the best that we can for our citizens, for our community. And I pray, God, for everybody
[0:23]

[0:29]
this in the beautiful name in Jesus' name. I'm in. I pledge allegiance to the
[0:35]
flag of the United States of America and to the Republic for which it stands one
[0:42]
nation under God and it is well with liberty and justice.
[0:49]
I'd like to welcome all
[0:50]
here this evening. We
[0:57]
will start with our first ring of public hearing to adopt
[1:00]
We're proposing budgets and millage rate for fiscal year 2627.
[1:06]
Ordnance 26-18.
[1:08]
Ordnance 26-18, ordinance leavening, tax upon all taxable property within the city of Wintergaard and Florida for the tax year beginning October 1, 2026 and ending September 30th, 2027.
[1:20]
And my adoption of this ordinance, the commission is adopting and establishing a millage rate for the avalanche taxation of real and tangible personal property within the city of winter garden for the fiscal year, beginning October 1, 20, 26, and then September 30 of 20, 27 at the rate of 4.8, 5, 6, 5, mills, $4 in 80, 5 cents for every $1,000 of the sets.
[1:50]
That's valuation upon assess valuation of property within the corporate limits of the city of winter or in Florida.
[1:56]
This milled rate is greater than the rollback rate of 4.5928 mills by 5.74%.
[2:05]
Thank you.
[2:07]
Yes, ma'am.
[2:08]
Good evening, ma'am commissioners.
[2:09]
The proposed fiscal year 2027 budget recommends a milled rate of 4.8565 mills, which is the current rate that we have right now fiscal year 2026.
[2:18]
As you recall, the proposed budget presentation, we reviewed that at the public budget workshop on August 27th.
[2:26]
There we discussed and provided an opportunity to review the major financial priorities,
[2:30]
significant budget changes, and the long-term considerations incorporated into the fiscal year 2027 plan.
[2:37]
Overall, the budget focus is on several key priorities, keeping the current military flat,
[2:41]
that, strengthen public safety, investing in our employees, advancing major infrastructure
[2:48]
projects and preserving the city's financial stability.
[2:51]
These priorities are reflected in the balanced budget that position-society to continue
[2:56]
meeting their current needs while preparing for the future.
[3:00]
Based on these considerations, staff recommends approval of ordinance 26-18, establishing that
[3:06]
this year, 2027 military and 4.8565 mills.
[3:10]
And I'd be happy to answer the questions in behalf.

[7:12]
Ordnance 26-21.
[7:15]
Ordnance 26-21.
[7:17]
Ordnance of the City Commission of the City of Wintergarden, Florida, authorizing the appropriation
[7:22]
of city funds for the fiscal year 2026-2027 in accordance with Article 3, Section 30,
[7:30]
the subsection five of the city charter of the city of Ontario and Florida in Florida statute 166.241 for the purpose of fulfilling the financial obligations of the city.
[7:42]
Thank you. Yes ma'am.
[7:45]
And this ordinance reflects the budget as a whole. It is the budget that we considered at the budget workshop and staff recommends approval.
[7:53]
So, question some of the commission.
[7:59]
When you get the fees, some of the other cities charge and update that, you'll give that
[8:07]
to us.
[8:08]
Fire assessment fees.
[8:09]
Yeah.
[8:09]
Or I guess asking if we fee would be the fire assessment.
[8:12]
I think some of them do charge for street lighting maybe.
[8:15]
Yeah.
[8:16]
So, we can look at that.
[8:17]
Yeah.
[8:18]
That's something we all look at.
[8:19]
I know.
[8:20]
Look that up this week.
[8:21]
Thank you, ma'am.
[8:22]
Okay, this is a public hearing. We will open a public hearing if anyone wishes to speak.
[8:31]
You have to.
[8:34]
Another routine. Name an address please.
[8:37]
I'm trying not to show her.
[8:43]
Tonight, hocks for report. I just had a general question because you just said that thing
[8:48]
about the fire and I came in late. Is there a fire assessment included in this?
[8:52]
No, ma'am, what I was referring to when we looked at the
[8:55]
at the Orm taxes, well, the different cities,
[8:58]
several of the cities have a fire assessment fee
[9:01]
and other things.
[9:03]
And we're just saying when we compare the millage rates
[9:05]
and all that, that needed to be added in for the other cities
[9:08]
so we can see where we stand.
[9:10]
Yes, ma'am.
[9:11]
That's all that was.
[9:12]
Oh, yeah.
[9:13]
Yes, ma'am.
[9:16]
Yes.
[9:18]
That we will close the public hearing and we need a motion.
[9:22]
Motion to approve, right in its 26-21, second or second readings in public here in September
[9:29]
29, 2026.
[9:31]
We have a second.
[9:32]
Second.
[9:33]
No, we have a motion.
[9:34]
We have a second.
[9:35]
Oh, favorite second.
[9:35]
Five by saying aye.
[9:36]
Aye.
[9:37]
Aye.
[9:38]
Opposed?
[9:39]
Motion carried unanimously.
[9:41]
Thank you, ma'am.
[9:43]
Right there, meeting, approving approval of our minutes from the August 27, 2026 meeting.
[9:49]
In addition, situations or corrections.
[9:55]
Hearing none, we need a motion.
[9:57]
We have motion to approve.
[10:00]
Second.
[10:03]
All those in favor, signify by saying aye.
[10:06]
Aye.
[10:07]
Opposed?
[10:07]
Motion carries unanimously.
[10:11]
First reading of public hearing opposing ordinance is ordinance 26-25.
[10:16]
5.
[10:16]
Ordnance 26-25 in ordinance of the city of Wintergarden, Florida.
[10:21]
Mending chapter 114, city of Wintergarden, federal ordinances.
[10:24]
Mending section 114-38, governing artificial turf requirements.
[10:29]
Providing requirements for installation and maintenance of impervious and artificial turf, providing
[10:34]
for codification, severed billy conflicts and an effective date.
[10:38]
Thank you.
[10:39]
Yes, ma'am.
[10:40]
Good evening, Mayor and commissioners.
[10:42]
Ordinance 2625 amends section 114-38 of the city code to establish new standards for the installation maintenance and regulation of artificial turf within the city.
[10:51]
The ordinance is intended to clarify existing regulations and ensure compliance with the Florida statutes and the new DEP rules that were recently adopted.
[10:58]
The ordinance clarifies permitting requirements for artificial turf installation and establishes
[11:04]
standards related to things like appearance, material composition, permeability, storm
[11:09]
water management, maintenance, and location restrictions.
[11:12]
The ordinance also prohibits artificial turf in certain areas that could negatively impact
[11:16]
trees, water bodies, or storm water infrastructure.
[11:19]
Additionally, the ordinance requires property owners to maintain this turf in good condition,
[11:23]
and establishes environmental standards related to PFAS content,
[11:28]
infill materials, and disposal methods.
[11:31]
So with that, the staff recommends approval of ordinance 2625.
[11:36]
I'd be happy to answer any questions.
[11:39]
I know very little about artificial other than ball fields, but
[11:43]
I'm going to assume that this doesn't put, this is very commercial out there to buy.
[11:51]
In other words,
[11:52]
This is a restricting as such that it's not available.
[11:57]
That is correct.
[11:58]
We had a version of this ordinance come before the planning and zoning board last month
[12:02]
with very strict restrictions on the PFAS content.
[12:06]
And after doing some research, we moved that number more towards what was commercially available
[12:12]
by most turf vendors.
[12:13]
So it's not that restrictive.
[12:16]
It's not restrictive in the sense that it precludes all the manufacturers from being able to offer it.
[12:20]
Yeah. Okay. Any other questions?
[12:24]
Just a comment to that point Mayor. We also include a language because I think the state of Florida has yet defined what standards will be fast regulation.
[12:32]
So if in the future they do come out with a statute or a regulation relating to that.
[12:37]
This ordinance will ultimately automatically apply to that as well.
[12:40]
Okay. Okay.
[12:44]
Anyone else?
[12:46]
This is a public hearing, so we will open the public hearing if anyone wishes to speak.
[12:54]
Seeing none, we will cause the public hearing and we need a motion.
[13:01]
Motion to approve ordinance 26-25 with a second rating in public hearing September 29, 2026.
[13:08]
Do we have a second?
[13:10]
Thank you.
[13:10]
We have a motion.
[13:11]
We have a second.
[13:12]
Paul with favor, second.
[13:12]
I have a second.
[13:13]
I have a second.
[13:13]
Hi.
[13:14]
Opposed?
[13:15]
Motion carried unanimously.
[13:37]
23 and 1-8-1 Buele Road on the northeast corner of Buele Road and Dealer Avenue into the city of Wendell-Gardenford are re-defining the city boundaries to get into the city of Wendell-Gardenford.
[13:49]
of the city jurisdiction over said property providing for severability, providing for an effective date.
[13:55]
Thank you. Yes, ma'am.
[13:57]
Do you want to take them one by one or or BC and D all related?
[14:02]
They're related. They were different parcels, but yeah, it's a little confusing, but they are, are all related.
[14:08]
They are. Yeah, okay.
[14:10]
If you want to do them all together, that's fine.
[14:11]
They just had different parcels and there's only reason I was saying me.
[14:15]
Okay, fine with you, it's fine with me.
[14:18]
Are we, you want me to go ahead and read all three,
[14:20]
and do one public here?
[14:21]
Yeah, sure, my presentation is all three.
[14:22]
All right, okay.
[14:23]
Ordinance 26-28, an ordinance of the city of Wintergarden,
[14:27]
Florida, mending the future land use map
[14:28]
of the Wintergarden Conference of Plano
[14:30]
by changing the land use designation
[14:32]
of real property, generally described as approximately
[14:34]
1.47, and plus or minus acres located
[14:37]
at two, absolutely, one, two, two, one, one, two, three, three,
[14:42]
one to eight one-bular road and nine to one-polymer avenue on the North East
[14:48]
corner of Bueller road and you'll have a new from Orange County low density
[14:52]
residential and city low density residential to city commercial providing
[14:56]
for severability providing for an effective date ordinance 20
[15:00]
6-29, an ordinance to the city of Wintergarten, Fort Irresonning. Certain real property, generally described as approximately 2-1, 1, plus or minus acres of land, generally located 8-8-2, Mengele Street, 1-2-1-1, 1-2-2-1, 1-2-3-3, and 1-2-8-1, Bueller Road, and 9-2-1, I'm sorry, Palm Avenue, on the northeast corner of Bueller Road, and Julliard Avenue.
[15:26]
from City, C2, or to their commercial district, City, or one single family residential district in Orange County,
[15:35]
or Orange County R1 single family dwelling district to PCD plan commercial development as set forth in this ordinance providing for certain PCD requirements in describing the development as the Magnolia commercial development PCD and providing for
[15:53]
Suburability, conflicts, and an effective date.
[15:56]
Thank you, sir.
[15:58]
Yes, ma'am.
[15:59]
Thank you, apologies.
[15:59]
This one is a bit of a puzzle box to kind of.
[16:02]
Yes.
[16:03]
I'll try my best.
[16:05]
There are six plus parcels that make up the subject property.
[16:08]
Two of the properties, 882 Magnolia Street and 1211 Bula Road
[16:12]
are zone C2 located in the city
[16:14]
and have a commercial future land use designation.
[16:16]
There is another city property located at 921 Palm Avenue
[16:20]
that is zone R1 with a low density residential
[16:22]
future land use designation. The three other properties 1, 2, 2, 1, 1, 2, 3, 3, and 1, 2,
[16:30]
8, 1, Bueller Road are currently located in unincorporated Orange County and are zoned
[16:35]
R1 with low density residential future land use. And there is also a recently vacated
[16:40]
segment of Palm Avenue that is now incorporated into the subject property which is also currently
[16:45]
in the county. So for the parcels located at 1, 2, 1, 1, 1, 2, 3, 3, and 1, 2, 8, 1,
[16:53]
and the vacated segment of Palm Avenue, the applicant has requested annexation into the city of Wintergarden for the parcels located at 1-2-2-1-1-2-3-3-1-2-8-1-bular road and the vacated segment of Palm Avenue and 9-2-1- Palm Avenue, the applicant has requested an amendment to the future land use map of the city's comprehensive plan to designate these properties as city commercial.
[17:16]
And the applicant has also requested to rezone the entire subject property, all of those parcels
[17:22]
I named to plan commercial development.
[17:25]
The PCD would permit the development of the 2.11 acre site with three new single story
[17:30]
multi-tenant commercial buildings with approximately 18,000 square feet of combined retail and office
[17:36]
space.
[17:38]
The buildings would appear more residential in nature with pitched metal roofs, front porches
[17:42]
and lap-siding to provide a compatible transition for the more residential uses to the south and
[17:47]
the west, to the more light industrial and heavy commercial uses to the north and east.
[17:54]
The project would also include associated site improvements such as sidewalks, a buffer
[17:58]
wall on the east side of the property, buffer and site landscaping, and storm water ponds.
[18:04]
Staff has reviewed the application and recommends approval of ordinances 2627, 2628, and 2629.
[18:10]
Any questions?
[18:12]
Questions from the commission.
[18:14]
What about the business that's still there in the county on the corner of Magnolia and
[18:18]
Giller?
[18:20]
Are they, is anybody talking about coming into the?
[18:23]
Is the person on the northeast corner.
[18:25]
Those are residential properties and they actually did the owners of those properties to come to
[18:29]
our community meeting that we held a few weeks ago.
[18:32]
And mainly their questions are more technical about, you know, how the storm water is going to be handled on the
[18:37]
adjacent site impacts of the construction and they were really happy with the
[18:43]
fact that there's going to be a solid buffer wall between their properties and
[18:46]
them. We also talked about potentially annexing into the city and they were
[18:49]
very receptive to that so they might be coming in but I believe that they still
[18:53]
want to keep it as a residential property because I'd be surrounded now by
[18:57]
will be surrounded yeah and they realize that so okay conceptually with that as
[19:03]
as long as it's properly preferred.
[19:05]
Okay, and we'll make sure that, okay.
[19:08]
Questions from the commission?
[19:12]
Not only other than the thing is the renderings
[19:14]
are always difficult for me to look at and say,
[19:17]
so I have that most faith that you're gonna,
[19:20]
I'm sure that they make it look good for there,
[19:22]
because once we start redeveloping all that,
[19:26]
whatever goes in first is gonna set the trend
[19:29]
down the road.
[19:30]
Okay,
[19:34]
I'm getting all clear.
[19:35]
Yes sir, I thought you were going to raise that one.
[19:37]
I thought you were going to raise that one.
[19:39]
I thought you were going to raise that one.
[19:41]
This is a public hearing.
[19:43]
We will open the public hearing of any voices to speak.
[19:55]
Good evening mayor and commissioners.
[19:57]
I have nothing to say about the property that's being developed
[20:00]
except to ask how many residential houses are being lost?
[20:05]
Are there residences on these properties now?
[20:08]
And how many are being lost?
[20:10]
There was a couple.
[20:11]
I thought they tore some down, they already demolished most of the houses that run the properties, there is one existing residential property, but it's abandoned, nobody lives there and so there's really only one breath.
[20:26]
I bring this up because we talked a couple years ago, there was another question about three houses coming down, so we're slowly losing, I'm not sure these houses are worth keeping.
[20:35]
but we're slowly losing the small single family dwellings in winter garden that people actually can afford to live in. Thank you.
[20:44]
Yeah, these were under several of those that have been gone for a while.
[20:48]
That much I remember.
[20:51]
Yes ma'am?
[21:00]
Since these and I know there's three sections of them.
[21:03]
Some of these properties are going to city commercial where they weren't city commercial before.
[21:09]
So, I just have a question, is there, do we know what's going in there?
[21:14]
I just want to check on the data centers to make sure they're not like popping in a mini data center anywhere.
[21:20]
No.
[21:20]
Okay.
[21:20]
Thank you.
[21:21]
Go ahead, Kelly.
[21:22]
You can answer that statement.
[21:23]
Sure.
[21:25]
The PCD ordinance sets all the permitted and prohibited uses.
[21:31]
And so the uses in this particular development will all be light commercial uses like office
[21:37]
and maybe small retail, small, maybe even a small restaurant, but nothing as larger industrial as a data center.
[21:45]
It's just not a, first of all, it's not a big enough property, but second of all, it's not compatible with the area.
[21:49]
So, absolutely.
[21:50]
Okay, anyone else?
[21:54]
We will cause the public hearing, and we need a motion, please.
[21:59]
Motion to approve, ordinance 2627, to name them all.
[22:04]
2628 and 2629 with a second reading in public here in September 29, 2026.
[22:11]
We have a motion to approve.
[22:13]

[25:11]
The commission appointed position currently held by Ed McKinney will expire on September
[25:16]
December 30th, 2026, and Mr. McKinney has expressed an interest in serving another four-year term.
[25:23]
Staff recommend the appointment of one board member for four-year term, and then September 30th, 2030.
[25:30]
So the general employee pension board, I'll be happy to answer any questions.
[25:35]
Questions from the commission?
[25:38]
Just one.
[25:39]
Now, Mr. McKinney's on this board, runs for public office.
[25:42]
Does he have to vacate that board membership?
[25:49]
That's the only question I really had.
[25:51]
You know, just thinking in the future.
[25:54]
So, okay.
[25:56]
We need a motion.
[25:59]
Motion to keep, Mr. McKinney.
[26:01]
Okay.
[26:03]
Do we have a second?

We have a motion, we have a second.

[26:29]

[26:40]
will expire November 30th, 2026.
[26:43]
And both have expressed an interest
[26:45]
in serving another four-year term.
[26:47]
Staff recommend appointment of two board members
[26:49]
for four-year term and in November 30th 2030 to the police and firefighter
[26:55]
suspension board. I'll be happy to answer any question.
[26:58]

All in favor signify by saying aye.
[27:15]

[27:17]
Motion carries unanimously.
[27:20]
Thank you, ma'am. Matters and citizens of Winner Garden.
[27:24]
Troy
[27:38]
and I got the paper this time of hand. I just have a general question about data
[27:43]
centers and are there any in-winner garden is my first question and then if there was
[27:50]
to be a business that wanted to bring a data center would we find out beforehand?
[27:58]
Data centers to me are about like Bitcoin mining and I can name a couple others
[28:04]
I don't have an interest in them being in a community.
[28:09]
So check that we would know before you answer.
[28:12]
Yes.
[28:14]
Obviously submit an application for development and meet with the city staff and ultimately
[28:19]
to be something to be scheduled to come before the commission.
[28:23]
We did do some modification to our ordinance a few months ago that would require any uses
[28:31]
of a certain threshold of water being used, that that would require a special exception
[28:36]
which would ultimately have to go through a secondary process as well.
[28:41]
Thank you.
[28:42]
Anyone else?
[28:55]
Yes, give you a name and address please.
[28:58]
I'm sorry.
[28:59]
Name and address please.
[29:00]
Oh, I've heard from the first time, you know.
[29:03]
Santa Green is my name.
[29:04]
My address is 1, 2, 3, 3, 1 to Green Way, 1 to Garden Florida, 3, 4, 7, 8, 7.
[29:11]
and you do this up 30 seconds of my three minutes.
[29:15]
But we won't count that.
[29:18]
The reason that I'm here tonight, and I'm not certain,
[29:21]
I live in one of garden town homes.
[29:23]
I've been there since 2001, and since 2001,
[29:28]
I've had flooding in my backyard.
[29:31]
It's my understanding that this occurs occurred
[29:36]
because the subdivision that's behind me
[29:39]
was built after hours and they were allowed to elevate three feet so their
[29:45]
rainwater floods into our backyards.
[29:51]
I'm not sure where I heard it but
[29:53]
recently I heard that there was a possibility of funding to help us with this
[29:59]
And I'll back.
[30:00]
I thought it was going to be addressed today and two weeks from now, but it's not only agenda. So my question is,
[30:10]
can you give me an update, is that a possibility? Because it's just continuous. Every, every time it rains, if we get a few inches back yards, I can't even get my backyard mold because when they drive in, it gets stuck in the mud.
[30:29]
But this is an ongoing problem, 20 plus years.
[30:35]
The short answer is yes, it is a possibility.
[30:38]
Last year when we adopted the current operating budget that we are in,
[30:42]
we included an appropriation of $175,000 since that time we have started to get some survey work out there.
[30:51]
And throughout the last few years, we've been working with the HOA because one of the things that we're gonna have to do is we're gonna have to
[30:58]
to have the HOA work with us in getting right of entry permits from every one of the different owners there to be able to do any improvements from a stormwater perspective in the backyard mayor commissioners is not really much any different than the years of work that we put in over to town home and wonder garden to try to fix those problems.
[31:17]
So at this point, we've gotten some of the survey work, excuse me, and we have been working with the HOA who has gotten draft right of interior agreements, and they're actually trying to get all of those agreements approved so we can take this to the next phase, which would be the design phase to address the problems that you're encountering.
[31:40]
And quick estimate, how you've been doing this for years, so how many more years I'll be
[31:48]
dead and gone.
[31:50]
I mean obviously I would recommend that you get back with your HOA and because it's
[31:57]
the balls in their court to obtain that information for us before we can go ahead and proceed.
[32:02]
Okay, so you're waiting on information from my HOA.
[32:06]
Yes ma'am.
[32:07]
Thank you very much.
[32:08]
Thank you, ma'am.
[32:10]
Anyone else?
[32:15]
Madam from our city attorney?
[32:17]
No report.
[32:18]
Thank you.
[32:18]
Sort of.
[32:20]
City manager.
[32:20]
Mr. Case, anybody's not watching.
[32:22]
We have about 50 days before the November election between now and then on September 30th.
[32:29]
I'll be participating in another town hall meeting regarding the impacts of amendment three.
[32:35]
That's being put on by the West Orange Chamber, be hosted over at the Coe Lake Shore Center from 6730.
[32:41]
We have another rare Tuesday meeting, which will also occur on September 29th, so I have nothing further.
[32:52]
Commissioner Johnson.
[32:53]
Just staff, thank you for the hard work.
[32:55]
Thank you to our first responders and our police officers for your dirty day job, keeping the community safe.
[33:02]
Thank you.
[33:05]
First, I want to say thank you to all the first responders and I want to say a special
[33:09]
thank you to the fire station 24 last Thursday, a couple of people got stuck in the elevator.
[33:16]
And thank God we had a Brandon Minick, Jim Rodas, Jose Perez, Chase Firman, and Logan
[33:24]
Miller.
[33:25]
Thank you so much for coming and rescuing us and get us out.
[33:28]
But I really appreciate you.
[33:29]
That's a prompt attention and response.
[33:33]
Thank you.
[33:34]
It was almost two hours, so.
[33:36]
Really?
[33:36]
And our new building, living cutting day.
[33:39]
Oh, your building?
[33:41]
Wow, two hours.
[33:42]
Almost two hours, it was like a 9.45, 1.15.
[33:46]
I was under a really good company, Joe Dunn,
[33:48]
and one of my co-workers.
[33:49]
So we had a lot of catching up, so it was so bad.
[33:53]
But thank you, thank you so much.
[33:54]
Joe, yeah.
[33:55]
And that's why we need our fire department
[33:56]
and our police department as well.
[33:58]
Thank you.
[34:00]
Commissioner Smith?
[34:04]
Thank you, staff, for all your hard work
[34:06]
and thank you for all the work on the budget.
[34:10]
And really appreciate the 9-11 ceremony that we have
[34:14]
with the police and fire departments.
[34:16]
It was very moving and the speakers were in travel too.
[34:20]
But thank you for putting that on.
[34:24]
I like that, thanks to our two chiefs,
[34:27]
And I guess Jason and Shawn and Mike Mason, who are all the ones that were involved on
[34:36]
that it was an emotional touching and well done remembrance in honoring all those and then
[34:44]
continued in the City Hall with Norman Reign and all of his volunteers who put that 9-11
[34:51]
this exhibit together but make you stop and think make sure we are thankful and
[34:56]
pray for our first responders every day. Thank y'all with that wheel of
[35:00]
adjourn.
