working on switching everything over to

the looping project we did, which would

6D Highlands Development Agreement,
Miles.

» Uh yes. So, we the previous two council
meetings, or maybe last month or so,
[14:35]
we've done our preliminary plat and
final plat for the Highlands
[14:38]
development, which is coming in uh this
summer. So, this is will be the seventh
[14:41]
phase. So, 28 single-family lots will be
going up as part of the Highlands
[14:45]
development. Uh and we've been working
on a development agreement for the last
[14:51]
four or five months now.
Um and they've just been in negotiations
[14:55]
uh the last two weeks with Bigelow Homes
on getting that completed. Um so, we're
[14:59]
bringing that draft for you tonight. Um
Council member Kevin Amundson thankfully
[15:05]
pointed out a couple errors, so we had
some typos. And I am embarrassed to say
[15:09]
there was two mistakes with the numbers,
which I will address in a second here.
[15:14]
Um couple uh big items of note for you
as part of this agreement. Um there are
[15:19]
there's no park that park dedication
fees for this one.
[15:23]
That is because
on the very first agreement that or one
[15:27]
of the first agreements, they had
dedicated land in that agreement, so
[15:31]
that was for the entire phases a whole
multi-phases,
[15:35]
which is
odd, but in this case a little bit
[15:38]
different since there's a golf course
there, too. So, again, can't speak on
[15:41]
how it was done 20 years ago, but that's
where we are. Um another note was that
[15:46]
they had in the sixth phase a sewer
extension,
[15:50]
um which was for about $68,000,
um and that was supposed to be on a
[15:55]
10-year term, so they're in year five or
six of that. So, they are required to
[15:59]
pay off the remaining balance, which is
$434,315.

Um they will be posting a financial
security on this project of 125%, which
[16:09]
is required by our ordinance.
Um that will be in the amount of
[16:13]
$1,391,250.
[16:16]
Um the regular cash requirements are
$118,315.
[16:21]
315 dollars. As you know, in your
agreement, those numbers are incorrect,
[16:26]
and that was where I messed up. I
miscalculated. The we originally did
[16:30]
120% for a financial security as part of
our normal draft that we have, but our
[16:35]
ordinance requires 125%. Thankfully,
Kevin pointed out to me, so I got that
[16:39]
addressed. Um and then I just
miscalculated on the cash requirements.
[16:43]
It's actually 118,000.
In the agreement, we have $104,000, so
[16:47]
just keep that in mind that it'll be
more than what's there. I miscalculated
[16:51]
it for
whatever reason. So, that's my fault
[16:55]
completely.
Um those fees in particular are for
[16:58]
engineering administration,
legal expenses, which is 0.5%, and then
[17:03]
for the sewer extension as well. So, not
a ton of fees, but on our previous
[17:06]
agreements, there were no fees at all.
So, I think having anything is really
[17:11]
good slam dunk for the city on that one.
Um and I also added a provision about
[17:17]
site maintenance during construction
because we have a couple comments during
[17:20]
our public hearings from the from the
general public in the area about how on
[17:26]
previous phases some of the site
maintenance was poor
[17:29]
and a lot of debris or trash blew into
other people's properties. So, we added
[17:33]
a stronger provision in there that gives
us a little bit more room to say, "No,
[17:37]
this is our contractual agreement that
needs to be clean and it can't affect
[17:41]
the neighboring properties as well." Um
so, those are kind of the big notes I
[17:45]
have, but I'll open that up to any
questions.

talked about this, there were several

things that the engineer talked about
and that they were in the process of
[17:56]
going through.

final plat has yet to be recorded and
that's because it's contingent upon us

too. So, all these things will be
addressed and I Bill is not here
[18:15]
tonight, but
but Bill has has been They actually
[18:19]
forwarded us construction plans and
everything. From my perspective it's
[18:22]
been addressed, but I don't know if he
has anything he still needs to work out,
[18:25]
but we've obviously have never had a
problem with Bigelow or working with
[18:29]
their engineers on addressing those
concerns. So, I think we're we're okay
[18:33]
where we are now and again all this
stuff will be ironed out for sure by the
[18:37]
time everything's recorded with the
county.

This is kind of like an odd phase or
really wasn't space for anything. Um I

don't know why that had occurred cuz it
really wasn't in any agreements. I think

they kind of just put it in one of their
plats at one point, just cuz it was
[19:13]
probably an odd lot, and they were like,
"We'll just put something there
[19:16]
um for the general public." But, their
original notes about Parkland dedication
[19:20]
was that the golf course, cuz it was
originally a nine-hole golf course, they
[19:24]
added nine holes, and that was meant to
be the Parkland dedication.
[19:29]
Little bit weird, I think, but
um that's the way it was done when it
[19:34]
was first signed in 2003.
Um and so, lots of things changed. One
[19:39]
other interesting note, too, is that
they wanted to pay their sewer and water
[19:43]
availability charges up front in the
first agreement. So, they paid us a sum
[19:48]
of almost $300,000 in two in 2003 um for
those for that So, that's for the entire
[19:54]
90 acres of future development, which,
as our attorney Mike Flaherty noted, is
[20:00]
really weird, um and he didn't really
like that, but that's what happened. And
[20:04]
so, that's why you don't see that as a
fee in here, too, like you saw with uh
[20:09]
the Keller Barton building
um and all the projects we have, just
[20:12]
cuz they decided to pay it up front, and
that's the reason you don't see it in
[20:16]
the previous agreements, either, is cuz
they already paid it, I guess. And we
[20:21]
Kim and I had to go back and dig back in
2003 to make sure that was actually
[20:24]
paid. So,
um yeah.

» They probably came out really good on
inflation, then.

uh there's basically two topics that we

is the water billing building.

And then also the health insurance
something about

when our renewals are, they want to
change the renewal but won't affect our
[21:16]
budget.

meeting with um our

I think he's our consultant on our
health insurance services or he he's

part of our health insurance and we were
looking for a way where we could know

about our rates for next year earlier in

because as you know, we get our rates in
October and that's a problem because we
[21:43]
set a preliminary budget in September
and we can't go any higher than that. So
[21:47]
if the rates come in at 20% increase,
then we are out of luck almost and we
[21:52]
have to really maneuver. We had to do it
last year, too.

» that's what we had to do last year.
>> And so one thing that he proposed is
[21:58]
that we can change the structure of our
year and move it a month earlier. So
[22:02]
basically the benefit year would start
in December and go until um
[22:06]
the next year. Um so it like we're
moving things up a month and that will

get us our rates in July. So we'll see
what the increase is in July. That way
[22:15]
we can budget for it. Now this is a
little bit confusing and so Kim and
[22:19]
Brian will probably bring some
explanations and some charts for you to
[22:22]
kind of paint a graph picture of it um
at the work session but that's just kind
[22:26]
of the idea we're floating because it's
kind of a hassle on us um to budget for
[22:31]
it and it can even be a problem in union
negotiations as well when that comes up
[22:35]
because well we don't have the rates
until
[22:37]
um
October and that screws things up
[22:40]
because I mean we started negotiating in
August and September. Um so that can be
[22:44]
a problem. So that's just kind of what
we're proposing. We're going to let you

and then we'll bring some more

I'm covering a few people tonight. So,
[25:00]
number one was out for Kim. We had our
budget or sorry, our audit this week.
[25:05]
So, Abdo came in. They did field work
only on Tuesday and Wednesday,
[25:10]
which is different than what we're used
to because our previous auditor were
[25:13]
here all week, sometimes even into the
next week as well. So, they did their
[25:17]
field work this week. They were here and
they got to see our processes and they
[25:21]
got to handle everything and they
completed everything and it ran very
[25:26]
smoothly and
we had no really big hiccups, which is
[25:30]
really nice.
I think Kim thought this process was
[25:34]
a lot less stressful than previous
years.
[25:37]
So, yeah, we'll get more information
when we get those audits back, but
[25:41]
things went really well.
Couple notes from our community
[25:45]
development director,
Kurt Meister,
[25:48]
the Zumbrota Economic Development
Authority voted to continue advertising
[25:51]
the city by purchasing some Google
Performance Max ads.
[25:56]
EDA used Facebook ads last year, but
felt the advertisements weren't reaching
[26:00]
as many people as possible. So,
the Google Ads campaign will work with
[26:04]
users' online algorithms and allowing
advertisements promoting Zumbrota to
[26:08]
appear more frequently to targeted
audiences. Um,
[26:11]
ads will highlight a lot of the
community attractions we have and
[26:14]
amenities, including the covered bridge,
the new community pool, campground, and
[26:20]
our
walking and biking trails, strong school
[26:23]
system, and our new housing
opportunities and local festivals as
[26:26]
well. Um, and they
approved the purchase of a 3-month
[26:30]
advertising campaign for $3,100
through Tulip Tree Studios of
[26:34]
Stewartville.
That all came from the promotional
[26:36]
budget of the EDA.
And the second item is that the EDA is
[26:41]
exploring some ways to better utilize
our historical plaque that we have at
[26:44]
the roundabout near Quick Trip. As you
may know, it's kind of in a weird spot
[26:49]
and it's really rarely seen by the
public and may benefit from being
[26:53]
relocated near the existing monuments by
the covered bridge. So, Kurt has been
[26:57]
working with Jeff
to kind of identify a solution for
[27:00]
relocating the display. Due to the size
and structure of the monument, it can't
[27:04]
be removed in its entirety.
Instead, the plaque will need to be

and I attended the Minnesota City

Managers Association conference last
week from Wednesday Wednesday to Friday

morning basically.
So, we got to hear a lot of great

speakers there and got a lot of
networking opportunities with other
[27:46]
cities. So, we got to flow a lot of
different ideas around, talk about
[27:49]
different topics.
So, that was really great.

We also had our groundbreaking ceremony
last week for the Kilbourne Bridge
[27:57]
Apartment building. Which went really
well. We had a pretty good turnout, a
[28:01]
lot of different members of the
community. And then finally, Miranda and
[28:05]
I this week attended our first election
training.
[28:08]
So, getting ready for the primary and
general election this year. So.

had some good news in regards to the

memorial highway that's being renamed
and was able to show me the sign that

they're going to be placing
and it'll be up It looks like to me in

some prominent sections of the uh,
north and south end of the city, so it
[28:47]
will be quite visible.
And so, we're excited to see
[28:52]
um, that uh, Memorial Highway being
renamed. Um, we uh,
[28:57]
our newest employee is on track uh,
field training wise.

Um, so we're we're hoping maybe by the
end of the month um,
[29:06]
Misty will be ready to roll on her own.
Other than that, I got nothing.

we're kind of looking at ideas.
