[1:14:30] Depending code enforcement action is separate from the applicant's request to amend the approved

[1:14:41] When the unified development code was amended and adopted in December of 23, we as staff
[1:14:47] recommended that we revise the highway 21 plain code or street planning requirements because
[1:14:52] because we acknowledge that
[1:15:00] The required amount of landscaping could be reduced while still basically achieving the same result. The applicant today is requesting to instead of utilizing the originally approved landscape plan by you all back in 2024 to use today's current standards essentially. While the current UDC requires fewer landscape paintings in the former land development code, the revised landscape plan is not satisfied the minimum requirements of the UDC.
[1:15:30] The plan is deficient by two class A trees and one class
[1:15:35] featuring in the highway 21 plan corridor.
[1:15:39] They are requesting a WS land development code irrigation was not a requirement under the current UDC it is.

[1:15:51] There are a few statements contained within the applicants written request that are inconsistent with the landscape plan,

[1:16:06] landscape islands were planted and constructed.
[1:16:08] However, the submitted as-built plans that engineering is currently reviewing indicate that one required landscape island was not constructed.
[1:16:17] The proposed dumpster enclosure and the required seven foot opaque fence and gate as shown on the previously approved plans are not reflected on the revised landscape plans.
[1:16:25] to staff has questions as to where the dumpster is located and whether or not it conforms
[1:16:30] with the UDC. We also note that the location and death of the existing drainage infrastructure
[1:16:36] within the North landscape offer conflicts with the proposed plantings as shown and should

[1:18:36] up, where the landscape plan was tucked in there too. And so I'm assuming that I don't
[1:18:42] know this for a fact, but I'm assuming that the landscape plan was approved at that time
[1:18:49] as well. And as I did hear her mention that the code had changed and that was one of the
[1:18:56] big issues that the owners needed me to come in and take my former student's plan and
[1:19:04] redo it. And after 40 years of teaching at LSU I get to do that with a lot of my former
[1:19:11] students time to time. But it was a very good plan. I would have given him an A on that
[1:19:18] plan, just like I gave him an A in his classes in LSU, but it needed to be redrawn, and so
[1:19:26] redrawing it was a relatively easy thing to do, but there were a few little things that
[1:19:32] came up that I wanted to point out.
[1:19:36] And some of these things, maybe the way the code is written and the way it's presented on
[1:19:43] on the internet. I had a really hard time trying to work with the internet to get all of
[1:19:49] the code things in it. I don't know. Maybe it was my computer. Maybe it was me. But there
[1:19:55] were some problems. And one of the issues was a street planting area. And that's an area
[1:20:04] So on my plan, this 39 feet deep and 160 some feet wide, and the purpose of that street
[1:20:14] planning area you may or may not know the number of class A and class B trees that go
[1:20:22] in there are dependent upon the total square footage of that area that's been set aside
[1:20:29] for that street tree plant. And that's fine except there's one problem. Just a minor problem.
[1:20:39] There's a concrete driveway that goes through it. And that reduces the square footage of that
[1:20:48] area which is in our favor of reducing the number of trees that need to go in there. And so I made
[1:20:57] the assumption that you all would agree that we can't plant trees on concrete so that square
[1:21:05] footage should be dropped out of the calculation. Nowhere in the code notes that I read it said anything
[1:21:14] about allowing me to do that. So I'm here to ask your permission to not have included that it's
[1:21:23] like 1200 square feet of concrete.
[1:21:26] And so I subtracted that from the overall area,
[1:21:30] did my calculations, put the right required numbers
[1:21:33] of trees in there according to my calculations
[1:21:36] and not your calculation.
