[18:18] Get going and call tonight. Thursday, August 6, 2026. We'll call on you, planning, commission, meeting to order. Dave and Brenda, could you please take roll call or the people present? Thank you. Motion to tonight to adopt tonight's agenda. I will make a motion to adopt the agenda as distributed.
[18:43] We have a motion to adopt by Commissioner Paulson and a second by Commissioner Weckman, all in favour say aye.
[18:50] Aye.
[18:50] Opposed, same sign.
[18:52] Motion carries.
[18:55] Approval of the minutes from the July 9th, 2026 Planning Commission.
[19:00] I can get a motion to approve those.
[19:03] Motion by Commissioner Weckman, a second by Commissioner Paulson, all in favour say aye.
[19:09] I pose same sign. Motion carries. Item number four, new business. We have no new business, but we do have some old business to take care of. And that's to the amendment of chapter 541, the housing ordinance for rental property.
[19:25] Thank you Mr. Chair, as you mentioned today in front of you is the ordinance amendment to the short-term rentals.
[19:34] Previously we talked about this at the last meeting and we just had a very productive work session on it.
[19:40] So the public hearing has already been had and I pass it back to you.
[19:45] Okay. Thank you, OBD. We did have very meaningful discussion. And that being said, I will make
[19:53] a motion to approve approval of the drafted regulations to include no long-term rental
[20:00] buffers, the grandfathering of the existing short-term rentals, including an annual inspection,
[20:07] motion. To also include the no warranty by the city, the applicable laws add that in,
[20:17] add in house rules and a one year rental record. I will make that motion.
[20:26] Those second that motion, Mr. Chair. Second by Commissioner Paulins. Any further discussion?
[20:31] All in favor say aye. Aye. Opposed, same sign. Motion carries.
[20:37] Please.
[20:38] Mr. Chair, if I may add just to the end of that, I appreciate all the work on this and
[20:42] the time by the Planning Commission.
[20:44] The intent would be to bring this to the City Council at their next meeting with those
[20:47] recommendations, some clarifications that we talked about at the work session.
[20:52] I think it would be appropriate, we'll bring back a draft of those house rules slash neighbor
[20:57] kind of good neighbor brochure elements so you can see exactly what our take is on that
[21:04] and see if there are some modifications that might need to happen.
[21:06] We'll discuss it at that point.
[21:08] Yeah, maybe some verbiage around the four other stipulations that we put in there would be great as well.
[21:13] Certainly.
[21:13] We'll bring that back to you guys.
[21:14] Right.
[21:15] Perfect.
[21:16] Just as clarification on the house rules, I mean, we're going to require that they be posted in the short term rental property.
[21:24] Yes, sir.
[21:25] Be a clarification.
[21:26] Yep.
[21:27] Right.
[21:27] Yep.
[21:28] Thank you.
[21:30] Yes.
[21:31] Moving right along, staff update.
[21:33] Staff update, Mr. Chair, just a couple of items for you.
[21:38] I want to welcome Brenda back, we're happy to have her back in the office.
[21:42] She's been out for a little while, so we're excited to see her at the employee picnic yesterday.
[21:47] And Dave's happy that she's taking minutes tonight, so I'm glad you're having that.
[21:52] Ordinance amendment, I tell you what, the City Council spent a lot of time on this cannabis buffer conversation that we had.
[21:58] It was a recommendation of denial from this group.
[22:01] The council, it's been three different meetings now, where they ultimately did make some modifications to the cannabis buffers that would allow the type of use that Mr.
[22:12] Levine is looking for at the Jay Carvers site.
[22:15] Now Mr. Levine does not own the Jay Carvers site, there is no approval for this to happen at the Jay Carvers site, but the buffers have been reduced once we notice them in the paper.
[22:24] this ordinance amendment reduces the park buffer by 250 feet. It measures the school set back
[22:31] based on structure to structure so that 1000 foot buffer remains but it's structured a structure
[22:35] taking to account you know before it was like parking lots and things like that. The other modification
[22:40] was that a mezzo or micro cannabis retail business or with a retail component can be located in the B1
[22:50] but as a conditional use permit. So if they do come in and say hey you know if Mr.
[22:54] Jelevinge comes back and says, I purchased the property, I want to put this in this location.
[22:59] He'll come here as a public hearing with the conditional use permit with very specific conditions.
[23:04] You'll be able to review that and add any applicable conditions to that, but I wanted to make you aware.
[23:08] Do you guys have any questions about that because it was kind of a back-and-forth conversation and it was a lot of time the council spent, but it passed and here we are.
[23:22] I'll keep moving if there's no questions on that as we continue our growth
[23:27] pattern right we're going to get into our 2050 comp plan next year but the
[23:31] council approved a bid package for the construction of water treatment
[23:35] plant number four so if you remember the whole Brook development which is
[23:38] hard to forget because it's 240 acres and 339 homes directly to the east of
[23:43] that the city purchased 15 acres from the Dirkes family and the council
[23:48] approved the bid package at their meeting earlier this week so we will start
[23:52] construction of water treatment plant number four this year.
[23:59] When I say we
[24:00] issued the permit either OBD Brenda or Dave issued the permit for the new
[24:04] restaurant at all of an Elm so that is the front facing space at the Wilford which
[24:11] will be a nice addition so as we always do it's always like when you can open
[24:14] you know we want it we'd like to know what you're going to make and when you're
[24:20] tractor said 16 weeks so we'll see what's the name of that going to be all of an
[24:26] elm right now is the name okay the other item if you wanted to come and talk to
[24:33] Dave you know or Brenda or Abdi usually they're too busy because we've already
[24:37] issued 118 new home permits for the year we had anticipated 125 for the entire
[24:43] year so my bad joke is probably by Tuesday we're we're done issuing permits for
[24:48] year we can come back later. August 6th, Planning Commission meeting is shaping up to be a typical
[24:55] one, right? We've got a couple of residential variances that you'll see, ones for a garage, ones
[25:01] for a 1% hardcover request, and then I finally heard back from the DNR on our shoreline flexibility
[25:09] ordinance, and I'm not lying that today is the day they sent me the conditional approval of that
[25:14] language so bringing it to you as part of a formal public hearing. We'll notice it in the paper.
[25:20] We'll notice it here at City Hall on our website. Try to get some feedback from the public,
[25:24] but it's this on and off ordinance we've been working on for a couple of years so I'm happy to say
[25:29] that DNR finally got back to me.
[25:33] Lane did the county have any input? The county hasn't had. We've
[25:38] been telling them what's going on but I haven't asked them for comment. I think I will reach out
[25:44] out to Paul Malene and just see if he has any other feedback on this, but I think he
[25:49] might just clap, you know, based on the language.
[25:53] We did, sadly we're saying goodbye to Nicole Meyer, she's moving on from the city, so she's
[26:00] been our finance director, she's worked with the city for 22 years I think is what they
[26:05] said.
[26:05] So she's been, she's, her last day is tomorrow, so it's her farewell to her this whole
[26:12] week we've kind of been doing things right but with the city hired Joel Mary. He's
[26:17] a new finance director so if you see him around or about town or a city council
[26:21] meeting he's going to be a great addition to the staff and to the community and
[26:26] then Woodland Trail residential development that's just east of Lake Town
[26:31] Elementary School Airport Road for thinking about that area. The annexation has
[26:38] been submitted to the state. We expect that back either later this week or
[26:42] next week, so that means they'll formally be in the city limits so we can formally execute
[26:47] their early grading agreement, right? So I anticipate that they're going to be starting
[26:50] in the next couple of weeks as long as they can get watershed approval to get that going.
[26:54] So dirt will start moving out there as well. So the two new developments that will have started
[26:59] this year will be Elm Creek Ridge, right? If you haven't driven past that one on 284, then
[27:05] this one will start moving dirt soon, which would be called Woodland Trail. And those are the
[27:10] updates I had, unless you guys had any specific questions about projects that are going on in town.
[27:20] Okay. Moving along, I guess, can I get a motion to close tonight's meeting?
[27:27] I will make the motion. Motion by Commissioner Weckman. Do we have a second?
[27:31] Second? Second by Commissioner Peterson. All in favor, say aye.
[27:36] Opposed, same sign. None motion carries. Meeting close. Thank you very much.
