[3:21] AG
[3:30] I
[4:27] we
[4:50] com
[5:00] com
[5:42] number
[6:29] even my name is
[6:35] Kennedy my name is Kennedy my address is 9147 rwood Drive Louis
[6:43] 71220 to the counil coun woman um I'm a former B City
[6:52] employee and I would like to read um the um information that I just passed out to
[6:58] the mayor City City Attorney
[7:05] andity at the city council meeting I spoke during public comments about the
[7:10] American Rescue plan payments arpa to the city of as employees after
[7:16] the me after the meeting I request the documentation detailing the specifics of
[7:23] arpa payments to the city of bash employees during my presentation last
[7:27] month IED the cler as to the process of criteria for city employees to receive
[7:33] their arpa payments she told me the payments would be only made to employees
[7:39] who work between October 1st 2021 to December 31st 2021 and who remain
[7:45] employed until December 31st 2024 unless they retired and no resignations would
[7:50] be considered after a few days I emailed the city cler requesting the information
[7:56] and writing I asked her to create lloy their names titles and the amounts that
[8:01] they received I was supposed to receive the information within a 72 hour time
[8:06] frame as stated by the City attorney Jones during the January 2025 city
[8:09] council meeting that did not happen within a designated time however I
[8:15] finally receed the information a day or two later after receiving the paperwork
[8:19] I realized I needed some additional information to complete my
[8:22] research I the additional information included the employment dates and
[8:27] retirement dates for each IND on thepa list in responding to my second request
[8:33] I did receive that information within the 72 hour time frame now what did my
[8:38] research uncover there is a letter attached to
[8:42] this list of employees to the list of employees who receive payouts from Miss
[8:47] Laura Harts who is the CPA of party company I assume this is the accounting
[8:52] firm who hired who was hired by mayor Al the introduction of the letter States
[8:58] thank you for providing us with the request from city council
[9:01] regarding the remaining ARP funds with the city of B one request from a council
[9:06] person was to research arpa premium I did ask a few councilman had they made
[9:12] the request and they told me no they told me the mayor did all of this on her
[9:16] own this means that the that Miss har began the process without any discussion
[9:21] or approval from the bachor city council the city council controls the budget so
[9:26] how was the mayor able to disperse ,7
[9:31] 3467 without approval from the bachor city council the letter goes on to say
[9:37] the arpa final rules allow for retroactive payment of an hourly premium
[9:43] pay as long as the period payment is not for hours work prior to March 3rd 2021
[9:48] which is the effective day of thepa Miss Hart Miss Hart ends her
[9:54] letter by saying this letter is in no way intended to all the rules and
[10:00] regulations governing the American Rescue
[10:03] plan I thinktime people put disclaimers in therey to
[10:07] C the mayor represents the executive branch of government hence she does not
[10:12] control the legislative or judicial branches of government she is supposed
[10:16] to work with the councel not strong arm belief or deceive them I have reviewed
[10:22] this payout list and the list clearly reveals discriminatory practices with
[10:26] the payment why are for different people
[10:31] there are so many discrepancies for example Jim supervisor Terry Davis hired
[10:37] show H shows February 10 2022 he was paid
[10:42] $2,000 however police patrolman Elizabeth brixie whose hire date was May
[10:47] 31st 2022 only received $1,000 and she is considered an essential
[10:52] worker Cemetery supervisor Mark Alfa received $2,000 and he was hired March
[10:58] 18 198 but Mr Terry Davis had only been
[11:02] employed approximately 10 months and received the exact same
[11:05] amount I on the other hand started July 1st 2017 and resigned December 28 2022 I
[11:12] was shot what three days of the deadline but main his employee Kendrick Johnson
[11:17] who was hired on December 28 2022 and he was paid
[11:21] $2,000 which means he had only been employed for three days with the city of
[11:25] Bachelor security officer Ronica Johnson 12 21 2022 and she was paid $1,000 for
[11:33] being employed with the city Ambassador for 10 days police Sergeant cassand who
[11:38] was hired 1110 2022 was paid $22,000 for approximately 50 days of
[11:44] employment however I work for over five years and receive zero retroactive pay
[11:49] I'm also curious to know why communication officer Sandra Alexander
[11:53] who hired date shows May 5th 1999 retirement date shows December 1st
[12:00] only received $1,333 33 but judicial assistant Sheila
[12:05] and Hunley who hir Day show February 5th 1997 and retire Day show November 1st
[12:12] 2021 only received
[12:16] 66667 Pam Duncan administrative cour was hired February 27 2013 and retired
[12:23] November 1st 2021 also received the exact same $667 67 they both worked for
[12:30] at least eight months during the ARP dates and received less than some of the
[12:33] others I've named who worked for seven to 10 months and why would fire driver
[12:39] Jeremy defi who was hired 1119 2022 only receive
[12:44] $1,000 but the maintenance man Kendrick dson hired December 28 2022 and security
[12:49] person Monica Johnson hired December 21st 2022 received
[12:54] $2,000 or better yet how did communication a mar who H date was
[13:00] December 10th 2012 get paid $2,000 but communication officer Sandra
[13:05] Sandra Alexander who hir was May 5th 1999 and retired December 1st 2021 only
[13:11] got paid $1,333
[13:14] 33 I also noticed that Frederick Hatfield H shows
[13:19] 61422 and he received $1,000 but he worked for the city of bash for at least
[13:25] 15 years before resigning and returning in
[13:29] year but but if we're going by the mayor's plan that was
[13:34] recommended by Mrs Hart um wouldn't that disqualify him from being able to
[13:39] receive arpa funding because you you you wasn't
[13:42] supposed to resign am I correct okay so record
[13:48] clerk Yolanda Wilson hir date was May 3rd 2022 and she received $2,000 but Pam
[13:55] Duncan who was hired 227 2013 and retired 111 2 only receiv
[14:01] $667 67 Yolanda was hired to to fill Pam's
[14:06] place when she retired on top of all the Nam that I
[14:10] just listed the mayor paid four assistant Corners James Marsh Ryan Floyd
[14:17] Scott Floyd Rick penon ,000 each last time I checked Corners do not work for
[14:23] the city they work and are paid through the Parish police year so I would love
[14:27] to know the proc behind that one as well it must be a reason um you know and I'm
[14:33] just calling it out cu I just want to understand because I I truly thought cor
[14:36] was paid you know by the based on my research and Analysis
[14:41] mayor Olive has proven to be very vindictive and financially irresponsible
[14:47] the mayor has proven to be highly discriminatory as it relates to this
[14:51] payout as a result of the city council's fail to property research study and
[14:55] analyze this situation they are indirectly respons responsible for
[14:59] aiding and abetting the mayor in her fraudulent Financial practices against
[15:03] the city of B Louisiana therefore I have a few
[15:07] important recommendations for the bachor city council number one make a motion to
[15:11] immediately compensate employees who qualify for the arpa retal payment but
[15:16] did not receive funds because it was more than just
[15:19] me number two immediate reg sorry real slow number two
[15:29] resignation of Mayor Betty number three I request that criminal charges be filed
[15:35] against Betty ol for committee M Fe in office RS statu 14134 says m in office
[15:43] is committed with any public officer or Public Employee engaged in illegal
[15:47] wrongful or intentional H it can include theft misusing of public funds or making
[15:54] decisions that are not in the best Public's best interest and Mal office
[15:57] can be grounds from Office through a recall elction or by stat St statute
[16:03] thank you all for your time that be
[16:25] awesome EMP
[16:29] resarch I like make
[16:51] research research who eligible to be paid be
[16:58] El they fall under that term and we find we do a research and find any employee
[17:03] that comes under that terms and condition they should be
[17:16] paid I com last in last's meeting I did ask for a list of um not only the
[17:25] employees that received it but the employees that possibly were eligible
[17:29] so for the record I asked for that last month and I have not received that yet I
[17:34] asked who would make it even fall closer qualifications I want to see
[17:49] I first I
[17:55] to but I said in
[18:08] attorney got
[18:14] frame the the inial list and when I sent the email I C all
[18:20] the counsel and as I resp as I responded backney City attorney I made sure I was
[18:25] including you all so once I got the information
[18:29] first that included this's letter right I asked some coun seen
[19:23] recall asking his heart myself about the deadline date
[19:28] I had some feeling that has been done properly and I think what going to
[19:35] happen unless we come up with some type of a or some type of resolution to to
[19:41] amend the budget and do some rescue F make the necessary adjustment once we
[19:47] find out who's eligible you know because everything was done so quickly and last
[19:55] minut you know we doing last minut Contin
[20:02] I think once we we find out who anybody can file a claim say I'm for this
[20:10] because of this Fe submitted to the court office whoever need to be
[20:13] submitted to and then once that is done we uh look at what kind of money we
[20:20] look at where the money going come from that they
[20:24] requ also of
[20:29] ideas of what we would like to see like for myself for example it was a couple
[20:34] things maybe like U enhancing the parts but one of my um ideas
[20:39] was uh cost a living bonus we wasn't ready aware of
[20:46] the Prem until and that's exactly I said
[20:53] in you have we have to you all have to be willing to enforce
[21:14] I'm how much want to so as y see only
[21:21] show some people I so if I Nam your name don't take it personal I'm just showing
[21:26] you where Jim got paid was here 20 years and got
[21:33] paid th000 and and Joseph was here 10 months
[21:41] and
[21:46] mayely break
[21:51] law for the counil sake because again Council position we got
[21:59] on
[22:05] all the this that here today I can speak I
[22:11] think this was only given to us the last minute we I think it our eyesight and
[22:16] the mission tree came along and then we start researching looking into it we I
[22:21] said we this was not even put in the line item of the 24 25 budget something
[22:27] attached to got past that stage and like you say well I just want to speak for
[22:32] this Council I about think this Council sleeping we're not we're acting on as we
[22:36] receive it and I just want to put that on a record that this
[22:42] Council we we would only give the last moment and
[22:50] weary she told and don't and we we acted in the best interest and the best our
[22:56] ability and our knowled
[23:05] I think the of agre they have
[23:17] to I'm speaking from
[23:23] this situ situation we
[23:36] secure I did not personally go through any list and pick out any Nam pleas
[23:43] reflect that let's on we
[23:51] have is it
[23:56] my speaking on on theend but I'm
[24:05] speaking I'm
[24:53] good evening to everybody my name is Robin Simmons and I am the owner
[25:01] my husband and children it's at 918 Washington I'm not
[25:06] a native of Bast but my husband is so are my children but this is a home that
[25:12] I have called my home for 43 years we have been in bus 43 years at 918
[25:20] Washington Street can you not hear me
[25:28] I thought didn't need it but I'm here tonight to speak about the trash and the
[25:33] white in our community it's important to me I don't
[25:37] live in the city but I do own pretty much a city block at 918 North
[25:41] Washington and 10 other addresses that are around there and
[25:47] we what I gave y'all is a copy of the list of properties that was emailed to
[25:54] the code enforcement officer on February 19th
[25:58] Reform Act 2024 was passed by the city council I personally drove by every one
[26:04] of these addresses this afternoon one of them number N I could
[26:10] not find I don't know that that exists but I think address is wrong and then
[26:17] number has been down but the rest of them are the same or worse than what
[26:22] they were and I'm just in a year I feel like some of that should have been
[26:26] handled I don't but um I am concerned and about about
[26:34] our city and I'm very concerned about people that come our C next month on
[26:39] March we will have our annual bck contest and it comes thousands of people
[26:46] over a thousand will come from every corner to our city Breen in our
[26:52] restaurants they're staying in our hotels they're buying gas at our gas
[26:56] stations anding every Corridor of Bas and they're passing some
[27:03] very undesirable looking places to get to meet and it's embarrassing to me and
[27:11] it should be embarrassing to all of us we are proud of our city and I proud to
[27:15] be here but we need help and keep beautiful I'm not on that committee but
[27:22] I know some of the people that are and they are great individuals that
[27:28] for this city and they get paid and I don't know how they go about
[27:33] this but I know that they willing to help they're will to if there's somebody
[27:38] that's that AFF it that needs help their they're there to help and all they have
[27:45] to do is just ask them and and they made this list and they are tirelessly riding
[27:50] around trying to find properties and while I was looking there was a lot more
[27:54] properties and one thing that has nothing to do with properties next to B
[27:59] the road is torn up and it's just mud and I was told that's been there for
[28:03] almost a year the road is blocked and we're proud of our Rams and all these
[28:08] people come to our basketball games and our football games and our baseball
[28:11] games and they I mean that's a mess and they're coming down marable and there's
[28:17] a lot of mes on marable it's not a main drag but we just we just need to address
[28:23] that if y'all would to try to help clean organizations and there's businesses
[28:30] that'll to help um whatever they
[28:38] call know that they GRS that will help tear down some of these properties I'm
[28:44] probably speaking out of term but I think they could probably help elderly
[28:48] people get rid of those cars in their yard that they don't want and they are a
[28:53] tool that we need to use in the city and from a business person's
[29:00] perspective please let's clean up our city to make us proud because they're
[29:05] coming they're coming in droves to see s sptings and other places in this town
[29:11] and I want them to be PR I want to be proud
[29:37] with
[29:39] anticip it out work
[29:43] be out and before football
[29:49] started at same time samees fled
[30:07] I think call his name he was here his entire house flooded
[30:11] because what I let us table this because the urgency
[30:17] was this man losing all of his property because our drainage system was not
[30:23] working we tabled it at the time to take care of the drainage system so and the
[30:28] drainage still hadn't been taken care of on the other street that is why I said
[30:33] let's prioritize that's a big word for me
[30:37] priori flooding we need to fix the flooding and then we would go to fix
[30:42] that road just because we did not we all agreed to do that and I told it was my
[30:47] district and I did want to take care of the flooding first so was a priority
[30:53] thing not that I ever said don't fix it Pi it back
[30:59] off I asked the engineer he stated that it need to be
[31:05] done but it wasn't urgent to the shut down shut down so we were surprised when
[31:12] the shut down
[31:28] that mean going get back to it next
[31:34] weable proceess had to get so we
[31:41] had we had
[31:47] noed TR reason they got to look at it I think
[31:54] the price was way higher than what they anticipated
[31:58] so it's
[32:02] station it should never been bled off because was
[32:05] noer to saf and come from
[32:21] engine that should be open Mr
[32:28] who who ordered that road to be closed I guess that's what we need to establish
[32:32] because they've been going back and forward for the last three months the to
[32:37] me reason that cannot be
[32:42] reopen
[32:51] man on April 14 was
[32:58] Council vot mayor did not vot mayor only V break time and that
[33:06] not in as much asled was a problem with the road and I
[33:12] spoke with interest two there are two schools over
[33:16] there student commuters resents that live
[33:22] there employees that drive to those two schools every day
[33:27] a recomendation public go ahe um I'm El Mo P I'm the CEO
[33:36] morous General Hospital right here at B glad to be here today take this
[33:41] opportunity to talk about you know what we're trying to do as a community um we
[33:46] look at buildings that we have houses and you know we're a good partners so
[33:51] what we want to do is definitely partner inuring that we do take care of houses
[33:58] life and just try to work together as partnership I know that mayor and the
[34:03] council want to do what's right and us as a medal Community we just want to
[34:08] make sure that we do the same thing and get good part um I'm just happy to be
[34:13] here be honest with you I've been here about seven months and uh I this is a
[34:17] great place to live it's a great place to be and uh we would just want to
[34:21] provide excellent healthare and we want to make sure it's safe so we want to
[34:25] make sure it's safe in the daytime we want to
[34:28] so whatever we can do in Partnership we willing to do it and help out because we
[34:34] not definitely not here I'm not I'm lives of people that we serve and
[34:41] I'm a man of
[34:55] service ter
[35:07] nobody are ready toch clean F money that I did receive from
[35:17] representative Francis Thompson but right now we're in the stage of working
[35:24] on another that those strings are not as stringent
[35:30] as the others that have come before us so we welcome you to come to sign up in
[35:36] fact we were about to make an announcement but due to the weather we
[35:41] haven't been able to put our equipment out to
[35:47] start thank you very much for your welcome I am Mar Miller I was born in
[35:54] morehous General Hospital a long time ago let me say I'm a 1973 graduate of
[36:00] Bast High School 1973 so that tells you something but I'm just here to ask
[36:06] you to behold how good and how pleasant it could be if the city of vast was
[36:14] beautiful I think we would all agree that our city is in need of
[36:19] renewal Rejuvenation revitalization and
[36:24] beautification our city as a matter of City should be kept beautiful keeping B
[36:31] do you agree keeping B beautiful would help to
[36:37] solve mental health problems that exist in our community as well as the crime Mr
[36:45] Patterson just said that he was about keeping Bast safe that's important to
[36:50] him that's important to me as well keeping Bast beautiful is to act in a
[36:55] proactive man rather in a reactive manner to our problems given the right
[37:01] conditions the people here could Thrive and thank you for this
[37:08] opportunity let me just say to express my concerns regarding what I saw
[37:16] today today as I drove around town
[37:21] unfortunately I saw filth
[37:25] trash lter abandoned dilapidated houses and some of
[37:32] them might been adjudicated to the city of B I don't know and this evening I beg
[37:38] you to Hear My Cry feel my pain my Agony my
[37:46] suffering and my grief I'm hurting because I know that the current
[37:50] landscape is depressing I'm hurting because things do not get better on
[37:55] their own better when actions are taken to make
[38:03] them better and I'm hurting because what I of what I see and because of what I
[38:08] don't see I'm hurting because we have potential but it's being wasted and
[38:14] misused we all need Mustard Seed Faith do do we have Mustard Seed
[38:22] Faith must that's all we need must receive Faith with faith this this city
[38:28] right here could become one of the best cities in the South now in the let me
[38:34] correct that in the United States of America one of the best cities in the US
[38:39] America USA and recently there have been catastrophic disasters from the east
[38:47] coast to the West Coast sadly families have been displaced consider selling the
[38:54] adjudicated properties to them
[38:58] okay I just want you to know I care so much about this I care because I was
[39:02] born here and I will probably die here but for now I want to live here and live
[39:10] here with a good quality of life I want all of the residents to have a good
[39:15] quality of life I need all of the residents to feel beautiful live
[39:19] beautifully think beautifully and to act beautifully after all what goes around
[39:25] comes around behold how good and how pleasant it could be if this city of
[39:32] Bast was beautiful in closing be reminded of the words of the musical
[39:38] philosophers Earth Wind and Fire they said and I quote where there is no
[39:44] Beauty you have to do what make some beauty Lord have mercy
[39:50] in um I just have a comment right to Miss Miller and Miss Simons I have three
[39:56] prophecies on and and they're listed that we should enter into a Cooperative
[40:02] Endeavor agreement pre so we plan we going to see a little action great I'm
[40:07] glad you have that must receive Faith fa faith that the city of Bas can become
[40:11] listed among the top 10 cities in the United States of America let's reach for
[40:17] the top after all where there is a will there is a
[40:29] we have some guest some
[40:33] students student government
[40:57] facy members any of the facy
[41:03] MERS
[41:15] announ come to the microphone please state your name
[41:31] even my name isart I'm here at uh with my student
[41:37] council members we just really wanted to come and see how our local government
[41:42] works uh we're at with Delta Elementary School and um we're just excited to be
[41:48] here and to see how everything is working together for the better of their
[41:55] good thank you
[42:14] Henry 746
[42:18] District um I Rose to um I basically had one comment but I'm going to pick I'm
[42:24] going start backing off the said they talking about black uh there
[42:31] is a thing that's called keep more house beautiful but I don't think a lot of
[42:36] citizens understand exactly what uh keep more house beautiful me and what that
[42:41] project is uh from my understanding and talking to people I think there are a
[42:46] lot of people that think we're just talking about up here inside up here
[42:51] around Courthouse down the main Avenues and things of that nature
[42:57] where we have a lot of businesses but keeping more house beautiful ought to be
[43:02] about should be about and needs to be about the entire community of
[43:08] Bast going outside into those side streets those streets as one way in and
[43:14] one way out where you have a dead end and where you have a lot of dumping over
[43:19] on Ma feet I think it was the the area was cleaned up maybe one or one or two
[43:25] times before pass through there now it's become a big Dumping Ground what do we
[43:31] do for places like that uh that keeps coming around you know every six months
[43:39] and it needs cleaning up do we install cam is that a place maybe we can install
[43:43] some cameras can we possibly look at uh heightening the uh fine level increasing
[43:49] the fine level uh for lers because that's just as important as any road
[43:55] downtown I'm minimize anything but it needs to be
[44:01] made clear to the public to every citizen and master that keeping more
[44:07] house beautiful is about South Washington East Madison West Madison Van
[44:16] Avenue uh nutam Avenue all the streets with in the uh confines of the city of
[44:23] the city and I think if we if we do there we can do uh to uh maybe put the
[44:31] word out about that because a lot of people don't get interested in things in
[44:36] in programs like that because they think we're only talking about a specific area
[44:41] and again every street every road every Avenue everything here in Bast needs
[44:48] needs attention and I think that's where a lot of our a lot of our uh a lot of
[44:53] our attention has gotten away from those as opposed to our downtown so again I
[45:00] want to make sure that everybody understands that keeping more
[45:05] house beautiful is more than just about keeping more house beautiful because B
[45:10] is the is the uh is is the seat of morous Paris Bast is the seat of morous
[45:16] Paris so we need the entire city of Bast to be beautiful for more house uh to be
[45:23] beautiful again thank you yes sir
[45:32] my name is I
[45:37] live9 Louisana and I'm
[45:41] a of I was
[45:46] born October 7 1951 at General Hospital I one of the first ladies to be
[45:55] going my com reference to what has been spoken to about black and so for I work
[46:01] for six years for the city Ambassador as C offic ior with the fire chief and we
[46:09] removed about 60 houses that were there was a group of people who got
[46:18] an injunction to stop
[46:27] as experiment for train burn
[46:34] of I personally know is not funding to bring houses down a lot of people think
[46:41] the city has money they don't but the other thing that I came
[46:47] comment about I've been following Council
[46:51] meetings and I've heard the ma mention several times
[46:58] to do different things but I never heard one counil person say that they worked
[47:04] on anything to
[47:11] get not anybody and one of the things it appears the council has
[47:19] delegated their responsibility to the if each one of you work to try to
[47:26] get uh grants of help even within the
[47:31] community try to get churches and organizations to network together to
[47:37] clean up some of this stuff we would have a better option but all I hear is f
[47:42] and blame I'm a lifelong citizen I've never
[47:47] want to live anywhere else with that but it's apparent that we have more
[47:55] interest
[48:02] [Applause]
[48:12] improve the summer we had a municipality conference and there was a session H
[48:24] in were session H at the municipality conference in swport Louisiana where
[48:31] this city or any other municipality in the city of B will fill out application
[48:36] up to $2 million to take care elated houses clean up community and also what
[48:43] it Calla or something Happ we could apply for but there was no action taken
[48:48] on it and uh I just want to share that with the this C I'm up to defend this
[48:52] Council but we're doing the best we can I'm defend our marriage well don't get
[48:55] me okay but when you come up and say what
[48:59] the body do that you try to separate too much of that but we what the mayor tell
[49:05] us we try to do the best we can cuz she she's she's the chief
[49:10] executive now if she don't tell us we don't
[49:13] know and one other thing um we have been told every almost every meeting the is
[49:19] over day operations and if I was a wrer you better believe i'
[49:24] beting I am not a I'm a nurse by profession I try to work with the
[49:30] community but you supposed to use the expertise that you have to help this
[49:33] city go forward I not a
[49:42] iason when you talking about grant writing when this Council knew about a
[49:46] grant it's already written and we never get to M we just said that was a grant
[49:50] such and such a program p e p I never heard of but that's a gr for see other
[49:57] words we got to be more we got to be more transparent one of the
[50:01] other Administration need to be more transparent with
[50:05] this La of transparency is probably the biggest problem we have in our
[50:10] community here say with the
[50:20] c items on the agenda lisw provides
[50:26] has the opportunity to address this board prior to our taking action on an
[50:32] agenda item at today's meeting members of the public will be given an
[50:37] opportunity to speak on any item before a vote is taken you will be afforded
[50:43] five minutes to make your comments and the entire public comment period will be
[50:48] limited to 30 minutes unless an extension is granted this is not a
[50:53] question and answer session where you can ask questions and demand answers of
[50:59] the board members mayor or the city employees we have
[51:18] now I respect everybody's op but when you know the functionality
[51:24] of the city government misleading state that Mr Le just made very misleading and
[51:31] I'm very disturbed by that because I get up every day to do the best I can I
[51:35] challenge you now you talk about grants who wrote the grants or was it offered
[51:43] to the city of Bast but that falls under day-to-day operations what I want to
[51:47] know is show me how many grants that this man have since the public got this
[51:53] misconception that the grant writing is done by this
[51:57] Mar I I I I I beg to differ with you because I kind of know I worked I know
[52:04] how I work and that was a Mis statement and when it comes to the reputation of
[52:09] the city council I stand on what we have been doing because we've been trying to
[52:14] make progress with this city trying to work with the mayor and we have met with
[52:20] the mayor before we come into this me and then when we get in here things
[52:24] change I don't want to change back to the grant saying that the May is the
[52:30] only one look for grants that is that is that is that is not
[52:35] true not true in no sense and if the Amica could provide us with how many
[52:40] Grant she written in three or four years versus the grant that was given to the
[52:45] city of bastor and then I may be able to take a little bit of responsibility for
[52:50] not applying all of ourselves but don't come to this Council me and try to act
[52:55] like f because if you know what goes on behind closed doors if you come to a
[52:59] finance me and then I'll be able to explain to you what we're really talking
[53:03] about because we try to keep the piece up here in some decoral but if you
[53:09] really really know the real fight what the real fight was about you would be
[53:14] amazed and you would be astounded because you all it's it's it's two sides
[53:18] to the story three sides it's my side Administration side then that's a Truth
[53:24] side so the TR is in the beholder in the telling you need to get
[53:30] remove the person whether it's myself the mayor councilman green remove it and
[53:36] look for facts and I and I I I I really really
[53:41] I'm disappointed in that statement because that's a divisionary tactic we
[53:46] here to work together not to compete against each other we here to uplift the
[53:50] city of B not to divide because when you divide A House Divided a sure fall
[53:58] you also that
[54:03] must I'm out here clean up every time the you know anything myt I'm here
[54:09] cleaning up so I I know that's misle
[54:16] St I just feel like it was staged I'm just being honest
[54:40] am and I as many GRS as possible and in
[54:49] and and million and they have been and certain parts of the gr has to be by
[55:00] certain people narrative then it goes on technical assistance so I say that to
[55:07] not have my character or my professional background attacked go
[55:20] ah ask
[55:26] have you informed the counil
[55:34] ofar okay my name is I've been volunteer with since
[55:40] about7 when Cindy me and I told her no and I don't know what I any I want to
[55:47] make C you providing GRS for demol
[56:04] he worked for the city and public works and he worked very hard but he made a
[56:09] suggestion to kmb and to others as well that possibly we could start partnering
[56:18] with property owners and approaching them about they part of the demolition
[56:23] cost and we part of the demol contract signed by property owner as
[56:31] well asul that theer
[56:35] is C amount of time whe and it's it'll be clean
[56:43] of money to be provided we would pay the money directly to theer own we don't get
[56:50] invol who now another stipulation
[56:57] he can tell you about it it's a simple process we have the contract drawn up
[57:02] between the property owner andm we agree to payer owner % of the
[57:09] demolition cost get and we give it directly to the
[57:13] property own once the building the structure is brought down the property
[57:19] is clean according to my inspection and it's done in a man we've been 201 the
[57:27] first one we brought down was the ew Smith house at the intersection of West
[57:32] Madison and
[57:38] time
[57:41] now but anyway of Y remember a white and
[57:53] need and rest history we brought down about 27
[57:59] structures and trying to bring down moreci
[58:05] railroad Hospital have all been very generous and kind us and gr us the money
[58:11] to do
[58:26] [Music]
[58:49] pH I said your phone
[58:56] we would even partner with the city another thing the
[59:01] city we' approached several owners that have turned
[59:06] us now the city would them and them they to
[59:15] do and I know I know you offer that service to the people Mar
[59:50] we are currently working on GR
[59:56] is about to
[1:00:00] come and the window of
[1:00:05] opport a lot
[1:00:09] of lot ofs
[1:00:14] support
[1:00:18] supp it's not just a matter of spitting out of gr and think it's going to to
[1:00:24] happen but I want you to talk we going close this out about what our plan
[1:00:31] is starting distri all the areas a c and d every year we do the love
[1:00:39] Louisiana and we picked up 13 tons of and we need everybody we need to support
[1:00:45] the city and I said this over and over again cannot do it along there are laws
[1:00:51] in place and Mr attorney Jes can speak to that but go
[1:00:57] ahead and talk about what our upcoming plan is and Grant that we are
[1:01:08] presently presently it's under under 397 Francis Thompson instrumental get us AED
[1:01:18] Grant we Reed half funds we expense about $8,000 I think at this
[1:01:27] the plan was to use City equipment and city employees
[1:01:34] during it was originally set out to do during the the summer time during our
[1:01:40] summertime hours to use some of the money to pay over time to clean those
[1:01:45] adic pieces of prop that we identifi it has to be
[1:01:53] onit at the time we didn't pass in the budget so we at time now
[1:02:00] we're at strength of the weather we're going to try Implement that try to
[1:02:08] work we don't have the to te down houses what we're on doing was trying to clean
[1:02:13] the Lots or the get the trash up and cut the underbrush bush using City equ and
[1:02:22] was I have a question
[1:02:34] but we don't have we don't have the money to be able to to dispose of it and
[1:02:39] if if it hasard materials
[1:02:45] is as and stuff like that it has toet the
[1:02:50] CR all have
[1:02:56] we have
[1:03:05] EnV
[1:03:13] original5
[1:03:18] question the resue American Rescue plan I see here clean
[1:03:26] for return to the tax Ro we all some $200,000 that money being
[1:03:34] used approved you go back and get your
[1:03:49] american, but you got 200,000 for 25,000 but you have 200,000 in your budget
[1:03:55] have been approved 24 25
[1:03:59] budget
[1:04:06] y' the budget was aded October that was he say was part of budget so we after
[1:04:14] once it adoped we didn't come back forward to to amend the budget to remove
[1:04:19] it so once the budget was adopted so was that
[1:04:24] $200,000
[1:04:37] $200,000,000 reason I
[1:04:41] Wasing down because I was
[1:04:48] thinking of some of $55,000 I can pay over time for the city workers to down
[1:04:56] City theity
[1:05:02] so all of to to employes
[1:05:15] to at time so it's but I you said the on about that we can't those but I'm not
[1:05:24] talking about those talking can be T down and we can utilize the
[1:05:28] city equipment and now what we can do also to save money you guys budget each
[1:05:34] coun in their District can notify inform you which property need to
[1:05:38] be down and we can pay the over time to the city workers I was told it only take
[1:05:43] like a day maybe two days to down C especially if you have one to two give
[1:05:49] three employ they take three days to tear down so so I'm looking at
[1:05:55] off I'm just get I can say $500 a day for each employee $1,500 so I can say 20
[1:06:02] 20 grand I probably in myri those we still have to
[1:06:10] for
[1:06:31] the only way that we can dispose right now is we hire a what they call a roll
[1:06:37] back through one of the trash services and we have we have a track we can tear
[1:06:45] it down with a track but it's still still has to be to a lamp
[1:07:02] we have a burn curtain located atfield but we can only
[1:07:08] burn trees and that type of debris we
[1:07:14] burn you have to speak toq about burn like things that come from a
[1:07:21] house shingles and
[1:07:28] yeah it was there when I
[1:07:43] got we still have
[1:07:49] bur yes perod correct
[1:08:11] other words that we have to pay again pay over but we just have to pay for The
[1:08:16] Dumping somewhere we have
[1:08:19] to how would you
[1:08:25] on the Tage I'm right now I'm spending uh give me the high low right now I'm
[1:08:31] spending almost $3,000 a month to empty the two dumpsters that we have on the
[1:08:35] yard we just pick up trash on the street so you say so it's yeah it's
[1:08:42] usually calculated by the T they take it in they weigh it and then they you know
[1:08:48] and then they build us
[1:08:50] according I get like able toze that we was giv
[1:08:57] outp roughly
[1:09:09] 4500
[1:09:19] for be
[1:09:42] there is no
[1:09:48] administra a private contractor we have a private contractor likeing
[1:09:55] ARP funding that would given to each district now that have nothing to do
[1:10:00] with the city being in any type of violation we go out have a independent
[1:10:05] contractor to do it and pay it out our our rescue money americ
[1:10:20] miney as long as it
[1:10:26] out anyil
[1:10:30] anything I think be the way to now my
[1:10:37] district money I'm I'm looking into a private
[1:10:43] contractor to car on those du elor houses in the community because they
[1:10:49] they don't have to they're responsible for dumping she whatever consist on that
[1:10:53] property they are City they they'll have to stay within compliance with the DQ
[1:10:59] and all those people now with that said with that
[1:11:04] said with the ARP money those private contractors can do
[1:11:09] things we can't do as city
[1:11:13] government I think I think it be more feasible for us to contract out a
[1:11:19] private contractor and let them take their responsibility and if we can
[1:11:24] receive
[1:11:27] a invoice whatever you may want to call it
[1:11:31] with a private contractor for a particular piece of property that have
[1:11:35] been judic by the p and I think I SP Mr joh we got to look into some legal
[1:11:41] aspect of the ownership but they want to sign out like this car say if the owner
[1:11:45] agreed to it fine you know we can move forward okay and then if the owner don't
[1:11:51] agree to it I think we be able to move forward under our law
[1:11:58] the city of B because it's a heal and a to our community we can no longer let
[1:12:04] the owners will not take care of their responsibility to tell us how we going
[1:12:09] conduct our city and we already have an A since
[1:12:13] 1953 and we need to take action and with the 50 under doll that I have in my
[1:12:21] district I'm going to take action I need to ask Council maybe you I mean
[1:12:28] the attorney maybe you
[1:12:39] I agement once we take out a contract with a private contractor tell me the
[1:12:45] procedure let's say I have a a invoice or B those $5,000 we don't have to do
[1:12:51] let's have to have an invoice for have an invoice for less than
[1:12:58] $5,000 what's the procedures from there I I know you said you have to check with
[1:13:03] the owner and like I asked that question because the city have property too that
[1:13:07] we need to get rid we don't in our house we can't
[1:13:25] have AER
[1:13:31] thatu homeed
[1:14:02] well legisla
[1:14:08] sitations they would like
[1:14:21] bsed transf to contra to so
[1:14:30] that talking properties Mr Lock is talking about adjudicated properties are
[1:14:36] not in our name they're not our properties they're still the owner
[1:14:40] properties in order forer is to be to the city of you have to pass have it Ser
[1:14:48] all people and Days Run fromes
[1:14:55] to City of it's just simp we have ownership
[1:15:01] interest not aess we just have a stake in the money
[1:15:06] they can actually get let's say a property's been adjudicated which you of
[1:15:11] see they to sell it we never actually title put our name we just transfer our
[1:15:15] ability to do it to private so a property says adjudicated
[1:15:21] to the parish or to the city you can still redeem title ised through thatle
[1:15:28] process theer to the
[1:15:33] citynot no because you're not the
[1:15:38] only the only thing that's adjudicated is
[1:15:48] not no it doesn't what's the differ in process somebody purchase
[1:15:55] what they do Pur and
[1:16:04] why right toity right toell it but it doesn't us
[1:16:08] we don't have we just have we hav interest we Haven officially giv notice
[1:16:14] to those owners for the law which reques us to pass saying yes we're taking
[1:16:20] what's so what's the point of the what's the point of the
[1:16:23] consult property because they're selling our right to have that property if you
[1:16:28] take on the property by title you take theability of that
[1:16:40] so only adjudicates taxes adjudication notf title
[1:16:48] adjudication gives you the right to you can take title from by fil you have pass
[1:16:55] and that has to be served on the owners days from there that's adjudication is
[1:17:01] just tax it's not it's you have the right to do it but it doesn't mean that
[1:17:07] it transfers title you have the right to get title transfer you but you have to
[1:17:19] ex so some of the houses inct be down
[1:17:40] inad Mr Jake please see the houses in my district that can be down our can be
[1:17:46] tore down by the city and let us
[1:17:52] knowed list
[1:18:01] did
[1:18:17] you personated once we get once we because
[1:18:22] we really don't get a title because judic they property we don't have that
[1:18:27] property until you get the title what we have is we have the right to get the
[1:18:31] title we never
[1:18:45] go we have have pass
[1:18:50] for pass
[1:19:13] own yes yes I can and that's what so when they call these on these properties
[1:19:17] or thing they ask me what the title is I go run the title on it's adjudicated and
[1:19:22] the notice is in the law specifically in 47
[1:19:34] 22 having a right andise you have the right to Silent not a lot of
[1:19:41] people a right gives you the ability to exercise something we have the right
[1:19:47] once the taxes becomes adjudicated taxes so what's the purpose we don't own
[1:19:53] what's the purpose of clean well
[1:19:58] because
[1:20:09] obviously own property we can goer clean up well you can go you can go on that
[1:20:15] property and clean it up if you s out the
[1:20:19] no so we can do the same
[1:20:38] understand yes there
[1:20:48] a can take any action necessary they that they declare
[1:20:54] a n a half I don't care if adjudicated notated a
[1:21:01] half so to the community we have a lot of that so to the community the city of
[1:21:07] B can go in clean up we just can't take title of the proper that understand that
[1:21:16] right yes you are reading that right however the general laws in the state of
[1:21:22] Louisiana involve what is consed code
[1:21:26] enforc and further deol destroy the your Charter BS to the general laws of the
[1:21:34] state now specific laws likeon act your Charter Trump but your Charter bows to
[1:21:39] the general laws of State the general laws of the state requ a procedure and a
[1:21:45] process that we have Adan to reflect the laws but yes the charter does say that
[1:21:51] provision that is correct however that provision
[1:21:58] [Music] St to one of the sites here down next to
[1:22:05] the bank post office andity want to say hey this is a dang to
[1:22:13] side have to this community send them a notice to that I think we had and if
[1:22:19] they do not act then we have the right to go in and do it our
[1:22:25] corre you have you have it underne your ordinances that the
[1:22:28] state we can do that and it's one of theard of having a 1956 Charter state
[1:22:34] laws that are every year okay do we need to I'll try to what do we waiting on to
[1:22:41] do that I guess I mean we got we got
[1:22:47] $200,000 alligated for clean up and to do this stuff beautify I think everybody
[1:22:55] want to see on the P we
[1:23:00] oury business and come here why can't we move forward we got
[1:23:07] $200,000 I mean we can use private contractors or we can use our city
[1:23:13] workers I mean but once we send these notices out to these Property Owners we
[1:23:18] cannot continue to let them turn their noes up to this community as we go down
[1:23:27] Ander
[1:23:30] department and I
[1:23:40] willion contct anybody coun that was to expedite you
[1:23:47] have bring
[1:24:05] saying that with your rescue money you get
[1:24:10] somebody clean up your District
[1:24:18] MRI you goad and private contractor stop
[1:24:24] go ahead and a private contractor to remove of these
[1:24:30] build
[1:24:51] theion probably need to be revised the ex have
[1:24:59] govern
[1:25:10] soed to St
[1:25:17] are I need to ask we take this out of we have our
[1:25:25] man
[1:26:03] comp well what what is preventing the city from actually
[1:26:21] implen that's what I'm trying to we we we spent this time to pass the
[1:26:28] laws to enact the laws now it's time for us to enforce the laws which comes out
[1:26:33] to dayto operation like you said you continuously
[1:26:38] let the people THB theirse up at us they not do anything we can Environ I'm
[1:26:44] talking about enforcement we can get those people envir and
[1:26:49] find correct the issue I will say this the issue with Environmental
[1:26:55] don't
[1:26:59] it's so a judge but they refuse to come so we
[1:27:05] going to Contin to pay a judge $1,000 a month for no activity that's why there's
[1:27:13] that is a first off the second thing is that's why there
[1:27:19] because to get people to participate you generally speaking
[1:27:25] you would take of the properties and tax people realiz bills are
[1:27:34] going so people are a lot ofer people
[1:27:43] away people
[1:27:54] they can come to the environmental Bo explain to the judge what's going on
[1:27:57] what's Happening that person say okay we're going to work with you but you got
[1:28:00] to show us some progress so that requires voluntary participation but
[1:28:05] historically in the year and a leading up to our change just was very low
[1:28:11] participation environmental so the concept was get them to see that we were
[1:28:15] doing things where we didn't give Environ the people who were here would
[1:28:20] say oh I'm going to go I'd rather have more time than days
[1:28:26] what I'm getting at people get the misconception that you
[1:28:30] fight we trying to come up with Solutions because we have enacted the
[1:28:34] laws and we've been stagnated nothing has been done it's not blame gang the
[1:28:40] end game is to get results we and there's no results then there's no
[1:28:45] results so are we supposed to just keep sitting here and just playing like
[1:28:52] something is getting done it's not getting that's where ask you the
[1:28:55] question we pay a judge we got environmental officer code
[1:29:01] enforcement there has not been any citations written not to my
[1:29:08] knowledge of private owners I'm not talking about adjudicated property so
[1:29:13] what I'm saying is we looking for solution we looking for to fix the
[1:29:17] problem we got the laws enacted on the book now we got to find a way to
[1:29:22] complete the cycle you laws why not go enforce the laws that's when you I ask
[1:29:28] you which way to which is the best way to go well my point is you say
[1:29:33] environmental Court takes a little long well what about the other why isn't the
[1:29:38] other Avenue being pursue what is the problem I'm just just asking you
[1:29:45] attorney what is the problem you say this way is long so if I'm I'm going
[1:29:51] back to what I originally it's a twep thing if one way
[1:29:55] is not going to work you have the other way well well ain't no way
[1:29:59] work all I do is all I
[1:30:05] do I just want I just want people to understand that there's no we we're not
[1:30:10] impeding progress we actually passed the laws so the laws can get done we've done
[1:30:16] our part we not want we don't want to blame because we are Community we just
[1:30:20] want some results and we just you know ask questions
[1:30:25] fight if you never ask questions you never going to get
[1:30:28] results so I just want to know which is the best way to get it done if you have
[1:30:34] a if you have a property I would tell you from a legal standpoint if you have
[1:30:38] a property own
[1:30:47] responsive workan oner you have owner who is respons more time
[1:30:55] envir judge each that's
[1:31:01] two going right now I got one question because we talk about waste of
[1:31:06] spending you spending about three in in three years you spent about
[1:31:11] $330,000 between C enforcement the secretary and the judge that's three
[1:31:17] years fig so you spending that type of money
[1:31:24] with no results when I when I say no results I mean no results I'm talking
[1:31:28] about no fines I can't find a fine if you if I'm wrong please tell me what I'm
[1:31:33] wrong has it been a fine in the last three years yes I started
[1:31:47] in three years have it have this been a fine given in the last three years there
[1:31:52] was one given in EnV
[1:32:03] can just just together and come with Sol problems not try
[1:32:19] to I I just had a comment
[1:32:25] and we took time to pass these laws but the bottom line no citations being
[1:32:31] nothing you don't take step one you going get to step two you will never
[1:32:36] have an active environmental court if no citations are ever written so we just
[1:32:42] sit around like Mr said wasting money wasting money in our community is
[1:32:49] horrible I talked to somebody and excuse was given to me they want to know why
[1:32:55] tickets hadn't been citations hadn't been written they said they called talk
[1:33:00] to somebody the reason that was given to them was something about a City Garage I
[1:33:05] said sir you have to be kidding you must have misunderstood nobody I don't
[1:33:10] believe told you that because what a City Garage have to do writing cations
[1:33:16] and somebody going Court sound like a bunch of
[1:33:21] excuses that's all we get and I get tired of getting blamed for
[1:33:26] things that I have no control over I ask for a list of how many
[1:33:32] citations were written nothing I have nothing so we do we trying to do our job
[1:33:40] we're trying but again we do not control
[1:33:43] day-to-day operations okay
[1:33:55] I'm ask take agenda out of and allow
[1:34:31] AG May
[1:35:14] thank you mayor and Council M we're just talking about the
[1:35:18] resolutions for Louisiana Department of Environmental Quality
[1:35:25] per A and A is for the main and B is for the West the super treatment facilities
[1:35:32] for the city they uh is to get the permit and
[1:35:38] keep it going as we always we do the on
[1:35:45] repss emergency reps needed by monly cleaning of lines and sections of the
[1:35:51] collection system certain facilities and sub Basin
[1:35:56] uh continue operation maintenance and upep and Rehabilitation of pump
[1:36:01] stations reping m whatever needed station at West Pond
[1:36:11] facilities and maintenance and stuff and upkeep of like D Foods pre- treatment
[1:36:17] we're putting in newers as we speak we had purchased in
[1:36:24] or some bers were used at the
[1:36:32] time it's time and are
[1:36:37] inefficient continue work with the engineers on rehabilitating the main
[1:36:43] PL talking with the mayor Engineers about
[1:36:48] getting rehab years old
[1:36:54] time for it to be upgr and rep we will continue to streamline eon
[1:37:03] eon economize operations of plant equipment meaning that we'll make
[1:37:08] efficient what we can while we can until it has be rep ints doing regular
[1:37:15] maintenance on it keeping it up to dat so it has less we've got pretty good at
[1:37:21] everything going because maintenance program to keep track we do
[1:37:26] it prev instead of reactiv and we continue to train
[1:37:31] Personnel AC cross train them to work Collections and treatment right now
[1:37:35] since I've been in there uh we have more State licensed employees than we've had
[1:37:41] in a long time and we have two new hires that we're training them to get them
[1:37:45] certified with the state also and implementation process control
[1:37:52] procedures at the facility that's Main West it's all one you have
[1:37:58] two separate facilities for permits because you have two separate outs which
[1:38:03] means two different places have to retreat it get it back it's not K any
[1:38:07] wild
[1:38:11] rele twoes
[1:38:32] system
[1:38:36] LS L2
[1:39:20] yes
[1:39:24] not
[1:39:59] Environ main requirs for water discharge system
[1:40:07] L S9
[1:40:39] so much mayor and council members my name's Debbie rers pres of
[1:40:44] planning and Z commission uh this meeting we had three
[1:40:49] different special use requests first special use permit was at 705 C
[1:40:57] Lane that was a um request to put in solar panels at the new location that
[1:41:06] was torn down uh it's Sunbeam solar LLC um they would be the same as the
[1:41:16] ones at 350 Jefferson which is behind the old
[1:41:25] behind the data center over at the Old Mill it's supposed to take three years
[1:41:29] to complete the project and um they would supposedly after they
[1:41:38] finish they're supposed to have 10 full employees so we
[1:41:48] approve with this one yes ma'am
[1:41:53] uh you said you per yes
[1:42:01] sir he
[1:42:05] gave
[1:42:09] noard contact when ISS a special perm uh you are you referring to the city
[1:42:16] council yes no sir why was I was go
[1:42:23] I'm just asking
[1:42:26] question it's fine I don't mind a question at all sir in our
[1:42:34] um book we have things that are allowable by right and then we have
[1:42:41] things that are allowable where the um commission can make can issue a special
[1:42:47] use permit now there are things that have to be approved by the city council
[1:42:53] there's some that we can just issue the special use permit and this was one of
[1:42:58] them according to the Chart that's in the book okay I I want to see the book
[1:43:02] because I was in C enforement to yes sir and I think if you going give a special
[1:43:06] permit to bring a company to B I think it should come before the council I mean
[1:43:13] because we don't know what's coming into our city it's just like an unelected
[1:43:18] board determining what's coming to the city of
[1:43:21] B we we have no we have no knowledge of a
[1:43:27] solar pan don't get meong I want the to come in but when you have to switch and
[1:43:33] give a special permit then that should be I think a city council's job whether
[1:43:38] I'm on the council or not I think when you start dealing with the charter and
[1:43:42] you moving stuff around to fit a company I think you need to I think it would be
[1:43:48] more appropriate for that to be brought before the city council
[1:43:55] so the purp of the
[1:44:00] orig it's not that they wouldn't have passed it's just that for that
[1:44:06] particular um that particular Zone in the city it's
[1:44:14] it's for mixed use and so that's the reason we had to issue the special
[1:44:19] permit instead of it just being approved out
[1:44:24] so would approved right no it couldn't have been approved by the uh code
[1:44:30] enforcement officer himself there are some things that he can approve that we
[1:44:35] don't have to issue a special use permit for so it couldn't have been approved by
[1:44:40] him just out it had to have the agreement of so another question
[1:44:46] both projects what what do they pay on behalf
[1:44:51] of the city what
[1:44:54] uh added taxes uh right now the uh the property is being assessed as open land
[1:45:04] no improvements once the solar panels are being built it's reassessed then as
[1:45:11] improved property therefore the city gains more tax money than they would
[1:45:16] have if it's just open and
[1:45:20] no let Mr you remember that board you and I was talking about remember the
[1:45:26] board that I said you talked about told take it back
[1:45:31] out because put it back in yeah Bo that is in the cfor hold I'm just saying you
[1:45:38] remember what I'm kind what I'm talking about what I'm saying is you added
[1:45:41] another board that's what I'm going here these are unelected people that's making
[1:45:47] changes before when it like what she said you
[1:45:51] can't do it out understand I was infor when you see it when the Dot's there you
[1:45:56] can do it but when you have to make some special accommodations I don't think
[1:46:01] unelected board should be making those type of decisions for the city of B
[1:46:07] because we have constituents and I got to get with my constituent and see would
[1:46:11] they even want toone it for that or would they want to make an exception so
[1:46:17] now I got to go tell them about this this solar panel deal over a good thing
[1:46:23] but would you feel kind of bad if um you got clients and they asking you and you
[1:46:28] got constituents or whatever in your district and they asking you about a job
[1:46:31] and you have no knowledge of it so that's when I asked you before you
[1:46:36] remember I keep Haring on what you bring us everything that you prove and
[1:46:42] disapprove therefore the counselor know what's coming into the city of B Because
[1:46:46] if you just bring us something that you disapprove we would have never knew what
[1:46:50] you approve would like for you to bring us
[1:46:55] everything you know it's just a copy you know what you approve and disapprove so
[1:46:58] we'll have some kind of knowledge of what's businesses that's coming to Bast
[1:47:03] because if I would have looked and seen that thing and I know about code
[1:47:06] enforcement I would say hey you know what that problem need to come before
[1:47:09] the city
[1:47:15] council I think I have your phone number but anyway I can get I can copy the
[1:47:21] pages I
[1:47:24] can and would you like me to do that I got
[1:47:30] I'm well aware of how it goes I'm saying about I'm talking about the business
[1:47:34] that you approve yes sir and disapprove because I asked you I've been the first
[1:47:39] about two months I was on the counil I've been asking about I've been asking
[1:47:43] about I've been asking about the approve and disapprove I've been asking but I've
[1:47:47] never received one from I've just been just kind of patiently Wai well now
[1:47:52] agenda that we have on the meeting that we meet at that if if something is
[1:48:01] disapproved that's on this agenda I could tell you about it now
[1:48:09] if if there's something that goes to the code enforcement
[1:48:15] officer and it's not approved just because it's black and white in our
[1:48:23] Zone ordinance that this is in a certain area and it cannot be approved we don't
[1:48:30] see that okay well I got a better solution
[1:48:35] there whatever you approve or disapprove it's pretty simple would you please
[1:48:38] provide when you come do your mon report provide a
[1:48:42] copy and it goes for code enforcement also when you approve application for
[1:48:48] somebody with a business just provide us with a cop
[1:48:52] I'll go by I'll tell you what I'll do before the next meeting I'll just go by
[1:48:57] the code enforcement officer office and the ones that we don't see I'll get
[1:49:08] of yes sir because I have concern about what
[1:49:15] bring citiz
[1:49:24] we have one that right here to East city hall right here they got we nobody going
[1:49:34] they were I think before any I don't know
[1:49:40] where you this project I'm fam with this this company
[1:49:45] create 10 jobs and kill all 30 35 3500 citizens right coming right into
[1:49:52] community and we got a great deal concerned of that I think that should
[1:49:57] need to be Ted until this Council get the full
[1:50:00] detail we should we have Commit commit like ear
[1:50:08] they can't bring in IND City especially inside the city limit who going affect
[1:50:14] the citizens of this city now I don't think that here got P up and rning
[1:50:23] uh but before we go into the international site the new site with uh
[1:50:27] the country out of Texas I think out of Texas if I yes sir they Tas I spoke with
[1:50:33] them already uh Dallas Texas Tas I spoke them already because I got so many
[1:50:38] causing concern about why coming inside the city well the citiz 95% African
[1:50:46] amans I think before you go any further if you have approve you might disapprove
[1:50:53] the board people out there protesting because there are some great concern of
[1:50:58] the citizen in this community about P that stuff coming over their head C it
[1:51:05] may be I think it need to be T we can get more detail and can ensure the
[1:51:10] citizen that it's going to be safe you know we just we got interational a part
[1:51:16] for 100 years okay they finally thank God God pray good on one hand
[1:51:23] okay we don't want to create the same thing within this city limit where our
[1:51:26] children have to go to school and and and grow and and and
[1:51:31] produce solar panels can be dangerous I I think we probably the only city that I
[1:51:36] know I travel quite a bit around the country that ever seen a solar panel
[1:51:41] with inside C limit I see them all out Ria I see them
[1:51:46] in Cross I see going each Direction outside the city limit down the within
[1:51:51] the city that's that's a a help to this community
[1:51:56] and I think that need to be table or you going to have people out demon and going
[1:52:02] make it wor what it is we can get to the fact before we go and them approval to
[1:52:06] come inside our city to create 10 job and kill all 3500 people now I will say
[1:52:12] one thing sure after our uh meeting the I'm not sure if it's a code enforcement
[1:52:20] of his secretary I don't know who sends out the letter
[1:52:25] but at any rate from that office there's a letter sent out telling the people if
[1:52:30] they're approved or they're denied the only problem I see and I I'm I'm willing
[1:52:36] to do whatever y'all want me to do but they may have already sent these people
[1:52:41] a letter saying that they're approved so I don't know if there's any kind of
[1:52:45] legal action against the city if we now say oh
[1:52:50] wait you're not approved now I guess attorney J if they have a question we
[1:52:55] got attorney we can deal with that but I hope attorney whoever they are Tak a
[1:53:00] citizen of this community under consideration okay because you're
[1:53:05] talking about my grandchildren children I probably W live another 10 15 years my
[1:53:10] grandchilden will yes sir and their children going be with this I just don't
[1:53:16] think it's appropriate to bring that inside the city limit unless we Ure
[1:53:23] by DQ whoever agency environment who can ensure the city this not going to be a
[1:53:29] half 10 jobs not going to hurt us one way or another and for land whoever own
[1:53:35] the land going pay the taxes right whoever but my understanding
[1:53:41] they buy they they have a purchase option to purchase this land from Total
[1:53:46] one they haven't been sign seal delivery yet they making payments they makeit on
[1:53:52] know and then they make F the obligation but right now to one is the tax well
[1:53:59] taxpayer because I say this toal one sold it to
[1:54:05] them for $700,000 I may be wrong and they turn around sold it back to toal
[1:54:11] one for $600,000 that g place we cannot afford
[1:54:16] to play games in the B I'll find out and I know that by
[1:54:20] research I'll find and
[1:54:30] I'll let try to stop that and hold that a better dat we get some yes sir not you
[1:54:36] you just trying to project somebody proba push it don't push
[1:54:41] my thank you um our next special use permit was uh location at 305 North
[1:54:49] Washington Avenue that is right beside aon's
[1:54:55] Furniture um it's a building if you're facing eron's Furniture it's a little
[1:55:00] building to the right that's kind of connected on uh gentleman wanted to open
[1:55:05] a car lot and sell cars there and that was
[1:55:10] approved uh if you're facing erand furniture on North
[1:55:17] Washington there's a little building to the right of that long
[1:55:37] Place who's going up by the old church of chicken Church Chicken where City
[1:55:42] Garage is yes sir is another garage uh that's that was
[1:55:48] going to be uh this is that's on the this that I was going to tell you okay
[1:55:54] that is in the cor of our city you get all
[1:56:00] right okay uh the next special use permit was 1510 Elm Street sweet D
[1:56:09] that's in the um I think it's called Robinson Williams it used to be uh the
[1:56:15] school on Elm Street uh there's a lady uh her name is
[1:56:21] Miss haw and she wanted to be approved to put an
[1:56:25] adult dayare in there U she's talked to the owners of the building uh they're
[1:56:33] okay with it uh it would be from 7:30 to 3:30
[1:56:38] every day the person would pay $40 per day she's providing transportation that
[1:56:45] will take them to and from their home they'll have food provided
[1:56:52] uh breakfast and lunch will be provided there um they'll only have 35 people at
[1:57:00] the most and they'll have activities for the people during the day music
[1:57:07] Bingo exercises different things for senior people to go to rather than just
[1:57:14] having to sit at the house and have nothing to do or maybe their family
[1:57:19] works and they until they
[1:57:25] get do you you may not know answer will it be CS
[1:57:35] sleep I don't know M Mo I don't know about that
[1:57:42] because it's not going to be anything that's going to be
[1:57:49] overnight so I can't tell us and I guess I didn't think about
[1:57:55] asking her because it got off you know they left at 3:30 so I'm sorry I don't
[1:58:01] know the answer
[1:58:05] that yes kind
[1:58:13] of the name of it is Hawkins adult daycare
[1:58:19] healthare uh they'll have a
[1:58:29] they'll a nurse practitioner on call in case someone gets hurt or has heart
[1:58:35] attack or whatever uh and they'll have
[1:58:40] a CNA there on the site in case they need
[1:58:46] some kind of little
[1:58:49] special Medical adice
[1:59:00] she's already got all of her yeah she's already got all of
[1:59:07] her certificates and everything that she needs from the state yes she already had
[1:59:13] that
[1:59:23] okay our next uh and those were the special use permits going to the items
[1:59:29] that were approved by right drama queens dance company that's at 651 East Madison
[1:59:36] Avenue and that's just a dance studio they go in and teach the children
[1:59:41] dancing brotherto brother Automotive 1503 South Washington they're just
[1:59:47] changing owners that is the automotive center that's on the
[1:59:53] corner of South Washington and colling road right there on the corner it's not
[1:59:58] changing the type of business just the owners uh the next item that was
[2:00:05] approved was zavon Z Mitchell signature Services
[2:00:12] 2107 Cooper Lake Road now that's his address and that's where he's housing
[2:00:18] his business however people won't be going to his
[2:00:23] and it's called a crowning service if someone passes away they go and they
[2:00:31] have a crown like a physical crown that they put uh at the cemetery on the
[2:00:38] casket and then they offer music as well and so you just call the person and
[2:00:44] tell them what you want to do and then he goes out so nobody will be at his
[2:00:49] home the next item was St service 302 West
[2:00:55] Madison they're moving from Van Frank and that's the one mren that was at the
[2:01:07] city theity we got problem
[2:01:14] already trying
[2:01:19] to I think when you deal especially dist we
[2:01:25] got Ty
[2:01:30] that's city council
[2:01:40] back I don't know how long it's been in business starting off on the wrong
[2:01:47] foot because you to through there I thought it's a city I know the
[2:01:53] city move many bad cars we don't got them many bad cars it's Clos it's right
[2:01:58] at our Gage kind of tied to our it look like it's a city problem like belongs to
[2:02:05] the city but it belongs to a private person
[2:02:09] well I mean have already given the permit it's already been approved they
[2:02:15] already op
[2:02:22] who's the owner of it
[2:02:27] um Steve's mobile mechanic service and let me see if I can see the gentleman's
[2:02:33] uh the the gentleman's individual name is not own here so I'm
[2:02:38] Sorry appr by back there what I'm saying I want to
[2:02:43] know the owner because we we got to make sure that the owner know that this got
[2:02:47] to be a it's got to be the area got to be
[2:02:50] clean is not a junkyard we we approve it for what what does it approve for uh a
[2:02:57] mobile mechanic Mobile Mechanic means you go
[2:03:01] out well he's going to work on the cars there at that shop that's not a mo I
[2:03:07] mean that's a specific fure he's got on there these a mobile mechanic mobile
[2:03:12] means you go out to place so that's a deception if you going
[2:03:18] to have Mobile Mechanic on there you got to go out turning that into a car shop
[2:03:24] up town but you the application says Mo just like in big cities when you call
[2:03:30] the mobile M come to your house just like I call mobile he come to my house I
[2:03:34] don't take my car to him that's where needs the mile because
[2:03:38] he drive and fix your car wherever it
[2:03:42] is so I I think we since you approve I think Council need to really we need to
[2:03:49] reconsider that code enforcement go by there if he's
[2:03:54] going have bu up there make sure it's going be AI influence on
[2:04:01] not because you just St yourself as a mobile so it's on the false pretense if
[2:04:08] you got the license saying you're mobile but you actually having people bring the
[2:04:13] vehicles to you leight
[2:04:24] okay next one is I'm sorry I can't pronounce this name it's a Spanish name
[2:04:30] but it's a food
[2:04:34] truck I would mess it up if I tried but it's a a food truck uh it's a Mexican
[2:04:41] food and um they'll be located in the city wherever the business gives them
[2:04:47] the right to be they have to get approval from the business for instance
[2:05:03] next one is Morehouse Community Medical Center 501 durum
[2:05:08] Street uh you know they built the new building where the old movie theater was
[2:05:14] well they're opening their old building so they'll be located in both
[2:05:19] locations
[2:05:23] the next item was k and t jiy ta 647 East Madison and that's just a person
[2:05:32] who's going to be open just to do income taxes during income
[2:05:42] tax and
[2:05:45] that's yes sir
[2:06:03] particular from committee
[2:06:46] City counil
[2:06:53] we need to let our people know what's coming into the city especially thata
[2:06:59] that
[2:07:23] I think that I made a suggestion earlier so we won't have this problem it's going
[2:07:28] be a special perm to come of network with the counil
[2:07:33] before approve it now we got a problem because y'all already
[2:07:37] approved now it's going to be hard to go tell somebody that spent
[2:07:41] money that you got to stop you know we probably didn't if we
[2:07:46] would P our people they probably told us right off the turn down already been
[2:07:53] approved I think I'm going let the attorney on this situation but what do
[2:07:58] you think
[2:08:21] was that have
[2:08:59] that's one of those I was talking about that you I'm going go back and find it I
[2:09:04] promise you I'm going find
[2:09:10] it type of stuff the type of thing that I fear was going to
[2:09:19] happen have
[2:09:24] of so it's 33429
[2:10:13] so the and
[2:10:17] zonings z
[2:10:35] have
[2:10:51] me that when they go to the board of appeals it don't come to the city
[2:10:56] council did you did you just say it go to the board don't come to the city
[2:11:01] council so y have aard of they
[2:11:15] have because there there's two ways it goes your board of appeals Acts
[2:11:24] of off
[2:11:51] it for us to make I mean motion to
[2:11:58] R for counil to
[2:12:04] V I guess I question before I get that the day this
[2:12:11] particular what day would this approve
[2:12:22] was I think it was
[2:12:28] just our meeting was the 27th January the 27th it's normally the third Monday
[2:12:35] of each month but we WEP it the 27th because of Martin Luther
[2:12:43] King so January 27 what day did the approval
[2:12:51] you for approv that you that it came before the 27 January do you have a c
[2:12:57] letter Sun saying they have been approved I don't Mr Bradford because uh
[2:13:03] the committee doesn't send that out it's the office of the code enfor
[2:13:14] off you sor
[2:13:40] I don't have I'm I answer I looked at when I looked at it it says you got the
[2:13:47] right to appeal it goes to the city council always had the say so
[2:13:55] when I was in and I read the book pretty thoroughly andless something to change
[2:14:00] because I'm I'm perplexed why would a city council go back to an unelected
[2:14:05] board for some
[2:14:10] approve speaking ziss
[2:14:17] have cityil
[2:14:24] that what what I was saying I mean because I
[2:14:31] in my district I don't really have a problem but I don't want this to set a
[2:14:34] precedent where a board have final when we elected
[2:14:39] officials represent our district so when you have a
[2:14:44] of because that's why they put it in there you have the option to do it you
[2:14:48] don't have to option
[2:14:58] I'll be contacting you so you can work on something because I don't think
[2:15:03] nobody in the city of B would go for unelected person dicta what comes to the
[2:15:09] city of B and based on my analysis and I worked up there with Mr MC we studied
[2:15:14] this PRD and we have been through this with
[2:15:24] Mr we came up his deal so I'm glad we having this discussion something good
[2:15:31] comes out every day now going to force us to research the law because I don't
[2:15:35] think that un elected board should have never what comes into the city of now I
[2:15:43] think it's a good idea Mr just one vote just one vote if it comes to the council
[2:15:48] if voted because I want haven't did a study like you say he did a
[2:15:52] comprehensive study it's not I'm not saying I'm part against it I'm just
[2:15:57] talking about the process we don't want to short C the process because think
[2:16:02] about what you just said because if if somebody turned down it was in Reverse
[2:16:07] if you turn somebody down then they go to the board of appeals and they turn
[2:16:11] them down that's that's not fin well the process
[2:16:17] there we not this year in the past we have denied
[2:16:23] someone uh they appealed it they go to the board of adjustments the board of
[2:16:28] adjustments denied it their next set of their their next uh appeal is to the
[2:16:36] city council so if the board of adjustments
[2:16:40] denies it then the city council sees it but if we approve something like that
[2:16:46] which it states in our code book that we to approve that according to what was
[2:16:53] adopted when the code was
[2:16:58] adopted all Heavy industrial all light industrial all research and development
[2:17:04] it's in here that the
[2:17:09] uh the Planning and Zoning commission has the right to approve those by
[2:17:15] special permit now there are some things in certain areas
[2:17:21] uh and our book says that the city council has to approve that however
[2:17:25] these solar panels was not one of them according to our code that's written now
[2:17:31] and that's why it never went to the city council because it was approved and ACC
[2:17:37] what say there are
[2:17:44] cust that no it's not
[2:17:50] been different since I have done it just so it wouldn't be the same person that
[2:17:55] denied it one time and denied at a second I believe the delay on that is
[2:18:01] generally days the problem we here it's never you
[2:18:06] really never going to run into this problem because most of the time when
[2:18:10] they approve something it's for good cause I mean the problem you disapprove
[2:18:14] something I'm just trying to get some understanding for when it's a
[2:18:18] controversy when they approve counil really don't want it in well so
[2:18:25] that where that runs to is all your counil all
[2:18:39] oftion who approve who you who you don't there are certain things that are
[2:18:45] planning own they make final decisions
[2:18:53] have
[2:20:14] and also allow you to put people there who weren't elected but had more
[2:20:19] specialized knowled
[2:20:30] is is the Sol company aware of process including time for
[2:20:39] possible
[2:20:43] doubt I don't think so Mr Green because they wouldn't have need of kn
[2:21:16] I know where you're going but I'm going to show you when we changed over
[2:21:21] that's when we got to P close attention that's what I was going to bring to the
[2:21:24] counil I left my paper on but we when we revised the code enforcement deal
[2:21:31] remember I was tell you councilman attorney Jones that we I kept asking you
[2:21:35] are we just dealing with code enforcement that's the only section of
[2:21:38] the code well trust or verifi I really believe that until I start looking for
[2:21:44] something I started looking for that boy and then I found something very very
[2:21:49] curious enfor so I got photo copies of how the
[2:21:53] laws work versus when they changed them Mr Lock a very very good point when you
[2:22:01] changed it it says before that the city council appointed the board but
[2:22:08] mysteriously when you rewrote the law this is what it states
[2:22:16] now4 the May no I got it on I got it on my phone
[2:22:22] right here Ian I got the code enforcement photo copy of my book if you
[2:22:26] want the I give you the I'm not looking for I'm looking for what's in the book
[2:22:31] if you want to say what happened
[2:22:38] in17
[2:22:44] May you kind know what I'm talking about there's
[2:22:51] the books
[2:23:40] okay this one before prior to we Chang I got the date on this is what it say what
[2:23:46] what SE it say section 162
[2:23:51] and it says this in the book it says Planning
[2:23:57] Commission Planning Commission shall be she also serve
[2:24:01] zoning commission and is jump around and it's establish it will be consist it
[2:24:07] will consist of seven members and they will be appointed by the city
[2:24:12] council period well you should pull that ordinance from 20 I'm not you I'm
[2:24:18] talking about what's in the Z Mr McDuff can you go get your Zone plan zoning
[2:24:23] book The zoning book's not the law the law is the ordinance on the
[2:24:27] books I'm saying is you had to change it because it's in the book it's it's in
[2:24:33] the blue book so I'm looking at in the Blue Book you can't tell me what I don't
[2:24:37] see in the book it's in the book but then all of a sudden we change the law
[2:24:41] it says the may show me in the Code Enforcement Act where we change
[2:24:45] that I didn't write this up I didn't do that that's I'm going to so this come
[2:24:52] from this is this is the code enforcement book hold up I'm tell but
[2:24:56] this is the code enforcement we got the Corum we just
[2:25:00] having a lively debate we not I'm just showing what I got I didn't do that I
[2:25:04] didn't say you did that I say it's in the code enforc book A book
[2:25:13] line so you want to pull 04417 so you mean tell me it was a Mis
[2:25:18] they miscalculate this going about all this
[2:25:32] time Z operting
[2:25:37] not never seen Mr just that counil
[2:25:46] appointed may I add somethinge when we get like if someone passes away
[2:25:53] or they decide they don't want to do it anymore um the mayor recommends a person
[2:26:00] uh for instance the last person that was recommended was Miss Angela Glatt she
[2:26:05] works
[2:26:08] at Bush State Farm and she was the last one that was recomended and what happens
[2:26:15] the mayor uh recommends this person and theity
[2:26:21] voted on her for a final
[2:26:25] approval the mayor recomend now when it first started that was different but now
[2:26:31] the mayor recommends the person and then they're brought before the city council
[2:26:35] and Miss gladney was the last that was approved by the
[2:26:43] counil to pull all thean but one that is today
[2:27:13] May February 12th 2004 so actually it's 11
[2:27:20] how did it change from the mayor to the city council I don't know if that's a
[2:27:25] printing err it's not ating
[2:27:38] erera uh I've been since 2010
[2:28:01] feary now there have been amendments that have been made and we've added them
[2:28:07] into our packets in a book yes sir so it seems to me the books
[2:28:29] she was on the city council the mayor was a May back then they've been
[2:28:35] operating as the council but all of a sudden mysteriously appears the mayor
[2:28:41] when I look through here I see the book I'm looking at my photo copies then I go
[2:28:46] to the computer and I see the book then I see we made changes all of a sudden
[2:28:51] it's it omitted the city council and put the word Mayor in
[2:28:56] there all I know de
[2:29:05] mersh what made you go back to 2004 and see that it's on I mean I mean but what
[2:29:12] what triggered you to go and look okay so when you pass ordinances and they go
[2:29:17] on COD that we just said we specific I was
[2:29:22] looking at the composition the board of adjusts so I was trying to see where the
[2:29:26] members were to see if you had your board of adjustment so I went to your
[2:29:31] ordinances online and like any law they put down at the bottom the
[2:29:37] instrument
[2:29:44] didn't so what we need to do to put in place so we can change we just discre or
[2:29:50] why that book says that versus why the the official recorder of the law says
[2:29:55] different you
[2:30:08] get
[2:30:12] off let a suggestion and I be glad to do whatever
[2:30:18] you I'll look this code up and try to print it out I'm not sure how long it is
[2:30:25] but I'll try to print it out I'll compare it with the book see what the
[2:30:30] discrepancies are and then I can get with attorney Jones and maybe we can go
[2:30:35] from there
[2:30:50] I'm trying to deal with the this wasent out by Mr Mike Duffy and I need to
[2:30:57] know okay you say January pass january7 Sir
[2:31:05] Mr I'm Sor Mr repli that he letter out
[2:31:21] I'm got Mr
[2:31:27] Mr do you have a copy of that letter that you sent to Sun LLC the reason I
[2:31:34] asked because I want to know I want to cop of I want to know if we
[2:31:40] in that we can appeal you know we still procedure I heard say 10 days 11 days I
[2:31:48] what Sun Belt LLC and we still in our appeal
[2:31:53] procedure then we have a right to appe it's a now if we outside our appeal
[2:31:59] procedure we still have a right to because attorney tell you that as delay
[2:32:05] appeal you got
[2:32:08] deadin after
[2:32:13] deis I want to see what the DAT of the letter what
[2:32:20] the decision is the decision date is what controls okay okay just what
[2:32:26] was
[2:32:30] anybody was thee was sent out LLC I need to know the DAT was sent
[2:32:38] to if we still in our frame if he sent it out two weeks afterwards or something
[2:32:44] or if he if he did it in a Tim man excuse me if he did it in a Tim we have
[2:32:50] to request what you call a delay appeal you can always appeal anything but you
[2:32:55] call it attorney the day
[2:33:00] appeal we got to stop Community I can you
[2:33:10] myve right here right I could offer something to
[2:33:14] you about Sol stuff dealt with this you need to pass a
[2:33:22] solar solar we had to this that would mandate what the requ
[2:33:29] like so you're not going through theal process that that
[2:33:35] way because I've heard this before already the problem is that we don't
[2:33:41] have a zoning ordinance onul solars and what they have to look
[2:33:47] like the knows look
[2:34:03] you
[2:34:05] canate it to zonings counil and de we never thought
[2:34:15] not in my day time anybody would approve a Sol
[2:34:20] they must don't know anything about Z need to be educated as well okay and the
[2:34:26] compan taking advantage of this I guess guess
[2:34:33] question guess
[2:34:43] question you got find out
[2:34:51] possible yeah I can get on it as soon as we get soon as we get out of here and
[2:34:56] clearly doing it through here right now to try and figure out the delays go from
[2:35:01] the day after decision and also in the me we upd to reflect what the book for C
[2:35:08] counsel yeah we'll get together and see what the I've never seen a blue book I
[2:35:13] didn't know they going around with the blue book book I I look I look at the
[2:35:17] actual book which is one off
[2:35:22] not by having City counc us our input going forward yeah we can move with that
[2:35:28] we can move with solar F to look atan toate like that so we can have
[2:35:35] unifor you just something you go by book not something I got this out of the code
[2:35:43] enforement this ain't I didn't find this on the internet anywhere remember I was
[2:35:47] in told come from the book that's right down there and the book that's encoded
[2:35:53] for so our to resolve a problem so it's not like that we arguing or fussing a
[2:36:01] mute point the code enforcement officer sitting right there it's pretty simple
[2:36:05] walk you get the book flip it over and you will see it that book's not your
[2:36:09] official reg well you just said you go bu a
[2:36:12] book it's not your official but but you just said I'm going to go by the book
[2:36:17] The Blue Book I'm going by the Blue Book correct said you just said you going by
[2:36:21] the Blue Book I'm going by the book I'm not going by the book I go by your
[2:36:24] official log of yourin kept by your
[2:36:34] clerk Mr bu operating the same book that's correct so it's like it's like
[2:36:39] saying that you had two copies of the same thing but one of them obviously
[2:36:43] there's something in between so you go to the official Journal of ordinances
[2:36:48] which is where I'm
[2:36:56] that you make things you want to make sure that when you make copies or
[2:37:00] excerpts of laws that you actually cop them correct type them in
[2:37:15] there as well that's why you had to check the Blue Book
[2:37:21] okay I'm brainstorm you you got me on
[2:37:26] something you ear about changing the code you said you Happ to look when you
[2:37:32] was looking for another Zone another board that what draw you to it because
[2:37:37] you can go to the line online I used to look at it when I was in Houston go
[2:37:41] online and it never said it never said the mar I'm talking
[2:37:46] about it never ever said the mar you can anybody got to go online go back type in
[2:37:52] five years from now I me back five years you going to see it's going consistently
[2:37:57] say the board the city council but now when I when you go online and you see it
[2:38:05] so it had to change what I'm saying now it's saying the mayor you go put it up
[2:38:10] online now it's going to say the mayor but if you go back and look five years
[2:38:13] ago it's going to say the counsel so somebody changed something changed what
[2:38:18] you do
[2:38:27] 200 online onlys well I'm ask you a question when
[2:38:32] you found out it discrepancy did the C was code enforcement notice he one he
[2:38:38] the one provide code enforcement so if it's a
[2:38:41] error uh why would we still be operating on a blue book that's really available
[2:38:46] that he goes by not me he goes by that Blue Book
[2:39:06] to reflect changes
[2:39:32] what's the so what's the process of changing the the charter You' have to
[2:39:36] you would have to make a petition to the governor you would have to then notify
[2:39:41] the Attorney General to say that it's not in it's not
[2:39:45] inconsistent it's not inconsistent ision of the Louisiana constition or
[2:39:51] general laws or the Federal Constitution they issue a declaration to the governor
[2:39:56] stating they've reviewed it and it's not that way the governor then issues a
[2:40:00] proclamation to the city of bastard that if anybody is going to object I think it
[2:40:06] is percent
[2:40:11] i% object then by to the petition then you have to go to an election
[2:40:18] well Charter that was not officially in the charter this was Amendment so we can
[2:40:23] change the amend this was put zoning when when they made zoning so so that's
[2:40:28] that's that was a point what I'm saying is you don't have to go through all that
[2:40:32] change in the chart you just change the you just change the artist because it
[2:40:36] was it was implemented so we can change the artist to go back to where we
[2:40:40] thought it was originally so we need to draw ordinance to change it back to what
[2:40:45] we thought it was which was the counil that's the simp thing we need to go
[2:40:50] search down the4 ordinance and see if it's reflected properly what it says and
[2:40:54] once we pull that we'll have an answer and then we can say is the blue
[2:40:59] reflec reason
[2:41:06] i000 things have happened where they didn't come before us and nothing took
[2:41:10] place so I was trying to see what we need to do to make it more concrete so
[2:41:15] to make it more concrete if you want to change your Charter to uh not just not
[2:41:20] just this particular thing I was just asking the process of
[2:41:23] oh because because apparently we did an ordinance
[2:41:27] for over $5,000 several times and and I asked you can be done said can be done
[2:41:35] so say I was just to know would it to change so you have to issue
[2:41:43] told yeah so and you can do you can do something about that that
[2:41:49] somebody has created office and then it goes to the attorney general I can't see
[2:41:54] the mayor I'm the City attorney
[2:42:20] over stud
[2:42:24] number office
[2:42:30] administ started and the first board started in
[2:42:40] 2009 attorney resarch
[2:42:49] did the book like in 2016 I mean when I was in C enforcement
[2:42:55] I was talking to M we was researching something and she says that it was
[2:43:00] updated in 2016
[2:43:06] because I think that was when we added an amendment I don't remember what the
[2:43:11] amendment was but there was an amendment to it and it was um we were given that
[2:43:17] and we added into our book and took out the page that had to do that what book
[2:43:25] do you get your stuff out of the book well I don't remember what color
[2:43:30] the book was and I apologize I don't mean that negative uh when my house
[2:43:36] flooded in 2016 uh I lost my book I lost the whole
[2:43:41] thing so I don't remember what color it was and I but you do get it out of the
[2:43:45] book book what I did I went on the and I printed one I printed it off of
[2:43:52] the website so now mine's not colored and back from 2016 I don't remember what
[2:43:58] color it was and I wouldn't be a negative when I said that I
[2:44:02] promise that's fine yes
[2:44:09] sir charum resol

[2:46:25] inor
[2:47:00] I'm
[2:47:19] what
[2:47:47] you 2000
[2:48:44] would you
[2:49:02] two there's actually two ordinances never
[2:49:10] overed and there's there's a that created a separate book called
[2:49:17] zoning goes one through 16 and then there's a Planning
[2:49:22] Commission that is in the code ofan
[2:49:49] which one you going to theed by the May or the counil got that's why it's not
[2:49:54] fing it's getting understanding I knew
[2:50:20] thank you
[2:51:16] officials govern
[2:51:21] yes to original then I for
[2:51:41] the time I'm sorry time at what point we going to rece
[2:51:49] okay
[2:53:15] know
[2:53:47] BRS us
[2:54:12] you know how long process I I a to answer that duration
[2:54:28] that's a private we don't own that it's owned by priv right owned
[2:54:34] by we I know we it but it's still by her we
[2:54:40] should have sent out something her amount
[2:54:44] ofine by now this has goingo long
[2:54:50] think
[2:55:11] am are not afraid that's one thing nobody's afraid because they know City
[2:55:20] well that's that's
[2:56:20] the
[2:57:17] res so we
[2:57:34] Del is open and we have collected information to apply for the community
[2:57:42] infrastructure the last time we applied for this gr they ran out of money
[2:57:49] now make an application again and we are asking for resolution of support to go
[2:57:55] along
[2:58:13] with so we asking for resolution of support
[2:58:43] resolution2
[2:59:09] we looked at the possibili what we apply
[2:59:36] we talk about the possibili based onig
[2:59:58] yeah our recommendation is is the funds are through the office of Community
[3:00:04] Development is the local governmental assistance program
[3:00:09] and it's a maximum of $50,000 one of the things that that when
[3:00:14] we look at the criteria
[3:00:20] would meet was it had to be on public property and we looked at we have a
[3:00:25] piece of property located adjacent to HB Adam cemetery and we're we're running
[3:00:32] out of cemetery blot so applying for that Grant to see if we
[3:00:37] can clean that piece of property level it and have survey for ceter Block do
[3:00:44] you have resolution
[3:00:48] have to make the resolution I'm just pulling I'm just
[3:00:52] pulling the data stuff together to put on the applic
[3:01:41] ol 25
[3:02:42] I'm asking
[3:03:15] the
[3:03:26] if a resolution has not drafted where number
[3:03:45] come can will will
[3:04:00] re so it's not a
[3:04:06] resolu I have to know this I don't know what the lgap is for what the specific
[3:04:12] and so we cannot vot on
[3:04:16] this if our journey don't know we can't vote on this okay Grant as Mr oral if
[3:04:23] you don't want to vote on that's not it man we cannot just sign off on something
[3:04:27] that we don't we we we can all read we have to be able to read it and look at
[3:04:32] it and then we definitely are in support of it we don't want to lose the money
[3:04:36] but you are asking us to do something that you should not we cannot vote on
[3:04:40] something that we do not have in front of
[3:04:43] us and I know it may be like a simple mistake but we we needed in front of us
[3:04:48] and that's what I was telling you so you were saying that so I don't want to see
[3:04:52] this grant go through and that's not the case what I'm I'm tell you I
[3:04:57] don't but it's not but it's definitely not City counc call I just received my
[3:05:02] package at 9:00 last
[3:05:10] night it's just a support letter it's just a resolution of support
[3:05:18] I make a motion I make a motion the table cuz I I don't want to draw
[3:05:21] something last minut I'm trying to find one I think I did one
[3:06:14] in my only consideration was it's not one item a simple resolution
[3:06:23] that you support about I don't know what Mr was
[3:06:29] reading I don't know what he was reading from so you ask me to
[3:06:35] from okay okay okay item number 11 of new
[3:06:40] business discussion demolition of structure at 1305
[3:06:47] okay uh Mr Bradford yes 135 me is uh elaborated propy uh the police jury
[3:06:56] under a letter W in get a permission on their behalf by being adjudicated still
[3:07:03] legal point the owner of the Mr Jones is brought up a Endeavor agreement yes uh I
[3:07:13] need the woman specific okay you you had we had other
[3:07:20] stuff yeah I've got I've got everything done down to name I just didn't know how
[3:07:25] spell the name exactly I think it's Mary Hawkins no the the
[3:07:31] property a description of the
[3:07:40] property that's I had Carol I had c r o l i n that's what I
[3:07:48] what are we doing this is property out of District B uh money that we given to
[3:07:56] District B this is one of the projects that we're taking on we'll T down 13 we
[3:08:01] demate 1305 Mi can I can can I make a suggestion for you please
[3:08:07] U being what I was told because the house have best it's going probably
[3:08:13] going to run all year $55,000 that going be
[3:08:20] okay for the for the legal the way it was structured was is that the person
[3:08:26] the the owner person of the home would contract
[3:08:32] with the person to do it and we reimburse up to the amount that he had
[3:08:37] so which was 4,500 bucks that's what we came together with
[3:08:41] was that and they would present it to us that after it was done and as long as
[3:08:46] the ProCuts were to meeting with the ordinances in the state law so that it's
[3:08:50] in compliance now then we would pay we would pay we would reimburse the so
[3:08:55] other
[3:08:57] words out of that's coming out of Contra have so it was they have to
[3:09:06] present us with it it has to be returned to the the property then is returned to
[3:09:12] where it would meet and comply with the ordinances of Bor and the state laws if
[3:09:16] there's any appliable St and at that point they present us with
[3:09:19] the invoice services for reimbursement up
[3:09:31] you it it goes back to the owner's property so how do we get the
[3:09:38] $4500 back we don't don't you giv away not giving away that
[3:09:45] you allocate I just want to I know what's going to happen tomorrow
[3:09:50] mind Happ tomorrow yeah so so here's here's what the the kind of the benefit
[3:09:56] detriment of the Cooperative Endeavor agreement was the benefit was is that we
[3:09:59] don't have to go through the hearing we don't have to have an engineer report we
[3:10:02] don't have to produce all these cost and we don't have to worry about finding the
[3:10:05] contractor the detriment is is that we also don't get to recoup our cost but we
[3:10:12] don't have all the administrative cost either but but you but you clean some
[3:10:18] correct you can do it through a CA she said you can do that as long as you pass
[3:10:22] through a CA
[3:10:25] because did I did I just my did I just say my
[3:10:30] number did I just say my number
[3:10:47] be approved take V on the $55,000 you have to the the council has to approve
[3:10:53] the Cooperative Endeavor oh
[3:11:04] okay I got I got a question serious question because I don't care where the
[3:11:11] money come from it's still City money was it a grant or whatever was it in a g
[3:11:15] fund it's going to come from the city no it come from the already
[3:11:24] to what he saying is belong to the
[3:11:30] city now I'm I was U I was thinking this was going to be
[3:11:38] you know I didn't think we was going to go do private properties I thought we
[3:11:44] was going to partner with different organizations to go do it you telling me
[3:11:48] we going to clean up a property and we get finished cleaning up with it it's
[3:11:55] going to be back to the person that we clean it up with without assessing what
[3:12:00] we PID to clean it up Mr Green
[3:12:10] can you a question that Direct Direct
[3:12:18] I'm can I say one thing no I'm asking a question can I say one thing I feel some
[3:12:24] kind of
[3:12:55] all okay because I asked this question because you know when we when we paid
[3:13:03] that that premium pay you see what happened we open Pand box and you can't
[3:13:08] put it back in now we're going to I I I want to clean up BL I think
[3:13:17] we need to clean up but like but I was under impression when we clean up
[3:13:21] somebody's property that we was going to be we was going to add that to their tax
[3:13:25] bill I I didn't know that we was going to go clean up somebody's property and
[3:13:29] then give it back to
[3:13:32] him question just statement let let me make a stat to Sor I'm sorry go ahead
[3:13:41] and answer Mr J green and then Mr BR and maybe we have
[3:13:47] let
[3:13:54] M was directed to
[3:13:58] me I think he hold I brought I brought I brought I
[3:14:04] brought this issue to on the G had the floor so I was asking point of
[3:14:15] information someity I okay the the I'm going be real short u
[3:14:21] the rescue money that will allgate to each district yeah to spend as their
[3:14:27] their leure long as they did something within the community and all say
[3:14:31] nonprofit and also said private now this is a private piece of
[3:14:36] lot that have been judic by the Mohawk Parish police year the moha par polier
[3:14:43] had issued a letter saying they have no objection to us in this
[3:14:48] property the owner of the property say she have no objection they don't have
[3:14:51] the money that's why we got some much bright you got to understand half of
[3:14:55] this stuff is standing around this community because the people do not have
[3:14:57] the money and we have the obligation to protect the other neighbors in the
[3:15:02] community okay now now with that said that 50
[3:15:08] $50,000 we have the Le use as we choose it east east C and I have a spoke with a
[3:15:15] private contractor that would do it under
[3:15:19] $5,000 and and with that said it wouldn't have to be
[3:15:23] bided or I didn't think it had come for the counsil how each district get to
[3:15:28] spend their money I didn't think so but but I mean you know now now back before
[3:15:32] the counsil we might not never get it spent we might not never get it I have I
[3:15:37] have a question
[3:15:44] so is this proper or still owned by that said individual
[3:15:50] adjudicated by the parish owned by a family individual and then I have
[3:15:56] spoke with them and they said sure they have no objection to us cleaning this
[3:16:00] proper and they going to sign all in but just like the uh what they call here
[3:16:08] Beauty so in other words the same thing they doing so in other words how about
[3:16:11] this how about this I'm just just brainstorming so so if you have an
[3:16:16] individual they have a piece of property they haven't been adjudicated but it's
[3:16:22] BL we can spend our money to get that yes under section under Section six of
[3:16:28] our chter it say that we can tear down or remove anything that's a danger and a
[3:16:34] hassard in the community it don't say the at the owners it say The city can
[3:16:40] take that action and we should be able to do if we don't do it you got to
[3:16:44] realize these people that own property two3 of them can't afford to
[3:16:50] clean the LA house grandma grandma dead Uncle Bob in California B Jean in Texas
[3:16:57] somebody in Detroit and all this mess is still here I mean I like I mean I mean
[3:17:02] you
[3:17:05] know we as a city responsibility have been all just for the clean up right and
[3:17:10] do certain particular things in our particular district and we have the
[3:17:15] money money been alligated we paid we paid the employe we PID everybody now
[3:17:21] the $50,000 that was allocated to each district those counsel should be getting
[3:17:26] busy in their District seeing what it take to clean it up and I'm not sitting
[3:17:32] back waiting to make a uh you know that's what we asked I asked M uh Mrs uh
[3:17:39] Mrs Hardy the same thing and we spoke about nonprofit organization I also have
[3:17:44] endeavored him for a nonprofit organization we getting ready to give
[3:17:48] $10,000 to we not getting that
[3:17:53] back BR you minut I'm not disagreeing what I'm
[3:17:58] saying because when when we was awarded the $65,000 I was trying to come way to
[3:18:03] to do it with within the city but your way prevent all that you can just get
[3:18:08] some okay private contract
[3:18:13] and you go saying thisal so the way you make it legal iser what okay with the
[3:18:21] c correct you have to articulate the benefits you're getting the benefit
[3:18:25] they're getting you're cleaning up light but yes you are giving up the right to
[3:18:27] get a lean so Mr you say one word we about to get busy okay
[3:18:33] okay only property just
[3:18:37] anyer it's any property that would meet the status for
[3:18:42] being a dangerous or or dilapidated structure which is a a a very
[3:18:49] specialized word that has legal meaning behind it it has to be one that when we
[3:18:54] do those when we condemn things we have an engineer who looks at
[3:19:00] it who says yes issues report yes this is it meets the state definition for
[3:19:04] dangers into life dat like we had with the L building e side building
[3:19:09] so if I get a a contract is just it
[3:19:14] down I got but but you have to meet that definition
[3:19:19] but what what we're giving up in return for them allowing us to consensually do
[3:19:23] it without having to go through that processes and all that that that
[3:19:27] unnecessary red tape is he's giving he elected to give up the the tax the being
[3:19:35] able to place the bill on the tax he said look we're not going to hit their
[3:19:38] taxes because they we went to them they consented to it they're going to do this
[3:19:41] without all the house on the red well I got I got a question well can we do this
[3:19:45] I understand what you're saying but we don't want to get into a place
[3:19:49] where we clean somebody's property of and then they turn around and sell it so
[3:19:53] long as you maintain that property I don't care I kind of go along with what
[3:19:58] you saying but you don't want to get in the business of going cleaning
[3:20:01] somebody's property up making it look good and then they turn around sell it
[3:20:04] for a profit so if we spend 45 4500 on it just say 4500 can you stipulate in
[3:20:12] that Z whatever it is that if you sell the property that the city is going to
[3:20:17] be required you to give the money back that they invested in cleaning the
[3:20:20] property all right CA is a contract our vision in
[3:20:24] there put you put in Language by us cing up
[3:20:30] you give it to us but we'll do away with the the um the taxes that's on because
[3:20:35] pretty much everybody adjudicated old taxes on it so we clean up the property
[3:20:40] you belong to the city but therefore we don't need your the taxes that you owe
[3:20:45] on is that can they turn ownership of that property back to the city well you
[3:20:51] can you can do that yes is the answer and the way the way you do that is is
[3:20:56] you just file that ordinance in the thing and they would have to consent
[3:21:00] that they're not going to object or
[3:21:10] redeem and understanding clear for for the other Council to have clear Clarity
[3:21:15] on this that this particular property do uh have adjudicated proper
[3:21:22] adjudicated property this particular adjudicated property is no more than a
[3:21:26] house or a liot you mentioned somebody engineer believe me I don't have to be
[3:21:30] engineer know that elab because it's sitting on the ground already that
[3:21:33] particular okay but what I'm trying to say is I agree okay okay what I'm trying
[3:21:37] to say is that we do not want to get into if
[3:21:43] adjudicated it don't uh to the police Maj of the city they already have a lean
[3:21:49] on the prop would I could be correct that is correct it's unpa because the
[3:21:52] tax going go through a
[3:21:56] tax what I'm saying is if you go clean up some belongs to
[3:22:01] the police jury that's their jurisdiction and if they turn around
[3:22:04] just like who who sell business for us that that lady do she do she sell
[3:22:09] property for them also EMP does they they s proper what we don't want to get
[3:22:14] into is go clean it up then they go make a profit off of them no they won't be
[3:22:19] they that go to you speaking about they have they
[3:22:25] have that's a $1,000 process to start and these
[3:22:29] particular loots and property we're talking about if you clean up and do
[3:22:33] that thing you still can get I think the easy way to do it is when you draw the
[3:22:37] the contract you put in there if you sell it we we need to redeem our money
[3:22:41] back we not going to clean nothing enough for you to make a profit off us
[3:22:45] as long as you keep it in a thing and it's your property and you paying the
[3:22:48] taxes on it whatever but we can't go clean up something and let you make a
[3:22:52] profit off everybody be up here clean my y'all would y'all please come clean my
[3:22:57] properer clean my property everybody taxes on adjudicated
[3:23:04] property they old taxes on so that's why if you come in and say hey we going to
[3:23:08] clean this up let us have it but the the taxes that you ow on we do away with you
[3:23:13] that's adud
[3:23:18] then that then y'all will have to come up with some kind of contract provision
[3:23:22] where if they sell it or they do something then you can recoup it at the
[3:23:32] next I can check real quick and tell you I believe yes it is adjudicated no it's
[3:23:37] not adjudicated it's the taxes were bought by somebody somebody else has the
[3:23:41] taxes so that the taxes to adjudicate nobody buys a tax sell and that gives
[3:23:46] you the right to go in claim ownership if you want you have to exercise it but
[3:23:50] you have a right to so it's not adjudicated it's just the tax been
[3:23:54] purchased by that individual down there and what it is is here is it's it's the
[3:24:00] it's discretion of how far you can go in a contract it's not everything's legal
[3:24:04] there it's just what Provisions do you all want can you find me the contact
[3:24:08] person yeah I actually have this phone number we I can talk I guess I guess
[3:24:14] what I was saying about the about property to the parish it's different
[3:24:18] between the city cuz we go clean that property up you can't tell them what the
[3:24:21] charge if they go sell it for the the property taxes if they go if you go
[3:24:26] spend 4,500 and they go sell it for 1,200 that's your loss you cannot tell
[3:24:32] another another mun another jurisdiction what what they will and can charge
[3:24:37] that's the only thing I'm getting at you go clean it up they going to sell it for
[3:24:40] whatever they want to sell it for they don't care you just clean it up to make
[3:24:42] it look good I understand that to a degree but what I'm trying to say
[3:24:47] I don't think the police jury even though they have a adjudicated lean on
[3:24:50] it I'm I'm looking at this particular piece of proper I'm speaking of okay
[3:24:54] have have have a judic adjudicated and the owners are not going to never it up
[3:25:01] they not going to pay judication okay and order for them to
[3:25:07] sell or transfer this property any other name or do they have to pay the judicat
[3:25:12] police their taxes now if we want to out that if if they pay the taxes the tax is
[3:25:21] not going even be worth the tax is not even worth for what would you what did
[3:25:26] you to get it from that's what I'm getting at they going to sell it for you
[3:25:29] going to go spend 4500 clean up and they going to sell it for $1,000 yeah see but
[3:25:34] we get we get we what do we get out of as a city we get a
[3:25:38] duplication what we need that's only I mean section six of section six of our
[3:25:43] ERS tell us that we have the right to take any so anything condemn danger to
[3:25:47] the community and that fall back on us and I mean we have the money see we
[3:25:54] can't turn this into a a revenue collection we can buy property clean up
[3:25:58] and then turn around get revenue and get tax I don't think we need to we need to
[3:26:03] clean it up attorney Attorney
[3:26:08] General okay the property is
[3:26:14] adjudicated you resarch the legal aspect of and both parties get in line if
[3:26:22] property is sold and the police jury gets his share
[3:26:27] put the lean on and City back gets his share yes all the leans have to be paid
[3:26:31] through
[3:26:39] the they want to sign on to a lean of their proper I'm a problem and they can
[3:26:43] make an agreement the ca that they allow us to right I just want to move forward
[3:26:48] clean it
[3:26:50] up put in there they
[3:27:02] going
[3:27:05] CA the 397 project that's one I'm
[3:27:16] approve
[3:27:18] that got a motion the motion motion
[3:27:25] to that that U
[3:27:31] 1305 yes5 okay Mr is making a
[3:27:38] motion with conditions attached to it as stipulated um by attorney Jones and
[3:27:44] taking in consideration everything has been said here on this
[3:27:50] property3 to do a Cooperative Endeavor agreement your
[3:27:59] pleasure motion
[3:28:03] pleas make motion
[3:28:08] okay okay all in
[3:28:12] favor any
[3:28:21] all right project this is a core opportun Endeavor
[3:28:26] agreement with Robinson Williams and you will see this one is
[3:28:32] for the sum of $5,000 to be paid to and this is coming
[3:28:39] from a grant specifically for children for children and
[3:28:47] as you will see has stipulated this is parallel to what stipulated in
[3:29:05] the this is for children act 397 we can only get the second of the
[3:29:12] M the first
[3:29:16] the same thing with like the the fence over there we took care of that the rest
[3:29:22] of that part of that so this this is a separate gr of
[3:29:26] $5,000 we can't get the other half until we spend this part this coming from this
[3:29:33] is coming from Adrian proper title representative
[3:29:40] Fisher and state senator Katrina Jackson how long you been ask
[3:29:47] okay this grant I think we received the money in
[3:29:51] July wasn't it we receed the money in July we could
[3:29:56] not spend it until the budget was adopted and it was adopted in
[3:30:06] October the total Grant is
[3:30:12] 25,000 so still
[3:30:16] you pleas please used it for promoting safety have use
[3:30:24] 5,000 use 5,000 for this and I have to submit a report to the um to the peak
[3:30:31] project on how we're utilizing These funds so the rest of is going to be used
[3:30:36] on promoting um Unity is this the do this
[3:30:40] not the do par no no Mr hold up do
[3:30:46] I'm asking a question three different grants I'm I'm asking uh I'm asking the
[3:30:51] clerk what Grant I know you don't want get put in this I'm asking a question
[3:30:56] cuz we got two
[3:31:03] $5,000 represent
[3:31:07] a was 25 we did get two $25,000 Grant one came through Francis
[3:31:15] Thompson to clean up this one is for clean up for children
[3:31:21] clean up for blight the fence and the other
[3:31:25] part I thought one part this is Francis Thompson okay two one of them is for
[3:31:33] blight and the other one was for supposed to been used specifically for
[3:31:37] doson Park well doson related I spoken with him and this time because we
[3:31:42] realize children are coming from different places but this is the I was
[3:31:45] right this is the doson park yes okay I mean I know do my
[3:31:57] research the last be
[3:32:16] okay on Wednesday
[3:32:24] I the after school tutoring from 4 to 12 years of
[3:32:29] age and the projected number of
[3:32:38] students this is I make myself clear this fund was adoped it was two
[3:32:46] different grants this fund that that she's spending right now that mayor is
[3:32:50] talking about spending was dedicated to doson park talking like do Park like dos
[3:32:56] Park doson Park like when they gave money to the food truck that was not in
[3:33:01] doson park that was that come out of the doson park Grant though now if I'm wrong
[3:33:08] somebody correct me hold up I'm I'm just I'm just here I'm just trying to get
[3:33:13] clarity so we have a D part it's
[3:33:18] called
[3:33:26] location I have I in my I'm saying order to be you have to you have to State
[3:33:34] something pertaining to D par order you want me to put
[3:33:39] in I'm trying to understand I'm trying I'm trying to get why became a D part Dr
[3:33:44] so it had to be something in place when you going to apply for the grant to be
[3:33:48] consist of some deal with d Park and will so that's that's what we asking
[3:33:53] like so have with this R have anything been utilized for do the last part will
[3:33:59] culminate the do part so how much is the last part of it's what's left after this
[3:34:05] and this because we have Community engagement we're going to invite
[3:34:09] nonprofit agencies that offer services for children any nonprofit
[3:34:17] the reason why I because I think I had spoke with and part of
[3:34:22] M I spoke about 4 that we that we have is person
[3:34:28] equipment for like the basketballs or like gripping Flor but we have a grant
[3:34:34] that's
[3:34:45] do have to utilize what's available how we going to get the children there who's
[3:34:49] going and that this is a facility that we are doing The Cooperative I think I
[3:34:54] think what you're doing you know great idea but we talking about dos and I was
[3:34:59] just out there yesterday I still go out there basketball but but I mean we can't
[3:35:05] the kids can't dribble on on the basketball floor properly without being
[3:35:09] so CU slippery Jake you been out there right it need to be it need to be it
[3:35:13] need to I don't know who the but I don't think they did a great job because now
[3:35:18] the kids go out there right now the kids SL
[3:35:22] ice but so so now we have a grant cuz I'm using some my money to purchase
[3:35:26] basketball Mr Lock do some other things but we have a grant that's there for Dr
[3:35:30] par that's not getting used for Dr that's crazy no the children meeting the
[3:35:35] children where they
[3:35:39] are but we don't have the same resources that Mr Rand William going to over there
[3:35:47] so we are we to
[3:35:52] execute that's that's a great cuz I I don't I guess I don't want
[3:35:57] you to to make it seem like we we don't want y but it's just like I being out
[3:36:03] there on the regular it's just like it's it's a greater need it's it's
[3:36:09] a def a need for enhancement inside do Park especially
[3:36:15] get the other half of the money then we can but we got to spend the first half
[3:36:21] before it goes away and we were delayed because the budget was adopted in
[3:36:27] October I got a question the first half of the original plan
[3:36:34] toze 5,000 went to sa promoting went to truck I got to break I
[3:36:42] got to break down 5,000 so what what I'm getting at is I
[3:36:49] guess what I'm saying when we had the or fund correct me if I'm wrong attorney
[3:36:53] Jones you supposed to spent the arbor funds in the manner in which it was
[3:36:57] given to you right you got specifications that you have to spend it
[3:37:01] yeah there's regulations around around America R funds okay so if they give you
[3:37:05] a fund for doson Park and you not using in the manner in which the grant was
[3:37:10] that you applied for the grant for that's kind of miss
[3:37:17] sir that's a very word to it might but it's defin definitely on the line no no
[3:37:24] sir it's not because I talked to representative
[3:37:29] fish to do I said so what do the language of the gr states do the
[3:37:34] language of the great states that you have to do something in pertaining to Dr
[3:37:37] Park we get the other half we will some of this is a is a result of the delayed
[3:37:43] budget being adop it can't be because you already UTI
[3:37:49] 5000 no
[3:37:53] can't the grant was 25,000 we got half of it we got half we can't get the other
[3:38:00] half until we spend the first half and I got notification that if it's still
[3:38:06] available so why we use the first to
[3:38:11] actually there were there were some stipulations to more
[3:38:16] children so we can use the second in fact I've already spoken to about
[3:38:22] lighting yeah
[3:38:26] think CH basketball down the court still so like
[3:38:33] the first can't talk about
[3:38:54] administrator and said this is what we are going to do and she said it's
[3:38:59] fine this is
[3:39:03] serving I get what you saying but can you can you tell me to let I hate to say
[3:39:08] that but how often do you go to do because if you if you if like by me
[3:39:12] saying that someone like myself that go out
[3:39:16] and play with your kids train the kids shoot basketball on the court
[3:39:21] there's a need in fixing that D part Court you still have dead spots in their
[3:39:26] court so I'm I'm what I'm saying is I love the idea to get something to arange
[3:39:32] but the fact that we haven't did nothing for D par it's just cuz you know I'm
[3:39:39] don't matter what pair of shoes you put on them kids can't shoot basketball
[3:39:42] proper the basketball matter of fact the basketball are using I think they may
[3:39:46] have two or three new basketball but everything else problema I are you
[3:39:50] asking to change FL
[3:39:55] no but it's floor you can put it on the floor it's it's a lot of things and you
[3:40:02] have a great person out the he can all know everything they give everything
[3:40:06] about the courtly we're trying to spend the first
[3:40:11] and put it for the children where it have a direct impact I can't get the
[3:40:15] second half to take under consideration so what type of money are we talking
[3:40:21] about for this $5,000 that will go to after school
[3:40:26] tutoring for 4 to 12 years of age any student in need of T projected number of
[3:40:32] students to be sered which is the number that I how much
[3:40:37] have oh okay after we give the 5,000 here we will have 2,000
[3:40:45] uh because we spent 5,000 on the safety and spitting
[3:41:08] Mr it any of it do don't put them to the
[3:41:14] G stand back what I
[3:41:27] did to 25,000 half of that 12,500 the other half is
[3:41:34] 12,500 the other go strictly to D it can
[3:41:42] yes make this is going to go
[3:42:02] towards we don't have the we don't have the tutors to put out there well that's
[3:42:07] what the money is for but the children are going to benefit the kids of that
[3:42:13] disadvantage for out of town for certain group of people dson Park Pacific dson
[3:42:19] Park he should stay in dson park okay we should start moving around to P
[3:42:24] State freshman B like for stay to do Park you should stay with pafic state
[3:42:32] was granted for water we start that we can go you you can go to farest Park you
[3:42:37] can go to uh the little park down street for me I don't know the name of it but
[3:42:44] parks for pafic use and that's da par so so let me ask you a question so with
[3:42:51] that with that dson par so like like the water P inside par can this be used to
[3:42:57] purchase with this funding because there need
[3:43:04] for you just for also the water pressure if I'm not
[3:43:10] mistaken the water pressure Dr part it's been it's been we probably a cple not
[3:43:16] without being a to go in
[3:43:24] they I'm just I'm just giving you ideas I go out
[3:43:31] there well we have I something yes sir go ahead I believe when money is all for
[3:43:38] Pacific you should be to that but thinking of Rob I don't want to take
[3:43:43] anything because ARP money whatever it is we're
[3:43:48] allocating $10,000 for after school program for the same facilities now we
[3:43:52] need to use that money in D Park allocated for D Park uh District B we're
[3:43:58] allocating $10,000 to Roberton Willam after school program okay that's and and
[3:44:05] I think the attorney just said you know you know let
[3:44:09] not to pay cut someone out of something El
[3:44:15] those the low most low income people who really need the money is D Bar
[3:44:22] Community you speak of a community uh uh William does a wonderful job of Ls in
[3:44:29] District B and I'm all for it I wish I give more but I'm trying to stretch a
[3:44:33] little more further okay but but $10,000 is that we can use on the ARP
[3:44:40] money American Rescue money right here the next page over has already allocated
[3:44:46] $10,000 for the after school program let's not dimin do Park this was the
[3:44:54] weak par and was Historical Park in this community and every time we can get allg
[3:44:59] to D Park should be used for Dr Park I'm sure they have
[3:45:05] 116,000 they can use that $5,000 for when we have a basetball league you know
[3:45:11] we need some more jerseys
[3:45:15] okay you want to just table this and
[3:45:31] I ioke this goes to the heart of
[3:45:37] it of doing something for the children and they will at
[3:45:45] that money will be used to bring all the agencies together have many convention
[3:45:50] like you walk rain you walk through the door without going the water okay but
[3:45:54] this grant was not given for for that kind of
[3:45:58] repair I thought it
[3:46:09] was I like to make a motion that be the
[3:46:16] this is
[3:46:19] motion ass a motion to table
[3:46:27] that in faor
[3:46:45] according to I'm requesting a
[3:46:51] $10,000 corpor agreement with Robinson Williams from out of the ARP money how
[3:46:58] much I have left now spend how trying
[3:47:03] to I SP I this would be 15 okay that leave me 35
[3:47:33] you I'm
[3:47:38] hold what you say we want to give I'm talking about ,000
[3:47:45] they got T program
[3:47:51] here okay what I'm getting at
[3:47:56] is numbers keep going up and up we we want to table five they want to
[3:48:13] get coming out youry yeah yeah bone I
[3:48:23] have we get one for what I have to do to get one but I I rather not speak my
[3:48:32] price uh just just text me with the D we coordinated about it just got the
[3:48:40] details I put
[3:48:45] you make
[3:48:47] m i I make a motion we will $10,000 ende enter into agreement with
[3:48:55] District B endeav agreement with Robert for $10,000 I
[3:49:04] said second in
[3:49:19] oh let's do a question can can I take supp
[3:49:28] have okay there's no we over we over
[3:49:34] $5,000 I mean you got to look at the totality of what's about to happen I
[3:49:39] know we got this money I think it should be a cap
[3:49:44] on what we can do with the money with just individuals right in still of just
[3:49:52] $10,000 I know it's a great idea but that's a lot of money to give just one
[3:49:58] nonprofit organization I think we need to have I'm just brainstorming I mean
[3:50:03] it's question answer I got it right to my opinion so U I think we need to cap
[3:50:08] it off even if it is your money because it's still City money and it kind of
[3:50:14] look when you look at it they they're not going to look at it as a grant it's
[3:50:17] just going to look at you gave one organization was it nonprofit whatever
[3:50:21] you gave them $10,000 I think that's a little steep I mean I want to help
[3:50:27] enhance the community but I think that is uh because
[3:50:32] when you open Pand Bo somebody else going to come up here and want
[3:50:38] $10,000 that' be up to discussion of that program to submitt I think it's a
[3:50:42] valid program I think it have the potential to use $10,000 or more I think
[3:50:47] we just trying to give five additional ,000 from another program I think I
[3:50:51] think I mean that's just show your opinion I'm responding $10,000 is all
[3:50:55] spelled out for the use I like the way the propos is written I'm not just
[3:50:59] coming off the top of my head this talk about the program thre Monon program for
[3:51:04] $10,000 with two teachers uh I mean you know it seem to be
[3:51:08] super I would have to say one of the best proposals I have seen submitted you
[3:51:12] know in my in my life business is all spelled out uh it say 11,000 but we
[3:51:18] never down to 10 uh all been agree all depend the extent of the
[3:51:25] program other words if I want to shoot mares I would ask for $110,000 shoot
[3:51:29] mares but we're talking about educating kids in a Tut and reading program which
[3:51:34] this this this organization is in the community that could use it like I say
[3:51:39] it probably could use a whole 15,000 but excuse me it was just coming from the WR
[3:51:45] program I had a problem with from the WR bank but like I said I think I mean I
[3:51:51] hear what you're saying I agree what you're saying but if somebody else come
[3:51:53] in my district say well you gave Mr uh Roberts and Williams uh $10,000 they do
[3:52:00] proposer I look at in back that would be basically up to the uh decision of the
[3:52:05] district that it's coming from I don't want to put a cap on your District you
[3:52:09] should want to put a cap on uh cap District we talking about District just
[3:52:13] still City money I from is City money I mean I'm just I'm
[3:52:19] just paying Dev what I'm saying is when you get when you get later on
[3:52:25] people going to come up and they going to want they going to want different
[3:52:29] things and you just can't distinguish we just gave one person ,000 wait wait if
[3:52:34] we have it and it's a good program somebody come up tomorrow with a
[3:52:37] $155,000 program I think it's suitable I think that would be the district uh who
[3:52:44] whoever counsel in that District to present it and I think I should I would
[3:52:48] want you would want me to support yours as well I want you to support mine I
[3:52:52] didn't think we were giv $50,000 to say mother may I I thought we would have
[3:52:57] enough sense to see what good what benefit our community and I think Robert
[3:53:01] William is one of the best communities in the city of Bor
[3:53:07] no Miss hey just like you got a point I got a point let me finish you finish let
[3:53:12] me let me finish floor now my turn okay don't sit here and think that I don't
[3:53:18] want to give them the money you miss no you missing the whole concept of what
[3:53:22] I'm saying and you go ahead and do it and y'all mark this down to this night
[3:53:27] watch and see what happened with other nonprofit organizations so I'm you vote
[3:53:34] the way you want to vote I got a right to my opinion you got a right to your
[3:53:38] opinion that's your money you spend the way you want to spend it but I'm telling
[3:53:41] you just like that other stuff started off good just like you do some of the
[3:53:45] churches thr it off good and then people just turn against it you about to find
[3:53:50] out
[3:53:53] keep
[3:54:01] Mr have one for what Mr BR advocating for for Community outre to children from
[3:54:09] the city of B by providing after school care tutoring and mentorship
[3:54:15] recreational activities to the youth for the furtherance of physical activity and
[3:54:22] exercise okay you have the other one from the peak project which is the one
[3:54:26] that you
[3:54:29] compliment I I say could use more money only thing I have with the PE that mayor
[3:54:36] is you coming out of Dr already been alligated for D har that's the only
[3:54:41] problem I have with that but I I I refer to that they uh that this uh after
[3:54:46] school program could use more money but like I said but I'm going goad call for
[3:54:52] the vote yeah yeah call for the
[3:54:59] vote speak agenda
[3:55:23] D is discussion resolution 24 2073 track program to reconsider the previous
[3:55:30] elimination of City SP program can I speak on that man yes sir I I think
[3:55:37] that it's been u a misunderstanding if my memory Ser me
[3:55:42] correctly I think that budget was adopted it was more
[3:55:47] of removing funding because I I think that we had spoke to the fact of
[3:55:53] football and at the time we uh adopted the budget we was past football season
[3:55:57] so we said hey don't need to have that that money in the
[3:56:00] football a line it for football when we pass football so and I and I can't be
[3:56:06] wrong but I I just wanted to say that I don't think that I remember any council
[3:56:10] member saying they eliminate get of St for okay well I think there's a
[3:56:16] resolution that that that speaks to that glad and I'm glad you brought that up
[3:56:21] because we have it in our packets and my name is signed as yay James Green is
[3:56:28] signed as yay har Lo is signed as yay the NES are Charles Bradford and de
[3:56:34] green is no way that I said strip just stop or eliminate
[3:56:41] programs I said it for the record last time I said for record again I have
[3:56:46] grandchildren in bastu that participate in programs so why would I eliminate a
[3:56:57] program I would not and I'm furious about this so what what I want my
[3:57:02] grandkids to do all of them go to Sterlington and play no I work my
[3:57:06] daughter works we trying to stay local but when you look at this um U
[3:57:12] resolution my name is like I agree to this and I did
[3:57:16] not I did not okay I didn't write the resolution and all you have to do is
[3:57:23] look back at I didn't sign it that's not my signature and that's a problem too
[3:57:27] why aren't we signing resolutions okay at one time we were signing every
[3:57:32] resolution now we sign
[3:57:36] nothing definitely not
[3:57:44] oh for clarity they have I have instructed when
[3:57:50] they make the resolutions there's no signature
[3:57:54] required of any member because the vote is reflected in the minutes well de de
[3:58:00] now it's a problem with that why I say that is because of the resolution that
[3:58:04] came up earlier we didn't see it we just went on somebody's word and now the
[3:58:10] whole thing has changed where it says the mayor appoints council's left out I
[3:58:15] didn't sign that so when did it happen so that's the that's the point when I
[3:58:20] said you need to have material in front of you yeah there's no way I can go take
[3:58:25] a test and don't look at anything so when they pass them over since they're
[3:58:30] not signed the vote that's recorded in the record those writings for anybody
[3:58:35] who's here in the public those writings are my writing of the names who voted
[3:58:40] for the resolution tr get mixed up like was
[3:58:45] yeah mixed up so they for some reason and I don't know why they still want a
[3:58:52] name wrote on told them the law is it's a resolution once y'all once y'all V
[3:58:56] vote that's it but when something is is screwed like we eliminating the program
[3:59:02] like this we need something in black and white so so for for clarity for anybody
[3:59:08] in the public nobody on that Council signed that motion I simply recorded the
[3:59:13] vote on the and you always know it's me because I
[3:59:17] put the first letter of your name a period and then your last but it didn't
[3:59:21] happen like this we didn't we did not but intend for it to be deleted but what
[3:59:27] the what y'all voted for that night in the
[3:59:30] resolution what this was the night the budget was passed okay you cuz I got
[3:59:35] something you know I got all my records just keep going I'm going to walk you
[3:59:38] all the way up to this this one right here so what was voted on was is Tove
[3:59:44] remove the money from the way it was paid because it was being paid to City
[3:59:51] teams there was the football one was specifically eliminated because the
[3:59:55] football season had already run and there was no reason to put money in the
[3:59:59] football thing because by the time the budget came through the football season
[4:00:03] was over and there had been no football program so there was determined by the
[4:00:07] council that hey we don't have to allocate money there
[4:00:11] because the football season's ready there was no money spended on football
[4:00:16] that year because there was no football program that year the track team was the
[4:00:22] track money was taken out because of I gave the legal opinion that you can't
[4:00:27] pay for a track team but you can have a track program you can't have a track
[4:00:31] team so it was taken out of budget but this is eliminating programs yeah that
[4:00:36] that that's not uh but the way they're listed so the way
[4:00:42] the items are listed in there hold on real quick I don't mean to cut you off
[4:00:46] but the way they're list in there reflects the budget line item the way it
[4:00:50] was titled but we still are not deleting we deleted the money because
[4:00:56] the season was over but this is not what this says it's saying that we as a
[4:01:01] council deleted uh some of the City Sports
[4:01:05] programs so you have to create um whenever you do ordinances or
[4:01:11] resolutions it's for the people that's coming behind us somebody come behind me
[4:01:16] and they pull this it says that Angela ta agreed to um eliminate sports
[4:01:23] programs this is what this say I I I think cuz I think the two
[4:01:28] intertwin like approving approving the adopting the budget and and removing
[4:01:36] some of the funds I think somehow got they're always interwined because you
[4:01:42] made alterations to the budg adoption instrument
[4:01:46] no not from not from eliminate a program how how would they be so so so if you if
[4:01:57] you correct you did and the way those amendments are done is you have to list
[4:02:01] the line item when it was listed on the budget it was listed as those exact
[4:02:07] words the perception we cancel
[4:02:14] you saying when the budget was adopted you just what you tell me it was a line
[4:02:19] item that St removal of C the program no no there was nothing in there said that
[4:02:24] I'm trying to get to it before I read that so I'm just talking about where the
[4:02:27] the I remember typing in the as they were going as y'all were going through
[4:02:31] them which ones to take out and I put I always put just like a c put some
[4:02:36] track they said when they made the motion to take out not get rid of the
[4:02:41] program it for it was to move move the money to to the
[4:02:55] appropriate just lot the that's
[4:03:06] why at the
[4:03:19] at the last city council Mee we asked we asked the mayor specifically about this
[4:03:26] and she said it was a arrow with the flowers she said the prepar must have
[4:03:33] made a mistake go back and look at the tap when I when she when we was talking
[4:03:37] about this last time she said well we asked her about removing this she said
[4:03:41] well it must been the prepar that that did
[4:03:44] and also and you know better than I know we was talking about a team yes and and
[4:03:52] the reason we was talking about a team because the money and actual we was
[4:03:58] really trying to just yeah keep people uh from getting in trouble because you
[4:04:04] misappropriated the $188,000 right correct so what what what you have here
[4:04:10] is you have two things you have two things running head on okay separate I'm
[4:04:14] going to separate them for you so it's real clear for the public one is is that
[4:04:18] uh when you're using accounting terms talking about the budget you can either
[4:04:24] do additions subtractions or you can call them
[4:04:29] deletions it's either subtraction or deletion it deletion is whenever you
[4:04:33] just took the line item out because one the football program it didn't delete
[4:04:38] the football program it deleted the line of item am of money and so the physical
[4:04:44] document that y'all voted on that reflected because I drafted it the
[4:04:49] physical document you voted on just deleted the line item because the
[4:04:53] football season had already run there was no need to allocate money there so I
[4:04:57] used the accounting term deletion the track program we discussed
[4:05:02] that they were paying for individual players city employees hotels all this
[4:05:07] stuff I advised yall that it was against the law to pay that so that was taken
[4:05:12] out of the miscellaneous funds is the
[4:05:15] accounting term you'd use to take it off the thing if you drafting a you say
[4:05:19] delete off the line item for miscellaneous funds you didn't delete
[4:05:22] any programs you only took out the football program money because the
[4:05:27] season had already run you took out the track program because I advised you
[4:05:31] legally you cannot pay for a team and then you deleted out miscellaneous funds
[4:05:36] because that fund you didn't know where anything was going you said look we
[4:05:39] don't want to allocate money there so you can either make additions or
[4:05:42] deletions of the budget and that's what it reflected it was not a deletion of
[4:05:46] the wholesale program or any way to impede the administration or anybody
[4:05:51] from having a program it was simply to reflect what was the current stake we
[4:05:56] proposed the budget in July but it didn't get adopted till uh I believe
[4:06:02] this is actually I can put the date on there it is October the 14th since the
[4:06:06] football season had run so to have money allocated in a current year budget after
[4:06:11] the time the thing had run was was a not it was just it was it was going to put
[4:06:15] money somewhere it would never get spent and go back to General form Mr Jon that
[4:06:19] same night we had a parent here that was concerned that we were deleting program
[4:06:27] now you you explaining that to us here but what does public say yes that three
[4:06:34] City Council Members deleted program well that's perception correct
[4:06:41] perception if anybody fin sorry Mr La we want that corrected
[4:06:46] corre we did not delete programs no and and I will put that on the record that
[4:06:53] discussion that night there was not a deletion of programs any
[4:06:56] characterization that a mischaracterization of
[4:07:00] what attorney Jes it's kind of amazing to me that you know we was pushed to
[4:07:06] trying to get the budget pass you remember that we kept coming back coming
[4:07:09] back and to read this on the door let talk about the three council members
[4:07:15] that voted to pass the budget to keep the city going we get thrown under the
[4:07:21] bus trying to make it look like that we did something that we didn't do only
[4:07:26] thing we was trying to do was keep the city going but you know what's going to
[4:07:28] happen next
[4:07:31] time we going to read everything and compromising when we compromise if it
[4:07:38] take us six months we going to read every
[4:07:41] line we going to do everything because you see what happen when you do a good
[4:07:46] deed think about it the ones that pass the budget are the ones that's getting
[4:07:51] ostracized yeah that was so that and and D can speak to this you have accounting
[4:07:59] experience we both discussed this when you amend budgets you it's not stifling
[4:08:06] something it was simply you can either make additions or deletions from budget
[4:08:10] that was just to delete the idol it was not
[4:08:14] not the program that's what that's why I stay for that's why I stay for so so
[4:08:19] much took place tonight before it's adopting the budget and with adoption
[4:08:24] the Council made their amendment in which somehow somehow it took removing
[4:08:29] the funding is removing the program no the the and and for clarity the
[4:08:35] football funds by the time we came through adoption had already run past
[4:08:41] the season and so that money was going to just sit there there and not be able
[4:08:44] to be used in other places when it hadn't been used already the track
[4:08:48] program uh line item was actually a team and I advise you legally you cannot pay
[4:08:54] for a team cuz cuz I also too in regards to the track I think that uh it was it
[4:09:05] was you was you informed the council that it was illegal for this coun
[4:09:14] give any funds to track so and this if I heard different you know tell
[4:09:21] me tell me differ no no I will confirm that the way in which the track funds
[4:09:26] have been expended was not was not an appropriate way to expend the track and
[4:09:31] that's why this Council had removed the funding for track because we wanted to
[4:09:36] be correct legal you know I voted the way I voted but I I stand with them when
[4:09:42] they for leg purposes because when hearing from the city attorney that what
[4:09:46] we was doing have been illegal so all us none of us want to go to jail so we
[4:09:52] everybody did what it took to be legal yeah the track track although it was not
[4:09:56] a program it was a team there's a difference between a program and the
[4:09:59] team hold on so here's the thing for transparency so so the people that don't
[4:10:04] know would look at the council body and say oh they just don't want to deal with
[4:10:09] track but when we we have to follow your instruction for just being legal so if
[4:10:16] we' been for some our years been illegal that don't mean we should keep pushing
[4:10:20] you know kicking the can no no and it's in I don't recall any dialogue
[4:10:26] regarding wholesale doing away with programs we had a dialogue that there is
[4:10:32] no way are you authorized to have a team and the dialogue was and then future
[4:10:37] dialogue at other meetings was how can we proceed with having a track program
[4:10:45] I if I recall right you're absolutely right that it came about how they were
[4:10:51] being funding who have been paid to that but that was M see because we're
[4:10:57] thinking the funding was coming through the city they was raising their own
[4:11:02] money for the track team I mean for the track program call track program the
[4:11:07] proper ter be programmed because not a team it's a program we can have program
[4:11:12] we can't have a team correct okay okay that was a track
[4:11:15] program it say in the budget track program call it as is as a track program
[4:11:21] and if if they can raise money to help with their program that you know the
[4:11:26] sponsors that that should be fine I think when Mrs
[4:11:30] misunderstood understand how would came about and I think it should be called
[4:11:35] track program it should be called track
[4:11:39] program and we should fund the track program as well as the football program
[4:11:44] I mean fund the program now we can't call them a team we can call it a
[4:11:48] program and if it's a program any program can go outside of the city and
[4:11:53] raise funds for the additional cost of what they need I think we misunderstood
[4:11:57] that that got past all that that's that's the that's the
[4:12:02] delineation
[4:12:06] there keep we should we should stipulated anything that you raise
[4:12:11] outside anything that you donate to you should be put in a separate
[4:12:15] F that's that's what we saying that's
[4:12:20] what what the own to see it okay well let us do it properly because the track
[4:12:24] Program start tomorrow and we need to correct that
[4:12:28] before we leave here T name the track program should we we should spell out
[4:12:33] that the program have whatever we going to give them for the program anything
[4:12:37] that race should be put in a separate fund and move forward the ISS
[4:12:43] so when it comes to when it comes to doing a budget when it come to doing a
[4:12:47] budget typically what they what theyve been doing is they've been budgeting off
[4:12:51] PR year so they look at the budget see what what been spent so when they look
[4:12:55] at the um the year to end date at the end of June they look to say hey the
[4:12:59] track spend I'm going just go off say $36,000 but of that $36,000 there's
[4:13:05] donations so when we when you come to budge you budg based off what's included
[4:13:11] with the donation and that's
[4:13:15] we should correct the problem I agree with you Mr GRE we should correct the
[4:13:18] problem and move the program forward so what happened is is in in particular it
[4:13:23] was with track football was ready passed track had an amount of money that was
[4:13:27] coming from donations which which and then there was some money the city was
[4:13:34] giving in but the issue with that is different from football that was
[4:13:38] actually paid to coaches paid to people traveling paid people which is a
[4:13:44] team not a program but would be a problem if we just reinstate the program
[4:13:50] instead and state on WE once we reate the program and state anything that
[4:13:56] donat should be kept separate from the city funding can we do that you actually
[4:14:01] on even St a program you'd have to start a program well well we start the program
[4:14:05] and start the program and anything and and and spell out anything that donated
[4:14:10] to the track team football team baseball anything donate to any program should be
[4:14:15] put in a separate fund separate from the city budget correct and Miss Hendrick
[4:14:20] stood up that night who with she's had DNA sport for a while and she explained
[4:14:24] it there's a there's usually a a league account and then there's a there's a
[4:14:29] city account for certain things that are like little equipment stuff that are
[4:14:33] General like that but the uniforms come out of the the leag can we make a motion
[4:14:38] to move on the motion that that what I just said
[4:14:42] seor make a motion well we that's what we accomplished with the budget okay the
[4:14:47] M track program and and what I'm saying is
[4:14:51] you'll see when when the audit I checked on the audit too the audit you'll see it
[4:14:56] at the end of the month and then you'll know exactly what I'm talking about so
[4:15:00] everybody just Cal down and we was talking about this $118,000 when I say
[4:15:06] it was when it was put into a city fund it become City money and you cannot give
[4:15:12] City money to private citizens so you going to see when the when the audit
[4:15:17] comes exactly why we was trying to correct the wrong so we can have a
[4:15:24] program because actually when you violate the law which is the man I talk
[4:15:31] to the big bad rou and other people you could get in trouble not the city
[4:15:35] council but the people that actually reive the fund so we was just trying to
[4:15:41] come up with a comprehensive way to to to do it because and you can't just you
[4:15:47] know ignorance of the law is no excuse when you put the money in to the city
[4:15:52] fund then if you violate any codes or any law then you going to be held liable
[4:16:00] then you can get a criminal
[4:16:03] referral and to make it clear I was I was under one directive
[4:16:09] when I City attorne to keep person legal and I gave the advice that we needed to
[4:16:16] take that money out until we could establish a program not a te because of
[4:16:22] what because of what there so that's why so I gave that advice based on what
[4:16:29] I what I've seen and discover
[4:16:47] like to make a motion that program be put back the track
[4:16:53] program be put back and any money donated to the track program any sport
[4:16:57] program be
[4:17:08] kept about
[4:17:17] can I get a motion
[4:17:30] to ition
[4:17:36] toour yeah I'm all in
[4:17:41] favor any CL
