[15:27] urgency ordinance creating temporary
[15:30] moratorum on rent increases on mobile
[15:33] home spaces in the city of Fortuna.

[15:51] members. This evening, as directed by
[15:53] your city council, staff have brought an
[15:56] urgency ordinance creating a temporary
[15:58] moratorum on rent increases on mobile
[16:01] home spaces in the city of Fortuna.
[16:05] Just as a reminder of how we came to be
[16:08] here, here is a timeline of events. In
[16:11] early July, the city council began
[16:13] receiving communication from Royal Crest
[16:16] mobile home residents about unaffordable
[16:18] mobile home space rent increases. On
[16:20] July 17th, city staff met with residents
[16:23] of Royal Crest to hear their concerns
[16:25] about increasingly unaffordable rent
[16:27] increases.
[16:29] July 21st, uh, Save Our Seniors made
[16:32] public comment um, and made a request
[16:35] for mobile home rent stabilization
[16:38] ordinance at the Fortuna City Council
[16:40] meeting that day. The city council
[16:43] during future agenda items directed
[16:45] staff to return with information on the
[16:47] rent stabilization ordinance. On August
[16:50] 28th, city staff met with
[16:52] representatives from stores management.
[16:57] On September 15th, the city council held
[16:59] a study session on mobile home rent
[17:01] stabilization and city council directed
[17:04] staff to return with a temporary
[17:05] moratorum on rent increases on mobile
[17:08] home spaces. September 24th, the city
[17:11] council held a close session due to
[17:13] significant exposure to litigation due
[17:15] to assertions by the owners of Royal
[17:17] Crest mobile estates. And today,
[17:20] September 29th, the city council is set
[17:22] to review urgency ordinance creating a
[17:24] temporary moratorium on rent increases
[17:26] on mobile home spaces.
[17:32] The purpose of an urg urgency ordinance
[17:34] is to place a temporary moratorium on
[17:36] rent increases on mobile home spaces to
[17:39] preserve housing status for vulnerable
[17:41] populations and affordable housing for
[17:43] the community while staff further
[17:45] investigate and develop a permanent
[17:48] mobile home rent stabilization ordinance
[17:50] temporarily pausing rent increases on
[17:53] mobile home spaces until April 30th,
[17:55] 2026 as stated in the ordinance or the
[17:58] effective date of a mobile home Rent
[18:00] stabilization ordinance will prevent an
[18:02] undue rush on rent increases on mobile
[18:04] home spaces before the effective date of
[18:06] an ordinance that will be designed to
[18:09] protect mobile home space tenants. Such
[18:12] rush increases could defeat the purpose
[18:14] of rent stabilization.

[18:59] increases from property owners could
[19:01] defeat the purpose of a rent
[19:02] stabilization ordinance or defer its
[19:05] benefits for years.
[19:09] Adoption of this ordinance on an urgency
[19:12] basis is necessary to preserve the
[19:14] public peace, health, and safety of the
[19:16] residents, businesses, and property
[19:17] owners of the city. The findings that
[19:20] constitute the basis for the urgency and
[19:23] the need for a temporary moratorum
[19:25] include all of the items listed on the
[19:27] slides. Uh but a few of them are mobile
[19:29] home parks provide an important
[19:31] alternative form of housing. A
[19:34] significant majority of the residents of
[19:36] mobile home parks in the city are older
[19:38] individuals or couple living on fixed
[19:40] income. Nearly all mobile home park
[19:43] residents own and occupy their mobile
[19:45] home and have made a st a substantial
[19:48] investment to live in the mobile home
[19:49] park. And residents of a mobile home
[19:52] park have very limited mobility due to
[19:54] the impracticality of relocating a
[19:56] mobile home.
[20:04] A number of residents of mobile home of
[20:07] mobile home parks in the city have
[20:09] expressed the concern that they could
[20:10] become homeless if mobile home park
[20:12] owners continue to impose significant
[20:14] rent increases.
[20:16] Temporarily pausing space rent increases
[20:19] will prevent again rush space rent
[20:21] increases before adoption of regulations
[20:23] to stabilize mobile home space rents.
[20:27] Uh for these reasons, an urgency urgency
[20:30] ordinance can be adopted.
[20:34] Tonight, your city council will consider
[20:36] an urgency ordinance creating a
[20:37] temporary moratorium on rent increases
[20:39] on mobile home spaces in the city of
[20:41] Fortuna. If the moratorum on mobile home
[20:44] space rent increases adopted this
[20:46] evening, staff will return before April
[20:49] 30th, 2026 with a draft mobile home rent
[20:52] stabilization ordinance.

[20:58] to approve the emer emergency ordinance
[21:00] that's in your packet creating a
[21:02] temporary moratorium on rent increases

[21:55] whole lives for. In mobile home parks,
[21:58] base rent is directly tied to home
[22:00] value. That is devastating for seniors
[22:03] on fixed incomes
[22:05] who cannot replace that lost value. At
[22:08] Royal Crest, rents have risen almost
[22:11] 100%.
[22:14] since 2012, outpacing inflation,
[22:18] stripping residents of tens of thousands
[22:20] of dollars in equity. Imagine saving for
[22:23] decades only to see the value of your
[22:26] home eroded in a few short years. Not
[22:29] because of the market, because of
[22:31] unchecked rent increases.
[22:34] The temporary moratorum on rent
[22:36] increases you are considering tonight
[22:38] fixes this temporarily while ensuring
[22:41] fairness that protects everyone. Council
[22:45] members,
[22:46] this is about dignity. Seniors should
[22:49] not be forced to choose between heat,
[22:52] medicine, and keeping their homes. This
[22:55] pause pervers preserves stability while
[22:58] you finalize a fair, permanent,
[23:01] enforcable framework. I respectfully ask
[23:04] you to adopt the temporary moratorium on
[23:06] rent increases, including no pass

[23:23] the Royal Crest Mobile Home Estates.
[23:26] We've heard about temporary rent
[23:27] assistant programs like MH,
[23:31] but these are band-aids on a deep wound.
[23:34] They cover only a handful of residents
[23:36] at most, about 10 out of the over 200
[23:39] families. And even then, there is likely
[23:41] no more than five that could qualify in
[23:44] Royal Crest and only for a short time.
[23:46] The majority remain remain unprotected,
[23:49] still subject to unaffordable increases.
[23:52] In addition, for those who do not
[23:54] qualify for those unattainable funding
[23:56] resources,
[23:58] are forced to vacate their homes,
[24:00] corporations like stores for their
[24:03] benefit by obtaining their homes and
[24:05] reselling them for a higher profit. We
[24:08] have one they just got that they're
[24:10] selling for $210,000.
[24:13] >> These programs do not stop the root
[24:16] problem, skyrocketing rents. They leave
[24:18] us scrambling for aid while park owners
[24:21] continue to raise rents unchecked.
[24:24] Worse, they depend on outside funding
[24:26] that can vanish at any time. That's not
[24:28] stability. That's false hope. the
[24:30] temporary moratorum on rent increases
[24:33] before you allow for development of an
[24:36] RSO. It's systematic, enforcable, and
[24:40] fair. It provides certainty for
[24:42] residents and ensures owners continue to
[24:44] receive a fair return. It prevents race
[24:47] to rise rent hikes that could otherwise
[24:51] occur before permanent rules are
[24:53] finalized. We don't need temporary
[24:55] charity. We need structural fairness.
[24:58] and tonight you can provide it. I
[25:00] respectfully ask you to adopt the
[25:02] temporary moratorum on rent increase
[25:04] including the no pass through owner
[25:06] expenses tonight. Thank you.

[26:15] recoup the last four years will not
[26:18] recoup the last four years of over 20%
[26:20] rent increases but it will be a large
[26:23] welcome and most appreciated re respit
[26:27] to the gnawing constant fear of this
[26:29] happening again.
[26:32] As the roads diverge, it's up to each of
[26:34] us which road we choose.
[26:37] We hope you will choose the moratorum
[26:40] and vote yes for the RSO when that time

[27:53] argument that a moratorum, I mean,
[27:55] sorry, a memorandum of understanding
[27:58] could be a solution. But let's be
[28:00] honest, anou is a promise. A rent
[28:03] stabilization ordinance is protection.
[28:06] Anouou can be written rewritten at any
[28:09] time by the park owner. It has no
[28:11] enforcement mechanism. It does not
[28:14] guarantee caps or on increases. Nor does
[28:17] it put limits on pass through charges or
[28:20] a restriction on one increase of one
[28:23] increase per year. In short, it leaves
[28:25] all the power in the hands of the very
[28:27] people who have already raised rents
[28:30] without restraint. Our homes cannot be
[28:32] moved. We cannot shop around for a
[28:35] better deal. Without a binding law, we
[28:38] have no stability, no security, and no
[28:40] recourse. Our RSO, even a temporary
[28:44] moratorum leading to one, creates
[28:47] balance and ensures fair return for
[28:49] owners, but stability for residents. It
[28:53] gives this council, not out of town
[28:55] corporations, the authority to safeguard
[28:59] Fortuna seniors and families. Plea,
[29:02] please don't give us a promise. Give us
[29:04] protection. Please don't give us a

[30:54] not radical. It is careful, legal, and
[30:58] financially planned for. It's a seat

[31:11] helping pass out notices for this
[31:13] meeting tonight. And I noticed from this
[31:16] meeting to the meeting before,
[31:19] uh there was one household that told me
[31:22] that they were trying to stay in that
[31:24] stores was foreclosing on them and that
[31:27] they were a little bit behind on rent.
[31:29] They kept trying to make the payments.
[31:31] That house is empty. Uh, as of when I
[31:34] posted the notice, uh, there was another
[31:37] fellow uh, 82 year old fell named Phil.
[31:40] Lived about a half block up the Crest
[31:42] Drive there. He lived there quite a few
[31:45] years. And when I talked to him, he had
[31:48] trouble paying the rent and making
[31:50] medical uh, expenses. And the coroner
[31:53] picked him up uh, midweek.
[31:57] So, uh, there are people that are
[31:59] actually having to choose between
[32:01] possible medical operations or paying a
[32:04] rent, buying food or paying a rent,
[32:07] getting their doggy taken care of with
[32:09] the pet place or paying a rent. So, this
[32:12] is this is critical to a lot of people
[32:13] living here, particularly the long term
[32:16] that thought they moved in, rent was
[32:17] great, and they live here forever. Well,
[32:19] stores just replaces them with new
[32:21] people that look like they got plenty of
[32:22] money to ask them 20 years from now.
[32:25] And, you know, I've had lots of money in
[32:26] my life, too. like you people, some of
[32:28] you do. And I ended up in stores
[32:31] management. So things change in our
[32:33] lives. So just keep watching out for
[32:35] your local voters and citizens. We

[38:45] so eloquently in representing
[38:48] um not only her constituents but her
