[2:56] Next time on the agenda. Resonance case number 26-3 staff.
[3:05] Thank you Mr. Chairman. How are you?
[3:06] Senator Planner, present in Resonance K26-03.
[3:11] This is a request to resume two parcels with a combined size of 7.23
[3:16] gross acres in size, from rural area to an acre minimum to rural area,
[3:21] five acre minimum located in a foothills planning area.
[3:24] In the vicinity of the 44th street, an avenue 14E,
[3:27] alignment and new Arizona, the intent is to consolidate existing parcels
[3:31] into a single parcel that complies with a minimum, five acre
[3:34] large size requirement of the RA zone in district.
[3:41] It combined parcels is intended to accommodate future infiltration
[3:46] basins and implement pump station associated with the existing waste water treatment facility.
[3:54] This is the zoning and vicinity map showing the subdued parcel, cross hatch of the center of
[3:57] the map,
[4:00] parcels to the east is on R810, and is the location of the Las Barrancus,
[4:05] Of course, then we have parcel number 7 for the north is zone RBS, then we have parcels on the south west zone RBS improved with site build and dwellings, and then we have parcels 126 and 23 to the west, they are making parcels on R10 and then we have a narrow parcel 900 zone R10 as well just west of parcel 12.
[4:32] This says that Lightning Red is a subdued properties.
[4:37] Parts will 198-14-044-2.87 acres in size.
[4:41] And is the location of a wastewater treatment plan,
[4:43] which was approved with special use permits 01-111-11.
[4:47] Accessors of his records indicated that the property was created
[4:51] on September 6, 2002 at the time of the processing the SUP.
[4:56] The parent parcel was 470.702 acres in size.
[5:00] parcel 12 of the North is 4.36 acres in size and can be taken in this or terrain.
[5:07] This is a site plan submitted by the applicant,
[5:11] looking east at 44th street from the west,
[5:17] now looking south at the subject parcel from the North.
[5:24] Sure, looking south is a subject parcel from the west, looking south, east, now looking
[5:32] the U.S. at Access Road 443 from the East.
[5:37] Staff received no comments from residents,
[5:40] no comments received from any agency as well.
[5:43] Staff recommends approval of resulting case number 26
[5:45] that shall three, subject to the following performance
[5:47] conditions.
[5:48] Number one within 60 days of approval by the Board of Supervisors,
[5:52] the owner agent or shall record an infrastructure
[5:55] disclosure statement, and number two within 180 days
[5:58] of the Board of Supervisors approval,
[6:00] the subject properties shall be combined pursuant
[6:04] to the Umeconic Southern Basin Regulation Section 7.12.
[6:08] Mr. Chairman, this concludes staff's presentation.
[6:12] And you know what?
[6:12] Not sure if, public on this present,
[6:15] that the record show that August, August Garcia
[6:17] is also present now.
[6:20] Any commission, have any questions for staff?
[6:23] Mr. Chair.
[6:25] Excuse me, David.
[6:25] And
[6:31] looking at the environmental breakdown,
[6:40] the
[6:43] applicant was given credit for the PM10 and 15 points for the releasing of nitrates and sulfates, are these going to be evaporative ponds or infiltration ponds?
[7:00] Mr.
[7:04] German, don't know if the applicant is present to clarify that question.
[7:08] I would like to refer that to the applicant.
[7:11] We can ask the applicant when they come forward. Anything else, Mr. German?
[7:18] We'll ask the applicant when he comes forward.
[7:20] Okay, okay. So, by my calculations, it probably should be about a 275 on a checklist.
[7:27] And...
[7:30] And then also a part of the roads on item 24 in that chart is roads on site. But they indicate that they're
[7:42] going to have 10 to 30 trips per day on dirt roads. And since it's part of the PMTN, non-acayment area,
[7:51] that's going to make it difficult out there unless they pay for everything. So I'm concerned
[7:57] about both of us. Thank you. Any other commission or any questions, staff?
[8:04] See, and I'd like to invite the applicant up to just answer some questions if the applicant
[8:08] is here.
[8:15] If you need this, sir, if you'd like to talk, you need to come to the podium, but are you the applicant?
[8:21] Are you the applicant?
[8:23] Okay.
[8:25] The applicant is not here.
[8:26] This is not here, Mr. Chairman.
[8:28] Okay, I'd like to open it up to anybody, either for or against this rezoning case, to come forward, please.
[8:33] If
[8:38] you'd like to speak, sir, you can come forward.
[8:46] State your name and address for the record, please.
[8:49] I'm sorry.
[8:50] State your name and address for the record, please.
[8:51] Michael Johnson, one, two, six, seven, nine, south-repped wood.
[8:57] Out of the end of that dotted line to the west.
[9:00] But we're going to extend 44.
[9:01] What's the purpose for?
[9:02] Are we park out there?
[9:05] Is that what our views mean?
[9:08] Which part of the...
[9:10] You go straight out, 44th.
[9:11] Where you got our views out there, seven.
[9:13] Okay, that probably is on RVS and is supposed to be a lot for recreation of the eco subdivision.
[9:19] It allows side bills, manufacturing homes, and RVs.
[9:24] That's the zoning that we're going to open up Partial 7 for building.
[9:28] That is correct. If the owner is, don't know if he's under the ravines and there is one subdivision being worked on.
[9:36] Don't know if that's the area.
[9:38] And they're going to extend 14A through that corner there or bring it around the back.
[9:42] Sir, we're here to discuss the zoning case, not personal seven.
[9:47] That that person has already been rezoned for that purpose.
[9:52] I'm just confused about what they're going to do.
[9:54] Why the what affects the dotted line?
[9:56] I mean, if they're going to affect my backyard or I'm going to start in from that dotted line
[10:01] off, 2014 and 46th.
[10:04] Mr. Chairman, that dotted line, sir, is just to
[10:07] So, in a graphical ratio, which properties are going to be notified, though, that this Dutch
[10:13] line is that this stands 300 feet from the subject properties and indicates that these
[10:18] properties were notified.
[10:20] It's just a notification buffer per say.
[10:24] It says, all these properties will need to be notified of this rezoning case.
[10:29] That's the only indication, just to show that those properties were notified.
[10:34] In this case, we extended the notification to 1,000 feet.
[10:40] So we extended the notification area.
[10:42] And instead of 300, it was extended to 1,000.
[10:46] So we reached out to more residents in that area.
[10:49] Yeah, I'm just not to a favor of 14.
[10:51] You need to get more traffic.
[10:55] So that's all I got.
[11:00] Anybody else like to speak on this either for or against?
[11:05] See, and then I'll bring it back to the commissioners for action and discussion.
[11:11] Mr. Chair, but I just don't think I have enough information to vote on this at this point in time.
[11:16] We just have no clue as to where the ponds are going to be and whether there's going to be a buffer zone and whether there's going to be a lot of, you know, what type of ponds are going to be.
[11:28] Well, if the applicant shows not to come, then.
[11:32] And that's another reason why I don't feel we should approve.
[11:36] Mr. Chairman, I believe that there's an ASEY plan on file?
[11:40] Yes.
[11:41] And Mr. Chairman, if I may, this is for the rezoning, not the development.
[11:45] Correct?
[11:46] Mr. Chairman, also that wastewater facility is already in there.
[11:52] Working is there.
[11:54] They will like to, according to the narrative,
[11:57] they're going to do some basings on the northern parcel once they're combined.
[12:02] So, but the wastewater facility is functioning and is working right now as it is.
[12:09] That's Chairman.
[12:10] Chairman, do we know if this is part of Far West Water?
[12:13] Come on.
[12:14] Is it the same people?
[12:15] Mr. Chairman is for them.
[12:17] It is for them.
[12:18] Yes.
[12:18] To improve the service in the area.
[12:21] Yes.
[12:23] Yes.
[12:23] Do we know will this rezoning serve to increase the amount of traffic on that partial?
[12:30] The traffic that it's currently there is probably be maintained.
[12:36] We're not doing anything that increases the traffic that you're aware of.
[12:41] I mean, the only thing we've had some complaints in the past about dust,
[12:45] with the traffic that goes in and out of there,
[12:50] is there any chance in this process that we could speak to the applicant about dust control?
[12:57] probably if we, yeah, the time of the Board of Supervisors probably they decided to show up.
[13:03] But I can contact them and probably making my wear of the commission's questions, so either
[13:08] you can email them to me or come to the next meeting and address those concerns.
[13:14] As when I was serving as chairman, I've had more than one complaint about the traffic that
[13:21] goes back and forth and down a day-to-day basis with dust control. And if we have a chance
[13:26] to help get that mitigated for the property owners around there, I would just stop to take
[13:31] advantage of that if we do.
[13:33] Councillor Chairman?
[13:35] Yes, Maggie.
[13:36] You do have the option of continuing the space if you would like to hear from the applicants
[13:40] since they're not present.
[13:42] Make a motion.
[13:44] Mr. Chairman, I'd like to move that we continue this
[13:47] to another time when the applicant can be here to answer questions.
[13:52] Second.
[13:53] Mr. Chairman.
[13:54] Next.
[13:54] Would you like to continue to
[13:56] the July, Bob Planning and Building Commission's hearing?
[14:00] Yes, ma'am.
[14:01] I need that stated in the motion.
[14:04] You want to refer to that, Bobby.
[14:05] Commissioner McNermon once he would like to.
[14:09] However, it was properly awarded to the next meeting.
[14:12] To the next meeting in July.
[14:13] Meeting is fine.
[14:15] I have a motion and a second motion by the permission to make a permit to forward it to July meeting second-by
[14:23] The next paneling and building commission's hearing is July
[14:27] Okay for July 28
[14:32] Discussion
[14:33] All of a favor say goodbye by say an eye. Hi, I suppose nay. Hey
[14:38] Motion passes just to try my who second their motion. Hey james get up. Thank you
[14:45] Next time, I'm going to be agenda special.
[14:47] Use permit case number 26-04.
[14:52] Stack Reservation, please.
[14:53] Thank you, Mr. Chairman.
[14:54] This is Carillo presenting the special use permit 26-04.
[14:58] There request for these special use permit.
[15:00] Commence per section 601.03W. The U.M. can is on ordinance to allow a wireless communication facility on a personal parcel, three-course acres and size zone, roll area for the acres minimum.
[15:13] Properties are located in the 65th decimal noise zone. The property is also located in the U.M. Valley, Plion area, located approximately 900 feet north of County 13th Street and 600 feet west of Arizona, U.M.
[15:27] And as mentioned previously, this is to establish a new wireless communication facility.
[15:34] This is the Zony map, the property is in the center with a cross hatch, a lead in blue,
[15:40] a personal number 21.
[15:41] It is surrounded by SSB2 and R140 to the east and RA40 to the north south and west.
[15:53] And this is the hero imagery, properties currently vacant.
[15:55] and
[15:59] this is the step and there was a matter by the applicant showing the proposed location
[16:04] of the wireless communication.
[16:08] Staff received comments from MCAS.
[16:11] They're not in a position.
[16:12] However, they would like to review this tower once the apply for building permits.
[16:18] And we also received a letter of an opposition for a property owner within the notification area.
[16:24] Staff recommends approvals, but she used number 264, with the following performance conditions.
[16:28] and the owner or applications just submit the following documents within 120 days of
[16:34] worse supervisor approval, in obligation, in agriculture and infrastructure
[16:38] schools or statements.
[16:40] And for operational conditions, the approval special use permit is based on the
[16:44] stipend submitted by the applicant.
[16:46] Any change for the site plan will require approval by the county,
[16:48] planning director, pursuant to section 402.04 of the human
[16:52] or an ordinance. Number two, the special use room is limited to a self-support
[16:57] sale in Antena. Number three, the applicant must comply with our
[17:00] thorough of the Asian administration and thorough communication
[17:04] commission.
[17:07] Number four, prior to the commencement of the construction
[17:09] or operations, the application provider for the project plans, FFA,
[17:14] determination of no hazard and MTAS, Yuma, Taure Review,
[17:18] Clarence to humankind development services. Number five, the proposed
[17:22] our most we remove with the cessation of its use.
[17:27] The property, all in and red, it's the property and
[17:29] opposition to the request, that concludes that presentation.
[17:34] And the applicant is present.
[17:36] Any commissioners, have any questions,
[17:41] staff?
[17:41] If the applicant is here, I'd like to speak, welcome to come forward.
[17:45] Please state your name and address for the record, please.
[17:51] Hello, my name is Omar City, and I'm in state 48.
[17:54] And all of the consulting, our address is 14 West Main Street,
[17:57] may say Arizona, and I'm here to answer any questions you may have.
[18:02] Any commissioners have any questions of the applicant?
[18:06] Yes sir, how much of the three acres is this going to take?
[18:12] So the monopole antenna will be on 70 by 70 foot, Fensteria.
[18:20] Does it use any water?
[18:23] No.
[18:26] Is it just one antenna?
[18:27] So it is one monopole, but it is 69 feet in total height, and that allows for it to hold up to three carriers.
[18:36] So the tower is designed for Verizon, but the intent is to lease it to other carriers as well.
[18:42] And the benefit of that is you'll have fewer poles within the vicinity.
[18:47] Will it be a disguised role? Just be a regular.
[18:50] It will be designed in accordance with requirements and I think our general guidelines are
[18:54] that we use sort of colors that tend to blend in, but that's sort of our general guidelines.
[19:05] Any other questions, commissioners?
[19:09] Okay.
[19:09] If not, if you have a seat, please.
[19:10] Thank you very much.
[19:13] Anybody in the audience have any questions or comments for or against this case?
[19:20] Seeing none, I'll bring it back to the commissioners for discussion and action.
[19:23] Yes, Mr. Fisher, are you ready for a motion?
[19:26] I'll take one.
[19:27] Yes, I'd like to make a motion that we approve permit case number 20604 as presented by staff.
[19:35] Second,
[19:37] I have a motion to approve, and a second by UL Garcia, any
[19:44] question?
[19:45] I'm not there.
[19:46] We're sigma 5 by say and I.
[19:48] Hello, opposed nay.
[19:49] Emotion passes.
[19:52] Item number six on the agenda requested.
[19:54] Initiated option of the Appropos.
[19:56] You're a county of nois control ordinance, which is intended to protect public health, safety, and welfare by regulating excessive unnecessary and unreasonable noise in the
[20:07] Thank you, Mr. Chairman, Mrs. Carillo.
[20:12] Due to the, for the previous stab report that was presented to you through the commission,
[20:18] there were also a couple changes done.
[20:21] We are at a copper recommendation that was added by the commission in the board,
[20:25] to adopt some noise levels reductions as well, and the times.
[20:32] I don't know if you guys have any chance to go over the staff report.
[20:38] Besides that, the staff recommends.
[20:42] Initiated the adoption of the proposed Umechani noise control ordinance,
[20:48] and that concludes the staff presentation.
[20:53] Any commissioners, have any questions?
[20:54] Do this request to initiate the adoption?
[21:03] The end then.
[21:05] Maggie, ready to open it up?
[21:07] Yes.
[21:08] over to the public for any comments or concerns before or against.
[21:15] See, I'm not able to bring it back to the commissioner's for discussion and action.
[21:24] We want to move a big opportunity.
[21:27] Mr. Chairman, do you have a Vice Chairman Brian?
[21:30] Yes, I move that we forward, as staff has requested,
[21:35] and initiate the adoption of proposed human control,
[21:38] county noise control ordinance as requested.
[21:42] This is the second.
[21:44] There's a better request to initiate adoption and a second.
[21:49] All those of the favorite CQ5 by say aye.
[21:51] Aye.
[21:51] Aye.
[21:51] I'll suppose may.
[21:53] Initiation passes.
[21:56] I don't understand what I'm going to be agenda.
[21:57] Requested.
[21:58] Initiator.
[21:58] Text the name and three.
[21:59] Mechanism is there any ordinance to limit number of foreign animals on parcels of less than
[22:02] five.
[22:02] Contiguous commercial acres that are zone to R.A. that don't meet the minimum parcel
[22:07] of the requirements of the zoning district.
[22:11] Yes, Mr. Chairman, Maggie Castro planning and so on, Director, this item was presented to you a few months ago, concerning the amendment to the zoning ordinance to limit the number of large farm animals.
[22:26] I'm properties that don't meet the minimum population.
[22:30] Our social size requirements of the RA district.
[22:34] And the change or the proposed amendment would affect section
[22:42] 601.0 to the of the zoning ordinance,
[22:51] which is item D indicates farms and ranchers for the production of crops and or raising of animals.
[23:00] And then the new portion that will be added or the new language that will be added is
[23:06] on parcels of less than five contiguous commercial acres.
[23:10] The raising of farm animals shall be limited to one animal per 10,000 square feet of
[23:15] cider in the yard area.
[23:17] Commercial feed lots are only permitted in the heavy industrial and intensive industrial
[23:22] zoning district.
[23:25] Mr. Sherman, staff recommends initiating amendment to the zoning ordinance as
[23:29] I have a question.
[23:34] Maggie, on the parcel size, is that, are they also included in the buildings in that,
[23:42] which is just the pastures, the land, or is it the barn?
[23:46] Mr. Chairman, this pertains to parcel size only.
[23:50] Okay.
[23:52] I think the commission's having got the question to staff.
[23:56] Seeing none open up to the public for any discussion?
[23:59] Either for or against.
[24:03] Seeing none of them bring it back to the commissioners for discussion and action.
[24:07] Mr. Fisher Rice.
[24:08] I just have a problem with one animal for 10,000.
[24:12] I think that's really restrictive.
[24:16] I would rather see a different number in there, two or three.
[24:25] I mean, just if you have a 4-H project, sometimes you have two lamps, sometimes you have, I just think it's too restrictive to have one animal.
[24:37] So on that Maggie, you could have put four.
[24:42] This would allow four large animals per acre.
[24:46] Or 10,000 square feet?
[24:48] Mr. Chairman, four animals per acre.
[24:50] One acre is 43,560 square feet.
[24:54] It's one animal per 10,000 square feet.
[24:58] That's what my argument is, is 10,000 square feet.
[25:03] I'd rather see more than one.
[25:05] So for acre, that'll be four animals.
[25:08] That's fine if you have an acre, but if you have 10,000 square feet, that's a quarter of an acre basically.
[25:17] Right, but I understand what you're saying, but if they have a 10,000 square foot lot, that means they have a building structure or house
[25:23] So they're backyard areas, probably two to three thousand square feet. You can't really have I mean that'll be a residential subdivision
[25:30] So that's why the restriction is there
[25:32] But if you have a project with kids and everything having a couple of lamps in a 10,000 square feet
[25:40] I mean you raise them in pants left and 10,000 square feet. I just think it's a two restrictive in my opinion
[25:47] I'd rather see it minimum of two and preferably three.
[25:52] But it's four.
[25:54] I'm just trying to do the math.
[25:56] It's a division.
[25:57] A lot of 10,000 foot.
[25:59] Can I just turn, can I ask staff a question?
[26:03] If we currently have a one acre partial,
[26:07] how many animals are allowed on that one acre partial today,
[26:11] and a SR1 zoning category?
[26:12] Mr. Chairman, the suburban rent, suburban side building zoning districts, and the R-140 zoning districts allow one large farm animal per 10,000 square feet.
[26:25] So what we're doing is trying to match unmatched parcels with what already exist in the county.
[26:31] So we have a piece of property that zoned R-810, but it's only four acres.
[26:38] R-A-10 would allow unlimited farm animals, and so what we're trying to do is to match that
[26:45] four-acre partial that's zoned
[26:49] wouldn't be zoned that today, because it's only four acres,
[26:53] but it's zoned R-A-10. We're trying to restrict that to what today's four-acre partial
[26:59] would have animal-wise. Correct. So it's no more restrictive than the zoned we already
[27:06] have in place.
[27:07] Well, Mr. Chairman, throughout the county we have numerous parcels that are zoned RA, however they don't meet the minimum
[27:18] parcel size requirements. If those parcels are pre-ordered and it's not conforming, they can have an unlimited number of
[27:25] farm animals. If they are zoned RA regardless of the size. So the intent of this amendment is so that those parcels that don't meet the minimum
[27:34] the heart's size of the R.A. zoning district would be, would be allowed to have a limited
[27:42] number of farm animals depending on the acreage.
[27:46] If they, as if they were zoned their proper zoning category for their size.
[27:52] They'll be better fit.
[27:53] They'll be better fit.
[27:55] No, no.
[27:57] No, but it makes it a plane even feel for the newer stuff.
[28:00] Yeah, it doesn't benefit the folks who want to have 10, 10, 10 cows per acre, but it protects
[28:08] the neighbors next door who are only allowed to have more than 10,000 square feet,
[28:15] so it's trying to make it even, and that doesn't apply to partials that are five acres
[28:21] are more.
[28:23] Mr. Chairman, if a property is five or more contiguous commercial acres, and it is used
[28:31] for general agricultural purposes, they are exempt from zoning, so they can have an unlimited
[28:37] number of farm animals, large farm animals, however, they cannot have commercial feedlots
[28:42] on those properties.
[28:44] And could they now today, on an RA zoning, have a commercial feedlots?
[28:50] No,
[28:53] commercial feedlots are only allowed in the heavy industrial and intensive industrial
[28:57] zoning districts.
[28:59] So this is an addition to this zoning category because you couldn't, I mean if they
[29:03] have a four acre partial now, they couldn't have an industrial feedlot today.
[29:09] Correct.
[29:10] So that's just an added bonus that you're putting into this change.
[29:18] It's so that the general public is aware when they read our zoning ordinance that commercial
[29:24] feed lots on that allowed in the areas on industry.
[29:28] Okay.
[29:32] That's all the questions I have in the stream.
[29:35] I just have a question as to when you have obvious overpopulation on an RAPs.
[29:45] That's five acres, what are the ramifications that can be done to reduce the number of animals?
[30:02] Mr. Chairman, I don't know. It seems that there needs to be some common sense, somewhat, but if they,
[30:12] so let me, let me, let me do a scenario. Somebody has 4.4 acres, okay, they can have 1, or 7, 10,000 square feet, or 1, cow, or 10,000 square feet, but the guy next door has 5 acres.
[30:25] He has unlimited and because he is egg-exempt, the county has no way by zoning regulations to limit him.
[30:35] Is that a fair statement?
[30:37] Mr. Chairman, again, if the property is used for general agriculture.
[30:40] If it's assumed, yeah.
[30:42] If he qualifies for egg-exempt status, he can have unlimited animals on that.
[30:47] Correct.
[30:51] don't see the cells or anything, but I agree that, you know, an animal per acre, 100 by
[30:58] hand. Four animals per acre seems is a great number. I mean if you have chickens, you can have,
[31:05] you can have four chickens. No, not large animals. No, large animals. No, large animals.
[31:10] No, this is only large animals. Well, chickens have a whole statute all of themselves.
[31:15] I don't even go down there.
[31:17] We went through there and there were so many features in this structure.
[31:19] I don't even open that coop.
[31:21] Okay.
[31:22] Yeah, it's just the, the violations that we can't do anything about it.
[31:27] That's all.
[31:28] We can make a motion.
[31:29] I would make a motion that we change instead of one on that animal for 10,000 square feet.
[31:37] That we have at least two animals for 10,000 square feet.
[31:44] There's a motion on the floor.
[31:50] There's a motion by Mr. Ron to amend it to two animals for 10,000 square feet, there's a second
[31:59] boboocarsia.
[32:01] So is this motion to a man to recommend approval as amended?
[32:09] Is that okay, Maggie?
[32:12] You're going to Maggie's answer.
[32:14] And that means
[32:19] that other people are going to use that.
[32:21] We've got a border friend.
[32:22] Yeah, because we're 100 by 100.
[32:25] Initiating a text to memo.
[32:27] So we're actually initiating the amendment.
[32:30] Mr. Chairman, if you would vote on the amendment and then vote on the approval as amended.
[32:36] I'm sorry, ma'am.
[32:37] If you would vote on the amendment and then vote on the approval as amended.
[32:41] Okay.
[32:42] So let's vote on the amendment as amended.
[32:44] And the men did.
[32:46] There's a motion to amend it.
[32:49] The second, all in favor of the motion to amend it.
[32:52] Say goodbye by saying hi.
[32:55] All opposed.
[32:55] Nay.
[32:58] Your roll call, please.
[33:00] Hey, James mosquito.
[33:02] Run race.
[33:04] Tim Bowers.
[33:05] Hi.
[33:05] Danny Bryant.
[33:07] No.
[33:09] Bugarsia.
[33:14] Bobby McDermott.
[33:16] No.
[33:24] That's not a reason to say, I mean, it's either I or no because of what you feel.
[33:29] Not because what I'm going to say.
[33:32] I think it will come.
[33:35] I was for the last Ivy.
[33:37] All right, now we're going to have a motion on that.
[33:40] I'm going to give me a chance on the record.
[33:42] Give me a chance on the record, please.
[33:44] Yeah, I'm going to give you a chance.
[33:45] May.
[33:50] Mr. Trauma, can you give me the motion and the second on the amendment?
[33:53] Ron Ring.
[33:54] Motion by Ron Rice, second on Hupel Garcia.
[33:57] Now we will vote on a motion on the amended request to initiate the text amendment as amended.
[34:06] Yes.
[34:07] Well, I have a motion on that.
[34:10] I have a motion by Ron Rice.
[34:15] I think I'm a who we were seeing any discussion
[34:19] All in favor signify by say it. I
[34:23] The same opposed I mean those opposed nay
[34:26] Hey, hey
[34:30] Hey, James. Good. Hi
[34:33] Run race high
[34:36] Himbours
[34:38] Danny Bryant
[34:40] I'm going to explain my boat. I'm going to vote no not but on there motion as amended because I like
[34:47] assistancey in zoning categories as much as we can. So I vote no.
[34:52] Mathieu Rosales. No.
[34:56] Lu Garcia.
[35:01] Bobby McDermott.
[35:05] Ron Vanwey.
[35:08] No issue cat.
[35:11] All right. Next time on the agenda.
[35:12] Discussion regarding a proposed amendment to the
[35:15] Yuma County is owning the only 30 comprehensive plan to address
[35:18] aggregate sources in land use element.
[35:22] Thank you Mr. Chairman, happy to present in this discussion item concerning a possible
[35:28] tax amendment to the 2030 comprehensive plan to address aggregate sources.
[35:34] The intent is to address aggregate sources in the land use element.
[35:39] At a new map depicting the locations of active aggregate minds and areas suitable for
[35:43] aggregates of resources, all in and from the artisan of geological survey, you may
[35:48] county public work department. Also add a definition in the plans glossary and incorporate
[35:52] the respective layer in the e-maccounting geographic information system.
[35:58] A recent revised stat use 1184B-1E requires including currently an antifisources of aggregate
[36:04] in the land use element of the comprehensive plan for counties with a population of more
[36:08] than 125,000 people. The land use element shall include currently an antifisources of aggregate
[36:15] from maps that are available from state agencies.
[36:18] Information from the Arizona geological survey on how to locate existing mines.
[36:24] Consideration of existing mining operations in suitable geological resources and policies
[36:28] to preserve currently identified aggregates sufficient for future development and policies
[36:33] to avoid incompatible land use.
[36:37] In addition to the Yume County 2030 Compliance Plan already contains policies applicable to aggregate
[36:42] mining activities within all planning areas, specifically the plan includes a policy and priority
[36:49] too, encourage appropriate buffers to mitigate conflicting land users, including between
[36:54] aggregate mining and residential land users and pursuant to stay low, preserve currently
[36:59] identify aggregates sufficient and for future development.
[37:02] The proposed amendment is consistent with this existing policy by providing additional mapping
[37:07] resources, identification and planning guidance intended to improve compatibility,
[37:12] between accurate extraction activities and surrounded land uses while supporting the long-term
[37:17] availability of aggregate resources necessary for future development and infrastructure
[37:22] that needs within the U. Mcounty. Staff is recommended that follow-in changes to the 2030
[37:28] complete the plan, text that it.
[37:30] This is right through format is intended to be deleted, and text in bold font is proposed new text to be added.
[37:37] We are adding agri resources right after the designated planning areas in bold, the bottom.
[37:45] This is also going to be included.
[37:49] Also adding something about buffers.
[37:54] Then down below in the glossary, between adequate public facilities and amendment, it's the agri resources definition.
[38:01] And this is the proposed map identifying existing aggregate sources throughout your
[38:10] account.
[38:12] Staff remains forward in this discussion item to the vote of supervisors for fuller discussion
[38:17] and input.
[38:18] And that concludes the staff presentation, Mr. Chairman.
[38:23] Any commissioners?
[38:24] Any questions?
[38:27] Just one.
[38:28] I, at these aggregate sources, will the boarding include management of your flood and rain
[38:38] waters and things like that, I'd be censored digging holes and they'd get a lot of precipitation
[38:44] and runoff and stuff like that, is that included in that or is it solely the aggregate itself?
[38:52] Mr. Chairman, the intent is to protect existing aggregate sources,
[38:59] and mine and activities
[39:01] are exempt from zoning, but however, not for flunk control.
[39:13] Any other commission or have any questions to
[39:18] staff?
[39:19] Seeing none.
[39:20] Open up the public on this.
[39:24] Any discussion from the public?
[39:27] Seeing none, I'll bring it back for discussion.
[39:29] Mr.
[39:32] Chairman. Mr. Chairman.
[39:33] Mr. Chairman.
[39:33] Mr. Chairman.
[39:34] And I mean we, we accept staff's recommendation and send this discussion up to the Board of Supervisors for their comment.
[39:41] I'll second that.
[39:43] Vice Chairman Bryant,
[39:46] McSemotion.
[39:47] Did you miscare the second it?
[39:48] Any discussion?
[39:50] All I'm facing if I'm saying aye.
[39:52] Aye. Aye. Aye.
[39:53] We oppose me.
[39:55] Motion passes.
[39:57] Next item on the agenda discussion, the commissioner planning director of the events
[40:01] attended, attorney events in the schedule for future planning commission meetings.
[40:08] Anything to add?
[40:09] I did go to the NAACP Juneteenth event at Harvard Park, pretty nice event.
[40:16] I don't think that I attended this one so far.
[40:19] Anybody else?
[40:24] Next item on the agenda is the call to the public.
[40:27] Anybody wish to come forward and speak?
[40:32] Can we go back to our other place?
[40:36] Can we go back to the other building?
[40:39] Sound in here sucks.
[40:40] I think we can make that decision.
[40:44] Isn't that a commissioner or a podium thing?
[40:46] There's been a motion to move back to the original.
[40:49] We have any kind of authority on that?
[40:52] It will save the county money if you think about it
[40:54] because everybody you all had to come over here.
[40:57] Mr. Chairman, I move.
[40:58] We send that up to the supervisor.
[40:59] Thank you.
[41:01] We'll be sending an email to our designated counterparts though.
[41:05] If there's no other business to be discussed, I will declare this meeting adjourned.
[41:10] Thank you.
[41:11] Thank you.
[41:12] Thank you.
[41:13] Thank you.
