[1:25] Appearance of interests its systems item number one

[2:04] Anything online?
[2:08] Excellent.
[2:11] Item number two consideration of an action pursuant to
[2:14] elections code section one zero two two nine for council districts one two and
[2:19] three that must be you that's me good evening mayor and council this will be
[2:26] brief one and two touch bases with you regarding the November 2026 election as
[2:33] you know the city is scheduled to hold a consolidated general election on
[2:37] November 3rd 2026 for the purposes of election electing council members for
[2:43] districts 1, 2, and 3. The nomination period for this election closed on Thursday, August 6th,
[2:51] and only one candidate was nominated for each of the three council districts.
[2:57] On August 11th, the city received a certificate of facts from the Sutter County Registrar,
[3:03] our voters confirming this information, and shortly thereafter, I as the city clerk
[3:09] certified that there were no more than one candidate for each office. That being
[3:16] said, the nominated candidates are Dave Shaw for District 1, Mark Boomgarden
[3:21] District 2, and Mike Pasquale for District 3. Under these circumstances and
[3:27] pursuant to elections code 10229, the City Council may take one of the
[3:35] following courses of action. A, you can choose to appoint to office the person who has been
[3:42] nominated. B, you can direct that we go forward with the election regardless. Or C, you can
[3:50] take no action. In the event that council chooses to appoint council members to these
[3:58] offices, the person appointed shall qualify and take office and serve exactly as if
[4:04] they were elected. Additionally, I will not be accepting any write-in
[4:10] candidates after this appointment is made. So I, as a city clerk, have compiled
[4:16] the requirements for elections code 10229 by providing the city council
[4:23] and certifying there's not more than one candidate per office. And now the
[4:30] council has the option to either adopt a resolution to nominate and appoint the
[4:37] candidates that are nominated to move forward with the election or to take no
[4:42] action. One note I want to make before the council takes action is that we
[4:48] because we consolidate the election with Sutter County we typically spend
[4:51] and around $12,000 per seat for those services. And if we decide not to go forward with the
[5:03] election, we're looking to save at minimum $36,000 for the election, plus all the other
[5:10] incidentals that might come our way for that process. So we typically will, in the
[5:16] case where we have three council seats open, we'll budget for 50 just to be safe.
[5:19] and we did budget for 50 this year.
[5:22] So there's, if we decide not to move forward
[5:25] with the election, that's what the council wishes to do.
[5:28] And then there is potential savings there.
[5:30] So we don't have to pay that county for that election.
[5:34] So I'm happy to answer any questions.
[5:37] Thank you for the presentation.
[5:39] Any questions from the council?
[5:42] Seeing none, any comment from the public?
[5:47] No public comment.
[5:48] No public comment.
[5:49] One thing I do want to mention too
[5:51] is if you do plan to vote on appoint people you can't vote for yourself. So we
[5:59] would vote for district one and council member Shaw would have to recuse
[6:05] himself from that particular vote and then council member two and so on. Okay.
[6:10] So privilege of the chair what we'll do is we'll go district by district and that
[6:15] way we can document and we'll do roll call vote and we that way we can
[6:19] document the abstentions. All right. Any further comment before we get going?
[6:26] All right. Yeah. I would like to make a comment before we move forward. I've worked with most
[6:34] of you for quite a while now. And I know jokingly I say once in a while I enjoy keeping the
[6:41] band together. I know you've heard. I beat that one to death. But I think what we're
[6:45] looking at right now is pretty important. We've got three districts and those three districts
[6:54] ran unopposed. And what that speaks to me as a citizen of this city is to the caliber
[7:01] of the candidate that's running and the job that you gentlemen have done. So thank you
[7:07] for that.
[7:09] I appreciate that.
[7:13] Gentlemen and ladies.
[7:15] Okay, any other comments?
[7:19] City Manager, do you have any comments?
[7:24] That would be no.
[7:25] Excellent. All right.
[7:26] So the first item here on item number two is to bring forward the resolution in regards to District 1.
[7:38] So we need nominations.
[7:41] the chair I'd like to nominate Dave Shaw to continue as city council person for
[7:48] district one.
[7:53] I can't. Right. I have a nomination from council member Kirchner
[7:59] a second by council member Cole will have roll call vote on district one.
[8:04] Before you start roll call does he have to leave the room I would refer to
[8:07] our attorney because you have to leave the room for this vote.
[8:50] So to make sure
[8:51] we doing this correctly then is an abstention okay or does he actually need to use the
[8:55] word recusal? Thank
[8:58] you very much. All right.
[9:00] Roll
[9:05] call vote for district one. Councilmember Kirchner.
[9:10] Aye. Councilmember Cole.
[9:12] Aye. Mayor Boone-Garden.
[9:14] Aye. And Vice Mayor Pistol Wally.
[9:18] Aye.
[9:21] Oh yes. And Councilmember Shaw.
[9:24] Thank you. All right we'll do procedurally. Can I bring my own
[9:30] district in or do I need to pass that off to the vice mayor? I'm the next district
[9:34] district too.
[9:43] Thank you mayor. Do I have a motion to take action on the
[9:48] appointment of council member of the second district? Through the chair. I
[9:54] know I moved to nominate Mark Boone-Garden for district two council
[9:59] member. Second that. I have a first from council member Cole and a second
[10:04] I'm from Council Member Kirchner.
[10:06] May I have roll call vote please?
[10:09] Council Member Cole.
[10:11] Aye.
[10:12] Council Member Kirchner.
[10:14] Aye.
[10:16] Vice Mayor Pasquale.
[10:17] Aye.
[10:18] Council Member Shaw.
[10:21] And Mayor Boone-Gordon.
[10:23] Abstain.
[10:24] Thank you.
[10:25] All right, District Number Three.
[10:28] Take up that district now.
[10:31] Here to the chair.
[10:32] I'd like to make a motion to nominate
[10:36] or for consideration, nonate Vice
[10:43] Mayor Pasquale
[10:45] to continue being a council member for district number three.
[10:50] Second.
[10:51] All right, I have a motion by council member Kirchner,
[10:53] second by council member Cole Gavril-Covol, please.
[10:58] Council member Kirchner.
[10:59] Aye.
[11:00] Council member Cole.
[11:01] Aye.
[11:02] Mayor Boone-Garden.
[11:03] Aye.
[11:04] And council member Shaw.
[11:07] And vice mayor.
[11:09] I'd say.
[11:09] Thank you. Okay. So we have one more item of business. The recommendation is to
[11:18] adopt a resolution appointing the nominated candidates to office. So moved.
[11:26] Second. I have a motion to appoint the nominated candidates to office. Go ahead.
[11:33] All those in favor signify. Hope I guess we can do our own right.
[11:51] All those in
[11:52] in favor? We got a nomination in a second. All those in favor signify by saying aye.
[11:57] Aye. Any opposition? Any abstentions? Hearing none, item number two, adopt a resolution
[12:05] appointing a nominated candidate to office is passed unanimously. Any further business?
[12:13] Meeting adjourned.
