[0:00] three meeting of the gardensville stormwater Utility Board to order
[0:04] [Music] please join me in a slip to our flag
[0:14] I pledge of the United States of America and to
[0:19] the Republic for which it stands one nation under God indivisible with
[0:24] liberty and justice for all thank you very much
[0:29] roll call from my right John Bear Camp gross
[0:35] minutes of the previous meeting um let's see John you were not here for
[0:39] the last meeting Michael was Michael's gone he's not here so can we approve
[0:43] these minutes there do we have to table them to the next meeting
[0:48] you can't approve them all it is is agreement that's an accurate
[0:50] representation of the meaning you'll necessarily if John's has to
[0:55] reviewed glass meeting [Music]
[1:01] soon so what
[1:04] you think we'll just table it we'll just table it to the next meeting
[1:25] [Music]
[1:30] alrighty first item of old business [Music]
[1:39] all right so this is plat 401-2022 the Hickory Trace subdivision a
[1:45] preliminary drainage review of a 36 lost subdivision located
[1:49] on Morgantown Road approximately a half mile north of Whiteland Road
[1:54] this was at the April meeting and was continued as there were some revisions
[2:00] that needed to happen this has been back through Tac
[2:04] commented on and reviewed by wessler at this point staff would recommend
[2:10] approval of the pulmonary drainage approval we do have Donna here with
[2:15] North Point I'm sure she could talk about the project okay sounds good
[2:26] thank you
[2:33] good afternoon Donna Smithers with the North Point engineering and we're
[2:38] representing uh Greg Allen's group for Hickory Trace subdivision
[2:43] um it's a 36 lot subdivision containing roughly 39 Acres
[2:49] on if you look at page three I just have an aerial just so you can see the
[2:53] location of the site majority of it is a cultivated field with the southern
[2:59] portion is a wooded area on site and what we are doing and if you look at the
[3:06] very last page just to show you we have our proposed
[3:10] subdivision what this exhibit shows you is we have two ponds on site one out by
[3:17] Morgantown Road and the other on the southwest corner of the project
[3:21] and it just shows our drainage areas to these ponds
[3:25] um the pond at along Morgantown connects to the pond at the southwest and then it
[3:31] Outlets into a swell or a low area at the southwest
[3:35] corner of the site and as Joe said we've been through our review addressed all
[3:41] comments and everything's in order actually in the process right now the
[3:45] final construction plans and final drainage and everything right
[3:50] now to get those filed but we meet the ordinance and we don't have any waivers
[3:56] or anything such that we're asking for so
[4:00] um I guess I can address any questions that you might have
[4:07] looks like wesler did a review for the town and everything was good there
[4:20] any questions
[4:28] so when it first went through tech review what was the hold up again Joe
[4:32] there was a signature Control Ordinance requirement for a stub Street
[4:36] to the West yes was it Incorporated initially and that's been Incorporated
[4:48] and it just doesn't show it in here then on this drawing
[4:52] um that is from the I have another map I can show you
[4:58] foreign
[5:13] not sure he wanted to do that he maybe had to do it so we were held until he
[5:18] made that decision so that was the reason for our continuance okay so yeah
[5:25] let me see all the blues all of our storms that were proposed and are
[5:29] sanitary and our coupons so
[5:39] alrighty yep thank you for that
[5:50] so we're looking for approval of the drainage design for this or
[5:57] preliminary drift okay so that's going to drain off to the
[6:01] West southwest corner right there lowest area
[6:06] on the site you know
[6:13] there's a swell that ditch that crosses the southwest corner of the property
[6:31] kind of looks like everything naturally drains that direction anyways the
[6:35] proportion of it does that's why the need for the pond out by Morgantown
[6:39] because it has a couple different watersheds on the site as you can see
[6:44] from that existing Watershed map so with the new proposed grading and such we're
[6:51] draining a portion of it again to the that
[6:54] detention area along Morgantown and then it connects and flows Southwest to the
[6:59] other pond
[7:05] unless you have any more questions I can make the motion
[7:08] nope go ahead I'm good I moved to approve the preliminary drainage design
[7:13] for Platt zero zero zero four zero one dash 2022 for the Hickory Trace
[7:20] subdivision I will second that so I got a motion in
[7:23] a second to approve plat zero zero zero four zero
[7:27] one-2022 for the Hickory Trace subdivision
[7:31] any further discussion don't think so seeing none those in favor say aye aye
[7:37] aye so that motion passes thank you you're welcome thank you very much
[7:49] um is there going to be a time for the public can input some I know I've been
[7:54] working with these guys because we're a point in time when we can discuss some
[7:57] of these things is it water related
[8:07] so I don't have an issue with that there um
[8:11] is it something short and brief there you just want to talk about it quick
[8:17] yeah I tell you what step up here well just take your name there in your
[8:22] address there and we'll I am John ogborn um I am at 4082 South Morgantown Road on
[8:28] the property to the uh north of this subdivision
[8:32] um my my background is engineering so I you know you can you have to bear with
[8:36] me but um the uh I have a subdivision out in Hendricks County so um so I have
[8:41] a little bit of experience in this stuff slightly so
[8:44] um so so the water flow going to the Southwest I know you said that that was
[8:49] naturally how it goes but when you typically when you do a a subdivision
[8:54] you're changing AG to to a residential type of thing it's not the same kind
[8:59] there's more water um it's different kinds of water it's uh
[9:02] you know that sort of thing so there's usually different stipulations on it so
[9:06] I I am concerned that and I'm just bringing this up now so that we can
[9:10] somebody can look at it okay um that that water flow going that way
[9:15] ends up it ends up across a couple fields that people may not like that
[9:21] um and um and then it ends up in a pond and then it goes over to persimmon woods
[9:25] and down another area so so that's just something to look at as we're going
[9:30] through this and then you know just going through all of the fundamentals of
[9:34] this I I don't want a lot of water coming I have a lot of water already
[9:38] coming across my ground from the natural way it is and when you start to put
[9:43] houses in concrete in here the coefficient of runoff becomes instead of
[9:46] instead of absorbing into the soil from 25 you know 75 going into to the soil it
[9:53] goes to zero percent going into the soil so that can increase it I could I
[9:58] calculated on a million gallons so of during a big kind of big rain so so that
[10:03] is a lot of water and so I don't want it you know flooding my my whole area so
[10:08] yeah so that's my concerns right now as we we start to walk through this that
[10:12] those get addressed and that all the elevations and the pipe flows and all
[10:16] the things that we're saying all make sense in that it cannot actually be done
[10:21] and like I said I'm an engineer I've Done big big projects and if you don't
[10:24] get it done to begin with it costs millions of dollars taxpayers will end
[10:27] up millions of dollars so um and we can't Burgers still can't afford that so
[10:32] yeah so so that's my input thank you all right no no thank you
[10:41] and then you're always welcome to review the drainage surveys and stuff there so
[10:46] I mean that's distribution lessons as soon as we get
[10:51] new filings for construction foreign
[11:02] and like I said these developments are supposed to capture and hold water on
[11:06] their sites all right so they're not allowed to shut it off to somebody else
[11:09] there you know what I'm saying so yep and we we do you know as we mentioned go
[11:14] through our diligence and have our engineering firms review these to make
[11:17] sure that they're in compliance with the ordinances and yeah so oh yeah yeah but
[11:21] no no thank you for your time
[11:29] thank you all right anything else for old business nothing else for old
[11:33] business all right moving on to new business
[11:36] uh new business is encroachment request
[11:43] nc3506-2023 at 82 North Sedona Drive this is
[11:49] a lot 20 and Highland Knoll section two it's right at the very North End kind of
[11:56] work so don't North Sedona Drive dead ends into the field
[11:59] they're asking to put a fence over the northern
[12:02] drainage and utility easement there's no uh infrastructure in that easement
[12:09] however there is a pretty substantial ditch in that 25 foot
[12:15] I mean you can kind of see on page page with our plot plan they've drawn
[12:21] out this one here yeah uh they're proposing to kind of bridge
[12:25] that Swale with the fence
[12:29] which would leave that open to flow staff doesn't necessarily have an issue
[12:34] with it but with the significance of that easement and the the Swale there
[12:40] we didn't feel real comfortable just administratively okaying that
[12:46] which side is the there's the significant as well
[12:55] [Music]
[13:00] and see it's not yeah
[13:06] so what's that bad eyes
[13:13] so Courthouse 57 normal soil 35. it's about two foot
[13:20] so they're just playing on their spanning that that's what they're
[13:23] holding yeah
[13:26] proposal is
[13:41] [Music]
[13:45] they've got a big gate though that looks like it's going yeah basically the Swale
[13:51] I mean oh
[13:55] I mean we when we make these approvals it's with the condition that if there's
[14:00] work that needs to be done when I bring them here I always make them do a
[14:03] recorded in courtroom agreement yes yeah that goes with the title yeah
[14:08] so I was going to ask you there's no there's no utilities right
[14:13] there yeah
[14:16] that was a big utilities and bring trans using the base click
[14:21] it's because they had to get that water through and to get your side grades
[14:26] enough to study wide yeah
[14:32] so we're doing close engagement behind the
[14:36] fence partially
[14:40] yeah they're they're spanning across the top of the ease
[14:46] and our recorded I don't think I put a copy the Trap one in this one I didn't
[14:52] we cross reference we cross reference to feed that is from a number
[14:58] uh so the encroachment agreement would turn up on
[15:02] a title search
[15:06] [Music] that kind of insurers future owners
[15:10] or at least somewhat aware of I know I see he's always bothering me
[15:15] there it's not the person that does it there it's the second or third person
[15:19] down the road that comes in and we have to go back in and do something
[15:22] and they go uh what that's the one always bothering remember
[15:27] remember that but legally it has to be disclosed right yeah yeah because
[15:31] because we we record it yeah cross-references there number for the
[15:35] plat and the uh first recorded Deed on on the lot so yeah
[15:41] to any kind of title search should turn that up and it should be
[15:45] disclosed
[15:54] so this is more for just collection purposes yeah it's a
[16:00] that is the high point of the whole subdivision up there so
[16:04] okay I mean I mean to be honest I feel like
[16:08] it's more at their risk than it is ours if they have an encroachment agreement
[16:12] so yeah yeah I think I think they're big it's going to be collecting uh
[16:19] to half off that field right
[16:25] all righty you good with it I'm good yeah as long as we got that encroachment
[16:29] agreement there we're fine um I
[16:34] [Applause] moved to approve
[16:39] um
[16:42] I guess the encroachment number enc-003506-2023
[16:48] um the request is presented all right well second that so I've got a
[16:52] motion and a second there to approve and encroachment enc-003506-2023
[17:02] any further discussion seeing none of those in favor say aye
[17:08] aye aye that motion passes all righty anything else for new
[17:13] business this is all for new business it's all for new business moving on
[17:17] discussion items not not a whole lot for the uh Project
[17:21] funding update um we've been working with Adam Stone in
[17:25] stone Municipal right now if with the West Street
[17:30] project a fully funded by stormwater we're about a half million dollar Gap
[17:36] from what stormwater has available and what that's going to require yeah so
[17:42] we're working through with Town Council on Dan
[17:44] and the engineers to uh figure out
[17:48] where that comes from because obviously it's not
[17:51] income from this board with the projects we have on the books
[17:55] already correct
[18:00] the pipe Culvert replacement at 300 North Roy got us through idem approval
[18:05] I'm good for you all right working on uh core approvals
[18:12] core approval yes we're uh we're ready to order the the pipe that's a 103 inch
[18:19] by 71 inch I was aluminized aluminized
[18:24] it was just 500 600 more for the aluminized pipe
[18:30] versus the standard galvanized so it's certainly worth the money for oh yeah an
[18:35] extra 25 to you know potentially 50 years on top of the 50-year Baseline so
[18:41] that's it's yeah yeah and we're gonna when that approval's ready we're going
[18:48] to get that from contact at 18 000. 234 dollars and 10 cents I think when we
[18:55] first brought this we we approved up to I think it was 60 000 for that pipe
[18:59] which this is significantly lower
[19:04] but we will have we'll have some additional uh County highway is going to
[19:08] perform the work and then invoice the town for uh
[19:13] material is beyond base materials so uh concrete rebar
[19:19] type stuff so we'll have one of this invoice when
[19:23] this comes in then we'll have one additional invoice in the county
[19:26] uh once that's complete okay it should still come in significantly under the
[19:31] sixty thousand dollars we estimated
[19:35] sounds good it works scheduled for July
[19:41] Luke told me he had it scheduled for probably late July Late July so that's
[19:46] assuming the approvals for the with the Army Corps well that's the kind of
[19:52] question I want to try to get to but some of the back and forth
[19:57] correspondents that I have not been able to ask that question if it's
[20:03] safe to do it prior to full approval or whatever so we would like to get it or
[20:09] just as soon as possible ask that question if it's
[20:13] safe to do it prior to full approval or whatever
[20:17] so we would like to get it or just as soon as possible
[20:24] she had syndicated that she has four
[20:30] reviews ahead of us that were in the queue but she's been actually working us
[20:34] in kind of in the first place so I'm
[20:39] hopeful that we'll see some positive that it has been a little bit of a
[20:44] struggle with just just correspondence yeah I don't really have to review that
[20:49] in 30 days um technically I found out that they
[20:54] have 60 days and let's
[20:59] a little bit
[21:03] on the forms that are submitted their idep forms and idem says after 30 days
[21:09] you have automatic approval well that's for my denim uh the core
[21:15] yeah so that was kind of a disconnect a little bit but yeah we don't anticipate
[21:22] any but real issues we're seeing you know having to answer some questions or
[21:28] asking some specifics about impacts and things like that but hopefully
[21:33] trying to get rid of the answers with it the three Master names the three masted
[21:38] Schooners won't be able to go through anymore but yeah
[21:45] the rgp process is supposed to be it's not the full-blown
[21:52] an individual Perma cover of things that were but generally is the guys of the
[21:59] there's already a mechanism in place and there's already these
[22:03] a small list of things that you have to comply with
[22:08] items or as long as you're in compliance so theoretically the review is about
[22:17] but in this case it's been stolen Communications
[22:23] I always immediate and maybe we're just too used to that but
[22:28] it's a federal government I understand so what was the lead time
[22:34] on our pipe there I haven't got that information yet again that we're also
[22:39] have communication with contact to get that okay
[22:43] we're working through it I don't I don't see any I'm confident in Roy's design
[22:49] well we'll also have it looks like our actual Paving schedule
[22:57] I don't know if Brian had mentioned that oh yeah but they've part of the schedule
[23:04] we've just got this past week they've actually pushed their start giving back
[23:09] out okay
[23:14] so it's I think that's this possibility okay
[23:21] so
[23:24] try not to become a nuisance to the core and I'll come off yes I you know try to
[23:31] be insist I guess you might squeaky wheel
[23:35] yeah
[23:39] we've seen I mean not on our side we've seen
[23:45] pretty decent lead times for custom you know like with your more standard
[23:50] pipe sizing it's not as bad but with more with something that's custom it's
[23:54] been a little bit longer so I've already put in the inquiry and
[23:58] we're um getting the process rolling yeah just
[24:02] waiting on this final
[24:06] Roya when did you submit that for the review
[24:10] we said it's certified on the 25th of hey
[24:18] so they've had it already over 30 days yeah
[24:23] okay there's nuances with that you know yeah yeah
[24:28] trying not to get it push to that 60 day if she's she's already working with us
[24:36] to you know move it forward even though she's
[24:40] not so I'm trying to you know balance that to say
[24:46] hopefully we'll get it less than 60 days yeah I don't see anything
[24:53] any large issues that
[24:58] that's all they are selling our ballpark right now the
[25:02] county is ready to come in help us get the work done
[25:06] probably in Late July okay
[25:13] we will be sounds good all righty get those Three
[25:18] Notch village Village um
[25:22] kind of in wrapping up the Grant application at this point to the end of
[25:27] the month we do have that easement issue still outstanding
[25:32] um I've knocked on doors over there for with just no luck
[25:37] nobody's answering the door for me maybe it's just scary
[25:43] I don't know um I haven't been able to get anybody
[25:46] home or anybody to answer the door Mike is going to go ahead and send those
[25:50] certified to hopefully get the signatures on them
[25:53] okay and get those to get that process rolling you just need to show up to the
[25:57] door holding an empty pizza box that's all I need maybe that's it
[26:01] this this spring just no empty pizza box man storm water board uh some crumble
[26:07] cookies yes that that crumble cookies will get
[26:12] Advanced for already I think there you go
[26:16] so that's that's where we're at on that uh
[26:19] uh a whole public hearing second public hearing on the 13th at Town Council
[26:25] there will also be a resolution the Town Council to pass at that meeting
[26:30] uh just all authorizing application for the grant
[26:42] but I think we've still used any letters of support from
[26:46] anyone to attach that
[26:50] okay especially residents if you know anybody
[26:53] out in Three Notch that would write a letter
[26:55] just saying hey we've had streets flooded and
[26:58] yards flooded
[27:08] yeah yeah we have we have two Town Council Members
[27:12] out there that's right yeah
[27:16] what happens if you don't get those uh we relocate the pipe yeah just moving
[27:22] over one a little bit over one lot to where the easement is yeah
[27:29] you just feel and abandon that section both the costs way up as we have to put
[27:34] in new curb inlets uh let's put a new curve inlets at that
[27:38] point um
[27:41] so we have new structures addition well new structures anyway but
[27:46] there's additional structures additional pipe length
[27:52] there that could be used yes originally
[27:59] foreign Place who knows who knows what they were
[28:05] smoking when they drew up those drawings that's right they put the pipe in the
[28:08] wrong place man the construction plane show it right
[28:13] where it's at it's not with an easement um
[28:18] that's why you have professional people reviewing your plans now and so make
[28:21] sure
[28:32] yep this is all the way through there
[28:41] okay
[28:46] all right moving on that that administrative items there
[28:51] [Music] I also first you just have our
[28:55] department uh interview information from April
[29:02] [Music] I think have the plans and suited
[29:05] Visions in our Construction another 13.
[29:10] new home permits in April
[29:24] a little bit slower but not significantly
[29:31] a lot of Builders are running a lots frankly oh at this point
[29:36] um there's a handful in in Morningside
[29:39] there's a handful of these open open up a new section that'll go up South
[29:44] um there's a handful of lots I think
[29:46] there's six Lots in I don't know
[29:50] yeah filling up the lot Supply they're ready to build lot Supply is running
[29:56] low that's I don't think it's lack of sales
[30:01] it's it's don't have the lots of ready to build on
[30:15] all right I know we haven't got much rain here lately
[30:20] I'm assuming the complaints are pretty slim I'm still in Pickens on the
[30:25] complaints there yeah that not uh well we did get a new one uh what we shoot a
[30:30] violation and fine at Aberdeen
[30:35] that uh 4053 piscotti Court had a concrete truck wash out in the in the
[30:41] storm drain no way in the storm drains in the storm drain
[30:50] so yeah I immediately wrote them a 250 fine and put a stock work order on the
[30:54] permit so they were quick to clean up the
[30:58] gutter and replace the filter basket yeah yeah yeah yeah yeah oh my goodness
[31:07] oh I think the question was who needs to
[31:11] pay that fine he said I don't care who pays the fine
[31:16] that tends to roll downhill too people
[31:22] the stuff work order isn't getting listed until it's paid so
[31:27] take it as you will yeah
[31:43] hopefully that wasn't Shelby concrete was it
[31:48] I don't know all right I just want to make sure I'm just gonna guess it's a
[31:53] possibility
[31:59] [Music]
[32:05] was it brand new right yeah that was in Aberdeen yeah
[32:08] [Music]
[32:14] Brandon pointer what Brandon pointer
[32:19] oh Brandon pointer Brandon pointer
[32:23] [Music] I think it's a greyhound house
[32:28] I think it's a Greg Allen house
[32:35] that's who a contact person is but I think it's a Greg Allen house
[32:47] I mean the concrete guys you know you can't dump it in this they all know that
[32:51] they all know that
[32:55] um foreign
[33:22] all right anything else there Joe is that it no that's uh the only actually
[33:28] the only new uh and entry on this one more complaint log
[33:34] and the one before that was March 31st so yeah
[33:41] that one uh over County issue we forwarded over to
[34:00] all right Treasures report
[34:08] Vanderbilts foreign Bells
[34:13] I don't see anything exorbitant here so unless you have any
[34:19] comments I can move to approve the monthly claims as presented all right
[34:24] well second that so we got a motion and a second to approve monthly claims as
[34:27] presented any further discussion
[34:32] seeing none of those in favor say aye aye aye that motion passes
[34:38] alrighty our next meeting June 26th [Music]
[34:46] make the motion to adjourn motion to journal second dance I got a motion
[34:50] second to adjourn those in favor say aye aye all right that motion of
[34:54] passes we are adjourned thank you everybody
