]
van. The reaction is hugely different
[1:14:27]
when the organizers
[1:14:30]
of that graduation party first of all
[1:14:32]
are trying to comply and not disturb
[1:14:33]
their neighbors and know that they might
[1:14:36]
have to shut it off and it doesn't
[1:14:39]
clear that potential riot in the street
[1:14:46]
for you to go and explain that.
[1:14:50]
>> Okay. I'm going to ask a personal
[1:14:51]
question, but just because I want to
[1:14:53]
make sure I'm not like making an
[1:14:54]
exception for myself. Um, so in the past
[1:14:57]
we have had a food truck and this
[1:15:00]
weekend have someone coming that I've
[1:15:02]
gotten permission to park on
[1:15:06]
place in the street for the couple hours
[1:15:07]
that they're there. Should I have them
[1:15:09]
park on my lawn?
[1:15:11]
>> Is that
[1:15:13]
>> I purchase it's all prepaid once.
[1:15:16]
>> You're just giving it away. But I'm like
[1:15:18]
I there I've gotten permission to park
[1:15:20]
on the street before and if that's not
[1:15:21]
allowed then I shouldn't be an
[1:15:23]
exception.
[1:15:24]
>> That's that that's basically catering.
[1:15:26]
>> Yeah.
[1:15:26]
>> You have I'm saying because I have them
[1:15:29]
parked on the street. We don't do street
[1:15:31]
parking. Am I getting the except Is that
[1:15:33]
an exception that
[1:15:35]
>> No.
[1:15:35]
>> Okay. Like should I have them park in my
[1:15:37]
grass?
[1:15:38]
>> I think you ought to have them park on
[1:15:40]
the lot.
[1:15:41]
>> I would agree. still going to be looking
[1:15:44]
>> get to park on the street and I don't
[1:15:46]
get you know I mean being your neighbor.
[1:15:48]
Yeah, that's what you're saying.
[1:15:49]
>> That's what I'm saying. Like I don't
[1:15:50]
want it to look like I get an exception
[1:15:52]
by doing
[1:15:53]
>> if they're if they are
[1:15:56]
serving from the truck as opposed to
[1:15:58]
unloading from the driver. I Yeah, I
[1:16:00]
think that that would be
[1:16:01]
>> okay. So I'll have them first. I mean
[1:16:03]
you're talking game.
[1:16:04]
>> Yeah. Yeah.
[1:16:05]
>> Yeah. Right.
[1:16:07]
That's so
[1:16:10]
easy.
[1:16:11]
That's what
[1:16:12]
>> Thanks for going through that. Troy, did
[1:16:14]
you have anything else?
[1:16:15]
>> I do not. Aaron, I apologize for being
[1:16:17]
longwinded, but she'll help me perhaps.
[1:16:21]
>> Thank you very much. We'll go to the
[1:16:22]
citizens report. Mike, we sent around a
[1:16:25]
report. My report was longer than usual,
[1:16:27]
too. Um,
[1:16:30]
>> yeah,
[1:16:30]
>> we're starting to receive regular public
[1:16:33]
records requests and the four that I
[1:16:37]
included this month, three all came from
[1:16:39]
the same place. And basically, it's an
[1:16:44]
AI data center that's looking to scrape
[1:16:47]
information. So, we've got a pretty good system now of
[1:16:53]
looking doing keyword searches for what
[1:16:56]
they're looking for. And I happened to
[1:16:58]
reply to them yesterday at 11:00, you
[1:17:01]
know, on Labor Day that no, we don't
[1:17:03]
have any of those. Immediate response
[1:17:06]
back. Well, thank you. We'll take that
[1:17:07]
off our we'll take that off our list.
[1:17:09]
So,
[1:17:11]
uh, yeah, I I think I think that's going
[1:17:14]
to come pretty regularly. Now, I will
[1:17:15]
say we did have one additional I don't
[1:17:18]
know if if anybody ever looked through
[1:17:20]
all this. We did actually have a student
[1:17:22]
ask us and it was somebody from a Iowa
[1:17:25]
City school district address. So I'm
[1:17:27]
sure it's either a Westside Story or the
[1:17:30]
Little Hawk newspaper asking about the
[1:17:33]
city's dealing with slot cameras to
[1:17:35]
which I could also say so we haven't
[1:17:38]
done anything. So
[1:17:41]
uh you may see more of these as as they
[1:17:43]
come along because I think that's what
[1:17:45]
it is. It's a lot of data scraping and
[1:17:47]
that's what they want is to look for
[1:17:49]
stuff from us there. I do have one other
[1:17:52]
fun thing to talk about. Um, Sunday,
[1:17:55]
October 4th, the Johnson County
[1:17:58]
Historical Society will be having their
[1:18:00]
annual celebration of history event
[1:18:02]
right here in the community center. They
[1:18:04]
reserve the community center. This is
[1:18:06]
their annual meeting as a nonprofit and
[1:18:10]
they are going to focus on University
[1:18:12]
Heights and they've got some guy
[1:18:14]
speaking for 15 minutes about University
[1:18:16]
Heights history.
[1:18:17]
>> What day is that?
[1:18:18]
>> That's Sunday, October 4th.
[1:18:21]
>> Some guy some guy may be telling you
[1:18:24]
about it. So
[1:18:29]
I think I I I've got 15 minutes worth of
[1:18:31]
material I think. So, um,
[1:18:34]
>> but that'll be there. And there's it's,
[1:18:37]
uh, they're going to have refreshments
[1:18:38]
and things. There tickets that are free.
[1:18:41]
They just want to get a count to get an
[1:18:43]
idea for how much food to bring and
[1:18:45]
things like that. So, I'll I'll make
[1:18:48]
sure that Lisa gets the full details and
[1:18:50]
puts them on the web page. But since
[1:18:51]
it's before next month's meeting, this
[1:18:54]
month's meeting is as early as possible,
[1:18:56]
next month's meeting is almost as late
[1:18:58]
as possible.
[1:18:59]
>> So, yeah.
[1:19:00]
So, just to let you know about that, but
[1:19:02]
that's all I have.
[1:19:04]
>> Thanks so much. Any any questions for
[1:19:06]
Mike? We'll go on to John Brown, the
[1:19:09]
treasures report, date of the bills. Hi,
[1:19:11]
John.
[1:19:12]
>> Hey, thank you very kindly, mayor. Uh,
[1:19:14]
business as usual for the city. Uh, a
[1:19:17]
few items that uh
[1:19:20]
I will speak to. Um, I do have one item
[1:19:24]
to add to Mr. warrants and fairy
[1:19:26]
brothers for $150 for paid by
[1:19:30]
maintenance.
[1:19:32]
And um
[1:19:35]
I said business as usual, but the local
[1:19:38]
option sales tax deposit uh that came in
[1:19:41]
this month was
[1:19:44]
drastically lower than what we've been
[1:19:46]
getting. So me and my esteemed colleague
[1:19:50]
Steve P will be meeting tomorrow for
[1:19:53]
other things, but we're going to
[1:19:55]
uh try to do some mental
[1:19:59]
uh six more but soon because other
[1:20:04]
neighboring municipalities have engaged
[1:20:07]
that robot cells looks like our this
[1:20:12]
could be an adoration or
[1:20:15]
>> summer is slower
[1:20:17]
sometimes you know and once fall picks
[1:20:20]
up I don't know but I
[1:20:23]
I'm sorry.
[1:20:26]
>> Oh, really?
[1:20:26]
>> Oh, I mean we got five more than five
[1:20:29]
grand. I mean, it's like drastically. Uh
[1:20:33]
it's enough that
[1:20:35]
Steve and I are going to get together
[1:20:37]
figure out can some
[1:20:40]
try to get some intel, talk to area.
[1:20:44]
>> They miscount delivery.
[1:20:47]
>> Well, no, it's always possible. I'm not
[1:20:49]
trying not a little saying. and just
[1:20:52]
say, "Hey, we we got something that's
[1:20:54]
really caught our eye, but we're going
[1:20:56]
to look into it and we're going to get
[1:20:58]
you intel and banks out to you because,
[1:21:01]
>> you know, we don't want to ignore it and
[1:21:02]
we're getting mid gear or whatever, like
[1:21:05]
we got money problems."
[1:21:11]
» Yeah.
[1:21:12]
>> So, with that addition to the warrants,
[1:21:14]
you have the list of warrants are there
[1:21:17]
along with Ryan's payments that he asked
[1:21:20]
for. Are there any other additions or
[1:21:24]
corrections? Or are there any objections
[1:21:27]
to paying the Lawrence?
[1:21:31]
Hearing none, the warrants will be paid
[1:21:33]
by unanimous consent.
[1:21:36]
Thank you. Uh
[1:21:39]
thanks for pointing that out. That's
[1:21:45]
um
[1:21:46]
we'll go on to uh finance. You have
[1:21:49]
anything this month, Nick M?
[1:21:51]
>> No.
[1:21:52]
>> Thank you. We'll go to community
[1:21:54]
protection fan achievement this year.
[1:21:59]
» And I saw your report.
[1:22:02]
I don't have a lot to add to the report.
[1:22:04]
Uh Saturday was an experience. We had a
[1:22:07]
lot of heat and net. Didn't help
[1:22:10]
anybody. Uh but everything was
[1:22:12]
manageable. Um, and it went the game
[1:22:16]
pretty much went off without too many
[1:22:18]
complications. So,
[1:22:20]
>> other than it was terribly hot.
[1:22:22]
>> Yes.
[1:22:23]
>> And I know you said you got water for
[1:22:26]
everyone. I saw you had water with
[1:22:28]
carrying with you. That was very good.
[1:22:31]
>> We did that.
[1:22:32]
>> We're uh we're getting better and better
[1:22:35]
about stocking the golf carts and what
[1:22:37]
we have on it. Anywhere from medical
[1:22:39]
needs to water to things like that. So,
[1:22:42]
uh, and it's probably there or the
[1:22:44]
bicycles are probably the best ways to
[1:22:46]
get around this city at game day.
[1:22:50]
>> Any questions for cheaper?
[1:22:54]
>> Thank you very much. The fy features I
[1:22:56]
added this month. No,
[1:23:00]
we'll go on to engineers boards. We
[1:23:03]
don't have much, right, Ryan?
[1:23:07]
>> What a busy
[1:23:09]
board.
[1:23:12]
Yeah, it's been a busy month to try to u
[1:23:15]
especially as you talked about last
[1:23:16]
month. Um we had some projects that were
[1:23:19]
kind of I guess I say stalling out right
[1:23:21]
a little bit taking a long time but um
[1:23:24]
thankfully I'm happy to report that the
[1:23:27]
one in particular of the street got paid
[1:23:29]
back just in time for else. So um I did
[1:23:33]
issue um just an updated report uh with
[1:23:36]
the holiday yesterday. I wasn't able to
[1:23:38]
get all the signed documents I usually
[1:23:40]
need uh for my report to issue to you
[1:23:43]
like we asked for updates to um uh pay
[1:23:47]
applications changes and quantities
[1:23:49]
around. So I got most of I got all that
[1:23:51]
stuff this morning once everybody was
[1:23:52]
returned from the holiday. So uh
[1:23:55]
included those signed versions with my
[1:23:56]
updated report that I sent out this
[1:23:58]
morning. Uh for I'll just kind of go
[1:24:00]
through the lists hopefully fairly
[1:24:03]
quickly here. the Melrose complete
[1:24:04]
street project. We did submit the design
[1:24:07]
team finished up and submitted uh the
[1:24:09]
check plan submitt to the DOT. I have a
[1:24:11]
DOT. Um so the DOT does review. We have
[1:24:15]
a couple um a couple spots where we add
[1:24:18]
some water main work uh to try to avoid
[1:24:21]
conflicts with the design the storm
[1:24:23]
shore design. So we'll we'll have to
[1:24:25]
review that with the city of our city
[1:24:27]
this month as well. And then we we have
[1:24:29]
a final plan submitt to the DOT on
[1:24:31]
October 20th. So those those dates are
[1:24:34]
rigid. They have to be done by those
[1:24:36]
dates in order to hit the the leting uh
[1:24:39]
the bid dates uh for the DOT's
[1:24:42]
scheduling. Um our RFBs at Sunset and
[1:24:46]
Orest. So this one I I I did receive a
[1:24:49]
final invoice from New Miller Electric
[1:24:52]
um for the our RFBs, the the new bowls
[1:24:55]
and flashing beacons at Sunset and
[1:24:56]
Orrest Street. Um, so this one I do have
[1:24:59]
a resolution for just to uh make sure I
[1:25:03]
read it off correctly.
[1:25:05]
Um, so resolution number 2661 is
[1:25:09]
accepting the Sunset Street and Norris
[1:25:11]
Avenue rectangular rapid flashing beacon
[1:25:14]
RFB signs project as completed and that
[1:25:18]
is essentially just to release
[1:25:20]
retainage. We'd already paid for all the
[1:25:23]
u the project work um up to this point
[1:25:25]
except for the retainage amount of
[1:25:27]
$668.16.
[1:25:29]
So the invoice number two is final from
[1:25:32]
memory electric was included in the
[1:25:34]
Lawrencees as well. So move we'll do
[1:25:38]
that now motion second
[1:25:41]
by Tim.
[1:25:43]
Okay, with discussion
[1:25:46]
roll call vote
[1:25:47]
>> second.
[1:25:50]
Sorry.
[1:25:51]
>> No, that's okay. Dwire
[1:25:53]
>> I
[1:25:54]
>> Herbald.
[1:25:54]
>> Hi.
[1:25:55]
>> Moore.
[1:25:55]
>> Hi.
[1:25:56]
>> Sher. I
[1:25:58]
>> swelles absent. Motion carries. 401
[1:26:01]
absent.
[1:26:06]
And I haven't heard any complaints from
[1:26:07]
the police department yet for the start
[1:26:09]
of school year up there. So hopefully
[1:26:10]
that's going pretty well. Good news. All
[1:26:13]
right. Good news is the young people are
[1:26:15]
becoming very accustomed to
[1:26:18]
that. That'll be correct.
[1:26:20]
>> Yeah. Excellent. It's good to hear. Um
[1:26:24]
Melrose Avenue 2026 electrical service
[1:26:26]
relocations. I did have an agenda item
[1:26:28]
here to uh award approve award of this
[1:26:32]
contract. I decided to defer that to the
[1:26:34]
special meeting we have planned for the
[1:26:36]
22nd in a couple weeks here. Uh, a
[1:26:39]
couple reasons which I laid out in my
[1:26:41]
report, but one was mostly Tim Tim
[1:26:43]
Greenwood from Steve's office was
[1:26:45]
working with um working on an agreement
[1:26:48]
with Paul Moore uh for some
[1:26:50]
reimbursement of the electrical upgrades
[1:26:52]
he wanted made to the system. So, those
[1:26:54]
were included with our design um and our
[1:26:57]
bid package. Um, and so just wanted to
[1:27:01]
give us a little bit more time to get
[1:27:03]
that coordinated with Paul, make sure
[1:27:04]
everybody feels good and comfortable for
[1:27:06]
signing that. and also so I can report
[1:27:08]
to Paul what the bid numbers were and
[1:27:10]
then also give me a little more time to
[1:27:12]
follow up with this uh bidder uh and get
[1:27:16]
some experience. Uh the Gumble
[1:27:18]
electrical engineers I spoke with hadn't
[1:27:20]
worked with this contractor before. They
[1:27:22]
are headquartered out of Minnesota. They
[1:27:24]
do work in Wisconsin, Iowa, uh the
[1:27:27]
Dakotas, generally the Midwest and um
[1:27:30]
region. Um they do a lot of solar work.
[1:27:33]
Um, I'm told schools, cenos, and stuff
[1:27:37]
of that nature. Um, so I'll just get
[1:27:39]
involved with them. So, we work on some
[1:27:41]
example projects. So,
[1:27:44]
the
[1:27:46]
idea
[1:27:46]
>> 1007 109 Milrose Avenue driveway
[1:27:49]
improvements sod was installed. You saw
[1:27:51]
photos of that yard. New driveway. Uh,
[1:27:54]
it was parked on this weekend. Um, so
[1:27:57]
they've been watering that side. We are
[1:27:59]
punch list. I've issued a punch list to
[1:28:01]
the contractor. We're just re wrapping
[1:28:03]
up a few things. Um I'll probably reach
[1:28:05]
out to them to see if I can get a payout
[1:28:07]
potentially for the special meeting in
[1:28:08]
September and try and get that one
[1:28:11]
brought up. They didn't submit anything
[1:28:12]
this this last week. Uh overhead to
[1:28:15]
underground utility trench. Um we've got
[1:28:19]
constructions completed uh from the
[1:28:22]
bridge to 1135 Melrose, which is to the
[1:28:25]
west of the curve around Melrose. uh
[1:28:28]
they weren't able to provide extra crews
[1:28:30]
and were due to the ongoing road
[1:28:34]
construction at George Street. So um I'm
[1:28:38]
told they would have mobilized extra
[1:28:40]
crews and board rigs if had they had the
[1:28:42]
opportunity um in the space to work. Um
[1:28:45]
so that project is behind schedule. Um,
[1:28:48]
but they'll work in between games and
[1:28:51]
hopefully they should be I believe they
[1:28:54]
should be done by the end of September
[1:28:55]
now, but they'll have to mobilize in and
[1:28:57]
mobilize out every week um for the three
[1:29:00]
home games in a row here and clean
[1:29:02]
things up and they'll have to do shorter
[1:29:04]
smaller segments
[1:29:06]
uh of uh boring or trenching the new
[1:29:08]
conduits uh around the George Street
[1:29:11]
Back
[1:29:12]
um
[1:29:14]
and Melrose Avenue area. So, uh, that project, we do have a change order,
[1:29:21]
uh, on the agenda tonight, um, or on my
[1:29:24]
in my report tonight. This was, um, for
[1:29:27]
some extra work at the hotel driveway.
[1:29:29]
Um, they they hit an unmarked water
[1:29:31]
service. I believe it's to the
[1:29:33]
residential property that Greg Stillner
[1:29:36]
owns right there at the entrance. Um, so
[1:29:38]
they had to do an emergency repair and
[1:29:40]
remove pavement there that wasn't
[1:29:41]
anticipated to be removed. So, we added
[1:29:43]
line items for 8 in pavement uh modified
[1:29:47]
subbase and uh pavement markings to
[1:29:50]
replace the pavement markings that were
[1:29:52]
referred for Greg there at the hotel. Um
[1:29:55]
so there's that work and then Mid
[1:29:57]
American Electric in our discussions
[1:29:59]
with them during design uh they
[1:30:02]
indicated they would handle installation
[1:30:03]
of conduits from secondary enclosures
[1:30:05]
which are handles between their system
[1:30:09]
and then the private services the meters
[1:30:11]
at the couple residential properties
[1:30:15]
uh during construction they've asked if
[1:30:16]
we would have Midwest Underground
[1:30:18]
install those. So we did not have a line
[1:30:19]
item for the size conduit the 2 and 1/2
[1:30:22]
in conduit that they need for that. So
[1:30:24]
this change order also adds a line item
[1:30:26]
with a unit price of $14 a linear foot
[1:30:29]
of install only the kind that is
[1:30:31]
provided by Mid American Electric. So um
[1:30:34]
the total cost of that change orders
[1:30:37]
$4564.50.
[1:30:40]
So
[1:30:42]
um I don't know if we could have a
[1:30:44]
simple motion just to approve that
[1:30:46]
change order. M please.
[1:30:49]
So moved
[1:30:50]
>> motion by Nick second second by
[1:30:53]
McKenzie.
[1:30:55]
So this a simple motion. All in favor?
[1:30:59]
>> Say I.
[1:31:00]
>> Anyone oppose? Motion carries 4 zero and
[1:31:03]
one absent.
[1:31:05]
>> Thank you Ryan. And then uh for that
[1:31:07]
same project, the joint joint trench
[1:31:09]
project uh we had a pay application um
[1:31:12]
pay application number two was for
[1:31:14]
$137,000213
[1:31:18]
23 I'm sorry $137,21322.
[1:31:24]
Um we review those and agree they they
[1:31:27]
represent the amount of work that's that
[1:31:28]
was performed since last pay
[1:31:30]
application. So recommend approval of
[1:31:33]
that uh amount and it's included in the
[1:31:35]
mark.
[1:31:37]
So um
[1:31:42]
back
[1:31:44]
>> you need to do that right now.
[1:31:48]
>> I don't think I need anything extra
[1:31:49]
unless anybody's got that on the
[1:31:51]
warrants.
[1:31:52]
>> It's on the warrants. Yeah. So I don't
[1:31:53]
need anything special for for that
[1:31:55]
unless anybody's got it. Thank you.
[1:31:56]
>> I thought I saw it under warrants. Yep.
[1:31:58]
>> Yeah, it was including warrants.
[1:32:01]
Um,
[1:32:08]
yeah. So, there's more detail in the
[1:32:09]
report on that, all that stuff. But, uh,
[1:32:12]
Melrose Avenue panel replacements. This
[1:32:14]
is the the project that was supposed to
[1:32:16]
be from Sunset down to George Street,
[1:32:19]
replacing panels on Melrose and doing
[1:32:21]
some underground utility work um along
[1:32:24]
Melrose and and at the George Street
[1:32:26]
intersection. We have reduced their
[1:32:28]
scope down to just finish what they had
[1:32:30]
started uh which is detailed in my
[1:32:32]
report here um by issuing an instruction
[1:32:34]
to the contractor to just uh
[1:32:38]
finish the phase that they had begun and
[1:32:40]
then not continue the the remaining
[1:32:42]
phases of work which would have included
[1:32:44]
a detour on Mars Avenue and Eric as
[1:32:46]
we've talked about bridges. Um
[1:32:50]
they got the paving in. Um they
[1:32:53]
completed the final segment of sidewalk
[1:32:55]
today on the west side of George Street.
[1:32:58]
So they got that removed and replaced
[1:32:59]
today. Um so all things are looking
[1:33:02]
pretty good for this weekend that we
[1:33:04]
shouldn't have a huge muddy mess over
[1:33:07]
there. They should be able to get the
[1:33:08]
rest of that area rocked in uh on 1215
[1:33:11]
Melrose. Um
[1:33:12]
>> that was the part that damaged. Is that
[1:33:14]
on place there? No, that was this is
[1:33:16]
just part of the originals.
[1:33:18]
>> The damaged parts. I'm probably going to
[1:33:21]
we'll talk about that at our next
[1:33:22]
progress meeting with that. I think I'm
[1:33:24]
going to probably have them wait until
[1:33:26]
we have a 3-week window in October um or
[1:33:30]
by or at least in a way or by week um to
[1:33:33]
start and then they can they have some
[1:33:36]
driveway pavement they've damaged and
[1:33:37]
some sidewalks they've damaged that
[1:33:39]
we'll need to remove and replace. So,
[1:33:41]
um,
[1:33:42]
we just haven't gotten that far far yet,
[1:33:45]
but that that would be kind of a
[1:33:48]
punchless little wrap-up thing and the
[1:33:51]
gravel in next yard that I got to get
[1:33:53]
something.
[1:33:54]
>> Uh, I might have to take a 5 gallon
[1:33:56]
bucket.
[1:33:58]
>> Are you going to wash down that street
[1:34:00]
again before Iowa State gets so dusty?
[1:34:04]
Residents are
[1:34:06]
>> upset.
[1:34:08]
Um there's potential I'll speak with I
[1:34:12]
they're just not really responding to my
[1:34:14]
requests to do certain things at home.
[1:34:16]
>> Well, it might rain tonight.
[1:34:20]
» Yeah, severe thunderstorm.
[1:34:23]
>> So,
[1:34:24]
>> here it is.
[1:34:27]
Chance of rain today. So,
[1:34:28]
>> I I
[1:34:30]
emergency managed. I just thought of
[1:34:32]
that.
[1:34:34]
Uh this project I've also got u they
[1:34:36]
have an intake left to set and then
[1:34:38]
board the street the intake throw back
[1:34:40]
and then uh they'll just be back filling
[1:34:42]
siding the parkways. Uh just so council
[1:34:45]
knows I I think this is new since our
[1:34:48]
last meeting. I spoke with both
[1:34:49]
properties on either side of George
[1:34:51]
Street and both elected to have their
[1:34:55]
yards rocked in for the football season.
[1:34:57]
So they will remain locked until we next
[1:35:00]
spring we we will have to dig that out
[1:35:02]
and saw the yards next spring. Um just
[1:35:05]
due to the amount of area that is that
[1:35:08]
was disturbed down there. Um we would
[1:35:10]
have been sing the entire yards just for
[1:35:12]
that to be destroyed with football
[1:35:14]
traffic. Uh we did the same thing at the
[1:35:16]
hotel empty lot for Greg Stner where he
[1:35:19]
agreed to let the the joint trench
[1:35:21]
contractor store equipment and materials
[1:35:23]
there uh which was very beneficial and
[1:35:25]
helpful for their operation. They've
[1:35:28]
also rocked in areas where they
[1:35:29]
disturbed we we left as much grass as we
[1:35:32]
didn't need to take out. Right. Right.
[1:35:34]
Um for the Melrose patching we have a
[1:35:38]
change order here also. This one is
[1:35:40]
because essentially just working days
[1:35:41]
they requested for various reasons. Um
[1:35:44]
there's no extra cost associated with
[1:35:46]
this one. The other thing that's added
[1:35:48]
is I'm just put in this change order
[1:35:50]
that we did reduce the scope of work for
[1:35:52]
them and that we will suspend liquidated
[1:35:55]
damages on Fridays through Mondays on on
[1:35:57]
game weekends so that they're not being
[1:35:59]
charged damages uh when we're
[1:36:01]
essentially asking or forcing them to
[1:36:03]
leave town with their equipment. Um so
[1:36:06]
not providing an option right to work on
[1:36:08]
Saturdays. So um so that's what that
[1:36:11]
change order is. Um like I said there's
[1:36:14]
no additional cost associated. So again
[1:36:17]
another simple motion on that change
[1:36:19]
order for approval. It adds three
[1:36:20]
working days. So moved.
[1:36:23]
>> Second.
[1:36:24]
>> Okay. Motion second. This is simple
[1:36:27]
motion. All in favor say I. I.
[1:36:30]
>> Is anyone opposed?
[1:36:32]
>> Motion carries four zero and one. Thank
[1:36:36]
you.
[1:36:37]
>> Yeah. And that projectation
[1:36:40]
uh pay application number three for
[1:36:42]
$78,0007
[1:36:44]
no I'm sorry $78,798
[1:36:48]
which was included in the war list as
[1:36:49]
well. Um thanks John. I got that in late
[1:36:53]
today this morning. So
[1:36:55]
>> um we had for that
[1:36:58]
>> no should that's on
[1:37:01]
>> it was in warrants. So
[1:37:02]
>> okay thank you. Then also included in
[1:37:04]
the warrants was a a font or another
[1:37:08]
invoice number two for a payment marking
[1:37:11]
word. LL Pelling was waiting on that
[1:37:14]
road project contractor before painting
[1:37:16]
the west side of Koser Melrose
[1:37:18]
intersection. And then the the
[1:37:21]
restriping between Sunset and Koser was
[1:37:24]
included with that project work. So
[1:37:27]
luckily Pelling was on that work. So we
[1:37:29]
got that all done last week. It should
[1:37:31]
be all completed. But this invoice
[1:37:34]
strictly for the the cities we pay the
[1:37:38]
parking spoke. So it was $25462.
[1:37:44]
So the only invoice remaining for that
[1:37:45]
one will be the retainage next.
[1:37:53]
Didn't have much updates on sidewalk
[1:37:55]
repair. Just a reminder that there's
[1:37:56]
going to be a grand avenue sunset
[1:37:58]
intersection water man work happening. I
[1:38:01]
didn't get a chance to get an update
[1:38:02]
from Iowa City, but what they told me
[1:38:05]
last month was September time frame was
[1:38:07]
what they were looking at that. So, I'll
[1:38:08]
reach out to them for updates. Um,
[1:38:12]
then we had Medic submit a couple
[1:38:14]
rightway permits to add the new electric
[1:38:16]
meters that we've approved new addresses
[1:38:18]
for. So, we'll be straight right away
[1:38:20]
permits.
[1:38:23]
>> I wanted to ask this media com what are
[1:38:26]
electric meters?
[1:38:28]
Uh, I don't know what there's. I think
[1:38:30]
it probably looked like a a pedestal
[1:38:33]
meter similar to where holes u added for
[1:38:38]
the the speed cameras that never went
[1:38:40]
on, right? Like at Kosure. Um,
[1:38:44]
it's a it's a meter. They need a they
[1:38:46]
need a power source apparently to to
[1:38:49]
power an amplifier for their system. And
[1:38:51]
I I'm not an expert on their um coax or
[1:38:55]
fiber networks, but they run both
[1:38:57]
coaxware and they use they they now use
[1:39:01]
like amplifiers to increase their signal
[1:39:03]
strengths is my understanding
[1:39:05]
>> from speaking with them. So they have to
[1:39:07]
play
[1:39:07]
>> so they're going to screw up my internet
[1:39:09]
again.
[1:39:10]
>> Yeah. Yeah. Probably a couple times.
[1:39:12]
Yeah. um they they they will have an
[1:39:15]
electric service there now at those two
[1:39:18]
locations that we've addressed for in
[1:39:20]
order to install these amplifiers
[1:39:25]
» for power.
[1:39:27]
>> So that's all I've got.
[1:39:29]
>> Any questions for Ryan
[1:39:31]
>> at the moment?
[1:39:32]
>> I I heard a lot of compliments about you
[1:39:34]
getting that Melrose open from people
[1:39:36]
outside of University Heights who pay
[1:39:39]
attention.
[1:39:40]
>> Yeah, I had a lot of people calling me
[1:39:43]
who had their football partners calling
[1:39:45]
them
[1:39:48]
asked, "Will more my response be
[1:39:49]
available?" And uh even the guys from
[1:39:52]
Midwest Underground on Graves Law were
[1:39:54]
there people that worked for Advanced
[1:39:57]
Traffic Control that parked there that
[1:39:59]
were messaging that
[1:40:00]
>> we were pleasantly surprised.
[1:40:02]
>> A whole lot of people interested on
[1:40:03]
that.
[1:40:04]
>> Hopefully even better before Iowa State.
[1:40:06]
>> Yeah. I would like to say, I guess just
[1:40:09]
on behalf of the the folks in my office
[1:40:12]
on that Melrose and George Street
[1:40:15]
intersection,
[1:40:16]
we had a lot of staff coming out um at
[1:40:20]
the request of the contractor for
[1:40:23]
various reasons for for compaction
[1:40:25]
testing, for um concrete testing, for
[1:40:29]
survey, um for construction saking, and things weren't ready, right? So,
[1:40:35]
they made a lot of extra trips that they
[1:40:37]
normally would not make. They were
[1:40:39]
rescheduling things because I was asking
[1:40:42]
them to. Uh, you know, pushing other work off uh and working late um a
[1:40:49]
couple of us came in on Saturday um
[1:40:52]
which then got cancelled due to rain,
[1:40:54]
but um for paving of course and things.
[1:40:56]
So, uh, I I'm just glad that everybody
[1:41:01]
dealt with my requests and we got to
[1:41:03]
have time before the fall. See you. So,
[1:41:07]
appreciate it. Thank you.
[1:41:10]
Any questions for Ryan? I
[1:41:13]
don't need to spend through enough.
[1:41:16]
>> Thank you, Ryan. We'll go to building
[1:41:18]
Sony sanitation. Do you have any update?
[1:41:20]
Okay, we'll go to P government and you
[1:41:22]
sent around a report.
[1:41:25]
>> And uh you have any questions for Lisa's
[1:41:28]
report
[1:41:30]
and does anyone have announcements that
[1:41:33]
>> I will not be here next month. I will
[1:41:36]
not I would be so I will not be next.
[1:41:44]
» We go on to adjournment.
[1:41:47]
Is there any objection to adjournment?
[1:41:50]
Hearing none, the meeting is adjourned
[1:41:51]
by unanimous consent. Thanks everyone.
[1:41:53]
Thanks for coming.
