So, for the past year and a half, after
those 80 accusations, have any other
[1:31]
commissioners found any merit in that
crusade? Any at all. Silence is
[1:38]
agreement.
Today, take a stand and end the
[1:43]
unproductive
session. Put forward a motion.

Commissioner Durk's concerns have been
thoroughly reviewed and found without
[1:52]
merit. More baseless accusations will
not be tolerated.

You can't just go with consensus taken
action.

Second, repeated public comments by the
same people is out of hand at commission
[2:07]
meetings. How many times has new
planning and zoning member Brandy Smith
[2:11]
and planning and zoning member Josh
Wiser's wife complained about planning
[2:15]
and zoning? limit public comments by an
individual to once per month.
[2:22]
Finally, what happened to Commissioner
Durk's conflict of interest policy that
[2:25]
he's been demanding for over a year?
Now, he drops it and blames someone
[2:29]
else.
I've appeared before this board to
[2:33]
refute each and every one of his
accusations. There's consensus that
[2:37]
there was no conflict of interest, but
again, no action was taken. In light of
[2:42]
Commissioner Durk's continued crusade, I
would ask for a motion.
[2:47]
I would ask that the board has reviewed
Commissioner Durk's concerns of conflict
[2:50]
of interest by planning and zoning
member David Mueller found them to be
[2:55]
without merit. More baseless accusations
will not be tolerated.

The coordinated attacks at the last
planning and zoning meeting were the
[3:04]
last draw. It's time for the board of
county commissioners to take a stand.

I woke up this morning and

and
[3:49]
windmills was was making a whole lot of
noise which they do at this kind of day
[3:55]
and uh
air conditioner kicked on. Here I'm over
[4:00]
the air conditioner. It's it's obvious
that it's way over the the accepted
[4:04]
limits
of uh the 55 dB. I've got a decibel
[4:08]
meter. I I understand what this is. Uh
so few weeks ago, um there was a
[4:16]
conversation, you know, we've done well
well on the lights. I mean, fine. It
[4:19]
took three years thanks to Commissioner
Dirks to to to you know, start to fix
[4:25]
those, you know, and then, you know,
they're not quite where they should be,
[4:28]
but great improvement.
And so now so they they had a
[4:33]
conversation a few weeks ago between him
and counselor about what we should do
[4:37]
about the noise level and also well the
TV and a reception that I don't get and
[4:43]
uh over the air and others and uh so he
told the comm uh counselor from as I
[4:50]
recall was that uh to refer your
comments to the zoning board which I did
[4:57]
and I haven't done it for a long time.
He did it last April when he talked to
[5:01]
him about the roads or did said they'd
look into it. Here we go.

And then uh
so uh they said go to the board. So I
[5:10]
went to the to the zoning commission or
the zoning office and and and filed a
[5:17]
complaint. Thought maybe they had a form
or something. They didn't. And uh so I
[5:23]
wrote it down on a piece of paper what
you know my objections were. And uh the
[5:27]
secretary told me, "Well,
it's not going to do it good because uh
[5:33]
well, there's nothing we can do about
it." And I said, "Well, yeah, you know,
[5:35]
there is. You know, I mean, all we're
asking you to do is is uh enforce
[5:40]
regulations, you know, and and and we
need to, you know, look at this. So,
[5:45]
what are we supposed to do?" So, so
well, so following Friday or something,
[5:52]
um I I presume it was the director
called me and about 5 till 5 and called
[5:57]
me and told me, well, she reported it to
uh to Orstead. Well, you know, they're
[6:02]
not going to do anything. They haven't
never have got to push it, I guess. I
[6:08]
don't know. So, I guess my question is
today, what are we supposed to do? What
[6:13]
can we do?

there's nothing. We're not in
[6:21]
enforcement regulations. That's all
we're asking for. And and in my opinion,
[6:26]
and I think that it is the
responsibility of the zoning board to do

don't do any work uh they just come out

test uh the environment for the inside
they do a full inspection and then they
[14:58]
give us a full report on what we would
need to do and how we would need to do

it um is what this is
the total price for that that he gave me
[15:09]

um and I before I did anything or we did
[15:14]
anything. I wanted to come and talk to
you guys to see one if this is the way I
[15:18]
guess we want to handle that or if
there's a different way or what we want
[15:23]
to do there moving forward on the inside
of that lake building.

happen. And I'm utilizing this company
in another
[15:59]
not in the realm of my county role, but
in another role that I am in leadership

on and have
found that to be the case with them. So,

follow-ups for you and um you had asked
[18:52]
about how we receive money for the
sheriff's drug fund and I did talk to
[18:57]
the sheriff that is that comes from the
state. It's money collected typically
[19:01]
like through a set off program or
individuals that are stopped or um they
[19:09]
don't have and they don't have the drug
stamp and so they are there are charges
[19:14]
that are brought because of that
[clears throat] financial financial
[19:17]
charges that they have to pay. And so
what the way that the sheriff said they
[19:21]
typically typically get that is the
state set off or a state agency that
[19:26]
sends them the money back and like they
intercept if they have any tax returns
[19:32]
or things like that. And so that's where
those funds come from. They do come from
[19:36]
the state and that's the process that he
outlined.

arrest they say no drug

Um and again most the time we don't get

much out of that um in a year. Then

uh emergency management and planning and

zoning uh because they have the most
knowledge and interaction on those
[20:16]
topics. And the wind farm do have their
uh they have their own high angle rescue
[20:22]
teams and local emergency responders
take over when the patient is on the
[20:27]
ground or they're also they can also
stand by for support. So that is how
[20:31]
that's handled. We do not
actually
[20:35]
» they deployed teams in it

expertise that they need to be able to a
lot of equipment and training involved
[20:44]

noted that most of the fire departments
here are trained on grain bin rescue
[20:57]
which includes some high angle rescue
skills and um they have a course that is

called rope rescue course which includes
high angles. So we do have personnel in
[21:06]
the county that do have some of those um
kind of trainings but um the situation
[21:11]
is
um Marcy explained that it's similar to
[21:16]
the process for anything on like a
railroad property. So the wind farms in
[21:20]
this instance are in charge. Their
incident command is under the wind farm
[21:24]
and then they have spe uh specified
standard operating procedures for that
[21:29]
and then the county rescue teams are
support on the ground. Okay. All right.

And then um I just also since we're
since we still have a little bit of
[21:42]
time, I will go back into what the
commission recently uh set as an
[21:48]
expectation for people that have
complaints regarding the wind farms
[21:53]
that they are to go to the planning and
zoning department and file a complaint.
[21:57]
And that has been done recently, which I
I did inform the board when I knew that
[22:02]
a complaint had been filed there with
the planning and zoning office. that has
[22:06]
gone to the to the wind farm for
investigation. It's my understanding
[22:11]
that they have tried several times to
follow up and have not been getting an
[22:16]
answer from from Mr. Britain. Um but my
question is to the board is um so that's
[22:23]
the process that you all outlined.
My other my question is, would you
[22:28]
rather
um
[22:32]
hire a third party
to investigate these? So, when a
[22:38]
complaint comes in, then the county can
go to [clears throat] a third party
[22:42]
investigator that works specifically for
us. There are three or four of them that
[22:47]
I'm aware of that we could utilize. we
would have to pay for that, but then we
[22:51]
could request reimbursement from the
wind farm and that might be a better way
[22:56]
for
>> our folks to actually feel like um we
[23:02]
can ensure that that things are are fair
that way.
[23:06]
» So this third party, are they just a
information gather and a deliverer or do
[23:13]
they actually do investigation? Well, I
could look into a little bit more, but
[23:16]
as of right now, the board has not
authorized anything like that. And so, I
[23:21]
think if you have the expectation of the
department fielding the request, which
[23:25]
they did, the department initiating an
investigation through the wind farm,
[23:30]
which they have done, that's that's the
only thing that you have so far given
[23:34]
authority for us to do. So if you want
to have a true avenue for these things
[23:40]
to be investigated and and
at our direction and our you know I I
[23:49]
think it might be something to look into
and I could bring back more information
[23:52]
on the companies and what exactly they
would do for us.

» That doesn't sound like a bad idea to
me. I I would hate it if the the
[24:01]
taxpayers would have to pay for
somebody's
[24:07]
individual complaints,

something that we would potentially be

able to seek reimbursement for. But that
gives us some teeth. Gives you all a way
[24:22]
to actually know and feel like you have
gotten the investigation that you know
[24:28]
and then also if somebody doesn't want
to answer a phone call from the wind
[24:32]
farm themselves when they're trying to
gather more information perhaps they
[24:36]
would be willing to answer a phone call
from a third party that is working for
[24:40]
us.

think so. I mean there are certain
[24:51]
things in our agreement. I believe that
that especially in regard to the
[24:57]
reception that like the television
reception and things like that that

I think that there is money that is
allocated for that in our agreements.

And so to me that would potentially be
the be able to be a source of
[25:10]
reimbursement for those investigations.
But I would need to do a little bit more
[25:14]
clarification research on it. But I just
thought today might be a good day to
[25:19]
raise that with you. It was on my list
for a different meeting, but since it
[25:23]
was brought up today,

we looked at something like that. But to
me,

there would need to ask have some teeth
into uh whatever they sign as a
[25:37]
complaint
that if there's no merit value in the
[25:43]
complaint
that it falls back onto the person that

there. The individual has the right to

sort. The law does allow for uh sanction
uh in that case, but that's going to get
[26:12]
back to Mr. Phillips like Mr. Garing
taxpayer have to pay for it.

be one that side or the company's not

county staff a tool as well because
we've done everything on our end that

the commission has asked and we have
received the update that they have been
[26:50]
trying to reach out but have not been
um successful in getting through to to

the complaintant. And so when you get to
that point, then you're at a you're at
[27:02]
an impass unless there is a a process in
place. And I I think it's always a good
[27:09]
idea to have a a non-interested third
party involved in these kind of things
[27:14]
and people that would be potentially um
trying to investigate these things.

I mean it wouldn't automat necessar
automatically every complaint
[27:26]
like a TV reception something they can
document yeah there is no TV reception
[27:31]
here

complaints that come from this type of
development I think it would be

appropriate any complaint that we get we
send to a third party investigator there

precedent for any and all things
[27:59]
necessarily it depends [clears throat]
on the contractual obligations in the
[28:02]
relationship this thing is very unique
in terms of it does they do have a
[28:07]
number of obligations and duties the
decibel level that is amended in the
[28:11]
extent to which that can occur um
interference with uh uh radio or TV
[28:18]
types of reception and signals. Those
things were contemplated to some degree.

So if complaints come in about those, at
least those have some element within the
[28:26]
original pervasive uh parameters of the
agreement uh to to at least contemplate
[28:34]
some relief.

you'd have to write in a crywolf clause

tile and then build up on top of that.

it's just something to try to make

things safer up there right now. So that
