[0:09]
Well, I'm going to bring a zoning board of repealed meeting order. We typically start with the pledge of allegiance if you could all stand and face the flag on the recycling pledge of allegiance, a pledge allegiance to the flag of the United States of America, and to the public, or which are stands, one nation, under God, and the visible, with liberty and justice for them. Thank you.
[0:38]
Thank you for coming out tonight.
[0:40]
As I said this, I was on a board of appeal meeting is held every 4th Thursday of every month.
[0:51]
Tonight, let me put this mask on.
[1:01]
No, the item number three, notice that all notifications of the meetings has been published,
[1:06]
posted and distributed among the compliance with the succuline and freedom of act.
[1:12]
Number four, the adoption of our, what was that?
[1:17]
The marsh meeting?
[1:19]
The opposite.
[1:20]
The agenda.
[1:21]
The next one.
[1:22]
Oh, adoption of agenda.
[1:26]
Do we have any leachings, everything that we need to do with the agenda before we make an
[1:32]
emotional objective, agenda, if not going to get someone to make a motion to adopt
[1:38]
the agenda?
[1:39]
Motion to meet.
[1:41]
Uh, adopt the agenda.
[1:41]
Second, most are made in a second, all the favourable.
[1:45]
This past,
[1:49]
approval for January 23rd meeting.
[1:52]
I mean, you know, minutes for January 23rd meeting.
[1:56]
Obviously, we can't do that tonight because we don't have enough.
[2:00]
The board members, I think, Mr. Chair, is not here.
[2:05]
That wouldn't be because Mr. Cecil was not there.
[2:07]
So we don't have enough board members to meet.
[2:09]
So we have pushed that over until our
[2:11]
The next schedule board meeting is noticed that Mr. Gasperine is not here tonight.
[2:19]
Whatever unknown reasons, you know, if he may return back, he may not.
[2:24]
But if he don't, I'll just like to say that I, we, that this board really do miss him
[2:30]
and appreciate his service air serving on the zoning board of appeal for the years that he has served.
[2:36]
Okay, we're now further ado, we're going to move on to item number six, which is C, R, Island Park.
[2:46]
You have court actions.
[2:54]
It is our custom to give the applicant 10 minutes to present their case up to 10 minutes, I would say.
[3:06]
And, you know, any public comment up to three minutes.
[3:11]
Mr. Chairman, good afternoon.
[3:12]
If you don't mind, sir, I've asked earlier mass speak without my mask.
[3:15]
Yes, that's fine. Thank you very much board members. Let me first say on Tom Taylor. I represent the applicant before you see our island park on there
[3:25]
But half I want to thank you all and the staff for making this meeting happen. I know this is not easy for anybody, but who genuinely appreciate it. It's been a long time since we were able to meet it. Hopefully we're all moving my
[3:38]
for what sense of enormous, if I thank you all for being here,
[3:40]
if going through all of the mask and the heat,
[3:43]
it's about it, it's killing me.
[3:45]
But I do thank you all, and appreciate you being here.
[3:49]
Gentlemen, this is an application for a special use permit.
[3:52]
This is a proposed residential facility
[3:56]
to be built as an assisted living and continuation
[4:00]
of care living on ladies Island, the packages,
[4:05]
As in front of you, it is basically being built on 8.9 acres at 171 Meridian Road, which consists
[4:12]
of 70 independent living units and 24 assisted living units.
[4:18]
As you all are aware, three years ago, the Ladies Island Community Preservation District
[4:23]
tax ordinance was amended by tax to include specifically a provision that would allow
[4:30]
uh... in this ladies on preservation district these types of resident residential units
[4:35]
and i know that i'm not telling anyone here uh... this or news but i want to make
[4:40]
sure they're everybody realizes
[4:42]
as we in view for county like the rest of america
[4:45]
baby boomers age we are all trying very hard to work with an our communities so that
[4:51]
those who do not feel they can continue to maintain a home in the ninety degree
[4:56]
bloggers, whether you can come in somewhere in due for county.
[5:00]
Hopefully in the ladies island area where they have been in this neighborhood and continue their lives.
[5:04]
And we believe that this project is a very important step for be for county and for ladies island.
[5:10]
We believe it will be welcomed. And I'd like to ask James Ankins, who is the lead architect on the proposal to come forward and tell you just a little bit about the efforts that have been made to try to incorporate the design into the ladies island area.
[5:25]
specifically, Meridian Road and I believe that y'all will see and you've seen the drawings,
[5:30]
it's going to fit right up. So I'm going to have to say exactly, let's say just a few words.
[5:36]
I'm going to show this off as well. My glasses all up and I'm going to.
[5:41]
So again, my name is James Adkins with Cordacans Group,
[5:44]
I appreciate the time this evening to talk about this exciting project.
[5:48]
I think the biggest thing that we can stress about this particular project is this,
[5:52]
When the client approached us with ideas, it's a very sensitive site.
[5:57]
Here's a lot of things going on around it.
[6:00]
It's backed up to residential.
[6:02]
It's on the main thoroughfare.
[6:04]
This was a custom design that we intentionally and specifically created for this site.
[6:09]
This is not a prototype that came out of catalog of senior living facilities and put down here.
[6:15]
And the reason for it is the uniqueness of the infrastructure.
[6:18]
There are some magnificent oak trees on this property.
[6:21]
one of them that we've centered the entire arrangement around us 72 inches, and so
[6:26]
not only do we want to preserve those, we also wanted to have this facility
[6:31]
fit in and use them as opportunity to settle the project down to blend in the
[6:36]
environment and also act as a natural buffer.
[6:40]
As you can look on the site plan, there are probably 2 dozen 20 to 70 inch
[6:46]
votes here. There are three separate masses on this project. There's a single story, a two story,
[6:53]
and a three story component. We intentionally, if you see the V shape and the upper left hand corner,
[6:58]
is the single story structure. We intentionally put that to the back along Meridian Road,
[7:03]
to allow it to blend in with more of the residentially scaled neighborhood. We intentionally rotated it
[7:10]
so that there was not a long linear facade along the main road and that as you move up and down
[7:16]
the landscape buffers are much more dense as you travel in that building the other way.
[7:21]
On the right-hand side is ladies Island Drive, located the two-story structure there, again being more of a commercial thoroughfare.
[7:30]
And then the bottom section is the three-story.
[7:33]
We focus that internally pushed it back and as you can see on the south end, really gets waves in that south property,
[7:39]
so that we can maintain all of those natural levels of buffering from the residential neighborhoods.
[7:46]
We've also made sure that we have buffered as some of the different old country materials in the design,
[7:52]
gave us shared hip-roots. Part of the plant-siding, expanded break break.
[7:57]
It's been a really nice wood-backed awnings, metal hoopats, etc. Again, it's just been into the community
[8:02]
and not feel like this alien ship landed in the middle of ladies eye on it. Thank you.
[8:08]
So you said near Meridian Road, that's the single story right there on near Meridian Road and the V-shaped.
[8:15]
Yes sir. So all of the other buildings are three stories.
[8:18]
The far right block on the right hand side.
[8:20]
Which is on that.
[8:21]
The North South is two story.
[8:24]
And then the piece along the bottom there that runs east west is the three story that's pushed for this to kind of into the site.
[8:34]
If that makes sense.
[8:39]
Here we go.
[8:45]
Any questions for the gentleman?
[8:50]
Chairman, I'd also like to point out that effort has made to route as much traffic as
[8:58]
could be made on to 21. So the main entrance to this is on to Lady's Island Road, not
[9:03]
on to Meridian. There is an entrance on Meridian because the South wanted to flow through
[9:08]
type, but the main entranceway is on Lady's Island and he sees me. They again have made great efforts
[9:17]
as they talked about to save the tree canopy and to make sure that they've developed around
[9:22]
that.
[9:23]
So we do believe it is going to fit.
[9:26]
And Joe and also would like to introduce Josh in the Pearson just as he's raising his
[9:30]
hand.
[9:30]
Josh is with the developing company, came down today from Charlotte and if he needs to answer
[9:35]
any questions as delighted to, but he is excited about becoming a part of the community
[9:40]
also.
[9:41]
And Joe and I'll be glad to answer any questions you may have or we can move this along.
[9:45]
have been a traffic steady. No certain
[9:48]
estimate. The numbers are way below the
[9:51]
minimum of 50 generated per hour that they
[9:54]
would be. It's the peak is 25 in the morning
[9:57]
and 35 trips in the afternoon.
[10:00]
According to the standards, and that's well below the 50 determines that the staff would want you to begin to do a traffic study.
[10:08]
So there's just really very little impact because as you can imagine, most of the people who live here are not going. They eat here. They recreate here.
[10:17]
That's one of the reasons why the project candidly is so large, just because there are dining room, there are recreational facilities.
[10:24]
But it does not generate a lot of trips.
[10:27]
This truly is about as light a residential footprint as you could have.
[10:32]
Lighter than any type of department complex,
[10:34]
whatever base, certainly lighter than any type of retail or anything like that.
[10:38]
It will be a fairly quiet neighbor.
[10:42]
So, you, you, you, and you said your main interest is coming in
[10:45]
off for maridian room.
[10:46]
No sir, off 21 on the back.
[10:48]
It's the double entrance there on the back.
[10:51]
Okay.
[10:51]
And we believe that is the most all of the routine visiting traffic would come from that would come off of 21.
[11:02]
Question the gentleman.
[11:06]
Sorry to again I'll be here. Something does come up.
[11:31]
Are you represented again?
[11:34]
Yeah, this really quickly.
[11:36]
With this being a thank you, Mr. Chairman board members.
[11:40]
With this being a special use, application, your primary duty is to determine whether or not this particular use is appropriate.
[11:50]
for this particular location in this particular spot. Again, as Mr. Parker, I mean, Mr. Taylor spoke
[11:57]
to and Mr. Agons spoke to the traffic generation. Here's going to be very small. There's
[12:05]
not require a traffic impact analysis because of the type of use that it is. Another key component
[12:13]
to this particular facility that I want to talk about and I want to commend. I would have said
[12:18]
have they not been here this evening, so I want to make that clear that we work with our
[12:24]
ladies island fire folks to make sure that the public safety aspect of this particular
[12:30]
design was very appropriate. Basically fire access, potential all the way around the building.
[12:39]
So if there's any situation that fire department can access, the facility from practically any
[12:46]
location and get to it. So to staff, recommend approval of it. To you all, this is in an
[12:54]
appropriate area of Lakeies Island. As you all may or may not be aware, we have spent a lot of
[13:00]
time over the last couple of years doing Lakeies Island and planning and specific plans for Lakeies
[13:06]
Island, which calls for variety of uses and mixes of densities and residential types. The one
[13:15]
concern that I would have on this particular situation is I think there's a historic access
[13:20]
on 21 that folks may be using to get to their homes.
[13:24]
We would either need that adequately dealt with or that protected in some ways,
[13:29]
so maybe someone is here to address that from the community,
[13:35]
but that would be an issue.
[13:36]
I think the name of that route is pooped.
[13:38]
So we would want to make a sure word that we, whatever your approval would be,
[13:43]
would indicate that that access would have to be available to the folks that should
[13:48]
this development interfere with that. I don't think it does. I don't think the property
[13:52]
owners would do that intentionally or unintentionally, but that would just be one concern
[14:00]
that helps. But for the most part, staff recommends approval without one caveat that we
[14:05]
and pay attention to you.
[14:08]
Thank you.
[14:09]
I still have a question.
[14:12]
This is Taylor.
[14:13]
Thank you, Mr. Green.
[14:17]
What is your plans for buffering this property?
[14:21]
I mean, obviously we have two stories here,
[14:24]
and I don't want any residents behind this to be,
[14:28]
you know, concerned about, you know,
[14:30]
folks on the second level looking down
[14:32]
into on the air property.
[14:35]
So what is, well, what are your plans,
[14:36]
I guess this is where he comes in it.
[14:39]
I would like to ask Mr. Ackens if you would mind because that has been a primary concern
[14:44]
to the architects and the developer. Would you mind if he addressed that?
[14:48]
Yes.
[14:48]
Thank you.
[14:57]
I'd like to get a transform from my glass.
[15:01]
Absolutely, actually with this design and this image, and I brought this exhibit, and certainly get a little close to your past, and I have some 11 by 17s that makes it easier.
[15:13]
But the buffering and the positioning of this property has been thought through and during the SRT process we've actually increased the buffering distance as well as the density of these.
[15:23]
So with all the meridian roads, certainly from the residential perspective,
[15:28]
increased the suffering by pulling the building away from here,
[15:32]
and maintaining, there's a 48 and a 44 live oak here.
[15:36]
Again, from a height perspective, we felt like maintaining all of the existing,
[15:40]
or majority of the existing trees, which are significant,
[15:43]
are going to provide a lot of existing height buffering, which is important.
[15:47]
And then we will augment that with additional street trees and lower story
[15:52]
and ground covering for the lower levels of the buffering.
[15:57]
Also, with pulling this building back, we've maintained all of this
[16:00]
as a 34 or 28, 32, 21, 40 inch oak tree here.
[16:05]
So, along the existing, we've just pulled this whole building back
[16:08]
to maintain all of that buffering.
[16:10]
So, we really take advantage of the existing natural hierarchy,
[16:15]
which you wouldn't get if you were planting a new buffer.
[16:18]
And then added, you can see the green circles and everything
[16:20]
throughout. And then there's a lot of things existing. We've located the
[16:27]
Retentionary here and then increase the buffering, all of the green and red and everything's all new.
[16:33]
New buffering.
[16:34]
So a lot of the existing buffering you guys are, you guys have a massive amount of new buffering coming in there.
[16:42]
So at least we've got a lot of good care of it. And one thing about the buffers is
[16:46]
when they're like I mentioned when they're new,
[16:48]
you don't get a lot of that height.
[16:50]
And so we've really taken care of even a pair of 18 inch.
[16:54]
And then this is that 70 inch light oak
[16:55]
that we've centered this whole development around.
[16:59]
So, here regardless of the buffering,
[17:05]
what is the minimum distance between any upper level,
[17:08]
window, or whatever, to the nearest residence?
[17:11]
Do you have that?
[17:14]
I know that this is over a hundred feet of distance just to the property line.
[17:20]
These structures are down here.
[17:22]
There's no structures that are right up on the adjacent property lines, either same with
[17:26]
here.
[17:27]
So over here, again, 50, 100, there's at least a hundred feet here.
[17:31]
This is probably the closest corner, but it's pulled away in next the marine road.
[17:35]
And I believe that's 50 feet over there.
[17:39]
So we've really tried it to center this and then work around the trees.
[17:45]
All right, lots of Mitchell.
[17:47]
On that bar length side, you don't have much buffering over there, do you?
[17:51]
This is already a pretty densely wooded area with a nod shape.
[17:55]
So there's a lot even though it's not on the property.
[17:58]
This wedge here is very densely wooded from a buffering perspective that,
[18:03]
problems and purposes, undevelopable, due to setbacks.
[18:07]
And then we've come in.
[18:08]
There's a 13 inch light over here, and we've added some
[18:11]
understory.
[18:11]
And then right at the entrance, there's quite a
[18:14]
bed of existing vegetation that we're maintaining.
[18:16]
You said that piece of property and JSON too is
[18:18]
undevelopable?
[18:19]
Well, not not undeveloped.
[18:21]
This is this triangle.
[18:23]
I mean, you couldn't build anything here.
[18:24]
And there's a lot of existing vegetation right there
[18:27]
in that corner from a screening perspective.
[18:29]
About the rest of it above that.
[18:32]
It's all densely wooded, but when somebody wanted to come in and clear those trees and build near, could they do it?
[18:38]
They certainly wouldn't be able to also eliminate dirt buffers in landscape.
[18:41]
They would have the same requirements on their side when they went through the process.
[18:47]
And that's why, again, we've kind of maintained this as a two-storey structure rather than making that a three-storey.
[18:57]
Where is the Pope the historic Pope rule on that right there? Where's that?
[19:05]
That is a good question.
[19:06]
Good question.
[19:10]
It's adjacent to the curved up there on 21.
[19:14]
You can kind of see it down in the bottom.
[19:17]
It's a lower right part of the screen.
[19:20]
It's a lower right part.
[19:21]
It's hard to see.
[19:22]
But you can see there are two main entrance here exit.
[19:25]
There is a small curb cut right below it with a couple of monuments on the sidewalk right here.
[19:34]
So it's to the south of their property.
[19:37]
But it comes up through here that we want to.
[19:41]
So what are your plans to make sure that they still have access?
[19:45]
I can address that on their Hoover for four hours.
[19:48]
So one's here.
[19:49]
And you post those that didn't make so that you can be picked up.
[19:52]
It was determined that Coab Avenue was just a private road.
[19:56]
It always had a sign, but when the attorneys went through and did all the research.
[20:00]
It was collaboration with the county. It was determined at Pupro, which is a private road. So they have it in the since this plan has been developing going through the SRT process. They have eliminated Pupro.
[20:15]
So they have all the access agreements with the two residential, I think it's middle ten. She has access from her normal driveway and then the other property.
[20:29]
White, they have access off of Meridian.
[20:33]
It was the term that was never truly a road.
[20:36]
Would you say it was a sign out there to say this?
[20:38]
Yeah, it was a sign for all those years.
[20:41]
Everyone thought it was a road.
[20:42]
But then when they did the research,
[20:45]
it was a term that was never a right away
[20:46]
for that property going through.
[20:49]
And you say county council,
[20:51]
determined that?
[20:52]
Who did that?
[20:53]
Who's the county?
[20:54]
The county.
[20:57]
And there's, well, it was with Eric, there are probably our, it was probably our
[21:03]
highway football.
[21:04]
Yeah, so it was our right-of-way folks.
[21:06]
Traditions.
[21:08]
Do you know what John was working on?
[21:11]
I can remember this specific name, I know that it wasn't in the, in the GIS level.
[21:18]
Yes.
[21:20]
But did they have all the documents, they've recorded the new plat and everything without
[21:24]
that the Pope wrote going through that property because it was just essentially just a private
[21:31]
drive. Was the sign on the county Pope wrote sign or was it a private Pope wrote sign? Is it
[21:38]
blue? Is it blue? Yes. I think the point for me here is that this has been cleared by some
[21:47]
county administration. Yes. It's been recorded. Yeah. All this survey was the ones that recorded
[21:53]
the plaque that showed it not being one the property. And then they got the sign off of
[22:01]
booth, White Ann Middleton. One as well. And the residents of these properties, they have
[22:10]
access from the existing roads. Of course,
[22:15]
no infringement upon any rights there. No.
[22:18]
So, correct me if I'm real, so that hope wrote to access this property and that's in question.
[22:31]
Would you have to eliminate that hope wrote to access the old property?
[22:36]
Well, because temp row was off of our property, down here was on to a Milton's property, it came
[22:44]
through that little triangular piece, came up basically filed this thing and then came out
[22:49]
at this intersection.
[22:50]
So, all we're doing is reworking it to have it on to our property.
[22:54]
Because the of T required us to do that instead of having it go through a Milton's property.
[23:00]
So, the Pope road actually came on to your property as we can say.
[23:05]
But besides, it's a little tiny trying it.
[23:07]
It's completely on our property.
[23:09]
Okay, that's what you see.
[23:12]
Mr. Jim, engineers in some kind of coal.
[23:15]
I want to show the board as they asked for a minute ago.
[23:20]
We would expect that this would be a condition of the approval, hopefully, of this permit.
[23:26]
And we will, in a lot nicer terms, make sure that those residents have access to easily
[23:34]
come and go from their property.
[23:36]
I did not mean for it to sound as if that road was promised.
[23:39]
So we did not do that, sir.
[23:40]
And we're going to make sure that the people who have been there for a long time and
[23:44]
he will use that have easy access to come and go as they need to it.
[23:48]
We'll leave us what Eric will ask him about.
[23:51]
Don't be such a dang engineer.
[23:54]
And we'll question sort of that in the engineers.
[24:04]
All right.
[24:05]
And we'll question for the camera.
[24:09]
Public comment.
[24:14]
If anyone, if anyone want to speak on this property, there's a form that we need you to fill out.
[24:23]
I mean, I have Margot Middleton here now, but if anyone else want to speak there's a form that
[24:29]
If you can see Tamika fill out and she'll bring it to me and they'll call you name up that way you can have time to say.
[24:36]
But are you Miss Margaret Miss?
[24:38]
Well you might as well come on up Miss Middleton.
[24:43]
Yeah about the three minutes to say what you have to say.
[24:55]
Good evening, how are you?
[24:56]
How are you going?
[24:57]
Yes.
[24:58]
I'm not the brightest person in the world.
[25:00]
But I do want to ask some questions that I understand correctly that my blood is what they have in the sun. I can't talk with this.
[25:10]
That's good. So far enough for me everyone.
[25:13]
All right.
[25:14]
For my understanding, what I have signed over the memo ready is that they are banding in pro-growth.
[25:21]
But I go to the access to give them a lot of my driveway rise.
[25:26]
That's the plan.
[25:26]
That's fine. I mean, we can ask those questions now to make sure you have access to your residents.
[25:34]
Okay, and the pork road, now that I have the signs of people for them to come over onto my property in order to get to there.
[25:42]
Drive away.
[25:44]
So, there's big trees around this front, follow that road, there's just another road.
[25:49]
You come through and never heard the pork road until it's always been there.
[25:53]
It's open with Meridian Road and like I said, I've signed the tables I just want to make sure that I have access to get in and out and that road does not exist anymore.
[26:06]
That's what I'm pleased.
[26:09]
That's what we're understanding.
[26:10]
That road does not exist but they will ensure that you have access to your property.
[26:16]
Thank you.
[26:17]
Yes, you heard your highway, offered ladies, how many things are there to take that? I can clearly hear your names.
[26:23]
I trust him.
[26:24]
It was tailored to the people who helped access, you could have that.
[26:27]
I don't know where I'd like to see him in with a piece of one of those.
[26:30]
Wait, no, I'd like to have him in.
[26:32]
I don't know where he was, but they just put him on the right arm off to the shore.
[26:37]
I just wanted to make sure all that.
[26:39]
Yes, ma'am.
[26:39]
I saw a tree, I figured everything was okay.
[26:42]
But why?
[26:43]
Thank you.
[26:45]
any more public comment
[26:49]
you can you have the phone fill up okay if you can
[26:55]
fill that phone button then you can come
[27:07]
out chief it seems like you have a lot
[27:10]
of credibility over there you have a lot of credibility in that area as well
[27:18]
That's a good thing.
[27:20]
A lot of the people who are performing in case I heard those people.
[27:26]
Do
[27:45]
you want to speak again?
[27:48]
Well, we bring this public comment to a close.
[27:51]
Gentlemen, do we have any questions for the county or the applicant?
[27:55]
I would just like to make one comment.
[27:59]
This has been reviewed by staff and Mr. Greenway and my understanding is that the architectural design meets all of the conditions of the community development code.
[28:17]
Is that correct?
[28:26]
We have no questions for them.
[28:27]
will it get someone to make a motion on this scale, that will be good, get it seconded
[28:35]
in the fourth.
[28:39]
I'll make a motion, we'll go ahead and prove it, pending those things we talked about with
[28:46]
that access room into the property, mismitting the middle to the property.
[28:51]
The President said if you spoke about the Pope Rome, we'll be able to have access to the new world worth.
[28:59]
Yes, yes, sir.
[29:03]
All right.
[29:05]
Can you kind of accept our provisions?
[29:09]
Yeah, look at that.
[29:10]
That's all I'm just going to condition.
[29:11]
No, that we can put the conditions into your motion.
[29:17]
To me, start that over.
[29:23]
Mm-hmm.
[29:24]
Well, the SRT recommendations for special use permit,
[29:28]
it won the fire marshal approved prior to SRT's final review.
[29:34]
The applicant shall ensure the buffer along the east side of the property
[29:37]
is heavily planted.
[29:39]
And three SRT reduced to 50 foot buffer along the reading road to 30 feet
[29:45]
in order to provide fire access along the east side of the property.
[29:50]
For applicants shall address the access separation on ladies on drive in the existing access to the adjacent property in the list.
[30:00]
That's one of his projects, his subject to the design review work.
[30:05]
You're going to have to book roll with residents, make sure they're sure.
[30:09]
The second, number four, that was number four.
[30:13]
That's the suggestion, perhaps, okay.
[30:17]
All right, motion's been made.
[30:19]
Second.
[30:21]
We've been properly made in second it.
[30:27]
All them people are up to motion.
[30:30]
Motion's been passed.
[30:32]
So, we guys have you, especially for me.
[30:39]
I don't know if you'll find you.
[30:41]
Yes sir.
[30:51]
I don't know mate.
[30:52]
Mike, we've around a couple of days.
[30:55]
Okay.
[30:55]
Okay.
[30:55]
Okay.
[31:11]
Okay.
[31:12]
Okay.
[31:15]
Okay.
[31:16]
Okay.
[31:17]
Okay.
[31:24]
Okay.
[31:26]
Okay.
[31:28]
Okay.
[31:28]
I'm going to take a look at the slide.
[31:30]
I can also take a look at the slide.
[31:35]
Just trying to see it straight out of that.
[31:37]
I understand.
[31:38]
We're going to.
[31:40]
I'm going to show you a little bit of the flow.
[31:41]
I'll take a plan.
[31:44]
You need even gentlemen.
[31:45]
My name is David Gaffs, working on gas when the associate's.
[31:47]
It's not been working with mine.
[31:49]
We were all this property for several years.
[31:51]
What is it about a 50 acre piece of property?
[31:54]
And off the very end of it, there's a five or six acre.
[31:57]
that's over there.
[31:59]
There's like a 20-foot strip of marsh.
[32:03]
We've got to get to five and six-acre track.
[32:06]
We've got all the permits.
[32:08]
We just got penetrated buffer to get to the bridge
[32:11]
of the integrals.
[32:13]
The county has recommended approval for five
[32:15]
of the American Districts.
[32:17]
If you got any questions, we're here today.
[32:19]
Thank you very much.
[32:35]
Staff recommends approval this request.
[32:37]
Again, it's a central access.
[32:38]
So I've gone out to the property personally,
[32:42]
not seeing any issue in the district or request,
[32:44]
just so I don't even have to stop to approve,
[32:48]
as you would say, the kind of decoded.
[32:52]
So this wouldn't have any effect on, well,
[32:54]
I guess I can act so, this is a gasp.
[32:58]
This bridge, it wouldn't have any effect on any,
[33:03]
if I don't know how, what's the depth, what five feet,
[33:07]
that that for this high time. You got to build high enough for the mark grass is it's literally
[33:11]
it used to be high ground. They kept driving track or ceiling into the development of a model.
[33:17]
So no one can really chop it. No, no, no, no. We have to go to the US to the Coast Guard to get a
[33:23]
brief permit. So they have agreed so we touched all the buttons. And it does affect navigation or
[33:32]
Thank you so much for any questions for anyone, guys.
[33:36]
We need to prolong it, I guess.
[33:41]
Any public comment?
[33:44]
No public comment right now too close.
[33:47]
Gentlemen, do you want to go ahead and just, since we have any more questions,
[33:51]
we want to just go ahead and make a motion on this?
[33:55]
I'll make a motion.
[33:56]
We have proved the special use permit with the conditions recommended by the SRT Fire
[34:06]
Marshal Approval and playing back for an entry's removed within the river buffer and any
[34:11]
disturbed area outside of the buffer.
[34:14]
Welcome to the main, seconded, seconded, closing the main, probably the main and seconded,
[34:19]
All in favor,
[34:23]
boys and fast.
[34:25]
We're going to go ahead and take a break.
[34:33]
All right.
[34:37]
I'm in the M10.
[34:39]
What's that?
[34:39]
Lennon investment, LLC, care of.
[34:43]
Law office, the Thomas C. Taylor.
[34:53]
Mr. Mark?
[34:54]
We need to gain out.
[34:55]
Thank you for letting me come off again.
[34:57]
This one I believe will be on a little bit shorter.
[35:00]
Our represent the LNL investments LLC. This is a proposed development of a new Kia dealership. It is going out on Cecil Reynolds Road, right off near where there is the existing tractor supply, and right out here the miracle mile already, O.C. and everyone else is out there. This is a zone C5RCMU or regional center mixed use.
[35:27]
We are here today because our 3.6 acre track, which is run in the shadow of the large
[35:34]
soil that was built by a CDOT when they built a giant intersection there, has caused
[35:40]
a non-natural wetland of form of about 0.889 acres, and we are here because we are making an
[35:48]
application for a hardship variance to allow us to fill up to one half of the acre of that wetland.
[35:54]
So, we can adequately have the footprint that is required for the standard key of the worship.
[36:01]
Mr. John Lee, who is here and who owns the worship, is right here, and he's come down from
[36:07]
Charlotte, Charlotte, or North Carolina, not Charlotte, and Ashley, or Charlotte.
[36:12]
Got it.
[36:12]
Be here today if there are any questions and I appreciate him coming down.
[36:17]
But this is staff endorsed, and it meets from our perspective,
[36:22]
of German all of the requirements for a hardship variance.
[36:26]
The main thing that I like talking about,
[36:28]
because it's so hot, is just to reinforce,
[36:31]
that this is not a natural wetland whatsoever.
[36:35]
There are no native species of anything in there
[36:37]
that staff or anyone else has said we need to protect
[36:41]
and the proposed to fill it in,
[36:43]
comes, of course, under the Corps of Engineers'
[36:46]
precedent where we will do alternative credits
[36:49]
for other wetlands projects in other areas.
[36:51]
And we would ask the board move forward with the granting of the hardship variance, please.
[36:57]
I think the staff will be in support.
[36:59]
When you say that it's not a natural wetland, so my understanding is when they built these other roads,
[37:06]
they caused such a condition that it became, it just filled in, because it was a low area.
[37:12]
I think literally, and I'm scared to let the engineer back up here, because I think you might say,
[37:16]
I'm about somebody who will throw up.
[37:19]
I'm an agent also.
[37:20]
I get, I understand, engineer.
[37:22]
So, the Giants, the giant swayal really, that was built in order to accommodate the on ramp coming from 178 towards 278 towards Elton here.
[37:32]
It just throws a whole lot of water down in that area on that side of the road.
[37:37]
I was amazed.
[37:38]
I was the one who went out and put up our red sign, one day during the rain and there was some substantial water there that day.
[37:44]
But it drains off very, very quickly.
[37:46]
And I guess my question is really before they built this road, yes, but it did not exist.
[37:53]
And then after they built the road, it didn't now exist.
[37:55]
It apparently so, I guess so.
[37:58]
But again, I want to reiterate, this is basically a commercial area where the county is, I think,
[38:04]
actually hoping that there will be more infill of commercial so that it doesn't bleed over
[38:08]
into the residential, because you have the big Marines, the big Matthews Marine there,
[38:13]
tractors, farmers, supply, and then the large tailors landscape all of which are right there.
[38:18]
We believe this will offer people from Sun City and all of Southern View for County, a good
[38:22]
opportunity to come in and shop at a K&D worship, which is really, very much needed in this
[38:27]
low country area. This shaded area is that the area that you are proposing to backfield. Yes, sir.
[38:33]
The shade is that 10 percent. Yes.
[38:37]
And it looks like parking is beyond net. So would that,
[38:42]
You don't, I guess that's not needed to be back filled.
[38:46]
I mean, lift the elevation of it.
[38:48]
Yes, sir, that is exactly right.
[38:50]
If it's not showing all this and being able to fulfill it, then.
[38:56]
There, I'll have to tell you what we're going to look at.
[39:01]
I'll hold you this if you wish.
[39:03]
This is another engineer who's lost.
[39:06]
I'm to the alert range with more than worth engineering.
[39:09]
So the blue area is...
[39:12]
Okay, let me get my battery straight.
[39:16]
So this, where you see the hatch with the little dots,
[39:19]
that's our wetland all the way.
[39:22]
And this black dash area is where we would like to fill.
[39:25]
The blue shaded area is what would only be 10%
[39:29]
which is allowed by the ordinance.
[39:31]
So we're requesting to fill this black dash area.
[39:36]
And what's beyond that, and this other side
[39:38]
with that will all remain, that's the buffer.
[39:41]
from 278 and 170 that were required to maintain.
[39:46]
Okay, so everything in the dark perimeter here is where you will be back fillet.
[39:54]
I apologize for that.
[39:55]
Yes.
[39:56]
And the blue is one we would only be allowed under the existing ordinance.
[40:04]
So, it's our intent to keep a 15 foot buffer from where we would disturb where those parking
[40:13]
stalls would be. It's our intent to have a 15 foot buffer and then it will be the natural wetlands
[40:19]
of that 15 foot and can break out and ensure that no disturbance would be beyond that.
[40:24]
Okay, so I guess that would be the whole half of an acre of 0.5 something.
[40:29]
Yes.
[40:30]
Okay.
[40:31]
The national permit allows you to put up to have an anchor in some of that is on that black
[40:38]
dash polygon is less than happening here.
[40:45]
I
[40:48]
have a question.
[40:51]
Obviously, that water has to go somewhere after you've filled this in.
[40:55]
Is it going to affect any other properties around this?
[40:58]
Yes, so what's actually going on in the reason why that went like formed is along to 78.
[41:05]
There's actually a rather more to ditch that goes down to the water along to 78.
[41:10]
And so this is actually a low spot that was formed when that ramp was built.
[41:16]
And so what will happen is that ditch will maintain in the right of way.
[41:20]
And so that water will just continue to where it naturally goes down.
[41:24]
And there's no other, this is like the end of the ditch.
[41:28]
So, it wouldn't back up water on the other properties.
[41:33]
So, looking at this image on the monitor there.
[41:40]
See that little wetland area on the top.
[41:43]
Is that the area we're talking about?
[41:46]
That's not the area we're talking about, right?
[41:48]
So, where your mouth is on the screen, it would be right here with this blue text is.
[41:54]
And then this would be where the majority of the wetland is kind of at that corner,
[41:59]
where he's going to write also in 170, but that's kind of where the majority of that one is.
[42:06]
So I believe what happened was when they built the ramp, there was a significant amount of dirt
[42:11]
that brought that up to higher elevation, and then there's runoff from that now.
[42:15]
Right.
[42:16]
Yeah, there's in that area.
[42:17]
And then you would still have sufficient drainage where that little pond is or whatever.
[42:25]
As you build up your property, it will still be doing a jerry at there.
[42:32]
And I understand now where you say that that was not a wet land previously to the
[42:38]
ramp being built.
[42:40]
And there's also a significant ditch along a piece of railroads that runs all the way down towards
[42:45]
Matthews Marina.
[42:46]
So we have ditches on both sides of our property that train all the roadways away
[42:52]
one
[42:56]
more question please. I take the stormwater folks are good with all this. Yeah, that's okay.
[43:04]
My job and survey has been done. There are no species of wildlife that are critical to this property.
[43:18]
All right.
[43:22]
I don't know if there's any more proposals to that,
[43:29]
but he has the spirit.
[43:30]
Yeah, I mean, from a more revealed perspective professionally, I think this is a textbook case of what you'd have to do in order to help meet all four requirements for hardship.
[43:44]
You have roads on three sides of this property. You have existing parcels.
[43:50]
You have a natural occur in condition that occurs that was not the making of the applicants.
[43:57]
Thought we think the disturbance and the relief is minimal and is the exact amount necessary to carry out the development of the property.
[44:07]
So all of those things satisfy all the requirements of unique conditions, unnecessary hardship,
[44:14]
applying to just this particular piece of property, the applicant, did not create their own
[44:19]
hardship.
[44:21]
So we think relief was warranted and also, you know, I've got some concern about, you know,
[44:28]
the 10 percent, you know, you can only disturb 10 percent.
[44:32]
Well, what is that number based on?
[44:34]
So that plot gives me a little bit of polish for concerned.
[44:36]
That's one of the reasons why we supported the request.
[44:40]
So, you know, there's really no magic number.
[44:42]
is to 10% as appropriate, but 11% or 12% or 15% is it because that's just too much, so
[44:49]
you know, it's just a lot of trees. And we support it. We recommend it to people
[44:54]
as you appreciate your treatment. They've been waiting for several months for this.
[45:00]
Thank you. Would I be able to see the plot that you were just holding up there a few minutes ago?
[45:11]
I'm just wondering where your access will be to the dealership.
[45:20]
to the dealership, let's see.
[45:25]
So we're proposing, with this rendering,
[45:29]
two active points along these over and over.
[45:32]
OK.
[45:34]
You visualize the feeling of having to be oriented this way.
[45:37]
This would be kind of where you drop off
[45:40]
for a service area.
[45:41]
And then this would be your main entry here.
[45:45]
I'm actually, I'm sorry, I've seen that your main entry
[45:49]
to be here and the business is their secondary injury and that's a requirement for the
[45:53]
fire on access to that secondary injury.
[45:58]
I am familiar with this area because I live not far from here,
[46:02]
so that was my concern
[46:04]
because that entrance ramp or that entrance ramp on to 278 off of Okatee Highway is
[46:11]
correct, right, and that's, and this is at the bottom that's Taylor's landscaping is
[46:17]
correct? Right. So Taylor is actually adjacent. Right. So just to the lower right of that,
[46:27]
the southeast of that. Yep. Okay. Yep. And the SDOT is reviewed all this to make sure that
[46:38]
you're okay for access. And the preliminary stages, but yes, we would have to go to the
[46:45]
and when designing the layout, we make sure we have direct
[46:48]
with separation requirements.
[46:51]
I would say that would be a condition that I would have
[46:54]
make sure that SCDOT is good with that all out.
[46:58]
We would welcome that.
[47:06]
Any public comments?
[47:12]
Public comments is closed, gentlemen?
[47:16]
Guys ready to make a motion on this.
[47:25]
Anyone of you guys?
[47:27]
I don't have to take it to have conditions on it.
[47:29]
I'll go ahead and make a motion.
[47:30]
I got it.
[47:31]
I'll go ahead and make a motion.
[47:33]
Do we approve the variance?
[47:35]
With the condition that the Harvey Corps
[47:37]
Benjamin here standards for wetlands,
[47:40]
disturbance, slash mitigation,
[47:41]
be complied with, and also,
[47:44]
South Carolina DOT for the access,
[47:48]
against the driveway.
[47:51]
The motion has been made.
[47:54]
Second.
[47:54]
The meeting is seconded.
[47:55]
All in favor?
[47:59]
Motion has been passed.
[48:03]
You guys can move forward.
[48:04]
and get your key of project code.
[48:09]
Yes sir,
[48:16]
any old business,
[48:23]
new business,
[48:25]
election, I guess we can't do the election,
[48:27]
I guess we need to wait until Mr. Williams return it.
[48:30]
Hopefully at our next meeting, we will be able to do the election,
[48:34]
and I will be in this hot seat.
[48:37]
I have one announcement review on this to make sure
[48:40]
a layer of what's going to occur at your activity, at your July meeting, we will be hearing
[48:48]
the vape point, item special use request. We will not be holding that meeting in this
[48:56]
green. Our projected plan right now is to hold it at the land brown facility down in town in
[49:05]
the gym there, but we'll be providing you instructions on that and setting that up as we
[49:11]
progress more into it. But we will be doing a big point in July. There will be the
[49:16]
element in seating for the public. It will be posted on Facebook Live for comments there
[49:23]
potentially, but we're working out those fine details. I just wanted you all to know that
[49:27]
it will not be in this room and there will be a special meeting location. So pay attention
[49:32]
So that one might send out the agenda.
[49:34]
Is that the only item on the other, that agenda?
[49:37]
Oh, the thing we got a couple more.
[49:39]
I do expect that public hearing to be quite linked.
[49:42]
So, yeah.
[49:43]
Just prepare yourself for that, okay?
[49:48]
All right, anymore.
[49:50]
Thanks.
