>> Becky, we please do roll call. Mayor
[0:17]
Clark
[0:18]
>> here. Council member Anderson,
[0:25]
» she's muted.
[0:26]
>> Here.
[0:26]
>> Council member,
[0:28]
>> thank you. Council member Cone
[0:29]
>> here.
[0:30]
>> Council member Grove
[0:31]

[0:32]

[0:32]

[0:35]
>> Agenda item D is open forum. Open forum
[0:38]
is the time for anyone here tonight to
[0:39]
address the council on any subject over
[0:41]
which the council has the authority to
[0:42]
act or on any item on the agenda other
[0:45]
than a public hearing. Uh does anyone
[0:47]
here tonight either in the council
[0:48]
chambers or in Zoom wish to address the
[0:49]
council at this time? If so, please
[0:52]
approach the podium or raise your hand.
[0:54]
Uh, if you are participating via Zoom,
[0:56]
please click on the raise hand icon
[0:57]
located under the reactions controls.
[1:00]
And if you're participating via phone,
[1:02]
please raise your hand by hitting star9.
[1:04]
After you are recognized to speak, you
[1:06]
will need to state your name clearly uh
[1:09]
name and address uh for the record. Um,
[1:11]
and comments are limited to three
[1:13]
minutes. Uh, all right.
[1:17]
Go ahead. Um, Veronica Gak. I was
[1:20]
elected in 2018 by Dallas County
[1:24]
residents to be our so one of the soil
[1:27]
and water conservation commissioners. My
[1:31]
uh agenda was to get access to the
[1:34]
equipment necessary for the De Moines
[1:36]
Waterworks to be able to test for the
[1:39]
PAS and people's chemicals that are
[1:42]
contaminating our water. Unfortunately,
[1:45]
even though Biden's infrastructure bill
[1:48]
had 10 billion set aside for this, our
[1:52]
governor uh at the time uh uh was of the
[1:58]
opinion that we didn't need to know what
[2:00]
was in our water and she refused the
[2:03]
option of getting the funds to be able
[2:06]
to test for the levels of PAS and POS
[2:10]
chemicals.
[2:11]
But then I I ran my suction second
[2:15]
election to try again to get these since
[2:20]
I had won the suit against the USDA NRCS
[2:26]
for uh the PAS and POS chemicals in a
[2:30]
different watershed in Iowa, the Cedar
[2:33]
Valley Group aquifers. I had one results
[2:38]
and the state of Iowa had agreed they
[2:41]
were going to put up a 3D GIS web
[2:43]
mapping system for the whole state so we
[2:46]
could know what had already tested
[2:48]
positive in our tap water. And so this
[2:53]
last uh uh April, I paid for the P tests
[2:58]
and other chemicals tests to be done.
[3:01]
And you have to send yet today out of
[3:05]
state to do these tests. I sent them to
[3:09]
Southbend, Indiana, and they came back
[3:13]
22
[3:15]
uh uh herbicide and pesticide
[3:18]
ingredients. The worst one for me is our
[3:22]
President Trump's family profits from
[3:24]
Trump card, which is a herbicide in the
[3:27]
middle of Iowa State University's chart.
[3:30]
And that herbicides ingredients are 24D
[3:34]
choline and glyophate. And this test
[3:39]
result shows 24D choline at the top, way
[3:44]
over the maximum containment level set
[3:46]
by the EPA. Veronica down at the bottom
[3:49]
the glyophate.
[3:50]
>> Veronica, you are almost to your three
[3:53]
minutes or you're at your three minutes.
[3:54]
So, can you get to what you would like
[3:55]
from us, the Walke City Council?
[3:58]
>> We need to know, everyone here needs to
[4:01]
know what's in their water. And we have
[4:04]
a a local company uh that says they can
[4:08]
the Adel Colligan company is saying they
[4:12]
can do 99%
[4:15]
removal of these chemicals. I got a bid
[4:19]
on that today for that filter system to
[4:22]
get installed in my house along with a
[4:26]
whole house uh herbicide and pesticide
[4:30]
uh uh
[4:33]
honest filter that did not remove the
[4:36]
PAS uh that I installed in uh September of 2025.
[4:44]
But that new filter removed the E.coli
[4:47]
and cififor bacterias that were causing
[4:51]
so many of our kids to end up with uh
[4:54]
bacterial lung infections and even
[4:58]
bacterial bone. And
[4:59]
>> Veronica, you're at your time.
[5:01]
>> Yeah, we do do need to know what's in
[5:04]
our water. Thank you. And we need
[5:07]
>> to have tests done to prove. These are
[5:10]
mandatory tests that are supposed to be
[5:13]
done each year, but the city and the
[5:15]
state have not done
[5:19]
my
[5:20]
>> No, it's your turn. Go ahead.
[5:22]
>> My name's Charles Jeffrey Williams. I
[5:24]
live at Southeast 680 Southeast Booth
[5:28]
Avenue. Um I've lived here for about
[5:31]
four years. Um, and on reason I'm here.
[5:35]
to ask in the spring and in the
[5:38]
fall I see the notices in the Walke
[5:40]
Living magazine about if your grass in
[5:43]
your yard gets 8 in too tall, you're
[5:46]
going to get a citation. If you don't
[5:47]
shovel your snow off your sidewalk
[5:50]
within 24 hours, you're going to get a
[5:52]
citation. I've gone on to the city
[5:55]
website. I can't see any records of
[5:57]
those citations.
[5:59]
I'm just want to like to know where I
[6:01]
can find them.
[6:03]
>> Um I don't
[6:05]
So
[6:07]
we're not allowed to speak about topics
[6:10]
that are not on our agenda. If you would
[6:11]
like to stick around till after the
[6:13]
meeting, we can maybe answer that
[6:14]
question or uh Andy could answer it,
[6:17]
although generally we don't post
[6:19]
citations. But um Andy, our um head of
[6:23]
community development, can answer that
[6:25]
question if you would like to not wait
[6:26]
till the end of the meeting. Is there
[6:28]
anything else you wanted to address?
[6:29]
>> No, I I Yeah, I gota wait till the
[6:33]
meeting's over.
[6:34]
>> If you want to speak to one of us if
[6:35]
you'd like, he can step out with you now
[6:38]
and and Yep. Yep. Thank you.
[6:41]
>> Okay.
[6:52]
» My name is Jonathan Aubberg. I'm a
[6:54]
constituent of De Mo, Iowa. and I was
[6:56]
here to talk about the city's agreement
[6:59]
with the corporation block safety.
[7:02]
Um I I would like to request an
[7:04]
extension to my time to 5 minutes for
[7:07]
parody with the procedure set west de mo
[7:09]
city council to talk about our civil
[7:11]
liberties some more.
[7:12]
>> We we limit to three minutes
[7:14]
particularly we have multiple but um
[7:16]
please go ahead and uh you can always
[7:18]
wait after the meeting and speak with us
[7:20]
more.
[7:22]
>> Sure. So, I conducted an investigation
[7:25]
of the city of West De Moines and their
[7:27]
use of surveillance technology
[7:30]
through a lot of chapter 22 requests and
[7:34]
um during the way there were a lot of
[7:36]
interesting findings. I actually have 40
[7:38]
plus findings and the media in Iowa.
[7:41]
None of them have ever been asked to see
[7:43]
my uh the evidence I received from the
[7:46]
government. Um which I thought was kind
[7:49]
of dubious. And so I think more people
[7:53]
need to hear about it. I started a
[7:54]
website to try and get my findings out
[7:56]
there, dsminel.org.
[8:00]
And so I actually filed a complaint with
[8:02]
the attorney general uh last week about
[8:06]
uh that company Flock Group doing
[8:08]
business as Flock Safety.
[8:11]
And also there are other parties
[8:13]
involved. It's really not just about
[8:14]
them. And I'm not an attorney. I can't
[8:16]
say if anything was lawful or unlawful.
[8:18]
It's not my place.
[8:20]
Uh, but a lot of civil liberties groups
[8:23]
who thank me. The American Civil
[8:25]
Liberties Union of Iowa thanks me for my
[8:28]
investigations I do into these kinds of
[8:31]
8 billion dollar surveillance
[8:33]
corporations.
[8:35]
And
[8:37]
you know, this is something that really
[8:38]
concerns me. This level of surveillance,
[8:41]
all these automated license plate
[8:43]
readers that use artificial intelligence
[8:45]
to catalog our vehicles. To me, this
[8:48]
just doesn't really feel like something
[8:50]
that's congruent with the Constitution,
[8:53]
with our Fourth Amendment, with our
[8:55]
rights, with our civil liberties. And
[8:57]
that's why I'm here to talk about this.
[9:00]
And, you know, I wish I could get an
[9:02]
extension in my time for that because I
[9:04]
think our rights and our civil liberties
[9:06]
are very important.
[9:09]
Um, looks like I have about a minute
[9:11]
left. So some of my findings the um in
[9:14]
the state of Iowa you need a you need
[9:16]
certain lensure and permits and things
[9:19]
like this to do operations in our state
[9:22]
and when I a citizen investigator who's
[9:24]
a college dropout started looking into
[9:26]
this I filed a two complaints with dial
[9:30]
I feel like they rolled my two
[9:31]
complaints into one complaint instead of
[9:33]
addressing both of them but I'm not an
[9:36]
attorney. Maybe that's the SOP over
[9:38]
there. I'm not sure. So, um, trying to
[9:41]
find electrical permits and licenses for
[9:43]
this company. Yeah, I might not be going
[9:45]
the right place. Sometimes you go in one
[9:47]
database online. Sometimes there's
[9:50]
probably a different procedure there.
[9:51]
But, I'm really kind of struggling and
[9:53]
I'm curious, is the city, are you
[9:55]
checking the lensure of the vendors that
[9:58]
you're placing inside of consent
[9:59]
agendas, which are usually for mundane
[10:02]
and routine things like liquor license
[10:05]
renewals.
[10:07]
>> What's that? I' I'd like for you to
[10:08]
speak to us and not to the camera,
[10:11]
please. Uh this is a city council
[10:12]
meeting. Gotcha.
[10:13]
>> Yep. But your time is just about up.
[10:16]
>> It is. You're right. Thank you. Thank
[10:17]
you, council.
[10:18]
>> You are always welcome to stay after and
[10:20]
talk to us more.
[10:21]
>> Um
[10:23]
>> Okay. Anyone else for open forum?
[10:27]
There are no hands raised in Zoom. Okay.
[10:31]
Right. Item E is agenda approval. Can I
[10:34]
get a motion? Move to approve. Second.
[10:38]
>> Any discussion? [clears throat]
[10:41]
>> Please vote. Council member Cone,
[10:44]
>> yes.
[10:44]
>> Council member Lion,
[10:45]
>> yes.
[10:46]
>> Council member Pierce,
[10:47]
>> yes.
[10:47]
>> Council member Grove,
[10:48]
>> yes.
[10:49]
>> Council member Anderson,
[10:50]
>> yes.
[10:52]
>> Agenda item, uh, we have none of those.
[10:56]
So, agenda item I1, consent agenda.
[10:59]
>> Move to approve.
[11:00]
>> Second.
[11:01]
>> Any discussion?
[11:06]
Please vote. Council member Pierce,
[11:09]
>> yes.
[11:09]
>> Council member Grove,
[11:10]
>> yes.
[11:11]
>> Council member Cone,
[11:12]
>> yes.
[11:13]
>> Council [snorts] member Lion,
[11:14]
>> yes.
[11:14]
>> Council member Anderson,
[11:16]
>> yes.
[11:18]
Agenda item I2, uh, mayor's appointment
[11:20]
and resolution, consideration of
[11:22]
appointment or consideration of approval
[11:24]
of a resolution approving appointment of
[11:25]
a citizen member to the parks and
[11:27]
recreation board for an unexpect
[11:30]
unexpired term ending January 31st,
[11:33]
2029. I plan to appoint Roger Claxton.
[11:36]
Can I get a motion? Move to approve.
[11:38]
>> Second.
[11:40]
>> Any discussion?
[11:43]
Please vote.
[11:46]
Council member Cone,
[11:48]
>> yes. [clears throat]
[11:48]
>> Council member Grove,
[11:50]
>> yes.
[11:50]
>> Council member Lion,
[11:51]
>> yes.
[11:52]
>> Council member Pierce,
[11:53]
>> yes.
[11:53]
>> Council member Anderson,
[11:55]
>> yes.
[11:58]
>> Item I3, consideration of approval of an
[12:01]
ordinance to amend chapter 26 park
[12:03]
regulations by amending section 26.12
[12:05]
dogs restricted to rename section 21.12
[12:09]
as dogs and to include dog park rules
[12:11]
and res regulations. Sorry guys, I blame
[12:14]
the heat. It has been a long day. Uh to
[12:17]
include dog park rules and regulations.
[12:20]
This is an introduction and a first
[12:21]
reading.
[12:24]
>> I introduce the ordinance and move to
[12:25]
approve the first reading and title
[12:27]
only. Second, Matt.
[12:29]
>> Good evening, mayor and council. This is
[12:31]
kind of it's a basically a cleanup item.
[12:33]
Uh what we found is back when we opened
[12:36]
the dog park, we passed all the rules
[12:38]
and regulations via resolution, but
[12:41]
they're not in our park regulations
[12:43]
ordinance. Um so in order to seek
[12:46]
assistance from the police department as
[12:48]
it relates to uh hours of operation and
[12:51]
those types of things, uh we did add the
[12:55]
this section uh to include the park uh
[12:58]
dog park rules and regulations under the
[13:00]
park regulation ordinance. So, I'd be
[13:02]
happy to answer any questions you might
[13:04]
have.
[13:05]
>> Thank you.
[13:06]
>> Any questions?
[13:09]
>> Please vote.
[13:10]
>> Council member Lion,
[13:11]
>> yes.
[13:12]
>> Council member Cone,
[13:13]
>> yes.
[13:13]
>> Council member Pierce,
[13:14]
>> yes.
[13:15]
>> Council member Grove,
[13:16]
>> yes.
[13:16]
>> Council member Anderson,
[13:18]
>> yes.
[13:20]
Item I4, consideration of approval of an
[13:22]
ordinance to amend chapter 169 zoning
[13:24]
ordinance, city of Walke, Iowa by
[13:26]
reszoning certain property from KMFSM
[13:29]
to KMFSM/PD1
[13:31]
of property to be known as the REN. This
[13:33]
is second reading.
[13:35]
>> Move to approve the second reading of
[13:36]
the ordinance and title only.
[13:38]
>> Second,
[13:40]
>> Andy.
[13:43]
>> All right. Uh, good evening, Mayor Clark
[13:44]
and council members. Uh before you
[13:46]
tonight is consideration of the uh
[13:48]
second reading for the REN resoning. Um
[13:51]
this property uh just a reminder is
[13:54]
located uh generally north of Southeast
[13:56]
Ashworth Road and east of um Grand
[14:00]
Prairie Parkway. It's approximately 5.78
[14:02]
acres in area and simply this is to uh
[14:06]
the existing underlying zoning is of
[14:08]
course already allows for the
[14:09]
multifamily development. Uh the plan
[14:11]
development overlay would simply allow
[14:13]
them to add one more story to the
[14:14]
building uh for this multifamily
[14:16]
project. Uh that would be a total of uh
[14:19]
80 uh units targeted for active adult
[14:22]
living. Um the proposed resoning is
[14:24]
consistent with the Kettlestone uh
[14:26]
master plan. Uh and staff recommends
[14:28]
approval of the second consideration of
[14:30]
the resoning. I'm happy to take any
[14:32]
questions.
[14:33]
>> Thank you. Are there any questions?
[14:37]
Please vote.
[14:38]
>> Council member Cone.
[14:39]
>> Yes. Council member Grove,
[14:41]
>> yes.
[14:41]
>> Council member Pierce,
[14:42]
>> yes.
[14:43]
>> Council member Lion,
[14:44]
>> yes.
[14:44]
>> Council member Anderson,
[14:46]
>> yes.
[14:47]
>> Item I5, consideration of approval of an
[14:50]
ordinance from in chapter 76, Walke
[14:52]
Municipal Code Bicycle Regulations to
[14:55]
rename Chapter 76's personal
[14:56]
transportation device regulations to
[14:58]
update the ordinance and include the
[15:00]
regulation of personal transportation
[15:01]
devices and upon the effective date
[15:03]
repealing chapter 77 Wii Municipal Code
[15:06]
skateboards. This is a third and final
[15:08]
reading.
[15:09]
I move to approve the third reading of
[15:11]
the ordinance in title only and place it
[15:13]
on final passage. Second, Chief.
[15:17]
>> Good evening, Mayor and Council. We're
[15:18]
here. Um, first of all, thanks to uh
[15:22]
Steve for putting up with uh a year's
[15:24]
worth of working through this and also
[15:25]
thanks to Heather who is up until I left
[15:28]
the station to come up here currently
[15:29]
working on the education component of
[15:30]
this. But, uh, as you've heard us talk
[15:32]
before, this has been a long process to
[15:34]
get to this point. Um we're excited to
[15:36]
have the ordinance um hopefully passed
[15:39]
and that provides us the framework
[15:40]
that's necessary for the direct
[15:42]
messaging related to our education
[15:44]
campaign because up until this point
[15:45]
it's been primarily please be
[15:47]
responsible, please be respectful um
[15:50]
with this ordinance passage that gives
[15:52]
us the actual solid framework to um
[15:54]
provide that messaging that's more
[15:56]
directed on this is what is acceptable,
[15:58]
this is what's not by city code. And
[16:00]
then uh further down the line if we do
[16:02]
run into continuous problems and it does
[16:04]
uh create an enforcement mechanism. Um
[16:06]
but again as I've said all along none of
[16:08]
us want to write a child a ticket. Um
[16:10]
that's not the goal of this. The goal is
[16:12]
to uh put those boundaries in place and make sure that everybody's enjoying
[16:17]
our outdoor space in a safe manner. So
[16:20]
um I'm happy to answer any questions.
[16:21]
There have been no changes since the
[16:22]
second reading. So and I've had no other
[16:24]
feedback since the second reading.
[16:26]
>> I [clears throat] only have one
[16:27]
question. Chief, is there an easy way to
[16:30]
identify whether the emotos are 750
[16:34]
watts or above?
[16:36]
>> Easy in the eye of the beholder.
[16:39]
Um, [clears throat]
[16:40]
not not particularly. What I will say is
[16:42]
that um another component,
[16:45]
[clears throat] excuse me, another
[16:46]
component of the definitions for um
[16:48]
low-speed electric bicycle, which are
[16:50]
legal, okay, the class one, two, and
[16:52]
three,
[16:53]
>> a component of those is operable pedals.
[16:56]
And so, um, if our team or if a parent
[16:59]
were to look at something and say, "Is
[17:01]
this a low-speed electric bicycle or is
[17:03]
this an emoto?" Um, one of the telltale
[17:06]
signs will be, "Is there operable
[17:07]
pedals?" And if the answer to that
[17:09]
question is no, then it's an emoto and
[17:11]
it shouldn't be out and about. Um, so
[17:13]
that's a a quick and easy way kind of to delineate that for the public. Um
[17:18]
Heather has done a great job putting
[17:19]
together some uh quick fact sheets and a
[17:21]
card that we can hand out that shows
[17:23]
what is and what isn't based on uh the
[17:26]
different characteristics. Um we've been
[17:28]
working on some website edits where
[17:30]
people will be able to go in and click
[17:31]
on uh my device is this wattage and it
[17:35]
has operable pedals and it's this and so
[17:38]
all of that's coming together and then
[17:40]
the next piece of that will be our
[17:41]
education component. Once this passes,
[17:44]
um I should say if you pass it tonight,
[17:46]
um then one of the things that we're
[17:48]
planning is is standing up a couple of
[17:50]
officers along the trail in different
[17:51]
places on a couple different maybe a
[17:53]
Friday night, Saturday midday, Sunday
[17:56]
um at different times um to help with
[17:58]
that education component and then uh
[18:01]
looking at what else we can do to get
[18:03]
the word out. But um it is complex. It's
[18:07]
not easy,
[18:07]
>> right?
[18:09]
>> I have a question just for to kind of go
[18:11]
along with that. So, if it's under 750
[18:14]
and it does not have pedals, then it
[18:16]
can't.
[18:17]
>> If it's under 750 by our our code, um it
[18:21]
depends what it is.
[18:22]
>> Yeah.
[18:23]
>> Okay. By our code, um for instance, the
[18:25]
electric scooter is under 750 does not
[18:28]
have pedals and they can operate that.
[18:30]
>> Um but it it would depend on the exact
[18:32]
characteristics that that fit within
[18:34]
that. But typically what um what our
[18:38]
community should rely on as a kind of a
[18:40]
guideline is 750 and above and then
[18:42]
operable pedals.
[18:43]
>> And [clears throat] I think it's also
[18:44]
important to note that while we can pass
[18:48]
this tonight, well, it's possible to do
[18:51]
that. It's also possible that the state
[18:53]
may um introduce some sort of
[18:57]
legislation along the way next year that
[19:00]
could change things
[19:01]
>> absolutely
[19:01]
>> one way or another. And so people just
[19:03]
need to be aware that for now this is
[19:06]
what we have.
[19:08]
>> That is uh yes. So I appreciate that
[19:11]
point. Um it is possible the state will
[19:13]
take this up in the 2027 legislative
[19:16]
session. Uh at this point though our
[19:18]
officers need a way to enforce this and
[19:20]
so I'm very grateful for your work and
[19:22]
continuing to push forward on this and
[19:24]
um and appreciate that. I think the
[19:27]
educational component will be incredibly
[19:30]
important and I appreciate all of our
[19:32]
staff's work on that effort because it's huge and it's very needed. Um so
[19:38]
any other questions?
[19:40]
>> No, I was just going to just a brief
[19:42]
comment. I know I talk on this every
[19:43]
time. Um just a brief comment. as long
[19:45]
as this process has been um especially
[19:47]
for you um over the last year plus um I thank you greatly for starting it when
[19:54]
you did um because there are um
[19:56]
certainly our counterparts in the metro
[19:57]
that are just getting started um or just
[20:00]
figuring out that they have a problem um
[20:02]
and so to be ahead of it is what is
[20:05]
going to save people from getting hurt
[20:07]
and so I appreciate you doing that um
[20:10]
and and taking the initiative. I know it
[20:12]
was it was a begrudging process at some
[20:15]
point [laughter] but um but it was
[20:18]
necessary and we had to work through
[20:19]
some of the things we had to work
[20:20]
through to get where we are and there
[20:22]
may be additional things we have to work
[20:24]
through in a year from now. Um but I
[20:26]
mean this is to have that initiative I
[20:29]
think is is huge. Um and I think a lot
[20:31]
of people are going to use that as an
[20:32]
example too. Um so here we go.
[20:36]
>> Perfect.
[20:38]
>> See council member Anderson has her hand
[20:40]
raised. Okay, Caleb.
[20:42]
>> Uh, yes, Chief. I just had uh some quick
[20:44]
clarification. If if we were to pass
[20:46]
this this evening, when exactly does
[20:49]
this take effect?
[20:51]
>> So, it has to be published um upon
[20:53]
approval of the council, which Becky, I
[20:55]
think that's typically a weekish.
[20:57]
>> It'll be next Thursday, but it'll be
[20:59]
published in the Dallas County News or a
[21:00]
summary of it will be published in the
[21:02]
Dallas County News.
[21:03]
>> So, that that has to happen um before
[21:06]
any enforcement mechanisms can take
[21:08]
place. However, that does not stop us
[21:10]
from going forward with the education
[21:11]
piece of that. And I know Heather's been
[21:14]
working uh with her team on uh a news
[21:17]
release and getting the website updated
[21:19]
and all of that. And that stuff can
[21:20]
happen ahead of that publication, but
[21:22]
the publication's the official um notice
[21:25]
that it's been passed. And then like for
[21:28]
an example, if if one of your team were
[21:31]
to give like a warning to um somebody
[21:36]
writing something that is no longer
[21:38]
appropriate,
[21:39]
do we have kind of that like a plan of how that's handled in the beginning
[21:44]
while this education is getting out to
[21:46]
notify like let's say a parent for
[21:48]
example or how do you handle that if you
[21:50]
just run across a minor along a trail or
[21:53]
a sidewalk?
[21:55]
>> Yeah. So, it it really falls in line
[21:56]
with anything else that our team does
[21:58]
involving juveniles and depending on a
[22:02]
multitude of factors, but you know, if the juveniles receptive and they're
[22:06]
close to home and we say, "Hey, take the
[22:07]
thing home. You can't be riding on it."
[22:09]
Um, then that may be the end of it. Um,
[22:11]
if it's a continuous thing with the same
[22:13]
kid over and over, then we'll
[22:15]
[clears throat] reach out to parents. If
[22:17]
the juvenile is not receptive, we'll
[22:18]
reach out to parents. If it's a safety
[22:20]
issue, then we can reach out to parents.
[22:22]
Um, but it it truly revolves around uh
[22:24]
the officer's discretion at the time
[22:26]
based on what they think is most
[22:27]
appropriate. And um we you all heard me
[22:31]
say it before, but we have an amazing
[22:33]
team. Um they use common sense and
[22:36]
discretion every single day in
[22:37]
everything they do. And um rarely are
[22:40]
they out of line or out of step with
[22:42]
what what I expect of them. And so I'm
[22:45]
sure that they'll handle it uh
[22:46]
appropriately. But it it is up to the
[22:48]
officer's discretion based on the facts
[22:50]
at the time.
[22:51]
>> Okay. Thank you.
[22:55]
>> We know that there are certain areas of
[22:57]
town where we have more
[22:59]
>> um more action than other areas of town.
[23:03]
Will we be posting anything like a a
[23:07]
laminated poster that that describes
[23:10]
what is not really very easy to post
[23:14]
those things. We can put signs at, for
[23:16]
example, parks and on trails, uh, but on
[23:18]
a street corner, they're not going to
[23:20]
see it. And it's not really um but I
[23:23]
think you've spoken uh about you know
[23:27]
being able to not just have the
[23:29]
educational component but having
[23:30]
officers uh through that educational
[23:33]
period uh posting at some of these areas
[23:36]
where we have more issues and uh
[23:38]
speaking directly with kids who are for
[23:41]
lack of a better term violating
[23:43]
and and moving forward from there. Any
[23:45]
additional comments you'd like to make
[23:46]
on that?
[23:47]
>> No, I I would echo that. That would be
[23:49]
part of our focus on our the educational
[23:51]
piece where we put people out along the
[23:52]
trails. Maybe we put them out in an area
[23:54]
where there's a lot of activity and
[23:56]
explain to the children why this
[23:59]
decision was made and and what needs to
[24:01]
happen next. Um, you know, our team's
[24:03]
pretty good about explaining the why
[24:04]
behind what we're doing rather than just
[24:06]
saying you can't be here. Um, and I I
[24:09]
fully expect that to be part of that
[24:10]
education campaign. And then of course
[24:13]
as we go back to school, um we worked
[24:15]
with the school district last last year
[24:17]
on this this uh topic. We made a video
[24:19]
with the school district on this topic.
[24:21]
uh they're willing to send out
[24:22]
information um for us and I have no
[24:25]
doubt that relationship will continue
[24:26]
and we'll continue to work with them on
[24:28]
um on making everybody safe and
[24:31]
ultimately to to uh counselor Pierce's
[24:35]
point, you know, we don't want to see
[24:37]
somebody seriously injured or killed on
[24:38]
one of these and we want to get some
[24:40]
guard rails in place before that happens
[24:43]
and we need parents to help us do that.
[24:45]
Um but this this provides that
[24:46]
framework.
[24:48]
>> Thank you. Thank you. All right, please
[24:51]
vote. [clears throat]
[24:52]
>> Council member Lion,
[24:53]
>> yes.
[24:54]
>> Council member Pierce,
[24:55]
>> yes.
[24:56]
>> Council member Cone,
[24:57]
>> yes.
[24:58]
>> Council member Grove,
[24:59]
>> yes.
[24:59]
>> Council member Anderson,
[25:02]
>> yes.
[25:04]
>> Item I six, consideration of approval of
[25:06]
an ordinance for the Division of
[25:07]
Revenues under section 403.19, Code of
[25:10]
Iowa, for the Walke Consolidated Urban
[25:12]
Renewal Area 2026 ordinance parcels.
[25:15]
This is also a third and final reading.
[25:17]
I move to approve the third reading of
[25:19]
the ordinance and title only and place
[25:21]
it on final passage.
[25:22]
>> Second, Nick.
[25:25]
>> Thank you, Madame Mayor. This is a
[25:29]
change to our existing urban renewal
[25:31]
tiff ordinance uh for the consolidated
[25:34]
area. It covers 2026 additions as well
[25:37]
as uh projects that we know are coming
[25:39]
in the near term. Those [clears throat]
[25:41]
projects are highlighted in yellow. And
[25:44]
this is the there's been no changes uh
[25:46]
since the previous two readings, but
[25:48]
happy to answer any questions.
[25:50]
>> Thank you. Any questions?
[25:54]
>> Right. Please vote.
[25:56]

[26:06]
Item I7, the crossing at Alys's Road,
[26:09]
Plat 6, Hive View Walke Expansion at 105
[26:13]
East Hickman Road. Item I 7A,
[26:16]
consideration of approval of a
[26:17]
resolution approving final plat. Can I
[26:18]
get a motion? Move to approve. Second,
[26:21]
>> Melissa.
[26:22]
>> Good evening, mayor and council. And I'm
[26:23]
going to go ahead and present on both
[26:24]
the final plat and site plan at the same
[26:26]
time. Um, the owner and applicant is Hi,
[26:29]
Inc. Uh, the property is located west of
[26:31]
Northeast Alysses Road and north of
[26:32]
Hickman Road. It contains 12.84 84 acres
[26:35]
in area. It is zoned C-1B, large scale
[26:39]
commercial district. The existing
[26:41]
grocery store building was constructed
[26:42]
in 2013 and then in 2019 they added the
[26:46]
Isisles online structure um within that
[26:48]
parking lot just north of uh northeast
[26:51]
uh Venture Drive, the private street. Um
[26:55]
a previous site plan was approved for
[26:57]
the expansion of HY, but nothing has
[26:59]
been built since that was approved. The
[27:01]
current project includes an addition to
[27:03]
the existing grocery store building to
[27:05]
the next
[27:07]
um
[27:08]
slide there so you can kind of see what
[27:10]
they're doing on there. Uh so the
[27:12]
addition um will include an aisles
[27:15]
online and pharmacy pickup uh just to
[27:18]
the west of the building and then also
[27:20]
additional loading docks at the
[27:21]
northwest corner of the building. The
[27:24]
proposed addition is just under 5,000
[27:25]
square feet in area and then the
[27:28]
existing aisles online structure will be
[27:30]
removed from the site and that area will
[27:33]
be returned to standard parking stalls.
[27:35]
The new loading dock area will include
[27:37]
separate driveway access for trucks
[27:39]
along the west side of the site. Um they
[27:41]
will also add landscaping um just to
[27:44]
provide screening along both the west
[27:46]
and the north sides of the site there.
[27:50]
Um the final plat includes combining
[27:52]
there's an unplatted parcel that part of
[27:55]
that parking lot exists on right now. Uh
[27:58]
you kind of see the line on there. So
[27:59]
it'll just um plat that whole um lot
[28:03]
that exists where the H high store is on
[28:05]
today and then the unplatted parcel into
[28:07]
one large lot and that again that's
[28:09]
12.84 acres. Uh no changes are proposed
[28:13]
to the exist existing access points into
[28:15]
the site. Those will all remain. Uh the
[28:18]
proposed site plan will add a total of
[28:19]
24 parking spaces.
[28:22]
Parking requirements are being met.
[28:24]
Landscaping requirements are also being
[28:25]
met, including those landscape buffers
[28:27]
that I talked about. Um the building
[28:30]
elevations,
[28:32]
um they're proposed to match what is
[28:33]
existing. Uh they're to be constructed
[28:36]
mostly of brick, pre-cast concrete
[28:39]
panels, ephus, and glazing. Uh staff
[28:42]
recommends approval of both the final
[28:43]
plat and site plan, and I'd be happy to
[28:45]
answer any questions.
[28:47]
Thank you.
[28:49]
Are there questions?
[28:53]
Um my only question is uh can you speak
[28:56]
a little bit more about traffic flow and
[28:59]
vetting of that process given that there
[29:01]
have been issues with that in the past
[29:03]
on this site?
[29:04]
>> Yes. So the traffic as far as are you
[29:07]
talking mostly for the trucks or just in
[29:09]
general?
[29:10]
>> Um both.
[29:11]
>> Okay. So the trucks um will access the
[29:15]
um
[29:16]
so let me go here. So this this area at
[29:19]
the northeast corner or sorry the
[29:20]
northwest corner that's the additional
[29:22]
loading docks. They have some existing
[29:24]
ones right here. Um so that'll still
[29:28]
remain over there on the northeast
[29:29]
corner. This will be only for truck
[29:32]
traffic right here. And of course
[29:34]
emergency vehicles if they need to
[29:36]
access it are able to access it as well.
[29:38]
Um they can go in off of the access off
[29:42]
of Alice's Road through here or I
[29:45]
believe um potentially off of this um
[29:49]
>> drive there's aisles that there
[29:56]
» and then the parking lot that is um so
[30:00]
that existing aisles online building is
[30:02]
right here approximately.
[30:04]
>> They're just returning those all to ex
[30:06]
to drive. So, you'll be able to drive
[30:08]
all the way through those drive aisles
[30:10]
and then just turning returning them to
[30:13]
normal parking stalls
[30:16]
>> and they'll likely have the truck area
[30:19]
marked truck entrance or something.
[30:20]
>> Yes, it is only for truck access only.
[30:22]
There's not Yeah. And then the the
[30:25]
access. So right now like the front of
[30:27]
the building has that um drive aisle for
[30:30]
like the um pharmacy that is going away
[30:34]
and they're putting like parking there's
[30:36]
some parking spaces and whatnot. So only
[30:38]
these um to the west of the building
[30:41]
will be the drive aisles for both the
[30:43]
pharmacy and for the the aisles online
[30:45]
pickup.
[30:48]
>> Same access for both. There's different
[30:52]
lanes, but so there's two going into it
[30:55]
and one will be the the aisles online
[30:57]
and one will be the pharmacy. Okay. And
[30:59]
then once you pull through there's it'll
[31:00]
be marked which one you're supposed to
[31:02]
be in for each. And there's I believe
[31:04]
>> and they exit [laughter] the same way.
[31:06]
>> And then they exit out the same way on
[31:07]
the south side.
[31:12]
» Okay. Other questions?
[31:16]
» Thank you. That'll be nice for those
[31:19]
employees that have to do that in the
[31:21]
bad weather.
[31:23]
All right, please vote.
[31:25]
>> Council member Cone,
[31:26]
>> yes.
[31:26]
>> Council member Pierce,
[31:28]
>> yes.
[31:28]
>> Council member Lion,
[31:29]
>> yes.
[31:30]

>> Council member Anderson,
[31:33]
>> yes.
[31:35]
>> Item I 7B, consideration of approval of
[31:38]
a resolution approving site plan. Can I
[31:39]
get a motion? Move to approve.
[31:41]
>> Second.
[31:43]
Melissa,
[31:44]
>> anything further?
[31:44]
>> I have nothing further to add. Thank
[31:46]
you.
[31:47]
Any other questions?
[31:49]
>> Please vote. Council member Pierce,
[31:51]
>> yes. Council member Grove,
[31:53]
>> yes.
[31:53]
>> Council member Cone,
[31:54]

[31:55]
>> Council member Lion,
[31:56]
>> yes.
[31:56]
>> Council member Anderson,
[31:58]
>> yes.
[32:00]
>> Agenda item J is reports. Nick,
[32:03]
>> no report.
[32:06]
>> Report.
[32:07]
>> Uh, no report. Another hot but very
[32:10]
successful arts festival last weekend.
[32:12]
That was fun. Um, otherwise, no. Rob,
[32:15]
>> no report.
[32:19]
>> I welcome the cooler weather.
[32:22]
[clears throat]
[32:22]
>> I was just gonna say that the uh I was
[32:24]
excited to see a good turnout at the
[32:26]
arts festival as well.
[32:28]
>> Perfect. With that, I will take a motion
[32:30]
to adjurnn. So move.
[32:32]
>> Second.
[32:33]
>> All those in favor? I
[32:34]
>> I
[32:36]
>> have a good week everybody.
