I heard the expectations, but I I was
told by somebody like I was hoping that
[0:03]
they would put it in writing. I was
hoping that they would curve curve
[0:06]
perpendicular and then I think that they
would do that. Well, I think they're
[0:08]
going to, so
[0:11]
And that's why that was done by the
Mark Tony and
[0:21]
And then he's mostly family, too.
[0:25]
Let me know. I told you
I want to see what you've got on
[0:29]
We're going to have to
[0:33]
They're going to be doing a $50 million
thing.
[0:35]
I think it's for three months.
And
[0:39]
Yeah.
[0:41]
I'll figure out what we're planning for.
[0:45]
It's part of what they're doing.
It's a different stuff for job.
[0:49]
You know what that was with the arch?
But I just I just wanted to
[0:54]
Let Let me know if they
[0:59]
You know what
I I I was talking to one of the planning
[1:02]
guys.
[1:10]
I have a decision to
[1:14]
No, I didn't
[1:19]
Oh, yeah, maybe
[1:24]
First of all, they
[1:27]
And that's why the guy is smart.
Drive away like this.
[1:31]
This is all what you
[1:35]
I don't know.
He said they got to figure out how
[1:37]
they're going to do this.
[1:40]
We'll spring a
manufacturing down in the form of a
[1:44]
mess.
[1:48]
So, what they got to try and walk by by
the church?
[1:51]
But they So, that that is Start rolling
there.
[1:54]
They got to They literally They put them
on the top of the top of the yard.
[1:59]
I don't know.
[2:12]
So, we met with him
[2:24]
That's weird.
West Palm?
[2:58]
Yeah.
[3:04]
That is
Did they arrest
[3:18]
Well,
there's two ways to do this.
[3:34]
So,
we're going this far with him.
[3:44]
Basically, I look at him and I'm like,
[3:52]
And that's the problem.
[4:11]
I can tell that it's previously done.
[4:20]
Bring those over.
[4:24]
I would pieces that are still good.
You're not intimidated
[4:29]
No.
[4:35]
I don't know.
[4:38]
No, I see.
Huh? I know you want
[4:42]
That doesn't make
It's not my property.
[4:47]
Where is his property?
Okay. I didn't say anything.
[5:03]
I grew up
[5:06]
And then you know
Yeah, they just
[5:10]
I don't know.
[5:16]
I'm going to try and put this up.
The crazy thing is
[5:39]
So finally
I was coming to work.
[5:44]
Are you going to sell all these off?
Give me another call.
[5:49]
I'm sure you are.
[5:55]
Yes.
That's it.
[6:00]
I'm not
[6:07]
Yes.
Right.
[6:15]
I was
[6:21]
You know what's funny?
He's the last one I called.
[6:26]
I know he's
[6:38]
» [laughter]
>> Keep me on your toes, John. Keep me on
[6:42]
your toes.
[6:46]
I wish him the best.
But that's what he was all worried
[6:48]
about.
So I know it was a Christmas
[6:52]
I called
[6:54]
Well,
you guys you take it
[6:57]
I know it's called the best
I finally got
[7:02]
It's silly.
[7:08]
And he's not
He asked not
[7:10]
and
he's just being a Yes.
[7:15]
I was I was
Yes.
[7:19]
Hey, you know what I don't have to worry
Yeah.
[7:23]
So that's where you can get it.
Everything's got to balance. Okay. Uh
[7:30]
They're anything
If you have anything it's worth a
[7:32]
million dollars.
[7:35]
But he's a
[7:39]
So if you want to come in and see it, I
mean
[7:41]
This would be a first for me.
Great.
[7:49]
All the neighbors are like
[7:57]
You know, I mean well, yeah, that's one
of the
[8:12]
We could but they just give you the
president.
[8:23]
Cuz once you go through this
[8:48]
It is my distinct pleasure to welcome
you to our May 4th meeting. I want to
[8:50]

bill today.
[10:06]
And then the approval of the minutes of
the last meeting was sent for your
[10:09]
consideration. No. No.
All right.
[10:12]
I can't hear you.
Excuse me.
[10:21]
We'll approve those. And what?
[10:24]
I don't care if you're deaf or not.
Can you hear me better or not?
[10:27]
Oh, bring it up.
Can you hear me better? Yes, better.
[10:31]
All right, thank you.

[11:33]

Motion carried.
[11:37]
Any public interest tonight?
Yes.
[11:41]
Hi. Hi. How are you? How are you doing?
Good.
[11:49]
Hi. How are you? It's good afternoon. Uh
my name is Louise Berger. I represent
[11:52]
Love Nail Dispensary uh over on the
Niagara Falls Boulevard. Joe here
[11:57]
with the executive director. Actually,
it's 3176
[12:00]
Niagara Falls Boulevard. 3176 Niagara
Falls Boulevard.
[12:04]
Um I spoke with Matthew Broderick, the
town attorney, uh past few months asking
[12:08]
for an extension of Sunday operating
hours.
[12:11]
Uh currently, uh
Town of Wheatfield specifically
[12:16]
is about 4 and 1/2 hours less than any
other Niagara County uh dispensary and
[12:22]
almost 5 and 1/2 hours less than any
dispensary in Erie County. Um
[12:27]
We have about at least 40 pages of
patrons with Love Nail who's asked for
[12:32]
an extension of hours that we're happy
to provide here in public commentary,
[12:35]
but today we're really just looking for
a resolution to pass that we can tell
[12:38]
the people we need um
for public comment that it's hopefully
[12:41]
extend hours for any dispensaries uh
in the Town of Wheatfield.
[12:47]
And I believe and you know, I'm sorry
Matt was off sick today. I know. I'm
[12:51]
lucky. Yeah. Um
I think he probably was watching the
[12:55]
circle as well.
But it seems to me there was a local law
[12:59]
that regulates
the hours of operation for dispensaries.
[13:04]
So, if anything, we would have to modify
the local law to open up on Sunday.
[13:09]
You know, I don't think the the board
has discussed this.
[13:15]
So, I I guess what maybe I could say to
you is that we should discuss this. I
[13:20]
wish Matt was here, but unfortunately
he's sick to discuss.
[13:23]
Um and and I guess the reasoning is
because of the
[13:27]
uh the actual number of dispensaries on
top of that. I know we you currently
[13:31]
operate from 12:00 to 5:00, which is
what's permitted but
[13:34]
um both of us have state law. Um
the state of New York has no regulation
[13:39]
in regards to Sunday operating hours and
town of Fishkill is actually the most
[13:43]
strict of any of the localities in the
area. So, the real issue comes into
[13:47]
play, especially on things like those
Sunday games and we're on Sunday that
[13:51]
12:00 to 5:00 uh window really impacts
businesses. Um
[13:56]
just for reference, you know, we're
talking about the difference between
[13:58]
making $400 a day between $1,500 a day.
So, that can really impact a small
[14:03]
business and actually this is an area
that small businesses is, you know,
[14:06]
marketed and and um you guys have done a
great deal for small businesses and we
[14:11]
just are looking to have an extension of
hours from 9:00 to to 9:00 or uh 9:00 to
[14:18]
to 8:00. Having a fun, you know, we're
granted here, but
[14:22]
um
really it's it's coming to impacted
[14:25]
problem for for that Sunday period.
All I can say is that I mean again, I
[14:30]
wasn't here. I'm not sure of the
specifics, but I believe it's a local
[14:34]
law that regulates so we would have to
modify the local law.
[14:39]
And if you would um
give me your name and phone number, I
[14:43]
will contact you and we can sit down and
you can tell us your justification why.
[14:49]
Sure. And then I can discuss that with
the board and if we feel that action
[14:52]
should be taken, we will let you know.
So, I talked to Matthew two days ago. He
[14:56]
has already drafted a resolution. So,
would it make the most sense for the
[14:59]
three of us to talk and for him to
propose the resolution? Is that
[15:02]
something we can do prior to next
month's meeting then we can hold a
[15:06]
public comment?
>> we can we can meet and discuss it.
[15:09]
Um but as far as doing a formal
resolution, that would have to go to the
[15:13]
board meeting.
May I ask if there is uh
[15:16]
some adversity to extending the hours?
Um the hours that we haven't discussed
[15:21]
it. I personally have no problem it. But
the are board members accept it as a
[15:25]
board, so it's it's a voting decision.
Sure.
[15:28]
Before we have that meeting, is there
anybody that would like to ask any
[15:31]
questions or any questions regarding the
extension or anything that may be
[15:34]
helpful
to give a little bit more clarity to
[15:37]
this to this extension of hours? Yeah,
good question. Sure. Your website posted
[15:42]
this year hours on Sunday were from 9:00
to 7:00.
[15:46]
And I think you just recently corrected
it back to 9:00 to 5:00. Yes, uh Were
[15:50]
you open to 7:00 on Sundays? No, so when
the original website was first built
[15:55]
that during that final inspection
period, that's before you even begin
[15:58]
opening. You do that through the OCM and
you know, Julie and I we looked back at
[16:03]
the reason it was changed is because
Matt had brought that to our attention
[16:05]
and we actually didn't know that that
was the case with the hours.
[16:08]
» hours were really to 5:00 and not to
7:00? They were to 7:00, now they were
[16:12]
5:00.
So what site was wrong?
[16:14]
Website was wrong and at this point um
we haven't you know
[16:20]
any real uh events past 5:00 at this
point.
[16:24]
Does anybody else
I do have a question but it doesn't
[16:28]
pertain to the old Sure. Go ahead. I had
a couple of residents call me about the
[16:32]
lighting at the
corner of Hoover and Wolcott.
[16:35]
It's right up near the sidewalk
and they come down Hoover and they can't
[16:39]
see the cars coming.
They have I have two residents called.
[16:44]
Okay. They said one side you almost have
an accident trying to pull out
[16:47]
cuz that big open flag there and
Sure.
[17:03]
And they come down Wolcott pretty quick.
Yeah. The cars can't so somebody coming
[17:07]
out of there
Hoover is got and Hoover and Wolcott is
[17:11]
going to be able to see
the folks.
[17:12]
Yeah.
Yeah, there was a fatality at 14 years
[17:16]
old and I think it's all down there.
Can't see if they have any lights. I was
[17:20]
going
[17:23]
I
have no problem.
[17:25]
You know, I would I would say this
personally I mean what you're doing is
[17:28]
completely legal.
And
[17:31]
I will talk to the board members between
now and the next meeting.
[17:35]
And
we support all our businesses in the
[17:38]
town
and I don't think your request is
[17:41]
operational personally. So
again I wish you the best of luck.
[17:49]
No, I understand. Thank you for letting
me Thank you.
[17:56]
Anyone else?
[18:07]
Not as much just
almost wrapped up all of our hot
[18:10]
patching for the year or for the spring.
We're going to start actually milling
[18:14]
and paving hopefully the end of this
week.
[18:16]
We will be spending a lot of time doing
maintenance work on existing roads. Not
[18:21]
as much blacktopping as usual because of
the weather we had really beat the roads
[18:25]
up.
The only other thing I have and we've
[18:28]
been getting calls for these people I
guess you have a few people here but I
[18:31]
don't think any of you guys care.
We're actually getting calls for people
[18:35]
in their lawns with the grass with these
stupid garbage cans. They don't know
[18:38]
what to do with their grass. They call
modern
[18:41]
Modern tells me call leaf hills. I am
not collecting grass and they are not
[18:44]
coming to my shop. So if you have
neighbors that ask you what to do with
[18:47]
the grass tell them to get mulching
blades.
[18:49]
Cuz Well, we can suggest composting
mulching lawn mowers and they can take
[18:55]
bag it and put it in their compost
thing.
[18:58]
Modern told me they won't. Well, I don't
know what to do. Yeah, I know.
[19:01]
I I don't
I just in case people ask you guys on
[19:06]
the board, you know, what am I supposed
to do with my grass?
[19:08]
Those are the only choices. Dumping it
at my shop is not an option.
[19:12]
Okay.
And if the bag got to be in the garbage
[19:17]
for us.
Right. Besides that, that's all I got.
[19:20]
Thank you so much.
[19:23]
I was getting a cherry yogurt.
And then you come to the water
[19:26]
department, too.
[19:34]
Good evening, Anne. Mark will be out
probably for
[19:38]
a month or two, so
I'm telling the shoes as best we can. Uh
[19:42]
we we've been busy.
We've been busy and like Paul was saying
[19:46]
with the weather and everything.
We've been trying to catch up with the
[19:49]
last meeting and
the weather is trying to hold us back,
[19:52]
but we we've been moving. We've had a
couple of water and sewage taps that
[19:56]
we've been working on.
Um
[19:59]
drainage issues as usual, but we still
got to do the sewage. We rebuilt that.
[20:04]
And the SPCA and the dog unit has been
involved a little bit with
[20:09]
that issue, but
trying to resolve it as best we can.
[20:12]
They're doing a better job with trying
to keep more of that pet hair and things
[20:16]
around. You know, they You know I was
over there.
[20:19]
Yeah, Mark had mentioned that.
And I mean, of course I'm a big
[20:22]
supporter of anybody who loves animals,
but
[20:25]
they're trying to be a little bit better
at making sure they keep what pets they
[20:28]
have or looking for Yeah, Mark went out
there as well and got to give them the
[20:32]
suggestions, but it seems to be working
for now, so fingers crossed. They're
[20:36]
doing great.
You know, I don't
[20:38]
see any cats out there as much over
there.
[20:41]
Uh
we're going to be doing the seasonal
[20:43]
drainage cleaning as well, so the
hopefully we have a few summer help come
[20:49]
kids to help with that. They'll rather
than that, they're going to have town
[20:52]
IDs and and uh
uniforms as well, so people don't
[20:57]
freak out who's in the yard doing that.
We're just doing the seasonal things.
[21:01]
Uh the
lead testing has begun.
[21:04]
Uh
working with Mr. Zuber there. We're
[21:07]
We've got coffee here.
Finals dropped off tonight for tomorrow.
[21:10]
We have
two more pickups scheduled for that. So,
[21:13]
that that should be taken care of by the
beginning of June.
[21:17]
Uh that's the requirement. We're trying
to get that done ahead of schedule.
[21:21]
And
um
[21:23]
that that's about it. We've been working
with Tim Waltz and also with Ronald.
[21:27]
Give my best to Mark and
We'll look forward to it.
[21:30]
Thank you.
And you can say hi to Mark for me.
[21:35]
And Mike Brunalli was excused tonight
for personal business. First job
[21:39]
building permits.
[21:48]
Just a couple things. Um
our new guy, he is halfway through his
[21:52]
classes, so he is currently uh certified
assistant BSI. Uh a few classes over he
[21:58]
is supposed to be a CEO.
And secondly, we began a street cleanup
[22:02]
around the town. Uh
we pulled probably
[22:06]
I'm going to say nine violations as of
today. And we have
[22:10]
a couple cases that are heading to
further
[22:14]
um
enforcement. Uh proceed with that.
[22:17]
And a couple things that I'm going to
work with Tim on tomorrow. And hopefully
[22:20]
this goes well.
Um do you guys have any questions?
[22:24]
Is there any way to expedite the
process?
[22:28]
Hey and uh First of all, are there any
other issues with the vehicles cycle
[22:31]
balance? Yeah, we're we're we're trying
to get all of that. And we're working on
[22:34]
it with uh
So, the new people doing that.
[22:37]
So, once he goes through his final
process to get certified
[22:40]
for
BSI, he can
[22:43]
start writing those violations.
So, we can start hitting your guys with
[22:48]
understand not versus when it's not
versus when
[22:52]
Thanks so much. Ricky.
You're welcome.
[22:55]
Thank you.
[22:58]
Call me counselor on this session.
[23:10]
» Hello.
Um
[23:12]
So,
tentative roll link is on the homepage
[23:18]
of our website. It's uh
[23:23]
So, it is on the front homepage right
there that says the link
[23:27]
to tax roll to write to the mayor. I
just checked it. So, it's
[23:31]
the link that says the
assessment roll or tax roll on the
[23:35]
homepage of the website. It says the
link right to my zone where tentative
[23:40]
roll is
posted. Tentative roll is out as of May
[23:44]
1st.
July 1st will be final roll. And so,
[23:48]
right now, between now and July, I can't
change anything. So, if any resident
[23:52]
comes in asking, I can't do anything.
They would have to go to the Board of
[23:55]
Assessment Review. And that is scheduled
for late July of this year.
[24:01]
Um
Then, I would also I gave you guys a
[24:06]
memo. I'm requesting to go to Attica for
um IAAO class and take the exam. The
[24:13]
highest level in the assessing
you know,
[24:18]
and I just kind of
want that and um
[24:22]
I've been working towards that, taking
exams and different classes and
[24:25]
everything. And now, I'm at that level
that I would like to take that and get
[24:28]
that designation.
All right.
[24:32]
Um you know,
I'll make the motion now. Okay.
[24:35]
Second.
And we have a second. All in favor
[24:37]
signify by saying aye. Aye. Aye.
Uh
[24:40]
all opposed? Motion carried. All right.
Thank you.
[24:54]
No, sir. Thank you.
[24:59]
One more thing today?
[25:02]
No worries about
I just want
[25:06]
And you want me to you want me to make
it happen for you?
[25:11]
Are you ready to get everyone?
Uh we just have two things on our agenda
[25:14]
this evening. The first is a planning
board summary from
[25:18]
April. Now we're kind of back on
schedule again and we're doing one month
[25:22]
at a time here. So
our first meeting April on April Fool's
[25:26]
Day
appropriated
[25:28]
The first item on that that agenda was a
site plan for Policano's Marketplace.
[25:32]
That's been in front of the planning
board several different times.
[25:37]
But the applicant is proposing to expand
their existing Policano's Marketplace
[25:40]
business at 338 and 3354 Airport
Boulevard.
[25:45]
Uh they recently revised their plans and
now propose to move the actual
[25:49]
Policano's Marketplace visual building
uh to a new building that's going to be
[25:54]
constructed on next door. The new
Marketplace would occupy 18,600 square
[25:59]
feet in the new building and it'll
include a 3,000 square foot and 3,600
[26:04]
square foot tenant space on either end.
The existing Marketplace building will
[26:09]
be extended by a 3,000 square feet and
include a 1,200 square feet of an
[26:12]
outdoor eating area.
There's also an additional 10,000 square
[26:16]
foot retail building and three pole barn
storage buildings that are proposed in
[26:21]
the complex.
The storage buildings would be only for
[26:24]
ancillary uses for the businesses that
are in the complex. It's not meant for
[26:29]
commercial storage.
The complex will have an additional
[26:33]
access point to Airport Boulevard. The
development will be phased and include
[26:37]
parking, landscaping, stormwater
management practices to support the
[26:40]
overall development.
It's going to remove the two existing
[26:44]
curb cuts from the residences that are
in the lot that were acquired next door
[26:49]
and uh we've replaced it um with a
modified, expanded
[26:53]
single, um, access point.
Parcels are all zoned commercial and
[26:57]
fall within the Nitro Industrial Overlay
District.
[27:00]
Planning Board continued discussions on
the critical issues and
[27:04]
uh, discussed the project's need to
update their project documents, design
[27:08]
reports, uh, swept, etc. to come up with
a new layout and configuration of the
[27:13]
site.
They were almost complete with the
[27:16]
previous, uh, layout, but now they need
to do some adjustments
[27:21]
to accommodate the needs that changed
with the fire.
[27:23]
So, no action was taken on that project.
The next item was the site plan for
[27:28]
Comfort Plastics Addition.
The applicant proposes to construct a
[27:32]
27,000 sq. ft addition to the existing
building at 2107 Liberty Road.
[27:38]
Site is zoned industrial and is in the
Airport Potential Impact Area.
[27:42]
The addition would be to provide a
additional storage of plastics products
[27:46]
at the facility. There is no
manufacturing at the site, just storage.
[27:50]
The addition would be in an area of the
site that is currently paved with other
[27:53]
back access.
The Planning Board issued a negative
[27:56]
declaration of procedure and
subsequently approved the site plan with
[28:00]
four conditions.
That's been in front of the board a
[28:03]
couple times as well.
[28:06]
Last item was the site plan for
Simonton.
[28:09]
The applicant proposes to construct a
90,000 sq. ft prefabricated metal
[28:13]
building within the footprint of the
recently demolished 345,000
[28:18]
sq. ft industrial building and office
space at 6601 MacCorkle Ave.
[28:23]
The new building would be constructed to
support industrial
[28:28]
industrial ceramic processes.
Site is zoned industrial, general
[28:32]
industrial, and falls within the Airport
Zone 1 Overlay and Airport Protection
[28:37]
Area, obviously.
Project proposes to restore portions of
[28:41]
the impervious site's lawn area to
reduce the impervious coverage we take
[28:45]
on stormwater management practices.
Planning board discussed several items
[28:49]
including utility capacity, drainage and
coordination with the NFPA, FAA and Air
[28:54]
Force Base.
Planning board declared meeting to
[28:58]
status under secret motion again
coordination with you.
[29:02]
No other action was taken.
That was it for the first meeting and
[29:06]
the second meeting for April 15th was
cancelled
[29:10]
Sorry.
Uh the second meeting was April 15th but
[29:15]
it was cancelled due to lack of agenda
items.
[29:18]
So that is our planning board summary
for April. Any
[29:22]
questions from anybody on that?
[29:27]
So our our only other item is we
have a
[29:32]
a memo and some updated fees on our
engineering fee schedule that we're
[29:36]
proposing. We have a motion in our
packet for you tonight for that.
[29:39]
Uh basically we're proposing an increase
in inspection fees for our engineering
[29:44]
fees.
Uh we don't have any on the books or
[29:47]
schedule at this point but
our inspection fees are going up so we
[29:51]
have to increase that fee from $25 to
$150.
[29:55]
And these are fees that are paid by the
developers during construction not by
[29:58]
the town.
Uh the other item in there is our base
[30:02]
site plan review fees.
Currently $600 we're proposing to
[30:05]
increase that to $800.
Uh that's for projects that are under an
[30:09]
acre and we can see the influx of those
which
[30:12]
we think it's good cuz people trying to
stay underneath the threshold to uh meet
[30:16]
the requirements of the state's
stormwater requirements
[30:19]
but we're finding that there's many of
the same things that need to be looked
[30:22]
at during those site plans as well.
So we have a motion.
[30:26]
Uh
We'll leave it at that so you can go to
[30:29]
the next That's all we have.
[30:37]
Any council remarks on the budget
section? I didn't think tonight did.
[30:41]
Um nothing really official but I do want
say that a week ago Friday I had the
[30:45]
pleasure of joining our Sheriff's
Department and graduating eight
[30:50]
correctional officers.
Six of those were from Niagara County,
[30:54]
two from Orleans County.
And when you think about correctional
[30:58]
officers today and
the ability to rehire them and retain
[31:03]
them is right up there with volunteer
firemen and EMS. It's one of those
[31:10]
special things that you just can't hire
anybody. So I was very proud to be there
[31:15]
during that graduation. They've done an
outstanding job and we have a list now
[31:19]
going for yet another class coming up
there.
[31:23]
It's nice to see eight correctional
officers.
[31:31]
It was a pleasure hearing some of those
economic development projects,
[31:34]
especially Calcano's.
Before I retired when I was commissioner
[31:38]
of the county Department of Economic
Development, we worked hard with the
[31:42]
folks at Calcano's to help them with
their expansion. And they were just
[31:46]
granted an extension of their low-cost
power that the county offers through the
[31:51]
Empower Niagara program. So it was great
to hear those great to hear your report
[31:56]
on Calcano's.
And and just thanks for being here. I
[31:59]
appreciate it.
[32:05]
Motions.
The first motion is from Wine Lo.
[32:10]
Move to approve the statement of need
granted variance to May 26th while
[32:14]
applying for the variance
in PSC in question please
[32:18]
and in accordance with Wine Lo's letter
dated April 30th.
[32:22]
It says
we have to do it in order.
[32:26]
Motion is
So moved.
[32:28]
Seconded. But we're going to put these
things in the minutes for you. They just
[32:32]
stand alone.
It's very very valid in that instance.
[32:35]
Is there anybody else left?
Now they're in agreement.
[32:40]
» Yes.
[32:44]
All members of the board signify by

from Reno for maintenance and compliance
with the town's weak field chlorine

testing
including transportation, registration,
[33:08]
and lodging.
[33:13]
I'll make a motion.
Second. The motion is seconded. All in

[33:22]
The next motion is from our recreation
department to approve and authorize the
[33:26]

[33:29]
Um
[33:33]
Um Mark Durlak, water sewer department
superintendent, to hire
[33:37]
Ronald Horton, Dwayne Grayson, and
Summer Weismore to help at Wayne Curve
[33:42]
starting May 11th at a rate of pay and
terms pursuant to staff specifications
[33:47]
of the water sewer department with no
help pending approval from the Niagara
[33:51]
Resources and the Niagara County
Terminal Bag Contract. So moved. Second.
[33:56]
The water sewer superintendent
[34:02]
All right.
Motion and a second. All in favor
[34:04]
signify signify by saying aye.
Aye. Opposed?
[34:08]
Opposed carried.
Motion from the budget director
[34:11]
Um at this time the board has hereby
approved and authorized the expense for
[34:15]
the amount of $308,000
from the highway equipment capital
[34:20]
reserve fund for the purchase of a new
2026 2027 Mack Granite tandem dump truck
[34:27]
with a plow and wing
universal plow and wing as well as
[34:31]

department subject to a 30-day
[34:35]
permissive referendum notice of which
shall be published in the town newspaper
[34:40]

The next motion is from the town board
[34:51]
and town attorney to approve and
authorize the supervisor to sign a
[34:54]
letter of agreement to sign a letter of
agreement for workers compensation audit
[34:58]
with Wegmans company.
So moved.
[35:02]
Second.
Motion moved and seconded. All those in
[35:04]
favor signify by saying "Aye." Aye.
Opposed?
[35:07]
Motion carried.
The next motion is from the recreation
[35:11]
department to hire Mackenzie Grace
Bolender as a summer seasonal park
[35:15]
worker for the summer camp at a rate of
pay in terms pursuant to job
[35:20]
specifications for the recreation
department, seasonal help, and attending
[35:24]
to Bolender's Grace Bolender's needs at
the Niagara County summer camp.
[35:30]
So moved.
Second.
[35:32]
Motion moved and seconded. All those in
favor signify by saying "Aye." Aye.
[35:36]
Opposed?
Motion carried.
[35:39]
Thank you, Catherine.
[35:44]
Board member Fred Ehlers.
Uh it's just one item I have. I sent an
[35:49]
email out. The town has outdoor Wi-Fi in
the parking lots
[35:54]
connected to the town hall and the
community center.
[35:57]
And uh our maintenance renews for the
coming up June today.
[36:02]
I sent an email out to the town board
and town department
[36:05]
to see how much use it's getting.
And uh
[36:08]
we're waiting to get the statistics on
it.
[36:11]
It's It's like a little over $400 a year
for the maintenance.
[36:14]
So, it's something to question whether
it's
[36:17]
worth spending $400 for the maintenance.
So, we're trying to figure out
[36:22]
uh who's actually using it. I don't know
if the password will be used or if the
[36:26]
sheriff's department or
if they have court right here if people
[36:29]
are on their phones. to
get their tickets and parking in the
[36:31]
lot.
We have outdoor Wi-Fi and
[36:35]
anybody who goes to the using the
internet, you know, they have a little
[36:38]
need. I guess it's as long as we can
decide whether or not we keep it or not.
[36:47]
Here's
[36:50]
Hey, do you use the
statistics inside
[36:54]
the radio? We were able to study them
all
[36:56]
off the internet, so
it's kind of the same thing really.
[37:01]
You know, they they contract with the
instrumental in getting these boards by
[37:05]
the end of the COVID process in
2021 and 2022 and
[37:09]
then they put them in uh cuz
people
[37:13]
needed Wi-Fi to do their computer work
and they couldn't socialize in public,
[37:16]
so they figured they'd just go and hang
out in the parking lot in their cars.
[37:20]
So, that's that's why we put it in,
but I don't know how much it's being
[37:23]
used.
And we're glad you're using it again
[37:26]
because
we didn't know if we wanted to pay for
[37:28]
If you cut it off, can you get it back
on? We could.
[37:31]
But if we don't pay the maintenance, the
licenses will expire
[37:35]
and it's due June 7th.
You know, it'll just start charging us
[37:39]
monthly.
Well, now we don't have a cellular cuz
[37:43]
Wi-Fi is useless at all.
I mean, it's part of the college and
[37:47]
nothing. Well, what we're trying to tell
her is, you know,
[37:51]
so if we don't get any use at all and we
think we should keep it
[37:58]
Does anybody else want to chime in?
[38:02]
Any other items?
[38:05]
There.
Anything else?
[38:08]
What is that?
I've got correspondence from Berkley's
[38:11]
fire hall. They want to add dog jacks
through the asphalt. You don't make that
[38:16]
motion.
Second. I have a second. All in favor
[38:20]
signify by saying aye.
Aye. All those opposed signify Mr. Thank
[38:26]
you.
Nothing tonight.
[38:29]
Nothing tonight.
Thank you.
[38:42]
Mr. Brady, I. I have nothing.
[38:46]
I just want to remind all the people out
here in our town employees
[38:51]
of the town was mandated that all of our
employees do receive CPR training.
[38:55]
And that will take place the
[39:00]
here at the town hall.
And
[39:03]
I want to say I attended the
CPR training about 6 weeks ago.
[39:08]
And it's well worth
[39:11]
how things have changed over the years
for CPR training.
[39:14]
Well worth it and I think it'll be a
benefit to all of our employees.
[39:19]
Also, we're getting ready
We have two constables graduating from
[39:23]
the peace officer class.
And I didn't realize how extensive it
[39:28]
was.
Uh
[39:30]
in fact, this week they're at Buffalo
doing
[39:33]
a warehouse actually shooting training.
It's actually pretty intense what they
[39:38]
do.
Uh
[39:40]
and I I kind of practice
I wish you very, very proud of them
[39:46]
and what they do.
So, there's a lot of opportunities
[39:49]
there.
I believe the certificate of course is
[39:51]
never attained by them.
So,
[39:53]
Mr. Brady is doing it the
early December will be their graduation.
[40:01]
And that's all I have. Any further
public input?
[40:06]
Cathy Nelson.
Um
[40:08]
we've had
[40:11]
we've had a few calls from residents
regarding the recycling folks.
[40:15]
Um we had one today which is
that people are allowed to have two or
[40:20]
three recycling totes.
Um, Modern
[40:25]
and they can they can only be picking up
one tote. So, the customer the resident
[40:30]
calls Modern and Modern says, "Well, our
records show you only have one tote."
[40:34]
The town records show that they have two
totes.
[40:37]
So, what we learned today is that
um
[40:40]
the Modern database for recycling totes
has not been updated.
[40:46]
the file was sent to Modern.
The residents can get additional totes
[40:52]
recycling totes picked up.
Um, so there's been a lot of confusion
[40:57]
about that and we
we've been getting calls. So, we finally
[41:00]
resolved what the issue was. So, if the
people call out their recycling totes,
[41:05]
they can get the additional totes. They
should be picked up and Modern will pick
[41:12]
Well, unfortunately the additional totes
coming in Nope.
[41:16]
I guess they're at Modern, but we
haven't seen them yet. That's why I've
[41:19]
been telling people if you come in and
get one,
[41:22]
I don't know when you're going to get
delivered to your house cuz like I said,
[41:24]
we're starting paving and that comes
first. Well, you know, unfortunately one
[41:28]
of the one of the departments
uh
[41:30]
one of one of the other departments
Michael Nardone already agreed
[41:35]
to one of the talks with you all.
Yeah, something that's not a problem.
[41:40]
Um,
I'm going to check with Modern tomorrow
[41:43]
to see when they're being delivered.
Yeah, sure.
[41:48]
Our next meeting is May 18th, 2026 for
bill paying only. The new person will be
[41:53]
our regular town board meeting
at 7:00 p.m.
[41:59]
Have a motion to adjourn. I'll second.
Can I say something, please?
[42:04]
Use the mic.
Okay. What would you like to talk about,
[42:08]
please? Hi.
I know my property has been a a problem.
[42:13]
Can I speak to the mic, please?
I know my property is I need to do it
[42:17]
and follow
okay it's been a problem
[42:22]
but
I'm 70 years old
[42:25]
and my age I should be tired and bored
of them
[42:28]
can't be if she asks for something I
help her
[42:32]
behind over there is Burger I helped out
I followed up
[42:37]
the legislator
I got money in jail
[42:41]
write my share was because I'm putting
dirt on the road
[42:44]
just to help people
I like my problem is I bring things home
[42:50]
I file it I clean up I clean
I got a
[42:55]
it's a hoarding issue but um
I've been taking various vehicles and
[43:00]
bringing them in every day I know
it's a mess and I got a fence permit
[43:06]
but this is what I'm going against Gary
and I'm a homeowner
[43:10]
why can't they
just if I'm doing it and they say he's
[43:15]
not bringing me in front of the judge
again
[43:17]
I'm asking the town to give me this July
4th
[43:21]
I asked to
build this
[43:23]
building and they said I'm not here for
culture I'm moving I can't be resolved I
[43:27]
talked to Gary about it
so I'm working my butt I just
[43:32]
I apologize to the town for the mess
it's just I help everybody
[43:39]
because I'm always busy in my age I
shouldn't be
[43:43]
but
I got to get out of this town
[43:46]
and
and then I tried doing too much and I
[43:49]
shouldn't bring me back to my property
and and it's by the way you're doing a
[43:52]
great job
but um
[43:55]
I just asked if you could ask to go in
front of the judge again this July 4th
[43:58]
it's just it's
it's not going to be
[44:01]
homes in front of the judge again Gary
he'll slam my hand say there's no golden
[44:07]
problem there
There's
[44:10]
There's no I am I got kids. There's I
don't know what to say to
[44:15]
all this stuff, but I got to get rid of
the lumber. I tried They the town won't
[44:20]
let me take this old lumber I got off
jobs and they don't take their tires no
[44:25]
more.
I mean this is the only way I can get
[44:28]
rid of this stuff
is probably piling in the woods, but I
[44:32]
don't want to do it. I just
I took some lumber off of Daniel's jobs
[44:37]
and
you know, it's I apologize to the town.
[44:41]
I just asked him to really pardon me. He
didn't need to wipe off
[44:45]
family in the front of
the area again because
[44:49]
it's not going to help.
He's getting spoiled and sitting in town
[44:54]
and I apologize. You know, I mean
I just want to say this to you that that
[44:59]
one the town board
uh
[45:02]
I think you all know you're a good
person. All you're doing is helping
[45:06]
However, we are not in a position
to force the building department or the
[45:10]
court.
I think if anything you need to approach
[45:14]
uh the building department with a
request for adjournment. And if the
[45:18]
judge doesn't feel that's appropriate,
then they'll continue uh
[45:22]
trying to get you to clean up the
property.
[45:24]
Okay, but it's not going to happen. And
I'll get a
[45:28]
fine down with all the board vehicles
and I'm working
[45:32]
on the grass [clears throat] I cut. I'm
not
[45:34]
making my property my final clean. Thank
you, John. Yeah. Well, thank thank you,
[45:39]
John. Thank you.
Motion to adjourn?
[45:43]
Second.
All members signify by saying aye. Aye.
[45:46]
All members signify by saying aye. Thank
you.
[46:03]
I'm getting
[46:12]
» You have
swallowing here.
[46:17]
You do better?
I just take out the moisture.
[46:22]
I bring everything home.
I'm a bad boy.
[46:29]
Talk to Jerry tomorrow.
[46:40]
All right.
All right. Go ahead. You're here
[46:43]
tomorrow.
Talk to Jerry.
[46:46]
I can't talk to Jerry. Yeah, you got to
talk to Jerry.
[46:49]
Cuz I'm talking to Jerry right But they
didn't say anything to
[46:52]
I would get talking to Jerry.
[46:56]
I would get talking to Jerry.
I'm proud the problem.
[47:01]
I'm proud of you, Tommy. I know.
