the city council meeting of August 15th

she's uh on vacation right now at a
family vacation and um it was a
[2:06]
pre-planned vacation that she had so she
apologizes for not being able to be here
[2:11]
but wishes us well and she wishes Malik
Garcia well to as well
[2:17]
okay right um with the role I'll uh ask
everyone to please stand and we'll say
[2:22]
the Pledge of
[2:27]
Allegiance I pledge allegiance to the
flag of the United States of America and
[2:31]
to Republic for which it stands one
nation under God indivisible with
[2:36]
liberty and justice for
[2:42]
World normally we don't have uh uh TV
cameras or press or whatever here um for
[2:51]
you know for other than sometimes not
the best reasons but uh anyway we have a
[2:57]
we have a special uh presentation that
we like like to make today and is for
[3:01]
Malik Garcia um so I'd ask marleik if
you mind coming up forward
[3:24]
here um Malik Garcia is um a resident or
resent here water um grew up here in
[3:32]
water attended water High School uh was
a trct graduated from water High School
[3:38]
uh was a track coach here and has
represented the uh Honduran U country
[3:45]
for in the 2024 Olympics uh this is kind
of a very very unique um rare you know
[3:53]
occasion that we had we're very I mean
so really in some ways so excited to see
[3:58]
that you know we had somebody from
waterly here you know that was in the
[4:01]
Olympics and I can't tell you how how
happy we are you know for you for the
[4:07]
residents is the people that you know
you uh you taught you you know in school
[4:12]
but also for the little kids that have
seen you as you know along the line um
[4:17]
you as I said he grew up here long time
ago I don't remember him as a as a kid
[4:22]
but now I do know the connection that I
have with um I was also a track star I
[4:28]
was talking earlier
in high school yes nobody else here
[4:32]
knows that I ran track check that
record you can fact check it myself I
[4:38]
came in second in a major race of two
people um so I I do know what you went
[4:45]
through not really at all so um first
what I'd like to do is I know that U SE
[4:52]
McDonald has to go and I'd like him come
up and say a couple words for you and
[4:56]
and talk to you
[5:04]

everybody and we congratulations and uh
[5:09]
what a great experience we were
discussing what it was like the
[5:12]
hospitality and the accommodations you
did or did not have and the fact you're
[5:16]
able to see LeBron and you're able to
see many of the performances um you know
[5:20]
it's interesting mayor's right it's not
often that we have individuals from the
[5:25]
capital region in the Olympics I can
think back maybe 9 years ago one of the
[5:29]
pompe
goes participate in track field and you
[5:33]
been know enough my cousin FR our Harry
Mar used to be the cathol coach he
[5:38]
coached two Olympic C
worlders and the reason I mentioned that
[5:43]
is listening to him tells me how much
work I have it and there's a lot of
[5:49]
individual time a lot of individual
sacrifice that is part of this and uh
[5:55]
our hats off to you and congratulations
we thank you for being a great
[6:08]
I do want to acknowledge that the uh
Senator um Ashby was here um presented
[6:13]
when we put um Proclamation himself but
he had a lead as as well as uh John has
[6:20]
a lead so i' like to now ask for um
County Executives uh Mich come on up
[6:31]
thank you mayor I'll add a little bit
more to your growing pile of paper uh
[6:36]
and
proclamations um on behalf of County te
[6:40]

congratulations um it's an incredible
[6:44]
achievement I think uh for me what what
amazes me most about the Olympic
[6:48]
athletes is kind of what you were saying
earlier when we were talking outside was
[6:52]
you're going to take a week off you're
going to get back after it and you're
[6:55]
also going to go to your job and get a
full-time job and so you're a
[6:58]
professional athlet but you're also
juggling a great many things and uh I
[7:03]
think that shows the dedication you know
you're talking about how you know maybe
[7:07]
the guys from USA Basketball got to stay
in a different place uh and uh you know
[7:13]
that that goes to show the level of
dedication above and beyond what even
[7:18]
they uh have to put into things and your
love for what you do I have to uh insane
[7:24]
children and I would like to think that
when they grow up and perhaps if they
[7:28]
have a love for physical activity as you
do that they'll have a dedication that
[7:32]
you do and uh you're heard to talk about
how you coach and things of that nature
[7:36]
and those are the type of things that I
think Olympians bring to the table that
[7:40]
others do not so congratulations thank
you uh welcome back hopefully your bed's

from the city of water whereas Mal
[8:40]
Garcia was born on June 18th
1992

wow where I believe was a fourar a four
sport athlete at the water High School
[8:50]
participating in football wrestling
indoor and outdoor track and field he
[8:54]
graduated with honors in 2010 and he has
coached football and track at waterly
[8:59]
High School
and whereas in 2010 le le helped lead
[9:02]
the caners to the State title in the 400
relay event in the New York State uh
[9:10]
whatever Association on October uh
outdoor track and field division um
[9:16]
Championship meeting and where his
relief was on was on to complete the
[9:20]
Sunni kobal skill and Sunni Portland
where he was named Team MVP at both
[9:25]
schools during his collegate career he
captured numerous uh champ ionship with
[9:30]
and was the five-time NCAA division 3
all America and whereas being an auran
[9:35]
American descent believe completed in
the 2024 Summer Olympics in Paris on the
[9:41]
Honduras Summer Olympics team now
therefore I Charles V patricelli mayor
[9:45]
of the city of water ble do hereby
recognize commend and honor Malik Garcia
[9:49]
for his accomplishments I further
Proclaim August 15 20124 is Malik Garcia

day in the city of Waterland

um it's a little it's a lot
um I just want to say that I'm honored
[11:21]
to have this opportunity um I'm honored
to have been a coach forward of weite
[11:26]
and to have the opportunity just to be
able to help the community grow in any
[11:32]
aspect oh look at
[11:36]
that I want to say wow that's that's
kind of loud uh I just want to say thank
[11:41]
you to the city of waterite for being
there supporting me from the time I
[11:45]
started kindergarten here and all the
way through my high school career um
[11:50]
thank you for those that have attended
also it's really an honor to be
[11:54]
recognized by the Senate and by the city
of water for my accomplishments and
[11:59]
and quite honestly I can't take all the
credit myself my mother was a good
[12:04]
impact on my life and I just have to
thank God for having that type of parent
[12:10]
in my life to stay on my back and to
make sure that I'm staying on the right
[12:14]
path and so I hope that this achievement
a lot of the youth in world of Le sees
[12:21]
and they don't stop pursuing their
dreams and their goals and they can see
[12:27]
it doesn't matter the timing as as long
as they keep the consistency and have
[12:31]
the love and the passion they can
achieve anything that they set their
[12:34]
minds to so thank you mayor welcome and
thank you everybody for the city waterly
[12:42]

officers and committees all right so um

I just have a couple items here this
evening Paving on 19th Street will
[14:43]
continue uh we're going through the
Milling process and we fixed all the man
[14:47]
holes and uh valve covers uh the paving
will commence uh Monday night on the
[14:54]
19th of August and go through the
daytime of the
[14:59]
21st uh our municipal pool is closing on
the 23rd uh visitation has been equal to
[15:06]
just a little bit below last year um we
know there's an end of a year party
[15:11]
tomorrow on the 16th and I believe that
starts at 1:00 noon noon noon um so
[15:19]
we'll to see a lot of people there uh we
talked before about the uh SK system at
[15:24]
the hydro uh the
1993 uh Software System
[15:29]
and um and going out we're able to find
a compatible piece to it brand new in
[15:38]
the box that'll be here tomorrow and
install our fingers are cross that the
[15:45]
um
software uh will stay running with it we
[15:50]
were told by the company that in fact it
will uh so we hope our Hydro will be
[15:55]
back up and running uh by 10:00 tomorrow
morning
[16:00]
uh specs for the heating system for this
building are due tomorrow um and we will
[16:06]
share them at the next council meeting
uh so we could Advance forward on that
[16:11]
repair uh Firehouse study that's been
out the RFQ is also due tomorrow uh and
[16:17]
that's going to be a study of the city
of water B and response time and fire
[16:22]
department needs and where a suitable
Firehouse could potentially be in the
[16:29]
future in the city of waterf uh we
completed all the demolition bids uh
[16:35]
last week the first order of business
will be the 16th Street
[16:40]
Garage um and we have to look at
underneath that the infrastructure
[16:45]
underneath that tunnel for that Alleyway
there's a super tunnel there so before
[16:49]
we open that up through to passage uh
for the continued use of the garbage
[16:56]
Shar I'll get an Integrity study on that
tour uh tunnel uh but right now Aly
[17:01]
county has 409 3rd Avenue 1336 4th
Avenue 2330 Broadway and 5081 14 Street
[17:11]
uh in a request uh to den uh W County
now is looking at approve of all the
[17:17]
demition prior to as they make us whole
for all theost um for demolition of
[17:24]
processes in the
city um
[17:29]
the parking lot dead end okay bid for
the parking lot tomorrow is also due for
[17:33]
the dead end 11th Avenue by AOH and um
the Arsenal uh so hopefully that uh will
[17:41]
be before the board to accept the bids
for the um removal of that parcel of
[17:48]
city land into um residential or
business hands and uh that will do
[17:55]
everything at this point in time
[18:00]
unless there's any questions

had um that we were going to talk about
too was that at one of the previous

this as an email but I never got an

answer back was the millings we were
going to use the millings in the alleys
[18:27]
was that done we did use millings for
all the alley aprons on uh 16th Street
[18:35]
um we are actually talking
to um can you use the m to jail so yeah
[18:41]
so the millings all along 16th Street
were used uh where we did the Milling on
[18:46]
that and repaving on all the apron alley
access points there uh we also
[18:51]
stockpiled millings on lisi's property
we're looking at an alley
[18:56]
tomorrow um that is is the one that goes
right next to St Bridget's and um we'll
[19:04]
use a majority of millings there as well
so we did that one and then we fully
[19:09]
paid with using millings on the bottom
on I think it's the
[19:13]
13th Street alley that's between 7th and
8th uh that alley
[19:19]
there
okay is it all right to ask a few more
[19:25]
questions on sure different issues all
right uh another issue that had been
[19:29]
popping up is the garbage that's being
left um by the
[19:35]
trucks um if they're not in
compliance what what is the what's
[19:41]
what's the procedure now being done
about
[19:43]
that um not quite sure you're saying
that when a truck goes by being missed
[19:49]
well there there were a couple one of
them was on 25th Street and the other
[19:52]
one was on Broadway I sent you two
emails on that but I never got an answer
[19:56]
back I'm sure they probably got picked
up
[19:59]
but why are the why are the men leaving
the garbage or is there a procedure that
[20:03]
says they left the garbage and
somebody's coming back to get it or how
[20:07]
is that being done well I think the one
that I think was noted was the excessive
[20:13]
garbage on 25th stre I think Paul
responded to that uh on it um yeah but
[20:19]
that's not the that's policy I know is
that they pick everything up right and
[20:24]
they do that and I think um we'll have a
greater conversation when we have that
[20:29]
meeting with
CCA no no it's about garbage so we'll
[20:34]
have a greater conversation we will have
the conversation but but like like on
[20:37]
the garbage on Broad on Broadway there
there was a garbage I sent it a picture
[20:42]
there was a um they picked up all the
garbage on Broadway on the 2400
[20:47]
2401 um the Broadway there but they left
three or four bags of garbage on the
[20:52]
ground um
and so what's the procedure on that did
[20:58]
they just leave it is that no we know
what the procedure is we know the
[21:02]
procedure is is that they're to pick up
everything right that's what the
[21:05]
procedure is and right now like I said I
think we're going to have a greater
[21:10]
conversation um with CSEA about this
topic cuz I can't answer that question
[21:16]
as to why people are leaving it yeah but
isn't it an order for them to do what
[21:20]
you're told yes okay all right that's
what I wanted okay it's an order that we
[21:25]
we're saying all right yes um also
couple months ago or whatever I think it
[21:30]
was just after was just before Chief
cenni we were going to get a police
[21:34]
report on the overtime
yes we Amanda and I this that's that for

that uh you could review Amanda and I
met with Chief Bryce to go over that
[21:45]
report okay so that's the report for you
that's what we've met uh on Chief with
[21:51]
Chief Bryce and uh we'll be happy to

got an answer back you know from anyone

here about what what we could do about
it cuz I'm not a garbage expert myself I
[22:46]
did call a hose and talk to Steve about
it he gave me the you know check the
[22:50]
plugs I go okay but yeah didn't know
what it was and I know you had explained
[22:54]
it to me I know we have someone here
from uh in audience right now that you
[22:59]
know was also complaining about it um
but we again it was kind of left for a
[23:07]
long time and what I know what we have
now is a resolution right we have a
[23:12]
resolution to it we do have a resolution
and it's not uncommon that garbage
[23:16]
trucks do spew that liquid I mean it
happens in my neighborhood and that's a
[23:20]
private company um this was has been
excessive throughout our our vehicles um
[23:26]
that we have multiple trucks
so the plugs were missing and we put the
[23:31]
plugs in two of the three vehicles cuz
the Third vehicle right now is not even
[23:36]
in our property uh or in our DPW Yard
because it's being worked on but it will
[23:40]
be fixed when it gets back the two plugs
are in we used it one day and then the
[23:46]
pressure with compacting the garbage was
pushing the liquid out through the
[23:49]
gaskets those gaskets were resealed so
those two trucks um as it stands today
[23:55]
it's been 2 days of operation and no
complaints have been received at all so
[24:00]
the plugs are in they're tightened and
the gaskets are fixed between the
[24:04]
compactor and the truck body and right
now like I said no other complaints have
[24:08]
been
received and and I appreciate that and
[24:13]
and like that but the one thing that
concerned me the most with all the
[24:17]
complaints that we received beforehand
wasn't that something that would have
[24:22]
been as a dpw's gage being able to say
let's check the plugs
[24:28]
uh to answer that question yeah that
would have been right a logical yeah it
[24:33]
would have been a logical thought
process cuz it's common I mean it's not
[24:38]
like this is brand brand new with you
know when we had that
[24:42]
conversation um as of I think it was 10
days ago when I started getting the
[24:47]
complaints um well we're getting
complaints like for the past 6 months
[24:52]
but okay right if that's the time frame
um but when I looked into it 10 days AG
[24:58]
because we were getting more right
frequent
[25:02]
calls um there were no plugs in the
trucks and the answer received was we
[25:10]
haven't had them in vehicles for
years so to answer the question honestly
[25:17]
that would have
been yes there's got to be a plug that
[25:22]
would have been a thought process but
the answer received was there hadn't
[25:25]
been a plug in those trucks for years

all right moving on are we okay now with
tree
[25:33]
trimming we got a big going out for the
tree trimming is it out yet uh no it has
[25:38]
not got one out yet I've been Penning
that that tree bid I you looked at it
[25:41]
with the um one that we did three years
ago and that will probably be going out
[25:47]
uh Friday and Monday and it's Citywide
right okay speed bumps on First Avenue I
[25:53]
know they're still in the city clerk's
office right they are still in the city
[25:56]
clerk's office the unfortunate thing
with that is is they had spikes that are
[26:00]
probably uh 16 in long and they weren't
the ones that I wanted I wanted the ones
[26:05]
that b in and both out so I'm trying to
find those type of ones the bolts now
[26:12]
that have the Molly in it that we can
screw into the ground or core into the
[26:17]
ground and then just tighten it down
each and every season pull them light
[26:21]
okay is that speed bup seasal thing yes
yeah they're going to go on in the fall
[26:26]
or they're going to come off in the fall
and they'll go back in the
[26:30]
spring
generator yes the generator I have two
[26:36]
questions to answer for Mr fassel and
that will go back to him and then we
[26:42]
should be moving
forward Jermaine Church uh no answer on
[26:48]
that no answer uh I have no followup on
it as of yet go
[26:54]

don't think the answer would be

senior citizen um thermostat

the for the thermostat it's the sen Cent

for the heat I've talked to centrica I
have not locked them down to a time

frame when to come

of the city of waterwood I'll make a
[28:43]
motion on ordinance number two I'll
second uh this is a request to remove
[28:50]
the uh sign at 1435 1 Avenue um we
received the request on July 23rd thir
[28:59]
uh Mr foli and Mr Harbor looked at it
and we have the recommendation to remove
[29:05]
and that's what the ordinance is for is
this a handicap side
[29:10]
yes okay those other questions golden W
councilman do in favor mayor patri in
[29:19]
favor resolution number 36 for 20124 is
a resolution approving a contractor
[29:25]
Consulting and facilitation services
at Hudson Shor park with reliable
[29:30]
development consultant and authorizing
mayor Charles V patelli to ex execute
[29:36]
all required documents for the same I'll
make a motion on resolution 36 I'll
[29:41]
second it and uh this one here is to
hire reliable development Consulting to
[29:46]
help us through the uh Consulting
feasibility yeah
[29:53]
elicitation of uh services
for the uh um restaurant at Hudson
[29:59]
Shores Park uh the scope of services
again is to look at the
[30:04]
feasibility uh to Aid the city in uh
financials and uh seeing um you know
[30:11]
again the overall viability of a
restaurant uh at
[30:16]
Insurance
okay other questions call the rooll

councilman favor mayor p in favor
resolution number 37 for 202 4 is a
[30:28]
resolution adopting Americans with
Disabilities Act and procedures for
[30:33]
implementation make a motion on
resolution 37
[30:38]
2024 I'll second uh this one here was
brought to us uh by the division of
[30:44]
Housing and Community Renewal uh this is
part of one of the requirements needed
[30:50]
for the housing projects I believe this
is a onetime action that once this is
[30:56]
approved we probably won't be able to do
need this for future projects uh but is
[31:01]
something we should be have on board or
on our records uh that we adopt the
[31:06]
Americans with Disabilities
Act okay all the rooll councilman do
[31:13]
mayor mayor p in
favor resolution number 38 for 2024 is a
[31:21]
bond resolution dated August 8th 2024 of
the Council of the city of B authorizing
[31:27]
not toed receed 300,000 aggregate
principal amount of Serial General
[31:32]
obligation bonds to finance the removal
of existing underground fuel tanks and
[31:39]
acquisition and installation of
replacement above ground gasoline and
[31:43]
diesel fuel tanks at an estimated
maximum cost of
[31:49]
300,000 ly of tax and annual
installments and pay it thereof the
[31:54]
expenditure of such sum for such purpose
and determining other matters in
[32:00]
connection
there I'll make a motion on resolution
[32:04]
38 I'll
second uh as it states the bond
[32:09]
resolution is to pay for the work that's
Happ over
[32:15]
that
okay there's no other comments B the RO
[32:22]
coun mayor in favor
[32:28]
resolution number 39 for 2024 is a
resolution amending the contract for the
[32:33]
play trael at hon Shores park for the
installation of a security gate under
[32:38]
change order number one as part of the
local Waterfront revitalization plan and
[32:43]
authorizing mayor Charles patelli to
execute s make res motion on resolution
[32:49]
39 I'll second it I think I sent you the
uh specs of this gate um that we're
[32:56]
using this is going to going to be right
before in the front of the boat house
[33:01]
area there are cars uh going down the
far down um
[33:08]
so one of the reasons why I requested a
a bid on this and through the plate
[33:13]
trail system was there was a car uh
probably
[33:18]
about maybe two weeks ago 3 weeks ago
now um that was parked on the embankment
[33:25]
and it was the car was really
like this um
[33:31]
so I just was a little bit fearful of it
so this security gate will block any
[33:35]
Vehicles going down past the boat house
or anywhere close to the uh ramp for the
[33:41]
the
river did that also include that other
[33:44]
fence um on that first playground yeah
that's already been part of the project
[33:49]
yeah so that one uh we did uh a meeting
ago two meetings ago and that one
[33:54]
supposed to be installed at the same
time this one was
[34:00]
okay okay go the RO councilman mayor in
favor that concludes the new business
[34:08]
all right Appropriations accounting
command anything I think we covered
[34:13]
that the one other item that we had for
this meeting too was to talk about the
[34:20]
uh report on the phone system you were
going to make a report this that this
[34:25]

no he wasn't at the last

class I guess the answer is no I do not

it's called and they said they assured

their trucks they said there was no

holes nothing um I said listen like this
smells bad like it smells like the
[35:51]
common dump in my Aven and there's just
puddles and it's like gray and I've been
[35:56]
buying Pine power and and baking soda in
going out there and putting them in the
[36:00]
puddles um every morning Monday through
Friday the garbage trucks parked there
[36:06]
to go to Dunkin DS and they let them
idle some of them leave them on they let
[36:11]
them idle the tenant in the back and
friends to me all the time and I'm like
[36:15]
you come for your your your stuff you
know um they leave them run in and the
[36:20]
stuff just runs all over and I don't
feel like the extent should be on me if
[36:27]
their trucks are good I mean I feel like
maybe sawdust should be putting the you
[36:32]
know the Hol or whatever I mean if if
it's an armg goinging thing they assured
[36:37]
me that it's the garbage that when
people throw them out you know people a
[36:42]
lot of people don't empty their can
their cans and they fill them in there
[36:46]
and they said that when they crush the
garbage and the trucks idle the garbage
[36:50]
just SPS out of the back and I don't
know I don't know if that's true not but
[36:58]
I mean is there something that maybe
they if they're going to leave their
[37:03]
trucks idle for that period of time
maybe they can dump something in their
[37:09]
nasty sewage
bundles I don't know well I think the
[37:14]
last time we
spoke um we sent
[37:19]
the nobody came they were supposed to be
there that day I know one of the times
[37:23]
that somebody did the truck I don't
think you go to sweeper that Al right

it's all a Shale what's that is that
your alley Shale right it's like a Shale

pick up or you honestly I looked real
quick and I didn't see any puddles real

quick but I didn't I usually not their
cleaning and stuff and I just came walk

I want to deal with it I didn't want to
hear from her in the back okay you know

cuz she has issues with them too well I
don't know if you heard earlier we
[38:15]
talked about the repairs that were made
to so there was holes in that uh there
[38:21]
is a there is a drain hole Yeah in there
um which Now isn't pluging in so I knew
[38:28]
because like I've been at that location
for 13 years in October and I have I'm
[38:34]
not a complainer folks I clean the
street in front of the business I do
[38:39]
long I do the long clean up on the
curves and like I maintain the front of
[38:43]
my building and I just the smell this
year has just been really bad I'm like
[38:49]
something's got to be done Sandy this is
my if it happens next time there's my
[38:54]
cell number on there so hopefully
there was a problem with the seals in
[38:59]
their fix yes okay that's all I'm here
