[1:46:14] ORD-2020-768 : Consider an ordinance amending Chapter 26 “Utilities” of the Code of Ordinances of the City of Waco, Texas, by adding a new Article X entitled “Municipal Drainage Utility System”; providing for definitions; making required findings; establishing a municipal drainage utility system; adopting Subchapter C of Chapter 552 of the Texas Local Government Code; declaring the drainage of the City to be a public utility; establishing the service area; establishing a drainage utility fee; providing for categories of drainage utility rates; providing for billing of drainage utility fee and penalties and remedies for nonpayment; creating a drainage utility fund; providing for administration of this Article X; providing for an appeal and hearing process; providing for exemption; providing for no waiver of immunity; providing that the City may issue drainage revenue bonds; providing for discontinuation of drainage system; prohibiting access to stormwater drainage infrastructure unless designated as open to the public; and providing for hours of operation if open to the public. [1:46:14] PH-2020-769 : Conduct a public hearing and consider a resolution adopting the Schedule of Drainage Charges for the Municipal Drainage Utility System in the City of Waco, providing that the effective date to begin charging the fees as shown in the Schedule of Drainage Charges for the Municipal Drainage Utility System and issuance of bills for said fees will be October 1, 2021, and providing that the Fiscal Year 2020-21 operating budget fee schedule for the drainage utility fund is hereby amended to include the Schedule of Charges for the Municipal Drainage Utility System.
[1:46:14] PH-2020-770 : Conduct a public hearing and consider an ordinance amending the Project and Financing Plan for Reinvestment Zone Number One for Tax Increment Financing ("TIF" or "TIF Zone One") to: (1) provide TIF funds in an amount not to exceed $350,000.00 to Heritage on Webster LLC, for public improvements associated with the development of a mixed-use development at 823 Webster Avenue, 416 S. 9th Street, and 418 S. 9th Street; (2) amend the agreement with SRH Hospitality Waco Downtown Investments, LLC, to provide an extension of the project completion date, reallocate TIF funds among portions of the project, and additional contractual changes associated with the construction of a Marriott AC hotel at 301 and 325 S. 6th Street; (3) amend the agreement with Czech Brewing Co., LLC, to provide an extension of the project completion date for Pivovar Restaurant, Brewery and Hotel Project located at 320-324 S. 8th Street, and authorizing the City Manager to execute any documents in connection therewith. [1:46:14] PH-2020-771 : Conduct a public hearing disclosing the employment status of Soila Resendez, a City of Waco employee, who has applied for loans in an amount not to exceed $41,189.78, of which up to $22,122.90 is a rehabilitation loan funded by Community Development Block Grant (CDBG) funds from the U.S. Department of Housing and Urban Development (HUD) and up to $19,066.88 is a lead abatement loan funded by the Lead Is Preventable Program (LIPP) from the Office of Lead Hazard Control and Healthy Homes (OLHCHH), for the rehabilitation of the home located at 1601 N. 21st Street, Waco, TX 76708. NO COUNCIL ACTION REQUIRED
[1:46:14] RES-2020-782 : Consider a resolution: (A) amending the Fiscal Year 2018-19 Capital Improvements Program by increasing bond-funded appropriations in the Solid Waste Collections Truck project by $237,257.46, and decreasing bond-funded appropriations in the Solid Waste Landfill Liner Ph VIII project by $234,933.50, and in the Solid Waste Bond Issue Costs project by $2,323.96, as is necessary due to capital improvement project requirements, and (B) approving purchases through a cooperative purchasing agreement with Buy Board: (1) from Bond Equipment Company for a total amount of $530,587.00 (which includes a $400.00 BuyBoard fee) for three Crane Carrier LET2 Truck Chassis, (2) from Reliance Environmental Truck Sales, LLC, d/b/a Reliance Truck and Equipment for a total amount of $319,740.00 (which includes a $400.00 BuyBoard fee) for two Labrie Environmental Automizer Right Hand Bodies, (3) from Texas Pneudraulic Inc., d/b/a Southwestern Equipment Company for a total amount of $94,600.00 (which includes a $400.00 BuyBoard fee) for one SEC Champion Left Hand 36 Yard Commercial Side Load Body, and (4) from Lonestar Freightliner Group LLC, d/b/a Lonestar Truck Group Waco for a total amount of $162,570.00 (which includes a $400.00 BuyBoard fee) for one Western Star 4700 Roll Off, so that the total amount of purchases does not exceed $1,108,297.00, and authorizing the City Manager to execute any documents in connection therewith.

[1:46:14] RES-2020-777 : Consider a resolution approving a Program Project Agreement between the Waco-McLennan County Economic Development Corporation and the City of Waco in an amount not to exceed $3,400,000.00, (with an amount not to exceed $1,700,000.00 being provided by the City of Waco) to support the upgrade of Mars Drive and Old Hewitt Road into industrial grade thoroughfares in Texas Central Park, and authorizing the City Manager to execute any documents in connection therewith.
[1:46:14] RES-2020-778 : Consider a resolution accepting the Continuum of Care Renewal Grant from the U.S. Department of Housing and Urban Development (HUD) in an amount not to exceed $62,653.00 (which will require a City match of $15,700.00, resulting in a total grant commitment of $78,353.00), and authorizing the City Manager to execute any documents in connection therewith for acceptance and administration of the grant, including any budget allotment adjustments and increases to the grant.
[1:46:14] RES-2020-779 : Consider a resolution approving a contract with Animal Birth Control Clinic to provide low-cost spay and neuter services for a total amount not to exceed $166,000.00 in Fiscal Year 2020-21, and authorizing the City Manager to execute any documents in connection therewith.
[1:46:14] RES-2020-780 : Consider a resolution approving the purchase of tires and tire repairs through existing purchasing cooperative contracts and/or from vendors of tires of various sizes and types in an amount not to exceed $550,000.00 in Fiscal Year 2020-21, and authorizing the City Manager to execute any documents in connection therewith.
[1:46:14] RES-2020-781 : Consider a resolution authorizing the expenditure of funds for the purchase of bulk diesel, unleaded fuels, and dyed off-road diesel under the existing supply contracts with RKA Petroleum Companies, Inc., and Arguindegui Oil Co. II, Ltd., in an amount not to exceed $3,764,459.00 in Fiscal Year 2020-21, and authorizing the City Manager to execute any documents in connection therewith.
[1:46:14] RES-2020-783 : Consider a resolution authorizing the expenditure of funds in an amount not to exceed $425,000.00 in Fiscal Year 2020-21 for water and sewer materials from existing supply contracts from ACT Pipe and Supply, Inc., Core and Main, L.P., Ferguson Enterprises, LLC, and Techline Pipe, L.P., and authorizing the City Manager to execute any documents in connection therewith.
[1:46:14] RES-2020-784 : Consider a resolution awarding a contract to HCS Inc. Commercial General Contractor (HCS), lowest responsible bidder, for the Dutton Avenue Improvements project in an amount not to exceed $3,290,655.25, establishing a 5% construction contingency in the amount of $164,532.76 for a total authorization amount not to exceed $3,455,188.01, and authorizing the City Manager to execute any documents in connection therewith.
[1:46:14] RES-2020-785 : Consider a resolution approving Amendment No. 1 to the contract with Lockwood, Andrews, & Newnam, Inc., for design, surveying, and construction support services in connection with the Oak Road Reconstruction project, to add construction administration and construction observation (inspection) professional services and to increase the contract amount by $49,525.00 so that the total contract does not exceed $98,710.00, and authorizing the City Manager to execute any documents in connection therewith.
[1:46:14] RES-2020-786 : Consider a resolution awarding a contract for construction services to JNB Construction, LLC, lowest responsible bidder, for the 12th Street and Clay Avenue Sanitary Sewer Improvements, in an amount not to exceed $59,791.00, and authorizing the City Manager to execute any documents in connection therewith.
[1:46:14] RES-2020-787 : Consider a resolution: (1) amending the Fiscal Year 2018-19 Capital Improvements Program by (a) increasing cash-funded appropriations in the Water State Highway 6 Utility Improvements Project by $864,730.00 and decreasing cash-funded appropriations in the N IH35 Pump Sta & Ground Storage Project by $154,208.00, System Improvements from Riverside Project by $3,259.00, and Water System Improvements by $707,263.00; and (b) increasing cash-funded appropriations in the Wastewater State Highway 6 Utility Improvements Project by $131,050.00 and decreasing cash-funded appropriations in the Wastewater System Improvements Project by $131,050.00; (2) amending the Fiscal Year 2019-20 Capital Improvements Program by increasing bond-funded appropriations in the WMARSS State Highway 6 Utility Improvements Project by $304,220.00 and decreasing bond-funded appropriations in the WMARSS Plant Improvements Project by $304,220.00, as said amendments are all necessary due to capital improvement project requirements; (3) determining that a public necessity exists for the acquisition of temporary construction and permanent easements located on approximately twenty (20) separate tracts of real property for the relocation of water and sanitary sewer utilities located between State Highway 6/Loop 340 from Bagby Avenue to U.S. Highway 84; (4) authorizing the City Manager to make offers for the acquisition of easements required for the project, expend an aggregate amount not to exceed $1,300,000.00 to acquire said easements, establish certain procedures for acquisition, and receive any of these easements as a donation; and (5) authorizing the City Manager to execute any documents in connection therewith.
[1:46:14] RES-2020-788 : Consider a resolution ratifying a contract with Bear Contractors, Inc., for the Emergency 27-Inch Sewer Interceptor Manhole Repair Project, in the amount of $77,130.00, and authorizing the City Manager to execute any documents in connection therewith.
[1:46:14] RES-2020-789 : Consider a resolution approving the purchase and installation of a replacement drum, trunions, and exit piping from Andritz Separation, Inc., for the Waco Metropolitan Area Regional Sewerage System (WMARSS) Dryer Drum Rehabilitation Project in the amount of $577,884.00, and authorizing the City Manager to execute any documents in connection therewith.
[1:46:14] RES-2020-790 : Consider a resolution approving a contract for engineering services with Walker Partners, LLC, for the 54-inch West Bank Realignment Project, in an amount not to exceed $160,250.00, and authorizing the City Manager to execute any documents in connection therewith.
[1:46:14] RES-2020-791 : Consider a resolution amending Article 26 of the Collective Bargaining Agreement between the City of Waco and Local 478 of the International Association of Firefighters to add Veterans Day as a holiday, and authorizing the City Manager to execute any documents in connection therewith.
[1:46:14] ORD-2020-792 : Consider an ordinance amending Section 2-51 in Division 4 “Sustainable Resource Practices Advisory Board” in Article II “Boards, Commissions, Committees” in Chapter 2 “Administration” of the Code of Ordinances of the City of Waco, Texas, to provide for changes to the mission, purpose, and membership of the Sustainable Resource Practices Advisory Board (“Board”) and to add the requirement that the Board conduct its business in accordance with the City Council’s Policies Governing City of Waco Boards and Commissions. [1:46:14] ORD-2020-793 : Consider an ordinance amending the Code of Ordinances of the City of Waco, Texas, by adding Appendix C entitled “Impact Fees”; providing for definitions; establishing roadway impact fees within the City limits, and water and wastewater impact fees within the City and its extraterritorial jurisdiction service area; providing for assessment of said impact fees; providing for the general administration of said impact fees; providing for accounting of the collected fees; providing for waivers of impact fees; providing for a refund; providing for an appeal procedure; and establishing an effective date of June 1, 2021.
