All
[0:03]
right.
[0:06]
>> Ready. All right. Call this meeting to
[0:08]
order. It's the planning commission
[0:10]
meeting. It's current or it's May 13th,
[0:12]
2026. Currently 6 p.m. We'll start with
[0:14]
the pledge of allegiance.
[0:17]
» I aliance to the flag of the United
[0:21]
States of America and to the republic
[0:24]
for which it stands. One nation under
[0:27]
God, indivisible, with liberty and
[0:29]
justice for all.
[0:33]
>> Roll call.
[0:34]
>> Dan here.
[0:35]
>> Bradley Fra here.
[0:36]
>> Ryan here.
[0:37]
>> G Hood and Lee Freish are not present.
[0:40]
They couldn't make it. All right. You
[0:42]
guys have any conflicts of interest to
[0:44]
disclose?
[0:45]
>> I have a conflict of interest on one of
[0:47]
the items on the agenda. So, I just I
[0:50]
propose we table it.
[0:51]
>> Okay. Anyone else?
[0:55]
All right, then we'll just start with
[0:56]
item number one, the conditional use
[0:59]
permit application for an accessory
[1:01]
building larger than the given square
[1:03]
footage at 1614 North Apple Valley
[1:05]
Drive, AB 1334 T1. You want to go up and
[1:10]
present it?
[1:12]
The applicant is here and so is the
[1:14]
engineer, but I think I could probably
[1:16]
answer most your questions.
[1:18]
So, if you guys had a chance to look at
[1:20]
this at all, uh, when he first came to
[1:23]
my office,
[1:25]
I told him I was just meeting with him
[1:27]
to humor him because, uh, it's a pretty
[1:28]
big building. Um, what what he there's
[1:31]
some interesting um, facts that go along
[1:34]
with this, though. So, he's proposing a
[1:36]
15,000 foot shop on his two acres over
[1:39]
here. Um, my son thought was, of course,
[1:42]
his neighbors are not going to be happy
[1:43]
about that. Um, but remember the
[1:46]
loophole in our ordinance? he can build
[1:49]
four 4,000 foot buildings.
[1:52]
So, he doesn't even need a conditional
[1:54]
use permit for that. Right now, he can
[1:55]
go over there and build four 4,000 foot
[1:57]
buildings. Um, this does not cover up
[2:00]
50% of his lot. So, he could do that
[2:02]
between his house. Not even close. He's
[2:04]
not even close to covering up even close
[2:06]
to half of his lot. Um, so that was
[2:08]
something to take into consideration.
[2:11]
But the biggest deciding factor was he
[2:13]
brought me a paper you should have in
[2:15]
front of you with signatures from his
[2:17]
neighbors saying that they're okay with
[2:19]
this. Um he brought me the first one and
[2:22]
he had it on a notebook with all the
[2:24]
plans behind it and everything. Um one
[2:27]
of the neighbors said he didn't want
[2:28]
anything there at all and um I
[2:31]
understood that but I told him there's
[2:32]
nothing I can do. He has 4,000 square
[2:35]
feet. um he felt that maybe uh people
[2:39]
weren't informed on how big this
[2:41]
actually was. So I went to the applicant
[2:44]
and said, "Hey, I need you to do me
[2:46]
something. I need you to get this form
[2:48]
you already have and I want you to put
[2:50]
right on here. The building will be 250
[2:51]
ft long, 60 ft deep, 25 ft tall, 15,000
[2:55]
ft², and get all those people to sign it
[2:57]
again." So he did that. He got them all
[2:59]
to sign it again and even got another
[3:00]
signature on top of that. So, I put that
[3:02]
map for you guys so you guys can kind of
[3:04]
see who said they're fine with it. Um,
[3:07]
the only people in this uh
[3:10]
in his immediate area that you can see
[3:12]
where I wrote no, uh, they don't want
[3:14]
it. And I've told the applicant if it's
[3:16]
approved and when he goes to pull his
[3:18]
permit with the town, I'm going to
[3:20]
request that he keeps it all the way in
[3:21]
the back of the property and all the way
[3:23]
to the east as far as he can to the
[3:25]
existing building to keep it out of that
[3:28]
person's line of sight since they didn't
[3:29]
want it. I figured it's something we
[3:31]
could do. I told him we would let him
[3:33]
put it right up against the existing
[3:34]
building even though the setback
[3:35]
wouldn't be there and then I would not
[3:37]
approve his final inspection or his co
[3:39]
until he had relocated that building. So
[3:42]
then it was within the proper setback.
[3:44]
He had no problem with that. So I don't
[3:47]
want to spin it one way or the other
[3:48]
your guys's decision. Um those are just
[3:51]
some of the facts. Like I said the key
[3:53]
things are we tell them no. He's just
[3:55]
going to go build four or 4,000t
[3:57]
buildings. So, you're not going to get
[3:59]
away from the s that square footage.
[4:01]
He's allowed to do it. Um, it's just
[4:04]
going to cost him more money and not be
[4:06]
exactly what he wants. So, I'm kind of
[4:07]
like, well, do we want to do that to
[4:09]
him? Is there a reason? And then, uh,
[4:11]
like I said, with his neighbor signing
[4:13]
that that that for me, that went a long
[4:15]
ways. Uh, but it's not my decision. It's
[4:17]
your guys' decision. But that's some of
[4:19]
the things that Wade has with me. Do you
[4:21]
guys have any questions for me? Uh, do
[4:24]
we are they going to speak or do we
[4:26]
direct them to you or
[4:27]
>> you can hit me? If I don't know it, I'll
[4:28]
drag them up here. But,
[4:30]
>> uh, this is where I'm at. So, you've got
[4:32]
80% that are four by my calculations.
[4:35]
>> Uh,
[4:36]
>> 80% what? What do you say? I'm sorry.
[4:37]
>> Uh, you have 80% that are four.
[4:40]
>> Okay. Yeah. Yeah. Yeah. Okay. Yeah.
[4:41]
>> So, um, so I believe, you know, given
[4:44]
the majority that that makes a majority.
[4:46]
Um,
[4:47]
>> it is a conditional release. So, I
[4:50]
believe that if there's any change of
[4:51]
usage that it has to come back to us to
[4:54]
reapprove it.
[4:55]
>> Yep.
[4:56]
>> Uh the other thing I It's going to be
[4:58]
right at the entrance of Apple Valley.
[5:00]
Uh it's going to be one of the first
[5:01]
things you see as you're around the
[5:03]
corner right there. So, I would like to
[5:05]
see the colors be subdued and desert,
[5:08]
you know, something so they sort of
[5:09]
blend in. They don't stand out.
[5:10]
>> What do you have there now? It's an
[5:11]
older house. And I know he had told me
[5:13]
he plans on having the house match the
[5:16]
building once he get one project at a
[5:18]
time once the building's done. And he
[5:19]
has two I think two or three other
[5:20]
little buildings there that
[5:22]
>> he wants it to look nice. I mean he said
[5:24]
he told me he said those are nice. So I
[5:25]
>> put that kind of money.
[5:26]
>> That's exactly what he exactly.
[5:28]
>> Once in a while people pick out colors
[5:30]
around here sort of.
[5:31]
>> He said he wants to get rid of the one
[5:32]
building and the one building that
[5:34]
>> one building that was nice he wants to
[5:36]
keep that one but he wants to make
[5:37]
everything match and make it look nice.
[5:38]
Like you said, I mean, this is
[5:40]
>> going to be a million-dollar building
[5:41]
was my guess once he's setting down with
[5:43]
sprinklers and all that stuff. So, he
[5:45]
definitely wants to make it look nice,
[5:46]
and I agree with you.
[5:47]
>> Yeah. Okay. All right.
[5:49]
>> Anything else?
[5:49]
>> Any questions, Dan? Anything?
[5:52]
>> Okay. You guys have any questions about
[5:55]
>> No, I'm I'm with the mayor. When I first
[5:57]
seen it, I thought that's pretty huge,
[5:59]
but once you once I see all the
[6:00]
neighbors are good with it, my feeling
[6:02]
is if the neighbors are good with it, I
[6:05]
shouldn't have any issue with it. Um,
[6:08]
if you guys got any other questions or
[6:10]
comments, the applicants here, but I'm
[6:13]
good with it.
[6:17]
» All right, then I'll make a motion. Um,
[6:20]
I motion that we approve the conditional
[6:22]
use permit application for an accessory
[6:24]
building larger than the given square
[6:26]
footage at 1614 North Upper Valley
[6:29]
Drive, AV1334T1.
[6:33]
» Second.
[6:33]
>> Motion second. Let's take a vote. I
[6:36]
>> I motion carries. Far as item number
[6:39]
two, um Stuart Writing with the conflict
[6:43]
of interest will have to abstain. So we
[6:45]
don't have a full quorum. So I'll just
[6:47]
make a motion that we table the
[6:48]
application from Steuart Writing to
[6:50]
remodel and replace an existing
[6:51]
structure at 1456 North Mount Zion
[6:55]
Drive.
[6:55]
>> Second that.
[6:56]
>> Motion take a vote.
[6:57]
>> I I motion carries. On to the minutes of
[7:01]
April 8th, 2026. I looked at them. They
[7:03]
all look good. If you guys don't see any
[7:05]
issues, you can make a motion.
[7:09]
>> I make a motion that we approve the
[7:11]
draft minutes planning commission
[7:12]
hearing and meetings
[7:15]
4826.
[7:18]
» Second.
[7:19]
>> Motion second. Let's take a vote.
[7:20]
>> I.
[7:22]
>> Motion carries.
[7:24]
I'll make a motion we adjourn. Second.
[7:26]
>> Let's take a vote. I I
[7:29]
>> Meeting adjourned.
